PRESIDENT’S MESSAGE

Examples of How HBA Works for Our Industry and YOU And like that…. Fall is here. 2018 is almost in the rear-view mirror. I hope everyone has had a chance to enjoy the year both professionally and in their personal lives. Every few months I write the President’s message for Chalkline. This time I want to address something that has come up in conversations, usually with someone telling me they are too busy to get involved in HBA issues or that they dislike politics and dealing with governing bodies. A lot of people want to go about their business and have some time left over for their families. My answer is “No problem.” Not everyone wants to get involved or has the time. That is why we have staff and members that put the time, effort, and passion in. All I am asking for is your support. We are a member driven organization and we do rely on the dues and monies raised by having a healthy membership. Membership dollars have been at work at every level with a lot of positive outcomes at the local, state and national levels this last year. There are also some big issues that will affect us coming up. Here is a recap of things that we have been able to address.

1. Both member Rich Fry and CEO Mike President’s Erdmann have been serving for the last 18 months on the City of Salem’s Message SDC advisory committee, as the city by Matt Holstege prepares to update all of their Systems Development Charges paid with each building permit. While SDC fees are all but certain to increase next July, we’ve been successful in keeping the increases well below what they could have been. We’re also working on phasing the increases in over a couple of years, which should further soften the impact of an SDC increase 2. Also, in Salem, the HBA has representatives involved in the city’s update of the Comprehensive Plan, looking to provide input from the housing industry to help ensure that any proposed changes would be accepted by the marketplace. 3. The HBA has also been involved in both recent and upcoming SDC proposals in Dallas, Sublimity and Aumsville, working to make sure that cities aren’t charging development more than they’re allowed to under state law. An example of the HBA’s work is evident in Sublimity, where the city had

proposed to increase the SDCs without giving sufficient notice as required under state law, and then proposed to charge the higher fee to builders who had applied for permits prior to the increase adoption date but before the permits were issued. The HBA’s intervention saved numerous builders more than $4,000 per house.

3. Family Leave will also be on the agenda. Several groups will be looking for businesses – regardless of size – to provide paid family leave for all employees and guarantee positions will be waiting when they are ready to return to work.

At the state level, Jodi Hack has gotten the Oregon Home Builders Association a seat at the table on several issues.

4. We will most likely have to play defense against another cap and trade bill, too. Cap and trade may not affect every builder directly, but the supply chain will be dramatically affected causing more price increases than already seen.

1. Jodi and several members of the OHBA were able to have a productive meeting that will result in ongoing discussions with Speaker of the House Tina Kotek. The speaker is very interested in the affordable housing issue and has asked for our help in crafting a comprehensive plan that will make it easier for our industry to build affordable homes again.

The Home Builders Associations at the state, local, and national level will be at the table for every discussion and every deal. They will always be fighting for the interests of the homebuilder and the trades that help to build homes for people from all walks of life. We have had successes in tax reform, predictive scheduling, and fighting tax increases.

2. Wage accountability is something that you will be hearing more about in the upcoming legislative session. There are legislators who are advocating for “wage accountability.” In a nutshell, if your subcontractor fails to pay their employees on your project, you as the general contractor will be responsible for paying those wages. OHBA is working to show how most general contractors are small businesses that cannot absorb such a cost. It could be devastating for small homebuilders.

So, when you think that you do not want to get involved or do not have the time or expertise, don’t worry. The dues that we all pay as members of the HBA make it possible to hire very capable professionals who believe in what we do for our communities. These dues make it possible for us organize the fantastic volunteers that are here to fight for us. Just by being a member, you do make a difference for your industry and community.

Remodeling Love HBA Planning Tour of Remodeled Homes for 2019 By James Day

The annual Tour of Homes has always represented an opportunity for members of the Home Builders Association of Marion and Polk Counties to show off their skills.

“I’m excited to show off our work. I think it will be great,” said Jillian Renner of Golden Rule Remodeling, now in its 43rd year in the business. “In the past I’ve worked with other organizations that have had remodeling tours. They have been great.”

Now, the association is developing a Tour of Remodeled Homes to enable contractors who specialize in that niche to get some exposure for their work as well.

Renner, whose firm specializes in kitchens, baths and interior remodeling, said in discussions within the Home Builders Association a question kept coming up: “What if we could do it in coordination with new homes to allow builders to show off their remodeling work as well?”

The 2019 Tour of Homes is set for June 15-23, with the remodeling tour scheduled for June 29-30. “We wanted to open up some avenues for remodeling contractors,” said Mike Erdmann, chief executive officer of the association. “The Tour of Homes is a great marketing opportunity for home builders, and we wanted to give the same opportunity to remodeling contractors to show off their

craftsmanship. We haven’t been able to do that before.” Veteran remodelers affiliated with the home builders association are thrilled with the idea.

Kent Kaufman of Kaufman Homes, which has been building since 1975, said Erdmann’s emphasis on the project helped push it toward reality. “Mike was so involved, so engaged,” Kaufman said. “For several years

we’ve tried to get a remodeling group going. Mike thought it should work to piggyback it with our regular Tour. This gives us an opportunity to get our name and projects out here.” Kaufman also noted that given the lack of available land many homeowners would rather stay where they are and remodel than look for a new home. “Some remodeling projects are bigger than an individual home,” he said, “and people are spending more money on a remodel than a new home.” Dan Dorn of Sunoco Homes, which is celebrating its 40th anniversary, noted that at home shows all remodeling contractors can do is share pictures of their work. Dorn says that 90 percent of his work is in remodels and added that “the Tour allows people to go into the homes and see the work and find out the experience they had with the contractor,” he said. “It would be a real good move for anyone doing remodeling to get a project into that Tour.” Dale Van Lydegraf of Dale’s Remodeling, also in its 40th year, said “it’s always nice for people to see for themselves how we can transform a home. We’re helping people manage and change their living spaces and opening up their rooms. These are old homes that want to be new homes.” And that want to be on the remodeling Tour.

effort on the part of the membership to build and sell a house to fund the association’s political action and legal defense funds and used to protect the home building industry’s interests at the local and state levels, as well as at the courts. We have many companies who contributed to this year’s Showcase House. In addition to the list adjoining this page, we’ll be recognizing contributors at the HBA’s All-Member Dinner on November 13th at the Salem Convention Center. 2018 Tour of Home Showcase House

HBA New Showcase House: A Collaborative Effort Did you get a chance to visit the HBA’s New Product Showcase House during the 2018 Tour of Homes in June? If so, you saw a breathtaking modern home that represented the hard work of volunteer builder Mike Riddle of Mike Riddle Construction, along with the contributions from dozens of HBA members. This year’s project was a one-of-a-kind home located in Rock Ridge Estates in South Salem and was custom designed by Mark Stewart Home Design in collaboration with Mike Riddle who envisioned a modern sleek design. The home featured large windows, clean lines with minimal trim work, textured finishes, a modern custom stair railing, gorgeous herringbone floors, custom lattice metal work, and an outdoor kitchen. The home was sold and closed in August and is a beautiful addition to the neighborhood. The New Product Showcase House - an annual project of the Home Builders Association - is a collaborative

Ensuring a Seat at the Legislative Table I have officially completed my first six months on the job. I think I’m starting to settle in and get my bearings about me (maybe)… I spent the first five months traveling across the state meeting with local association EOs, boards and members. I have thoroughly enjoyed my time getting to know those we represent. It feels like time has just flown by… We’ve been able to make some positive moves forward - one of my favorites is the implementation of a leader’s roundtable focusing on input from stakeholders across the state relating to potential future legislation.

STATE ASSOCIATION UPDATE Jodi Hack, CEO

We held an impressive event for our larger donors – thank you Greg Kubicek and Betsy Cramer for hosting the event and the NAHB staff (Gerry, Jim and Brett) for attending and making it even more of a success. The feedback from members has been positive on a state and national level.

We’ve implemented a new membership drive toolkit for our smaller locals and have been able to offer staff support, marketing materials (emphasizing member benefits at the local, state and national levels) and onsite support for membership drives. Membership is up by 2.2% (as of 5/31/18) with 2,983 members statewide.

State-wide polls have housing slated as the number one issue for the first time in Oregon. Initially, we were tied with jobs and economy and have recently moved to the standalone number one issue of concern for citizens across the state – not just “affordable” housing but housing as a whole. We believe there is potential for comprehensive legislation in the 2019 session.

Third Party Inspectors:

We met with the Speaker of the House and were able to articulate our concerns directly to her and are now working on a package of housing bills that will be presented in the 2019 session. The (virtual) roundtable concept will continue throughout the legislative session to continue engagement with members across the state. I look forward to the work that lies ahead and am thankful for the opportunity.

Due to a recent Oregon Department of Justice opinion, building permits issued by smaller cities and counties that use private Third-Party Building Officials/Inspectors may not be constitutional, throwing the validity of countless building permits into question. We, along with other trade organizations, have sought legal advice and are now awaiting the state Attorney General’s formal legal opinion. No new update.

We are working diligently on building our PAC resources. To date, we have raised over $125,000 more this cycle than the last and plan to not stop there!

A Voice at the Capitol Workgroups, task forces, coalitions and rulemaking are in full swing, and we are at the table for our members.

Codes/Legislative/Regulatory Issues: Wetlands Urban Interface Code Change/Fire Mitigation Appendix W. We are holding a meeting with stakeholders to discuss code conflicts and concerns relating to the Appendix this month. More to come.

Rural ADU’s: The Rural ADU workgroup has met and is in discussion regarding potential legislative sideboards on the authorization to allow ADU’s in areas zoned rural residential with authority for counties to further condition the ADU’s. Look for legislation on this issue in the 2019 session. Workforce & Education: The Joint Committee on Student Success has completed majority of its legislative listening tours. The committee provided a public forum to focus on services and desired outcomes in our K-12 education system which will result in a push for more revenue. Roundtable discussions are underway with legislators, parents, early childhood specialists, and stakeholders to express the needs of industry and to collaborate on business and education partnerships. Systemic challenges will continue to be a part of the dialogue in the discussion about cost drivers like PERS and health care. The CTE-STEM Employer Coalition will continue to meet.

Business & Labor: The Paid Family Leave workgroup continues to gather information on possible legislation for the 2019 session.

Since 1978

Energy & Environment: A Joint Interim Committee on Carbon Reduction will be convening to begin work on carbon policy for the 2019 session. Another issue to be watching closely. Wetland Mitigation Rulemaking is underway. Three of four work sessions have been completed. Draft rules are in the works. We have been at the table working to make sure the rulemaking is favorable to our members. Cleaner Air Oregon (CAO) Rulemaking Advisory Committee met in May focusing on rules and fiscal issues.

OSHA Releases Silica Standard FAQ The Occupational Safety and Health Administration has released a set of 53 frequently asked questions – and their answers – to provide guidance on its respirable crystalline silica standard for construction. Through the Construction Industry Safety Coalition, the National Association of Home Builders was a contributor to the formulation of this FAQ. The FAQ stemmed from litigation filed against OSHA by construction industry trade associations challenging the new silica rule. NAHB will continue to work with OSHA to improve its workability. The FAQ is extensive and organized by topic. An introductory paragraph is included for groups of questions; answers appear when questions are clicked. The FAQ clarifies that many common construction tasks are likely to be outside the scope of the standard. This includes mixing small amounts of mortar; mixing small amounts of concrete; mixing bagged, silica-free drywall compound; mixing bagged exterior insulation finishing system base and finish coat; and removing concrete formwork. Tasks in which employees are working with silica products that are handled while wet are likely to generate exposures outside of the scope of the standard, including finishing and hand wiping block walls to remove excess wet mortar, pouring concrete, and grouting floor and wall tiles. The FAQ states that many silica-generating tasks performed for 15 minutes or less a day will fall outside the scope of the standard. Other clarifications in the FAQ highlighted by NAHB staff include: Table 1. The requirement that employers “[o]perate and maintain” tools “in accordance with manufacturer’s instructions to minimize dust emissions,” applies only to manufacturer instructions that are related to dust control. Other instructions, including recommended respiratory protection, do not have to be followed for purposes of the standard. OSHA also has agreed to issue a Request for Information on Table 1 to revise the table. Written Exposure Control Plan. The standard does not require employers to develop a new plan for each job or worksite. It requires employers have an applicable written exposure control plan – a single, comprehensive plan that covers all required aspects of the plan for all work activities at all worksites. Also, the standard does not preclude employees from entering areas where silica-generating tasks are occurring. Rather, the rule calls for minimizing the number of employees in the relevant work areas. Review the new FAQ at www.bit.ly/SilicaFAQ

Brad Nanke New HBA Safety & Training Director Please join us in welcoming Brad Nanke to the HBA staff as the association’s new Director of Safety & Training. He takes over for David Davidson, who recently moved on after nearly 10 years with the association. Brad will be working with association members enrolled in our Group Workers Compensation Insurance Program with SAIF Corporation, helping employers improve their workplace safety practices with the overall goal of reducing injuries and lowering workers compensation costs. Additionally, he will be teaching lead paint certification classes in Salem as well as throughout the state for the Oregon Home Builders Association. Nanke comes to the Home Builders Association with more than 30 years of experience in environmental health and safety (EHS) management in the semiconductor and solar industries, most recently as the EHS Manager for the Panasonic solar plant in Salem prior to its closure last year. Nanke has been a member of the Salem City Council since 2001. He served as council president for three years, chaired the Salem Citizen’s Budget Committee, served as chair of the Council Finance/Audit Committee for 18 years, and currently sits on the Council Legislative Committee and Water-Wastewater Task Force.
