Reflecting on 2015 As we approach the end of another year we reflect on what the Master Builders Association has achieved over the past twelve months as well as prepare ourselves for 2016. The Association has been busy working on a number of issues affecting us locally, with the major one this year being the royal commission into trade union governance and corruption. The Commissioner’s report is due to be presented at the end of the year and I’m sure it will make for interesting reading. As we’ve acknowledged previously, there have been a number of members and staff who have been willing to go before the commission and give evidence to expose some of the activities that have been taking place in our industry. I believe this has led to change for the better starting to take place and helped encourage other members in saying enough is enough when being confronted with intimidation and harassment. Members of the Master Builders Executive Committee have been working on a number of other issues including building quality in the region, which has led to a major review of the building regulatory system within the ACT. This is one instance where our members are asking for more stringent requirements and regulations around licencing and training; normally we are pushing for less regulation. We’re very pleased to be working closely with Access Canberra on this matter and appreciate the continued input they are seeking from our members. Variation 306 of the Territory Plan is another area where our members have been working with the ACT Government. The major concern is design outcomes that aren’t achieving the intent of the Variation. We’ve been able to highlight what can be achieved with sensible and sensitive design at the Master Builders display village at Moncrieff, which is due to open in the first quarter of 2016. The work we’ve undertaken on the display village has helped demonstrate a solution which is more workable for industry while maintaining the policy intent and has been a beneficial means by which we’ve been able to cooperate with Environment and Planning Directorate.

Support for the local building industry is another issue the Association has been lobbying for and will continue to do so. Over the past few years the majority of local building companies have been unable to tender for major ACT Government projects, whereas for the previous 20 to 30 years this wasn’t the case. This has detrimental effects on the local region that have been highlighted in recent times. Firstly with the majority of the ACT Government’s capital works program tied up in large projects such as light rail, the north side hospital at UC and the law courts to name a few, some local companies have been put in the position where they have had to seek opportunities outside the ACT. With large national companies delivering these projects this has also meant a bigger percentage of the money we spend on these projects is leaving the region. Having said that, the Association appreciates the ACT Government is listening to our concerns and working with us to improve the situation; although there is some way to go to ensure we have an environment where the local companies are able to compete on the majority of capital works in the Territory. As this is my last article for the year I’d like to thank the Board, senior executive members and all staff for their hard work and effort over the past twelve months. The respected position the Association has in this region is entirely because of the dedication and commitment of our members and staff, something we need to ensure we continue to work hard at maintaining. On behalf of the Executive Committee I’d like to wish all staff and members a safe and Merry Christmas as we look forward to representing your needs going into the New Year.

Encouragingly, government is keen to engage to better explore the benefits of active partnerships. We saw this in the collaborative approach taken to the Mr Fluffy demolition process where local construction expertise combined with government smarts to deliver a powerful dividend for our community. Building on this strengthening trust represents a major opportunity. We have another huge opportunity that, if effectively embraced, could see our industry powering into the future delivering ever more compelling value to clients through boosts in safety, productivity, innovation and attitude.

Anyone who listened to the conversations recorded for the Royal Commission into Trade Union Governance and Corruption will have an inkling of the impact the local construction union has on our industry and community. Irrespective of views about the motivation behind the Royal Commission, the evidence collected paints a picture of bullying, intimidation and exclusion that has strangled competition and sapped our industry.
For every $1 million spent on construction, an additional $2.9 million can be generated within the broader economy, giving rise to 46 jobs.
For example, it was revealed that the union extracted $1.2 million (not including memberships or ‘donations’) in undisclosed payments through its pattern enterprise bargaining agreements from businesses and workers over the course of the 2014 financial year.
Empowering Canberra This headline figure from the Australian Bureau of Statistics serves as a reminder that the construction industry’s job is more than building roads and bridges, schools and hospitals, homes and workplaces. It’s true that these things are the foundation of a productive, vibrant, growing community. But beyond the infrastructure that delivers efficiency and quality of life, the construction industry creates jobs, investment and opportunities throughout the entire economy. Gearing our national capital up for growth is essential. We can start by honestly and robustly challenging ourselves to address two major failings of the past 10 years that severely impact our industry today. The first was losing the confidence that governments once had in us to build our city; the second was lacking the courage to confront an increasingly destructive union. Ten short years ago our governments relied on local industry for the bulk of their construction needs. The first instinct of our local government today appears to be to look outside Canberra for all but the smallest of jobs. We’ve got to win back this trust and ensure our local construction industry can compete fairly for government jobs. We don’t need to be protected, but must win back the right to compete. The net result of the current context is that Territory tax payer dollars disappear over the border and take the jobs with them. Every time we import construction services we export opportunity. Using local construction services boosts quality as locals literally stand by what they build. It captures experience, rather than seeing this also exported beyond our borders, and it stimulates the economy with locals spending locally. These advantages are uncontested. Canberra’s construction expertise continues to deliver fantastic projects for the private sector, such as our world-class airport, but we can’t even tender for larger government projects.

That’s $1.2 million that should be in the pockets of workers or be reinvested in Canberra businesses. Granted, across the country the union faces tens of millions of dollars in legal fines and penalties, but that’s a bill that should never be paid by our community. By actively promoting conflict the union destroys the teamwork that is the cornerstone of productivity and safety in our industry. The casualties of this false war are counted in reduced competition, inflated costs and lost jobs. The emotional cost across the industry is enormous, but even this pales when compared with the total cost to the broader community. The union’s cut, plus the impact on competition, adds an estimated 20 to 30 per cent to the cost of building our schools and hospitals. Often this means the social infrastructure we need just doesn’t get built. We now have a chance to re-set the fundamentals of our industry by doing what we should have done from the start – stand up to the bullies and saying ‘no’ to union demands that hurt our industry and community. We can also return the cash extracted by the union to workers, to builders, to clients and our community. We can add even more value by empowering teams, boosting safety, lifting productivity, enhancing job security and ensuring that satisfaction and pride in a job well done are central to our construction culture. We can also take back the freedoms denied by the union to workers, including reclaiming the right for workers to choose when they want to take their rostered days off, rather than being forced into lock down weekends by the union. And we can embrace competition by opening our doors to new businesses and ideas. We have a once-in-a-generation opportunity to win back the trust of government, wind back the cost of bullying, and make our industry a modern powerhouse of competition, productivity and innovation. It’s an exciting time to live and work in Canberra.

Enterprise bargaining in 2016 The current pattern CFMEU enterprise bargaining agreement (EBA) expires in March 2016. The CFMEU has attempted to commence negotiations for its 2016 pattern CFMEU EBA, which has now been released. It contains a raft of restrictive work practices, union revenue streams and unsustainable demands. Analysis of the 2016 pattern CFMEU EBA While the 2016 pattern CFMEU EBA does not contain annual wage increases at this stage, early indications are that the union will be pushing for yearly increases of 5%. The extra money to afford such wage increases has to come from somewhere, either through inflated construction costs or productivity increases (i.e. more being produced for the same inputs). Estimates of productivity for the construction industry have been fairly stable for the last five years (even decreasing by 1% between 2012-2013 and 2013-2014) while the increase in CPI was a modest 1.5% over the past year. The truth is that 5% annual wage increases are unaffordable, unless competition from companies without pattern CFMEU EBAs is restricted. As emerged during the Canberra hearings of the Royal Commission, employers often enter into CFMEU EBAs on the understanding that the union will attempt to exclude competitors with lower labour costs from the market. With the ongoing investigations of the ACCC into potential cartel arrangements in Canberra’s construction industry (which could lead to imprisonment and / or fines of up to $10 million) it is likely that companies with inflated labour costs will no longer be protected from competition, and will find it more difficult to compete. The 2016 pattern CFMEU EBA also inflates labour costs in other ways, by strengthening the union’s revenue streams. Despite likely findings by the Royal Commission about conflicts of interest between the CFMEU and its members, along with potential breaches of competition laws, the union has continued its practice of using its pattern EBA as a running-sheet for CFMEU business interests. The 2016 pattern CFMEU EBA requires employers to use union-nominated insurance products (which only insure 10

union members) make donations to its charity (CCW) and use its training body (CSI) for vocational training, which in turn provide commissions to the CFMEU. These oncosts artificially inflate companies’ labour costs and tax wages, thereby reducing companies’ competitiveness and employees’ job security. The 2016 pattern CFMEU EBA also denies employees freedom of choice over superannuation funds, mandating use of CBUS. The 2016 pattern CFMEU EBA contains familiar restrictive work practices, such as lockdown weekends and ‘jumpup’ clauses for subcontractors, which further reduce the competitiveness of signatory companies. A significant new clause provides the union with the right to hold a paid meeting with employees for up to two hours per shift. In Queensland, this clause has used in a ‘rolling’ fashion for key trades (i.e. with one trade after another taking a two hour paid meeting) effectively giving the union standing rights to completely disrupt jobs and leverage demands. The 2016 pattern CFMEU EBA is also non-compliant with the proposed Building and Construction Industry (Fair and Lawful Building Sites) Code 2014, which is likely to be introduced by the federal Government to the Senate in 2016. If passed, it would apply to all EBAs entered into since April 2014. Companies with non-compliant EBAs would be prohibited from tendering from government work.
Members’ rights to offer a company-specific EBA Members may have already received a letter from the CFMEU requesting that they commence bargaining for the 2016 pattern CFMEU EBA and asking them to send out a notice of representational rights to employees (which would commence the bargaining process). Members should not send out the notice, unless they actually wish to commence negotiations for a new EBA. Members have a number of options when it comes to enterprise bargaining. Members could simply do nothing and maintain their existing arrangements (which could include keeping an existing pattern CFMEU EBA, or simply being covered by the relevant modern award. Alternatively,

This leaves more money in the kitty to award wage increases to employees, while maintaining a company’s competitiveness and employees’ job security. Company-specific EBAs can also offer employees freedom of choice over when they would like to take their RDOs, which superannuation fund they would like to retire with and which insurance product they would like to pay into. If members wish to commence bargaining for a new EBA, the first step is to ask employees if they wish to be represented by the CFMEU, or wish to represent themselves. Employees can appoint themselves or another employee to represent them in negotiations, by signing an instrument of appointment (which Master Builders can provide). If employees do not wish to be represented by the CFMEU, the union has no right to participate in negotiations.

they can enter into company-specific EBA that suits their business and their employees, rather than a ‘one size fits all’ pattern CFMEU EBA.
If employees do wish to be represented by the CFMEU, that requires members (or a member’s bargaining representative, such as Master Builders) to meet with the CFMEU, consider proposals and give reasons for refusals, but it does not require any agreement or even any concessions. In other words, members are entitled to ‘say no’ to the 2016 pattern CFMEU EBA and to offer their own company-specific EBA. If negotiations with the CFMEU reach an impasse, members are entitled to put a company-specific EBA directly to a vote by employees, regardless of whether the CFMEU agrees with the proposal (the union just has to be informed that a vote will occur). The power is in the employer’s hands – only an employer can initiate a vote. If a majority of employees approve the proposed EBA, it can be certified by the Fair Work Commission. Talk to your employees The focus of negotiations should always be with employees – talk to them, ask them what they really want. Employees are the ones that will need to approve the EBA, not the CFMEU. Members can commence negotiations for a new EBA before the nominal expiry date of the current pattern CFMEU EBA. If a new company-specific EBA is approved it will commence operation once the current pattern CFMEU EBA passes its nominal expiry date in March 2016. Safety with a story! October was Safe Work Australia Month, and I had the privilege of attending a number of seminars and webinars. Whilst the seminars and webinars all delivered a safety message, it was the diversity in the ways the messages were delivered that got me thinking. While thinking about this, an article from Trinette Jaeschke came across my desk, “Follow the red brick road… a story to a safer workplace!” i (I think she meant the yellow brick road). This incited the question – what is the best way to deliver the safety message? The messages I instantly recall from the seminars and webinars are those attached to emotive stories. Even from my childhood, I still recall the stories recounted by the procession of relatives through my grandmother’s house at Christmas, especially those from the “eccentric ones”. Trinette states in her article, storytelling is a powerful means to convey a safety message. The stories do this by provoking emotions and encouraging a connection with the message, as opposed to a lecture telling workers what to do (a boring them or getting them off-side); but why are stories better than the lectures? I believe safety is a conversation, and storytelling gives workers a picture of the meaning behind the information provided. I know I tend to tell stories when talking to workplace, especially younger workers. It creates an emotional link between workers and the issue, reflecting the culture in the workplace or the changes desired. Trinette goes on to states that there are a couple of different stories that will help improve workplace safety - warnings, quests and tragedies. All are emotive ways of presenting the information.
Warnings are stories that can help provide caution. These types of stories find a way to explain, “This is what happened, this is what the risks were and this is what we did to manage the situation”. They form a platform for bringing the issue to life. They help workers engage with an idea that there is a problem, or something can easily go wrong creating a risk or causing harm. Warnings demonstrate the dangers or risks involved with situations, and relate these back to the workplace. These types of stories work well when by alerting workers to what could potentially go wrong. From situations of “lost hope and despair”, quests demonstrate to workers how safety outcomes can been achieved. These are stories that encourage workers to continue to improve safety and show outcomes can been achieved from difficult situations. Even in our personal lives, we often tell stories about where we have been and where we are going. Business leaders are especially fond of telling these when implementing change. The same applies to safety. Quests are able to show and demonstrate successes achieved, so it is a useful strategy to motivate and encourage workers to do the right thing. Stories of tragedy can help motivate workers. Often organisations (and conferences) bring in motivational/ inspirational speakers who now have a disability due to a workplace incident. They tell their story and provoke an emotional connection in workers. This drives the behaviour desired by the workplace. If the leadership team is delivering the story, it must be credible and based on the truth to get any real value. A word of warning; workers may ignore the message if the stories do not relate to the workplace and the belief is that it cannot happen to them, or if the stories are overdone they become desensitised. Next time there is an issue in the workplace, try one of the story styles above and reflect, listen and observe what is going on.

Royal Commission into Trade Union Governance and Corruption The Royal Commission into Trade Union Governance and Corruption has found evidence of bullying, intimidation and exclusion that is strangling competition and sapping our industry.
These three examples – three of many – underscore why Master Builders ACT has launched the ‘Get a Better Deal’ campaign.
Evidence has been tabled that the CFMEU raised $1.2 million in 2013-14 from undisclosed payments in enterprise bargaining agreements (EBAs) – and that’s just in Canberra. This has inflated costs, eroded competition and put jobs at risk.
We want to encourage employers and employees to work together to build cooperative workplaces, healthy competition and shared value.
Nationally, the union has paid out more than $10 million in court fines and legal settlements in the past year. These fines are imposed for breaches of industrial laws – for acts such as coercing employers to enter into the CFMEU’s pattern EBA or pressuring employees to become union members. These fines are ultimately passed on to members. And a recent survey of members conducted by Master Builders ACT found that 60 per cent of respondents had had their livelihoods threatened if they did not sign the CFMEU’s pattern EBA. Half of all those surveyed had been told by CFMEU officials that they could not perform work unless their employees were union members. A whopping 70 per cent of people had been verbally intimidated by a CFMEU official and 40 per cent had been physically intimated.

Many construction industry workers are surprised to learn that they can get the same or better pay and conditions with an EBA that they negotiate with their employer. So, we are letting them know that they can reclaim their freedom to choose when they work, where they train and how they invest their hard-earned savings for retirement.
We are explaining to them that workers on construction sites around Canberra are negotiating EBAs that enable them to bank their RDOs and take them during school holidays, or even cash them out, as CFMEU officials do. We are also dispelling some of the myths about EBAs. While it’s often claimed that being covered by a pattern CFMEU EBA improves safety outcomes, research reveals that having a union EBA doesn’t improve safety on construction sites. In fact, three of the four tragic deaths in Canberra’s construction industry in 2011-2012 occurred on sites covered by pattern CFMEU EBAs. An examination of companies’ lost time injury rate reveals no correlation between safety records and CFMEU EBAs. The CFMEU’s combative approach to safety may even decrease safety outcomes, with only one company out of 76 recently surveyed
We think it’s time to re-set the fundamentals of our industry. Our plain speaking, fact-based campaign aims to reconnect employers and employees. We’ve developed a suite of fact sheets, and an information pack that can guide employers and employees through the process of negotiating their own EBAs. Working together as a team is the best way to put the money back in pockets of workers and businesses, and the best way of building a better future for everyone. MBA ACT Director Industrial Relations, Mr Nikolic told the Royal Commission the effect of the CFMEU’s conduct in the Canberra building industry is that emerging small businesses are eliminated from the market: “Emerging small-to-medium sized competitors are … excluded from the market, unless they submit to labour costs [under union EBAs] that may be unaffordable at their economy of scale. One does not need to be an economist to realise that the suppressed competition which would result from such practices (along with the economic costs of disruption) would inflate construction costs, stifle the innovation of new entrants and restrict growth.”

Get a better deal
Another myth we’re determined to dispel is the idea that unions always act in employees’ best interests. Royal Commission evidence has uncovered widespread threats to businesses and employees who refuse union membership. In one Australian Federal Police phone tap, for instance, a union official warned an employer to “move” an employee “off the job” because he didn’t want to become a union member. During another phone tap, a union official told an employer that the CFMEU would ensure that the company “won’t be doing any work on commercial sites” if he didn’t pay for union memberships – effectively sending the company broke and putting people out of work.

Master Builders ACT has released its Safety Policy. This Policy is the final in a series of policies released progressively over the last 12 months as the Master Builders Executive Committee determined, in the lead up to the next ACT Election in October 2016, that we needed to make sure all sides of politics were fully aware of our priorities that will help create the city and region we all want. Already released are our Procurement Policy, Land & Planning Policy, Education & Training Policy, and Building Quality Policy. The Safety Policy paper is viewed as the most important policy to be released. As a result, we have taken our time to widely consult with stakeholders to develop the policy. The Policy “seeks to combine the collective membership’s resources to help the members, and the broader industry, create a work environment that allows the best chance of people returning home from work safely.” The Policy sets out five deliverables:
1. Safety is seen as an opportunity, and as a collaborative and positive experience
2. Safety is the foundation for achieving productivity and quality
3. Safety is an integral part of the skills, knowledge
and culture obtained through construction industry education
4. Every person understands that there are risks which
they can influence and have control over, and that they can be actively involved in the management of those risks
5. Safety is never used to drive unrelated agenda 20

The deliverables are not “locked in” and success will only be achieved if:

3. Monitoring of progress of each individual task through its life cycle

bounce After a number of difficult years ‘quiet confidence’ is returning to Canberra’s construction sector. The bounce comes amidst a broader upturn in private sector confidence with the latest Sensis Business Index reporting that business confidence levels in the ACT are now the highest in the country. The Sensis report showed business confidence in the ACT was significantly higher than the national average, and higher than in New South Wales, Queensland and Victoria. ACT Chief Minister, Andrew Barr, said the results showed that the ACT has ‘turned the economic corner’ from the impacts of the Commonwealth Government cuts. “The ACT has already seen strong growth in our building approvals, and the ACT’s credit rating was also recently reaffirmed at AAA+ - the highest rating possible by Standard & Poors,” Mr Barr said. Executive Director of Master Builders ACT, Kirk Coningham, confirmed the Chief Minister’s view that prospects, particularly for the private sector, were improving. “Eight months ago, the best people in construction would say was that our industry was ‘bouncing along the bottom’. The view was that the worst was behind us, but confidence was flat. “In the past month or so we’ve seen a real change. Now members are telling me they are ‘quietly confident’ about the next two years. Good builders have work in hand and the prospect of further work in the pipeline. “We continue to struggle with a lack of clarity and certainty around the pipeline of government work, particularly in the commercial sector, but our residential sector is reporting an increase in confidence,” Mr Coningham said. The increase is justified in part through positive data from Master Builders nationally with forecasts for a year ‘of solid growth in the value of residential building work done in 2015/16 that will once again provide further impetus to growth in the Australian economy’. The latest building activity data show that the residential building upturn has further to run, ‘with claims to the contrary running the risk of jumping the gun’. Official ABS figures show better than expected dwelling commencements totalling 211, 500 for 2014/15. Master Builders is predicting 200,000 plus starts this financial year. “Although forward indicators may have peaked, there is a solid pipeline of work in train for at least another year, more likely 18 months to two years. For 2015/16, Master Builders expects real growth in the value of residential

building work done of 2½ per cent (more than 5 per cent in nominal terms). The forecasts are predicated on interest rates remaining steady in the short to medium term,” CEO, Master Builders Australia, Wilhelm Harnisch said. The figures are looking even better in the Territory with an estimated 8,900* residential dwelling sites coming to the market in the next two years. “Our Master Builders display village at Moncrieff will be complete in March next year, the precursor to a mini boom in residential sites including Moncrieff, Throsby, West Belconnen, Denman Prospect, Riverview, South Jerrabomberra, Taylor, Kingston foreshore, Mr Fluffy, CSIRO and construction on social housing,” Mr Coningham said. “Consistent with the ACT government’s policy of increasing the density of housing stock we expect the mini boom to include a number of low-rise multi-dwelling residential buildings. This opens opportunity to commercial as well as residential builders.” Master Builders ACT also pointed to the trade union royal commission as a distinct positive for Canberra’s construction industry. “The best thing to come out of the royal commission was courage,” Mr Coningham said. “More than 50 hard-working Canberra builders gave evidence at the commission hearings, showing real courage to stand up and tell the sad truth. Their example has strengthened the resolve across the industry in the Territory. “Courage is contagious and we are now finding many more in the industry ready to put their immediate commercial interests aside and act in the best interests of their industry and their community. In short, we’ve got a lot more people, from workers to subbies, from major commercial businesses to clients, ready to say ‘no’ to union demands. Everyone is sick and tired of the union bullies and the false war they seek to create in construction teams. “Some will buckle under pressure as sites are shut down for spurious ‘safety’ reasons, clients, subcontractors and suppliers are bullied, and vexatious litigation hits the courts. We know the union has huge power and wealth and will use this to punish anyone who refuses them. “But many more will stand firm. The end result will be a happier, safer, more engaged industry, with better performing, more flexible, and more productive teams
working together to deliver innovation, productivity, pride and great value to clients. The end of the union’s false war will deliver major benefits for our industry and community including cheaper hospitals, schools, roads and bridges.

The Public Housing Renewal Taskforce is forecast to build about 700 new dwellings over the next two years, and will boost these numbers with the purchase of product from the private sector in the order of 360 dwellings, of which 116 are already under contract. Shovel ready / build ready land, 740 dwelling sites are earmarked for release in 2015-16, which is 240 more than initially programmed.

Drug-safe building sites becoming a reality. Around two years ago, the Master Builders ACT and Frontline Diagnostics started a conversation regarding the disturbingly high incidence of alcohol and other drug use within the building and construction industry. Research from the Australian Drug Foundation on workplace drug and alcohol use has the building industry as high as one in five people working while affected. It was agreed between the two management bodies that an approach to Government may have some positive response, particularly with the ICE epidemic growing steadily. Master Builders ACT and Frontline Diagnostics wished to indicate a leadership response in addressing the growing drug issues. What wasn’t expected was for the Federal Government to take the leadership role and introduce legislation that could herald the start of a new responsible approach to workplace safety. From this legislation was born a partnership between the Master Builders ACT and Frontline Diagnostics to ensure the new world order of Drug-Safe worksites can be introduced smoothly and managed for the duration of the projects ensuring all FWBC audit requirements are met, comfortably. This then allows head contractors and subbies to get on with what they do best, the process of building. Although Frontline Diagnostics had been working quietly behind the scenes with Master Builders ACT to develop a joint Drug-Safe program, the final partnership decision was

offered to several contenders to ensure the final fit would meet the expectations of MBA members. It was found that Frontline Diagnostics exceeded the requirements on all points including the very important, “value for money.”

At a recent information session held in the Master Builders ACT training rooms, Frontline Diagnostics Managing Director, Michael White pointed out the importance of stopping the problem before it “comes through the gate” by running regular Drug-Safe inductions to new staff, contractors and visitors so that there are no misunderstandings. As Mr. White said, “if you can stop it entering your site you’ll dramatically minimize the potential for unfair dismissals, absenteeism, serious injuries, and with the rise in ‘ICE’ , violent behaviour. It really comes down to good management of staff on site and the acceptance that even if you have 20% of your workers using drugs, there are 80% who are at risk of injury”. Improving the ACT Building Regulatory System Discussion Paper Released
ACT Government released its long-awaited discussion paper on the ACT Building Regulatory System on 23 November 2015. This paper follows on from the ACT Government's Building Quality Report released in 2010 and also dovetails with other changes made to the Building Act and the Construction Occupations Licensing Act. This review of the building regulatory system is part of ongoing ACT Government reforms to ensure buildings meet contemporary standards – and the expectations of the community, industry practitioners and businesses and government alike. The Government is proposing reforms to the regulatory system, with the primary focus on residential buildings— single dwellings, townhouses and apartment buildings— and management of retention and project payments. Some of the proposals also apply to non-residential buildings.
It is the view of the Master Builders ACT that construction quality and defect mitigation will improve by adopting a process of collective responsibility by all of the key parties in the construction chain.
Our Building Quality Policy Objectives are; 1.
Advocate to the ACT Government for the establishment of the Building Regulatory Advisory Committee. On 2nd July 2015 Chief Minister Andrew Barr made the announcement of the new advisory committee at a Master Builders ACT President’s Luncheon attended by key stakeholders from the ACT building and construction sector 1.

Implement targeted professional development training for MBA members and the industry. Support the implementation of mandatory professional development training for all construction industry licensed practitioners. The ACT Government has introducing legislation for a system of continuing professional development for licensed construction practitioners through targeted training directed by the Registrar 2.

Advocate to the ACT Government for the establishment of a peer review of Class 2 buildings greater than two storeys. Pre-application guidance and review at design stage for projects including residential apartments3.

Implement two-day annual training seminars delivered by industry professionals for members and industry practitioners. MBA initiative held in Oct 2015.
Master Builders ACT and its members will continue to work with the ACT Government to ensure industry views are considered in the proposed changes to regulations affecting the construction industry. We are very pleased to see that many of our recommendations from our ‘Building Quality Policy’ paper, released in May this year have been adopted for consideration in the discussion paper. The ‘Building Quality Policy’ is part of this on-going review process and aims to maintain and enhance the quality requirements associated with being a member of the Master Builders ACT.

Develop proforma checklists for MBA members using a technology based document management system for recording critical holdpoint inspection stages on projects. Guidance notes for builders of residential buildings (particularly class 1 and 2 buildings), developed in consultation with industry members, could describe standard hold points at critical stages such as the above4. Technology could be better used for administrative and compliance activities and there are opportunities for improving education about the design and building process and regulatory requirements for consumers, builders and other stakeholders. Advocate to the ACT Government for establishing a review of the current building certification and inspection system. The Building Regulatory System discussion paper proposes a range of improvements to the current certification and inspection system.
Secondly, the discussion paper proposes an alternative dispute resolution process for residential buildings. The Government review has identified a range of features that could be beneficial in an Alternative building dispute resolution (ABDR) for the ACT, including that the process:

Two further reforms are proposed in the ACT Government’s discussion paper that affect the residential and commercial sector, and subcontractors. Firstly, the complex issue of payment claims, project funding and retentions are discussed. Ensuring all parties in the contractual chain are paid on time is a shared objective for all players in the construction industry. The discussion paper proposes the introduction of retention and building project accounts. A number of possible models are presented for comment. The discussion paper is also seeking comment on how Security of Payment legislation could be improved.

Canberrans researching a new home have never been more
spoilt for Most successful Master Builders ACT builder members are pro-active in marketing their businesses. A key tool for many of the project home builders has been the use of display homes to show potential customers the design layout, features and finishes they offer. Managed by the Master Builders ACT, and due to open in March 2016, the Moncrieff Display Village will showcase a combination of 12 single and double storey homes that demonstrate innovation in design, sustainability initiatives, and provide examples of livable housing standards. In addition to the group display villages such as Moncrieff, Googong, Coombs and the future Denman Prospect Display Village, builders have also been building stand-alone display homes in the greenfield suburbs and also in established areas. Whilst word-of-mouth recommendations and testimonials from existing customers are still a very effective marketing tool to identify leads, a display home can help to seal the deal. A display home can also present a useful marketing advantage for builders of custom homes. Whilst the design of a display home from a custom home builder is unlikely to be exactly replicated on another site it can provide a useful reference and starting point in terms of the approach to layout, room sizes, lighting, ventilation, building techniques, level of finish and materials.

CHOICE For owners of greenfield sites or existing houses contemplating a new home the opportunity to see and experience a home that has been designed specifically for that site gives a glimpse of what is possible with the custom approach. Master Builders ACT’s members, Danny and Robert Rosin recently opened their Concept Home in Wright, which is open for display on weekends and by appointment. Inspired by the contemporary architect designed project homes of the 60’s and 70’s, Rosin Bros and designer Tomi Milin conceived a single storey, four bedroom home with a modern aesthetic, on a corner site. ‘Concept Home’ rather than ‘Display Home’ was a deliberate choice of terminology to emphasise the ideas that were incorporated: basic principles of logical planning, well-proportioned spaces, the utilisation of light and ventilation for comfort and meticulous attention to detail. The home is also an opportunity for Rosin Bros to trial new materials, products and construction techniques before they recommend them to clients. ‘Low-maintenance’ is one of the requirements that comes up in conversation with potential clients. On this house the approach taken was to minimise the area of painted surfaces externally by the use of an architectural face brick for most of the walls and a relatively new (to the Canberra market) no-painting required, composite-wood external cladding for the upper walls.
Having a Concept Home also allows a custom home builder to have meetings with Clients around a dining table (out of exhibition hours) in a low-pressure, intimate environment as an alternative to meeting in their homes or the Builder’s office. The additional time spent in the house can help reinforce the attributes of the house and let clients imagine themselves living in the space. Rosin Bros has been assisting both owners of existing home looking to rebuild and also people who are looking buy into an established suburb and redevelop. Engaging early with an experienced builder can assist clients in identifying suitable sites prior to purchasing thus avoiding pitfalls such as costly site works and poor solar access. For most people, ideal sites in established areas are tending to be those of around 700 m2 where clients can create a single storey home, conscious of not only getting maximum value from their building budget but also of their own future needs and potential resale value in a future ageing population. Annual Charity Golf Day in support of the Tara Costigan Foundation Monday 16 November 2015, Federal Golf Club, Red Hill The purpose of the Tara Costigan Foundation is fundraising to provide victims with their own Tara’s Angels (personal caseworkers) for a period of up to two years. By connecting and coordinating vital services, Tara’s Angels work with individuals and families to help them secure appropriate housing, financial stability, regain their confidence, courage, self-belief and independence. Tara’s Angels support victims to begin again, create safe homes and build new lives. The format for the day was a four man Ambrose with a shot gun start at 7.30am and 12.30pm. Two fields of players were treated to perfect weather and a course that was in brilliant condition.

The 2015 Master Builders Association of the ACT Annual Dinner and Comedy Gala was held at the National Gallery of Australia. Local comedians Tom Gibson and Chris Ryan were joined by Raw Comedy Champion Luke Heggie and had the audience laughing throughout the evening. Still with its traditional elements, the night celebrated 13 Membership Milestones and two Honorary Memberships. Members gathered in the beautiful Gandel Hall for the premier networking event, where the industry comes together to take stock of its performance over the past 12 months and to consider the outlook for the coming year.

Former leaders of the association receive honorary membership President Valdis Luks made a special presentation at the 2015 Annual Dinner Comedy Gala and invited former Executive Director John Miller and Deputy Executive Director Jerry Howard to accept Honorary Memberships. Over the 90 year history of the MBA there have only been three other Honorary Memberships presented. Honorary Memberships are offered with the view of strengthening the association by the influence of members who have retired from the building and construction industry or other appropriate persons who may otherwise be ineligible for membership. The executive committee may invite such persons to accept honorary membership.
"This invitation recognises the achievements of two people who have served the MBA and the industry with distinction, dedication and passion and have worked together representing MBA members over a long period of time. I think history shows the Association doesn’t give this recognition out lightly and I believe tonight is no different” Valdis said. As the announcement was made, John and Jerry were welcomed with a standing ovation of cheers and applause as they made their way to the stage.

John Miller was the executive director of the MBA from June 2007 until 31 March this year. During that time he tirelessly represented the association and its members throughout this region as well as nationally. While he was at the MBA he represented its members on numerous committees and industry groups, lobbied hard with government and was a passionate advocate for the industry. During his speech, Valdis said “I’ve always been impressed with your positive outlook and attitude to life and found you to be a very encouraging person, fully supportive of work and industry colleagues and looking for the best in every situation.” Jerry Howard has over 40 years experience in the building industry both as a construction manager and as a building surveyor. He commenced with the MBA in January 1999 as the Manager of Technical Services, progressed to the Director of Training and Technical Services then undertook the role of Deputy Executive Director until 1 May this year. Valdis went on to say “Jerry has been a driving force behind much of the MBA’s success including; the group apprentice scheme, the development of the Fyshwick facility including the skills centre. He was involved with display villages, charity houses, submission to government, policy papers and very importantly the Fidelity Fund.”

We have all heard of experimental 3D printers capable of printing toys, car parts, and other gadgets, but Michael illustrated examples of real buildings being printed, onsite, and at full scale. One example showed a 5 story apartment building being printed one floor at a time, stacked and assembled on-site.
Professor Andrew Harris from the University of Sydney spoke about disruptive building technology and its impact on the building and construction industry. The clear message from both speakers to the construction industry is that innovation is happening now, and it is happening rapidly. Forbes Magazine reported earlier this year that technology giant Google had entered the construction industry, spending “$500 million on construction since 2004”. Google’s foray into the construction industry has gone un-noticed by many, including the industry itself, however as Globes online reports, Google’s secret development unit has developed a technology that could earn the company $120 billion a year. Google’s investment has resulted in the creation of Flux, a 25 person, 2 year old company. The project (called Genie) is reported to assist engineers and architects in the design process, especially for large buildings. Forbes reports that Genie “standardises and automates the design and construction processes with unlimited design options, enabling an architect to preserve the building’s uniqueness in the urban environment”.
Another example showed a bridge being built over water in the centre of Amsterdam. The “MX3D Bridge” combines robotic technology and 3D printing technology to ‘print’ an intricate, ornate metal bridge. hopes & dreams The Master Builders Association of the ACT is honoured to join with the Land Development Agency and Renaissance Homes in the Deakin Charity House Project. Launched by the ACT Chief Minister Andrew Barr on Friday 13 November, the third charity house project follows the 2006 Jenolan House Project and in 2013 the Franklin Charity House. For the Deakin Charity House Project we are building two houses on land worth more than one million dollars in Buxton Street in Deakin donated by the Land Development Agency. The first is a two-storey house aimed at second/ third home buyers and families or those who are preparing to have a family. The second is a single story house aimed at those looking at the empty nesters or mature professional couples. The build will be led by Renaissance Homes and the design of the houses was by AMC Architecture. Each house has a unique feel and brings out the best use of the block. The proceeds of the sale of the house will be split between three different charities that support people with a disability and their families. The three charities are; Boundless Children’s Playground, Hands Across Canberra and Hartley Lifecare. Master Builders ACT has already received great support towards the Deakin Charity House Project and expects that over the length of the project Master Builders ACT members will donate in excess of $750,000 worth of labour, materials and professional services.

Deakin Charity House – recycling Canberra Reds for Stromlo Cottage Stromlo Cottage project, is a heritage home the Land Development Agency has restored and will use for its Molonglo Mingle community development program. During the demolition of the Deakin Charity House site (below) we saved a truck load of Canberra red bricks and delivered them to the Stromlo Cottage site. The bricks will be used for the landscaping of the site in 2016, for paving and a BBQ area.

The McDonald Jones Homes team in the Canberra Region have been awarded a National Excellence Award at Master Builders Australia’s National Excellence in Building and Construction Awards held on 14 November 2015.

2015 Kids Assist program celebrates 10 year with PBS Building at graduation breakfast 2015 marks the 10 year anniversary of MBA Group Training partnering with PBS Building in the Kids Assist Program. The success of the program is a reflection of the passion and drive of many people over the past 10 years: people such as Warren Ahrens, Tim Porreca and the team from PBS Building including the many subcontractors who have donated their time to host the students. Since 2001 MBA Group Training has been working with local government schools to produce a program designed to take Year 10 students and put them into a practical and theoretical based training and work experience program. The aim of the program is to provide a structural workplace environment teaching students valuable skills and introducing them to the workforce.

This year saw 25 students from 12 schools graduate at a breakfast ceremony held at Symphony Park, a PBS Building site, at which the majority of the students completed placement. 2015 Canberra Home Show proves to be one of the biggest year’s on record. Master Builders ACT was this year the presenting partner for the 2015 Canberra Home Building Caravan Tourism 4WD and Camping Show. Our involvement included the opportunity for members to be a part of a nine stand section in the Budawang Pavilion at the show. Feedback from the members was very good, all indicating they would return in 2016 if we did it again next year. One of the members participating in this year's show was the team from Downpipe Garden. NATIONAL UPDATE REVISED DRAFT STANDARDS CONTRACT – AS11000 STILL A CONCERN In March this year, Master Builders provided comprehensive feedback on a new contract drafted by Standards Australia – AS11000 General Conditions of Contract (AS11000). Recently we were provided with a subsequent opportunity to consider a revised strictly confidential draft of AS11000. The revised version continues to have systemic defects and fails to recognise a large portion of our objections to the original draft. These largely concern the fact that the contract does not reflect up-to-date plain English drafting or an appropriate risk balance between the parties to the contract. We are also concerned that the role of the Superintendent, in accordance with the contract, is unclear and the constraints on subcontractor engagement are inappropriate. These objections were conveyed in a revised schedule of comments and lodged with Standards Australia. Master Builders will continue to be engaged with Standards Australia in relation to any subsequent drafts of AS11000.
SHIFT IN ENGINEERING AND COMMERCIAL PROJECTS The Deloitte Access Economics (DAE) Investment Monitor is a barometer of structural change in the Australian economy and of the investment climate. In its most recent report, DAE notes that the new PM and Treasurer have ‘rebooted’ a number of important reform processes – tax reform; competition policy reform and financial system reform – all of which have the potential to improve Australia’s international competitiveness and are vital to the long-term economic outlook. As the nation grapples with the end of the mining investment boom, the wind down in LNG projects over the next year and a half will dominate the investment landscape in Australia, with other sectors struggling to fill the gap left in their wake. The Investment Monitor reveals that information media and telecommunications has taken over from iron ore mining as the fastest growing sector in the past year, with mining exploration shrinking fastest as commodity prices continue to decline. The $A and low interest rates are helping both trade and credit-related sectors in the economy namely tourism and international education, along with housing construction and retail. The finance sector and some parts of business services are also benefiting from cheap credit and an increase in M&A

activity. The report finds NSW and Victoria as the main beneficiaries of low interest rates and the fall in the $A, while Western Australia and Queensland are slowing as mining-related construction winds back.
SUPERSTEAM TAX OFFICE SUPPORT FOR SMALL BUSINESS As the SuperStream rollout for small businesses continues, the Australian Taxation Office (ATO) is assisting employers who may need support to implement SuperStream. The ATO has recently commenced an intensive communication program, delivering practical help and information via email and SMS to registered businesses across 22 industries. They are contacting the relevant industry associations and hosting dedicated SuperStream online information sessions (webinars). Small businesses that may need more practical support to start using the new, streamlined super payment process typically rely on manual processes and lack close business support partners. They are particularly prominent in industries such as trades, hospitality, agriculture and construction. The priority for the ATO is to provide practical help and support to those who make superannuation payments on behalf of their employees, particularly those that aren’t frequently online or connected. SuperStream started for small businesses with 19 or fewer employees on 1 July this year and they have until 30 June 2016 to be fully compliant. FOREIGN INVESTOR DEMAND Spending by foreign investors on Australian residential property appears to be easing, accounting for 12.8 per cent of total demand in the June Quarter 2015, down from a 15.6 per cent share in the March Quarter of this year. The figures come from a survey of the Australian residential property market produced by the National Australia Bank (NAB). Foreign buyers were particularly active in the Victoria property market, where they accounted for just over 18 per cent of demand, well ahead of their shares in NSW and WA (at 13.1 per cent and 10.1 per cent respectively).
CITIES AND PLANNING Australia’s cities, and a number of regional areas, can expect to suffer a decline in their ‘liveability’ in the absence of major changes in planning and transport policies and practices. And, without major commitments to improve road transport systems in our capital cities, traffic congestion could cost more than $53 billion a year within 15 years, says a new academic study. The study also estimates there is already a ‘transport infrastructure deficit’ of some $100 billion (reflecting more than four decades of underinvestment), a figure which could blow-out to $350 billion within the next decade unless urgent action is taken.
COMMERCIAL RETURNS Returns to commercial property investors are likely to remain fairly modest over the coming financial year says CBRE, a property consultancy. While returns to investors in office and retail property are expected to edge up toward 3.5 per cent per annum next year (compared to little more than 2 per cent this financial year), investors in industrial property are likely to have to remain content with dividends stalling at around 1 per cent per annum.
NEW NATIONAL COMPETITION POLICY FRAMEWORK The Council on Federal Financial Relations (‘the Council’) met in Sydney on 19 October. The Council is made up of the Commonwealth Treasurer and the Treasurers from each of Australia’s States and Territories. The Council stated that competition reform was required in Australia, and discussed recommendations made in the recently released Competition Policy Review (the Harper Review). It was noted that previous national competition policy reforms had increased Australia’s economic efficiency. The Council agreed to undertake more work on how competition policy could be developed by the Commonwealth and State and Territory Governments to provide greater innovation and economic growth.
Council noted that the Commonwealth planned at the 2016/2017 Budget to expand the application of the GST to include digital products and services. Master Builders Australia endorses the focus by the Federal and State/Territory Treasurers on national competition policy. Master Builders has long called for the Federal Government to adopt national competition policy reforms to drive economic growth and tackle housing affordability in particular.
RESIDENTIAL BUILDING TO STAY STRONG Master Builders is forecasting another year of solid growth in the value of residential building work done in 2015/16 that will once again provide further impetus to growth in the Australian economy. The latest building activity data for the June quarter show that the residential building upturn has further to run, with claims to the contrary running the risk of jumping the gun. The official ABS figures show better than expected dwelling commencements totalling 211, 500 for 2014/15. Master Builders is predicting another year of plus 200,000 starts this financial year 2015/16. High rise apartment projects, particularly in Sydney and Melbourne continue to surpass record levels but detached houses have also been contributing, up by almost 25 per cent from their level of two years ago. New South Wales house starts, seasonally adjusted, jumped 11.6 percent in the June quarter in a hopeful sign that moves by the Baird Government to resolve impediments to land release are beginning to have an impact. Although forward indicators may have peaked, there is a solid pipeline of work in train for at least another year, more likely 18 months to two years. For 2015/16, Master Builders expects real growth in the value of residential building work done of 2½ per cent (more than 5 per cent in nominal terms). The forecasts are predicated on interest rates remaining steady in the short to medium term.
In relation to housing supply and affordability, the Council acknowledged the approaches taken to address issues by Victoria on solutions for supply problems and asked for a national reform strategy for the provision of social housing. Reform of the GST has been a contentious issue between the Commonwealth and State and Territory governments. Various Treasurers and Premiers have stated views relating to the broadening of the base of the GST, increasing the rate with funding to be spent of a specific area, and reforming the apportionment system of GST revenue. The

The Master Builders Fidelity Fund was established in 2002 to protect the interests of both consumers and builders in the ACT. For Builders, the Master Builders Fidelity Fund provides financial certainty as money held by the Fund remains in the ACT. It is securely invested and used for the betterment of the ACT builders and consumers and is therefore not subjected to the vagaries of international markets and events. The Fidelity Fund issues Fidelity Certificates which provide consumer protection for owners of new homes and those making significant changes to homes. The Certificates protect the owner during construction and for up to six years from the date of practical completion.
