Our story . . .

As a true pioneer in his field, Mark was the “first” in so many respects in Westchester County and the surrounding counties. In the 1990’s, Mark was the first Realtor® to place his photo on a business card, put his contact information on a “for sale” sign so buyers could get answers quickly to their questions, use “virtual tours” on the internet and print color postcards to mail out to procure buyers for his sellers, despite the prohibitive expense of printing in color at that time.

Starting in early 2000, while other brokerages continued to advertise using “old fashioned print media,” Mark had the vision to realize the buyers weren’t looking in newspapers anymore, but were searching on the internet. The Big Question

What is more important, the commission split or the amount on the 1099 at the end of the year?

The first question that most agents ask is: “What is the commission split?” If a Brokerage gives an agent a high split, but does not provide leads to the agent and also does not teach the agent how to procure and close more leads, then what does a high split do for the agent? 70% of zero . . . is still zero.

This is where a highly efficient Team comes into play. Yes, the splits are less, but the volume is much, much higher . . . therefore the 1099 is much, much higher!

Did you know that there are approximately 13,000 agents who sell real estate in Westchester, Putnam and Dutchess Counties? Did you also know that in 2023, LESS than 426 agents sold at least one property per month (12 per year)? That is only 5% of the agents! That means 95% of the agents sell LESS than one transaction a month.

It gets worse. In 2022, less than 12% of all agents sold just six transactions a year. On average, that is one sale every other month. So, 88% of the agents are doing less than that! Really?

For example, if an agent is on a “great split” of 70%, but closes four transactions a year, how

much money could that agent actually make a year? In addition, how much of the agent’s money did it cost to get those leads, buy sign riders, pay for Zillow ads, mailings, flyers, etc? And also, how much time out of an agent’s day, week, month, etc. did that agent work in real estate . . . to close just four deals . . . ?

So, if all of these Brokerages are so awesome, then why, on average, are 88% of their agents selling less than six properties a year? Unless an agent has an “awesome, multi-million dollar average price,” how can someone make a living on such few sales . . . even though the “split is so awesome”?

This is where an effective TEAM comes into play. On the Mark Seiden Real Estate Team, all of our agents are producing and selling many more homes . . . so the 1099 at the end of the year is substantial. Isn’t this why you wanted to sell real estate in the first place?

Mark Seiden was born to become a real estate leader and professional coach. As a graduate of Cornell University with post-graduate credentials from the University of California–Berkeley, he began his career in 1993 at Lois Seiden Real Estate of Westchester County, New York, and was the agency’s top agent each year until it was sold in 1997. He continued his ascent by earning a position as the Number 1 Agent for all of Westchester County at Coldwell Banker Residential Brokerage for five consecutive years (1997-2002). In 2003, he founded Mark J. Seiden Real Estate, Inc., rebranding it as the Mark Seiden Real Estate Team in 2008.

Since 2004, Mark was and continues to be ranked among the Top 3 Agents for selling single-family homes in all of Westchester/Putnam Counties (over 12,000 agents) — ranking Number 1 in 2008, 2014 and 2015.

A natural mentor and gifted communicator, Mark and his work have been featured in articles in the New York Times, New York Post, Real Estate In-Depth, Westchester

Magazine and numerous other publications. In 2016, Mark was recruited by Verl Workman of Workman Success Systems, who is recognized by Inman as one of the top 25 coaches. Allyson join the Mark Seiden Real Estate Team in 2005. As the Team’s Listing Partner, Allyson has led the sellerrepresentation side of the Team and has been the driving force in closing over 700 properties, establishing Mark J. Seiden as a Top 3 Agent in all of Westchester County.

Definitions

Showing/Buyer’s

Specialist: A Showing/Buyer’s Specialist is defined as a Team Member who will be utilized as a “Showing Specialist” for clients of Buyer and Senior Buyer Specialists for all “out of the office” and/or at-property, inspections, appraisals, walk-thrus, etc. In addition, the Team Member will work with own buyers as defined below.

• The Team Member may work with buyers generated by Mark Seiden up to $799,999. Any buyers purchasing above $799,999 will work with a Buyer’s or Senior Buyer’s Specialist.*

Buyer’s Specialist: A Buyer’s Specialist is defined as a Team Member who will work with buyers and utilize a “Showing Specialists” for all property showing appointments, inspections, appraisals, walk-thrus, etc.

• The Buyer’s agent is required to use a “Showing Specialist.”

• Authorization for a transaction without the use of a “Showing Specialist” must be approved by Mark Seiden prior to TEAM MEMBER working with the buyer in this capacity, or below the minimum price of the $799,999 standard in place for use of a “Showing Specialist.”*

• The Team Member may work with buyers generated by Mark Seiden up to $1,500,000. Any buyers purchasing above $1,500,000 will work with a Senior Buyer’s Specialist.*

Senior

Buyer’s Specialist: A Senior Buyer’s Specialist is defined as a Team Member who will work solely with buyers and utilize a “Showing Specialist” for all property showing appointments, inspections, appraisals, walk-thrus, etc.

• The Senior Buyer’s agent is required to use a “Showing Specialist.”

• Authorization for a transaction without the use of a “Showing Specialist” must be approved by Mark Seiden prior to TEAM MEMBER working with the buyer in this capacity, or below the minimum price of the $799,999 standard in place for use of a “Showing Specialist.”

• The Team Member may work with buyers generated by Mark Seiden at any price. There are no price limit restrictions.

* Team Member may work with buyers generated by Team Member’s personal sphere at any sales price.

Promotion from Showing/Buyer’s Specialist to Buyer’s Specialist

Minimum production requirements in order to be promoted from Showing Specialist to Buyer’s Specialist. All these closings must occur within the same twelve (12) month period.

In order to be promoted from Showing Specialist to a full-time Buyer’s Specialist, the Showing Specialist must produce a minimum of ten (10) closings by a combination of the following:

• Minimum of three (3) closed Buy-Side sales from the TEAM MEMBER’s personal sphere.

• Minimum of three (3) closed Buy-Side sales from Mark Seiden’s lead system (not including open houses).

• Minimum of two (2) closed Buy-Side sales from Mark Seiden’s open house system.

• Minimum of two (2) closed List-Side referred sales from any means.

Promotion from Buyer’s Specialist to Senior Buyer’s Specialist

Minimum production requirements in order to be promoted from Buyer’s Specialist to Senior Buyer’s Specialist. All these closings must occur within the same twelve (12) month period.

In order to be promoted from Buyer’s Specialist to Senior Buyer’s Specialist, the Buyer’s Specialist must produce a minimum of seventeen (17) closings by a combination of the following:

• Minimum of four (4) closed Buy-Side sales from the TEAM MEMBER’s personal sphere.

• Minimum of seven (7) closed Buy-Side sales from Mark Seiden’s lead system

Of the eleven (11) closed Buy-Side sales from above, six (6) closed Buy-Side sales must be at a sales price at or exceeding $800,000.

• Minimum of four (4) closed List-Side referred sales from any means.

Commission Structure: Showing/Buyer Specialists

Training Period/Initial Showing/Buyer’s Specialist Commission Fees

As a new Showing/Buyer’s for Mark Seiden, while performing as a “Buyer’s Specialist,” the Team Member shall be paid a commission for the:

First two buyer side closings (not rental/leasing): 40.0%

Third and fourth buyer side closings (not rental/leasing): 43.5%

Fifth and above side buyer side closings (not rental/leasing),

Full Commission Fee Split: 47.0%

For all sales generated by the Showing/Buyer Specialist:

• For being a “Showing Specialist” whereby there is also a Buyer Specialist or a Senior Buyer Specialist involved in the transaction, the TEAM MEMBER shall be paid: at an hourly rate of $20.00/hr. commencing at the actual time the TEAM MEMBER arrives at the 1st. property for showing/inspecting, etc, until finished with the last property showed. There is NO paid hourly rate for traveling to the first property or traveling back from the last property shown. A 10% bonus of the “buy-side” commission, on closed sales, for any deals whereby the TEAM MEMBER was used as the “Showing Specialist” in any way.

• For being a “Buyer Specialist,” Team Member shall be paid a commission of 47% (after the FOUR Training Period/Initial Showing/Buyer’s Specialist Commission transactions are fulfilled), on closed sales, for any deals whereby the “Showing Agent” was not utilized with a client. Authorization for a transaction without the use of a “Showing Agent” must be only for buyers of the TEAM MEMBER’s personal sphere or other situations as they arise, all to be approved by Mark Seiden prior to TEAM MEMBER working with the buyer in this capacity, or below the minimum price of the $799,999 standard in place for use of a “Showing Specialist.”

Commission Structure: Bonuses and Reductions

• A 25% bonus will apply to Listings generated by the TEAM MEMBER’S personal sphere. These Bonuses will be paid only when the Listing has closed. This bonus will not be paid for call-in listings to the office or for prospects that have been developed/ procured/established by the Mark Seiden team system.

• In the event of an agreed to commission reduction by Brokers and/or settlement deducted from the Mark Seiden Team, the reduction is taken off of the gross commission and the remainder is based upon the splilts outlined.

• A 15% bonus will apply to Listings generated by the TEAM MEMBER’S previous sale that the TEAM MEMBER procured previously as a BUYER’S AGENT with that client. Whereas that client was originally brought to Mark Seiden via Mark Seiden marketing. This bonus will only be deemed earned if the TEAM MEMBER kept in touch with the client(s) thru phone calls, mailings, emails, etc. on a reasonably regular basis. This bonus will only be deemed earned if the seller client contacts the TEAM MEMBER first and the TEAM MEMBER brings the seller client to the Listing Partner/Mark Seiden. These Bonuses will be paid only when the Listing has closed. This bonus will not be paid for call-in listings to the office or for prospects that have been developed/procured/established by the Mark Seiden team system.

• If the real estate commission is reduced because of a referral to be paid on the buying side, the referral fee is taken off of the gross commission and and the remainder is based upon the splits outlined.

Commission Structure: Personal Family Property

• TEAM MEMBER is permitted to sell personal residence or personal rental property and will receive a 70% commission on the list side of commission if property was listed with Mark Seiden when sold, or an in-coming referral fee when property closes. Limited to two transactions per year.

• TEAM MEMBER is permitted to purchase personal residence or personal rental property and will receive a 75% commission on the buy side of commission or in-coming referral fee when property closes, whether or not Mark Seiden was in anyway responsible. Limited to two transactions per year.

• In the event TEAM MEMBER shall receive any real estate commission during the term of this Agreement for a real estate commission related to the purchase or sale of any personal real estate property, or investment real estate property for a direct family member (i.e. mother, father, brother, sister or legal children); whether or not Mark Seiden was in anyway responsible, TEAM MEMBER shall receive:

60% referral fee from any closed OutGoing Referral (in-coming referral fee).

60% commission on a direct Mark Seiden buy-side sold/Non Out-Going Referral, Buy-side commission when property closes.

50% commission on a direct Mark Seiden listing sold/Non Out-Going Referral, List-side commission when property closes.

Out-Going Referrals (in-coming referral fees)

• For all listings and buyers generated by the Team Member that will be referred out to a Brokerage other than Mark Seiden, he/she shall be paid a referral fee commission of 50% (less any “Lead Generation Dept.” procurement commission 2-5%) of the in-coming referral commission from the closed sales where the Team Member procured the referral from his/her own personal sphere client.

• This bonus will not be paid for Mark Seiden procured leads to the office or for prospects that have been developed/procured/established by the Mark Seiden team system.

Commission Disbursement and Team Member Expenses

All commissions due from Mark Seiden to Team Member will be paid via the Howard Hannah | Rand Realty commission payment schedule.

• The TEAM MEMBER shall be responsible for the following expenses:

Your yearly and monthly Real Estate Dues and license renewal

Your “office” expenses, if applicable

Your electronics, social media and cellular/car telephones

Your yearly Automobile insurance

Your Business card reprints (first set of business cards supplied by TEAM)
