Fed up with Fines, Woodhaven Leaders Fight City Over Tickets By Anna Gustafson Woodhaven civic leaders and elected officials are urging the city Department of Sanitation to change its policy on trash removal after property and business owners said they have been unfairly slapped with tickets that are more about lining the city’s coffers than protecting residents. Owners have faced forking over as much as $350 per ticket – once fines have accrued while an individual fights the ticket in court – for garbage problems that are not their fault, but rather stem from people who dump everything from mattresses to pieces of paper on others’ property, according to Woodhaven Residents’ Block Association President Ed Wendell and Woodhaven Business Improvement District Executive Director Maria Thomson. The two civic leaders said individuals – many of whom are likely living in illegally converted apartments where the landlords will not allow them to properly discard garbage in an effort to not draw attention to the sites – will often dump late at night or in the day’s earliest hours. Not long after people have shed their garbage, Wendell and Thomson said the city will ticket owners for such violations as improperly disposed garbage or not recycling - and then remove the garbage before the owners know any of this has transpired. “Tickets are getting written at one, two, three in the morning,” Wendell said. “They come and write the ticket, the garbage gets taken away and when you fight the ticket and say the garbage isn’t yours, the judge says that in the absence of evidence the burden of proof is on you. But they took away the evidence.” For example, Wendell said the WRBA was given a $25 ticket for not recycling, and he said the non-recyclables were pieces of paper that somebody else has thrown into their bin. “We get this ticket, which was written at

2:30 in the morning – so by the time we see the ticket, the garbage was gone,” Wendell said. “They write you a ticket at 2:30 in the morning and take away the evidence. Others have gotten $100 tickets for a mattress or bureau somebody threw out. This has happened to many people. “This is not about keeping the streets clean,” Wendell continued. “This has everything to do with putting more money in their pockets.” A DSNY spokeswoman said, in response to Wendell’s complaint, that “the recycling was placed out for collection apparently by tenants of the building” and that the “officers issued the summonses as dictated by law and were unaware that the building was owned by the block association.” Public Advocate Bill de Blasio wrote a let-

ter on April 10 to Department of Sanitation Commissioner John Doherty and asked that DSNY alter its trash removal policy so owners have a chance to react to garbage being dumped on their land. De Blasio said that, similar to the department’s policy on snow removal, residents should be given a grace period during the night and be exempt from receiving tickets until later in the morning. “While I understand that it is necessary to hold property owners responsible for the garbage in front of their buildings, it is unreasonable to expect that property owners can act to ensure that all garbage in front of their home is disposed of property in the middle of the night,” de Blasio wrote in his letter. “While the practice of finding a property owner for something disposed of improperly at 2:45 in the morning will generate additional revenue for

the city through the fines collected because of these violations, it will not change the behavior of the owner.” A Department of Sanitation spokeswoman said the department plans to respond to de Blasio’s letter. She also recommended that should residents see people illegally dumping, they should take down the make and model of the vehicle involve in the dump, as well as the date, time, place of the dump and, if possible, the license plate number. The spokeswoman noted the department has two programs through which the public can collect monetary awards for reporting illegal dumping, the first of which being the Illegal Dumping Award Program, for which a resident must be willing to sign an affidavit and appear at an Environmental Control Board hearing. As part of the Illegal Dumping Tip Program, a person who provides information leading the DSNY to catch a dumper in the act would be eligible for a reward of up to 50 percent of any fine collected. Thomson said a change in the policy would bring waves of relief for business owners already struggling under the weight of a still floundering economy – though she added that, in addition to de Blasio’s proposal, the city should not continue to raise the price of a fine while an individual fights a ticket in court. “While they’re adjudicating it, they are also raising the penalty on the ticket and that is so unfair,” Thomson said. “Once you start fighting it, they should freeze it at the $100 mark. By the time they make the decision, you have to pay $350. “The people on Woodhaven Avenue don’t even bother to fight it,” she continued. “They just send in the check, and it’s so unfortunate and really hard on us because the economic times are bad.” The DSNY spokeswoman noted the Environmental Control Board is the adjudicating body that determines if the summons can be dismissed or if it has to be paid.

Council to Mayor: Less Over Time More Cops Current policies fiscally wasteful

With Mayor Michael Bloomberg slated to present the fiscal year 2014 executive budget this week, Council Member Elizabeth Crowley, joined by 27 other Council Members, urged the Mayor to increase uniformed headcount in the Police Department and curtail overtime spending. “The use of overtime spending should not be used as a long term solution to compensate for fewer officers,” the Council Members wrote in a letter delivered Monday. Since 2001, the uniformed headcount for the NYPD has been reduced by more than 6,000, and overtime spending has increased from just over $200 million to nearly $600 million. Current budget projections call for almost $500 million for future years. “The increased use of overtime clearly indicates that the NYPD needs more police officers,” said Council Member Elizabeth Crowley. “The NYPD has been given increasing responsibilities, including the department’s growing counter terrorism unit, and

we must pass a budget that gives the NYPD the resources and officers needed to keep our City safe and secure.” Full text of the letter: April 29, 2013 Hon. Michael R. Over the last eleven years, the police force has been reduced by more than 6,000 officers and overtime spending has more than doubled. It is especially urgent to

allocate funding for additional officers in the fiscal year 2014 executive budget as two twenty-year cohorts are about to retire. The Police Department spent $586.1 million on overtime expenses during the fiscal year 2012 budget alone. Budget projections indicate that the Department plans to spend almost $500 million in yearly overtime spending for the foreseeable future. At the New York City Council’s Public Safety Committee hearing on March 12, 2013, Police Commissioner Kelly stated that approximately 40% of the Department’s overtime budget is for planned events. We believe that using overtime to fund such a large percentage of planned events amounts to a fiscally wasteful use of overtime spending. Consistent overtime expenditures indicate the need for additional officers. The use of overtime spending should not be used as a long term solution to compensate for fewer officers. By hiring more police officers and implementing the voluntary vacation pay program, in which police officers may choose to work through vacation days for straight-time compensation, the city

will be safer and the Department will run more efficiently. We strongly believe that the Department’s overtime budget is unnecessarily high and that hiring additional police officers is the best way to reduce such spending. Costumed characters were an integral part of transporting visitors to Victoriana Day back in time.

50 guests crowded into Celebration hall to participate in Victoriana Day at Maple Grove Cemetary. Denny Daniels of the Museum of Interesting Things brought a wonderful display of antiques. The singing and playing of the piano by Mariel Pacific was just so these people are all rare gifts. How wonderful to be attracting wonderful people to Maple Grove. We started with a lecture and powerpoint which lasted almost an hour. Gavriel Maman, owner of Go Antiques of Forest Hills, gave so much of his day to help out and dressed up in tails and top hat and gave a wonderful presentation and brought a beautiful display of antiques from his shop. This was followed by a Walking Tour to the Victorian Section of Maple Grove Cemetery in beautiful weather visiting many sites and friends along the way. We saw the Receiving tomb which struck many people as fascinating and how cool the temperature was inside and it catacomb like appearance! We returned to the Center to a splendid dis-

play of wonderful and delicious foods. Traditional Victorian Funeral Tea foods including Raisin Pie and Prune Cake.. Denny Daniel, owner and curator of the Museum of the interesting Things made a wonderful demonstration of his antique devices of long ago including allowing us to hear a late 1800s recording of

our own George Washington Johnson’s Whistling Song on a miniature Victrola! It ended with one last song, Taps, played on the trumpet on the patio overlooking the cemetery and Bonnie Dixon the Executive Director of Maple Grove Cemetery had the 1875 Maple Grove bell chime the end of a perfect day.

CK’s Math Team Wins First Place in State Wide Math

CK’s Math Team competed in the New York State Mathematics League and won first place overall. More than 40 members competed over the course of the school year. CK’s Math Team has constantly placed first throughout the six contests, which were conducted from October 2012 to March 2013.

The New York State Mathematics League is comprised of teams from over 200 high schools, including public, specialized, private and parochial high schools. Last year, the CK Math Team was the top parochial school in the state and placed third overall. It's All About Teamwork Dear Editor: You can judge a person's character by the company they keep "Some Call For Queens GOP Chair's Resignation, Others Defend Regusa" (Anna Gustafson -- April 18) such as former State Senators Serphin R. Maltese & Frank Padavan who support current Queens County Republican Chairman Phil Ragusa. The recent potential indictments of both GOP Councilmember Dan Halloran and Queens County Republican Party Vice Chairperson Vincent Tabone are just the latest chapter in the spiraling decline over the past three decades of the once relevant Queens County GOP. One way of judging the health of any political party is looking at the number of candidates running for public office that qualify for ballot status on their line. Up until the 1980's, Republican Party members routinely qualified candidates for all Congressional, State Senate, Assembly and NYC Council seats. After the 1982 reapportionment, Democrats eliminated the districts of Queens GOP Assembly members Rosemary Gunning, John LoPresto, John Flack, Al DelliBovi and John Esposito. Senator Padavan voted for this reapportionment plan as it continued to protect both his and the late Senator Martin Knorrs own gerrymandered districts. In 2012, there were no GOP candidates on the ballot for 1 of 6 Congressional, 3 of 7 State Senate and 13 out of 18 State Assembly races in the 2012 November General Election. Watch how many Democratic NYC Council members will get a free pass with no GOP opponent in the General Election. Despite overwhelming Democratic Party enrollment in Queens, creative gerrymandering by the GOP-controlled Senate in 1980, 1990 and again in 2000 preserved the seats of both Republican Senators Maltese and Padavan. gerrymandering all Queens Democratic Assembly seats.. After being elected in 1972, Padavan listed RepublicanConservative affiliations on his headquarters' storefront. In the 1990s Padavan and Assembly member Prescott team proudly campaigned as your local Republican/Conservative team. Local Republican and tea party activists in 2010 were disappointed when stopping by Padavan's campaign re-election headquarters in Bayside. There was no literature, bumper stickers, posters or lawn signs at Padavan HQ for his fellow GOP running mates. A party's ticket is only strong when all the candidates, from top to bottom, work as a team. Republicans are in trouble when they are afraid to identify party affiliations and campaign on their own with no coordinated effort between them. Other Republicans were confused with Padavan's standard political campaign re-election theme "Nobody Cares Like Frank" when he obviously doesn't care about them. Both Padavan and Maltese failed for decades to build a Republican brand name when they ran from it. No wonder Maltese lost in 2008 and Padavan lost in 2010. Queens Republicans are on the way to political extinction like the dinosaurs of old! How disappointing that voters will have to look elsewhere for any alternatives to the Queens County Democratic Party machine monopoly. The failure of both Padavan and Maltese to only care about their respective next election rather than building a viable Queens GOP is the inheritance the last underdog Republican NYC Councilmember Eric Ulrich has to live with. been taking the Q52 bus to get home (at Arverne By the Sea). Based on my observations from waiting for Q52 at Woodhaven Boulevard near the J subway station there are two to three Q53 to one Q52. I take the Q 52 around 2:35 PM. Usually my wait is around 20 minutes but a few times the waiting times were 40 to 60 minutes. And when it’s a long waiting time the bus would be so crowded all the way to the bus's front doors. Thank God the riders don’t show any negativity. Can’t say the same for one of the rude bus drivers who drove over every street bump. Also, when the bus is late there is heavier traffic to deal with. It’s understandable that the A train tracks need time for repairs, etc. but it would be great if the MTA can schedule more Q52 buses so the Rockaway residents can get home earlier to continue the cleanup after Sandy. Is it possible to reopen the Rockaway Beach Line of the old LIRR train tracks so Queens can have a Crosstown subway or a LIRR? This would help reduce overcrowding on buses and trains and decrease travel times within Queens. The East Side Access project of LIRR trains to the Grand Central Station may add to the goodness of reactivating the Rockaway Beach Line. I hope someone can help us. Marilyn Chin Arverne

Missing Ridgewood Man Found Dead Girlfriends son admits to murder

By Patricia Adams The man who allegedly smothered his mother’s boyfriend is awaiting arraignment in Queens Criminal Court. Derrick Tudor, 27, is accused f suffocating Ridgewood resident Frank Soucie, who went missing over a week ago. Soucie was last seen at the home he shared with long time girlfriend Stephanie Bernie at 1866 Putnam Avenue in Ridgewood on April 22. Authorities say the 60-year-old had left to go gambling at either Empire City or Atlantic City. His girlfriend officially reported him missing on the 28th of April. In April 26th Soucie’s son Frank put up his father’s picture with the following desperate post on his Facebook page: I Need Your Help!!! Please Share!!! My father is Frank L Soucie. He has been missing since Monday April 22nd. He is 60yrs old about 5’ 8” 180lbs. Average build with a bit of a beer belly. Balding Black hair, recently has grown a full bread that is brown in color. Last seen in Ridgewood, NY (Queens). A missing person report has been filed but the NYPD basically said they are not gonna do anything. Tried to kill mother of his infant son The 22-year-old Corona man who left the mother of his son paralyzed from he waist down after stabbing her repeatedly in the back will spend the next 25 years of his life behind bars. Queens Distrcit Attorney Richard Brown supported the severity of the sentences in his statement. “The defendant in this case has shown by his actions that he is a threat not only to those to whom he was closest but to society at large. His violent actions changed the course of his young victim’s life as well as the life of his child.” Paguay was convicted earlier this month of second-degree attempted murder, firstdegree rape, second- and third-degree assault, second-degree burglary, seconddegree criminal trespass, aggravated criminal contempt, first- and second-degree criminal contempt, resisting arrest and fourth-degree criminal possession of a weapon following a three-week jury trial before Queens Supreme Court Justice Kenneth C. Holder. On April 21, 2011, Paguay went to the residence of his ex-girlfriend’s mother to ask the ex-girlfriend to move back with him. W hen the ex-girlfriend, who is also the mother of his son, refused, Paguay produced a knife and forced her to accompany him back to his residence a few houses away, where he brought her to the basement. He then stabbed her in the thigh while stating, “I did that to make you feel the same as me.” At knife point he removed her pants and forcibly raped her. Eventually, Paguay allowed her to return home.

Directly following that incident. Paguay chased his ex-girlfriend down 38th Avenue on the morning of June 20, 2011, and grabbed her in a choke hold and held a knife to her side. He then dragged her into the Fine Fare Supermarket on 109th Street and 37th Avenue. When police arrived at the scene, they observed Paguay stab his teenage victim in the back with a large knife. The victim was transported to a local Queens hospital with multiple puncture wounds to her back, paralyzed from the waist down in cardiac arrest.

Police Launch Manhunt For Unidentified Sexual Attacker

Allegedly sodimizes 7-year-old near her own backyard Police have released very few details in the chilling sexual assault of a South Ozone Park girl on Wednesday evening around 6 PM. The victim is believed to be a 7-year-old female who was dragged into a yard at 115-51 115 th street off Sutter Avenue and forced to perform a sex act. The child was reportedly playing with a ball that went over a fence. When she went to retrieve it, the unknown assailant grabbed her. Sources say that a neighbors surveillance video may have captured the assault and help to identify the attacker. The child was taken to Queens General Hospital to undergo examination, testing and treatment. A source at the hospital would not reveal specifics but told The Forum the child was "very traumatized and very shaken." She was seen shortly after the attack crying and being comforted by relatives. A neighbor, Lillian Pacheco told reporters she was very shaken when she saw the little girl. “We all have to be careful with our kids. I never saw anything like this before. It’s very scary.” Family members were sitting on the stoop of the victims front steps, just hugging each other, some of them weeping. Neighbors continued to file pass the crime scene commenting about how schocking the incident was. Rupert Narine lives down the street. "I know they always tell us to be careful. New Queens Library at Elmhurst Is “Topped Out” By Samantha Geary Borough President Helen Marshall; City Council Member Daniel Dromm; Commissioner David Burney, New York City Dept. of Deisgn and Construction; City Council Member Jimmy Van Bramer, Queens Library President and CEO Thomas W. Galante; Alan Nahmias, President of Stalco Construction and community leaders hoisted the ceremonial final steel beam onto the new Queens Library at Elmhurst today. It is a milestone: its steel structure is complete and it’s well on its way to serving the people of Elmhurst. Borough President Helen Marshall said, “I remember touring the old, crowded library during my first term as Borough President. Today, I look forward to the completion of this new facility, which will become an incredible community resource for residents of all ages. As Borough President, I had the privilege of providing more than $27 million towards this new library. It’s a good investment in the future of this community and will reap dividends for years to come.” The new Elmhurst Library will provide significantly more program area than the original 1906 building, with double the physical space, triple the space for educational and arts programming, and a design that allows for future expansion. The new building will also incorporate the City’s active-design principles

by encouraging movement throughout the space, especially via stairways. We are proud to join our partners at Queens Library in celebrating the topping-out of this exciting new investment in the future of one of the most diverse communities in our city,” said David Burney, FAIA, Commissioner of the New York City Department of Design and Construction. “Elmhurst is a thriving neighborhood that needs a state-of-the-art library to support education, job growth and intellectual development ,” said Thomas W. Galante, Queens Library’s President and CEO. The new, $27.8-million, 30,000-sq.ft. Elmhurst Library. The construction of the steel frame required 300 tons of steel delivered by 17 trailer trucks.This magnificent building is one of the most important and best-designed public projects currently underway in New York City. When it opens for public service in 2014, the new library will be double the size of the former one, featuring four levels for customer service with elevator access to all levels. Features include separate library areas for adults, children and teens; a large 32-computer Cyber Center for customer use; a new Adult Learner Center; an interior reading atrium and front and rear community gardens. “Memory features” will preserve the library’s legacy in the community. Original bricks will be used in the new façade.
