4 EH BRAH!

A mighty soul has been stolen from the earth, our hearts and the island of Maui. Ian Doane Smith loved life and lived it to its fullest extent possible. He was doing one of the things that he loved to do, snowboarding in Tahoe, when his life was tragically taken from his family and friends. He touched many lives, and all of us will remember his bighearted aloha spirit, his infectious smile, kolohe charm, and generous wisdom. Ian owned and operated Professional Property Services, Inc. in Haiku, where he lived. The firm conducted certified home and land inspections, project management and real property analysis. It sounds dry, but Ian was anything but. He embodied Maui’s sun, sea, and beaches, from the island’s coastline to the countryside. A Maui boy through and through, he held a special place in his heart for his mother, Polli. Persevering through life and work to enjoy the outdoors, he cherished moments with his wife Antoinette, and his family. He especially enjoyed being out in the ocean surfing and getting barreled. He loved Maui and made it his home. Perhaps even more, Maui loved him for his respect and connection to the land and environment. Always willing to lend a hand or a kind word to a friend, Ian made many friends everywhere he went. We will all miss him. A casual gathering and celebration of Ian’s life will be held from 2:00 p.m. to sunset on Sunday, Apr. 18 at Makena Beach, which was one of his favorite places on the island. Feel free to bring flowers and leis. There will be many on hand to remember the powerful and compassionate person that Ian was. He will always be in our hearts. A private family service will be held separately on a different day.

Spring is in the air, and while that certainly means warmer sun and drier days, it also means we’ll have to deal with more disease. A dreaded disease, too—Island Fever. Some people are completely immune, and can go for decades without caring about any place other than Maui. But I also know many people afflicted with this plague, the only treatment of which seems to be an extended stay somewhere else, like San Francisco or a casino on the Las Vegas Strip. Things to think about when pumping gas that Act 77’s price caps will be “ineffective, risky, costly, open to manipulation and complicated to administer.” The firm, which often advises government and energy officials, then offered that the real solution to Hawaii’s gas price problems lay in deregulating the oil industry. “Repeal [the Department of Business, Economic Development and Tourism] DBEDT’s extensive petroleum industry regulatory functions,” reported the firm, listing “random and periodic company audit and inspection requirements” as one such responsibility.

“High prices in Hawaii are a myth, perpetuated by the media to the level of urban legend,” wrote “Kauai petroleum distributor” Brian Barbata in the Mar. 18 Honolulu Advertiser. Barbata then proceeded to insinuate that a $1.48 average pre-tax price ($2.00) for Oahu gas was the norm for the rest of the island chain.

Tanks for nothing We who drive cars fitted with internal combustion engines that burn gasoline for fuel live in tough times. Gas prices, high all over the U.S., are hovering at nosebleed levels on Maui. In fact, the $2.36 we pay for a gallon of straight 87 Octane unleaded is not only the highest in the nation, but is six cents more than this time last year. Now the conspiratorial automatically leap to the guy sitting in the White House—old oil man George W. Bush, hails from an old Texas oil family, takes gobs of campaign money from Texas oil interests—thinks about how National Security Adviser Condoleeza Rice used to have a Chevron Tanker named after her (she was once a member of the Chevron board of directors), remembers the low gas prices of the last years of Bill Clinton’s administration and says “Ahhh! That’s it!” Now I’m not saying that there’s a connection between record-high U.S. gas prices and the well-documented friendship between the current administration and the oil industry, but there are lots of things you should think about the next time you shove the gas pump into your V8-powered SUV:

Representative Brian Blundell told The Maui News on Apr. 6. “I don’t know what the solution is yet, but I know this isn’t it,” added Republican Representative Kika Bukoski.

Since 1981, oil companies have closed more than half of all U.S. refineries. With so few refineries operational, maintenance problems in one area are enough to scare gas prices upwards. Though oil industry lobbyists say they need “more capacity,” there are no plans to build any new refineries. Instead, the industry has been focusing on getting state and federal clean air standards repealed.

In late 2002, state Attorney General Earl Anzai hired the law firm Winston & Strawn to sue Chevron/Texaco for alleged tax evasion after research conducted by two professors alleged the oil giant engaged in a “fraudulent scheme” that cost Hawaii taxpayers $563 million. But within a year, the firm—which The New York Times later showed had not disclosed previous ties to Chevron/Texaco—said it could find no evidence of wrong-doing. New governor Linda Lingle cancelled the lawsuit, despite grumbling that she had taken over $5,000 in Chevron political action committee contributions during her 2002 campaign.

As the Bush Administration was planning in the fall of 2002 to invade Iraq, U.S. Treasury officials calculated that such a war would cause a $5 “war premium” on the price of oil, according to documents recently released by former Treasury Secretary Paul O’Neill. At the time, a barrel of West Texas Intermediate (WTI) Crude went for not quite $30. Today, WTI crude is going for $36 a barrel, which is a 13year high. Now that’s planning!

LC Watch “Serious Trouble” Liquor Control Adjudication Board member Ron McOmber is a fascinating guy. McOmber’s been on the board since 2000, meaning his term will expire at the end of next March. One of the more active members, he often asks questions or just shakes his head with great gravity as bar owners plead their case from the witness table. A Lanai resident since 1971, he’s run a scuba diving outfit, worked as Kuamalapa’u harbor manager, tender pilot, Lanai Hospital maintenance chief and chief mechanic at the Lanai airport. According to a 1999 Honolulu Star-Bulletin article, he shares ownership of the island with land-owning giant Castle & Cooke, with the company owning 98 percent to McOmber’s two percent. An outspoken critic of Castle & Cooke, McOmber managed to beat a company plan to privatize part of a beach, then got hit with a restraining order after allegedly straying on company land to take unauthorized water meter readings. Among the Board members, McOmber actually seems to enjoy doling out fines and revoking licenses. One example occurred during the Sept. 5, 2002 Adjudication Board meeting. The meeting minutes show one member asked why it was that the Board went into separate deliberations for each item, rather than all at once at the end of the meeting like the old days. “Well, the reason that was changed is because the last time Akaku was here, they got to see the entire proceeding but they never got to see the end,” said Liquor Control Department Director Franklyn Silva. “And that made a good point because even the public sitting in the audience, they don’t see what happens to the licensee. This way everybody gets to see it from the beginning to the end what happens.” Then McOmber spoke up. “I think it’s more impressive on the audience, too,” he said. “[B]ecause they sit there and see, uh-oh, we’re in serious trouble here, and especially when they’re pleading no contest, they’re going in it saying their [sic] guilty.”

MONDAY, APR. 5 With the election just eight months away, the Maui Chamber of Commerce Political Action Committee finally decided to issue its report cards on incumbents, ranging from lowly county councilmembers to the lowlier governor. All nine county councilmembers earned “fail” ratings on “Land Use” and “Economic Development.” That’s right—councilmembers known for the exceptionally pro-development stances like Dain Kane and Riki Hokama failed the Chamber’s litmus test for being sufficiently supportive of converting agricultural land into golf courses and condos.

TUESDAY, APR. 6 Was all set to head down to the beautiful lava and coral shores of La Perouse Bay and put together one of them kayak companies and finally start cashing in all that sacred, natural beauty when I got word the state’s gonna shut the place down. Turns out the Natural Area Reserve System (NARS) Commission didn’t take to last week’s recommendation from the state Department of Land and Natural Resources (DLNR) to allow “limited” commercial exploitation of the land Hawaiian activists consider a place of healing. Even officials like Maui County Mayor Alan Arakawa, Councilmember Wayne Nishiki and State Rep. Joe Souki asked the state to ban all commercial activities in La Perouse. In a decisive 7-2 vote, the Commission trash-canned the DLNR plan. Finally, it seems, local Hawaiians got their way… Someone who didn’t get her way was would-be American Idol idol Camile Velasco. After weeks and weeks of singing on the popular Fox show, Velasco washed

out after bizarrely attempting to belt out Elton John’s “Goodbye Yellow Brick Road.” Missing from the myriad tributes to the 18-year-old former International House of Pancakes server— she did make the two dozen out of something like 80,000 singing hopefuls—is any mention of what complicity her singing coach, “vocal teacher to the stars” Lani Star, has in Velasco’s failure. As loyal fans of the show are undoubtedly braying, Velasco’s troubles lay not in her talent, but in her song selection and stage nerves— two factors her voice should have smoothed over. After all, Star’s own press releases sent out when Velasco began gathering millions of votes boasted that coach “could help get Camile’s talent to the next level.” Didn’t Star assist “luminaries” like Baywatch actress Stacy Kamano and Channel Nine News personality Kualoa Taylor? Didn’t she bill herself as “the best Hawaii could offer? Now there’s some good money spent.

WEDNESDAY, APR. 7 Wayne Nishiki and his County Council Planning and Land Use Committee— which is identical to the Maui County Council as a whole, but who cares—votes on Japanese Railway giant Seibu’s rezoning request for Makena Beach today. Considering the 40 conditions the committee needs to approve, they’ll be voting for some time to come… Willis McInnis, 57, of Kahana was out surfing at STurns when he was attacked and killed by what was most likely a tiger shark. McInnis’ death marks the first time in a dozen years that a shark killed someone on Maui. Reports from lifeguards and witnesses on the scene said McInnis was surfing in murky water at the time of the accident—a virtual invitation for sharks and other large sea animals that bite. And why was the normally clear spot murky? That would be urban runoff... Speaking of

sharks in the water, since he apparently has nothing much do in Sacramento, California Governor Arnold Schwarzenegger decided to play lifeguard at our very own Wailea Beach today, apparently pulling a man suffering from cramps from the water. The man apparently was unharmed and went home without filing a police report, though fellow vacationer and Access Hollywood anchor Pat O’Brien was really impressed.

THURSDAY, APR. 8 Your average die-hard Hawaiian activist hates two things a lot in this world. First, arrogant kayak companies at La Perouse Bay. The state’s pretty much took care of that two days ago. The second might take a little longer, and that’s the Akaka Bill. Now stuck in the U.S. Senate, the Akaka Bill is largely unknown throughout the nation but insanely unpopular amongst those locals who trace their lineage to pre-contact days. Its sponsor, Sen. Akaka (D, Hawaii) says it will “clarify” the Hawaiian people’s “relationship” with the federal government, giving them the same status as American Indians and native Alaskans. But Hawaiian activists, looking at the current state of affairs of American Indians and native Alaskans, want something more that. In fact, they’d like anything from total autonomy within the State of Hawaii to a fully reconstituted Hawaiian nation completely separate from the U.S., depending on who you talk to. In any case, Akaka told the Associated Press that his bill is “being revised” because the U.S. Department of Interior—which would house Akaka’s proposed “Office of Native Hawaiian Affairs”—isn’t happy with it. The fact that no one seems to like this bill ought to tell Akaka something.

By far the dirtiest word in American politics is “reform.” Every wannabe official from railroad commissioner on down to president uses it during campaigns. Welfare reform, budget reform, education reform, Medicare reform, procurement reform—it’s all sweet music to candidates. Who dare opposes reform? Even incumbents like to throw it around now and then. The problem is, naturally, that candidates almost always define “reform” as “whatever the hell I want at this particular moment in my day.” Anyway, our good Governor Linda Lingle isn’t up for reelection this year, but that hasn’t stopped her from dropping a few R Bombs on Democrats—specifically, over their refusal to go along with her plan to slice the state’s sole school board into seven boards scattered across the islands. “I cannot support what [Democratic legislators] have drafted up to this point because it won’t bring about any real reform,” Lingle told the Associated Press. But she did pare down her original proposal to just four school boards—one for Oahu and the rest for the counties of Maui, Kauai and Hawaii. How exactly “reforming” the school board in this way will help public school students hasn’t been spelled out in any detail…

NEWSOFTHEWEIRD THE UNFRIENDLY SKIES Louis Paul Kadlecek, 21, who had never even been in an airplane before, broke into a hangar at an airport near Lake Jackson, Texas, on Feb. 29, and, using trial-anderror, got a Cessna 172 airborne for about a mile, intending to fly to Mexico, before slamming into power lines. Although the crash left the plane a total loss, Kadlecek climbed out and walked home, but sheriff’s deputies, based on witnesses’ descriptions, arrested him the next day. One Brazoria County aviation official estimated that stunt pilots might survive an incident like that one time in 1,000. Said another, “This guy used up all the luck he’s ever going to have.”

PEOPLE DIFFERENT FROM US In a 2003 issue of the American Journal of Roentgenology, two Seattle radiologists described a 35-year-old man with severe abdominal pain but normal vital signs, who was found to have “multiple” heads from Barbie dolls lodged in his small bowel, which he attributed to his pursuit of the pleasurable anal sensation he gets from excreting them. After a straight-laced description of how doll heads show up differently from other objects on X-rays, the authors advised radiologists to “keep in mind that human imagination may not follow clinical algorithms.”

Tax Day We get what we pay for Since Tax Day is finally upon us again, we thought it prudent to let you know how much of your hard-earned income is going to pay for things like death and destruction. More than a quarter of the U.S. Federal Budget this fiscal year is spent on the military. Another fifth of the national budget— our national checkbook—is spent on paying previous debts incurred from military spending. If that was not enough to raise concern, homeland security eats up 20 percent of both the general government and the physical resources budget pies. Think about those percentages this way. Last year, Hawaii households paid an average of $7,325 in federal income taxes. Now if we break down the average household tax payment $2,157 is spent on military and defense. Education then receives $278, housing takes $164 and nutrition gets $197. All told, military spending and interest payment on our current war campaigns consume nearly half of every tax dollar. In fact, the federal government has allocated $125 billion over two fiscal years for the war in Iraq. Borrowing a page from President Dwight Eisenhower’s famous 1953 “Cross of iron” speech, we can spend $145,600 on one Bunker-buster guided bomb or accomplish associate degree training for 29 registered nurses. We can spend $46 million for one hour waging war in Iraq or improve, repair and modernize 20 schools. We can spend $275 million for three missile defense system tests or eradicate polio worldwide. We can spend $16 billion for a year’s worth of nuclear weapons design and manufacturing or provide healthcare coverage for 7 million children. If no children went starving perhaps there could be an argument for putting so much money for armaments and military action. But 35 million Americans are “food inse-

Many people fed up with these numbers act as war tax resisters in an attempt to speak directly to bank presidents and IRS auditors about the waging war instead of providing for the basic needs of American citizens. One of the pioneers in the tradition of war tax resistance was Henry David Thoreau, who opposed the Mexican war. “If the injustice is part of the necessary friction of the machine of government, let it go, let it go,” wrote Thoreau in Civil Disobedience.

“But if it is of such a nature that it requires you to be the agent of injustice to another, then, I say, break the law. Let your life be a counter friction to stop the machine. What I have to do is to see, at any rate, that I do not lend myself to the wrong which I condemn.” That tradition continues today. “In my mind, I am never willingly paying the military portion of my federal income tax due in April,” said Andrea Ayvazian, a current war tax resister. “The IRS must come find me and take the money from me. I have chosen to live my life as I wish, with them responding and reacting to my behavior, not the other way around.”

Others whose conscience forbids them from paying for war are organizing a National Campaign for a Peace Tax Fund, designed to starve the federal government of the money needed to build weapons and attack other nations. Its effectiveness hinges on how many people decide they’ve had enough. It will fail unless a sufficiently large segment of the population wakes up to the fact that taxes are the people’s money and should be spent on what’s necessary for the American people—social services, health care and education. Just Sail Talking with two generations of windsurfers It’s a sunny, windy day at the beach near Kahului Airport. There are lots of boards and sail rigs lying around and several top class pro windsurfers are getting ready to go out. Connor Baxter looks like your typical windsurfer: blond, slightly tanned, totally concentrated on his job. He walks around, checking his equipment. In the past he’s done the Molokai challenge. A Pukalani resident, his first international event was in Penghu, Taiwan as part of the Asian Tour in December. In the Professional Windsurfing Association (PWA) Severne Hawaii Pro two weeks ago, he made the third heat, competing against the guys like event winner and two-time world champion Jason Polakow. Did I mention that Baxter is nine years old? Or that he’s just 5’ 3” but typically rides mast-high waves topping eight feet? “I only started February last year,” said Baxter. “It’s really a lot of fun. You get to do a lot of stuff and you get to get out of school a lot if there is a photo shoot, so that’s one reason why I like windsurfing. But mostly because it is really fun and you get to sail with other people like Jason.” Polakow—a 31-year old who’s been competing since 1989—met up with Baxter recently at the beach to talk about school, future events and his own experience. “It’s pretty cool,” he said about his up and coming competition. “I think it is great that little kids are entering. When I started windsurfing and entering the competitions they actually had a junior division, I think they need to start looking into something like that again. It’s hard to go against these huge people and being a little kid, people can barely see your sail!” Clearly, Baxter would windsurf all day if he could. But being a nine-year-old, he can’t. “Baxter, how desperate are you to be a professional windsurfer?” asked Polakow. “I really want to be the best!” the boy said. “Is that really what you want to do?” pressed Polakow. “If it takes my school up,” said Baxter, “I will mostly try to do my school but if it takes up my other time, my playtime, I will do it. That’s all I want!” The feeling was very familiar to Polakow. “Back home in Australia we have pretty good conditions in Torquay and also coming here a lot, all I used to do was windsurf,” said Polakow. “I was hooked. I used to watch Robby Naish and the other guys windsurfing and tried to copy them. All I wanted to be was one of these guys. I was very motivated to be as good as those guys. If someone has that much passion

We had the big round boom. It was even hard to hang on to the boom.” “How have you stayed motivated all the time?” Baxter asked. “Once I fell in love with the sport, I just wanted to push myself to be the best that I could,” said Polakow. “And watching guys like Robby Naish in the magazines, I just wanted to be like them. Seeing them on TV and in the magazines doing the really high jumps and riding the really big waves, just want to get one of these shots.” “Well, I was watching you,” said Baxter. “Jason, just seeing all these moves you can do and getting all the air is really cool! I fell like I can just watch people and then learn that and then hopefully can get back out and get better than them!” Polakow smiled, then imparted some advice. “Just sail as much as you can and spent as much time on the water as you can,” he said. “Just do all you all you can to be the best you can. Just go for it, on the days you think it’s maybe too big for you, it’s a little dangerous, you just have to suck it up and go.” MTW

Rick Gregory just wanted to play music.

Was Rick Gregory

That’s all. Just play his guitar. He lived in Pukalani with his wife and four children. He surfed a lot, partied a lot and played his guitar a lot. He was playing a guitar in a small Lahaina studio the night he died. But statements and reports made by numerous police officers, detectives and civilian witnesses indicate he was also acting strange, yelling about God and Satan and surfing to the other guys in the studio. That’s why the guys called the cops. None of them really knew him. He had come with a friend of theirs, but that guy had left. At first they’d been content to have Gregory hang out, but not now. But now he was dead, laying flat on his back in the middle of the room, surrounded by three police officers whose actions would later be the subject of court documents and press reports. They certainly didn’t want that. Richard Joseph Gregory died at the age of 51 shortly before 11 p.m. on Dec. 2, 2002 while being arrested by three Maui police officers. Statements by the three officers after the death said Gregory continued to rant and rave as they tried to cuff him, but also that he complained he couldn’t breathe as they attempted to restrain him. All three officers said they ignored Gregory’s plea, telling him that if he could talk, he could breathe. They denied striking him or placing him in a chokehold, but one officer admitted that he was trying to perform a hold on Gregory that had the officer place at least one arm around his throat. A coroner’s report concluded that Gregory died of a heart attack. An attorney with the Maui County corporation counsel insists the officers acted responsibly and were “not the proximate cause” of Gregory’s death. Gregory’s wife sees it differently. Last summer she filed a lawsuit against Maui County for negligence and wrongful death. “It is the opinion of the Maui County Coroner that, if the officers had adequately responded to Richard J. Gregory’s complaints of an inability to breathe, he would not have died,” wrote Mrs. Gregory’s attorney Eve Green in a July 7, 2003 complaint against the county. Green added that the three officers “negligently caused the death of Richard J. Gregory,” who “suffered grievous physical pain and conscious and extreme mental and psychic trauma and emotional harm before dying.” Valerie Gregory refused to comment for this story. “If everything was done right, we can live with that,” her attorney David Sereno told me. “But we believe the police were aggressive. They ask him to leave, then within seconds they move on him. Was he really a danger?”

Really a Danger? A night of strange ranting, three Maui Police officers and one dead man heart attack, but that happens. He was always giving me health stuff. He partied a bit. He used to go to Oahu to party.” Gregory and his wife were very religious, regularly attending Calvary Chapel in Wailuku. Gregory’s only job when he died was playing the blues three nights a week at the Embassy Resort. He also smoked marijuana a lot. After he died, Police found marijuana, a “purple glass smoking pipe containing suspected marijuana vegetation/residue” and “a very strong odor of marijuana” in the van he’d parked outside. A toxicology report [from the coroner] found cannibinoids in his blood “indicating acute use.” But it was music that made Gregory go to the Lahaina studio the night of Dec. 2. He wanted music lessons. There were three men in the studio with Gregory the night he died. They refused to comment for this story, but the statements they later gave police investigators tell a bizarre tale. Gregory arrived at the studio at about a quarter to 10 p.m., on Dec. 2. He’d brought his $3,000 acoustic guitar. But he soon became “frantic” trying to tune it. Gregory’s friend left, but Gregory stayed, saying he wanted to tune the guitar. Soon the men began to argue. They said Gregory began “ranting” about how he was a “good Christian” who didn’t like the “devil music” the other guys played. “I ain’t going anywhere, I’m staying right here,” one witness later said Gregory told him. “You’re making me mad, man. You want to fight, man? What?”

By Anthony Pignataro The guys called 911, telling the dispatcher that Gregory was “on drugs and acting weird.” After his death, police investigators talked to Gregory’s friends and relatives. They used terms like “high-strung” and “bipolar” to describe Gregory’s alleged mood swings. “Stated Richard was okay, then two weeks ago he started acting really hyper, and was not getting any sleep,” a detective reported after interviewing one of the Gregory’s close friends. “Stated one moment Richard would be okay, then next he would be very loud or upset about something.” In any case, things went from bad to worse at 10:43 p.m. when three Maui police officers—Edwin Among, Nicholas Angell and Garret Tihada—arrived on scene. Though the Maui Police Department has thus far refused to name the officers who were involved in the Gregory incident, their names appeared in court records filed on Mar. 5 by Valerie Gregory’s attorneys and in police reports Maui Time obtained through the State of Hawaii open records act. The officers found a small studio crammed with speakers, a drum set and computer. A sofa lined one wall, piled high with drum cases. Inside was Gregory, all three officers later said, holding a jug of water and a pen. Officer Among later reported that Gregory “began rambling about how glad he was to see the police and that he was a Christian and god was with him.” At this point the officers and Gregory were the only

In recent months, Maui police officers have found themselves in the midst of two highprofile incidents in which they’ve shot and killed suspects. Considering that the shootings are the first since the late 1950s, the media attention has been understandable. But the case of Rick Gregory is different. Maui police officers didn’t shoot him, but they had been struggling with him when he died. The question of whether they had anything to do with his death is at the heart of Valerie Gregory’s suit against the county. So who was Rick Gregory? “I used to play bass with Rick,” said Scott Baird of the band Crazy Fingers. “He was totally a cool guy. But he was a very hyper guy. He was really proud of surfing big waves. We never thought he’d have a

ones in the studio. The other guys were in a nearby room, but told investigators they never saw what happened next. “Gregory appeared extremely high strung, excitable and jumpy,” reported Officer Angell. “His body appeared to be very rigid and tense. Gregory’s eyes further appeared saucer like. He spoke very loudly and rapidly even though officer’s [sic] were well within earshot of him.” Angell wrote in his report that he asked Gregory to drop the pen. Gregory apparently refused. All three officers told investigators that Gregory never attacked them or even seemed ready to attack them. Nonetheless, they admitted making the first move, grabbing Gregory’s arms. Officer Tihada later told investigators he grabbed the pen from Gregory and threw it aside. Tihada also told investigators he repeatedly asked Gregory to “relax already,” but that Gregory kept struggling. The officers reported that the whole tangle of men then tumbled partly onto the couch. Initially, reported the officers, they managed to push Gregory face down on the floor. Tihada put in his own report that he was on top, holding Gregory down and the officers slapped the cuffs on. “I used both palms push down on the back of Gregory’s neck in an attempt to hold him down,” he reported. But that didn’t seem to work. “I could not control Gregory by pushing down on him, so I changed position to control him,” reported Tihada. “I positioned my armpit on the back of his neck with my right arm under his neck and my right hand towards his right armpit. For about thirty seconds I could restrict Gregory’s movement due to my weight holding him down.” That’s when Gregory began complaining that he couldn’t breathe. “He said, yeah, he said, ‘I cannot breathe, I cannot breathe,’” Tihada told a detective six hours after the incident. “I was like, ‘No, you can breathe because you’re talking to me. If you couldn’t breathe, you cannot talk’… He must have said it about like 10 times.” Whether Gregory could breathe or not, all three officers agreed that at this point Gregory managed to spin himself around, so he was lying on his back. Tihada told Detective Ronald Hiyakumoto that Gregory didn’t seem aggressive to them, but seemed just to want to escape. “[N]either he nor us, none of us, you know, never made any striking movements toward each other,” he told Hiyakumoto. “It was just us trying to hold him down to arrest and him just trying to get away from us, you know, he wasn’t… [all ellipses were in the original statements] it wasn’t where, you know, trying to injure us at all.” According to Tihada’s statements to Detective Hiyakumoto, the officer then tried to apply a new hold around Gregory’s neck. The significance of this is crucial—if Tihada applied a so-called “Carotid Hold” or sleeper hold on Gregory incorrectly, it could have killed him. “We’re looking at whether they used a carotid hold,” said Sereno. “Most police departments don’t permit that. If held too long, it deprives oxygen to the brain and the guy can die.” Tihada denied using a carotid hold on Gregory, but in a way that’s worth looking at in some detail. Clearly, the matter seemed to concern Hiyakumoto:

HIYAKUMOTO: Was there any time that your forearm, either your right or your left, came close to the throat or the bottom of his neck? TIHADA: When… when we first were on the couch


at one point, it did but then after that when we got down to the… towards the ground, then I knew I… I made sure that there was like… there was like space so that… that’s why we could keep talking the whole time.

And later in the interview:

HIYAKUMOTO: Uhmm, at any time, did you have a choke hold on, uhmm, on Gregory, uhh, carotid… TIHADA: Carotid, no, not a carotid. HIYAKUMOTO: This is… uh, what you mean by on the chest and around the… TIHADA: Yeah, well, I had… I had my arm around but at not [sic] time was… was for the carotid kind.

Carotid hold or not, Gregory stopped struggling shortly after Tihada changed position, allowing officers Among and Angell to finish cuffing him. Though Gregory was 51 years old, standing fivefoot-seven and weighing 185 pounds, all the officers

The coroner’s office finally pronounced Gregory dead a half-hour before, at 3:23 a.m. on Dec. 3, but by then he’d almost certainly been dead for more than four hours. According to Maui County Coroner Dr. Anthony Manoukian, Gregory “died of a cardiopulmonary arrest during a violent struggle complicated by arteriosclerotic cardiovascular disease, mild cardiomegaly and cannabinoid intoxication.” Manoukian observed “multiple superficial nonlife-threatening injuries” to Gregory’s forehead, tongue, right elbow, wrists and right knee. He observed “no head or neck injuries.” When he examined Gregory’s heart, he found it slightly enlarged with a narrowing of the right coronary artery—in other words, heart disease. But what about the timing of the death? Would Gregory have died of a heart attack anyway? Did the struggle cause the heart attack? Or did it merely hasten an inevitable event? On this point, Manoukian

“WE’RE LOOKING AT WHETHER THE OFFICERS WERE PROPERLY TRAINED,” HE SAID. “WE’RE EXPLORING WHETHER THEY ACTED APPROPRIATELY FROM THE TIME THEY WALKED IN THE DOOR.” said they struggled for five minutes to subdue him. “It’s extremely unusual for someone to have superhuman strength for five minutes,” said Sereno, Valerie Gregory’s attorney. “We’re skeptical it took five minutes. Was he difficult or were they frustrated? Either the guy had superhuman strength or they were bullying him. And how does the struggle go on for five minutes and nothing is disturbed in a relatively small space?” Interestingly, there were slight differences between the stories the officers gave as to when they noticed that Gregory was “unresponsive.” Angell and Tihada told investigators that after they cuffed Gregory, they rolled him over. Tihada said he then “looked at [Gregory’s] face and it just looked odd.” But Angell said that after rolling Gregory over, they “brought him up” into a seated position. That’s when Angell said he thought Gregory “looked like he, he looked like, initially I thought he might be holding his breath.” As for Officer Among, he told Detective Hiyakumoto that Gregory was still conscious when they rolled him over:

HIYAKUMOTO: Then when you sat him up, was he conscience [sic]? AMONG: Yeah he was. HIYAKUMOTO: Like what, what is he doing? AMONG: He was just talking, all of a sudden he just went… we thought he was faking or something so I even rubbed the sternum rub [sic], nothing happened, ah. The “sternum rub” Among mentioned was a method of inducing a small amount of pain to elicit a response—to see if Gregory was playing possum. But he was not, which the officers say they then realized. They told investigators they tried reviving him with CPR and then an Automated Emergency Defibrillator (AED). Nothing worked. Paramedics arrived at 10:57 p.m. This time, they got Gregory’s heart beating again for about a minute, but then it stopped for good. No one called Valerie Gregory to tell her Rick was dead until nearly 4 a.m.

seemed less certain. “Sudden death during or immediately after a violent struggle is well-described in the forensic literature,” wrote Manoukian. “Often, these events are unassociated with a fully explanatory anatomic cause of death. In the typical scenario, the deceased has engaged in the violent struggle with one or more individuals. Restraint or positional considerations may be contributory. During the struggle, or more commonly immediately after it, the individual abruptly becomes unresponsive, develops cardiopulmonary arrest, and does not respond to resuscitation.” Manoukian also addressed the “hypothesis” that deaths like Gregory’s could be the result of “norepinephrine and Epinephrine surges” that could instigate a heart attack, but stopped short of saying that caused Gregory’s death. “Since this violent struggle has occurred between individuals, the best classification of the manner of death is homicide,” concluded Manoukian. “It is noted that homicide as used here is a pathologic classification and does not indicate criminal activity, nor does it imply murder.” Sereno isn’t implying murder either, but he said he will look at a whole range of issues in the suit. No trial date has yet been set, and Sereno said he and Green, are still in the discovery phase. “We’re looking at whether the officers were properly trained,” he said. “We’re exploring whether they acted appropriately from the time they walked in the door. We’re looking at their approach from the beginning. We want to know if the contact and interaction between Mr. Gregory and the officers was appropriate.” As far as the county is concerned, their discovery is proceeding at pace. And they’re casting a wide net. Corporation counsel attorneys have subpoenaed any video cassettes Calvary Chapel might have given Rick Gregory referring to “heavy metal music being ‘devil music’ and/or not ‘of God’ and/or not of Christ or refers to heavy metal music as being inappropriate in any matter.” Corporation Counsel attorneys are also subpoenaing any and all records related to Rick Gregory from the Elks Club, as well as all “education, medical and counseling” records relating to the Gregory children, two of whom are barely four years old. Wailea loosely translates as “Water of the canoe-making goddess Lea,” but these days its endless golf courses and giant resorts seem to say nothing more than “Wealthy as all hell.” I was thinking about this as I sat at one the tables just outside Caffe Ciao, located in Wailea’s Fairmont Kea Lani Resort. I was sipping a bottle of mango-melon SoBe and steadily reducing one of the Caffe’s Volcano Veggie sandwiches as pink and red-skinned families wearing swimsuits and rash guards walked past. Tasty, elaborate and good for you, it’s your basic, run of the mill veggie sandwich—yellow squash, zucchini, red onion, lettuce, tomato and olive relish pressed between two soft wedges of kalamata olive bread. “The hair cut looks great,” said a whitehaired guy suddenly standing over me. “But if you’re going out tonight, you’re going to have to shave.” Knowing that I hadn’t shaved in a couple days, I smiled and nodded. He sat down opposite me. He said he was a retired president and CEO of an electronics firm he’d built. A Michigan resident 11 months out of the year, he said he and his wife were just spending the month on Maui. It had become a 30-year tradition with them— splitting the year between Michigan and their places in Kapalua and Wailea. You meet people like that at Caffe Ciao. Rich, certainly, but a little different from those who might dine at the Kea Lani outdoor café that serves $17 chicken sandwiches for lunch. Think of Caffe Ciao as Wailea’s general store. They’ve got bottles of juice, cans of soda, cold sandwiches, hot paninis, grilled cheese, pizza by the slice, hummus wraps, pasta salad, roasted vegetable salad, mac & cheese, green bean salad,

African couscous, individual bottles of Chardonnay, Belgian Waffles and French Toast in the morning, fresh bread, doughnuts, muffins, croissants, individually-wrapped caramels, rock candy, biscotti, crackers, fennel, freshly roasted coffee, caramel apple mix, brittle, toffee, chocolate-covered nut clusters, peppermint patties, cheesecake, strawberry shortcake, margarita lime tarts, parfait, a half dozen varieties of sorbet, ice cream and Tiramisu so moist and fluffy the top layer looks like some kind of chocolate velvet that you just want to shovel down your gullet. You order at the counter and seat yourself. But we were talking about wealthy people. Like my new friend, who briefly sketched out the requirements for affording a home Upcountry and by the beach, allowing someone to live on Maui and always have pleasant weather. “It’ll take about $10 million,” he said, getting up. “And if you work for 15 years like I did…” I thought about that for a time, then commenced to shoveling that Tiramisu. I was done by the time my retired friend came back outside. “But you need to remember that money is not the key to happiness,” he said. “You start to make money, all you want to do is make more money. No one is immune from being greedy. Even me.” I let the thought—and my lunch—digest. “You know what the key to success is?” he asked. I shook my head. “Self-motivation,” he said, leaning forward. “I’d rather have one guy who’s motivated to work hard than five I have to keep after. But luck is also very important.” I asked him what made some men motivated and others not. “That’s a very good question,” he said as his wife came over and tapped him on the shoulder. “I’ve asked myself that. Orchestra 101 Peter and the Wolf—The Ballet comes to the Castle Theater

Once there in the open field, Peter hears a bird chirping—signified by flutes—and joins along in song on the way to a pond in the middle of the meadow. At the pond, Peter and the bird come across a duck, which the orchestra introduces by way of oboes. The bird and the duck begin to argue about which one is a better bird—the one who can fly or the one who can swim—as you hear represented by the interplay of flutes and oboes. While the two fowl are quarrelling, Peter hears his cat—introduced by means of clarinet— creeping slyly into the meadow. Peter then warns the bird of his cat’s approach and the bird quickly flies out of reach and onto a tree limb. The cat soon gives up his chase and instead, falls asleep at the foot of the tree. Just then, the grandfather discovers Peter and scolds him for his disobedience. Once again, he cautions Peter against the dangers of the animals in the forest. His grandfather’s warnings don’t frighten him, but Peter is led back to the yard anyway, behind the safety of the locked gate. French horns introduce the arrival of a wolf from the forest, who lurks closer and closer to the pond. The bird (flutes) then alarms the cat (clarinets) and duck (oboes), but the duck waddles too slowly and gets eaten by the wolf (French horns). Now both the cat and the bird are stuck in the tree, with the wolf waiting for one to slip, so he could eat them too, greedy little wolf that he is. A lot of other stuff then happens, but I don’t want to ruin the story. Presented by Alexander Academy of Performing Arts, Peter and the Wolf—The Ballet will be on stage this Friday through Saturday, 7 p.m. at the Castle Theater, Maui Arts & Cultural Center. Simply glance over the recent MACC schedule of events and you might not think twice about the production of Peter and the Wolf presented by Alexander Academy of Performing Arts. Just another classical ballet with boring orchestral backup, right? Not quite. Sergei Prokofiev composed Peter and the Wolf in 1936, intending to introduce children to the different elements of the orchestra. A particular instrument in the string, percussion or woodwind sections of a typical symphony orchestra represents each character in the story. Prokofiev’s piece also taught children how musical instruments can communicate particular ideas or moods in music. The story in Peter and the Wolf revolves around a young Russian boy. The tale may have taken place a century ago, but it has aged extraordinarily well. Peter is introduced in the score by the use of orchestral strings, which take on a young, buoyant tone whenever the character comes on stage. Peter is staying with his grandfather— represented musically by a bassoon’s deep, staccato notes. The grandfather solemnly instructs Peter to never go out behind the house into the wide green meadow that overlooks a mysterious forest, for fear of the dangerous creatures that reside there. Naturally, this is the first thing Peter wants to do as soon as his grandfather turns his back, which happens the next morning. Peter leaps out of bed to go outside and play. He loves to climb the gigantic tree in his grandfather’s backyard, but the tree hangs over the forbidden meadow, which proves to be a temptation Peter can no longer avoid. Peter apparently wasn’t afraid of the big, bad animals in the forest, nor his grandfather’s strict warnings. And so, Peter unlocks the metal gate and runs into the large meadow.

The Bride and an as-yet unkilled Bill Although it’s a gigantic shame that Miramax split Quentin Tarantino’s long awaited “kung-fu samurai Spaghetti Western love story epic” into two halves, Kill Bill Vol. 2 pays off in spades as it completes the Bride’s (Uma Thurman) trail of violent revenge with plenty of panache to spare. Characters are fleshed out far better in Vol. 2 with David Carradine (as Bill), Michael Madsen (as Budd), and Daryl Hannah (as Elle Driver) burning up the screen in scenes that brim with suspense, surprise, and witty dialogue. With his signature use of impeccably hip music, Tarantino delivers a rich movie made up choice references to splinter genres of “grindhouse” films. Kill Bill Vol. 2 is a movie-lover’s movie through and through.

★★★★★ The opening 15-minutes establish the pregnant Bride’s doomed wedding rehearsal in heavily saturated black-andwhite scope that’s so rich you can practically see the termites wriggling around inside cracks of the old wood of a small El Paso church. Beatrix Kiddo (The Bride AKA Black Mamba) explains that she will have no family members sitting on her side of the church during the wedding ceremony because she is alone in the world. This disclosure doesn’t sit well with the minister’s wife (Jeannie Epper— Switchblade Sisters) who insults Beatrix for being such a loner. Beatrix excuses herself from the discussion to avoid having a confrontation in her wedding dress,

and retires to the front porch of the church where Bill (David Carradine) unexpectedly greets her. As the two opponents approach one another in uneasy conversation, Tarantino’s camera goes to the characters’ feet to reveal that they gain on each other in a kind of ritualistic dance. It’s this brand of subtle formality that informs the scene’s casual dialogue with a heightened sense of percolating disturbance. When Bill enters the church to meet Uma’s groom, feathers are ruffled as she introduces him as her father, and he poses a question to her low rent suitor about seeing his bride-tobe in her wedding dress before the ceremony. The question sparks a foreboding uneasiness that ends in a blaze of gunshots from Bill’s Deadly Viper Assassination Squad, and finishes chapter 6 of the 10-part story with the barely glimpsed massacre from Vol. 1. Michael Madsen commands the next chapter (“The Lonely Journey of Paula Schultz”) as Bill’s younger brother Budd, a shit-kicking bouncer at a Barstow, California topless bar, living in a trailer home plopped down in the middle of nowhere. Dressed as a Ninja assassin Beatrix gets a rude surprise when she storms Budd through his trailer door. Johnny Cash’s rendition of “Satisfied Mind” plays on an old turntable when Budd blasts a double barrel of rock salt into Beatrix’s chest. Budd immediately calls his one-eyed Viper assassin cohort Elle (Daryl Hannah) to arrange a million dollar payment for dispatching the Bride, and sets about burying his bound victim alive. Madsen has grown considerably around the middle since he played the detached torturer in Reservoir Dogs, but he gives a similarly inspired performance here that bristles with the actor’s best instincts. It’s in the next flashback chapter (“The

Cruel Tutelage of Pai Mei”) that the movie hits its stride. Beatrix sits with Bill at a campfire in kinder times and listens to Bill tell a story about his kung-fu master Pai Mei while intermittently playing a long bamboo flute. Bill’s story is a classic riffing Tarantino monologue about a fighting technique that will play prominently into a later part of the story. It’s here that we experience the nature of Bill and Beatrix’s affection for each other, and the scene segues beautifully into a fighting apprenticeship that Beatrix enters into with Chinese fighting master Pai Mei (Gordon Liu—The 36th Chamber of Shaolin). Where Vol. 1 concentrated on Japanese Martial Arts, Vol. 2 focuses on Chinese fighting styles based on animals such as the crane or the snake. The skills that Beatrix learns under Pai Mei’s demanding tutelage allow her to escape her impossible trap and finish her quest for revenge. Cinematic pearls seep out in every scene by way of iconic compositions framed by Director of Photography Robert Richardson (JFK), who adroitly slips from a widescreen format for the burial sequence to a shifting zoom for Pai Mei’s scenes, and onto a variety of other cinematic allusions. These instantly recognizable reflections are exquisitely scored with well placed music by such artists as composer Ennio Morricone, rockabilly great Charlie Feathers, and original music by the RZA and Robert Rodriguez. Only when Kill Bill is finally released in its full 247-minute version, that Q.T. originally intended, will audiences be able to adequately judge the impact of his overflowing movie. But until that integration happens, we’ll have to settle for the brilliance that Vol. 2 has to offer. This is one movie you’ll definitely want to see more than once. Rated R - 138 mins. MTW

Hip-hop Hooray Sunday, 12-5 p.m. at the War Memorial Complex This is IT, baby!—the hugest, most hip-hoppin’est, two-day hip-hop event series that kicks off on Oahu and concludes on Maui: “Armory Heavyweights: 808 Edition.” There’ll be a semi-annual competition composed of a 3-on-3 B-Boy / B-Girl break dance battle, an MC / lyricist freestyle battle, a DJ / turntablist battle, and a 1-on-1 BBoy break battle. There will also be an incredible one-man turntable exhibition by two-time ITF Champion DJ Solution of the “Nokturnal Sound Crew,” a fashion show premiering some of the hottest underground hip hop lines, as well as a video exhibition of some of the most popular hip hop events happening all over the world.

Alternative Entertainment Friday-Saturday, at Borders Books & Music Last weekend, I discovered what a pain it is to try to see a movie on a Saturday. Fortunately, Borders has so much going on this weekend, you don’t have to wait in any stinkin’ line for any carnage or overpaid teenfilled flick. Starting Friday at 7 p.m., local poet and professor Eric Shaffer will be Center Stage, reading from his works in celebration of “April is Poetry Month.” Then Saturday, 12 p.m., author Stuart Coleman will be signing copies of his book, Eddie Would Go, which is now in paperback. He will also be giving away some special edition t-shirts, posters and bumper stickers. Then grab a coffee, pick up the latest Chicken Soup for the Debaucherous Writer-Who-Is-Surely-Going-ToHell’s Soul or whatever and wait it out until 2 p.m., when slack key guitarist Makana [pictured right] will perform songs from his new CD Kihoalu—Journey of Hawaiian Slack Key. They play “Passionate Exotic Hardcore Industrial Metal with divine breakdowns and demonic thrashes,” which is oh-so-deliciously described as being “an exuberant view into the Soul and the Flesh through music.” Also, the hard rock demon monsters of Zero Tolerance will be opening for their Lahaina show and the dirty angels of Maui’s metal mayhem out of Makawao, i.e. Khrinj, will open at the Casanova show... Anybody see my black vinyl culottes?

Never miss a good chance to shut up Last Thursday Jen, Kim, Sasha and I went to see Baaba Maal at the Castle Theater at the MACC. After Jen and I counted how many different kinds of hippie skirts were present, we all guzzled a quick beer before going in. The orchestra section in front of the stage quickly filled with the dancing, spinning, twirling crowd. From our balcony seats, the throbbing mass, with hands held upward, looked to Jen like “a scene from Dawn of the Dead.” After the incredible show, we caught up with Debra and went to Mañana Garage in Kahului for a post-cultural-event cocktail. When the girls bailed to go back to Lahaina, I headed to the SandBar in Paia. I chatted up with Dave for a while, ran into the “Baby Jesus guy” who introduced me to a lovely Hawaiian girl, who then introduced me to so many people I ended up forgetting her name. Then Elan came in, we did our ritual shot of Patrón and he told me of some weird recurring dreams he’s been having, all apparently with a common theme. “They all seem to be about something big coming,” he said. “Like something is about to happen, something really huge.” “Well, what are you doing to prepare yourself for this ‘big’ event?” I asked. “I’ve been beating off a lot,” he said, grinning. And so I left to the sound of one hand clapping. Okay, ew. On Friday night I had big plans: I was going to go to the SandBar to see a “funk, soul, reggae” band called Sirus B Posse and then to the Tropix Orgasmix night at Casanova. But the island-wide, heavy rain put a damper on my plans, so I stayed in town at the Sugar Shack. Kim and Sasha came over and we ate Jen’s Sloppy Joes, drank a huge bottle of red wine and watched Gothika. This was actually an historic occasion—it was the first time I’d seen Jen make something for dinner other than reservations or a To Go order. While Jen ate herself “to the point of nausea” then promptly passed out, the rest of us discussed whether you say “butt” or “buck”-naked and whether you pronounce “pecans” puh-KAHNZ or PEE-kanz. I continued calling my friends on the other side—Elan and Dave B. in Paia, the Khrinj household in Makawao—every half hour for a weather report on the status of the rain upcountry while back at home, the girls continued scoffing at me. “Maybe you should call somebody in Kula,” they said. “You know, just to be sure.” On what was to be my fourth night in a row at the SandBar, I went to check out the scene of roots reggae and dancehall with DJ Boomshot in Paia. At first, the bar housed a casual set of upcountry locals—mostly 20-somethings with a couple of older guys playing pool and a sprinkling of young, bohemian chicks. After Boomshot’s set kicked in, the place was packed and apparently everyone discovered their inner dreadlock, as nobody could walk without skankin’. The entire evening was nothing but sweetness and light. I was so busy making new friends and reaffirming my affection for old ones, I quickly forgot about Boomshot. I ordered my Sierra Nevada Pale Ale from effervescent bartendress Amanda, was briefly charmed again by Marty Dread, met a couple of sassy San Francisco girls, Michelle and Lucia, chatted with a cute photographer guy named Rob and his lovely friends Ray and Vivienne from London, who invited me to a fabulous art party. I love fabulous art parties. I also ran into my buddy Yancy, who launched into a couple of fascinating stories about drunk cowboys and marijuana legalization—not related— but he got nervous anytime I whipped out my notebook so I happily demurred. Then some guy I recognized around town asked who I was and for some reason wanted to tell me about some lawsuit he was recently involved in. Not necessarily a topic I wanted harsh my mellow with, so I decided it was a good time to leave. Then the guy followed me out to my car and as I started to pull away, he tapped on my window. “Yancy says I should be careful because you’re going to write about me,” he said, “but I told him I have good lawyers.” “I have nothing to say about you,” I said and smiled politely, hand on the gearshift. “But you’re a writer? For Maui Time, right?” he asked. I nodded and smiled again. “I wouldn’t worry about it, though,” I said, “it’s just a silly column. It doesn’t matter—” “Well, at least not to the world,” he said.
