A family to be proud of I could write a ton of what’s President’s Message currently going on by Mike Riddle in the Legislature, the economy or whatever, but honestly you hear about that stuff all the time. How about I make it short and highlight some really cool things happening in our HBA family…deal? Story: There were 2 builder members competing for a very cool project. Both members met the client separately the first time and put their best foot forward. On the second go around, they found out who each other were and were asked to compare themselves to each other. Both members spoke graciously of each other out of

There have been a steady group of a dozen or more builders/remodelers coming to our first 3 meetings. We’ve discussed how to deal with difficult clients, contracts and scheduling. These builders/remodelers are sharing their frustrations and successes and looking to the group for expertise. Work force development: We have several members helping mentor and recruit high school students into the Construction Industry at the Career Technical High School in Salem. One program called Advanced Construction Education (A.C.E.) has been working with students to design a new construction home to be built next year by the students. They’ve drawn the plans on CAD, done market research and 3 designs were voted on at ACE’s annual fundraiser on May

“This type of tax is subject to pyramiding, meaning that at each step in the supply chain, the tax is applied,” Hack said. “The producer pays, the manufacturer pays, the packaging company pays, the shipper pays, the distributor pays, the consumer pays. This leads to an effective tax rate that can be significantly higher than the statutory rate.” An additional cost to builders, suppliers and subcontractors means the impact on the home industry is “not a positive one.” Higher costs equal higher home prices. Other possible effects are possible, too, said Hack. “It’s too early to tell what all of the ramifications are going to be. There are still many unanswered questions and concerns.” Measure 97, a gross receipts tax for companies with Oregon sales exceeding $25 million, was defeated by a 59-41 margin in the November, 2016 election. In addition to the sales ceiling another major difference between Measure 97 and HB 3427 is that there was no restriction with 97 on how the funds could be spent.

You have to look at the building or structure that the scaffolding is going to be erected around and think about what the scaffolding is going to be used for. From there, you have to determine the type of scaffolding that is best-suited to that type of work. The best solution for a particular job will depend on factors such as the loads that will be present on work platforms, providing workers with safe access and fall protection, and the number of work levels. On any work site that requires scaffolding, safety professionals and others need to keep fall protection in mind. Although guardrails are probably the most common form of fall protection, on certain scaffolds, for example single- and two-point suspended scaffolds, you need both a guardrail and a personal fall arrest system. Passive fall protection, such as a guardrail, is preferable when working on scaffolding so that users will not have to think about their work positioning or where they are tied off, as they would with a personal fall arrest system. In addition to establishing safety requirements for scaffolding equipment, A10.8 includes training requirements to ensure that workers understand and recognize the hazards associated with

working on scaffolding and know the procedures to follow to minimize those hazards. The standard specifies that employers must provide training for each employee on site-specific hazards and that they understand the correct procedures for erecting, securing, inspecting, maintaining and disassembling the scaffolding. Tour of Homes runs June 15th – 23rd The 2019 HBA Tour of Homes presented by NW will officially open on June 15th with 21 homes on display from 19 of the Association’s premier builders. The Tour runs June 15th –23rd, hours noon to 6 pm on weekends and 6 pm to 9 pm weekdays. Home prices in the 2019 Tour range from $300,000, to more custom, luxury, homes with the highest priced at $1,030,000. As in years past, most of the homes are located in the Salem area, but several are located in surrounding communities including Silverton, Keizer, Dallas, Turner, Sublimity, Stayton, and Monmouth. Oregon HBA advocating for members on hundreds of legislative proposals affecting housing, small business With thousands of bills introduced in the 2019 Oregon legislative session, tracking bills that affect housing, construction, and small business can be daunting. Having reviewed all bills introduced, the Oregon Home Builders Association has narrowed the list down and your team of lobbyists, led by CEO Jodi Hack and supported by lobbyists Scott Barrie, Ellen Miller and Jameson Gideon, is monitoring approximately 700 bills that could affect your business. While not a comprehensive summary, the following are many of the most important as of mid-May. HB 2001: “Missing Middle” housing Would require cities over a certain size to allow duplexes, triplexes and quads on any lot zoned for single family homes. Would change the way cities calculate Buildable Lands Inventories, making it difficult for cities to overestimate capacity and underestimate land needs. The HBA secured language to make it clear that the additional housing types were optional for the property owner and couldn’t be required. HB 2003: Goal 10 accountability Would require the state to conduct regional Housing Needs Analyses,

identifying how much housing is needed in cities and regions to meet housing needs. Cities over 10,000 people would be required to develop and adopt a housing production strategy identifying a list of specific actions to promote development to address their housing shortage. The HBA was able to secure language that says that cities’ production strategies must promote development of all housing types, not just affordable housing. HB 2005: Paid family leave Multiple paid family leave bills were introduced, with the most draconian making all employees eligible for up to 32 weeks of paid leave for family illness or the birth/adoption of a child. Employers would have also been responsible for 100% of the cost of the program. It would have affected employers of even a single employee, and the employer would have to hold the job for the

HB 2007: Diesel engines This bill would require a phase out of all pre-2010 diesel engines on medium and heavy duty trucks over the next few years, including off-road construction equipment such as backhoes, skid steers, etc. The HBA has been working to seek additional time on the phase-out, and possible exclusions. HB 2306: Building permits at substantial subdivision completion Introduced by OHBA, this bill would require cities to issue building permits when development of a subdivision is substantially complete, rather than the current practice of waiting until the subdivision is entirely complete, including items like stop signs, street lights etc. Homes still could not be occupied until the subdivision was 100% complete, but this bill will help speed construction activity and

employee upon their return. OHBA and the business community have successfully modified the paid family leave requirements such that it will be 60% employee paid / 40% employer paid, will restrict paid leave to 12 weeks, and most importantly, completely exempt those with less than 25 employees.

reduce costs. The bill has been signed into law by the Governor. HB 2498: Independent contractors As originally introduced, the bill would prevent someone from acting as an independent contractor if they were providing services for someone when those services are within the course of the other person’s business. While the bill was introduced to target those who use independent contractor status to avoid payroll taxes, workers comp and other employment laws, the bill would have severe consequences for many legitimate independent contractors. The HBA has been working on amendments that should prevent the bill from affecting legitimate independent contractors in the construction. HB 3349: Mortgage interest deduction An especially bad bill for housing, this bill would eliminate the ability of higher-earning taxpayers to deduct mortgage interest from state taxes. We’re monitoring closely and cautiously optimistic that it will die before the end of the session. HB 3427: Gross Receipts Tax Perhaps the most controversial bill in 2019, this bill raises nearly $2 billion in new taxes through a .57% tax on a business’ gross receipts over $1 million. While not supportive of the bill, OHBA and the broader business community have

secured a 35% deduction for cost of goods or labor. The bill has been signed into law by the Governor. OHBA is working on a subsequent “technical fix” bill that would provide for exemptions for residential construction. SB 10: Salem transit corridors Seemingly targeted at Salem, this bill would require significantly higher densities within ¼ to ½ mile of arterial streets served by frequent bus service. We’re monitoring this, but it appears it is unlikely to pass. SB 379: Employee drug use Would make it an unlawful employment practice for an employer to discipline or refuse to hire a workers who uses any substance (i.e. marijuana) lawful to use in Oregon during non-working hours. The bill would appear to allow an employee to smoke pot during a lunch break and then return to work on a roof or operating power saws or other dangerous equipment. Unlike alcohol, where impairment can be easily checked, there is no easy way to test for marijuana impairment. Impairment could only be determined by someone who had gone through a multi-day class. The bill passed out of the Judiciary Committee, but we believe there are enough votes to kill it if it comes up on the Senate floor. SB 534: Skinny lots Some cities have banned home

construction on narrow lots platted decades ago. This bill, introduced by OHBA, would prevent cities of more than 10,000 from refusing to issue building permits on these lots. While the problem is most pronounced in Portland, we are aware of similar problems in smaller cities. SB 726: Sexual harassment and employee discrimination The bill would prohibit non-disclosure and non-disparagement agreements as a part of a settlement of a harassment/discrimination complaint, the most problematic element is that it would make owners, partners and corporate officers personally liable for harassment or discrimination if they, or one of the supervisors or managers knew or should have known about the unlawful discrimination or practices. While the bill has passed the Senate, the work of OHBA and the broader business community has successfully removed the personal liability provisions from the bill. Proposed raid of SAIF funds Governor Kate Brown has initially proposed raiding hundreds of millions of dollars from SAIF Corporation reserves that had been paid by policyholders. Along with others, we have reached a resolution that prevents funds from being raided for other state purposes.
