The Marche region boasts one of the hilliest landscapes in Italy, a characteristic that was well known to one of its most famous natives of the nineteenth century: Giacomo Leopardi, the Recanati poet who wrote “Infinito”, one of the most beloved Italian poems. Inspired by emotions awaken in him by the natural environment he enjoyed from his window, Leopardi, thanks to his sensitive inner soul, was able to capture the contradictory characteristics of the region where an endless variety of landscapes follows one another from North to South and from East, on the sea, to West, towards the Apennines. Even today, the Marche region remains a land of endless discoveries. Behind every hill, an unexpected view opens before the eyes: a river, a mountain, a cliff overlooking the sea, or an historical landmark. This means that a holiday in this land, so genuine, so warm and welcoming, becomes a journey with the capital “J”, to relax the body and the mind so that one may enjoy, in addition to the well-known culinary delicacies of the region, a glimmer of immensity.

THE MARCHE REGION
The Marche region is very particular. This is clear even from its plural name (“Marche�) which is unique in Italy and an attempt to include under a single name a complex and articulated land. The difference between one area and the other within the territory is linked not so much to the length of the region along the Adriatic coast, but to the uniqueness of the natural and manmade microcosms spread out between the coast and the inland, which over time drove the inhabitants to develop different lifestyles and their own local economy. This diversity must be read as a synonym of beauty, wealth and distinctiveness. The Marche region is born with history in its past. There is no activity one can do, or corner of the region one can explore, where history can be escaped. Everything is permeated by art and culture: this is clear in the inland, with its castles located just a few kilometres from the sea, and on the large costal expanse with its architectural and ecclesiastical heritage, as well as on the countryside with its literary and historical memories. The Marche region was the birthplace of many talented poets, artists, architects and musicians, such as Giacomo L e o p a rd i , R a f f a e l l o, B r a m a n t e, Gioacchino Rossini, Giovan Battista Pergolesi, and Gaspare Spontini. They all gave the region priceless and artistic masterpieces which transformed it into an open-air “museum” where abbeys, monasteries, churches, fortifications, libraries, archives are set between the hills and the sea. Historical villages are scattered throughout the region and they are among the most beautiful in Italy. History and its culture are an integral part of the social and production system of the Marche region, and they are so part of the life and heritage of its inhabitants that have become a valueadded asset characterizing the quality of life of people in the area and stimulating the connection between creativity and talent.
The ecosystems of the Marche region are as unique as they are extraordinary. For this reason, and especially in the mountainous areas, protected environmental oases were established: two national parks, four regional parks and six nature reserves, all with the purpose of promoting and safeguarding the beauty and peculiarity of the Marche. Within these areas, one can spend time discovering and watching a wide range of animal species, some of which are considered endangered, such as the wolf. Approaching nature in this region means more than abandoning oneself to the pristine beauty of its green spaces, enjoying breath-taking views and unique colours; it also means encountering history every step of the way, thanks to the numerous evidences of its ancient inhabitants left scattered throughout the natural environment. If, to the collective memory, the first unique feature of the Marche is its hilly landscape, in truth the region is gifted with a much more complex and structured territory: small lakes, rivers, mountains, high and low coastlines, natural creeks, scenic roads and a flora that accompanies these different scenarios with char ming seasonal changes.
The food and wine panorama of the Marche region stands for its quality, excellence and abundance. T he vastness of the offer in the region inspired the design of a vast network of gourmet itineraries and a “gluttony” map of the various areas according to their specialties, which mirror the close connection between local identities and production. Safeguarding the authenticity of the products, respecting tradition and constantly caring for the choice of ingredients and raw materials brought the food and wine industry to enter the cultural sphere, becoming a true point of excellence for the territory. Undertaking a culinary journey in the Marche region means enjoying colours, aromas, flavours, but also history and authenticity. Depending on the area, meat-based dishes and blue fish, shellfish or delicious seafood-based dishes alternate each other. There are many specialties that are worth tasting: the Acqualagna white truffle, Fabriano salami, Ciauscolo salami from Macerata, Carpegna Prosciutto, stuffed olives from Ascoli, a wide variety of cheese, fine olive oils and a large selection of DOC wines that won numerous awards and are renowned abroad.

When traveling across the Marche region, one must not miss visiting the region’s many fashion outlets. It is here that some of the most prestigious Made in Italy products are manufactured, among which clothing and footwear brands that became synonym of elegance and style all over the world: Tod’s, Hogan, Nero Giardini, Cesare Paciotti, Loriblu, Fabi, Fornarina, Vic Matiè, Oxs and Janet & Janet. The ancient artisanship and manufacturing traditions created over the years solid businesses that became popular destinations for shopping. This region always offers wonderful surprises and in addition to the aforementioned activities, there are many others equally worthy of note: smaller artisan-style businesses descendants of ancient trades that gave life to these lands in the past. Thus, leather processing, ceramics and pottery, artefacts in wrought iron, copper, cane, wicker and bamboo are iconic businesses of excellence in the Marche region. In the Marche region, one can also find the skilful technique of “pillow” lacing, the manufacturing of the famous accordions of Castelfidardo, and the beautiful handmade hats produced in the area of Fermo.
Since ancient times, the Marche region boasts a deep connection with the sea, demonstrated today by the numerous museums dedicated to the sea and its wildlife, both through events and festivals that, especially in the summer, enliven the Adriatic coast and that see fish and good food as their protagonists. Expressing this love for the sea through the numbers is easy, for they speak for themselves: almost 200 kilometres of coastline (with 26 seaside towns), 18 awards won for the Blue Flag, 9 tourist dockings and more than 800 bathing establishments. However, the incomparable beauty of certain areas of the coast must be experienced in person, such as the magic of the beach at dawn or the intense contrast between the blue of the sea and the green of the vegetation. Tourists who decide to spend their holidays in the Marche region will have plenty of choices among the many types of beaches the region offers: fine sandy beaches, gravel beaches or rockcovered beaches touching the clear waters of the Adriatic Sea, its pine forests, palm trees or maquis, and if one cannot decide, then it is easy to change beach every day because the landscape changes within a few miles!

On the beach, it is possible to practice many sports: windsurfing, kite surfing, water skiing, sailing, swimming, diving, as well as playing beach volleyball and more. In one day, it is possible to explore the most beautiful natural corners of the land alternating an exciting horse ride with trails in mountain-bike, perfect to exploit the best and most varied conformation of the territory; in fact, biking is always a great way to move around and discover the Marche region and all it has to offer. Depending on personal preferences, it is also possible to enjoy free climbing the white cliffs overlooking the sea, or hiking along the trails of the parks and natural reserves. Moreover, it is possible to enjoy speleological guided tours to the discovery of unique flumes and caves. Do you wish to add some thrill? Then you just have to try hang-gliding, paragliding downhill or canoe and kayak trips along the rivers. In winter, the white peaks of the Apennines offer a wide choice of facilities perfect for alpine, cross-country and excursion skiing. The A14 motorway runs parallel to the coast, while clearways and two-lane state roads lead to the inland. The Marche region can be easily reached via air, through the airports of Ancona, Rimini, and Bologna through international and national air routes.
BY BUS All of the major centres of the Marche region have bus services to inland locations and other regions. Information on schedules and services can be found at train stations and tourist offices. BY TRAIN There are two main lines, one connecting Milan-BolognaAncona-Lecce and Rome-Falconara Marittima-Ancona. Regional lines also lead towards the inland.
BY SHIP The great seaport of Ancona serves all the major locations of the Mediterranean Sea (Greece, Croatia, Albania, Montenegro and Turkey). Nine tourist ports, all perfectly equipped, allow docking in Gabicce Mare, Pesaro, Fano, Senigallia, Ancona, Numana, Civitanova Marche, Porto San Giorgio and San Benedetto del Tronto.

Gradara and San Leo, the most beautiful villages in Italy DURATION: ONE DAY Visiting the small town of Gradara, with its iconic Malatesta Fortress, means visiting a magical place set within high walls where the tragic love between Francesca da Rimini and Paolo Malatesta, and sung by Dante in the Divine Comedy, took place. San Leo, built on a mountaintop, is the second stop in the tour, and its setting is quite impressive. The panorama one can enjoy from San Leo is one of the most beautiful and characteristic of the area, with the view ranging from the surrounding mountains and the Marecchia Valley all the way to the sea. A pleasant walk will lead to visit the castle, the highest located structure in San Leo. The Renaissance fortress, well-known as a prison for the alchemist Count Cagliostro, dominates the inhabited village of San Leo, showing off its architectural splendour. Today the fortress hosts a museum with an exhibition of weapons dating back to its past and an art gallery. While approaching San Leo the road offers a picturesque view of the fortress, and a perfect stage to take photos before arriving.

Republic of San Marino DURATION: ONE DAY There are many reasons why it is worth visiting the small Republic of San Marino. In fact, it hosts a large number of architectural and natural heritage sites, which are a true feast for the eyes of travellers. It also offers a fantastic opportunity to buy souvenirs, to go shopping in the many local shops, but also in the most famous factory outlets and stores concentrated in the area surrounding San Marino, which will surprise for their great prices and the variety of big names and special offers. The beauty of Urbino and Gola del Furlo DURATION: ONE DAY Travelling across the hills of the Marche region it is possible to reach the State Natural Reserve of Gola del Furlo. A real paradise marked by the Candigliano River that flows between the towering rock walls of the Gola, where the suggestive landscape combines with the prodigious wealth of nature boasting unique specimen of flora and fauna. In addition to the impressive landscape, all to be discovered is also the history of Gola del Furlo with its distinctive features and relevant historical landmarks that range from the ancient Romans to the Second World War. From here, one can proceed towards Urbino, a town that is the pride of Italian Renaissance, and the birthplace of architect Bramante and artist Raffaello. The itinerary includes a visit to Urbino and to Palazzo Ducale, the jewel of Italian Renaissance, which since 1912 is home to the National Gallery of the Marche region. Urbino is also the birthplace of Raffaello and it hosts the Academy of Raffaello, countless churches each of significant importance, as well as the Fortress of Albornoz, which, surrounded by a well-kept garden offers a very beautiful view both of the town and surrounding hills and it is one of the urban prides of Urbino. DURATION: HALF DAY The caves of Frasassi, a masterpiece of nature, boast huge stalactites, underground streams and lakes. The caves are located within the Regional Natural Park of Gola della Rossa and Frasassi, one of the most beautiful protected areas of the Marche region, with unspoiled and lush nature, ideal for hiking. Within the natural park, one can find also the Hermitage of Grottafucile overlooking the Gola della Rossa. Corinaldo and Arcevia DURATION: HALF DAY Perched on the hills, the village of Corinaldo preserves, intact, its town walls and towers that date back to the fifteenth-century. The city centre, in its typical medieval character, is a succession of narrow streets and houses; the most characteristic glimpse is the Piaggia, also known as Cento Scale (the Hundred Stairs), which leads straight to the top of the hill. In the seventeenth century, the Venetian artist Claudio Ridolfi, to whom the Civic Art Collection is dedicated, lived and worked in Corinaldo. The second stop of the tour is Arcevia, a town rich in history and monuments. It is a medieval village of the thirteenth century that still preserves two beautiful ancient entrance gates. The national archaeological museum and the churches are a must-see, boasting art masterpieces of the sixteenth and seventeenth centuries, including the works of Signorelli.

The fortress of Mondavio and the uniqueness of Fratterosa DURATION: HALF DAY Located on top of a hill with views of the Adriatic Sea and Apennines, the medieval town of Mondavio is still surrounded by its ancient town walls and defended by a mighty fortress designed by architect Francesco di Giorgio Martini. Today, the fortress houses the Museum of Historical Re-enactment and Armoury, with manikins with costumes and weapons ranging from the fifteenth to the eighteenth century. A fleet of “war machines” with faithful reconstructions in actual sizes is in display inside the moat of the fortress. The historical downtown is among the best preserved in the Marche region, while the former monastery of San Francesco houses the Civic Museum with interesting examples of art and history. The second stop of the tour is in Fratterosa, a town famous for its traditional processing of pottery unique for colours and shapes. This is a centuries-old manufacturing activity rooted deeply into the history of the town. After a stop to enjoy the town’s panoramic landscape--among the most beautiful ones in the province of Pesaro and Urbino--the visit will proceed to a pottery workshop, where it will be possible to witness the entire process and learn about the customs surrounding the making of this product, with the opportunity to try the process in person. DURATION: ONE DAY The small town of Recanati is an ideal place where to relax and quietly enjoy the day surrounded by nature. Recanati also honoured Beniamino Gigli, one of the greatest Italian tenors. Macerata is the second interesting stop of this tour. The city stands on a vast hill like many of the most beautiful cities in the Marche region. Macerata’s noble and austere appearance is softened by the warm colours of the town walls as well as the stone and bricks of the buildings of its ancient downtown that hosts also its historical University. The town was the birthplace of the Jesuit Matteo Ricci, and it is bordered by ramparts dating back to the sixteenth century. It is crossed by many roads that lead up to Piazza della Libertà, the heart of the old town, which is surrounded by the most important monuments and churches and the entrance to the University Palace. Nearby, it is possible to find the Civic Museums of the Buonaccorsi Palace, known for its eighteenth-century paintings depicting the Stories of the Aeneid. Macerata houses also the famous Sferisterio Opera Festival, in the homonymous outdoor arena, with shows of international importance.

56 SALES CONDITIONS of MARITALY by Gazzella Viaggi SUBJECT OF THE AGREEMENT AND APPLICATION FIELD MARITALY is the brand through which GAZZELLA VIAGGI E TURISMO S.R.L. carries out brokerage activities for tourist services, organizing activities and sale of tourism packages. These general terms and conditions of sale apply to all products offered in the catalogue, without prejudice to what may be notified at the time of booking request. Upon booking, the tourist states and agrees to have reviewed, read, and received from the Travel Agency through which the booking was performed a full copy of the General Terms and Conditions of Sale in force at the time of booking.
GENERAL SALES CONTRACT CONDITIONS OF TOURISM PACKAGES 1. LEGISLATIVE RESOURCES The sales transaction of tourism packages, with the object of providing services both nationally as well as abroad, is regulated - until it is repealed under the art. 3 Decree Law No 79, May 23, 2011 (the “Tourism code”) - by Law 27/12/1977 n°1084 by ratification and fulfillment of International Convention concerning travel contracts (CCV) signed in Brussels on 23.04.1970 - as applicable – as well as the Consumer Code (art. 32-51) and its subsequent amendments.
2. ADMINISTRATIVE TREATMENT The organizer and the intermediary agency of the tourism packages must be enabled to perform their tasks according with the applicable administrative rules, also regional. According to the art. 18, VI paragraph Cod. Tur, the use in company name of the words “travel agency”, “tourism agency”, “tour operator” or other words and phrases, in a foreign language too, similar in nature, is allowed only to enabled companies referred to the 1st paragraph.
3. DEFINITIONS For the purposes of this contract means for: a) travel organizer: the subject which is obliged in his own name and to the flat fee, to provide to third party tourism packages, realizing the combination of the items in the following art. 4 or offering to the tourist, also through a remote communication system, the possibility to realize on your own and to buy that combination; b) intermediary agency: the subject who even non-professionally and non-profit, sells or is obliged to provide tourism packages realized according to the following art.4 to a flat payment; c) tourist: the buyer, the transferee of a tourism package or any person even to be nominated, who satisfy all the conditions required for the use of the service, for whom the principal contractor agrees to buy with no benefit a tourism package.
4. TOURISM PACKAGES The concept of tourism packages (article 84 Cod. Consumo) is the following: “tourism packages regard trips, vacation holidays and its “all inclusive” stays, tourism cruises, resulting from the combinations, by anyone and in anyway realized, of at least two elements indicated as follows, sold or offered as a flat rate price: a) transportation; b) accommodations; c) a dditional tourism services not included in transportation or accommodation costs, according to the art.36 , that constitute a significant part of the “tourism package” (art.34 Cod. Tur.). The tourist has the right to receive the copy of the tourism packages sales contract (according to art.35 Cod. Tur.). The contract is entitled to access to the Fund of Guarantee referred to the following art.21
5. INFORMATION FOR THE TURIST - TECHNICAL CHART MARITALY by Gazzella Viaggi & Turismo Srl, Via Litoranea 87 – 61037 Marotta (PU) Authorization Nr. 6232 – Comune di Mondolfo - 13.04.2000. The prices are expressed in Euros. The methods and conditions of substitution are regulated by article 10.
6. RESERVATIONS The reservation proposal must be written on specific contract forms, in the case that forms should be electronically submitted, they must be compiled in each part and signed by the tourist, who will receive a copy. The reservation agreement is valid only, with consequent conclusion of the contract, at the moment when the organizer sends relative confirmation, which can occur also by means of telecommunications, to the tourist through the vending travel agency. Before the departure, the organizer will provide the indications that are relative to the tourism package not contained in contract documents, in the brochures or by other means of written communication, as provided by art. 37, comma 2 Cod. Tur. According to the art. 32, comma 2, Cod. Tur., in case of contracts stipulated at distance or outside business premises (as defined by artt. 50 and 45 of D. Lgs. 206/2005), the organizer riserve the right to communicate in writing the non-existence of the withdrawal right provided by artt. 64 and ss. of D. Lgs. 206/2005.
57 7. PAYMENT The down payment, to be paid at the time of the booking and the date with which the payment must be paid in full, as listed in the payment conditions written in the offer sent from MARITALY BY GAZZELLA VIAGGI or in written communication . Nonpayment of the sum above mentioned, on the preset dates constitutes the conditions clause expressed in such a way as determined, by MARITALY BY GAZZELLA VIAGGI and/or for the conditions of rights to be determined by the organizer.
8. PRICE The price of the tourism package are expressed in Euros and is determined in the contract, with reference to what is stated in the catalog or program out of print and to any updates of these programs out of print catalogs or subsequently intervened. This is VAT included but not inclusive of tourist tax, which may be settled directly at the hotel. The price can be subject to change within 20 days before the date of departure and only in consequence to the variation of: - cost of transport, cost of petrol and insurance costs are included; - rights and taxes on certain types of tourism services for which are landing tax, disembarkation or embarkation of passengers in ports or airports; - changes applied to the package in question. For such variations there is referral to the exchange rate and to the above mentioned current prices advertised in the program, referred to on the technical chart of the brochure or of the referred date of the above mentioned update. Variations will incur price changes to the flat rate fee of the tourism package in the percentage expressly indicated on the technical chart or the out of catalog program.
9. MODIFICATION OR CANCELLATION OF THE TOURISM PACKAGE BEFORE DEPARTURE BY THE ORGANIZER Whichever significant modification on behalf of the organizer, or the package or of one of its essential elements is subject to acceptance by the tourist according to the law of article 91 Codice del Consumo (Consumer Code). In the case of non acceptance the tourist can exercise their rights with reference to article 10. The tourist can exercise their above mentioned rights foreseen in the program or owing to circumstances beyond one’s control, related to the purchased tourism package. For the cancellations different from those ones caused by circumstances that are beyond one’s control, fortuitous events, and by not reaching minimum number of participants as well as for those ones different from the missed acceptance by the tourist of the alternative tourism package, the organizer that cancels is due to give back the tourist the double of what was paid and collected by the tourist (art.33 letter E Consumer Code).
10. TOURIST WITHDRAWAL The tourist can withdraw from the contract, without paying penalties, in the following circumstances: - price increase according to article 6 exceeding 10% of the price; - Modification in significant manner of one or more elements of the contract that can be configured as an important aspect, at the time of use, of the tourism package and proposed by the organizer after the conclusion of this contract but before the departure and not accepted by the tourist. In the above mentioned cases, the tourist alternatively has rights: - To take advantage of an alternative tourism package, without supplemental charges or with the restitution of the surplus of the price, should the second package have an inferior value than the first; - To the restitution of the sum already paid. This restitution must be made within 7 working days from the moment of receiving the refund request. The tourist must communicate their decision (to accept the modification or withdraw) within and not longer than 2 working days from the moment in which the increase notification or modification is received. In failing to meet the abovementioned period of time, the offer proposed by the organizer is understood as accepted. The tourist that withdraws from the contract before the departure, outside of the circumstances mentioned at the first point, independently from the down payment by which article 5, the registration dues, the insurance premium and the percentages of the participation due calculated based on how many days the trip was cancelled before the start of the trip ( the calculation of days does not include the day of withdrawal) by which the communication must occur on a working day previous to that of the start of the trip: – 10% from the day after reservation to 30 days before arrival; - 30% from 29 days to 20 days before arrival; - 50% from 19 days to 10 days before arrival; - 75% from 9 days to 4 days before arrival; - 100% starting from 3 days before arrival. These sums must be paid by who is unable to carry out the trip for lack or irregularity of the expected emigration documents. In the case of pre-established groups these sums will be agreed upon each time at the signing of the contract.

MODIFICATIONS AFTER DEPARTURE The organizer, if after the departure finds him/herself unable to provide for any reason, excluding a personal case of the tourist, an essential part of the services written contract, must give alternative solutions, without additional costs at the expense of the contracting party and if the services provided are of an inferior value with respect to those expected, the reimbursement will be a standard of value equal to the difference. If there other alternative solutions are not possible, or if the proposed solution by the organizer is refused by the tourist for serious and justified reasons, the organizer will provide without additional charges a means of transportation equivalent to the means of transportation originally expected for the return to the location of departure or to a different location eventually agreed upon compatibly with the availability of the given means of transport and available seating/space and they will be refunded for the difference of the cost of the services provided and those of the services carried out from the moment of advanced re-entry.
12. SUBSTITUTIONS The renouncing tourist can be substituted by another person provided that: a) The organizer is informed in writing at least 4 working days before the fixed date of departure, receiving contextually communication regarding the generalities of the transferee assignee; b) The substitute satisfies all the conditions for the fruition of the service (ex art. 39 Cod. Tur.) and in particular the prerequisites relative to passport, visa and health certificates; c) the same services or other services in place may be granted as a result of replacement; d) The individual sub appointed must repay to the organizer all the additional expenses incurred to continue the substitution in the way that will be quantified before the transfer. The transferor and the transferee are jointly and severally liable for payment of the balance due and the amounts referred to in letter d) of this article. Any additional terms and conditions of replacement are indicated in the technical chart.
13. OBLIGATIONS OF THE PARTICIPANTS During the negotiations and before the conclusion of the contract, Italian citizens are provided for general information in writing – updated to the date of printing the catalog or the offer – relating to health obligations and documentation necessary for travel abroad Foreigners find the corresponding information through their diplomatic missions in Italy and/or their official government information channels. In any case, the tourist will provide, before departure, to verify the update with the competent authorities (for Italian citizens to the local Police Headquarters or the Ministry of Foreign Affairs through the website or the helpline www.viaggiaresicuri.it . Telephone number +39 06 491115). In the absence of such verification, no responsibility for the failure of one or more tourists will be imputed to the intermediary or the organizer. Tourists must inform the intermediary and the organizer of their citizenship and, at the time of departure, they will definitely make sure to bring proof of vaccinations certificates, passports and any other document valid for all countries visited, as well as visas, transit and health certificates if required. Furthermore, in order to evaluate the safety and health situation of destination countries and, therefore, the objective usability of the services purchased or by purchase, the tourist will find (using the information sources as in paragraph 2) the general official information at the Ministry of Foreign Affairs, which indicates expressly if destinations are subject to formal discouraged. Tourists should also follow the rules of normal prudence and diligence and to those specifications in force in the countries of destinations, all information provided by the organizer, as well as regulations, legislative or administrative provisions relating to the tourism package. Tourists will be liable for all damages that the organizer and/or the intermediary should suffer also because of failure to comply with the above obligations, including expenses necessary for their repatriation. The tourist must provide to the organizer all the documents, information and elements in its possession relevant to the exercise of the right of subrogation against third parties responsible for damage and be liable to the organizer of the injury caused to the right of subrogation. The tourist also will communicate in writing to the organizer, at the time of booking, any special personal requests that may be subject of specific agreement on the travel arrangements, provided that they are possible to implement. The tourist is still obliged to inform the intermediary and the organizer of any special needs or conditions (pregnancy, food allergies, disabilities, etc, …) and to explicitly specify the request for personalized services.
14. HOTEL CLASSIFICATION The official classification of the hotels are provided by the program with informative material based on the explicit and formal indications by competent authority of the Province of Bologna.The organizer reserves the right to provide in the program or tourist brochure a personal description of the accommodation structure, so to permit an evaluation and consequent acceptance on behalf of the tourist.
15. SYSTEM OF RESPONSIBILITY The organizer is responsible for damages caused to the tourist due to partial or total non-fulfillment of the contractual services due, both if these are caused by him or by third party service providers, unless proved by the tourist (therewith initiative independently taken upon themselves in the course of the tourist services) or by extraneous circumstances to the services provided in the contract, a fortuitous event, circumstances beyond one’s control or circumstances that the organizer could not, in accordance with standard professionalism, reasonably foresee or resolve. The vendor at the location of where the reservation was made of the tourism package is not responsible in any case of the obligations that arise from the organization of the trip, but is responsible exclusively for the obligations that arise regarding the intermediary’s qualities and within the limits of responsibility of the regulations in force on the subject.
59 16. LIMITS OF COMPENSATION Compensation for damages by artt. 44, 45 e 47 of Cod. Tur. and relevant prescription terms, are regulated as provided herein and in any case within the limits expected from the C.C.V., the International conventions which governing the services object of the tourism package as well as artt. 1783 and 1784 of the Civil Code.
17. OBLIGATIONS OF ASSISTENCE The organizer is responsible to provide the measure of assistance to the tourist that is imposed by the criteria of the professional standard exclusively in reference to the obligations of his/her job under the provisions of the law or contract. The organizer and the vendor are exonerated from the respective responsibilities. (art. 15 and 16 of these General Conditions) when the missing or inexact carrying out of the contract is chargeable to the tourist or is dependent on a third party in an unforeseeable or inevitable way, or in the case of fortuitous event or circumstances beyond one’s control.
18. COMPLAINTS AND CHARGES Any fault in carrying out the terms of the contract must be notified without delay so that the organizer, their local representative or guide can resolve the issue in good time. Otherwise, the damages will be reduced or excluded pursuant to art. 1227 c.c. The tourist must - for the loss of a right - send a written complaint registered mail with return receipt to the organizer or vendor, within and no later than ten working days from the date of return at the place of departure.
19. INSURANCE AGAINST THE EXPENSES OF CANCELLATION AND OF REPATRIATION If not expressly included in the price, it is possible, and rather advisable, to stipulate during the booking near the offices of the organizer or the seller special insurance policies against the consequential expenses derived from the cancellation of the package, accidents and baggages. It will be possible to stipulate a contract of assistance that covers the expenses of repatriation in case of accidents and illnesses. The tourist will exercise the rights arising from these contracts exclusively against the insurance company policyholders, under terms and conditions according to these policies.
20. ALTERNATIVE TOOLS OF DISPUTE RESOLUTION According with the purposes of Art. 67 Cod. Tur. the organizer will may propose to the tourist - on catalog, on website or by other forms – alternative dispute resolution modalities. In this case the organizer will indicate the type of alternative resolution suggested and the effects included in this accession.
21. FUND OF GUARANTEE (art.51 Cod.Tur.) The National Fund of Guarantee which the consumer can address to, in case of insolvency or declared failure of the seller or the organizer, for the guardianship of the following demands: a) refund of the deposited price b) repatriation in case of trips in foreign countries. The fund also has to give an immediate economic availability in case of forced reentry of tourists from non –European Countries on the occasion of emergencies due to the organizer’s behavior. The courses of action of the Fund are established with decree of the President of the Council of Ministers of 23/07/99, n. 349 G.Us. n. 249 of 12/10/1999 and the reimbursement instances to the Fund are not subject to any limitation period.. The organizer and the intermediary agency contribute to feed this Fund to the extent established by paragraph 2 of art. 51 Cod.Tur. through the compulsory payment of insurance premium that is required to enter into, a share which is paid to the Fund in the manner provided by art.6 of Ministerial Decree 349/99.
60 COURT OF JURISDICTION AND ARBITRATION CLAUSE The court of jurisdiction shall be the Court of Pesaro for any dispute arising from the implementation of the following general terms and conditions concerning the agreement or the tourism packages. COMPULSORY COMMUNICATION According to Art.17 of Law 38/2006. The Italian Law punishes with the penalty of imprisonment crimes related to prostitution and child pornography, even if they are committed abroad. INFORMATION EX ARTICLE 13 OF LEGISLATIVE DECREE 196/03 (PERSONAL DATA PROTECTION). The processing of personal data, which need to be provided for the finalization and implementation of the agreement, is carried out in full compliance with Legislative Decree 196/03, in hard copy or digital form. The data will be communicated only to the suppliers of the services included in the tourism package. The tourist shall be able at any time to exercise his/her rights ex Article 7 of Legislative Decree 196/03 by contacting the Organizer, which is the Data Controller.
TECHNICAL DATA SHEET Participation fees The participation fees shown within or without the catalogue are expressed in Euro and must be understood per person, unless otherwise specified. The fees concerning the stays refer to an accommodation in a double-bed room, if in a hotel. For any accommodation in a single-bed room, an additional charge shall apply, while a discount shall apply in the percentage/value shown in the catalogue for accommodations with a third and fourth bed. The age to obtain a children discount shall be considered the age of the child before his/her birthday. To calculate any price changes related to fluctuations in exchange rates, the reference currencies are those recognized by the ECB/UIC and published on “Il Sole 24 ore� on 01/10/2014.
Payments The Tourist has an obligation to pay a deposit of 25% on the price of the tourism package according to what is specified in Articles 8 and 9 of the General Terms and Conditions of Sale. Booking must be also accompanied by the booking/file management fee, including insurance. The balance of the portion of the package booked must be paid at least 20 days prior to departure, unless otherwise agreed and subject to exceptions specified in the individual packages.
Booking change Any change requested by the Tourist after confirmation of services included in the package shall be charged to the Tourist as specified in Article 11 of the General Terms and Conditions.
Cancellations The tourist that withdraws from the contract before the departure, outside of the circumstances mentioned at the first point, independently from the down payment by which article 5, the registration dues, the insurance premium and the percentages of the participation due calculated based on how many days the trip was cancelled before the start of the trip ( the calculation of days does not include the day of withdrawal) by which the communication must occur on a working day previous to that of the start of the trip: - 10% from the day after reservation to 30 days before arrival; - 30% from 29 days to 20 days before arrival; - 50% from 19 days to 10 days before arrival; - 75% from 9 days to 4 days before arrival; - 100% starting from 3 days before arrival. These sums must be paid by who is unable to carry out the trip for lack or irregularity of the expected emigration documents. In the case of preestablished groups these sums will be agreed upon each time at the signing of the contract. In the case of pre-established groups, such amounts will be agreed from time to time upon signature of the agreement. Some services may be subject to various penalties, which shall be communicated at the time of booking. These penalties shall be paid by tourists unable to perform the trip due to lack or irregularity of the necessary travel documentation. Such penalties shall also apply to Tourists unable to travel, including for reasons beyond their control. Alternatively, the Tourist may request to have another traveler takes his/her place, under the conditions detailed in clause 13 of the General Terms and Conditions.
Transportation The Tourist is transported exclusively according to the Terms and Conditions of the carrier available at the offices of the organizer or on the websites of the carrier In this regard, it should be noted that the name of the Carrier will be specified in the Contract related to the tourist package whenever the package includes transportation. The Tourist buying the tourist package, ipso facto accepts these Terms and Conditions.
Conferences and Special Events At the time of conferences or special events the hotel rates listed in the catalogue may not be applicable.
61 Travel Documents Information about travel documents and any visas/vaccinations are shown on the information pages of various destinations in this catalogue, according to the regulations in force. It should be noted that all the information related to travel documents must be considered as a general guideline given the variability of the legislation on the subject. Such information refers to Italian citizens who are 18+. For Countries participating to the Schengen Agreement, as a rule travel documents are not checked. However, it is necessary to always have a valid identity card or passport to travel abroad (other documents are not valid), because, for safety reasons, the border police may request them at all times. In the case of lack of identity documents, boarding and/or entry into the country may be denied. Any information related to travel documents must be requested to embassies and/or consulates of various countries. With regard to the expatriation of children, it is always necessary to check with the relevant authorities concerning the necessary documentation to travel abroad.
Luggage The Organizer and Seller are exempted from liability for the loss or damage of luggage when such loss or damage is attributable to the Tourist or when caused by unforeseeable or unavoidable actions of third parties or by change or force majeure. Beyond these cases the liability of the Organizer shall remain limited in any case to what is established in article 95 of the consumer code.
ADDENDUM GENERAL SALES CONTRACT CONDITIONS OF SEPARATE TOURIST SERVICES A) PRESCRIPTIVE AGREEMENT The contracts regarding the offer only of the service of transport, of stay that is of any other separate tourist service, that cannot be able to shape as organization of trip or tourism package, are regulated by the following dispositions of the CCV: art. 1, n.3 and n.6; art. from 17 to 23; art. from 24 to 31, as for the forecasts different from those ones related to the contract of organization as well as from the other agreements referred to the selling of the single service subject of the contract. The seller whom is obliged to provide to third parties, even electronically, a tourist unbundled service, must release to the tourist the documents relating to this service that will bring the amount paid for the service and he may be in no way considered travel organizer. B) CONTRACT CONDITIONS We can apply the following clauses of the above mentioned general sales contract conditions of tourism packages: art. 6 1° paragraph; art. 7 2° paragraph; art. 13; art.18. The application of these clauses does not determine the configuration of the relative contracts in this case of tourism package. The term of the above mentioned clauses related to the contract of tourism package (organizer, trip etc.) is to be understood with reference to the corresponding features of the sales contract of separate tourist services (seller, stay etc.). C) Excursions and services not included in the price of the package The excursions and services purchased by the Tourist on site and not included in the price of the tourism package, although possibly shown and described in this catalogue, are not part of the agreement entered into with the Organizer. Therefore, no responsibility can be attributed to the Organizer in the event that individuals, such as tourist guides or local representatives offer the booking or sale of such excursions. D) Excursions and services included in the price of the tourism package or booked together with the tourism package For excursions included in the package price (both those included in advance in the package, and the optional ones added on request of the Tourist) and whose implementation is subject to reaching a minimum number of participants, it will be the responsibility of Maritaly by Gazzelle Viaggi booking to notify the availability of the tour in advance and in any case not later than 20 days prior to departure, unless special offers and unless otherwise specified in the catalogue or at the time of booking request. Failing to reach the minimum number of participants, the Tourist is entitled to withdraw from the agreement or to pay an “exclusivity” extra charge, which will be specified from time to time depending on the type of excursion, for the correct implementation of the tour, even with a lower number of participants. For excursions that involve major activities to be carry out outdoors (nature, adventure, hot-air balloon, sailing), should it be impossible to carry them out on the scheduled day due to bad weather, force majeure, accidents or other unforeseeable events, and, therefore, not attributable to the Organizer, Maritaly by Gazzella Viaggi, whenever possible, shall postpone the excursion to another day before departure, notifying this change to the tourist within 24 hours before the estimated time for the excursion. Alternatively, the organization shall offer the tourist the opportunity to participate on the same day to another excursion not dependent on the weather conditions, without thereby having to pay any difference in price. If none of the proposed solutions is deemed satisfactory, the customer shall be compensated by way of a refund of the price paid for the excursion at net of any operating expenses, file management fees and agency fees.
