KNOW YOUR OPTIONS Now that you have seen a physician, and he has filled out and signed a physician statement and certification, you have two choices: 1. You may send payment and register with the state according to the instructions we have provided to you. 2. Or, you may keep your paperwork and come in on your follow-up appointment without registering or paying the State of Michigan WHAT IS THE DIFFERENCE IF I REGISTER WITH THE STATE OR NOT?
The difference is that if you register with the state you will be allowed Section 4 immunity under the MMMA. This means if you come across law enforcement and you are in possession of marijuana, you can present your license and the officer/agent would be bound by law to presume you are in compliance with the act. You should not face charges while being registered. If you chose not to register with the state, you are still protected under section 8 of the MMMA. The difference is that without registering with the state is you may face charges, but may file a motion to dismiss those charges based on section 8 of the law. Not registering with the state will not provide you with section 4 immunity but you will still have the protection under section 8. Therefore, you are not required to register with the state. This is completely optional and is at the discretion of the patient. We recommend that you register with the state to take full advantage of what protections the Act has to offer you as a patient. We also understand that not all patients want their medical information made available to anyone but a physician. So we will say again, it is completely up to the patient and you will be protected under the act whether you register or not.
Sec. 9. B. – Medical Marihuana Act of 2008 If the department fails to issue a valid registry identification card in response to a valid application or renewal submitted pursuant to this act within 21 days of its submission, the registry identification card shall be deemed granted, and a copy of the registry identification application or renewal shall be deemed a valid registry identification card. (What this means is until you receive your hard copy of you medical marijuana license the temporary copy our office provides for you is and will stand as your registry card.)
A FEW THINGS YOU MIGHT LIKE TO KNOW ABOUT BEING A MEDICAL MARIHUANA PATIENT After you get certified by the doctor you may: • Start cultivating your own plants, (if applicant/patient) you are allowed 12 plants at one time. • If not applicant/patient, you may have your Primary Caregiver begin cultivating your plants. • You may obtain and transport up to 2.5 ounces at any given time. • You can medicate yourself in the privacy of your own, your relatives, or your friends home as long as the owner and people present are ok with it. • DO NOT share you medicine with non-patients.

DO NOT USE A POSTAL MONEY ORDER!!! 21 days after your check/money order is cashed by the state of Michigan and you have sent your application and all other necessary documentation, and you DID NOT receive anything from Lansing VIA Mail, you may go ahead and visit a compassion club. This is not able to be covered by insurance, according the Michigan state law, no government, private, or any other health insurance provider shall be liable for any claim for reimbursement for the medical use of marijuana. This also does not include this additional fee to the state. This is $60.00, and if you are assigning a caregiver or are one yourself there is a $25.00 fee to the state for a background check. • HOW MUCH MEDICINE AM I LEGALLY ALLOWED TO POSSESS OR GROW? A person who has been accepted as medical marijuana patient can possess up to two and a half (2.5) ounces of usable marijuana (seeds and stems do not apply to this weight) and grow up to twelve (12) plants at one time for your use. Our clinics abide by the rules of no resale of products to non-medical marijuana patients. • HOW IS MY CONFIDENTIALITY PROTECTED? Your confidentiality is protected by law and by the procedures used by the registry. No lists of doctors, patients of caregivers are given out to anyone. Local law enforcement may only contact the registry to verify the information on a specific identification card. • DO I HAVE TO GROW MY OWN MEDICINE? CAN SOMEONE ELSE FROW FOR ME? WHERE ELSE CAN I OBTAIN MY MEDICINE? No, you do not have to grow your own medicine. Yes, you may give up your right to grow your own medicine to another person who is over the age of 21, and is not convicted of any felony involving drugs or any assaultive crimes, or any felonies committed within the past ten years of applying for a caregiver’s license. This person would be called your “Primary Caregiver”. You may also obtain your medicine from any Healthcare Collective in Michigan. • WHY CAN’T I GO TO A PHARMACY TO FILL A PRESCRIPTION FOR MEDICAL MARIJUANA? Pharmacies can only dispense medications that are prescribed. Marijuana is currently classified by the federal government as a Schedule 1 drug, which means it cannot be prescribed by any health care professional.
