A Matter of Vision Salem moves forward on comp plan update What is a comp plan? A comprehensive plan is a long-range plan for future growth and development that aims to meet the needs of current and future residents. It includes goals, policies and maps that shape everything from where multifamily housing is built to how the street system is designed to how natural resources are protected. “Affordable housing … what does that mean?” “I heard you say bridge.” “We need a coffee shop on this corner … or maybe a neighborhood bar.” The ideas came fast and furious Nov. 19 as approximately 100 people crammed around tables in a conference room at the Salem Area Chamber of Commerce. Chamber officials and members, local Realtors, members of the Home Builders Association of Marion & Polk Counties and the Salem Economic Development Corporation (SEDCOR) all were gathered to discuss the future of Salem.

The specific project on the table was the update of the city’s comprehensive plan, the main blue print for city growth and development. “Salem is growing, so this is an opportunity for the community to be proactive in guiding how and where that growth occurs,” said Eunice Kim, the city of Salem planner spearheading the work. “The project aims to develop and adopt an updated comprehensive plan that reflects the community’s vision for growth and provides clear goals and policies for the future.” Salem’s plan has not been updated for decades, and the city is spending $400,000 on staff work and consultants to make it happen. And Salem IS growing, with city officials projecting that the region will add 60,000 people by 2035. “This is super important work,” said T.J. Sullivan of Huggins Insurance, Chamber of Commerce board president. “It will determine how things happen in our city. Our comp plan is made up of a series of master plans. All will be getting a

We need to take this seriously or someone else is going to tell you what you can and cannot do.” “How do we want to grow?” summed up Kim. “What’s important, and what do we want to protect?” The multiyear “Our Salem” process is in its second phase. The work began in 2017, with phase one focusing on data, indicators and scenarios in an effort to evaluate existing conditions and a look at how Salem could grow. It also included the city’s first greenhouse gas inventory because the built environment – buildings, related transportation networks, etc. – affects GHG emissions, which city officials say “can and should inform larger discussions about how and where Salem should grow.” The chamber open house was part of the second phase, establishing a community vision for future growth. The final phase will consist of the writing and adopting of the new comprehensive plan that implements the vision. The city expects to conduct community-wide visioning into 2020. Included will be a variety of public engagement activities – public workshops, outreach at community events, stakeholder interviews, surveys and more. The main exercise at the Chamber event was a hands-on activity in which participants and facilitators gathered around tables, each covered with a massive city map. Participants then did their own comp plan work on the maps, adding high-density housing here, incorporating flex-zoning here, putting stickers and Sharpie markings on neighborhoods and with at least one table and “reviving Interstate 305,” which snaked southwest from I-5’s exit 260 along what is now the Salem Parkway and crossed into West Salem on a new Willamette River bridge. ASBESTOS: From Fake Snow to Real Rules Those who remember the famous poppy field scene in the 1939 MGM film, The Wizard of Oz, in which Dorothy fell asleep may be surprised to find out that the “snow” used in those camera shots was made from 100% industrial-grade chrysotile asbestos.

This exemption does not apply when the residence is going to be demolished. All commercial buildings regardless of construction date must have an asbestos survey conducted by an accredited inspector prior to any demolition or renovation activities done by a contractor, business owner or property manager New requirement 2: Updated disposal

The white, fluffy and fire-resistant fibers were the perfect way to simulate real snow on Hollywood film sets, but some actors died of mesothelioma after exposure. The Oregon Department of Environmental Quality regulates the handling, removal and disposal of asbestos-containing material to protect public health and the environment. In fall 2018, Oregon adopted additional requirements for handling asbestos-containing material. New requirement 1: Residential renovation asbestos survey All houses and other residential buildings constructed prior to 2004 must have an asbestos survey conducted by an accredited inspector prior to demolition or renovation activities. Owneroccupants doing their own home renovation work are exempt.

requirements Nonfriable asbestos waste must now be packaged the same as friable waste. Friable materials are those that can be easily crumbled and release asbestos fibers. Nonfriable materials can become friable if improperly handled. Applying the same packaging standard for nonfriable and friable materials streamlines the packaging requirements for all asbestos waste and ensures a safer work environment for employees, residents, neighbors and disposal facility workers. New requirement 3: Accredited laboratories for asbestos testing Laboratories analyzing bulk asbestos samples must participate in a recognized accreditation or testing program by Jan. 1, 2021. continued on page 11

A New Path for Property Owners By Jennifer C. Paul, JD, Saalfeld Griggs The recent U.S. Supreme Court Case, Knick v. Twp. of Scott, Pennsylvania—opinion issued June 21, 2019—may change the landscape for private property owners bringing claims against the government for unlawful taking of private property, opening a federal claims path earlier in the process. The Landscape Pre-Knick The Takings Clause of the Fifth Amendment states that “private property [shall not] be taken for public use, without just compensation.” Likewise, Article I, Section 18 of the Oregon Constitution states “Private property shall not be taken for public use, * * * without just compensation.” However, government entities often enact regulations and ordinances that impose restrictions on the use of private property (possible regulatory takings) or governments physically invade private property without filing a direct commendation action or paying just compensation (inverse condemnation/unlawful takings). In those situations, what remedy can the private property owner pursue? Prior to the Knick case, Williamson County Regional Planning Comm’n v. Hamilton Bank of Johnson City was the law of the land. Williamson County held that a private property owner’s claim for violation of the Fifth Amendment was not ripe until the property owner had exhausted state court remedies and been denied just compensation. In other words, the private property owner could not bring a Fifth Amendment claim in federal court at the outset—the property owner must first engage in state litigation. However, the Supreme Court later held, in San Remo Hotel, L.P. v. City of County of San Francisco that when a property owner’s claim is determined in state court, normally that has a preclusive effect on any later federal suit. By complying with the state-litigation requirement in Williamson County in most cases the property owner was foreclosing the right to a federal forum.

New requirement 4: Asbestos survey reports Asbestos survey reports submitted to DEQ must now meet standard requirements. This requirement ensures survey reports include all required information. Existing Demolition Rules On Jan. 1, 2016, the Oregon Department of Environmental Quality adopted rules requiring an asbestos survey before demolishing residential buildings built before Jan. 1, 2014. Knick’s Summary The private property owner in Knick owned a single-family home on land used for grazing farm animals. The land also included a small gravesite where the neighbors’ ancestors were buried. At issue was an ordinance that required all cemeteries be kept open and accessible to the general public and allowed Township officers to enter any property to determine the location of cemeteries. After receiving notice of a violation of the ordinance, the property owner in Knick first brought a declaratory action seeking injunctive relief in state court (but did not bring an inverse condemnation claim for just compensation). In response, the Township withdrew the notice and stayed enforcement, resulting in the state court dismissing the proceeding, as no evidence of irreparable harm could be established for the equitable relief. Next, the property owner filed a federal claim under 42 USC Sec. 1983, alleging that the ordinance violated the Takings Clause of the Fifth Amendment. The federal claim was dismissed pursuant to Williamson County, because the property owner did not pursue her inverse condemnation claim first in state court. Ultimately, the Supreme Court in Knick overruled Williamson County’s state-litigation requirement, and now no longer requires state litigation prior to bringing a Fifth Amendment Claim. The Court said, “[i]f a local government takes private property without paying for it, that government has violated the Fifth Amendment—just as the Takings Clause says—without regard to subsequent state court proceedings. And the property owner may sue the government at that time in federal court for the ‘deprivation’ of a right ‘secured by the Constitution.’” Practical Outcomes in Oregon For property owners facing an unlawful taking of private property by the government, the Knick case means access to federal claims or to the federal courts earlier in the process of challenging government action. In Oregon, it means property owners can advance their claims under the Fifth Amendment rather than having to rely on Oregon’s Constitution and Oregon common law, which may be less favorable. For example, under Oregon law, in the context of a regulatory taking claim, a property owner only has a claim if the subject ordinance/rule leaves the owner with no economically viable use for the entire property. Now property owners may bring a Fifth Amendment claim at the outset, with a potentially more favorable outcome utilizing the federal “Penn Central Doctrine.” Such claims could be brought in federal court, of course, but also in Oregon, under Boise Cascade Corp. v. Bd. of Forestry, such federal claims may be brought directly in state court. The bottom line is that Knick opens new paths and strategies for private property owners in protecting their constitutional rights. Winter 2019 | The Chalkline | 11

GRT Tax - The Oregon Department of Revenue held a series of public meetings about the new corporate activities tax in preparation for issuing rules for implementation of the tax. It is clear that the DOR and others have a great deal of work to do before the implementation. I am attending coalition meetings and will attend the RAC. We are working with partners in other business associations to ensure business concerns are raised in the rulemaking. Make sure you are having your sub-contractors separate out labor and materials on their invoicing starting Jan. 1, 2020 so you can take advantage of the additional 15% deduction only given to residential construction.

I am participating in discussions about potential legislation related to restrictions on use of independent contractors. I am continuing to meet with legislators throughout the state and have attended several fundraisers for legislators, both Democrat and Republican.

Rulemaking and Workgroup Updates Construction Defect – Three meetings have been held, the last meeting occurred during legislative days. The intent of the group is to work toward resolutions for remaining issues within the bill introduced in the last legislative session (HB 3432-1). The goal is to end the process with a bill that is ready and passable for the 2020 session. Including these elements: shorten the statute of ultimate repose, streamlined way to cure a defect giving the HOA/ COA the ability to accept repairs, choose a contractor or agree to payment for remedying the defect, require the majority (50%+1) of owners to approve litigation, potential up-front envelop type inspections/maintenance plans to reduce risk of any defects. SDC Fees – Workgroup meetings will begin this month. HB 2001 – Middle Housing – At its commission meeting this month, DLCD proposed a rulemaking advisory committee (RAC) and work plan on the HB 2001 elements that require rulemaking. The RAC will focus on:

The rules will also include process, criteria, and other necessary elements required for department review of HPSs and development of the process and criteria to be followed for LCDC to review and identify cities with a population greater than 10,000 that have not sufficiently achieved needed housing within their jurisdiction or have not sufficiently implemented a housing production strategy adopted under Section 4 of House Bill 2003.

2. LCDC is not yet scheduled to adopt rules relating to the HPSs. We anticipate adoption in late 2020 or early 2021. HB 2436 - 404 partial assumption – DSL has begun the task of developing a proposal for the 2020 legislative session for the legislature to grant the authority to administer permits for the discharge of dredge and fill materials under section 404 of the Water Pollution Control Act. DSL will first meet with the other state agencies before convening a stakeholder workgroup. OHBA participated in stakeholder meetings that kicked off on Sept. 25. 2020 WQ Fees – OHBA is serving on the RAC for the 2020 Water Quality Fee Increase. DEQ is proposing a 21% fee increase to most permit fees - 3% that is authorized through statute, and 18% to support program enhancements approved by the 2019 legislature. If approved by the EQC in May 2020, fee increases will take effect starting June 1, 2020.

Model ordinance for medium and large local governments required to adopt allowances for middle housing into their development ordinances, along with standards in Oregon Administrative Rules for governments choosing to adopt their own middle housing ordinance; and 2. Processes, criteria, and necessary elements of the infrastructure-based time extension request (IBTER) process authorized in HB 2001. 3. LCDC is scheduled to adopt the medium-sized local government duplex code and the processes to grant an extension based on infrastructure insufficiency in July 2020. LCDC is scheduled to adopt the large sized local government middle housing ordinance in September 2020. LCDC initiated moving forward with the proposed RAC. DLCD will schedule a roadshow to listen to input on the draft middle housing ordinance. DLCD anticipates wrapping up the tour before the 2020 legislative session and drafting the rules in the Spring of 2020 for adopting at the fall LCDC meeting. I will be participating in the RAC.

HB 2003 – Regional Housing Needs – OHCS is currently hiring staff to accomplish the work on the regional housing analysis. The agency expects work will begin on the program in January 2020. DLCD proposed a combination rulemaking advisory committee (RAC) including both HB 2001 and HB 2003. The work plan on HB 2003 relating to the housing production strategies includes: 1.
