Local developer hopes to build new mixed-use building on Broadway

N

ew development isn’t just coming to Lower Broadway and the Square: an Everett developer is hoping get the zoning board to sign off on a mixed-use modern apartment building at 605 Broadway.

Local developer Greg Antonelli purchased the Victorian building at 605 Broadway and its 9,885 sq. ft. lot for $700,000 and in April. The building, built in 1900, formerly housed the offices of dentist Al Mavilo on the first floor.

by Matarazzo, who retired at the end of June after serving in the role for over a decade. Cornelio argued that his ability to “step right into the job” made him the best candidate for the role.

In the initial round of voting, Councillor-at-Large John Hanlon voted for Febbo. After it became clear that Cornelio was the overwhelmingly favorite, however, Hanlon asked that his vote be changed to a “yes”, making the roll unanimous.

Cornelio thanked the council in a brief speech after the vote, saying that he was“humbled”by the appointment.

“I promise to work harder and harder to be the best city clerk I can be,” said Cornelio. “I don’t intend to be John Hanlon or Mike Matarazzo. I intend to be my own man, but I’ve learned from them.”

Cornelio also thanked his family, as well as Matarazzo, whom he said had “been the most tremendous help over the last two year getting me prepared for this. I didn’t expect him to leave this soon, but I am ready for this task. I’m ready to move the city forward and help forge this community. There’s a lot of work to, but it’s going in the right direction.”

State Senator Sal DiDomenico was also on hand to congratulate Cornelio – and the City of Everett – on the selection.

“He has been a person that a lot of people have relied on over the years,” said DiDomenico. “He comes from a great family. It is a proud moment for our family to see him rise up through for the ranks, and also for us who have known him for a long time.

Cornelio was appointed Assistant City Clerk in late 2015. He previously served as a common councillor.

Mayor encourages residents to attend Malden River Greenway meeting on August 8

T

he Mystic River Watershed Association (MyRWA), in partnership with the cities of Everett, Malden and Medford, is undertaking a visioning process for a waterfront park system with connected paths, new amenities, and vibrant open spaces along the Malden River. Mayor Carlo DeMaria encourages Everett residents to join the second public meeting â&#x20AC;&#x201C; on Tuesday, August 8, from 6:30 - 8:00 p.m., at Riverâ&#x20AC;&#x2122;s Edge, which is located at 200 Riverâ&#x20AC;&#x2122;s Edge Drive in Medford â&#x20AC;&#x201C;which will include a workshop featuring early design concepts for the greenway plan.

In a 2016 meeting, Mayor DeMaria, discussed his vision for the Malden River, including increasing access to the river with canoe and kayak launches, fishing piers, bike paths, and new parks, such as the River Green Park at GE. His administration is currently working with the Friends of the Malden River, MyRWA and MIT to ex-

The DeMaria administration is working on several projects that involve connecting the walking/biking path network around the Malden and Mystic Rivers. He and his team are also working with MyRWA, Wynn Development, National Grid, the Massachusetts Department of Conservation and Recreation (DCR) and the Massachusetts Department of

Transportation (MassDOT) to create a complete system of pathways along the Malden River and use the new Woods Bridge on Rte. 16 to connect to Wellington and Riverâ&#x20AC;&#x2122;s Edge Park in Malden.

Mayor DeMaria stated, â&#x20AC;&#x153;The Malden River is a hidden gem in the City of Everett. Working with our partners at the Mystic River Watershed Association, we can open up access to the river, create recreational opportunities and encourage development along the river which will complement those activities. Now is both a critical time for the river and for our community. Phunk Phenomenon promotes positives of Hip-Hop Talented crew head to International competition in Arizona

F

or the past 15 years, Reia Briggs-Connor and her husband Rick have been teaching students as young as three years old the art of hip hop dance.

In addition to dancing hiphop since she was three years old herself, Briggs-Connor also spent three years as a cheerleader for the New England Patriots.

In 2002, she and Rick opened their first Phunk Phenomenon studio at 1760 Revere Beach Parkway in Everett. The opening of their Peabody studio, located at 201 Andover St., followed in 2012.

Some of the classes offered include Baby Hip Hop and Breaking, Advanced Breaking and Tricking, Ballet and Contemporary Dance as well as Salsa.

Briggs-Connor said that on Aug. 5, she and six groups of dancers between the ages of six and 30 will be travelling to Phoenix for 11 days for this year’s International Hip-Hop Competition.

“It’s the Olympics of hiphop dance,” she said, adding that they have participated in the competition in prior years.

Emphasizing the positive aspects of hip-hop, Briggs-Connor said Phunk Phenomenon aims to dispel the negative stigma that is often associated with this style of street dancing.

Briggs-Connor also said that she and Rick established Hip-Hop for Hope after learning that their son, Jared, who was two at the time, had been diagnosed with a rare genetic disease called Sanfilippo Syndrome.

Briggs-Connor said not many people are aware of the disease and those who have heard of it assume that it is some form of Autism.

“It’s worse than Autism,” she said.

However, Hip-Hop for Hope continually strives to make an impact.

“All the dancers are philanthropists,” said Briggs-Connor. “I decided to use what we had as a tool, we always make it a point to talk about the disease.”

Briggs-Connor said anyone who walks into Phunk Phenomenon will find that it does not share many parallels with conventional dance studios.

“It’s not as structured as the traditional dance studio,” she said, adding that her students are free to come to class wearing sneakers and sweatpants. “The type of dancing we do is realty energetic, it’s

Established in 2004, Lil Phunk has done performances for KISS 108, the Cystic Fibrosis Foundation, Puma, Disney and Hasbro Toys.

In addition, the Lilphunk Boyz were ranked number one in the world at the HipHop International World Championships in 2009. In 2010, the Lilphunk Boyz were ranked first in the country while the Lilphunk Girlz were ranked third in the country

structing the Ella Jade O’Donnell South Memorial-Passos Avante Playground, complete with elephants and ladybugs, two of Ella’s favorite things.

Everett man sentenced for armed bank robbery B

OSTON – An Everett man was sentenced on July 27 in federal court in Boston for armed bank robbery and firearms offenses. Joseph G. Rachal, 65, was sentenced by U.S. District Court Judge Nathaniel M. Gorton to 101 months in prison and three years of supervised release. On April 27, 2017, Rachal was convicted by a federal jury of armed bank robbery, using a firearm during the commission of a crime of violence, and being a previously convicted felon in possession of a firearm and ammunition.

On Nov. 19, 2015, Rachal entered a branch of TD Bank in Brighton, removed a black semiautomatic handgun, pointed it at the tellers and ordered them to turn over cash

from the drawers. Rachal exited the bank with $2,397. When law enforcement arrived minutes later, they observed him hiding behind a parked SUV one block from the bank.

When the officers approached the vehicle and identified themselves as police, Rachal ran away while carrying a black nylon bag. When officers caught him, they searched his bag and found an active scanner tuned to a Boston Police radio frequency, a 9mm Glock semiautomatic pistol with one chambered round and a magazine containing 14 additional rounds, an additional magazine containing 15 rounds of 9mm ammunition, and $2,397.

Bank surveillance cameras captured images of the robbery, and the items recovered

from the bag Rachal was carrying were consistent with the items observed on the video.

The announcement was made by Acting United States Attorney William D. Weinreb; Harold H. Shaw, Special Agent in Charge of the Federal Bureau of Investigation, Boston Field Division; Boston Police Commissioner William Evans; Brookline Police Chief Daniel C. O’Leary; Sharon Police Chief Tilden S. Kaufman; and Barnstable Police Chief Paul MacDonald. The investigation was conducted with the assistance of the FBI’s Violent Crime Task Force. Assistant U.S. Attorney Kenneth G. Shine of Weinreb’s Major Crimes Unit prosecuted the case.

Pantapas described Ella as being “smart and sassy.” “Even as sick as she was, she was always smiling and laughing,” said Pantapas. “She came to school every day she was able, and when she could no longer go out at recess she spent her time reading to the preschoolers.”

Julie Butt, who was also a member of the Playground Committee, said it is unusual to be able to build an entire playground within six months.

However, she said time was of the essence, particularly for those students who will be moving on to Higgins Middle School in the fall. “The kids needed closure,” said Butt.

In addition, Butt said Ella did not falter despite enduring multiple rounds of chemotherapy. “The kid never missed a day of school,” she said.

In Ella’s memory, Butt said, for $100 residents can have a 4 x 8-inch brick engraved on the memorial patio.

Mayor Carlo DeMaria was on hand to support Ella’s father, Dennis, an Everett police officer. The City of Everett donated a bench for the playground.

“The Cities of Peabody and Everett came together with the family and friends of Ella O’Donnell to dedicate a playground in memory of Ella. She was the light to so many people,” said DeMaria. “There is a saying ‘there is no foot so small that it cannot leave an imprint on this world.’ That is so true of Ella. She was the strength of so many people and she is and will be greatly missed.”

City Council President Anthony DiPierro was also at the event, stating, “sometimes it takes a very unfortunate circumstance to teach you the value of life. I can certainly say Ella taught me and so many others what was important in life. I know her spirit is alive and well, and this playground will keep her memory strong for years to come. We all love and miss you Ella Jade. And we are Ella’s Army forever!”

“Both the Everett and Peabody communities came together to show their love and support for a courageous young girl and her amazing family,” said Peabody School Committee Member Joseph Amico. “Ella touched a lot of people in her short time; she and her family will never be forgotten.”

Police Chief Steven Mazzie stated, “It’s been great to watch the men and women of the Everett PD show their support for the O’Donnell fam-

ily during Ella’s battle against cancer, but even today in helping to keep Ella’s spirit and memory alive.”

After discovering the tumor in January 2016, Ella’s doctors were tasked with delivering a prognosis to Dennis and Erin O’Donnell that no parent ever wants to hear: Even with chemotherapy, it would be impossible to remove the tumor. Ella’s courageous battle against cancer ended 11 months later – one month before her 11th birthday.

Bettencourt, who attended South Memorial as a child, said the playground will hold Ella’s memory for generations to come. “As mayor, I have never felt so much Peabody Pride as I have watching our community come together following Ella’s passing,” he said in a written statement. “Together, we were inspired to build this playground – a place where children and families can enjoy being together as much as Ella enjoyed being together with her family and friends.

National Prescription Take-Back Day

ayor Carlo DeMaria, the Everett Health Department, Partnership for Success Collaboration and the Everett Police Department will be sponsoring National Drug Take-Back Day on Saturday, October 28, 2017 from 10 a.m.

- 2 p.m. Everett residents will be able to drop off any unused or expired medications for safe disposal at the Everett Police Department’s dropoff box. This is part of a nation-

al effort to take back prescription drugs.

Everett, like many other communities in Massachusetts, has been greatly impacted by the opioid epidemic. Take back days have provided safe, convenient, and responsible means of disposing prescription drugs, while also educating the general public abou tthe abuse of medications.

In addition, Everett residents

are encouraged to make use of the two drop-off location year round, including the Everett Health Department (accessible during City Hall hours at 484 Broadway, 2nd Floor, Room 20), and the Everett Police Department in the main lobby.

Mayor announces Director of Organizational Assessment position

s Mayor Carlo DeMaria looks forward to another four years as Chief Executive, he has announced a newly created position of Director of Organizational Assessment. The director will be responsible for creating job performance standards for employees throughout the City of Everett as part of the Mayor’s organizational assessment process. These measures will ensure the most efficient and effective service to Everett residents.

The measures will include goals and objectives of departments as well as employees’ performance measures to reach those goals. As with any organization, employee assessment is critical to employee performance and to achieving the most productive work environment.

Mayor DeMaria stated, “One of the reasons why Everett has been named one of the top places to live in Massachusetts is because we have a great team; however, we must always be improving the quality and efficiency of service to our residents. The Director of Organizational Assessment

he Everett Public Schools Extended School Year (ESY) program ran from July 5-28 at the Madeline English School serving students from grades PreK3-grade 8. This summer we had 156 students who attended full time classrooms and 20 students who were eligible for walk-in service. Eligibility for ESY programming is based on regression of skills after gaps in service.

ESY programming serviced students with disabilities ranging from autism to developmental delay as well as learning disabilities and emotional/social delay. Services included speech, OT and PT therapies as well as ABA discrete trials for eligible students. Eliot counselors provided counseling for all eligible students. n Wednesday, July 27th Mayor Carlo DeMaria and the Council on Aging welcomed over 500 seniors to the Connolly Center for the Mayor’s Annual Senior Summer BBQ. At the BBQ attendees enjoyed typical BBQ fair, prepared and served by city employees and were entertained by Vinyl Groove. Mayor DeMaria stated, “The senior BBQ was a huge success and I would like to thank all those who attended as well as the volunteers for helping keep the community such a vibrant place to live for people of all ages.”

ichael Zellen, of Saugus-Everett Elks, Lodge No. 642 of Saugus, recently finished his term as Grand Exalted Ruler for the year 20162017. Last Saturday (July 29), Zellen, of Peabody, received a Citation from the Town of Sau-

gus and the State Senate and House of Representatives for all his tireless work and charitable giving on behalf of the Elks.

During the time he was Exalted Ruler, Zellen traveled throughout the country, vis-

iting Elk lodges in 48 states.

Preliminary election for at-Large race scheduled for September 19

ominations closed for this year’s local election last week, and while many seats will go unchallenged, enough contenders have entered the at-Large race to force a preliminary election to narrow the field on September.

In all, 11 candidates have been nominated to run for the five at-Large council seats. Under the charter, a preliminary election to get the race down to two candidates per seat, or a total of 10 candidates.

In the first round, Incumbents Wayne Matewsky, Cynthia Sarnie, Richard Dell Isola, Peter Napolitano, and John

Hanlon will fight for re-election against challengers Michael Marchese, Joseph LaMonica, Catherine Tomasi-Hicks, John Whelan, Leo Barrett, and Stephanie Smith.

In Ward 2, incumbent Stephen Simonelli will face off against challenger Stephanie Martins Ward 1 Councillor Fred Capone, Ward 3 Councillor Anthony DiPierro, Ward 4 Councillor John Leo McKinnon, Ward 5 Councillor Rosa DiFlorio, and Ward 6 Councillor Michael McLaughlin are running unopposed.

The citywide preliminary election will be held sometime in September.

SENIORS ON THE ROAD TO ST. ANTHONY’S FEAST IN BOSTON

ayor DeMaria’s Council on Aging has planned an exciting trip to Boston’s North End to celebrate the Annual Feast of Saint Anthony on Sunday, August 27. The school bus transportation will depart from the Connolly Center at 11:30 a.m. and arrive just in time for the opening ceremonies. Upon arrival, guests will be delighted with the sights and sounds of the marching band parade, confetti drops and devoted members in solemn procession carrying the statue of St. Anthony. On the main stage, the Italian American Band Ambrosiani will be the main performance. The bus will depart at 5 p.m. back to the Connolly Center.

Local cities and towns are not required to offer the volunteer program.

GOV. BAKER’S MASSHEALTH CHANGES (H 3822) House 41-116, Senate 32-6, rejected Gov. Charlie Baker’s proposal to make some major changes to MassHealth, the state’s Medicaid program that provides health care for approximately 1.4 million qualified low-income and disabled persons.

Supporters said Baker’s plan is a humane and responsible approach and argued that under the changes, not a single person would lose coverage, and low-income families would continue to have access to zero-premium health plans.

Amendment supporters said the increase will give some seniors an additional $500 reduction in their property taxes.

They noted this is an important change that will allow more seniors to remain in their homes.

Most amendment opponents said they support the hike but noted that there is already a similar bill that has received a favorable report from the Revenue Committee and will eventually be debated by the Senate. They said that bill, unlike this amendment, has gone through the regular legislative process including a public hearing.

Amendment supporters said this additional $500 would help many veterans and their families further reduce the cost of their property taxes during this tough economy and in some cases, might even prevent them from being forced out of their homes.

Provisions include raising from $1,000 to $1,500 the amount of property tax reduction veterans can earn by doing volunteer work in their city or town; creating a new local option property tax exemption for deaf persons of $5,000 of taxable valuation or $437.50 of actual taxes due, whichever is greater; and allowing more homeowners over 65 to qualify for the state’s $1,070 “senior circuit breaker” tax credit.

Supporters said it is up to cities and towns whether to offer these tax breaks because the breaks are not state-mandated. They noted the reductions will be good for countless low-income seniors, military personnel and disabled persons and might even help some of them remain in their homes, rather than having to move because they can’t afford to pay their property taxes.

ICE BUCKET CHALLENGE FOR ALS (H 1697 Senate 39-0, approved and sent to Gov. Baker a bill annually designating the first week in August as Ice Bucket Challenge Week to honor the contributions of Pete Frates and others who participate in raising funds and awareness to battle amyotrophic lateral sclerosis (ALS, also known as Lou Gehrig’s disease).

Frates in the Beverly resident who was diagnosed with ALS in 2012 and has inspired millions of people around the world to dump ice on their heads to raise awareness of the disease and raise money to fight it. The House approved the bill on a voice vote without a roll call.

Supporters said that the ice bucket challenge has raised millions of dollars to help find a cure for ALS. They noted that designating a week as Ice Bucket Challenge Week will help publicize the event and lead to the raising of more money.

HOW LONG WAS LAST WEEK’S SESSION? Beacon Hill Roll Call tracks the length of time that the House and Senate were in session each week. Many legislators say that legislative sessions are only one aspect of the Legislature’s job and that a lot of important work is done outside of the House and Senate chambers.

They note that their jobs also involve committee work, research, constituent work and other matters that are important to their districts. Critics say that the Legislature does not meet regularly or long enough to debate and vote in public view on the thousands of pieces of legislation that have been filed. They note that the infrequency and brief length of sessions are misguided and lead to irresponsible late-night sessions and a mad rush to act on dozens of bills in the days immediately preceding the end of an annual session.

During the week of July 24-28, the House met for a total of seven hours and 24 minutes and the Senate met for a total of 11 hours and 36 minutes.

irtually no one wants to bequeath and devise assets to their children only to subsequently find out that those hard-earned assets are later to be lost in a divorce. One way to deal with this possibility is to leave these assets to your children via a trust.

A properly drafted trust is more about providing children flexibility and protection with the hope of not creating unmanageable limitations.

Most people look to set up a trust that ends at some particular point in time, typically when a parent feels the child will be mature enough to handle money. In many cases, one third of the trust estate is distributed at age 25, another third at age 30 and a final third at age 35. Others prefer one half at age 30 and the remaining trust assets at age 35.

Typically, upon the death of both parents, a child who is old enough and mature enough will be named a successor trustee to carry out the terms of the trust. If the child has not reached a certain age and a certain level of maturity, the parents will often appoint a third party trustee to administer the terms of the trust and to make distributions on behalf of the child such as for health expenses, educational expenses, housing expenses, etc.

Parents are often concerned that if assets are distributed directly to children upon death, any one of the children could subsequently get divorced only to see those inherited assets become part of a divorce proceeding. Leaving assets to children via a trust does have the benefit of â&#x20AC;&#x153;spendthriftâ&#x20AC;? provisions designed to provide better protection to the children in the event of an ongoing divorce proceeding or prior to such a proceeding when things arenâ&#x20AC;&#x2122;t going so well in the marriage.

Consequently, depending on the particular family and all of its dynamics, a family trust could be drafted to last longer, long after a child reaches the age of say 35.

This is another reason why in some situations, naming a third party trustee might be better than naming a child as trustee.

If the child has discretion to make distributions to himself or herself upon the death of both parents, then a probate judge in a divorce proceeding might order the child to make such a distribution representing that childâ&#x20AC;&#x2122;s share of the parentâ&#x20AC;&#x2122;s estate, thereby bringing those assets into the divorce proceeding.

Trusts can often be classified based upon their distribution provisions as being either support trusts or discretionary trusts.

Each state varies in its interpretation of the trust terms. Discretionary trusts will tend to protect children in the event of a future divorce and the potential alimony and child support issues inherent in such a proceeding. A support trust may very well cause a problem for a child because the court may require the trustee to make a distribution from the trust in order to satisfy what the court believes to be a â&#x20AC;&#x153;supportâ&#x20AC;? obligation of the child, whether it be in the form of alimony or child support.

Consequently, a pure â&#x20AC;&#x153;discretionaryâ&#x20AC;? trust would seem to offer the most protection in these situations with a third party trustee serving as opposed to a child (particularly the child that would most likely be the one to be involved in such a proceeding based upon facts and circumstances known to the parents at the time of the trust creation). A traditional â&#x20AC;&#x153;supportâ&#x20AC;? trust might not always be the way to go, as including language in such a trust that states that the childâ&#x20AC;&#x2122;s â&#x20AC;&#x153;standard of livingâ&#x20AC;? is to be maintained, might somehow lead a court to interpret that language as equating to an obligation on the part of a trustee to make a distribution to a child in order to satisfy an alimony or child support obligation. This is in contrast to simply providing income or principal to the child in order that the child have sufficient assets in order to be able to pay for his or her own food, shelter, medical expenses, etc.

In our litigious society, we all have to be very concerned with lawsuits originating from any source and the more protection contained in a trust (some may argue) the better, even at the expense of limiting childrenâ&#x20AC;&#x2122;s access to the trust assets for which the parents funded into trust for their benefit.

In any event, it is important to make informed decisions.

Whatâ&#x20AC;&#x2122;s right for one family is not necessarily right for another family. Different circumstances, beliefs and ideologies will surely result in different choices for each family. And in the end there are never any guarantees.

At 93, of Everett passed away peacefully, surrounded by his loving family, Thursday July 27, 2017, in the Morton Hospital in Taunton. Edward was married for 64 years to the late Angelina Mary (Ragucci) Anthony of the Village section of Everett. Born in Chelsea, son of the late Norman James Anthony of MA and Vincenza Mary (Cardone) of Italy. He grew up in Malden, and graduated from Malden High School before enlisting in the U.S. Navy. Edward was a gunners first mate on the USS Riddle and served in WWII in the Pacific. He received many honors including the World War II Victory Medal, the American Theater Ribbon, the Philippine Liberation Ribbon One Star and the Asiatic-Pacific Ribbon Seven Stars. After serving in the Navy, he returned to marry Angelina Mary (Ragucci) and then joined the Everett Police Department. He received several commendations from the department before retiring after 32 years of serving and protecting the citizens of Everett. Edward enjoyed spending time with his family, stamp collecting, coin collecting and traveling. Edward is survived by his loving daughters, Rose Hauser and husband Robert of Everett and Norma Jane Anthony (Wong) of Taunton. Brother of Albert Anthony of CA and the late George An-
