I’d like to offer you a warm welcome to the September 2019 edition of Dorset Business Focus. I’d like to begin by thanking everybody that contributed to our recent annual membership survey. We had a large number of responses and were very encouraged by the feedback we received, particularly around satisfaction with membership and customer service. The survey was also hugely valuable in gaining your feedback on both the delivery of services we currently offer and possible new services that would be of value. We will publish a full report in next month’s magazine. Following the appointment of Boris Johnson as PM, we were delighted to see the promotion of Dorset MP Conor Burns to the role of Minister of State for International Trade. I recently wrote to the prime minister and had a very positive meeting with Conor and we will be working closely with him in helping businesses take their goods and services to market internationally as well as promoting the many great examples of Dorset businesses trading successfully across the globe. His appointment is great news for Dorset and we will be giving Conor our full support. As we approach 31st October, we will also continue to do our very best in providing advice and support for businesses regarding our exit from the EU. Businesses still need clarification on a host of issues. In a snap poll we recently asked businesses how confident they are in the delivery a ‘satisfactory’ Brexit for business. 90 businesses responded with 78% stating they were not confident and only 22% confident. There is still much to do in terms of providing businesses with clarification around Brexit. Unsurprisingly we’ve had many businesses contact us over the last few weeks regarding the problems that are being caused for businesses due to both the ferry and bridge being out of order, and very unfortunately, at the same time. We fully understand that issues and problems will arise and actions are being taken. We’ve issued a press

release raising the concerns of our members and asked the various authorities to work together in finding longer term solutions for these problems. Locally we have already had several positive meetings with the Chief Executives of both new Dorset local authorities, building on our already strong relationships and we will work closely together in driving terms of helping drive the economic growth agenda forward across the county. Another positive development is the regional work that is being undertaken by the accredited Chambers across the South West. The county Chambers for Dorset, Devon, Somerset, Cornwall and the Bristol have come together as a partnership under the banner of British Chambers of Commerce for the South West. Our aim is to give our 3,500 members a regional voice on key policy issues for the South West. We will be focusing on key issues such as skills, infrastructure (including digital connectivity), housing and green energy. This partnership will enable us to engage with key stakeholders at a regional level and ensure the voice of business across the region is heard. We are fully supportive and engaged within this partnership and progress is already being made in terms of engaging with the Local Enterprise Partnerships across the region and working together to promote the South West. Search the word ‘leader’ and Google will present you with over 4 billion search results. Currently over 135,000 people are searching the term ‘leadership styles’ each month with 12,000 searches for the term ‘importance of leadership’. Leadership will mean many different things to us all based on our own experiences but effective leadership is what creates the environments in which people can thrive, be inspired and come together to do remarkable things.

L

eadership is less likely to succeed today when following a traditional command and control model, instead empowering every single person in the business enables business owners to create a more engaged, cohesive and powerful team that is stronger, efficient and more effective. Leadership is not a title, seniority or one’s position in the hierarchy of a company but progress driven by influence. What is clear is that it is during challenging times leadership makes the greatest difference for us all as we call upon clarity, vision and decisiveness. In 2016 Dorset Chamber introduced the Business Leader of the Year category within the Dorset Business Awards to inspire aspirational leaders. By showcasing and sharing the stories of great leadership by people achieving extraordinary things for their business, people, industry and Dorset, our goal was to simply present the lessons of success so they can be learned. To continue this work, we asked the question: ‘What is effective leadership’ to some of our business leaders for their take on the subject for the magazine. Here are some of the insights we received:

“I never planned to be a leader; I just set myself a goal and found like-minded people to join me along the way. I think that having resilience and a true passion for what you do are the keys to being a good leader. It’s important to treat people fairly - how you would want to be treated. In my opinion, being a good leader is about empowering your team to do their jobs well. I employ a team of highly talented writers, animators, and illustrators. Could I do their jobs? Definitely not: my animations would look like stick people. It’s so important to have faith in the ability of your employees; you employed them for a reason, after all. Showing your team that you trust them will equip them with the self-belief to produce their best possible work. If your team are empowered, appreciated, and feel like they are an essential part of the company, then you’re onto a winner. Running a business is full of ups and downs; it’s about celebrating your successes with your team, but also learning valuable lessons from the setbacks. A good leader should always be looking forwards and keeping a cool head”.

“We are tribal creatures. It’s deep in our DNA. Our species discovered a long time ago that we survive better as a group (or tribe) than as individuals. Effective tribes need leaders. Leaders give tribes a sense of security, safety, camaraderie, togetherness, hope, direction, purpose and a sense of value (status). This stuff isn’t new it speaks direct to the needs of humans as illustrated the great psychologists like Mazlow. Successful leaders require clarity of purpose. A clear vision backed by a plan generates confidence. We like confidence. Leaders can communicate visions and plans. They don’t have to be great orators but it helps win us over. Leaders also espouse (and publicly live) beliefs, values and principles. When a leaders’s values and beliefs also align with our own, a leader can become magnetic to us. They inspire us with their words and actions. In business great leaders involve us. They consult with us. They coach and support us. They create an environment that breeds success. They recognise and reward us. They make us feel part of something bigger. Leaders have to be even handed and challenge behaviour within our tribe that doesn't align with our tribal values. Leaders make tough decisions today for the good of the tribe tomorrow. That's why leadership is lonely. It is rare that tough decisions please everybody in a tribe. In business we need leaders at times of change. Business as usual does not require leadership, it requires management. “For me, effective leadership is the ability to empower people and take them on a journey. First you must be clear on what your journey is and where you are going. If people see clarity, vision and strength of purpose they will want to follow you. A great leader is humble, always learning and is always in tune with their team and on my personal journey it has been important to learn my limitations. A good leader will see and nurture great strength in the people around them and not fear them being better or stronger at certain things than they are. A big mistake leader’s make is thinking they must always have all the answers which ironically is one of leaderships biggest weaknesses often leading to disconnect and fractures in a team. I am also a strong advocate of self-learning and development and not being afraid to ask for help. People will be inspired by your growth journey so do not be afraid of it. This way, we also ensure we stay on top of industry trends. Another thing to do is foster an environment where everyone has a voice. No matter the seniority, everyone has something to add and take into consideration that holistic opinion. This will make people feel and know that their input and effort is not overlooked. In our office, we have the “15 rule” which says we have no more than 15 people per office. Dorset Chamber celebrates commitment to real living wage Dorset Chamber has this month been accredited as a Living Wage Employer. Our Living Wage commitment will see everyone working at the company receive a minimum hourly wage of £9.00 in the UK or £10.55 in London. Both rates are significantly higher than the government minimum for over 25s, which currently stands at £7.83 per hour. The South West is a region where over a fifth of all jobs (21%) pay less than the real Living Wage - around 463,000 jobs. Despite this, Dorset Chamber has committed to pay the real Living Wage and deliver a fair day’s pay for a hard day’s work. The real Living Wage is the only rate calculated according to the costs of living. It provides a voluntary benchmark for employers that wish to ensure their staff earn a wage they can live on, not just the government minimum. Since 2011 the Living Wage movement has delivered a pay rise to over 160,000 people and put over £800m extra into the pockets of low paid workers. Ian Girling, Chief Executive at Dorset Chamber said: “Whilst pay isn’t the only factor in being a good 6

employer, as a business we have always aspired to pay our staff a wage that recognises the actual cost of living. We are very proud to have achieved this accreditation as a Living Wage Employer and would encourage other businesses to look at this accreditation.” Tess Lanning, Director, Living Wage Foundation said: “We’re delighted that Dorset Chamber has joined the movement of over 4,700 responsible employers across the UK who voluntarily commit to

The President’s Column by Liz Willingham

T

he gym is not my natural habitat. I will admit to not really looking forward to it and my inner good twin’s voice really has to override the nagging “Yes, but you still have those 100 emails to go through….” to make me go. I know the physical and mental benefits are worth every painful minute, however I’m the first to crank up the sounds on the headphones to try and drown out the continued nagging naughty twin’s voice saying “You hate this, why are you even here?!” Recently I experimented with listening to a podcast or two rather than my usual playlists, and actually I found it more engaging and before I knew it I’d completed an extra 20 minutes on the cross trainer, then a second round on the treadmill. The first one was a Reid Hoffman (he’s the founder of LinkedIn) ‘Masters of Scale’ special episode called Recharge your brain with a Meditative Story by Arianna Huffington. The concept is great; an inspiring story from a known name woven into thought-provoking prompts, which asks you to consider key moments in your own journey and wraps up with a meditation that is aimed to help you ‘recharge and refresh’. Just watch you don’t zen out too much on the treadmill….it might not end well! I was mesmerised to hear how Huffington was driven to study at Cambridge – purely from seeing the front cover of a magazine on a bus home from school - as a young, non-English speaking girl, living in a small apartment in Athens supported by her mother, who taught her to embrace life’s journey without having attachment to the outcome – a lesson everyone in business can learn from. I’ll let you listen to it yourselves to get the full picture, but it made me think how anything is possible if you set your sights high. I’ll be downloading other podcasts in the Meditative Story series, as it was a great way to absorb inspiring business advice alongside a short, guided meditation. We should all try to build in a few minutes of something like this each day to help keep us on track. The second podcast was episode 42 from Hoffman’s Masters of Scale series, which I would recommend to anyone who needs the final push to fulfil a dream and start their own business, at whatever age or stage of their career, or to re-spark their passion for entrepreneurship. We all hear inspiring stories of young stars launching their successful enterprises but there are loads of examples of ‘late stage founders’ who have used their life experience to make the difference to their start ups in their 30s, 40s and later.

Recognising those who make the Dorset Business Awards happen Now that we’ve received all the entries for the Dorset Business Awards and the judges are hard at work picking their finalists, we wanted to take a moment to recognise all the different partners involved in making the ceremony come to life.

The main focus of the episode is Gwyneth Paltrow’s journey with Goop, her lifestyle brand, which started from a weekly newsletter created from her kitchen for a small database, to being valued at $250 million in 2018 with over 8 million subscribers. She describes where her love for business came from and how she had self doubts like everyone about whether she could make a success of her own having been known as an actress for so long. Now I am aware that ‘Gwinnie’ is a bit like Marmite… she’s often easy pickings for negative headlines and saying things like referring to her ex husband, Coldplay’s Chris Martin, on social media affectionately (but weirdly) as her “brother” doesn’t help. But as a businesswoman I think she has more than proven herself and this podcast is a relatable and open interview with someone that reveals her own weaknesses and insecurities, and is the first to say that savvy sounding boards and experienced investors were a major contribution to Goop’s success. She didn’t do it alone. And often her fame didn’t give her the credibility needed on the corporate stage. Paltrow also talks about the growing pains and key transition stages of the business, which naturally challenged the culture she had nurtured so carefully at the beginning. Backing up this one example of second career success are contributions from entrepreneurs such as Airbnb’s Brian Chesky and Sara Blakely from lingerie company, Spanx. They all endorse the view that you focus on what you know, embrace what you don’t and develop strategies to plug the gaps. By this stage my gym session was blissfully full flow and I was concentrating so hard I had no idea the adductor machine had seen twice as many reps as usual. Earth Wind and Fire was worth putting on the B side this time....even though ‘September’ is my favourite track…. sorry, I just couldn’t help myself (I can see the rolling eyes from here!) Chamber calls for infrastructure action

Dorset Chamber has called for action amid the ongoing closure of Poole’s Twin Sails Bridge and the Sandbanks ferry. Both are currently out of action at one of the peak times of the year. It wants to see a long term vision for infrastructure in the area to avoid repeated instances of severe disruption for businesses and help drive local economic growth at a strategic level. Dorset Chamber Chief Executive Ian Girling said: “To have both the bridge and ferry out of service is a serious concern for business. “Their closures are causing major disruption for businesses, as well as residents and visitors, with a knock-on impact for the local economy. “Both the bridge and the ferry have failed before and infrastructure, transport links and congestion are a concern repeatedly raised by our members. “It is absolutely essential we have a clear vision and ambition for the whole county for a strong infrastructure that provides a platform for business

growth. "We all need to work closely on building a stronger long-term vision for our infrastructure otherwise we will continue to be affected by these type of problems”. Dorset Chamber is the county’s leading business support organisation. It is the only chamber accredited to the British Chambers of Commerce (BCC) which gives it the platform to lobby for change at the highest level of Government. Mr Girling has contacted Poole Harbour

Commissioners and BCP Council regarding the concerns of businesses regarding the ferry and bridge issues. The Chamber will also be working with BCP Council on a conference regarding sustainable transport solutions. Dorset Chamber has also raised these concerns as a member of the Dorset Local Enterprise Partnership (LEP) board. The LEP has recently launched a new sub-group focused on strategic infrastructure.

Village Hotel Club’s boost for Cherries youngsters

AFC Bournemouth is partnering with the town’s Village Hotel Club for a sixth year in succession. Village Hotel Club will continue its partnership with the Cherries as Regional Supporters for season 2019/20. 4Com research reveals the pet peeves that annoy UK office workers the most Don’t eat smelly food, don’t eat someone else’s food and don’t eat loudly – say workers A third of workers (33%) are quick to point the finger, yet claim they have no irritating habits themselves

Eating smelly foods is the most annoying thing you can do in the office, according to new research1 conducted by business telecommunications provider, 4Com. With insight gathered from 2000 office workers across the nation, the study aimed to discover which habits most get under people’s skin in the work environment. According to respondents, the top five behaviours that office workers find most irritating are: 1. 2. 3. 4. 5.

When it comes to the habits workers admit to having themselves, notably, a third (33%) say they have no irritating habits at all, which is probably news to their colleagues! On the other hand, one in seven (15%) are aware they speak loudly, and 13% know they have a tendency to sing while they work. The research also looked at the way people react to workplace irritations. Over a third (37%) of workers say they’ll tell the culprit face-to-face that their habits are irritating, while one in seven (15%) would rather drop an email to express their annoyance, and one in nine (11%) will just leave a passive-aggressive note. But, proving that British politeness is going nowhere, over a third (38%) will just ignore the problem altogether. Interestingly, men are more likely than women to tell a colleague face-to-face that their behaviour is annoying (42% vs 34%). Yet men are also more likely to gossip to a co-worker about it, hoping that the colleague will pass on the message (13% vs 10%). Commenting on the research, Mark Pearcy, Head of Marketing at 4Com, says: “If you work full time, you probably spend more time with your colleagues than anyone else, so it’s no surprise that certain habits can start to rub you up the wrong way! “In those situations, we’d recommend letting the person know what’s bothering you in a clear, friendly and polite way, as well as being as patient as possible. Store & Secure: sleeping rough Store & Secure Self-storage staff will be taking part in the YMCA’s Big Sleep Easy on November 16, when they will sleep rough to raise funds to help combat homelessness. Store & Secure will also supply cardboard boxes for other participants to sleep on and under. The annual event is an opportunity for individuals and local organisations to help the YMCA raise both awareness of homelessness and vital funds to support their work combatting it. To do this, participants get sponsored to spend a night in cardboard shelters alongside other fundraisers. Last year, almost £25,000 was raised by 100 people! In recent years, YMCA Bournemouth has kept around 200 individuals safe from homelessness each year. It provides 108 beds as short-term supported housing for men and women between the ages of 18 and 65. And it offers one-to-one support for our residents and equips them with the skills and confidence

Dorset Chamber executives to join 40+ local businesses ‘sleeping rough so others don’t have to’ at huge overnight fundraiser this November On Saturday 16 November this year, almost 200 representatives from local businesses will be bedding down under the stars at The Bournemouth Sports Club (Chapel Gate), near Bournemouth Airport, as part of YMCA Bournemouth’s ‘Big Sleep Easy 2019’. The event is designed to raise awareness of local homelessness and fund projects that aim to keep individuals safe from homelessness over the long-term. Building on the success of YMCA Bournemouth’s inaugural Big Sleep Easy in 2018, which saw 98 individuals from 23 local organisations build shelters out of cardboard boxes, sleep outside for a night and ultimately raise almost £25,000 towards the charity’s work, this year’s sponsored sleepout has already recruited over 120 fundraisers and over 40 local businesses are expected to enter a team. Dolphin Centre staff dementia training The Dolphin Shopping Centre in Poole partnered with Colten Care to receive staff training in order to have a better understanding of dementia, as well as the different types of dementia. Colten Care provided a Dementia Friends information session with the Dolphin’s management team in order for the shopping centre to continue its journey to becoming a more dementia-friendly centre. The training equipped members of staff to be able to respond to the needs and challenges facing individuals living with dementia with more confidence. The session provided a wider understanding of the various stages of the disease. John Grinnell, centre manager at the Dolphin Shopping Centre, commented: “We’re very grateful to Colten Care for delivering a Dementia Friends training session with our staff. It’s very important that as a leading shopping centre, we have a thorough understanding of how even the smallest of actions can make a difference to those living with dementia. “The Dolphin is proud to support incentives to help make shopping more inclusive and enhance our accessibility. It was clear in the training session that every single person in attendance has been affected by dementia in some way, whether through a friend, parent or grandparent and everyone’s experience is so diverse.” Dementia Friends is a programme led by the Alzheimer’s Society, designed to change people’s perception of dementia. Colten Care supports the Dementia Friends

programme and helps to deliver the training. With more than 30 years’ experience, Colten Care operates care homes across Hampshire, Dorset and Wiltshire. Greendale installs life-saving defibrillator

Dorset Chartered Builders, Greendale Construction Limited, has funded the instillation of an Automated External Defibrillator (AED) at its Bourne Valley Road, Poole offices. The life-saving device, which costs over £1527 to purchase and install, has been placed outside the Old Generator House building, and can be accessed around the clock by anyone requiring it in an emergency. Maria Seabright, finance and HR director at Greendale commented: “In an emergency, finding the nearest defibrillator can be a matter of life and death. When someone is in cardiac arrest and not breathing, every second counts, and this is why Greendale chose to purchase and install the defibrillator which is registered with the ambulance service who can give out its location for anyone in need in the vicinity. If a defibrillator is used within the first 4 minutes of a person suffering a cardiac arrest, their chances of survival can increase to 70%, compared to just 5% if defibrillation is delayed.” Susan Turner, Business Training Manager at Ouch commented: “Ouch was delighted to support Greendale’s purchase of a public access defibrillator, and we were able to provide free training to all staff based at the Poole office, enabling the local community to benefit from the provision of this vital lifesaving equipment. Through a range of group development programmes, one to one mentoring, activities and events, young people can learn a new skill, gain confidence, overcome anxiety, gain a qualification, meet new people and lots more. How imagery can make or break your business Award winning Dorset photographer Anna Klesse asks: How important is PR for your business? How important is your reputation? So the next one: how do you take care of it? If we think of social media, website, merchandising – what kind of visual materials do you put in there? Is it your face, your premises or products? Is it a professionally looking image? Does it say ‘I am professional’ or ‘I am starting out, I don’t have money (or don’t want to invest) but I have an amazing product’? I want you think outside the box. I was always fascinated by how easily advertising can manipulate people. PR is a bit of manipulation, if you think that you are presenting yourself with ‘the better’ side; mentioning positive features and not failures. You curate the content and either build your reputation or ruin it. I have few examples of companies, that had a ‘privilege’ to experience the latter. How carefully curated content ended badly, how uncurated went viral, how did it harm

the company – or elevate it. I can present plenty of examples, but I want you to look at your imagery. First impression matters, we take care for our clothes, shoes, bags. We don’t treat our business images online as our business card 100% of the time. And we should! You never know who will see it. It is public. What is management liability insurance? Imagine this: after years of research and saving you decide to start your own business. Things are a little slow to begin with, but after a few months, it starts to take off. A couple of years later your business is incredibly successful, backed by a team of dedicated, hardworking employees. And then, someone makes a claim against your director and you lose everything because you aren’t protected by Management Liability Insurance (or Directors’ and Officers’ liability/D&O). It’s a sobering thought but, unfortunately, it can happen to any business regardless of its size or industry. Generally speaking, claims and legal proceedings can be brought against a director or officer for any decision made or act carried out within the workplace, however innocuous it may seem at the time. Claims aren’t just made by customers; they could come from regulators, shareholders and investors, as well as from employees. There are many reasons for a claim, such as a breach of trust or duty, wrongful trading, neglect, accounting and fraud issues or breaches of health and safety regulations. The director or officer needn’t even be actively involved in the incident; if the court believes they should have known what was happening, they’ll still be held liable for negligence. In order to mitigate risk posed by these claims, businesses have taken out Management Liability Insurance. This provides protection by covering legal costs to help defend claims and will pay out costs in the event of an unsuccessful defence. Some businesses wrongfully assume that Professional Indemnity (PI) provides full protection of their assets and employees. However, PI merely protects a business when someone makes a claim that they received substandard advice and/or poor service. Management Liability, on the other hand, protects a business in the event of claims made in relation to how the company has been managed.

With sustainability and environmental awareness more important than ever, businesses are being encouraged to minimise their environmental impact where possible. This even caught the attention of Local Member of Parliament, Steve Brine, who was keen to find out more about Condor’s green initiative and visited the head office to investigate. Steve was keen to find out how Condor planned on using the e-Bikes to reduce their impact on the environment. Whilst it may be a step too far to use the eco-friendly e-Bikes to deliver and install 150kg photocopiers – they will be perfect for local customer visits and toner deliveries. With an impressive range of 62 miles, Condor expect to

Buildings Sum Insured: Why Check? Buildings should always be insured for the amount it would cost to rebuild them. However, fewer than one in ten household and commercial properties in the UK are covered correctly.

et’s begin with overinsurance which affects around one in five homeowners, it’s true that it is better to be over-insured than under-insured. You’ll find out why in a moment. However, if your home is over-insured, on average you could be paying around 20% too much every year for your household

buildings cover. Over the years this unnecessary expense can seriously add up. Now the big one… Underinsurance can have far more severe consequences. This is because insurers have something they call the “Average Clause”. Sounds complicated, but it’s not. Here’s how it works: Let’s say your home or commercial property is insured for £600,000, but the actual cost to rebuild should be £1,000,000. Here, any insurance claim you make for the property could be reduced by 40%. That’s an awful lot of money you will

need to find to rebuild your property following a major incident, such as a fire that completely destroys your home or premises. For some homeowners, a reduced claims payment as a result of underinsurance has meant they’ve had to significantly down-size their property and for some businesses it means the end. Superior, a leading manufacturer of high integrity o-rings and seals based in Dorset, has presented Natasha Nichols with its ‘Apprentice of the Year’ award.

Natasha is currently a second-year apprentice at Superior who has worked across a number of roles and departments within the business including tool making, robotics, rubber technology, analytical chemistry, logistics and sales. She has been credited for her hard work and willingness to learn new skills to expand her remit within the firm, and was awarded the trophy by managing director, Tim Brown, in front of her fellow apprentices. Natasha is keen to act as an ambassador for apprenticeships and has previously appeared on a live BBC News broadcast from Superior during the annual National Apprenticeship Week campaign. The 20-year-old will be heading to study a chemistry degree at Southampton University in September which is fully-funded by Superior as part of its commitment to help the apprentices to progress in their roles within the company. Natasha said: “I am honoured to receive this award and greatly appreciate it. My development through the company has been supported by both the Academy and my parents, and I could not have come so far without the help and support I have been given during my time in each department. I have enjoyed every bit of my apprenticeship so far and look forward to the next stage at Southampton University and my future at Superior.” The ‘Apprentice of the Year’ award has been in place at Superior since 2009. The company initiative was introduced to help motivate its apprentices and reward significant progress. The first award was given to Bradley Hicks in 2009, who is now the maintenance manager at Superior. An efficient business trip begins way before any ticket is booked or any luggage is packed. Although we appreciate some of those last minute business trips can’t be pre-empted, we know that a lot of business travellers are used to be being on the move and therefore can plan their trips in advance. Keep your routine up Working away from home shouldn’t mean that you deviate from your usual routine, in particular fitness and leisure activities. Make time to suss out how you can keep up your usual fitness routine and wellbeing activities that will help make sure that you don’t let what you enjoy, and what’s good for you slip. Pack for some downtime, a change of clothes, fitness gear, your favourite PJs! Whatever it takes to get a bit of ‘me’ time while you’re away. 5. Bring a pre-charged phone charger Since calls and emails can drain batteries very quickly, advice for business travellers would be to keep a portable USB charger handy. The 11th (Royal School of Signals) Signal Regiment is the latest military sporting group to secure the backing of the company that is headquartered in Poole, Dorset. Criminal lawyers team up again at Ellis Jones Watch out – the boys are back in town! Specialist criminal solicitor Ian Daly has teamed up with former boss Jonathan Morrissey at Dorset law firm Ellis Jones. Why GDPR is sexy... I mean awesome By Mark Gracey

I fully get that compliance in general, let alone, data protection or GDPR, is not on the top of most peoples “interesting things to know about” list, but at a recent Dorset Chamber lunch (which I co-sponsored) I used “sexy” as a word to describe GDPR, asking the audience “is it just me that thinks GDPR is interesting and sexy?” – judging by the laughter, I guess, in that room at least, it probably is! Certainly “sexy” and “GDPR” aren’t words you’d expect to find in the same sentence, and just to clarify I meant sexy in its informal or slang form, meaning awesome or interesting… I stand by my use of the word, and here’s why. On the face of it GDPR is pretty black and white: you can do this… with personal data; you can’t do this… with personal data; make sure you allow data subjects to do this… with their personal data. The regulation, and the UK’s Data Protection Act 2018 which also implements aspects of it, are after all a set of rules set out in law, but where it gets interesting (or “sexy”) is the individual application of those rules to the varying types of scenarios or organisations when personal data is being processed: that’s a real challenge for anyone, and that’s what I love about GDPR and privacy law. So, by way of example, let’s consider the GDPR rules that apply to data breaches. The GDPR says: “In the case of a personal data breach, the controller shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal data breach to the supervisory authority competent in accordance with Article 55, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons. Where the notification to the supervisory authority is not made within 72 hours, it shall be accompanied by reasons for the delay.” (GDPR, Article 33(1) “Notification of a personal data breach to the supervisory authority”) That seems pretty black and white: so, in the UK, if you suffer a personal data breach you have 72 hours, once aware of it, to decide whether you need to tell the ICO (the Information Commissioner’s Office is the UK’s “supervisory authority”) because there is a risk to the data subjects. But, there’s more to it than that: for example, what constitutes a “risk” to the data subjects that would require you to report it to the ICO? If you then look at the guidance that’s available about what constitutes risk, then that may be physical harm to the data subject, financial harm, mental distress and so on, and the level of harm will depend on the context of the processing. The breach of some names and emails from a manufacturing company selling widgets will be a different harm, than the breach of some email and names relating to attendees at a sexual health clinic, for example. And this is where, as a data protection specialist, it gets interesting. It’s not just about interpreting what the rules say – yes you need to understand the rules, but you also need to understand the context of the processing, think hard about how the data subjects may be affected by the breach, about the implications for the data controller (the organisation who is processing the data), of what notifying the ICO will mean, let alone dealing with the ICO when more news online - www.dorsetchamber.co.uk/news

they decide it needs investigating. So, on the face of it the GDPR is a set of dos and don’ts but there’s much more to it than that, whether you see compliance as a nuisance or just EU redtape, and for lots of people that’s what makes it dull – they may never need to worry about dealing with the ICO, or they may never face a data breach, but just thinking about what constitutes a personal data breach in itself is much more complex than someone stealing your data which is what makes it challenging, interesting, awesome and sexy! Furthermore, the rules or their interpretation don’t stand still. Every time the ICO deals with a breach of the law, it considers what it believes is the right interpretation of these rules, so buried within the enforcement notices are little helpful nuggets to help you understand how you should be interpreting specific aspects of the regulations and those nuggets may be about specific elements of data protection (e.g. what the security principle really means in practice) or they mean how a particular sector or industry should be implementing those rules. Ever since the ICO started enforcing data protection back in the 1980s their guidance notes, codes of practice and enforcement notices are littered with helpful insight into just how compliant you need to be. At the same Dorset Chamber lunch, where I said data protection was sexy, I asked the attendees if they’d heard about the ICO’s intentions to fine British Airways £183m and everyone put their hand up; I asked about the £99m Marriott fine and again most put their hand up, but when I asked if they had heard about the £80,000 fine of an estate agent the week before, only 1 or 2 of the audience (of about 70 people) had heard about it. And herein, lies the problem – with the world of data compliance constantly changing from interpretation to case precedent (e.g. a court case or the ICO’s enforcement notices) how do you know you’re up to date and not missing any of those important nuggets of compliance information whether the “offenders” are in your market sector or not? Particularly if you’re relying on the mainstream media to keep you updated and informed! The irony of the BA and Marriot cases are they are just intentions to fine, not actual fines and therefore we’ve not seen the enforcement notices with all the interesting detail, unlike the estate agent case where we have plenty of information. There’s still useful information to be taken from these big cases: the BA fine appears to be about 1.5% of turnover, so does this mean the ICO are looking at this a fining benchmark? The Marriott case relates to a company they acquired that had insecurities and the ICO have criticised the due diligence procedures during the acquisition as not being adequate, so evidence you could be liable even for a past event you had nothing to do with… In the estate agent case, basically, they’d left personal data records on an insecure server for two

years and didn’t notice they had until a “hacker” told them he had their records and would go public if they didn’t pay a ransom. The ICO makes it clear that this is a breach of the security principle in data protection, but sets out that there was no evidence the estate agent carried out penetration tests or monitored access logs for the server, which would have highlighted unauthorised access or the weakness in access security. Do you check the access logs for your systems? Penetration test all the places where you store your data? And if you’re thinking that’s OK we use third-parties to store our data (e.g. cloud services), how are you sure they have appropriate security in place to protect your data and how do you demonstrate you know they’re secure? – you’d still be liable if they’re not... So, these ICO cases, are interesting too, not least of all because of the nuggets of information buried within their investigations giving away the actions you should be considering, to make sure you meet the ICO standard of compliance. So, what should you be doing? You can rely on mainstream media to report the high-profile cases, but you’re not likely to relate to them – you probably aren’t the size of BA or Marriott and the reports will focus on the size of the fine, not the substance. You might, however, be nearer the business size of the estate agent but they never make the news (outside data protection experts), so how do you know what you need to worry about and how are you keeping up to date? Whether it’s enforcement notices and their interpretation of the law or new guidance from the ICO, from the EU regulators or wider afield, you have no choice but to pay attention to all sources of enforcement and best practice. That means, reading ICO guides (when they update them) and enforcement notices, or spotting that the EU has published specific guidance on a GDPR topic. And, if you’re not finding data protection interesting or sexy then it’s unlikely, you’ll be interested in keeping track of all of this – you’ve got a business to run, after all! How social media is shaping sports Since the inception of social media, it has worked its way into every element of our day to day lives. Whether that be interacting with friends and family, booking holidays, shopping for clothes, allowing an insight into different lifestyles and it has definitely affected the world of sport: the way that we consume sport, the interaction with sports stars and the changes in advertising with the use of sports stars. Gone are the days where you have to wait until the evening news to find out the updates on the latest games, transfer and trade news. In today’s world you can get push notifications the second that a goal goes in or a buzzer beater is made. You can watch the games from all over the world straight from your smartphone and with the likes of 5G, you won’t even need to be connected to wifi. This ability to know everything that is happening without even being in the stadium has not only brought more eyes to sport, it has also driven more conversation surrounding sporting events, with a lot of this taking place on social media. Why Social Media is Important to Sport? At the end of 2017, football club Manchester City became the first football club to hit one million YouTube subscribers. Within the same year, City launched their own digital platform -- ‘Cityzens’, whilst their city rivals Manchester United unveiled their own in-house ‘MUTV’ app. These are just two examples of two of the biggest sports clubs in the world, in the same location looking at the new digital world we all live in and change their business approach to adapt to it. There has been a shift from club newspapers, magazines or physical programmes and moved more towards announcements via social media, whether that be announcing the team on Twitter, unveiling the new kit on Instagram or fulfilling a commercial sponsor deal on YouTube. Social media has also become very important for sport because it has allowed both athletes and sports teams to control the narrative more than ever before. Before social media, it would be very difficult for a sports team or an athlete to refute anything that was said about them in the media, whether it be a trade rumour or a story about something they had done. Whereas now, athletic stars can have their say and set a story straight before it becomes mainstream news, the most recent example of this was French football superstar Kylian Mbappe who was rumoured to be pushing for a move from his current club Paris Saint Germain to Spanish giants Real Madrid. Mbappe responded to a Tweet, trying to set the story straight before adopting the phrase coined by President Donald Trump: FAKE NEWS. Social Media Influencers in Sport Influencers in the sport industry are different from a lot of other industries because they can consist of the usual influencers that have made a name for themselves on platforms such as Instagram and YouTube, however, within the sporting world, a lot of the athletes themselves become the influencers and are paid millions of pounds by brands to represent them, their products or to go to their events. The magnitude of sports on the economy is such that it isn’t just sports companies that want to be involved with sports influencers. It is much more far reaching than that and there are many examples of titans of other industries becoming involved with social influencers and sporting events to promote their brand. 46

How Sport and Social Media will Intertwine in the Future One of the biggest changes that this new age could bring about is the look of the players of the future. The next generation of ‘athletes’ may not be the sports stars of today that are in peak physical condition, but are as likely to be regular men and women who take part in competitive gaming. With the increasing stronghold that technology has in the sports world, there is no reason that competitive gamers won’t be considered athletes in the future. There is also reason to believe that this new wave of ‘athletes’ are here to stay as sports bodies continue to embrace and push esports. An example of this was the first ever E-Premier League that took place in March 2019 -- the E-Premier League was a tournament featuring representative fans and gamers of all the Premier League Clubs playing against each other. Each representative was spoken about by the club on their social media with lots of content being pushed out by each club, showing that they take it seriously and see it as a new revenue stream or they are simply adapting to the ever changing times. Esports is growing even faster in the United States and there are estimations from Syracuse University’s online MBA program that esports will have more viewers than every professional sports league apart from the NFL by 2021. The researchers at Syracuse University project that there will be 84 million viewers of esports, this is higher than both the 79 million viewers of the MLB and 63 million NBA viewers, if this estimation becomes reality. He was later assigned military number 571 9357 and served in the second Battalion of the Dorset Regiment. Mr Bamlet commented: “I am astonished how much information can be gleaned from this old trunk. I do not know precisely how it came to be in one of my farm buildings, but my family have been farmers in this area for so long that there must no doubt be some kind of connection. I am very impressed that the museum can provide this sort of detailed information and I’m delighted to donate the trunk to the Keep Military Museum.” Christopher Copson added: “The Keep Military Museum is pleased to receive this artefact to join the very large collection of local and international historical artefacts in the museum available to be viewed by the general public. We are most grateful to Mr Bamlet for his gift of the chest and for an additional donation.” James Selby Bennet commented: “I am very pleased to have been able to assist in this matter. It is an interesting example of the very strong links between the military life of our county and the civilian and rural life of Dorset. Two out of three ain’t enough, Mr Loaf Jacqui Purdy, Executive Coach and founder of Here to There, looks at three distinct but connected modes we should adopt in making big career and business decisions “I want you, I need you, but there ain't no way I'm ever gonna love you. Now don't be sad, cause two out of three ain't bad” When we’re dealing with big career and business decisions, there are three distinct types of behaviour that we need to adopt in order to properly evaluate our choices. I characterise these three modes as: Reflection, Exploration and Action. And, contrary to Meatloaf’s famous dictum, we can’t just skip one of them and still expect things to play out as we’d wish. Each mode calls upon different aspects of our personality, and the best outcomes are achieved when all three are engaged, informing and supporting each other. Reflection – untangling the intangibles This is all about working out what really makes us tick. You may think you know yourself pretty well by now, but do you really understand the fundamental values and beliefs that drive your behaviour? It’s surprisingly easy to go through life without questioning some of the core assumptions that lie behind the decisions we make. Habit, the expectations of others, anxiety borne from uncertainty – all of these can work to mask our deeper motivations. It pays to look beneath the surface, to ask what’s truly important to us and understand how our personal attributes can be applied most effectively to getting to where we want to be. Otherwise the foundations of our decision-making may prove to be unsound.

Exploration – mapping the decision-making terrain If Reflection is about looking inward to find greater self-awareness, Exploration looks outward to establish what our options are. These might appear obvious on first inspection, but it’s important to throw off the blinkers at the start and be receptive to ideas that a closed mind would not consider. Applying lateral thinking and imagination can reveal new paths that can be genuinely life-changing. As we gather more information we can narrow the options, evaluate them and work out what real-world choices we should make. Operating in Explorer mode can be exciting or scary – and often it’s both – but it’s a necessary precursor to entering Action mode. Action – a plan without execution is just a wish So we know who we are and what we want, so what’s stopping us? Action mode is the simplest to understand, and looks like the easiest to get behind, but the gap between plan and execution can be a hard one to bridge. Good old-fashioned procrastination is a common problem. Almost everyone procrastinates from time to time and up to 20% of us identify as “chronic procrastinators”. (If this includes you, check out Piers Steel’s Procrastinus.com website or get his book, to understand why it happens and what you can do about it.) Despite this, Action mode is the default setting for many people. This is partly because society values action (or the appearance of action) over inaction,

and partly because Reflection and Exploration require us to think – and thinking is hard work. Action without Reflection and Exploration can still lead to a decent outcome, of course, but it relies on luck as much as judgement. And if you haven’t tested your internal criteria for “success”, you may have a great result on paper that still leaves you feeling unfulfilled. Three out of three is definitely good As Daniel Kahneman has said, “the effort invested in ‘getting it right’ should be commensurate with the importance of the decision.” So don’t take short-cuts when it comes to life’s big decisions. Even if the answer looks obvious, make sure you take some time to reflect and explore before acting.

Brexit and Bournemouth Business: What Does the Future Hold?

T

he voters of Bournemouth made their feelings on continued EU membership pretty clear in the referendum, voting 54% Leave, 46% Remain. A lot has changed since then. We’ve seen the occupants of 10 Downing Street change three times, Sterling’s value decline and fall, financial markets - including insurance – experience massive movements, leave deadlines come and go, and politicians’ stances on what is achievable change on almost daily basis. But now with a new Brexiteer PM, a proudly pro-Leave cabinet, a looming – and apparently immovable – exit date of the 31st October, the Brexit saga looks set to end. But what does Leave mean for Bournemouth’s businesses and the wider region’s economy? What will happen to the local property market – for homes, holiday homes and Bournemouth’s landlords’ rental properties? In this latest blog from Coversure Poole, Bournemouth’s leading business and property insurance brokers, we’ll look at the evidence and see whether Brexit means boom or bust for Bournemouth… Financial Services Most outsiders think that Bournemouth is all about tourism, holiday homes and hospitality. Now while the town is great at all these things and they all contribute significantly to the local economy, the largest private employer is the American bank, J P Morgan. With over 4,000 employees at its Chaseside base and countless more jobs dependent on its employees, any threat to its future is a threat to Bournemouth’s future. And that, sadly, is what Brexit means. Tobias Elwood has stated publicly that a no-deal exit could lead them to ‘think about departing Bournemouth.’ J P Morgan’s CEO Jamie Dimon said the company’s future in the UK would depend on the “passport” arrangement which allows banks to sell services throughout the E.U. If we see the recent hardening of attitudes continue and the UK leaving without a deal, then the consequences both locally and nationally could be severe. And its not just those in the financial services sector that could be hit. The jolt of a no-deal would create turmoil on the currency markets with Sterling dropping like a stone as it did in the aftermath of the result’s announcement and a likely fall in the stock market. Such outcomes would affect everything from pensions to holidays. Even 48

insurance quotes could be impacted. Many insurance companies are large multinational corporations and if they feel their financial positions are threatened then premiums could rise and they could become much more risk-averse. No-Deal Brexit: More Project Fear? Of course, if the last three years have taught us anything it’s that Brexit has generated more scare stories than Stephen King. The recession, the emergency Budget, Frankfurt replacing London as the finance capital of Europe, none of this has come to pass. The reality is that moving 4,000 employees – even for someone the size of J P Morgan – isn’t easy or desirable. A no-deal could well force their hands, but even in that situation it would take time; time that could be used to secure an arrangement with Europe on a different relationship. That’s the hope anyway. Tourism Tourism is big business in Bournemouth. According to the Council, in 2015 28.5m visitors contributed £1.8bn to the local economy helping it to provide 12% of local employment. Figures from Visit England suggest that 50% of all visits to UK coastal resorts are from EU nations – most notably Germany and France. So, what will happen when we leave? Two scenarios immediately present themselves: Decline – a weak pound makes the UK as a whole an expensive destination for European travellers. There’s also the ‘sadness’ or ‘hostility’ toward the UK’s leaving that may deter further potential visitors who will look to other European destinations and, going with the long-term trend, favour city breaks instead. Rise – what the 2015 tourist figures reveal is that domestic tourism actually accounts for more revenue nationally than that from overseas visitors. Domestic trippers spent £66bn versus £19bn by foreign

visitors. They also noted a trend in domestic overnight trips in England and tourism is growing steadily across holiday, visiting friends and relatives (VFR) and business travel. This growth is set to continue and see a 3.8% increase by 2025. Since Brexit began, there’s been a fall in demand for European holidays and if visas were required post October 31st then that would likely make places like Bournemouth even more attractive. Bournemouth’s Property Market In areas as lovely and desirable as Bournemouth and holiday home paradise Poole, we’ve seen the property market buck the national trend and keep on rising. From April 2018-2019 price growth was at 2.4% according to the Nationwide. Growth is slowing, however, and since April prices have slid 0.2% each month. Now while such declines can hardly be called a crash, they are indicative of the concerns many have over Brexit. So, what does Brexit mean for the region’s property market? Again, this is dependent on the sort of Brexit we get. If we leave in an orderly fashion then the omens are good. As business finally sees certainty so investment will be released, the likes of J P Morgan can stand their relocation plans down and property owners who’ve put moves on hold will feel free to go ahead. In short: the property good times can roll again. A no-deal on the other hand could have serious effects. A disorderly exit on the 31st will prove a massive shock to the global markets – that’s something everyone seems to agree upon. In the short-term interest rates are likely to climb as Sterling dives, businesses will be handed more uncertainty and the property market will slow as mortgages become more expensive and harder to come by. Longer-term thigs will recover – they always do – but the ride may be bumpier than crossing to Cherbourg in a January gale.

International Trade The clarion call of pro-Brexit politicians has always been that Britain is a trading nation and that there are nations queuing up to do deals. Australia, the US, Japan and South Korea have all made favourable noises regarding deals and in time these should become a reality. So how will local international traders fair come 1st November? Let’s look at this from Sunseeker’s perspective. Sunseeker are arguably Poole’s most famous business and exports are key to their success. Recently – and in no small part helped by Sterling’s slump – they have returned to profit and have big plans for the future. A no-deal Brexit with its attendant currency devaluation could mean an even greater competitive advantage in places such as the US, Middle East and Far East, their key export markets. As with so much with Brexit though, it’s not that simple. Tariffs, border movement problems, immigration restrictions and export delays are all possible things which could really hurt the business. Then there’s the potential global economic impact of a disorderly exit: bankers, financiers, investors and the like are likely to feel the turbulence most acutely – the same group who are Sunseeker customers. What Does the Future Hold For Bournemouth Post-Brexit? With its buoyant property market, exposure to international finance and trade, proximity to the Continent and the support it has received from the EU, Brexit will have an impact on our region. How radical that impact will be depends largely on the manner in which we leave. Leave with a deal and it could be business as usual – even more business as usual. Leave without a deal and the waters look a lot murkier, at least in the short-term. One thing that we can be sure of is that we will survive and thrive. have spent some time with a Volvo like no other I have ever driven. Forget the large estates favoured by antique dealers of old and the excellent SUV range the company has become famous for of late. The Volvo S60 T8 Twin Engine AWD Auto Polestar Hybrid is the new rapid saloon that looks mild but delivers a punch from behind the wheel. This car has been tweaked by Volvo’s performance division Polestar and produces 415bhp combining a turbocharged and supercharged four-cylinder petrol engine with a powerful electric motor. In short …. It’s quick, very quick 0-62 can be achieved in 4.3 seconds and you can feel that power.

Inside it’s what you’d expect from a large executive saloon, the latest style large touch screen is not dissimilar to the ones found in a Tesla. There is every possible safety gadget you can imagine, including a clever sensor that warns you if you are reversing out of a car parking space and a vehicle is coming towards you. There are various driving modes but I must admit I left the car in the sport mode most of the time. Although none of the gadgets are unique, many can be found in cars from BMW, Mercedes and Audi there is a sense of exclusivity from behind the wheel. Now to the cost, you won’t get much change out of £50,000 but most will business lease which

The MPG is excellent, using the Hybrid mode I managed 104.4mpg using the battery power in town and a mixture on faster roads. What is worth bearing in mind is that without the battery the car manages 34mpg on petrol alone which is still respectable. Overall this is a seriously quick car that has a stealthy look and yet with a low BiK rate (around 13% is expected) and CO2 of 42g the future of fast business motoring appears to lie with electric hybrids.

VAT experts prepare the construction sector for looming changes VAT specialists at PKF Francis Clark are urging those in the construction sector to prepare for the significant VAT changes that are being introduced this autumn, which will alter the way that VAT is collected for many taxpayers. These changes come into place as HMRC implement measures to tackle and crack down on VAT fraud in supply chains. The VAT domestic reverse charge, known as the reverse charge, for building and construction services is being introduced from 1 October 2019 and will mean that customers receiving ‘specified supplies’ will now have to account for VAT, instead of paying it to the supplier. Going forward, the supplier of specified services will not charge VAT on their sales invoices and instead the customer will be responsible for accounting for the VAT. The reverse charge prevents suppliers charging VAT to their customers but not paying it over to HMRC. Under the reverse charge, the customer can recover the VAT, subject to the normal rules for VAT recovery. For most businesses this is likely to result in a nil net effect on the customer’s VAT return since they will be accounting for the VAT and recovering the same amount on their VAT return. It is important to note that the reverse charge will only apply to businesses registered for VAT in the UK that supply ‘specified services’ that are reported under the construction industry scheme (CIS). Supplies to an ‘end user’ will not be covered

by the changes and VAT should be charged in the normal way. End users will usually be those customers who use the building or construction services for themselves, rather than sell the services on as part of their business’ activities. Cash flow could be impacted for some taxpayers who may want to consider switching to monthly VAT returns. So, what will the industry look like in the short and medium term, is it all doom and gloom on the high street or is this an industry changing shape with new channels driving growth as the old channels decline and retail is transformed. • Retail, an industry under pressure • Margins constricted by weakening demand and rising costs; • Record levels of discounting; • Store closures; • Consumer confidence falling; Channel change. The challenges facing the retail and leisure sectors on the high street are plain to see. The continued rate of store closures reflects the shift in public spending and the new reality that many of us prefer to shop online and eat, drink and entertain at home. The high street is adapting to an overcapacity in retail and leisure space resulting from these channel shifts. Those retailers embracing the shift from a store-based past to incorporating a digital future are reporting improving results but it appears that the slow to adopt are facing a more challenging future.

In addition to the closures in the retail and leisure sectors, many traditional store-based service businesses, such as banks, estate agents, recruitment agencies and travel agents, have continued to move online, albeit their rate of closure has slowed as fewer of these types of business remain on the high street. The high street is in urgent need of new ways of thinking and new forms of retail. It remains to be seen if recent packages of support for the high street and reductions in business rates for smaller retailers will be sufficient to stimulate this. To attract and retain customers many factors need to be taken into account, a number of which are born out by current trends that indicate retailers must acknowledge that consumers want to experience a seamless shop between the physical and the virtual, the bricks and mortar and the on-line. A strong on-line offer together with well presented, conveniently-located stores maximises revenue opportunities. Also, there is growing movement towards ethical consumption, sustainability is very much to the fore, with increasing numbers of shoppers becoming more selective in what they buy, where they buy it, and looking at how retailers source product. Certain retailers have picked up on this and responded with their own initiatives to correspond with the consumers’ increasing focus on the ‘Environment

3 R’s - reduce, recycle and reuse’ , careful in what they buy, where they buy it and how they choose to spend. Turmoil in the sector is unlikely to abate. Insolvency in retail, particularly those retailers unable to substantially reduce their cost base, is on the increase with more (often headline making) administration and CVA appointments being made. Michelle Breslin, partner at TRI Group Bournemouth office, who specialise in helping financially distressed businesses, said: “The changing UK high street raises questions which need to be addressed by retailers and leisure operators about how to take their business forward and ensure they remain fit for purpose. Adjustment to business models and concepts to meet evolving consumer habits and trends, restructuring and new investment must be addressed and in the current climate, immediate answers are required”. “The number of distressed businesses this year has led to an increase in company voluntary arrangements. We believe that CVAs can be helpful restructuring tools but alone are insufficient as research shows a significant percentage failed, leading to another insolvency process.
