verything SDCMS and CMA accomplished in 2007 — every bill we sponsored and lobbied to get enacted, every anti-physician/antipatient bill we opposed and defeated, every health plan battle we won, and every dollar we put back into our member physicians’ pockets with our broad portfolio of tangible, members-only benefits — was accomplished because physicians, like yourself, chose to act. No other organization, no specialty society, no ethnic society, no physician group is as effective in advocating for its physicians and for their patients as are SDCMS and CMA — and our effectiveness follows directly from our ability to speak as one and to speak for our profession as a whole. CMA DELIVERS MULTIPLE VICTORIES IN SACRAMENTO

F

rom the beginning of the 2007 legislative session, doctors, patients, and the practice of medicine were under siege in Sacramento. Governor Schwarzenegger wanted to levy a 2% tax on physicians’ gross revenues. Nurse practitioners, acupuncturists, psychologists, and others aggressively sought to expand their scopes of practice. And managed care companies ignored the state prohibition on rescinding contracts after doctors had provided treatment. By the end of the session, the 2% tax was off the table, every attempt at non-physician scope of practice expansion was defeated, and a bill was passed that prohibits insurance companies from cancelling or modifying contracts after a physician provides treatment. None of this happened by chance. Simply put, if the California Medical Association did not exist, no other organization has the resources, the lobbyists, and the relationships to defend physicians’ interests — all physicians — in Sacramento. Below is a list of bills and proposals that CMA’s powerful and effective Government Relations team passed through the legislature or defeated in 2007 on behalf of California’s physicians and patients. CMA-SPONSORED LEGISLATION • Whistleblower Protection (AB 632): Clarifies that physicians are protected as whistleblowers when information is given to a healthcare facility, government accreditation committee, or peer review body. Signed by the governor! • Routine HIV Screening (AB 682): Facilitates routine screening for HIV in all healthcare settings, as recommended by the CDC. Signed by the governor! • Medi-Cal Physician Enrollment (AB 1226): Helps facilitate physician enrollment in the Medi-Cal program by shortening the time the Department of Health Services (DHS) has to process physician applications. Signed by the governor! • Retroactive Policy Cancellation (AB 1324): Protects patients and physicians by prohibiting attempts by HMOs and insurance companies from retroactively rescinding or modifying treatment authorizations after the treatment has been provided by the physician in good faith. Signed by the governor! CMA-OPPOSED LEGISLATION: • All 2007 scope of practice expansion attempts were killed! Acupuncturists (AB 636), physical therapists (AB 1444), nurse practitioners (AB 1643), psychologists (SB 993), and audiologists (SB 557) all attempted to expand their respective scopes of practice in 2007 — and CMA killed every single scope of practice bill! • Other anti-physician bills killed! AB 425 would have exempted from the motorcycle helmet law a driver 18 years of age or older who had either completed a motorcycle rider training program or been issued a class M1 license or endorsement or a comparable license or endorsement from another jurisdiction — Killed! AB 1276 would have made it unprofessional conduct for each instance that a physician wrote a prescription without specifically asking the patient if they would like the intended purpose of the drug to be written on the prescription label — Killed! SB 389 would have prohibited outof-network hospital-based physicians working at hospitals that had contracts with HMOs from billing enrollees of HMOs, effectively allowing HMOs to unilaterally set rates for out-of-network emergency care — Killed!

GOVERNOR’S HEALTHCARE REFORM PROPOSAL hile the demise of Governor Schwarzenegger’s health plan was unfortunate, the critical issue for physicians was CMA’s ability to kill the 2% tax on physician gross receipts. CMA, in combination with many county medical societies, including a vociferous SDCMS, successfully killed this unfair tax, all the while remaining a critical participant in the year-long discussions that followed. Most notably and within days of the governor’s announced reform proposal, SDCMS president, Theodore Mazer, penned an op-ed entitled “Doctors Must Be at the Center of the Debate,” which was published in the February 16, 2007, issue of The San Diego Union-Tribune.

NATIONAL LOBBYING

L

egislation was again signed “just in time” at the beginning of 2007 to stop a scheduled 5% Medicare cut and at the end of 2007 to postpone a 10% cut (10.7% for San Diego County’s physicians) to July 1, 2008. SDCMS, CMA, and AMA continue to lobby Congress to stop current and future Medicare cuts, as well as to update the (un)Sustainable Growth Rate formula (SGR) and the inequitable Geographic Practice Cost Index (GPCI). While Congress failed to resolve either the SGR or the GPCI issues in 2007, SDCMS continues to have unfailing support from all of our San Diego County congressional representatives and California’s two senators. SDCMS Fighting to Fix the GPCI Inequity! After over four years of sustained advocacy, the County of San Diego in June 2007 joined six other counties in suing the federal government for retroactive and prospective Geographic Practice Cost Index (GPCI) relief to bring Medicare geographic payment equity to San Diego County physicians and other impacted counties and states — approximately $160 million for San Diego County’s physicians alone, and over $2.4 billion nationally for physicians in the 174 underpaid counties. SDCMS thanks County Supervisor Ron Roberts for his aggressive leadership and support of this critical physician issue. This is a huge achievement and a direct result of over three years of ceaseless work by SDCMS’ physician leadership.


ADVOCATING LOCALLY SDCMS Brings $3 Million to San Diego County’s Maddy Fund: SDCMS fought hard in 2007 to ensure that the San Diego County Board of Supervisors knew it could apply an additional $2 levy for every $10 imposed on fines, penalties, and bail forfeitures (SB 1773), and, once it was on the board’s radar, fought even harder to get it approved! These extra emergency and trauma service funds for our region are the direct result of SDCMS action, along with the work of Supervisors Greg Cox and Pam Slater-Price! SDCMS Monitors San Diego County’s Physician Workforce Trends: In 2007, we conducted our third San Diego County Physician Workforce and Compensation Survey — alone in San Diego County and across California when it comes to monitoring our physician workforce in order to ensure physician shortages, whether actual or projected, can be identified before they result in access-to-care crises. SDCMS Is Ensuring San Diego County Physicians Are Heard! SDCMS physician leaders and staff continue to ensure your voice is being heard whenever and wherever healthcare policy discussions are held in San Diego County by sitting on tens of community healthcare organization boards and committees. As well, SDCMS sends its physician leaders to Sacramento twice a year to lobby San Diego County’s state assemblymembers and senators.

RICO: ANOTHER $1.25 MILLION CMA Brings $1.25 Million to San Diego County Physicians With Another RICO Settlement! CMA’s RICO class-action lawsuit challenging the rapacious tactics of the for-profit managed care industry saw a further settlement in 2007, directing millions more dollars to San Diego County’s physicians. Of even greater significance than the $40 million Humana settlement (roughly $1.25 million of which came to San Diego County physicians) is the settlement’s prospective relief, which is valued at more than $80 million. The following award amounts were received in 2007 by San Diego County physician groups, with a total approaching $800,000: • Scripps Medical Group: $188,541 • Sharp Rees-Stealy Medical Group: $144,297 • UCSD Medical Group: $106,577 • Anesthesia Service Medical Group: $103,196 • Emergency and Acute Care Medical Corporation: $97,265 • Children’s Specialists of San Diego: $45,193 • Sharp Mission Park Medical Group: $35,347 • Children’s Primary Care Medical Group, Inc.: $24,494 • Park Terrace Medical Association: $21,944 • Mercy Physicians Medical Group: $14,056 CMA as well continued to monitor the health plans in 2007 to ensure they abided by the terms of their RICO settlements. CMA filed disputes after discovering Health Net, CIGNA, and Blue Cross had each violated the terms of their respective RICO settlements in 2007.

VICTORIES OVER HEALTH PLANS

N

o single organization or coalition of organizations in California — bar none — is capable of acting as watchdog to the nefarious actions of California’s health plans, ensuring they abide by the law! Below is a partial list of the reprehensible actions taken by health plans in 2007 that, if not for CMA — and CMA alone! — would not have been stopped: • In January, Blue Cross changed its medical and reimbursement policies in violation of California’s unfair payment practices legislation. Stopped! • In March, Blue Cross demanded that physicians and their attorneys sign its “confidentiality agreement” as part of the contract negotiations. Stopped! • In March, PacifiCare/United Healthcare illegally implemented a new laboratory policy. Stopped! • In March, PacifiCare/United Healthcare improperly denied claims for services provided to patients with “point-of-service” plans. Stopped! • In April, Blue Cross violated state law by canceling individual health insurance coverage after policyholders got sick. Stopped! • In May, Blue Cross violated state law and the terms of its RICO settlement by implementing a fee schedule change. Stopped! • In May, PacifiCare/United Healthcare committed 133,000 violations of state laws and regulations. Corrected! • In June, Blue Cross mistakenly paid some physician claims at the new fee schedule rather than the current fee schedule. Corrected! • In September, Blue Cross’s Prudent Buyer contract is found inconsistent with state laws and regulations, including the Knox-Keene Act. Stopped! • Between October and November 2007, United Healthcare inappropriately denied nearly 12,000 claims as a result of a system glitch. Corrected! • In January 2008, United Healthcare required that physicians notify it before admitting patients to the hospital, mandating that if physicians don’t comply, they will not be paid. Stopped! • In January 2008, Blue Cross asked physicians to provide information on new patients that it planned to then use to cancel the patient’s medical coverage. Stopped!

SDCMS AND THE WILDFIRES

A

long with providing a volunteer hub for San Diego County’s physicians and patients during the October 2007 wildfires, SDCMS facilitated the volunteer activities of 96 physician and 28 non-physician volunteers, extended its operating hours in order to monitor conditions as they developed, keeping physicians upto-date via emails, faxes, and continual updates to its website. Both SDCMS and CMA as well came to the assistance of member and nonmember physicians who lost their houses or practices by waiving those physicians’ 2008 dues.

PROTECTING MICRA

I

t can almost be guaranteed that physicians 50 years old or younger will witness during their professional lifetimes a California governor trying to undo MICRA, California’s Medical Injury Compensation Reform Act, which has kept professional liability insurance premiums reasonable since 1975. MICRA continues to protect physicians because CMA continues to defend it, and because grassroots physicians continue to thwart the trial lawyers’ repeated efforts to increase the non-economic cap on damages. Because of MICRA, San Diego County physicians saved an average $59,456.96 in 2007.

KEEPING THE DMHC HONEST

I

n November 2007, with California’s Department of Managed Health Care (DMHC) once CMA Speaker of the again proposing regulations House, Dr. James Hay, testifying before the to prohibit non-contracted DMHC. physicians from billing patients for emergency services, SDCMS organized a strong grassroots protest culminating in 25 SDCMS physicians showing up in force on November 14, 2007, at a public hearing on the proposed regulations. SDCMS physicians’ superb response coupled with intensive CMA lobbying stopped the DMHC from abolishing balance billing.

SDCMS OUT IN FRONT • SDCMS Bioethics Commission: In 2007 SDCMS formed a Bioethics Commission, bringing together all of San Diego’s bioethics committees in order to work together to advance “best practices” within each hospital ethics committee. • 2007 Health Care Champions: Congratulations to SDCMS members Ellen Beck, MD, Irving Jake Jacoby, MD, Patrick Lyden, MD, Theodore Mazer, MD, and Mark Stern, MD, for being chosen as the San Diego Business Journal’s first-annual Health Care Champions. • SDCMS Leadership Growth in 2007: SDCMS’ board of directors gained 11 new members in 2007 — physicians who have never been involved in organized medicine — and added, because of membership growth, three new directors, including a new geographic director for South Bay. Partnering With Alliant to Bring Members Discounts on Insurance Products and Services: SDCMS partnered with insurance broker Alliant Insurance Services in 2007 to offer our members 5–10% discounts or more on a comprehensive portfolio of insurance products and services. The Doctors Company Continues Its Discount While Adding Further Benefits: SDCMS continued its partnership with The Doctors Company (TDC) in 2007, offering our members who use TDC a 5% discount on their professional liability insurance. In 2007, TDC added a 7.5% dividend credit to the existing 5% SDCMS members-only discount, as well as its Tribute Plan, an individual balance that accumulates each year until the physician reaches the age of 55 or older, has five or more years of continuous coverage with TDC, and retires from the practice of medicine. EMR Software: SDCMS partnered with Allscripts in 2007 to provide our members with special preferred early adopter pricing and discounts on Allscripts’ HealthMatics EHR and practice management solutions. ncreasing our membership numbers in each of the past five years, the San Diego County Medical Society has outperformed every other county medical society in California! In 2007, SDCMS became CMA’s third-largest component medical society, behind only the Los Angeles County Medical Association and the Santa Clara County Medical Association. And because of our aggressive efforts to grow our numbers, SDCMS seated a third trustee on the CMA board of trustees.

Members can now refer prospective new members directly to www.SDCMS.org to apply. Tamper-resistant Prescriptions Pads: SDCMS partnered with American Security Rx to offer members prescription form discounts of 19–62%, the lowest pricing available! This was particularly beneficial to many members who have to, beginning April 1, 2008, write Medi-Cal prescriptions on tamper-resistant pads. SDCMS 2007 Pictorial Membership Directory: SDCMS completely redesigned our annual directory in 2007, enlarging the format and increasing the resources included. We also continued our partnership with a photography company to have our members’ photos professionally taken free of charge.

DCMS’ financial position is excellent. SDCMS closed out the 2007 fiscal year in the black, the sixth time in six years, and added $340,000 to its reserves. SDCMS has kept its dues low — we have only raised dues once, from $350 to $380, in the past 20 years — while dramatically expanding services (CMA dues = $545).

Citations From Leadership Quotes in Media: SDCMS’ physician leadership was contacted almost daily in 2007 when San Diego County’s print and broadcast media outlets needed a medical expert to comment on a story or explain an issue. The San Diego Union-Tribune, The North County Times, The San Diego Business Journal, KPBS radio and television, KGTV Channel 10 (ABC), KNSD TV (NBC), XETV (Fox), and KFMB Channel 8 (CBS) all turn to SDCMS whenever they want the physician’s perspective. In March 2007, for example, the Union-Tribune quoted Dr. Theodore Mazer for its “Boosting Medi-Cal viewed as first step” story: “The reimbursement rates are awful. Every time I see a Medi-Cal patient, I pay for the privilege. SDCMS’ E-newsletter: In 2007, 24 SDCMS’ “News You Can Use” email newsletters reached approximately 2,600 physicians every two to three weeks, up from 2,100 in 2006. We’ve increased content and frequency, and have made our e-newsletter a critical tool in helping our members and other San stay informed of the latest news that directly affects their practices and their patients. roject Access San Diego (PASD) is a countywide physician initiative to connect uninsured and underinsured San Diegans with volunteer physicians for pro-bono and discounted care. • PASD attained the staff and resources of Reach Out to provide Care Coordination services for its patients. • PASD has received $223,000 in grant funding: – $158,000 from Alliance Healthcare Foundation for Care Coordination – $15,000 from Grossmont Healthcare District for physician and resource recruitment in East County – $25,000 from San Diego County Board of Supervisors Chairman Greg Cox for technical upgrades, website development, and marketing materials – $20,000 from Supervisor Ron Roberts, San Diego County Board of Supervisors, for technical upgrades, website development and marketing materials San Diego County Board of Supervisors Chair Greg Cox (left) and County Supervisor Ron Roberts (right) present checks for $25,000 and $20,000, respectively, to SDCMSF board of directors president, Carol Young, MD, and executive director, Aron Fleck, for Project Access San Diego.

Improving Access to Care: Ensuring that San Diego county residents have access to the quality healthcare they need regardless of their socioeconomic status. Physician Service to the Community: Connecting our talented retired and practicing physicians to organizations in the community that desperately need their volunteer services. Providing Practical Consumer Health Education: Providing online patient education materials translated into all threshold languages in San Diego County, at a 4th grade reading level.

The SDCMS Foundation has formalized its scholarship agreements with the UCSD School of Medicine. This year, three scholarships were given to UCSD medical students. Congratulations to graduating physician Waheeda Samady, MD, who received a $1,000 scholarship, and first-year medical students Emerick Gallego-Arteche and Gabriel P. Murillo, who will each receive $1,000 per year for all four years of medical school. Our Emergency Department Medical Home Project (EDMH) has seen its first 1,000 patients. Completion of the project is slated for late 2008, and we will be able to evaluate how well EDMH was able to divert patients from emergency departments and into community health centers to establish a primary care medical home. An additional $15,000 was received for our Web Portal Project to cover the cost of Web portal development and the creation and posting of consumer health education materials: – $10,000 from Molina Healthcare – $5,000 from Sepracor, Inc. SDCMS Foundation held its first Auction for Access to Affordable Healthcare in partnership with San Diego Magazine, raising money for Project Access San Diego and the UCSD Student-Run, Free Clinic Project.
