I wanted to talk about 2 new ways your association is striving toward its goal of meeting the needs of its members. We want to provide the same great stuff we always do and keep a pulse on what else members need to provide as much value out of membership as possible.

21 - 22. It is a ticketed event and gives our remodelers a chance to show off their work. Come out to support our remodelers and let all your friends and family know about it. If you’re a remodeler, please consider entering in future years. It’s

2. Builder Round Table: This new group has been meeting for about 6 months. It’s a group of builders who have lunch and talk about different topics and issues affecting us. This gives us the opportunity to share ideas, strategies and encourage one another. Past topics have included how to deal with difficult clients, preventing

job site theft, scheduling and site management, contracts and financing options. We are planning more good topics. We’d like you to join us to share or just absorb the great conversation.

Lastly, I want to thank Jodi Hack, Scott Barrie and the team at the Oregon Home Builders Association.

This legislative session they worked tirelessly to protect the interests of our members which ultimately helps businesses and families.

HBA TEAM WELCOMES REILLY ROSECRANS The HBA welcomes staff member Reilly Rosecrans to the association’s team as Events Manager. Reilly will focus her efforts on the HBAs major consumer events: the Mid-Valley Home Show, the Yard, Garden & Home Improvement Show, the Tour of Homes and the Tour of Remodeled Homes.

A 2019 graduate of Eastern Oregon University, Reilly has a degree in business administration.

She was named the 2017 NCCAA Division II volleyball player of the year while attending Kentucky Christian University. Her husband, Jacob, works in the local construction industry. Another tour participant, Kent Kaufman of Kaufman Homes of Salem, noted that remodeling contractors occupy an important niche in the building industry.

“Some remodeling projects are bigger than an individual home,” said Kaufman, who has been in business since 1975, “and some people are spending more

New Analysis of Serious Injury /Fatality Prevention A new report from the Campbell Institute recommends a redesign of Heinrich’s safety triangle, which states that for every major injury (the point of the triangle), there are 29 minor injuries and 300 non-injury incidents. The triangle treats minor incidents and near misses as if they had potential to be a serious injury or fatality (SIF).

The report, Serious Injury and Fatality Prevention: Perspectives and Practices, notes that despite gains in safety in the past 20 years – the total recordable incident rate dropped from 8.5 incidents per 200,000 hours worked in 1993 to 3.0 incidents per 200,000 working hours in 2016 – fatal incidents and serious, life-altering injuries have not decreased. The National Safety Council reports that worker fatalities are at an eight-year high, with 5,190 workers dying of fatal injuries in 2016.

Released during the 2018 National Safety Council Congress and Expo, the report takes an in-depth look at SIFs and illustrates a new prevention model suggested by safety experts. It recommends a redesign of the classic safety triangle, which consists of non-injury accidents, minor injuries and major injuries. This model treats all minor incidents and near misses as if they had the potential to result in a SIF and diverts attention away from the incidents that have the most potential to result in something serious.

The updated structure is based on identifying the root causes and contextual factors that lead to SIFs on the job. While a fatality is easy to identify, a serious injury could be defined differently by different organizations. The report defines a serious injury as one that is life-threatening or life-altering. To reduce SIFs, the report suggests that organizations do not need to “fix the worker,” they need to redesign work processes to eliminate the potential for human error. This makes safety less dependent on employee behavior and more dependent on the safety system.

It seems that organizations are doing really well in preventing non-fatal injuries (e.g. sprained ankles, paper cuts, minor burns) but SIFs continue to occur.

What can companies do to get better at SIF prevention?

They should start by going back to basics with Heinrich’s classic safety triangle. Heinrich theorized that for every major injury or fatality, there were 29 minor injuries and 300 non-injury incidents. But when looking at this triangle with the aim of preventing SIF, safety professionals now realize there’s an idea not represented: not all non-injury incidents are equal in terms of their potential for resulting in SIF.

To prevent SIF from occurring, we have to isolate that part of the triangle with the potential for SIF and prevent those.

The Campbell Institute proposes a revised design of the safety triangle. In this new diagram, incidents with SIF potential are represented as a slice of the original triangle. This subset of incidents with SIF potential is different than those outside of it. They have different root causes and contextual factors, or precursors, leading up to them.

To help narrow down a few of the areas that have SIF potential, consider the following questions: • Did the event involve lock-out and tag-out?

• Did the event involve confined space entry?

• Did the event involve pinched between or in line of fire with a release of significant mass or energy?

• Did the event involve a vehicle collision?

• Did the event involve working at elevations?

• Did the event involve barricades/machine guards?

• Did the event involve NFPA 70E Arc Flash?

• Was the event related to working under a suspended load?

If you answer yes to any of these, you have SIF exposure.

The paper recommends three steps for intervention strategies: 1) EDUCATE ON SIF EXPOSURE Everyone in the organization should receive education on SIF exposure and the new way of thinking about near misses and their relation to recordables, lost-time injuries, and fatalities.

Provide training to workers to identify and eliminate SIF potential. This will help them be proactive in preventing lifethreatening and life-changing incidents before they can occur.

3) IDENTIFY SIF PRECURSORS Conducting gap analyses of procedures, controls and employee behavior helps safety professionals determine the precursors that could lead to SIFs if left unchecked.

New Product Showcase House a Success Did you get a chance to see this year’s HBA New Product Showcase House in Sabre Ridge Estates? The house was a stunner and was finished weeks ahead of the Tour of Homes thanks to the leadership of volunteer builder Rich Tovar of Wind River Homes. The key to success was the dozens of HBA members who generously contributed products and services.

The house featured cutting-edge Northwest Transitional style throughout its 2,898 square feet. A grand staircase with custom cable design welcomed you into the home with a floor-toceiling fireplace, custom built-ins, and lighted floating shelves.

The large master bedroom showcased a custom shiplap ceiling and featured a spa-like master bath with heated tile floors. This “smart” house came with all the bells and whistles and connected with a Ring doorbell, NEST thermostat, Alexa-controlled shower, Control 4 lights and security system. A covered outdoor living area with a custom built-in BBQ, refrigerator, and firepit were eye catching. The home featured an encapsulated underfloor creating a more comfortable, energy efficient, and healthy home.

This home sold weeks prior to the Tour of Homes thanks to volunteer listing agent Sam Labbe of Coldwell Banker Mt. West.

The New Product House Showcase is annual project of the Home Builders Association and a collaborative effort on the part of our membership to build and sell a house to fund the Association’s political action committee. These funds are used to support and promote business and housing-friendly candidates at the state and local level. Nearly $40,000 from the proceeds of the home’s sale have already been contributed to the Oregon HBA’s political action committee to help fund contributions in next year’s legislative elections.

We have many companies to thank for being a part of this year’s house. We will recognize Rich Tovar and all the contributors at the HBA’s All-Member dinner meeting on Nov. 12 at the Salem Convention Center. Make plans to attend the dinner!

Mid-Valley Home Show Delivers Customers to Your Business The HBA’s Mid-Valley Home Show, Jan. 10 – 12, 2020, is celebrating its 43rd year. Why does is draw thousands of local consumers each year? Attending a home show allows them to compare products side-by-side and experience them in person or receive a bid. Don’t let your competitor beat you out just because you weren’t there letting our attendees know that you WANT their business.

Meeting Contractors Consumers want to do business with people they like and trust, and that’s hard to establish from an ad or a Google search. A home show is a great place to meet contractors and ask questions. Meeting consumers, discussing their projects and developing trust makes them significantly more likely to buy from or hire

you. Let our attendees get to know you and your company’s products and services. Your presence at the show helps build and strengthen your company’s brand identity, making it more likely consumers will remember your business, and call upon you when they are ready to act.

Learning Something New Technology is changing rapidly, and so are homes. Home shows are a great place to learn about the latest gadgets. Home shows allow demonstrations, showing consumers how to integrate some of these new products into their homes and lives.

A Challenging Yet Successful Legislative Session for OHBA The 80th Legislative Assembly adjourned on June 30, only hours before the constitutional deadline.

The 2019 session will go down as one of the most challenging for businesses in Oregon and one of the most contentious sessions between Republicans and Democrats. Both parties maxed out their political capital and exhausted parliamentary procedures to further their legislative agendas. Democrats negotiated the School Success Act, or Commercial Activity Tax (CAT) by giving up required childhood immunization and gun control legislation. Republicans denied quorum and stalled the legislative progress to prevent the passage of the Clean Energy Jobs Act, or Cap and Invest bill.

Not everyone was happy about our carveout: Rep. Findley – “…also does something I cannot agree with, it gives a carve out for home builders. Carving out one very small sector when, if we are going to vote on carve outs, I would have a much different list.”

Rep. Barbara Smith-Warner – “…the housing crisis has nothing to do with contractors’ ability to build single family homes.”

In addition to business-related legislation and remaining at all tables, OHBA worked relentlessly to carry the two bills proposed by the OHBA across the legislative finish line. The legislature passed both HB 2306 (Substantial Completion) and SB 534 (Skinny Lots). In-depth information on these is included in the Legislative Recap to be sent to members.

Other wins of note include: • OHBA participated in the Speaker-led work group on HB 2001 (Missing Middle Housing) throughout the session and negotiated several amendments. OHBA’s changes included: adding townhouses to the definition, adding explicit language that cities may not prohibit single family homes, and modified statutory language for local jurisdictions to achieve an accurate buildable land inventory (BLI.).

• Modified LUBA appeals - shortened record objection timeline and expanded LUBA’s authority to award attorney fees on unsubstantiated motions.

• Passed HB 2003 – Goal 10 Accountability, Regional Housing Needs Analyses • Protected mortgage interest deduction.

• Prevented increased insurance coverage mandate.

• Ensured on-going ability of employer to prohibit employee drug use.

• Prevented excessive wage claims and contractors from being liable for subcontractors’ unpaid wages.

• Protected the residential dwelling code from costly modifications (rooftop solar requirements).

The 43rd Annual Mid-Valley Home Show, January 10th – 12th, and the 23rd Annual Mid-Valley Yard, Garden & Home Show, March 20th – 22nd, are coming up in 2020 at the Oregon State Fairgrounds.

Both shows consistently attract a large, local audience ready to buy and eager to learn about the latest products and services for their homes and outdoor spaces.

• Retained owner consent statute related to historic designation.

• Prevented expansion of inclusionary zoning.

• Exempted new construction from rent control.

What’s Next Your OHBA Government Affairs Team will participate in bill implementation at the agency level and prepare proposals for the February 2020 legislative session. We anticipate much of the same proposals and antics that we saw from legislators during the 2019 legislative session; however, the legislature will only have 35 days to pass legislation. For any hope of success, proposals will need to be finalized and skids will need to be greased come January.
