Welcome to our spring Interiors sale! This month we bring you a varied selection of items, from a chest of drawers painted with Marilyn Monroe, to a collection of 20th century model cars! We also have various private collections on sale this March, from Richardsons in Yorkshire (page 18), as well as the property of Francis Menotti, previous resident of Yester House, in East Lothian (page 33). Highlights of these collections include an extended ebonised and gilt dining table from Richardsons, and an antique marble fireplace once housed at Yester. Included in our paintings section of the sale are an interesting private collection of Irish oils and watercolours too. Pictures comprise of landscape and coastal scenes by prolific painters such as Belfast born artists William Conor and Maurice Canning Wilks, as well as Fergus O’Ryan and Norman McCaig. Turn to pages 46 and 47 for our ‘Showcase’ review of Royal Worcester Porcelain, which details the history and production of this famous English factory, illustrated by the selection of pieces we have available for sale this March. This month our sale commences with our paintings section, before moving to our works of art, furniture and rugs and carpets. Unlike our last two Interiors auctions, this will be a single day sale, on Saturday 29th March, commencing at 10am. Highlights from the Sale Private Collection of Irish Paintings This month our sale features a variety of 19th-20th century Irish oil and watercolour paintings, including the works of well-known exhibiting artists such as Fergus O’Ryan, Norman McCaig, Desmond Carrick and Clare Cryan. Pictures comprise of landscapes, seascapes, and city scenes, where the influence of home and abroad is clearly visible in many of these impressionist-inspired works. Highlights of the collection include an oil depicting bathers at the sea by James Le Jeune, Charles Joseph MCaughley’s fishermen, and a female portrait by William Conor.

Property removed from Richardsons, Yorkshire Richardsons, a red brick house in an idyllic English country village, was for a number of years the home of Rupert Forbes Adam, grandson of Sir Oswald and Cynthia Mosley (nee Curzon). He was man interested in the arts and tended to be the ‘depository’ for family items from past relatives. This March we are proud to present various pieces from the Yorkshire property, including pictures, ceramics, European and Asian works of art and furniture. Highlights include an Anglo-Indian watercolour of an owl and a large aesthetic style ebonised dining table.
Page 18 Private Property of Francis Menotti Philadelphia-born Francis Menotti was both an actor and figure skater, having studied at the Goodman Theatre in Chicago and appearing in operas as a mime during the 1960s. He was also the president and artistic director of Festival dei Due Mondi, founded by his father Gian Carlo Menotti in 1958. In 1985, following his marriage to Malinda Fitler Murphy, the daughter of Mrs Nelson Rockefella, Francis was gifted Yester House in Gifford, as a celebratory present, where he lived until last year. It is with great pleasure, therefore, that Lyon & Turnbull present various pieces from this private collection, including an impressive marble fireplace and a continental giltwood and gesso mirror, both previously housed at Yester.

Specialist’s Choice This month Sara Pierdominici from our Asian and Fine Antiques department chooses her favourite things from our March Interiors sale.
Staffordshire Hen Tureens Easter is coming up and this lot will be the perfect addition for your Easter Sunday table! They are colourful, but also functional, and therefore the perfect way in which to serve your vegetables and to decorate your home in an original manner. In this way, Lot 419 they demonstrate how antique pieces still have a popular place in the modern household too. As Staffordshire pieces, these tureens represent a long history of ceramic production, which began life in this prolific centre as early as the 17th century, reaching the peak of manufacture in the 19th century, when these examples were made. Hen tureens were popular in the Victorian period and these examples have survived in good condition. The hens modelled on their baskets with their eggs symbolises the upcoming Easter period, with links to both Christianity and the joys of spring. I therefore can’t imagine a better way to serve and enjoy the bountiful Easter Sunday meal than with these characterful tureens!
Carved elm tables by Ian Hunter, Linthill Studio One of my favourite pieces of furniture in the March Interiors sale is this uniquely carved wooden table. Ian Hunter, of Linthill Studio in the Scottish Borders, produces these works of art from traditional Scottish woods including sycamore, ash, elm and yew. I like the warm yet rugged look his tables have, and their unusual, natural shapes. The flower shaped tilt-top table (lot 341) is a great creative take on the traditional and antique model, and I think the additional frog shaped sections to the top surface of this dining table are great fun too. Indeed, animal carvings, sculptures, and paintings are a speciality of Ian’s, which he has arguably Lot 207 mastered with great skill. These are unique, individual pieces and I can just picture these tables in a country house, covered in delicious food and surrounded by friends and family.
My favourite painting in the sale is Desmond Carrick’s ‘Heat Shimmer on Burriana Beach, Nerja’, which depicts figures bathing and relaxing on the beach of the famous Costa del Sol, Spain. The artist is a most interesting figure, with an unusual and inspiring career, having worked in the Guinness brewery for many years while attending evening classes at the National College of Art before becoming a well-known and active member of the Royal Hiberian Academy. I love Carrick’s style in conveying the glimmering effect of the heat with brushstrokes in different shades of blue and red. I think this effect is most evident in the sea that shines in the summer sun. The bathers wear light and colourful robes and their white hats stand out against their tanned skin and slim figures. This seems to me the quintessential representation of summer, and is reminiscent of many past summers I have spent at home in the warm Italian sun. 5

49§ SV60/23 FERGUS O’RYAN R.H.A. (IRISH 1911-1989) PARISIAN STREET SCENE Signed, oil on canvasboard 34cm x 45cm (13.5in x 17.5in) Note: Born in Limerick, Fergus O’Ryan was one of the major Irish artists of the 20th century. After studying at the Limerick School of Art he moved to Dublin where he attended the Dublin Metropolitan School of Art. In 1938 he first exhibited at the Royal Hibernian Academy and kept exhibiting there nearly every year until 1984, becaming a full RHA member in 1960. O’Ryan’s work is firmly rooted in Ireland, depicting its wild landscapes as well as its busy urban scenes and industrial settings. His style varies from impressionistic strokes to highly-finished details. Particularly noteworthy is his ability to evoke the transparency and reflective qualities of water using it as a feature of the foreground. The many holidays spent in France and Germany before the Second World War left a European taste to his work which could be seen in his market scenes.

MCCAIG (IRISH 1929-2001) HARVEST TIME Signed, signed and inscribed on stretcher, oil on canvas 46cm x 36cm (18in x 14in) Note: Born in Bangor, county Down, he came from an artistic background and was interested in painting from his school days. After studying at Belfast Collage of Art, he travelled to Paris to Academy of Art Vavin where he became good friends and exhibited in 1948 with fellow Irish Joseph Sefton, set designer for Edith Piaf. He is mostly known for his landscapes, seascapes and harbour scenes where he uses rich colours applied liberally to achieve an atmospheric and dramatic effect. He was also a very accomplished pianist and played in many of Belfast nightspots.

Note: Born in Dublin, for nearly thirty years Desmond Carrick worked in the laboratory of the Guinness brewery following his father’s footsteps. Despite this career he was able to pursue his passion for art through evening classes at the National College of Art. In 1951 he was commissioned to paint a mural in the Guinness visitors’ centre in St. James’ Gate and in the same year gathered recognition as a painter when he exhibited at the Royal Hibernian Academy for the first time. In 1968 he was elected full member of the RHA and became one of its most eminent and active members, serving as Secretary until 1982. A trip to Spain in the 1950s ignited a lifelong passion for light and colour which he reversed in his Irish and Spanish country scenes. He worked with a wide varierty of media, including litography and stained glass, although he is best known for his oils and watercolours characterised by a strong impressionist style. His work is represented in private collections in the USA, Europe, Australia and New Zealand.
Note: Le Jeune was born in Canada to a French/English father, a musician, and an Irish mother. His great uncle was the English Victorian painter Henry Le Jeune. He grew up in Dinard, Brittany and later in Northampton in England. During his artistic training he attended art schools in Paris, New York and London, mainly focusing on Architecture. When World War II broke out, he served in the British Army in Tunisia and Italy where he worked as an engineer with Bailey bridges and also did a lot of sketching and watercolours. Despite becoming an architect after the war, he never lost his passion for painting and in 1948 exhibited at the Royal Insititue of Oil Painters. From 1950 he settled in Ireland with his wife in County Wicklow first and then in Dublin where he stayed until his death. Deciding to paint full-time, in 1951 Le Jeune began exhibiting at the Royal Hibernian Academy where he became a regular exhibitor for the next 31 years and a full RHA member in 1973. During the 1960s, he opened another studio in New York and spent some years travelling between the two cities. He is best known for his portrait, landscapes and seascapes.

Note: Liam Treacy was born in Avoca, County Wicklow where he lived all his life. it was not until the 1950s that he started painting while confined to bed recovering from tubercolosis. During this time at the hospital he was introduced to the sculptor Yann Renard Goulet who taught him everything he knew about painting and drawing and about Claude Monet in particular, who was to influence Treacy’s work more than any other artist. By 1956 Treacy was painting en plen air around his beloved Wicklow county and started developing a distinctive impressionist style. His luminous work reflected the moods and colours of the constantly changing familiar Irish countryside. He exhibited for the first time in 1956 and soon many other shows followed in galleries across Ireland and abroad. Despite his success as a painter he never focused on a professional artistic career until 1978 when he decided to become a full time artist. Thoroughtout his life Treacy taught art in night-time classes in Arklow Community College, Abbey Community College, Wicklow and at Shelton Open Detention Centre where he held art classes for the prisoners until 1995.
Note: Born in Dublin, Clare Cryan studied painting at the National College of Art and the Belfast College of Art. Known as a visual artist, she is also one of the country’s most noted art teachers and many of her students have made significant contribution to Irish painting. In 1971, after 4 years as Master of the Preliminary School of the NCA she founded the Blue Door Studio in Ballsbridge. Inspired by the wild landscapes of Connemara, Cryan’s work is characterised by a brilliance of colour and a poetic sensibility which have resulted in many successful exhibitions in Ireland and abroad. Her paintings have been shown regularly in the Royal Hibernian Academy, the National Watercolour Society London and the Royal Institute of Painters in Watercolour as well as in galleries in Brussels, Paris, Antwerp and Luxembourg. In 1990 the then President of Ireland Patrick Hillery presented one of her pictures as a state gift to Queen Beatrix of the Netherlands.

Born in a rural village where farming was the main source of income, he nurtured a deep love for painting ever since he was a child. In 1919 at a local Feis he met the painter James Humbert Craig who recognised his talent and encouraged his artistic career. Despite a brief period of study at Belfast Art College and Glasgow College of Art, he was largely self-taught, his interests spanning from art to poetry, writing, classical and opera music. An exeptionally prolific artist, McAuley never sought public recognition. His life was conducted in the rather secluted pastoral environment of the Glens, where he painted the nature around him. Rivers, glens, mountains and seascapes feature his oils and watercolours in a richness of tones and movements that became McAuley’s trademark. In these idyllic scenes people are depicted in their daily rural lives with humor and tenderness in an attempt at expressing the slow-paced life of the countryside. His work became known thorugh word of mouth rather than self-promotion. The fact that several of his paintings are now both in private and public collections is significative of how extraordinary and admired his art has become.

His most flourishing period was between 1933 and 1940 when he held many exhibitions at the Royal Hibernian Academy in Dublin, as well as in Belfast, London, Boston, Montreal and Toronto. When only 19 he won the Dunville Scholarship which allowed him to study full time at the Belfast College of Art. After college, he moved to Cushenden, a village on the Antrim coast and became a professional fine artist. His paintings and watercolours typically feature the landscapes of the northern and western counties of Ireland, although he always had a special connection with the mountains, valleys and bog islands of Donegal and Connemara. This watercolour is a fine example of Wilks’ style and subject matter. Loose fluid brushstrokes perfectly capture the romantic spirit of a bright sunny day in a rural village of Connemara.

After this prolific period, she went back to her family home in Kilkenny where she spent the rest of her life painting the gardens, farmyards, plants, birds and animals of her beloved county. Her work now hangs in major galleries in Ireland and England.

His origins strongly influenced his artistic life and inspired him many portraits of the working-class life in Ulster for which he is stil highly celebrated today. When he was ten, his music teacher recognised his talent and helped him entering the Belfast College of Art. Immediately after school he worked as a commercial artist but was soon enlisted by the British government as an official war artist during the First World War. In 1920 Conor moved to London and there a flourishing period of his artistic career began. He met and became good friends with Sir John Lavery and Augustus John and started exhibiting at the Royal Academy. He was also the first Irish artist to gain membership to the Royal Institute of Oil Painters. He remained faithful to his favourite subject: the people and street life of the industrial Belfast, which he always depicted with a warm and sympathetic approach. Between 1918 and 1967 he exhibited nearly 200 works at the Royal Hibernian Academy of which he became full member in 1946. Further honours followed: the Order of the British Empire in 1952 and President of the Royal Ulster Academy in 1957. More than 50 watercolours are held now in the permament collections of the Ulster Museum.

It was later made popular by a play in six acts based on his life, L’Aiglon, written by Edmond Rostand in 1900 and performed by Sarah Bernhardt. Dying of tubercolosis at the premature age of 21, Franz led a rather unfortunate life. The son of Napoleon I and his second wife, Archiduchess Marie Louise of Austria, he inherited by birth the titles of Prince Imperial, King of Rome and Prince of Parma. However he never got the chance to actually rule France as the coalition partners that deafeated Napoleon refused to acknowledge his succession rights. Soon after his father abdicated in 1815, the four-year-old Franz was forced to abdicate himself and spent the rest of his short life in Austria with his mother. The Austrian artist Franz Gaul, known for political caricatures and humorous pictures of theatre actors, captured the young Emperor the year of his death.

256 FF965/1 SEYMCHAN part slice 94g Provenance: Lucy Cullen Collection Note: Seymchan (Magadanskaya obalst’, Russia) Pallasite (stony-iron) - found 1967 A beautiful pallasite originating from deep within an asteroid. The original mass of this meteorite was found in the bed of a stream flowing into the River Hekandue, a tributary of the Jasachnaja. Further expeditions to the area yielded more finds; some discoveries being true pallasites with their roughly 50:50 mix of olivine and iron, while others were comprised entirely of iron. The Seymchan slice offered here is the pallasite type, revealing olivine (peridot) crystals surrounded by a web of iron. This exquisite specimen has been cut extremely thinly, maximising the surface area to weight ration. When backlit, this stunning meteorite gives the appearance of an extra-terrestrial stained glass window. Approximate dimensions: 212 x 113mm

Showcase: Royal Worcester Porcelain Lots 381 to 386 in this month’s sale are all pieces produced by the ceramics factory Royal Worcester Porcelain. Encompassing a range of dates and designs, these pieces are evocative of the company’s history, style and manufacture, and today, they continue to symbolise one of England’s longest running and best loved porcelain factories. Originally founded in 1751, the Worcester Porcelain Company was set up by Dr John Hall, and quickly became England’s finest porcelain producer. The factory used a ‘soaprock’ recipe which prevented cracking

under the thermal pressure of boiling water, unlike their rival porcelain manufacturers. This development and increased excellence in the company’s wares did not go unnoticed, and in 1807 the factory was granted its royal warrant by George III and was later named Royal Worcester Porcelain in 1862. The shapes and decorations used by Royal Worcester Porcelain were influenced by interior fashions of the period and foreign items imported through trade, with Japanese style and design playing a significant role. The factory produced heavily

decorative and ornate pieces during the late 19th century, but accommodated for more demure tastes during the early 20th century as heavy, historical designs were abandoned throughout fashion, in favour of a more organic natural style. Around 1900, the factory painters were permitted to sign their work for the first time. They were also encouraged to specialise and develop individual styles which allow us to recognise various artists’ work today. Harry Stinton, for example, regularly painted highland cattle, while James Stinton tended to portray game birds. Artists took inspiration from the factory’s large resource library and mainly painted landscape, wildlife and still life subjects. Today Royal Worcester is owned by Portmeirion Pottery Group, after the brand was purchased in 2009. The company had been merged in 1976 with Spode, but finally closed its doors, after 200 years of production, in November 2008.

All bought items will be held free of charge at Lyon & Turnbull until the Friday following the sale.
To get your purchases home in perfect condition you may wish to employ the services of a restorer.
Thereafter lots will be removed to store in Edinburgh and a charge incurred.
Restoration may not be as expensive as you think and Lyon & Turnbull are able to recommend restorers of Pictures, Frames, Ceramics, Furniture and Metalwork; Upholsterers and Framers.

Standard Terms & Conditions of Sale Lyon & Turnbull carries on business with bidders, buyers and all those present in the auction room prior to, or in connection, with a sale on the following General Conditions and on such other terms, conditions and notices as may be referred to herein. 1. DEFINITIONS In these Conditions: (a) “Auctioneer” means the firm of Lyon & Turnbull or its authorised auctioneer, as appropriate; (b) “deliberate forgery” means an imitation made with the intention of deceiving as to authorship, origin, date, age, period, culture or source but which is unequivocally described in the catalogue as being the work of a particular creator and which, at the date of the sale, had a value materially less than it would have had if it had been in accordance with the description; (c) “hammer price” means the level of bidding reached (at or above any reserve) when the auctioneer brings down the hammer; (d) “terms of consignment” means the stipulated terms and rates of commission on which Lyon & Turnbull accepts instructions from sellers or their agents; (e) “total amount due” means the hammer price in respect of the lot sold together with any premium, Value Added Tax chargeable and any additional charges payable by a defaulting buyer under these Conditions; (f) “sale proceeds” means the net amount due to the seller, being the hammer price of the lot sold less commission at the stated rate, Value Added Tax chargeable and any other amounts due to us by the seller in whatever capacity and however arising; (g) “You”, “Your”, etc. refer to the buyer as identified in Condition 2. (h) The singular includes the plural and vice versa as appropriate. 2. BIDDING PROCEDURES AND THE BUYER (a) Bidders are required to register their particulars before bidding and to satisfy any security arrangements before entering the auction room to view or bid; (b) the maker of the highest bid accepted by the auctioneer conducting the sale shall be the buyer at the hammer price and any dispute about a bid, which must be raised before the next lot is offered, shall be settled at the auctioneer’s absolute discretion. (c) Bidders shall be deemed to act as principals. (d) Once made, no bid may be withdrawn. (e) Our right to bid on behalf of the seller is expressly reserved up to the amount of any reserve and the right to refuse any bid is also reserved. 3. INCREMENTS Bidding increments shall be at the auctioneer’s sole discretion. 4. THE PURCHASE PRICE
Under new legislation which came into effect on 1st January 2012, this applies to living artists and artists who have died in the last 70 years. This royalty will be charged to the buyer on the hammer price and in addition to the buyers premium. It will not apply to works where the hammer price is less than €1,000 (euros). The charge for works of art sold at and above €1,000 (euros) and below €50,000 (euros) is 4%. For items selling above €50,000 (euros),charges are calculated on a sliding scale. All royalty charges are paid to the Design and Artists Copyright Society (‘DACS’) and no handling costs or additional fees are retained by the auctioneer. Resale royalties are not subject to VAT. Please note that the royalty payment is calculated on the rate of exchange at the European Central Bank on the date of the sale. More information on Droit de Suite is available at www.dacs.org.uk. 7. PAYMENT (1) Immediately a lot is sold you will: (a) pay to us the total amount due in cash or in such other way as is agreed by us. We accept cash, bank transfer (details on request), Switch or Debit Cards and Visa or MasterCard (please note there is a surcharge of 2% (VAT included) when using credit cards). We do not accept American Express. (2) any payments by you to us may be applied by us towards any sums owing from you to us on any account whatever without regard to any directions of you or your agent, whether express or implied. 8. TITLE AND COLLECTION OF PURCHASES (1) The ownership of any lots purchased shall not pass to you until you have made payment in full to us of the total amount due. (2) You shall at your own risk and expense take away any lots that you have purchased and paid for not later than four working days following the day of the auction or upon the clearance of any cheque used for payment after which you shall be responsible for any removal, storage and other associated charges. (3) No purchase can be claimed or removed until it has been paid for. (4) It is the buyer’s responsibility to ascertain collection procedures, particularly if the sale is not being held at our main saleroom and the potential storage charges for lots not collected by the appropriate time. 9. REMEDIES FOR NON-PAYMENT OR FAILURE TO COLLECT PURCHASES (1) If any lot is not paid for in full and taken away in accordance with these Conditions or if there is any other breach of these Conditions, we, as agent for the seller and on their behalf, shall at our absolute discretion and without prejudice to any other rights we may have, be entitled to exercise one or more of the following rights and remedies: (a) to proceed against you for damages for breach of contract;
The buyer shall pay the hammer price together with a premium thereon.
(b) to rescind the sale of that lot and/or any other lots sold by us to you;
25% up to £25,000 / 20% thereafter.
(c) to resell the lot (by auction or private treaty) in which case you shall be responsible for any resulting deficiency in the total amount due (after crediting any part payment and adding any resale costs). Any surplus so arising shall belong to the seller;
VAT will be charged on the premium at the rate imposed by law. 5. VALUE ADDED TAX Value Added Tax on the hammer price is imposed by law on all items affixed with an asterisk (*) or dagger (†). Value Added Tax is charged at the appropriate rate prevailing by law at the date of sale and is payable by buyers of relevant lots. 6. DROIT de SUITE This symbol § indicates works which may be subject to the Droit de Suite or Artist's Resale Right, which took effect in the United Kingdom on 14th February 2006. We are required to collect a royalty payment for all qualifying works of art.
(d) to remove, store and insure the lot at your expense and, in the case of storage, either at our premises or elsewhere; (e) to charge interest at a rate of 1.5% per month above the current base rate on the total amount due, to the extent it remains unpaid for more than four working days after the sale; (f) to retain that or any other lot sold to you until you pay the total amount due; (g) to reject or ignore bids from you or your agent at future auctions or to impose
conditions before any such bids shall be accepted; (h) to apply any proceeds of sale of other lots due or in future becoming due to you towards the settlement of the total amount due and to exercise a lien (that is a right to retain possession of) any of your property in our possession for any purpose until the debt due is satisfied. (2) We shall, as agent for the seller and on their behalf pursue these rights and remedies only as far as is reasonable to make appropriate recovery in respect of breach of these Conditions 10. THIRD PARTY LIABILITY All members of the public on our premises are there at their own risk and must note the lay-out of the accommodation and security arrangements. Accordingly neither the auctioneer nor our employees or agents shall incur liability for death or personal injury (except as required by law by reason of our negligence) or similarly for the safety of the property of persons visiting prior to or at a sale. 11. COMMISSION BIDS While prospective buyers are strongly advised to attend the auction and are always responsible for any decision to bid for a particular lot and shall be assumed to have carefully inspected and satisfied themselves as to its condition we shall if so instructed clearly and in writing execute bids on their behalf. Neither the auctioneer or our employees or agents shall be responsible for any failure to do so. Where two or more commission bids at the same level are recorded we reserve the right in our absolute discretion to prefer the first bid so made. 12. WARRANTY OF TITLE AND AVAILABILITY The seller warrants to the auctioneer and to you that the seller is the true owner of the property consigned or is properly authorised by the true owner to consign it for sale and is able to transfer good and marketable title to the property free from any third party claims. 13. AGENCY The auctioneer normally acts as agent only and disclaims any responsibility for default by sellers or buyers. 14. TERMS OF SALE The seller acknowledges that lots are sold subject to the stipulations of these Conditions in their entirety and on the Terms of Consignment as notified to the consignor at the time of the entry of the lot. 15. STANDARD VENDOR FEES AND CHARGES (Subject to VAT) (1) Commission: 15% of the first £3000 and 10% thereafter is charged on the selling price of each lot (subject to a minimum charge of £30). Loss and damage warranty: 1.5% on value of lots sold. Photography: max £40 mono per lot, max £250 colour. Internet Marketing Service: £10 per lot. (2) If a vendor wishes to withdraw a lot organized for sale, a withdrawal fee will apply; (a) If withdrawn over 28 working days prior to the sale, this will be charged at 10% of the mid estimate along with any ancilliary incurred (such as photography), all subject to VAT at the current rate. (b) If withdrawn within 28 working days of the sale, this will be charged at 20% of the mid estimate along with any ancilliary incurred (such as photography), all subject to VAT at the current rate. (3) Aftersales: We reserve the right to accept an after-auction offer on a lot on behalf of the vendor, at the agreed reserve price or above, for up to 48 hours after the original auction. 16. DESCRIPTIONS AND CONDITION (1) While we seek to describe lots
accurately, it may be impractical for us to carry out exhaustive due diligence on each lot. Prospective buyers are given ample opportunities to view and inspect before any sale and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description applied to a lot. Prospective buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. We undertake that any such opinion shall be honestly and reasonably held and accept liability for opinions given negligently or fraudulently. Subject to the foregoing neither we the auctioneer or our employees or agents or the seller accept liability for the correctness of such opinions and all conditions and warranties, whether relating to description, condition or quality of lots, express, implied or statutory, are hereby excluded. This Condition is subject to the next following Condition concerning deliberate forgeries and applies save as provided for in paragraph 6 “information to buyers”. (2) Private treaty sales made under these Conditions are deemed to be sales by auction for purposes of consumer legislation. 17. FORGERIES Notwithstanding the preceding Condition, any Lot which proves to be a deliberate forgery (as defined) may be returned to us by you within 21 days of the auction provided it is in the same condition as when bought, and is accompanied by particulars identifying it from the relevant catalogue description and a written statement of defects. If we are satisfied from the evidence presented that the lot is a deliberate forgery we shall refund the money paid by you for the lot including any buyer’s premium provided that (1) if the catalogue description reflected the accepted view of scholars and experts as at the date of sale or (2) you personally are not able to transfer a good and marketable title to us, you shall have no rights under this condition. The right of return provided by this Condition is additional to any right or remedy provided by law or by these Conditions of Sale. GENERAL 18. We shall have the right at our discretion, to refuse admission to our premises or attendance at our auctions by any person. 19 (1) Any right to compensation for losses liabilities and expenses incurred in respect of and as a result of any breach of these Conditions and any exclusions provided by them shall be available to the seller and/or the auctioneer as appropriate. (2). Such rights and exclusions shall extend to and be deemed to be for the benefit of employees and agents of the seller and/or the auctioneer who may themselves enforce them. 20. Any notice to any buyer, seller, bidder or viewer may be given by first class mail in which case it shall be deemed to have been received by the addressee 48 hours after posting. 21. Special terms may be used in catalogue descriptions of particular classes of items (Books, Jewellery, paintings, guns, firearms etc) in which case the descriptions must be interpreted in accordance with any glossary or guidance notes appearing in the catalogue. These notices and terms will also form part of our terms and conditions of sales. 22. Any indulgence extended to bidders buyers or sellers by us notwithstanding the strict terms of these Conditions or of the Terms of Consignment shall affect the position at the relevant time only and in respect of that particular concession only; in all other respects these Conditions shall be construed as having full force and effect. 23. Scottish law applies to the interpretation of these Conditions.
