The employer’s responsibility for the working spacewhat has changed?

During the pandemic and since the world of work has entered the hybrid working era, employers have found their teams working in weird and wonderful locations. However, employers should note that whilst staff are working away from the office, it remains their legal duty to ensure that employees have a safe working environment. Even a location as mundane as the kitchen table poses risks. For example, a chair unsuitable for long periods or an uncomfortable height difference from the table could lead to injuries over time. Employers should provide a risk assessment for their staff to determine the suitability of their workspace and equipment. Consideration should be given to issues such as whether there’s sufficient lighting, the suitability of computer equipment (mainly if not provided by the employer) and the ergonomic features of the workstation.

The next time you’re on a Zoom call with your staff, take a moment to think about the suitability of their working environment. And consider whether you’ve got a risk assessment on file to mitigate any liability you might face for that RSI injury sustained from typing on a laptop balanced on a compost bag in their garden shed.
