CHAIR’S COLUMN ADAPTATION AND ANTICIPATION: OUR KEYS FOR CONQUERING CHANGE BY MICHAEL MANSPEAKER, CPA

I perform a lot of peer reviews, which means I get to meet with a lot of CPAs at other firms. Each meeting is a conversation, and each conversation is an eye-opener. We spend a lot of time talking about the obvious stuff — issues related to the implementation of professional standards, changes in the peer review process, and the Labor Department’s recent study on audit quality, for instance. When the peer review is over and we head out to dinner, though, the conversations head in a different direction. That’s when we discuss the issues that really concern CPA firms. Most of those issues revolve around (a) the availability of good staff and (b) keeping ahead of the rapid pace of change. That change comes in many forms — technological advances, generational differences, leadership gaps, legislative and regulatory disruption, and succession concerns, just to name a few. In fact, the biggest issues facing CPAs these days usually have nothing to do with the technical challenges of the profession. MACPA Executive Director Tom Hood holds a series of town hallstyle meetings with the association’s members each autumn and spring, and as part of those meetings, he asks members to name the issues that are keeping them up at night. 4 Being proactive instead of reactive Complexity 5 We’ve entered a new era in which the biggest issues of the day have nothing to do with the core competencies that have traditionally defined this profession. A

new era means we need a new playbook for outrunning the pace of change. That playbook is based on learning. As Tom likes to say, our success going forward depends on our ability to outlearn the pace of change. That’s easier said than done, though. How do we learn in an era when we’re facing more change, more chaos, and more information from more sources than ever? In my mind, it comes down to two things. The first is better information. Consider this quote from Google CEO Eric Schmidt: “Between the dawn of civilization through 2003, there were just five exabytes of information created. That much information is now created every two days.“ When I hear something like that, I immediately think our problem is information overload. Not true, says New York University professor Clay Shirky. Our real problem, he says, is filter failure. We need better filters that deliver to us only the information we find valuable and let us ignore all the rest. Those filters are available, by the way, in every social network we visit. So that’s the first thing we need – better information. The second thing we need is a new mindset — one that’s devoted to adaptation and anticipation. Adaptation is about crucial selfimprovement. It’s about embracing lifelong learning as a core competency. Author Warren Berger calls it “serial mastery,” while Fast Company editor Robert Safian prefers the term “Generation Flux.” Either way, it boils down to this: In an ever-changing and complex world, the most important skill we need to succeed going forward is the ability to learn new skills.

In a recent national survey, 76 percent of small business owners say their CPAs are not proactive, and 75 percent have changed firms because their CPAs are providing reactive services rather than proactive advice. Another recent survey found that only 8 percent of CFOs, controllers and management accountants say they are future-ready. Daniel Burrus, the MACPA and the Business Learning Institute want to change that. EXTINCTION IS NOT. THREE STEPS TO FUTURE RELEVANCE BY BILL SHERIDAN, CAE What does a 50-year-old theory about transistors and integrated circuits have to do with the future of accounting? Everything, as it turns out. In 1965, Intel co-founder Gordon Moore predicted that the number of transistors that could be placed on each square inch of an integrated circuit would double every year. He later revised that prediction, saying the doubling would take place every 18 to 24 months. In essence, Moore predicted that the speed and processing power of computers would double every year and a half to two years. Smart guy, that Gordon Moore. His theory – popularly known as Moore’s Law – has held true to this very day, and it has brought with it some incredible technological advances. •
Computers today are 130,000 times more powerful than they were in 1988.

The iPad Mini is as powerful as the world’s most powerful supercomputer was in 1985.
•
The iPhone 6 is 120 million times faster than the Apollo Guidance Computer – the machine that controlled the Apollo space flights in the late 1960s and early 1970s.
But Moore’s Law has given us more than just a slew of cool, new, shiny gadgets to play with. It is fundamentally changing nearly every job on the planet – yours and mine included. Need proof? Ask a doctor, or a journalist, or a recording industry executive, or whoever’s in charge of the U.S. Postal Service. The day will come, I swear to God, when filing a tax return – any tax return – will be a completely automated process. Regulators and lawmakers will undoubtedly want a say in how that shakes out, but the technology will be there to make it happen. Moore’s Law will see to it.
A DI SAPPEA R I N G P R O F E S S IO N? In fact, Moore’s Law is already leaving its imprint on the CPA profession.

NPR recently collaborated with Carl Benedikt Frey and Michael A. Osborne, authors of a white paper titled “The Future of Employment: How Susceptible Are Jobs to Computerization,” to produce a guide that estimates the probability that certain occupations will be automated within the next 20 years. Among their startling findings: Tax preparation has a 98.7 percent chance of being automated within the next two decades. Accounting and auditing clock in at 93.5 percent. The editors at Fast Company agree. A recent article about the future of work included a sidebar titled “Top Jobs Today That May Disappear By 2025.” Accountants are included on that list. “Any professional that is mainly involved in dealing with information is going to be replaced by algorithms and (artificial intelligence),” futurist Graeme Codrington told Fast Company. Corporate finance is taking a hit, too. In “The New Bookkeeper is a Robot,” Wall Street Journal Senior Editor Vipal Monga reports that since 2004, automation has driven the number of full-time finance employees down by 40 percent. For whitecollar finance workers like accountants, accounts-payable and -receivable clerks, and inventory-control analysts, life as they know it has changed. Many of them have lost their jobs. Those who are lucky enough to work for future-focused organizations, however, have seen their jobs transformed, not eliminated, by technology. They have moved from data management to data interpretation, using the data to tell the story of their businesses and pave the way for future success. In fact, Monga writes that Wolters Kluwer “is hiring more analysts to help sift its data on profits, revenue and cash flow to help in planning and forecasting.”
TRANSFO RMATIO N: A NEW C O MP E TITIVE AD VANTAGE This type of career reorientation will be absolutely essential to our profession’s continued relevance. The key question each of us must ask is this: How will I continue to add value and relevance to my clients’ lives in a changing and complex world that threatens the very future of my job? STATEMENT
One thing is certain: We won’t find the answer by adhering to the same tired, stale, outdated business models that we’ve been following for decades. In the words of futurist and leadership expert Emmanuel Gobillot, “What got you here won’t get you there.”
Think about it: If Moore’s Law is transforming every job on the planet, we must transform as well. We must relearn what it means to be valued, relevant and trusted. That means having the foresight to know how our jobs are changing and being able to change along with them.
In fact, the ability to create and transform business models likely will be a key differentiator for CPAs going forward. In the Journal of Accountancy article “Models of Success,” Adrian Simmons, a CPA and chief creative designer with Elements CPA LLC, said business model design “is going to become a strategic skill that will become a competitive advantage. CPAs who have a comfort level playing with business models will be the ones who succeed.“
Put another way, to paraphrase Fast Company Editor Robert Safian: The most important skill any of us will possess going forward is the ability to learn new skills.
Jason Blumer puts it more bluntly. The chief innovation officer at Blumer CPAs says building the firm of the future starts with two steps:
1. “Blowing crap up,” which he defines as “the art of saying no to the majority.” It’s a definition grounded in a quote from Mark Twain: “Whenever you find yourself on the side of the majority, it is time to pause and reflect.”
2. “Making crap up,” which Blumer says centers on this question: “What is the new thing I want to create?”
2 . B ECOME EA RLY A DOPTERS “Early adopters eat the late,” says Andy Lark, a vice president of marketing at the accounting software company Xero. That’s especially true in a world where technology is advancing at an exponential pace. The problem, as a general rule, is that CPAs are notoriously late adopters. That has to change. “Our job,” says Reggie Henry, chief information officer for the American Society of Association Executives, “is to make the future more comfortable for our members.” He was speaking of associations at the time, but I believe those words apply to CPAs as well.
“This stuff won’t kill you,” Blumer told the crowd at the futurefocused Xerocon 2015 in Denver. “It means you can have the firm you want.”
Our clients and customers are just as perplexed by the pace of change as we are. They, like we, need help making sense of it all. Imagine how valued and relevant CPAs will be if they are the ones who provide that guidance.

Doing so means figuring out the new stuff before anyone else does. What works? What’s valuable? Where do the opportunities lie? The first step is to learn these things on our own. The next step is to help our clients learn them.
Doing these things – building the firm you want, designing new business models, remaining relevant in an era of great change and complexity – is not easy. It means that CPAs – professionals who are traditionally tied indelibly to what has happened in the past – must now be focused squarely on what’s to come. It requires a new set of skills that have nothing to do with our profession’s traditional core services. In my mind, it means CPAs must do three things to survive the automated future and be relevant, valuable and trusted business advisors to their clients going forward.
1. ADO P T A MI N D S E T T HAT E M B R A C E S CON T I NUO US LE A R N IN G I’m not talking about CPE here. Rather, I’m speaking of a concept that Warren Berger calls “serial mastery.” In his brilliant book A More Beautiful Question: The Power of Inquiry to Spark Breakthrough Ideas, Berger says today’s workers “are often left to figure out for themselves what new skills will make them more valuable, or just keep them from obsolescence.” This means “the need to constantly adapt is the new reality for many workers.”

The key, of course, is to spend less time following other people’s footsteps and more time blazing our own trails.
3 . A N TICIPATE Suppose you could know what’s going to happen before it happens. Would you find that a useful skill to have? Who wouldn’t? With that kind of foresight, we could position our organizations to take advantages of opportunities our competitors can’t even see. Predicting the future sounds like science fiction, but futurist and best-selling author Daniel Burrus says it’s a skill anyone can learn. In fact, Burrus says anticipation is the key missing competency in business today. The secret is three-fold:
1 . Identify the “hard trends” (things that will definitely happen) and “soft trends” (things that might happen) that impact our organizations and our clients.
2 . Isolate the opportunities that each of these trends offers, then ask ourselves, “What do we have to do to take advantage of those opportunities?”

3. Find the time in our already-hectic schedules to do Steps 1 and 2. That third task might be the most difficult of all to accomplish. Who has time for this future-focused work when we’re busier than ever just trying to get today’s work done? The fact, though, is that we make time for the important stuff … and friends, this is the important stuff. Just an hour a week will do. Put it on your calendar. Set an alarm. And when that alarm goes off, shut the door, turn off the phone and the laptop, and start thinking about those hard and soft trends and the opportunities they provide. You don’t have to do this stuff. You can keep doing the same tired, old busy work you’ve always done. You might even make some money at it. But those trends and opportunities aren’t going away. As Burrus likes to say, “If it can be done, it will be done … and if you don’t do it, someone else will.” The hard trend is that these things — automation, transformation, change, complexity, opportunity — are here. They’re real, and they’re here to stay. The soft trend, says Burrus, is this: Will you do anything about it? Each year, Accounting Today publishes its list of the 100 most influential people in accounting (MACPA. org/Top100). This year, five exceptional MACPA members made the cut.
Jody Padar is CEO and principal of New Vision CPA Group in Chicago, Ill. Though Jody is an Illinois CPA, she has maintained membership with the MACPA since 2012. Her book, The Radical CPA: New Rules for the Future Ready Firm, lays out a blueprint for what she calls the “new firm.” After taking over her father’s firm four years ago, she has become one of the profession’s emerging thought leaders in all things social and cloud.
Lyle Benson is president and founder of L.K. Benson & Company. An MACPA member since his licensure in 1982, Lyle has served the MACPA and the AICPA for several years. After serving on the MACPA Personal Financial Planning Committee for many years, he joined the AICPA PFP Executive Committee, where he now serves as chair. Wayne Berson is CEO of BDO USA, LLP, and chair of the Global Board of Directors of BDO International, Ltd. An MACPA member since 1991, Wayne served early in his career on the association’s Business Valuation and Litigation Services Committee. He recently served on the Appeal Bonds Task Force that scored a major victory for Maryland business last year. Through a series of well orchestrated mergers, Berson is on track to make BDO only the seventh firm in the country with more than $1 billion in annual revenue. Ed Karl is vice president of taxation at the AICPA and a member of MACPA since 1977, the year he became a CPA. In his role, Ed is responsible for the review, formulation, and submission to Congress, the Treasury Department, and the Internal Revenue Service of technical and policy

Also worth noting, Tom ranked No. 2 on Accounting Today’s list, just below AICPA CEO Barry Melancon. Each influencer was asked by Accounting Today, “What is the most important issue currently facing the accounting profession?” Here’s what the MACPA’s influential members had to say: Benson: “As specialization continues to grow in the accounting profession, we need to provide resources, career paths and opportunities to the next generation of CPA firm / practice leadership in these areas. Personal
financial planning is a perfect example of this. CPAs are the thought leaders in the financial planning profession, and we need to continue to raise the visibility and bring the next generation into this area.” Berson: “Accounting, like all professional services, is a people business. Any firm is only as good as the professionals it recruits, trains and retains. As the U.S. economy is improving, the battle for talent will continue to intensify as we seek the best and brightest professionals to help us achieve our growth goals.” Karl: “IRS service levels! The IRS says it has insufficient funds to assist taxpayers and practitioners, and IRS Commissioner John Koskinen says its service levels are ‘abysmal.’ Congress believes the IRS acts inefficiently, and in some cases, inappropriately, and has significantly slashed the IRS’s budget to pre-2009 levels. And the news is not getting any better for the IRS as the House Appropriations Committee recently approved a FY 1016 IRS budget that would fund the agency at 7.7 percent below its FY 2015 level. There is no question regarding the ‘disease’ – abysmal service – but there is a huge divide regarding the cure! An objective and transparent solution that results in the service levels that the taxpaying public, practitioners and, indeed, Congress and IRS would expect, must be found.” Padar: “Changing to adapt to the world around them. The world has changed, the way we do business has changed, our customers want to interact differently with their CPAs, and yet most CPAs have not changed to meet today’s consumers’ needs. feel the change and they know they need to do something, yet they have not started on the journey to remain relevant. Technology has become the core of today’s ‘New Firm,’ yet too many CPAs think only about it terms of efficiencies, instead of a new way to define and serve under new business model. talent because the ways people want to work are dramatically changing.” Hood: “The need to get out of our box(es), start looking forward and learning how to be proactive. All of the major issues facing the professio — like succession planning, generations,
adding value, and adopting technology — we should have seen coming based on the ‘hard trends’ of demographics, technology, and government regulations. The good news is that being proactive and anticipating future trends is a skill accountants and CPAs can learn, and it will benefit their firms, clients, and organizations they work for.”
Fewer staff hours, more community service at KBST&M
The partners of Kahn, Berman, Solomon, Taibel & Mogol, P.A., reduced its staff’s Friday hours during the summer to four while still paying everyone for eight hours. FINANCIAL PLANNING What every client needs: Food, shelter, clothing...and asset protection planning BY M A U R I C E OFFIT, CPA , E SQ . Editor’s note: This is the first of a two-part series. Clients spend their entire careers working hard and accumulating wealth. Once they’ve “made it,” their primary interest is in holding onto what they have. They also, therefore, have a keen interest in establishing an asset protection plan – a plan that will protect their assets from being legally seized and sold by a claimant who sues them. At its core, asset protection planning is a Plan B. Plan A looks like this: • Your clients don’t get sued. • If a suit is filed against your clients, win the suit. • If your clients lost the suit, have an insurance policy that will pay the claim. Plan B is everything else. Your clients need a Plan B because we live in a world that is increasingly litigious. More suits are filed in the United States than all other countries combined. Clients, therefore, need to be prepared for the possibility that they might lose a lawsuit. Otherwise, they could lose their assets. In “Henry VI,” Shakespeare wrote, “The first thing we do, let’s kill all the lawyers.” Obviously, that hasn’t occurred; there are 1.2 million lawyers in the United States. Believe it or not, there are more lawyers than (a) doctors (there are 945,000 doctors), (b) firefighters (there are 800,000 firefighters), and (c) policemen (there are 900,000 policemen).

To make matters worse, there are 15 million civil cases filed in the United States every year. This is because: • attorneys can be engaged on a contingent fee basis, and • the losing party isn’t responsible for the payment of attorney’s fees incurred by the winning party. Therefore, there is no penalty for claimants who file suits of questionable merit. Fortunately, your clients may be able protect themselves from future protection claims by having an adequate insurance policy in force. But there is no guaranty that an insurance policy will always provide protection to your clients, because: • all policies have a coverage limit (the claims filed against your clients may exceed the policy’s coverage limit); • all policies have exclusions from coverage (the claims filed against your clients may be excluded); and •
some insurance companies refuse to pay claims that they’re legally obligated to pay. An insurance company’s greatest expense is what it pays out in claims. If it pays out less in claims, it keeps more in profits.
How can you protect your clients from potential future claims? By establishing an asset protection plan. CAREER CRISIS? Many young professionals lack training in vital ‘soft skills’ Reports say strategic thinking, problem solving, communication among the keys to future readiness, but new hires are often unprepared B Y B I L L S H E R IDA N , CA E The CPA profession is at a crossroads where most young professionals are largely unprepared to meet the challenges posed by a changing and complex world. A number of recent reports have hinted at this emerging crisis, citing a significant gap between the skills young professionals need to succeed and those they actually possess. The reports also have suggested some possible solutions and uncovered a number of opportunities for educators, employers, and employees themselves to improve the “workforce readiness” of today’s CPA. The most recent of these reports was compiled by the Maryland Association of CPAs and the Business Learning Institute. As part of a May 26, 2015 strategy session facilitated by the MACPA and the BLI, the managing partners of 14 local, regional, and national CPA firms ranked what they believe are the most important skills for entry-level staff members. They chose the following:

SOFT SKILLS CITED IN REPORT AFTER REPORT That list mirrors the results of a number of other recent reports, all of which point to a widening skills gap that leaves both young professionals and their employers scrambling to stay relevant amid today’s

massive change and complexity. • A report (https://www.apqc.org/ knowledge-base/documents/ skills-gap-entry-level-management accounting-and-finance) by the American Productivity and Quality Center, produced in conjunction with the Institute of Management Accountants, found that the most critical non-technical skills needed by young professionals today are ethics, communication, customer service, adaptability, strategic thinking / execution, process improvement, leadership, and collaboration. • In a May 19, 2015 article titled “The Plain-Vanilla Accountant Goes Out of Style,” (http://blogs.wsj. com/cfo/2015/05/19/the-plain-vanilla accountant-goes-out-of-style/) Wall Street Journal reporter Kimberly Johnson writes that “leadership, forecasting, strategic thinking, cost management, and financial reporting are the skills where the gaps between demand and supply are the widest.” Citing the APQC / IMA report, Johnson adds, “(Eighty-one) percent of those polled said planning, budgeting and forecasting skills were ‘quite a bit’ or ‘extremely’ necessary for their organization to succeed. Yet the same respondents said only 30 percent of entry-level finance professionals possess those skills. Though 77 percent agreed that leadership ability was a necessity, only 14 percent said their employees had it.” • The Conference Board’s Global
Leadership Forecast for 2014-15 (http:// insight.ddiworld.com/glf20142015) outlined the top four skills that leaders must possess to succeed in a world defined volatility, uncertainty, complexity, and ambiguity. Those skills are managing and introducing change, building consensus and commitment, inspiring others toward a challenging future vision, and leading across generations.

During the 2015 AICPA E.D.G.E. Conference for young professionals, MACPA Executive Director Tom Hood facilitated a session in which attendees ranked the top skills they need to be successful. The top five were communication, inspiring and motivating others, strategic and critical thinking, anticipating and serving evolving needs, and influencing / persuading others.

Report after report clearly identifies the skills that employers say their teams need to help their organizations succeed. Despite that, young professionals say they are sorely lacking in those skills. The most recent Robert Half Readiness Index (http://www.accountingtoday. com/blogs/accounting-tomorrow/news/ infographic-most-professionals-dont-feelprepared-for-post-college-work-75332-1.html) found that 56 percent of employees say they felt only somewhat prepared for their first

accounting or finance job after graduation, while 14 percent said they were not at all prepared. “Respondents were unready for their first professional jobs in multiple ways,” Accounting Today’s Sean McCabe writes. “Forty-nine percent indicated the knowledge they gained in the classroom didn’t translate to their position. Thirtythree percent said they felt ill-equipped to handle office politics, and 23 percent said they lacked technology skills or software knowledge.”
WHO’S TO BLAME? Plenty of blame for the skills gap is being passed around throughout the profession. Some employers says accounting programs at the nation’s universities have failed to adequately prepare graduates for the workforce. Some college professors blame the K-12 system, saying high school graduates don’t have the skills necessary to navigate college, much less a career. Others blame the young professionals themselves, saying they need to take charge of their own careers and personal development. The answer, says Tom Hood, might go deeper than that. The real cause, he said, might be the exponential pace of change and technology that automates lower-level skills and requires more “soft skills” (or as Hood more accurately calls them, “success skills”) at earlier ages.

“The environment in the early CPA career is more demanding of those ‘soft skills,’ especially communication and business acumen or context,” Hood said. “Some posit that in the future, all of the ‘back office’ functions will be automated, which will require entry-level workers to do more customer- and client-facing work earlier in their careers. What does this mean as far as the skills they’ll need to do that work?” The answer is found in the reports themselves: CPAs who succeed going forward will have mastered a series of so-called “soft skills” that will improve their ability to do that important clientfacing work.
CONTINUOUS LEARNING: THE KEY TO FUTURE SUCCESS Our schools and universities can certainly do their part by transforming their business and accounting curricula to include skills like leadership, collaboration, and strategic thinking. Until that happens, though, young professionals must take it upon themselves to learn the key skills that will make them future-ready. Doing so will boost their careers, put them on a fast track to leadership, and help their organizations outmaneuver their competition in a changing and world. The word is spreading. Training in these “success skills” is available from more
sources than ever. Among them is the Business Learning Institute, whose lineup of renowned instructors includes courses in leadership, personal development, strategic thinking, communication, and scores of other competencies. HIGH-TECH SOLUTIONS Search algorithms: Myths and facts B Y A N D R E W ROSE It seems like every time Google changes its search algorithm, it is quickly followed by a plethora of gloom-and-doom marketing pieces from search engine optimization and website development companies. With distinctly terrifying names like Panda, Penguin, Caffeine, etc., devious service providers have used a lack of client understanding of what the changes are to sell fear-based solutions that weren’t needed in the first place. Over the past few years, the majority of the changes to the algorithm have been in response to black-hat SEO companies that have exploited flaws in the search process for their clients’ short-term advantage. The changes haven’t negatively impacted professional service firms as long as they have been playing fair with their website and content. That is, until now. The most recent three updates -Hummingbird, Pigeon, and the soon-tobe-named mobile readiness change -- are representatives of the future of search rather than reactions to companies that are trying to cheat the system. SAY WHAT? The Hummingbird update, which officially went live in August 2013, focuses on interpreting spoken search. As more people are speaking into their mobile devices as a search mechanism, this change was enacted to allow better results to be generated. For example, before Hummingbird, if you typed, “Where can I find an auditor for an auto dealership,” Google would have deconstructed the sentence and honed in on a few keywords, such as auditor, auto, and dealership, and then found corresponding results. Now, with Hummingbird, the entire sentence is taken into context for its full meaning. Why? Google wants search

to be more humanized moving forward. Google search chief Amit Singhal said Hummingbird is the first major update of its type since 2001. The impact on most websites is minimal in terms of rankings, although it would be a good idea to read aloud the words on your website to see if they sound natural. KEEP IT LOCAL With the Pigeon update in July 2014, Google places more emphasis on companies claiming their location on Google maps (as well as cleaning up any bad addresses that may be present). Google wants to ensure that organizations closest in geographic location to the searcher are appearing at the top of the rankings list. ARE YOU RESPONSIVE? The newest algorithm update, dubbed Mobilegeddon, is a game changer. Since most searches are now performed on mobile devices, any websites that don’t automatically resize (depending on the device) to the varying screen sizes available are now suppressed in search results.

Google will continue to refine and calibrate the search algorithms it uses to provide the best solutions for the information being searched. Therefore, your website needs to be viewed as an evolving platform, not a static picture of where you were in the past. Many CPA firms have been caught off-guard by this update and are now unknowingly paying the price in terms of their search rankings. If your firm’s website was built on an old platform, this is a good time for a refresher. Check to see if your website is responsive on Google’s mobile friendly test -- MACPA.org/GoogleTest. Mobile is only going to grow in terms of primary Internet search. In 2014, mobile devices represented 30 percent of searches; this year, it is already at 60 percent. Even though the official start date of this update was supposedly April 21, 2015, we saw significant changes in the search results for our mobile-ready clients as early as mid-March. They surged

TAX CORNER Services sales tax spreads through states B Y J E A N E TTE SHE RM A N In most states, services are exempted from sales tax unless explicitly made taxable by law. So why are the governors of at least two states, as well as legislators in another, fighting to change that? Sales taxation used to focus exclusively on physical goods. As the United States moved toward a service economy, states started to realize that not taxing services meant giving up billions of dollars in potential revenue. Today, four states — Hawaii, New Mexico, South Dakota, and West Virginia — tax almost all services. Five more states — Alaska, Delaware, Montana, New Hampshire, and Oregon — do not have a statewide sales tax, although local governments in some states may charge a sales tax. This leaves 41 states where services are “presumed exempt” from sales tax, but each of these states still explicitly taxes at least some services, and no two states tax the same ones.
Several of those states have recently faced budget shortfalls and are looking toward a “presumed taxable” law for services instead. California Senate Bill 8 is an example of a single proposal that could change the tax picture for thousands of businesses selling in the state. It would change the state to a “presumed taxable” state, in which most service businesses will have to pay sales tax at the same rate as sellers of physical goods. Expected to raise $10 billion a year in revenue if passed, the bill is currently in committee. Illinois Gov. Bruce Rauner made implementing a sales tax on services part of his 2014 campaign. Illinois, which has a strong service-based economy centered in Chicago, may be losing out on more than $2 billion in revenue by leaving a wide range of services untaxed. While the legislature hasn’t passed a bill to tax services in Illinois yet, this change could seriously impact businesses all over the state if legislators get on board with Rauner.
Pennsylvania Gov. Tom Wolf recently saw his proposed budget (which would add sales taxes to a range of business-to-consumer transactions while leaving business-tobusiness sales tax-free) knocked down by the Pennsylvania House of Representatives, 193-0. But with a budget deficit of more than $2 billion, it’s likely Pennsylvania residents haven’t seen the last of services sales tax proposals. Sales tax on services is an area of law that is complex, and it’s getting more complicated all the time. TAX CORNER, continued New tax due dates create more logical information flows F RO M T H E A ICPA
On July 31, President Obama signed into law a short-term highway funding extension that contained important due date modifications for several common tax returns, including partnerships and C corporations. PL 114-41 is the culmination of a long-standing effort by the AICPA, the MACPA, and other state CPA societies to eliminate the awkward chronology for many returns. Under the prior due dates, taxpayers and practitioners often had insufficient time to prepare returns because required information from a flow-through business was not available before the taxpayer’s income tax return was due. The idea behind the changes is to have flow-through returns completed before the returns in which the flowthrough information is reported for the recipients – in forms 1040 and 1120, for example. Taxpayers and their preparers will now have time to receive and analyze the flow-through information before reporting it in other filings. Most of these changes are ones that the AICPA and state CPA societies have been advocating for several years. The effort centered on urging a more logical flow of information that would help taxpayers and tax professionals file timely, more accurate returns. In articles, social media posts and personal appeals to other members, about 200 AICPA and state society members volunteered their time to communicate the profession’s concerns. Discussions also were

held between representatives of the profession and officials from the Internal Revenue Service and Treasury. “This legislative victory is proof that persistence yields results,” said MACPA Executive Director Tom Hood, CPA. “It just makes sense to complete flow-through returns before individual and corporate returns are due so that the required information is available. This victory is part of the profession’s overall effort to help alleviate the crunch that occurs every tax filing season.” Among the changes, the new due date for C corporations generally will be the 15th day of the fourth month following the close of the corporation’s year (i.e., April 15 for calendar-year C corporations). Currently, these returns are due on the 15th day of the third month following the close of the corporation’s year.

The due date for FinCEN Form 114, for example, will change from June 30 to April 15 to align with Form 1040 filings, and under the new law, Form 114 taxpayers will be allowed an extension, which was not previously permitted. That extended date, Oct. 15, is also aligned with the Form 1040 extension. “This is a terrific result, but we are not stopping here,” said Hood. “Taxpayers and preparers still face a host of other workload compression challenges. The MACPA is working with the AICPA to find ways to address common complaints about the current due dates for other forms, including Form 1099s that taxpayers need in order to file their tax return. In some cases, due dates have been moved up. For partnership returns, the new due date will be the 15th day of the third month following the close of the taxable year (i.e., March 15 for calendar-year partnerships). Currently, these returns are due on April 15 for calendar-year partnerships. It’s important for practitioners to note that the new law generally provides six-month extensions (five and a half months for trusts), mitigating possible disruptions from the new due dates. The new law also provides for additional extensions not previously
