Ongoing Challenges Require a Strong Association Well, we made it to 2020, all smooth sailing from here! Oh, how we only wish that were the case. As I sit down to write my first President’s Message I am reminded of what we have been through, the busy economic times we have all been experiencing, and all the challenges we are facing as we go into this new year and decade with eyes wide open. First, I would like to say thank you for the opportunity to serve you all as 2020 HBA President of this great association. I look forward to meeting all of you, serving this association, and to the challenges ahead. Reiterating from my speech at the Holiday Banquet in December, I think it is more important than ever for us an association and an industry to become more involved; to not just sit idle and let others make decisions and policy while we are out busy working. We have a strong association here at the Home Builders, but here in 2020 we are going to be facing many challenges and have many opportunities to better our industry and our businesses if we can get involved and stay engaged. More than ever we need involvement from you, the members, to help us out. Here are just a couple of the most important issues coming up.

Last year the Legislature passed through the new Corporate Activity Tax (CAT) with HB-3427. Though none of us wanted this additional tax burden on our businesses, the HBA in conjunction with the OHBA fought tooth and nail to get our industry some additional critical deductions when figuring the tax. It is all very over-complicated and I know a lot of us all have questions on how we need start tracking our subcontractors labor and materials separately. The HBA will be holding a conference on this new tax coming up soon and I encourage all of you to be there to learn what we all must do to comply and to better lower our tax obligations. I tell you without a strong association fighting for us with just this one legislative bill, I don’t

know where were would have been. This one additional deduction for just our Industry more than pays for what we pay in HBA dues each year. I want to say thank you to our lobbying team and all the crew that helped fight for us with this one. 2020 is, of course, a big election year. Not only at the national level, but at our state and local levels also. We at the HBA have the opportunity to vote and win critical seats at the Salem City Council. We have seen the effects of an anti-building/growth council and can’t afford to continue down that path. We will be supporting several candidates in the coming months and will be looking for your help to help get the word out, walk your neighborhoods, and help support these business-friendly candidates with your financial contributions. I cannot stress how important it is for all of us to win back these seats. Be on the lookout for more info coming soon on how we can all get involved here. Most importantly I encourage all of you to get more involved in the HBA. There are many ways to find out what is going. First come to the Monthly Dinner meetings. It’s a great way to not only meet other members and friends but to find out what is currently
going on, issues we are dealing with and updates on progress we have made. Another great way to get involved is to help with the New Product Showcase House which raises funds for our PAC. These funds are critical for us to help support our causes and candidates in the coming years. Contact the staff at the HBA, or Mike Riddle, who has volunteered to build the home this year, for more info on getting involved. Also, spread the word. Reach out to non-members you work or deal with. Let others know that we are an association that gets things done, that makes a difference for each and every one of us in this industry. We all benefit from the HBA’s good work and involvement and we would love to have new members to help keep our association strong. There is no doubt 2020 is going to be an exciting year. I know that myself and the rest of the tremendous staff down at the HBA will be working hard to fight for our association of members. I am looking forward to spring, this busy building season, and getting through all these coming elections. It may not be all smooth sailing, but with a little luck and a lot of work we may just get through it all just fine.

New taxes ahead?
Salem businesses may face new payroll tax requirements By James Day
The city of Salem is looking at new ways to raise revenue to pay for city services.
The new fee took effect Feb. 1, with single-family residents seeing an increase of $8 per month and larger entities paying $38.56 monthly.
Already in the books is an operations fee that has been added to the city utility bills of residents, businesses, schools and churches. The fee, which is designed to raise $7.1 million per year, will pay for a variety of city services, including parks and the library.
“The operations fee is intended to fill immediate gaps,” said Courtney Busch, manager of strategic initiatives for the city. “Funds coming into the city are often restricted to fund specific services. For example a portion of the gas tax comes to the city (only) to help pay for streets.”

The operations fee, Busch said, is aimed at “general fund” services, which have fewer restrictions. The second piece of the new revenue pie is a payroll tax that the Salem City Council has referred to city voters. The tax, if approved by the voters May 19, will target the wages of everyone who works in Salem, including those who commute in from out of town.
The city will have to ‘unknot’ whether a business owner’s draw is subject to the proposed tax. Workers would pay at the rate of 0.39% on income earned within the city limits. A person earning $50,000 annually, city officials project, would pay $195 per year. Those making the minimum wage, self-employed individuals and independent contractors would be exempt from the tax, said Salem City Manager Steve Powers. The tax would raise $9.1 million annually, with the funds only to be used for public safety – police, firefighters and emergency medical service.

Powers said that no formula exists for how many police officers or firefighters will be hired using
the funds. Those decisions, he said, will be made by the city’s Budget Committee and City Council. If the measure passes the revenue would begin to be collected in July 2022, giving the city a bit of time to figure out how it will be implemented. Courtney Busch, Manager of Strategic
One issue for initiatives for the City of Salem industries such as home builders – particularly those who work throughout the mid-valley – is that some projects are built inside the Salem city limits and some are not. Mike Erdmann, CEO of the Home Builders Association of Marion & Polk Counties, thinks that companies will face bookkeeping challenges. “We expect it will be an administration burden for construction employers to track which employee hours were worked in the Salem city limits and which hours were not,” he said. Also, Erdmann noted, is the question of “whether the tax applies to a business owner’s own non-payroll income. If a business owner takes a draw from his/her company is that draw subject to the payroll tax?” Powers said that the city must follow Oregon Department of Revenue statutes when implementing the tax, but he said that Erdmann’s question on owner draws is one that the city will have to unknot.

Time to Review 2019 Top 10 OSHA Violations Each year, the Occupational Safety and Health Administration inspects thousands of workplaces and issues citations to those facilities that violate safety standards. OSHA publishes its list of the top 10 most frequently violated standards to help prevent unnecessary worker injuries and illnesses in the future. This list is also meant to alert employers about these standard violations and encourage them take steps to address these hazards in their own workplaces. Fall Protection – General Requirements (1926.501) is OSHA’s most frequently cited standard for fiscal year 2019. This marks the ninth consecutive year it has stood atop the agency’s “Top 10” list. Speaking in September at the National Safety Council 2019 Congress & Expo in San Diego, Patrick Kapust, deputy director of OSHA’s Directorate of Enforcement Programs, talked about another thing that hasn’t changed: The agency’s willingness to assist employers with curbing violations involving fall protection and other standards. “These are common violations that we’re finding – they’ve been in place for a lot of years,” Kapust said. “The answers are out there, and employers shouldn’t feel like these are very complex issues. If you don’t know the answers, we encourage you to contact OSHA.”

Fall protection also prevents serious injuries and fatalities (SIF) that we wrote about in the Fall 2019 Chalkline Safety article. A strong safety system with a comprehensive fall protection program will help protect your employees, avoid costly penalties that can affect your reputation and your bottom line, and possibly even lead to a good night’s sleep. Now that’s a future to look forward to this year.

2020 Tour of Homes Applications Now Open

Builders considering entering one or more homes in the 2020 Tour of Homes are now able to submit entry applications. The 2020 Tour takes place Saturday, June 20th through Sunday, June 28th, and offers builders excellent marketing opportunities to sell existing spec inventory, sign custom build jobs with potential clients, and build brand awareness of their company with thousands of area consumers.

Mark Long Takes Over for Jodi Hack as Oregon HBA CEO With Jodi Hack leaving the Oregon HBA at the end of last year for a different opportunity, the Oregon HBA is excited to welcome Mark Long as the organization’s new CEO. Mark comes to the Oregon Home Builders Association with over 32 years of experience working for the State of Oregon, with the last 17 years as the Administrator of the state’s Building Codes Division where he oversaw a large staff of more than 100 employees and successfully navigated the complex legislative and agency regulatory process. Born and raised in Eugene, Mark is a fourth generation Oregonian, representing the family of pioneers who came to Oregon to eventually settle in Cornelius. He follows that pioneering spirit by traveling to and from his farm in Eastern Oregon with his wife Heather and their two dogs. Mark is committed to ensuring homeownership is available and affordable for all Oregonians, and looks forward to serving the association’s members and working to promote the best interests of the residential building industry throughout the state.

8 Reasons to Visit the 2020 Yard, Garden & Home Show as an HBA Member The 23rd annual Mid-Valley Yard, Garden & Home Show will be held at the Oregon State Fairgrounds on March 20th through the 22nd. This is the Home Builders Association’s largest and best attended show of the year bringing in thousands of attendees. But some ask why should I attend if I am not a vendor in the show? Here are 8 reasons why: 1. View the amazing landscape displays. a. A group of superbly talented local landscapers fill an entire building full of immaculate landscape displays full of life plants, running water, hardscapes, and more! You truly feel like you have stepped into your backyard dream. Support their hard work and be amazed by what they can accomplish! If you’re a builder and looking to get design ideas or talk with the landscapers about working on one of your future projects, this is a great opportunity. 2.
