News recently of a proposed $61 million Biodiesel refinery on Maui rippled through the islands (“Biofuels: They’re the bomb!” Feb. 22, 2007). Blue Earth Biofuels is seeking $59 million from the Hawai`i state Legislature by way of special purpose revenue bonds to build the project. Blue earth plans to produce bio diesel from imported palm oil and will import at least 40 million gallons per year. Importing oil? How does this create a sustainable local renewable energy economy? I thought we were trying to get away from this paradigm? Gee whiz, Mr. Wizard! I did some research into palm oil and was awestruck by the devastation palm oil plantations are causing to the world’s great tropical rain forests. Palm oil production is driving deforestation and cultural destruction in Africa, the Amazon, Central America, Indonesia, New Guinea, Malaysia, Borneo, SE Asia, and islands in other Asia Pacific regions. Sixty million acres are planned for palm oil plantations in Malaysia and Indonesia alone because palm oil is in such demand. The main culprit of deforestation is China’s burgeoning economy consuming huge tracts of tropical forest. In fact palm oil plantations using slash, burn, wetland draining methods are the third largest carbon dioxide producer in the world contributing eight percent of all global CO2 emissions. In April 2006, China purchased 28.2 million cubic feet of Indonesian old growth hardwoods to build sports facilities for the 2008 Olympic summer games at cost of one billion dollars. Huge swaths of tropical forest have been illegally logged by the Indonesian military and sold to China. After the land is logged it is converted to palm oil plantations. The Borneo rain forest is considered the lungs of Southeast Asia. This ecosystem is home to 7,000 species with a bio-diversity unlike anything on Earth. It’s home to elephants, miniature rhinoceros, the sun bear, orangutans, tree dwelling gibbons, deer, incredible bird life, nearly extinct wild forest leopards, cats and botanical specimens both discovered and undiscovered with untold medicinal value. At one field station in Borneo’s Kayan Mentarang National Park, dozens of new species of trees, mosses and herbs, butterflies, frogs, fresh water prawns, snakes and entirely new species of mammals were found since 1991. “This field station alone has more frogs and snake species than in all of Europe,” said research station director Stephan Wulffraat, a

conservation biologist with World Wildlife Fund. The unsustainable destruction of the world’s tropical rainforests will prove disastrous to valuable ecosystems required by plant communities, animals and people who depend upon the viability and economic benefits of intact watersheds, fisheries and sustainable resource harvesting. To put it bluntly, this idea that somehow sustainable palm oil can be produced is an erroneous one. All of the world’s palm oil can or could be consumed by China. If you somehow find and take away the small amount of “sustainable oil” the unsustainably produced oil will just fill the void and cancel out the benefits. Why does Maui need an unknown mainland company (Blue Earth), subsidized by the state to produce quantities of Biodiesel which are unsustainable through local production and which will always be dependent upon foreign oil imports? I believe it far better to invest in our local Pacific Biodiesel company and with Hawai`i farmers who have proven accountability. We should invest this $59 million into putting our own ag lands into bio fuel oil seed crops. Invest in research and in identifying the best sustainable oil seed crops for local harvest and production. Invest in the local community and keep the wealth for our island and state by not sending monies offshore perpetuating environmentally destructive palm oil production. The time has come for Hawai`i to control its destiny and not be at the mercy of foreign oil imports and mainland corporations who come to Maui/Hawai`i with their hands out looking for us to hand them the money. Alas, poor Monsanto… There was a time—we’re thinking the Vietnam War—when they were one of the most feared corporations in the world. Their dioxin (Agent Orange) lay waste to much of the South Vietnamese jungle and poisoned thousands of people, including many of our own combat troops. Needless to say, multinational corporations may secretly love that kind of reputation, but they certainly don’t advertise it openly. Today their Hawaiian subsidiary is trying to make a quiet life out here in Maui, growing genetically modified corn and other crops, all looking very reasonable and scientific, but time seems to be running out. According to a Feb. 14 online Pacific Business News posting, last year Hawai`i lawmakers introduced more anti-GMO bills than any other state in the union. And with a huge quantity of bills pending this year, that distinction probably won’t change.

Shall we just agree that from now until the day when the wind and rain erodes the last of the island chain that Everett Dowling is the most powerful guy in the County of Maui, if not the State of Hawai`i? The state is asking Dowling to build a high school in Kihei for them—in the 1990’s he built them Kamali`i Elementary, which is also in Kihei—and he’s now part owner of a huge swath of some of the most ecologically and archaeologically sensitive territory in Makena. His plans there, of course, are well known: expand serene Makena into a resort similar to Wailea. Native Hawaiian groups are largely mute about the proposed development in a large part because Dowling has built so many Hawaiian Homesteads. And now he’s sponsoring a series of monthly environmental lectures at the Maui Arts and Cultural Center. When The Maui News asked about the controversy of placing his name so close to that of noted environmentalist Robert F. Kennedy, Jr.—the first lecturer—Dowling responded perfectly. “Anti-development is against all development,” he said. “They’re never going to like the Dowling Company, and they’re never going to like developers. There’s nothing I can do about it.” What’s more, The Maui News editorial page agrees, not noticing or caring to notice that perfectly reasonable people might see a distinction between mere “development” and building condominiums and golf courses for the wealthy in one of the most sensitive coastal areas on Maui. Very interesting story in the Feb. 20, 2007 Maui News. “When it comes to making decisions on air safety,” writes News City Editor Edwin Tanji, “Maui-based helicopter tour operator David Chevalier isn’t waiting for the federal government to decide what the rules should be.” The story, headlined “Air tour operators taking safety into their own controls,” mostly concerns Chevalier, owner of Blue Hawaiian Helicopters, and his view that the Federal Aviation Administration (FAA) is so “slow” in approving new safety rules that he insists on following “his own high standards for air safety.” But what’s really fascinating is Chevalier’s explanation for the FAA’s glacier-like pace: “I think it all comes down to funding,” he said. It’s a perfectly logical and reasonable reason, but one that also flies in the face of Chevalier’s 2003 financial contribution to the George W. Bush’s reelection campaign. For the past six years, Bush has done wonders to hobble agencies like the FAA. In fact, his current proposed budget for the FAA includes more than $500 million in cuts that will hit air traffic control, safety inspection and small airports that cater to general aviation. “[J]ust this past Friday, the [FAA] Administrator told us to expect about 30 percent fewer inspectors to be hired,” U.S. Senator Patty Murray (D, Washington) said in May, 2006. “So with all the requirements placed on our flight safety inspectors, their number will still be well below the level the agency had back in 2003.”

LC Watch Board Game It’s hard to believe, but it’s come time to pick a new Liquor Control Adjudication Board chairperson and vice chairperson. More than a mere housekeeper, the chairperson directs hearings, rules on objections during not guilty “trials” and generally sets the tone of the nine-member panel that decides the guilt or innocence of establishments accused of violating the liquor rules. For instance, Tami Nascimento—the outgoing chairperson, who’s term on the Adjudication Board ends at the upcoming March 1, 2007 hearing—set a far more relaxed, pleasant tone than her predecessor, Shigeto “Mustard” Murayama, who presided as chairperson for two years and seemed to spend nearly as much time arguing with Board Member Lance Collins as he did guiding the hearings. Murayama also never hesitated to hope out loud that liquor licensees would simply plead no contest to the charges against them so the hearings would go by faster—a view that, if Nascimento shares, she has mercifully kept to herself. But Nascimento’s term is now up, as is that of Mary-Doreen Alborano, who refused the chairperson’s job last year. Current Vice Chairperson Marilyn Chapman still has a year to go in her term, so unless she doesn’t want the job, the rest of the board will in all likelihood vote her into the top chair.

Robert F. Kennedy, Jr. and the Maui Coastal Land Trust

Robert Francis Kennedy Jr. is one of America’s most passionate environmentalists. Last Wednesday, Feb. 21, he addressed a near-capacity audience at Maui Arts and Cultural Center’s Castle Theater, as the first of five speakers in the Focus Green lecture series. Though his voice quavered at times (Kennedy lives with a condition known as spasmodic dysphonia, which strains his speech), his ardent environmental and political message never wavered. In fact, he gave so much information that one audience member likened listening to “trying to drink from a fire hose.” The goal of the Focus Green series, according to sponsor/land developer Everett Dowling, is to increase public awareness about global warming and hopefully motivate more people to take action. Kennedy, as senior attorney for the Natural Resources Defense Council, one of the leading environmental watchdog organizations, is all about taking action. Plundering the Country and Hijacking Our Democracy. In his lecture he called Bush’s team “the worst environmental administration ever” which has “systematically eviscerated 30 years of environmental laws.” Listing former polluting industry lobbyists Bush hand-picked to guide environmental agencies—foxes guarding the henhouse—Kennedy said they have served the President’s corporate paymasters and profiteers instead of the public interest. He described the dismantling of the Clean Air and Clean Water Acts as the subversion of American democracy. He said corporate crony capitalism is treating the planet as if it was a business in liquidation. And he said that this “monumental arrogance and incompetence” is being abetted by a “negligent and indolent press. “Incompetence becomes criminal negligence,” said Kennedy, “and we passed that threshold long ago.” When an audience member asked what citizens can do, Kennedy said two things: media reform and campaign finance reform. “Corporations should not be running our government,” he said. Later he

called campaign contributions “a system of legalized bribery.” Kennedy opened his lecture by saying Maui is one of his and his wife Mary’s favorite places in the world. “Don’t worry”, he joked, “we won’t tell anybody.” Since a Time magazine cover story in see LEGACIES, page 11

But who for the vice chair spot—the allimportant runner-up job that takes over in the event the chairperson can’t perform his or her duties (or just calls in sick)? Bill Ghean, husband of former local Republican Party official Kay Ghean, is more than capable—he pays attention, often asks questions and I once saw him lecture the rest of the board on what was and wasn’t kosher according to Robert’s Rules of Order—but he’s an older guy and he sometimes leaves meetings early. John Urauchi and Darren Lopez are nice enough, but still have a few years left in their terms. Joe Tanaka and Donald Fujii are both veterans of the Liquor Commission, but are just beginning their Adjudication Board terms. That leaves banker Glenn Kunitake as the wild card choice. Barely in his first term, Kunitake is prickly, but fair. He’ll raise his voice and throw down a stern lecture. If nothing else, he certainly makes for good copy.

WEDNESDAY, Feb. 21 Okay boys and girls, today I want to introduce you to a very good friend of mine. His name is Irony, and he and I hang out now and then. Anyway, he’s really cool and lately he’s been popping up in the damnedest places. Like the latest issue of Hawaii Business magazine (February 2007). And though he concealed himself so well that I don’t believe the people who published the magazine had any idea he was there, I didn’t have to read very far into the issue to find him. But there he was in the page 18 story “Lanai Harvests Luxury Homes”—a brief piece on the growing popularity of living on Lanai. “The other islands are becoming a little busy, a little congested and people are starting to turn to Lanai as one of the few places that still offers the Old Hawaii lifestyle,” says Mary Hakoda in the story. Isn’t it great how the author capitalized “Old Hawaii” right there? That’s how

you know that my friend Irony is hanging around. See, Mary Harkoda said all that because she’s a broker with Island of Lanai Properties and makes a living selling $2.5 million condominiums that front the Challenge of Manele golf course and include two-car garages, covered lanais and possibly even a spa. If anything just screams “Old Hawaii,” it’s gotta be a $2.5 million luxury condo.

THURSDAY, Feb. 22 Hey Hawaii Superferry people: somebody never gave the State Environmental Council the word that your boat is going through without the need for a pesky Environmental Impact Statement (EIS). I mean, they’re just an advisory body and all, part of the state Office of Environmental Quality Control—Anna Nicole Smith’s infant daughter probably has more power than they do—but today they did vote nine to one (with one abstention) that the Hawai`i Department of Transportation (HDOT) should have required a full environmental review before giving Hawaii Superferry, Inc. (HSF) the go-ahead. And as expected, anti-Superferry groups are already cheering their victory. “Not insignificant was testimony that HDOT had set precedent by doing its own 561 page EIS for the Oahu Intraisland Ferry System in 1989,” reads a Maui Tomorrow Foundation press release sent out soon after the vote. “Throughout the hearing, the Council’s legal counsel and the HSF legal counsel argued to defer a ruling, and question the Council’s legal ability to take any action. The Council, however, saw this issue as an exact area in which their interpretation was sanctioned, and felt that the Courts and the public could well benefit from the Council’s own interpretation of their rules.”

FRIDAY, Feb. 23 Here’s a fun fact: according to the latest numbers put out by the state Department of Commerce and Consumer Affairs (DCCA), there are 3,449 licensed real estate brokers and salespeople—active and inactive—in Maui County. SUNDAY, Feb. 25 You see that full-color ad for the proposed Malulani Hospital in today’s Maui News? “State Senators [Roz] Baker, [Kalani] English & [Shan] Tsutsui Have Turned Their Backs on Babies Like Lily,” the ad says in big bold letters over a picture of a tiny premature baby, presumably this “Lily” that the good legislators allegedly have it in for. Paid for by an organization calling itself Supporters Holding Accountable Maui’s Elected Senators (SHAMES), which itself is apparently a radical splinter group of People United to Support a Second Hospital (PUSHH), the ad alleges that “Lily” had to go to Oahu because there “is no neonatal care available” at Maui Memorial Medical Center. “Why don’t they [the senators] care about babies like Lily?” the ad asks. “Why are they opposed to needed new facilities on Maui?” Ads as subtle and measured as this have been running in the News for the past few days—some merely say that the good state senators “turned their backs” on doctors and heart patients—and while it goes without saying that Baker, English and

Tsutsui are crying foul, the kicker is that some members of PUSHH also despise the SHAMES ads. “I think it’s very detrimental to our cause,” Hermine Harman, PUSHH co-chairwoman, said in a Maui News piece yesterday.

MONDAY, Feb. 26 The cruise industry is growing faster than ever, and Norwegian Cruise Lines (NCL) has just announced that it brought in $2 billion during 2006, but somehow managed to show a $131 million loss on the year. Their stated reason for such a miserable year, which should cheer up Wall Street and utterly depress the rest of us, is really quite simple: labor. Specifically, NCL is blaming their decision a couple years ago to run interisland Hawai`i cruises with allAmerican crews working ships flying U.S. flags, according to a report posted today on the Pacific Business News website. “Looking ahead, we face the challenge of an unprecedented 1.6 million capacity days of low-cost foreign-flag competition in the Hawaii trade during 2007,” NCL CEO Colin Veitch said in the report. “We, therefore, are closely examining all options in our efforts to bring NCL America to profitability.” So there goes the dream of NCL bucking the ugly, global trend of cruise ships possessing American names but flying foreign flags and carrying poorly paid, Third World crews. Not even four years ago Veitch had told the Honolulu StarBulletin that though labor costs on his Hawai`i ships would be double that of other vessels—American crewmembers demand American pay rates, after all—his company would cope through “innovative re-engineering” of ship operations, like contracting out laundry.

‘I am Just So Proud of Him’ Lt. Ehren Watada’s parents speak out at Maui Community College It was a full house last Monday night, Feb. 26, when Bob and Rosa Watada appeared in a classroom on the ground floor of the Maui Community College library. There, before 90 people, they talked about their son U.S. Army Lieutenant Ehren Watada and his refusal to fight in Iraq. The event, hosted by Maui Peace Action, Code Pink Maui and the MCC Peace club, was a closing for the Peace Ribbon Project. Code Pink started the project to memorialize casualties in the Iraq war. The night began with a 25-minute video of a speech Lt. Watada gave in Honolulu last December. He touched on the government’s manipulation of intelligence leading up to the war, civilian casualties and historical precedents. Applause and cheers frequently punctuated the video. By the end of the video, Watada’s supporters had packed the small room to capacity. Many were carrying plates of refreshments provided by the hosts. When Bob and Rosa took the podium, the room fell absolutely silent. “I am the very proud step mom of Ehren Watada,” Rosa said, bursting into tears. “I’m sorry, I just get so emotional whenever I think about him. I am just so proud of him. Above everything, he’s so brave for taking this stand.” Bob took the podium and gave a detailed time line of his son’s journey from voluntarily joining the army to eventually refusing orders to deploy to Iraq, for which he faces jail time. When Watada was told he’d be going to Iraq, he prepared by researching the country and its customs and culture, along with the U.S. government’s reasons for war. After a year of

study, Watada realized that he could not agree with the justifications for the invasion. In January 2006, he attempted to resign from the military but was denied. Lt. Watada was charged with two counts of conduct unbecoming an officer for comments that he made against the war to the media and one count of missing a troop movement for refusing to go to Iraq. On Feb. 7 the judge in Watada’s case declared a mistrial, only heightening the Watadas’ concerns. “It’s very unusual for the judge to ask the prosecution for a mistrial,” Bob said. His wife went further. “It’s not right, because every time they think they are going to win, they want to quit and try it again,” she said. A retrial has been set for Mar. 19, but some—including Eric Seitz, Watada’s attorney—are questioning whether it will proceed. This is because of a constitutional protection against “double jeopardy,” forbidding the trying of a person repeatedly for the same crime (the U.S. Army Judge Advocate General’s office denies that double jeopardy applies to Watada’s case). “That opens up a whole new chapter in this proceeding,” Seitz said. “Because what the army has clearly tried to do by the nature of these charges is send out a message to people in the military, that if you criticize the war... that you, too, could be charged with disloyalty.” The event also marked the end of the Peace Ribbon Project. The project display, which has been up in the MCC library for a little over three weeks, was an effort by Code Pink to remember those who have died in the Iraq war. It has been displayed all over the country and consists of more than 120 fabric panels, each one dedicated to a casualty. MTW

More than two million visitors arrive each year. Some like it so well they decide to move here, or buy a timeshare or second home. The influx of wealth over the past two decades has resulted in more mega-mansions, and the loss of beachfront lots and open space views. In fact, it was the surge in development of coastal land, and a few lost battles to save wild shorelines at Palauea Beach and Keka`a Beach, that led in late 2000 to the formation of the Maui Coastal Land Trust (MCLT). The mission of the Maui Coastal Land Trust is to acquire, preserve and protect coastal lands in Maui County. In a little more than six years, MCLT has accomplished a lot to meet this lofty goal. Among their first actions was support for a 2002 charter amendment to allocate one percent of real property tax revenues to support open space and coastal acquisitions. The ballot measure passed, and this revenue became a key part of the purchase of 277 acres of coastal dunes, wetlands and cultural sites, as well as more than a mile of beachfront at Waihe`e. Other accomplishments include a conservation easement on the Hana coastline through Maka`alae pastureland between Hamoa and Waioka and working with landowners in the “Pali to Puamana� park gateway to West Maui. Moreover, the MCLT board includes developers, landowners and conservationists, all working side-by-side. Executive Director Dale Bonar said he expects to issue press releases in the next month or so announcing conservation easements on three separate parcels, totaling more than 500 acres. He says that 1,700 land trusts nationwide have helped preserve more than 34 million acres of land. Bonar said he felt Kennedy didn’t do enough at his lecture to address how to solve the huge political and environmental problems of our time, but felt he “set the stage,� for other lecturers to do so. Future speakers include Canadian scientist David Suzuki (March 14), author James Howard Kunstler, (March 21), California environmental policy adviser Terry Tamminen (March 28) and Green Building Council CEO Christine Ervin (April 4). Though the Focus Green lecture series is free, donations go to MCLT,

It helps us establish legacies of protecting our natural resources in our lifetime. Robert Kennedy Jr.’s family legacy is a passion for his country, as well as for politics. He said that as a boy his father took him to Europe, where tens of thousands of people greeted them wherever they went. “We were the most beloved country on the face of the earth,� he said. “In six short years the White House has drained that reservoir dry, and we are either feared or despised.� Echoing that sentiment, and seated in the front row of the Kennedy lecture, was activist Lance Holter. Chair of the Sierra Club’s Maui Group and the Maui Democratic Party, Holter has campaigned against drilling in the Arctic National Wildlife Refuge, our military presence in Iraq, the U.S. Army court-martial of conscientious objector Lt. Ehren Watada and much more. “The Bush administration is a war machine run amok,� said Holter. “It’s gotta stop.� Holter also continues to campaign for a North Shore Heritage Park and to preserve the coastal wilderness between his hometown Paia and Spreckelsville. He has enlisted the help of former and current congressional representatives Ed Case and Mazie Hirono, and is reaching out to the County Council and Mayor’s office as well. Meanwhile, the MCLT recently prepared a report on coastal lands from Spreckelsville to past Huelo, as part of the studies for the General Plan update. Kennedy said that through nature we connect to the 10,000 generations that lived here before us. He related how in virtually every world religion, the central epiphany is revealed after Buddha, Muhammed, Moses, Jesus and others spent time in the wilderness. He told of American poets, writers and artists using nature as the critical defining element of who we are, and of Ralph Waldo Emerson and Henry David Thoreau perceiving Nature as our Spiritual Parent. Faced with our country’s leaders at loggerheads with reason and sanity, we may do well to look at our local model of cooperation, the Maui Coastal Land Trust. Perhaps these dedicated efforts here may have a ripple effect, leading others to see what’s possible. MTW

NEWSOFTHEWEIRD SERVE NO STEAK BEFORE ITS TIME Steaks from Waygu cattle in western Australia were already revered by gourmets worldwide (noted for their marbling), but recently an exporter went a step further: The choice grains fed the cattle are now being soaked in a 2004 cabernet merlot, according to a January dispatch from Sydney in London’s Sunday Telegraph. “Our biggest problem is going to be meeting demand,” said the managing director of Margaret River Premium Meat Exports, even though the best cuts of steak might run the equivalent of about US$90. Plans are to feed each cow a liter’s worth of wine daily during its last 60 days.

YIKES! In January the British General Dental Council found David Quelch guilty of professional misconduct for pulling two teeth of a patient, against her will, without anesthesia, because she had complained about previous treatments. He allegedly said, “That’ll teach you ...” And in Romania, the patient at Panduri Urology Hospital was not at fault (according to United Press International, from a January story in Bucharest’s Sunday Telegram) when surgeon Naum Ciomu lost his temper at his own sloppiness and chopped off a 36-yearold man’s penis. Ciomu later admitted that he had overreacted. Nonetheless, the Romanian doctors’ union complained that Ciomu’s fine (the equivalent of about $190,000) was unwarranted.

SCIENCE GONE MAD Transgendered patient Gina Tilley filed a lawsuit late last year against New York City plastic surgeon David Ostad (who has been cited by state medical authorities 11 times and sued 14 times), complaining that her 2004 saline breast implants had shifted to her armpits. And the fire alarm at the Sea Life Centre in Weymouth, England, sounded one night in December, attributed to a diet of brussels sprouts fed to a turtle. Marine biologist Sarah Leaney of the Centre explained that the turtle’s resulting flatulence probably created bubbles that raised the water level enough to trigger the alarm.

SETTLING THE GENDER WARS German cancer researchers, writing in a January journal article, reported that any exercise helped ward off breast cancer in premenopausal women but that housework-type exercise worked for all women and was superior to job-based or leisure-based exercise. And in January a female chimpanzee, Judy, escaped from the Little Rock (Ark.) Zoo. As she moved about, was observed entering a bathroom, grabbing a brush, and cleaning a toilet. She also wrung out a sponge and cleaned off a refrigerator, according to an Associated Press report.

Not all of the mysteries regarding Hawai`i’s humpback whales are contained deep beneath the waves. On the contrary, some of their most provocative enigmas are hundreds or even thousands of feet above the water’s edge, on boulders and cliff sides on nearly every island. These formations are perplexing not so much for what is there as for what isn’t. Before the whaling fleet came to Hawai`i in the 1800’s, or even before the coming of Europeans to the islands in the 1700’s, ancient storytellers had been practicing their craft here for centuries. Not all these early historians used their mouths or swayed their bodies in hula dance to pass on their stories or observations. Some used their hands to scratch petroglyphs upon rock surfaces. They are largely symbolic, found all over the world wherever people found the need to express great events or deep-seated needs. Curiously, whether by these petroglyphs or other means of expression, Hawaiian culture is largely lacking in references to whales at all, much less to the awe-inspiring migration of humpbacks we see today. In contrast, images of turtles and sharks and other sea creatures adorn everything from seat covers to tattoos to necklaces. In fact, these other creatures have been well represented in story and lore on the islands for generations. Why? What could have happened to images and stories, which are a type of record, of the acrobatic humpbacks, which provide one of the most excitingto-witness wildlife events on the planet? Could it be that the Hawaiians wanted to keep their presence here a secret, as some people claim? The whales were a source of power, god-like even, and it was taboo even to talk of them? “Come on,” says one whale researcher on Maui. “Forty-five tons ejecting out of the water like a Saturn V rocket is a little hard to keep a secret. Especially when it’s happening dozens and dozens of times every hour. Such behavior leaves an impact upon a

culture. This is especially true when you’re witnessing it close by, from a canoe, as many early Hawaiians would have been. “Imagine these people seeing such things and then going back to their village and exclaiming it to friends and relatives,” the researcher continues. “It would have shown up in art and custom and story. There would have been ceremonies welcoming the first whale of the season. Festivals would have been held in their honor. The Maoris [of New Zealand], to name one, have such things to this day and they’ve had exposure to humpbacks down there for centuries.” To be sure, a few images of whales do exist at petroglyph sites on Maui and other main islands. Such references also are scattered throughout Hawaiian culture. However, these references are few and far between. They’re hardly representative of the thousands of titans presently cavorting, splashing and blowing their way through Maui County waters. In addition, most of these references are to other species. For instance, most of the petroglyphs of whales seem to have a 90-degree or squared angle on the snout—more representative of sperm whales than of humpbacks. Along these lines, the Kumulipo, the ancient Hawaiian chant of creation, and other oftrepeated Hawaiian songs and tales usually bespeak of giant toothed whales. Again, this would be more indicative of the sperms or even dolphins, not the filter-feeder humpbacks, which do not have teeth. The Hawaiian word for whale, kohola, is a general term, not specific to any one species. So it’s uncertain what one type of whale, if any, it refers to. Most telling of all, references to breaching whales, the humpbacks’ trademark, are almost nonexistent. And this lack of evidence extends across two cultures, the Hawaiian and the European. During the early 1800’s, Lahaina was a rest and recreation center for the Pacific whaling fleet. For the most part, the whalers did not come here to kill whales, as many people think. Hundreds of ships would anchor off the

town every winter while the crews went ashore to let loose. This is just when the humpback migration would have been at its height. Yet these thousands of men, who whaled for a living, largely ignored the “show” offshore? Indeed, early on in the era, some whales were harpooned off of the islands. And accordingly, these events were recorded. Newspaper stories, sailors’ journals, even detailed paintings tell of whalers killing sperm whales here and a few humpbacks. But otherwise, accounts of the crews seeing or taking other whales, much less scores of them, are conspicuously absent from early media. To some local historians, the answer why is obvious. “They weren’t here is the reason,” says Jackie Hala. “At least not in these numbers. There may have been some but not this many.” A native Hawaiian, she has long talked history at Baldwin House and other historic sites around Lahaina. Presently she is a tour guide at Hale Pai, which means “printing house.” The first paper money in Hawai`i was made here. Its original press ran off the first newspaper west of the Rocky Mountains. Much of the literary tradition for all the islands originated at this site. Built in 1837, the historic structure sits cool in the shade on the lower slope of the West Maui Mountains, up next to Lahainaluna High School. Down below, the town itself stretches out along the water’s edge. A tableau of brilliant blue extends miles across to the islands of Lana`i and Kaho`olawe. On this January day, both islands are shrouded in mist. Whale watch boats cluster around cotton-candy blows and eruptions of whitewater, brilliant in the sunlight. “I wish they’d cut back some of these branches,” says Hala, trying to look out a window, “so I could see the ocean better.” Coming from a long line of local storytellers, she is well suited for her job. Her father and her grandfather were fishermen operating out of Lahaina. She


grew up listening to them and other relatives recount their experiences out on the ocean and with its wildlife. “When they were talking about something that had happened, they would say that it happened before the whales came or after the whales started coming,” she says. “They often couldn’t get dates right when talking story, so they would use things that happened as timelines. There weren’t these whales here, at least not in any numbers. That’s why there’s little record of them.” Various whale research organizations on Maui agree with her. The Pacific Whale Foundation, based in Ma`alaea, states flatly in its naturalist training literature: “There’s no evidence of humpback presence [off Maui] 200 years ago, based on lack of fossil evidence and lack of major references in Hawaiian mythology.” The Humpback Whale National Marine Sanctuary in Kihei puts out a pamphlet called, “The Cultural Significance Of Whales In Hawaii.” Joylynn Oliveira, who was cultural director at the Sanctuary, worked long and hard on the project, trying to solve the puzzle of the missing mammals. Despite her best efforts and the various theories she presents, nothing much is resolved, which is typical of such probes into the past. “You can’t find what’s not there,” as one reviewer put it. New research is showing that the 200-year period for humpbacks coming to Maui used by Pacific Whale Foundation may even be too long. The timeline put forth by Jackie Hala’s father and grandfather when talking story may be more accurate. Humpback whales may not have appeared in Hawaiian waters in great numbers until the 1900’s–the last century, in other words. If so, this presents as many questions as it does answers. Mainly, why? What made them start flocking here? One scenario goes like this: for a while, the northern Pacific humpbacks were hunted hard off the coasts of Alaska, Mexico and Japan. This decimated them in both their feeding and migration grounds. Struggling to survive, they sought waters away from

the killing grounds, waters that they eventually found in the waters around Hawai`i. A “seed population” had been coming here all along; perhaps hundreds of whales, perhaps as few as dozens. These “pathfinders” somehow led the way for the thousands we see here now. Furthermore, this shift in migration routes occurred after the whaling era here, after the whalers had left Lahaina, in other words. Roughly from the late 1800’s on. This would explain why the sailors wintering here did not record the mass migration—it hadn’t happened yet. Another take has it that this migration route, from Alaska to Hawai`i, is shorter than some of their old migration routes. For example, Alaska to Mexico or Alaska to Japan. The whales, like people tend to do, simply discovered an easier, softer way— and a better place. Environmental laws passed in the 1960’s have contributed to both the influx of whales here and to the confusion regarding them. Hunted to near extinction worldwide, humpbacks were accorded international protection in 1965. In the early 1970’s, they were listed as an endangered species, which

gave them additional protections. These and other laws are responsible for some of the boon now, but they don’t explain their scant background here down through the centuries. On this and other aspects of the mystery, research continues. Until such answers are provided, keep in mind that the “high time” is upon us— the time of most whales in Maui waters. “Whale Day,” a festival in their honor, was held Feb. 17 at Kalama Park in Kihei. This is only fitting because so many whales in Hawaiian waters may not only be historic but something worth celebrating. Moreover, it’s the type of thing that the ancients would have done had the whales been coming here in these numbers. MTW

A taste of the Blue Marlin Harborfront Grill There are few things I love more than good food. My quest for it has led me to many a white linen table at some of the finest restaurants on Maui. But it’s a love that takes its toll on my pocketbook—and there are only so many little black dresses a girl can own— so I keep an eye out for more economical and casual dining alternatives.

Blue Marlin has elements of two sometimes opposing worlds. It offers the harbor views, consistent service and impressive plate presentations of an establishment that regularly caters to visitors. But it also delivers a down-home appeal of bountiful servings, delectable yet unpretentious cuisine, and the easygoing ambience of its bar area.

Located on the lower level of the Harbor Shops, Blue Marlin looks directly out onto Ma`alaea Harbor and the bay beyond. The open-air dining room is all dark wood, lots of hanging green plants, colorful glass fishing floats, and various fishing photos displayed like family snapshots. Behind the elevated horseshoe-shaped bar is a rock wall with miniature waterfalls sprouting fresh ferns. Tristan Rodrigues, the bartender, possesses the easy charm and confident reverence you’d expect from an old-school Waikiki beach boy. His bar is generally packed all day with mostly tourists in from boat tours during the day, and a mainly local clientele at night. When I sat down, I noticed the earthy Upcountry couple on my left devouring the shrimp and chips ($13.95) and peel ‘n eat shrimp ($11.95), with garlic bread and Coors Light on draft. The three local guys on my right, who had just finished a surf session on the Westside on their day off, sat with Heinekens, sake ponzu oyster shooters and a half-pound of poke ($7.50). At Rodrigues’ suggestion, I sampled an array of pupu and entrees and shared with my neighbors. For the past three years, the head of the kitchen `ohana has been chef Laynie “Babycakes” Dougher, an MCC Culinary Institute graduate and former opening chef de cuisine for Marco’s and Sam Choy’s restaurants. She says her cooking philosophy is to “keep it simple,” focus on flavor and to create a family-style atmosphere in the back. As in her own kitchen at home, nothing goes out to the front of the house if it doesn’t taste good. Blue Marlin get their fish from one of four of the main sporting boats out of the Ma`alaea Harbor. The fish are hand-carried through the front of the

restaurant, providing a real showstopper for diners. Along with her sous chef, Dougher comes up with the specials, depending on what the fisherman bring in. The day I visited, the fish special was a sautéed mahi mahi with Jack Daniels shitake cream sauce. It was a surprisingly subtle and elegant dish, given its rich components. “Mmm!” said the Westside surfers to my right. “This is ono! What is ‘shitake?’ The mushroom, yeah?” Blue Marlin’s most popular dish is their fish and chips ($12.95) with minted pineapple remoulade and malt vinegar. And it was tasty. But so was the 24-ounce rack of the most tender, succulent, fall-off-the-bone, melt-in-your-mouth pork ribs ($23.95). I had the couple to my left try it out. “My ribs never come out that way,” he said. “That’s because you have no patience,” she said. The crab cakes ($10.95) were perfectly balanced, and not too rich, with a light honey Dijon sauce for dipping. I could eat a bucketful of them. Again, I shared with my bohemian friends to the left. “That’s the best crab cake ever,” she said. “Instead of all that froufrou breading and stuff,” he said, “there’s a lot of crab in there.” “If I could I would bring all my friends down here three-to-four times a week and spend all our money,” said one of the surfers. His friends heartily agreed. MTW

At every level of production and execution, Fincher meticulously crafts the true-crime mystery as a social phenomenon that touched the lives of many and ruined the lives of more than a few. Graysmith (Jake Gyllenhaal) is a timid but inquisitive divorced dad when we first meet him setting out for his workday on the open floor of the Chronicle newsroom. Almost a month after the Zodiac’s parking lot attack, a letter arrives at the newspaper’s offices from the gunman with a cipher containing Greek symbols, Morse code, weather symbols, alphabet characters, astrological symbols and Navy semaphore. An editorial meeting is called to discuss the killer’s demand that the cipher be published on the front page of the next day’s paper lest he kill again. An inveterate puzzle-solver, Graysmith impulsively copies the code and detects that the Zodiac will not reveal his name. The paper’s flamboyant crime-beat reporter Paul Avery (brilliantly played by Robert Downey Jr.) takes notice of the eager newcomer’s facility and the two men form an uneasy bond around their mutual interest in solving the case. Graysmith goes one better when he connects a Salinas couple’s interpretation of the cipher to a 1932 RKO film entitled The Most Dangerous Game, about a Russian Count who hunts people on his private island.

Hunting the filthy killer

More than a year later, a brutal knife attack on a couple enjoying the beauty of Napa Valley’s Lake Berryessa sets the siren pitch of crimson fear that infects Graysmith when the Zodiac sends a letter threatening to kill school children. James Vanderbilt’s judicious script front-loads the violence that peaks early on with the Zodiac’s murder of a cab driver in San Francisco’s wealthy Presidio district. The murder ushers in Toschi (Mark Ruffalo) and his partner William Armstrong (Anthony Edwards) who will suffer the burden of hunting for a killer without the benefit of collected evidence from other police precincts where the killer struck. The fact of police depart-

ments not sharing information, in order to claim credit for solving the case, creates a dysfunctional societal atmosphere akin to Billy Wilder’s Ace In The Hole. In the years since his last films (Fight Club and The Panic Room) Fincher seems to have abandoned his cinema of cruelty in favor of a more restrained goal. Zodiac brings his distinctively meticulous talent to the fore as he prompts intellectual and emotional responses from the audience without allowing for a second of distraction. There is an unobtrusive perfectionism in Fincher’s telling of a difficult story. He knows where reality and cinema meet, and when to push the boundaries of each. MTW

From the Ground Up Local folk singer Micah Wolf is learning the art of selling himself I first listened to Micah Wolf’s debut CD while I was driving through Kahului on my way to Lahaina. By the time I got to Ma`alaea, I hit eject. Sounds like Jack Johnson, I thought. Not that there’s anything wrong with Jack Johnson. After all, some of my best friends listen to Jack Johnson. But… well, not me.

We met at LiveWire Café, which was about a block away from “headquarters”—what he laughingly called his friend’s house, which he uses for practice space and miscellaneous business operations. Wolf laughed easily, especially when talking about the discomfort of picking out his own photos to send with press packets—a chore he’s had to do a lot of lately. “I haven’t quite perfected my ‘Blue Steel,’” he said. “You know, from Zoolander?” He admitted he does get comparisons to Johnson on occasion, and is trying to learn how to be comfortable with it. He joked that the only thing he has a problem with is that he’s not a big-time surfer. In fact, he said,

he’s sorta afraid of sharks. “I really respect Jack and I’m stoked that people compare us,” Wolf said. “But I didn’t go in trying to create a Jack sound. And I wasn’t the only one producing the album—that’s just what came out. But we are all influenced by the same people.” Wolf said he’s inspired by the obvious roots of modern folk music—Arlo Guthrie, Bob Dylan, Cat Stevens, Bob Marley—as well as the contemporaries, like Ben Harper, Mason Jennings and Michael Franti. “I just like songs that tell a story and create an emotional impact,” he said. “And I like songs that make people think and ask questions. Like, ‘How can I stop being so judgmental of myself and other humans?’ That’s the scary thing about pursuing your passion. It makes you look deep at yourself. If you wanna do it in a way that you aren’t drunk or on drugs all the time, you need to be really balanced and comfortable with yourself.” He’s had some time to think about this, since selling his house and quitting timeshare sales three years ago, in order to be a full-time musician. In the process, Wolf’s learning about the many facets of the music business, from the ground up. He started a record label, Blockplane Records, with his guitar-making friend Eric DeVine, and the two built a studio. Eventually, they recorded an album. But now the burgeoning folk star is finding that the greatest challenge is learning how to flip the hat—to be both artist and mar-

keting agent. But even more daunting is the realization that everything has to be done at once. He’s learning about the music business as he goes along, and has spent much time reading industry books and perusing websites. Most recently, he’s had a lot of success emailing BMI, a performing rights organization. “I was sort of fishing around on the website,” Wolf said. “And I sent the vice president of film and TV an intro, asking for suggestions. He wrote back right away, ‘There’s something to be said for timing— I just got out of a meeting with MTV…’” When MTV started filming Maui Fever in Lahaina, they then approached Wolf about using two of his songs—“Plastics” and “Muse.” But he had no idea how they would be used. “When you’re small-time and you sign a contract with MTV,” said Wolf, “you have no control over where they show it. So with ‘Plastics,’ the intro kicks in while this guy is saying, ‘Dude, I’ll totally wax that!’” A few months ago, No Cover Magazine—whose compilation CD featured Wolf—flew Wolf and his band out to San Diego for a series of shows. There, he met with a woman from Sony Records, who suggested that instead of working on another album, he should concentrate on promoting the one he just released six months ago.

“I’ve been doing it one department at a time,” Wolf said. “But you really need a high management team. See, you’re supposed to be promoting your album while touring. I just keep trying to plant seeds ‘cause you never know where it’s gonna sprout or harvest.” He’s since bought out DeVine’s share of the Emerald Plaza studio and equipment, and took over full ownership of the label. And he laughs at the irony that he has to now sign himself to the record label he created. “I’m learning that a lot of the industry comes down to who you know,” Wolf said. Then he laughed. “And I don’t have any friends. But I keep trying through MySpace!” No Cover is inviting Wolf to perform with their showcase at the big SXSW music fest in Austin, Texas, in just a couple weeks. While there, the band will also meet up with a record label in Australia who is interested in releasing their album. “We have no idea what we’re doing but it’s all conspiring,” Wolf said. “There’s a lot going on.” Wolf is now trying to plan a tour, based on when he gets “the budget finalized.” But he now has an interested investor for his record label, which will give him more tour support and help determine if he can take the band or if he’s going solo. “As much as I’ve learned about technology and the business,” Wolf said, “the good news is that it really comes down to being a great songwriter and performer. There’s no faking that.” Okay, I admit it: I judged Wolf too hastily. Wolf is not trying to be Jack Johnson. He’s very much his own artist, with his own experiences, and is just an up-and-coming folk performer trying to make it big on his own. He’s getting his hands dirty in the often confusing world of music business, while holding true to his integrity and ideals. He’s also just an all-around nice guy. And on second listen, his music is pretty sweet. MTW

The Rearview Review Judging local music according to a one-yearold wangsta’s response PEKELO “HANA BY THE SEA” Jack is one. He’s short, fat, and sports a receding hairline. His interests include lactating breasts, oatmeal raisin cookies, various types of lint, loose change and laptops. He is obsessed with cellphones, hairbrushes and rap music. Since becoming his mother, my life has been reduced to strategic planning on methods to keep him from trying to bludgeon me to death with plastic hammers. This has not been easy. My arsenal includes a cupboard full of treats, a taser gun and various CD’s to soothe the savage beast. Jack is finicky about music. His favorite artist is Snoop Dog. Whenever Snoop comes on the radio he gets this really serious look on his face, lifts his chubby hand in the air and does this slightly lecherous body undulation. If he’s in his car seat, he palm slaps the air while he bobs. If we’re at home he freaks his Cabbage Patch doll Diane. So when I was sent home with a bunch of local CD’s to review I decided to try them out on Jack. His response surprised me. I had assumed that he would go for the upbeat Hawaiian/Reggae styles. In fact, I was really looking forward to watching him attempt to skank while strapped into his car seat’s five-point harness. I tried three different CD’s with similar rhythms. He wasn’t into it. He spent the whole ride home picking foam from his car seat and then chewing it like gum. We went back to the radio for a few days. Jack approved. A few days later (translated: music review deadline date), I decided to put in the last CD on the ride home from town. I had purposefully put it off. Sue me, but I just didn’t think that my one-year-old hip-hop fiend would be into Pekelo’s Hana By The Sea Hawaiian slack key guitar. I was wrong. As soon as the music started, Jack’s little eyebrows went up. His thumb popped out of his mouth and he started snapping. I kid you not. By the second song, he was singing along (and by singing I mean making primitive howling sounds). By the third song he was so excited he started clapping with his feet. This is something that he usually reserves for cookies and ice cream. This is big. Suddenly, Pekelo changed it up and started to croon a soft, slow song. Jack got this dreamy look in his eye, went back to his thumb and nodded off in about 45 seconds. By golly, I was sold! Pekelo’s Hana By The Sea isn’t just good, it’s magic!
