DUNDEE RESTAURANT TO UPSKILL ‘HIDDEN WORKFORCE’

The very essence of Ooh De Lally, a restaurant taking over the former Mark’s in Dundee, can be described with one word: community.

It’s woven through the artwork, the food, and the individuals who work there. Individuals who are looking for a new community and a second chance after spending time incarcerated.

The Hidden Workforce

When Mark’s closed in Dundee after nearly 20 years in business, it left a gap in the community. That was, until Diane Good-Collins, director of Metropolitan Community College’s 180 RAP (Re-Entry Assistance Program), had an idea.

Good-Collins learned of French restaurant EDWINS in Cleveland, Ohio. The nonprofit offers formerly incarcerated individuals support and training in the culinary and hospitality industries as they transition out of incarceration.

The program reportedly graduates 75 individuals a year and has a 95% graduate employment rate with less than a 1% recidivism rate.

With Nebraska’s low unemployment rate and the abundance of positions available in the culinary and hospitality industry, Good-Collins thought a similar program could work in Omaha. After all, she calls the formerly incarcerated population the “hidden workforce.”

And with that, the vision for Ooh De Lally was born, eventually finding a perfect home in the former Mark’s.

Laying a Foundation

Developed in collaboration with MCC’s Institute for Culinary Arts, the Jumpstart program was designed to teach participants basic skills in an active restaurant.

“Our whole goal is to give them the opportunity to determine if this is their path; if this is where they want land,” Good-Collins said.

Throughout the three-month program, participants will learn about kitchen prep, line cooking, and front-of-house duties at Ooh De Lally. By the end of the program, participants will have essentially completed the lab component of an associate degree through MCC.

Participants can choose to transfer those microcredits to MCC to finish out the degree, or they may decide to pursue a job right out of the program. On the flip side, participants may decide that this isn’t the path they want to take.

“I try to tell participants that there’s no losing here. If they decide this isn’t for them, then we will help them get into a different program,” Good-Collins said.

They plan to begin with three participants, adding up to nine at a time.

Beyond a Paycheck

Individuals coming out of incarceration face an uphill battle. They may have lost skills and support systems, financial resources and personal documents, putting them in survival mode.

Good-Collins said that with those factors at play, it’s unrealistic to ask someone to attend college.

It’s a truth that 180 RAP recognized early on, and has built support systems around it, such as a food and basic needs pantry and a financial assistance office.

As it relates to Jumpstart, participants will receive a stipend to supplement expenses and will be enrolled in a financial literacy and empowerment program. Participants will also be asked to attend a peer group, and a full-time staff member will be dedicated to this program.

The staff member will support participants in a variety of ways, from providing transportation to appointments to helping fill out child support paperwork.

What’s more, 80% of the 180 RAP team members are individuals with similar lived experiences.

“When participants throw up excuses and say “you don’t get it” our team members can say “Yes, I do,”’ she said.

The support system is one reason 180 RAP has one of the highest success rates in the country, with a 99.83% participant employment rate.

Lean On Me

At Ooh De Lally another layer of support is added through staff members. Ben Dabney, Ooh De Lally general manager, said he owes his nine years of sobriety to his support system.

“I ended up broke, jobless, homeless, and in legal trouble back in 2014,” he said. “Since then I’ve relied heavily on the people around me to help me. I have to give a shoutout to Arch Halfway House, that was the program I was in in early 2015.”

While Dabney has never been to prison, he has friends that were incarcerated and acknowledges that he was probably only a few mistakes away from heading there.

“I don’t see myself as any different then someone who has served time,” he said.

After over nine years in the industry, Dabney said he’s excited about Ooh De Lally’s commitment to “do better.”

“I think a lot of folks in the industry say they care, but I think that’s different than showing it,” he said. “Partnering with 180 RAP gives us the tools and resources to do better.”

Simply put, this means treating people with respect, dignity, and compassion. In one instance Dabney was able to share his lived experience to help a participant feel at ease. In another instance he was able to help secure a bus pass for a participant.

Part of the Community

One of the biggest highlights so far, according to organizers, is the community’s overwhelmingly positive response.

“I was expecting support; this is a friendly neighborhood and people are generally open minded around here. But it’s been universal support,” Steinbach said.

Local artist Eduardo Gardea has created seven paintings to be placed throughout the restaurant. The paintings are impactful given that Gardea recently worked for RISE Re-entry Services and was incarcerated in his youth.

Several Omaha businesses have stepped up to directly support the initiative. Site-1 Brewing, Myrtle & Cypress Coffeehouse, eCreamery and Chocolat Abeille have all created custom products to be served and sold at Ooh De Lally.

“We’re trying to create more ways for people to support the restaurant without necessarily having to come in and eat,” Steinbach said.

Starting at the beginning of March, the restaurant will open for dinner service on the upper floors Tuesday through Saturday.

“As we gain participants we can expand to a lunch service,” Steinbach said. “We see the steps and we have places to grow. We just want to make sure we’re paying attention to every single step.”

There is no shortage of interested participants. Good-Collins said that she began putting fliers up at the Omaha Correctional Center, the state work release centers in Lincoln and Omaha, and the women’s prison in York, Nebraska.

“Right now we have about 90 people on the waitlist,” she said. “We want this to be successful … [so we’re] looking for employers to hire our skilled laborers.”

Ooh De Lally also has a place on its website for donations and e-gift cards.

Asked what factors would cause them to leave their current employer for another, nearly half the workers polled listed insufficient pay and benefits, easily outpacing the second-place cause. At the same time, the report found low-wage workers had

higher-paid counterparts. Given these realities, it isn’t surprising the study’s authors reclassified the “Great Resignation” as the “Great Reckoning,” describing a situation where government stimulus checks and workplace upheaval caused by COVID-19 gave the average worker more leverage.

“The pandemic has shifted the stressors facing employees and frontline workers have borne the brunt,” the study authors wrote. “Their jobs have become more challenging due to labor shortages, supply chain challenges and new safety rules. Many low-wage earners are asking themselves, ‘Is this job worth it?’”

The study indicated that organizations must address the unique needs of their workforce.

“Medical coverage is the most important employee benefit and having a wide-ranging portfolio of additional supplemental benefits, both employer- and employee-paid, helps provide diversity and soundness of the overall offering,” Holland said. “In the employee benefits space, supplemental health benefits, critical illness, accident and hospital indemnity insurance are on the rise as an additional benefit and sometimes to fulfill a gap with medical coverage.

“Employee-paid benefits continue to be on the rise to help employers control costs yet still offer a benefit to their employees.”

Mike Mandolfo, president of Strategic Benefits, said alongside specific perks offered, the ability of companies to provide choices for their workforce is a key differentiator among competing employers.

“A well-implemented benefits package will have long-lasting improvement on employee morale, new employee recruitment and overall employee retention,” he said. “A popular trend within an employee benefits package is increased employee options. One size does not fit all when it comes to health care needs and many employers have created a buffet-style benefits package where

Generation Gap

This strategy is even more valid as generational differences continue to bubble to the surface in the workplace. According to

Forbes Advisor, three of the top five most-desirable employee benefits overall — employer-covered health care, life insurance and pension and retirement plans, respectively — have remained fairly constant with previous eras. The other two — mandatory paid time off and mental health assistance — have a more contemporary feel.

Drill down a little deeper and generational preferences in benefits come into even sharper view. Forbes reported more than 30% of 18- to 41-year-olds are “most concerned” with having pet insurance as a benefit, while the Harvard Business Review noted 31 million Gen Xers and Baby Boomers are caring for an elderly parent, a reality shaping their demand for senior care benefits at work.

Pulling together a benefits package that meets each end of this spectrum and all the points in between, is a study in complexity, Mandolfo said.

“Building a benefits package from the ground up generally involves the replacement of individually purchased plans,” he

said. “A newly implemented benefits package that aims to improve employees’ access to more affordable health care or strategizes to replace existing coverage can be challenging.

“We recommend using employee questionnaires and surveys as a starting point to understand the type of in-force benefit plans employees already have in place and their current premium spend. The goal is always to improve upon existing coverage.”

Compensation as a Culture

Employers are also exercising creativity when it comes to offering benefits to part-time employees, even though there is no statutory rationale for doing so. Mitch Friehe, benefits advisor at UNICO Group, said companies following this strategy send a message about their corporate culture.

“Company culture speaks a lot when you start [offering benefits] to part-timers; it’s creating value for the employee to work for them,” he said. “We have started to put together

those nontraditional benefit offerings, usually offered more on a voluntary basis to give some choices and access for those parttime employees.”

Friehe suggested any company looking to get the biggest bang for its benefits buck should deploy a multi-front strategy of gathering employee wants and balancing it against the competitive landscape, communicating regularly and transparently throughout the process.

“Having employee benefit surveys, getting that pulse, learning what’s important from the employees themselves is powerful,” he said. “Benchmarking is also huge for employers, to be able to say, based on industry or geography or size, who they’re competing against for top talent and what’s the benchmark. You can then determine how you want to position yourself in the market.

“Finally, the most overpowering thing you can do is employee communication and engagement. You want to make sure employees truly understand the benefits they’re getting and the value they bring.”

5 Employment Practices to Watch

INSIGHT INTO EVOLVING PRACTICES

1. Non-Competition Agreements

For many years part of an employee onboarding process has included signing a non-compete or non-solicitation agreement. That may change in April when the Federal Trade Commission (FTC) is expected to vote on a new rule that would make such agreements unlawful.

“The rationale behind the rule was that limiting competition suppresses wages, jumpers innovation, and blocks entrepreneurs from starting new businesses,” said Patrick J. Barrett, an attorney with Fraser Stryker.

“By stopping this practice, the agency estimated that the new proposed rule could increase wages by nearly $300 billion per year and expand career opportunities for approximately 30 million Americans.”

The FTC rule would cover traditional employees, as well as independent contractors, interns, volunteers, apprentices, and sole proprietors who provide services to a client.

The National Labor Relations Board (NLRB) also signaled similar sentiments, noting that most non-compete and non-solicitation agreements violate clauses in the National Labor Relations Act.

2. Severance Agreements

The NLRB revised its stance on severance agreements in the past year. For many years severance agreements were put in place when employers and employees were parting ways to protect employers from future legal disputes.

“Historically, employers have included confidentiality and nondisparagement provisions,” said Sara McCue, an attorney with Baird Holm. “By using those provisions an employer essentially is saying to the employee that they can’t discuss what they were paid.”

The NLRB’s revised stance holds employers can’t offer employees an agreement that asks employees to waive all of their statutory rights (such as discussing pay) in exchange for pay or benefits.

Instead, McCue said, the clause must now be so specific it may render these agreements ineffective.

“That might mean fewer severance agreements overall, which could mean more litigation and lawsuits filed against employers,” she said.

3. Religious Accommodations

The Supreme Court’s ruling in Groff vs. DeJoy last June means employers must prepare a more robust argument for rejecting an employee’s religious accommodation request.

The Court unanimously agreed that Louis DeJoy, the postmaster general for the United States Postal Service, failed to accommodate Gerald Groff’s request for Sundays off due to his religion.

Before the unanimous decision, an employer could argue that accommodating the religious practice would present an undue burden, such as paying extra for an employee to work overtime. That no longer stands.

“The employer must look at its entire business and determine whether, within that context, the accommodation would result in substantial increased cost in operating the business. Moreover, the effect on coworkers (i.e., voluntary shift swaps) and increased administrative costs, including overtime, is not an “undue hardship” unless it is an undue hardship on the conduct of the employer’s business.”

4. Tracking Paid Sick Leave

Amy Luckenbill, government affairs committee co-chair for the Human Resources Association of the Midlands, said employers should be watching the Nebraska Healthy Families and Workplaces Act. The act is the proposed resolution put forth by the Paid Sick Leave for Nebraskans, which currently has a petition circulating in preparation for the 2024 voting season.

If the petition gathers enough signatures to be placed on the ballot and receives votes from 60% of Nebraska voters, companies will be required to offer employees paid sick leave so the employee can take care of themselves, or a family member.

“While any preparation on the issue is speculative at this point, employers do need to keep track of ballot initiatives and referenda, in addition to decisions made by the courts or guidance documents from the EEOC (Equal Employment Opportunity Commission),” she said.

“Employers should be investigating how their current payroll and time off technologies will accommodate any new requirements, should the initiative be voted into law.”

5. EEOC Enforcement Guidance on Workplace Harassment

Speaking of the EEOC, the first update to its Guidance on Workplace Harassment may come this year. The guidance, which hasn’t been updated since 1999, will include protections against sex-based discrimination in the virtual workplace.

The guidance includes sexist or racist comments or imagery.

“The proposed guidance also addresses Title VII’s prohibition of sex-based harassment and discrimination, which specifically includes harassment based on sexual orientation, gender identity, pregnancy, childbirth, or related medical conditions,” Barrett said.

“While the final guidance does not have the force of law, it does clarify requirements under the law or EEOC policies.”

Bonus Question

While not new, McCue said one of the most common questions they receive is concerning the Americans with Disabilities Act (ADA) and its provisions for animals in the workplace.

“There’s quite a bit of confusion from businesses concerning what its obligations are as an employer versus what are their obligations as an entity that is open to the public,” she said.

Title I states that an employer has to work with an employee towards a workplace accommodation, but doesn’t specify what animals are accepted.

Title III states that a workplace that is open to the public, such as a restaurant or shopping mall, must allow service animals for individuals with disabilities. In many cases, that’s a registered canine.

There have never been more Black CEOs on the nearly 70-year-old Fortune 500 list. Eight such executives joined the ranks in 2023.

While Fortune isolated this record-setting achievement alongside the achievements of those leaders, the publication also recognized that their representation on the list remains low – standing at 1.6% despite a labor force participation rate of 13%.

Locally, Black business leaders weighed in on respective accomplishments and experiences, while offering words of wisdom to those looking to bring more diversity to leadership roles.

Commitment to Community

“My biggest professional challenge was finding how I could mesh my passion for meaningful work with my professional career,” said Marcus Bell, CEO of Omaha/Council Bluffs Bridges Out of Poverty. “I always had jobs that I enjoyed, but outside of my 9-5, I would always volunteer to do something meaningful in the community, like mentoring or being of service.”

In the nonprofit world, Bell said his work can have a “true impact every day.”

Much can be gleaned from how admired leaders overcome setbacks.

“I continued to show up and do the work,” Bell said. “I was blessed to have mentors who looked like me, who poured confidence and positivity into me, that pushed me to realize my potential.”

Black mentors and leaders gave Bell the confidence to not shy away from leadership.

“I never intended to be a CEO,” he said. “This work came and found me, because I was present, showing up well and doing the work that needed to be done to push our community forward.”

Candice Price has established a thriving business in a competitive industry while expanding Home Team Auto Sale’s operations, an achievement she said reflects a commitment to growth, resiliency, and creating additional service and employment opportunities.

While licensed auto dealerships owned by African-American women are few and far between, Price is looking to change that.

She takes particular pride in Home Team Auto’s status as one of only two Buy Here Pay Here (BHPH) Institute’s Morning Show White Hat Way Dealers of the Year. She said the acknowledgment is a testament to its ethical, customer-focused approach. Altogether, Price said these achievements are valued deeply as significant milestones to drive cultural and societal change.

“It reflects my commitment to challenging norms and breaking longstanding barriers for minorities and women in fields where they have been historically underrepresented,” Price noted.

She currently serves on the board of directors of the Nebraska Independent Auto Dealers, committing herself to inclusive representation, equitable opportunities, and progress toward a diverse, inclusive professional landscape.

The path to her success hasn’t been smooth. Price characterized the challenge of balancing financial stability while not compromising on quality or community commitments.

“[It] required great sacrifice by not only myself and my business partner, Ron Devers, but also by our friends and family,” she remarked.

Price referred to sacrificing short-term gains for long-term stability, particularly through reinvestment, as a “critical decision” that has been “invaluable.”

Empowering Others

A military veteran, Wayne Brown has served in numerous capacities within the community and local nonprofit circles – from leadership with the Avenue Scholars Foundation to the Omaha Community Foundation. Brown was vice president of programs, tasked with managing education, youth development, employment, and career services programming.

“While I’m honored by several achievements throughout my career, my proudest accomplishment undoubtedly lies in witnessing the growth and success of future leaders,” he said. “This encompasses the students and families I’ve been privileged to serve, but seeing young leaders blossom under my care and guidance holds a particularly special place in my heart.”

Nicka Johnson gets great satisfaction from having a positive impact on thousands of lives worldwide in her role as the CEO of Budget for Success (BTS) and by transforming individuals’ relationships with money. To date, her clients have collectively saved $4 million and counting.

“This achievement is a testament to the effectiveness of our financial literacy programs and the dedication of our team,” she said.

Giving individuals the tools to make informed and responsible financial decisions can have positive influences on livelihood and economic development.

“Empowered individuals are better positioned to make sound financial choices, positively impacting the economic landscape at both individual and societal levels,” Johnson said.

BTS is also actively addressing disparities in financial knowledge and access to resources.

Johnson spoke to the personal and professional challenges of navigating life as a Black leader, noting “There are times when it feels lonely.”

“I hold onto my identity because I know my impact extends beyond myself,” she said. “I’m not just transforming my community. I’m influencing the world by emphasizing the importance of financial literacy.”

As a leader, Johnson has navigated unfamiliar territories where there are few people of color in C-suite roles and readily available mentors, which makes handling specific situations daunting.

“While I may not always have the perfect answer, my approach involves relying on prayer, journaling, and allowing my ethics and integrity to consistently guide me in making sound decisions, both internally and externally within my business infrastructure,” she stated.

Leveraging Resources

Dell Nared, Jr., chief inclusion, diversity, equity, and belonging officer, spearheads the Greater Omaha Chamber’s comprehensive CODE (Commitment to Opportunity, Diversity & Equity) program.

“This program has provided extensive education and networking opportunities to over 3,100 individuals, impacting 452 businesses and organizations in the Greater Omaha area,” Nared said.

Among its most successful programs, the Growing Home Program and Career Development Week have supported historically marginalized scholars in their college transitions.

“These initiatives represent tangible progress in fostering diversity, equity, and inclusion in our community,” Nared said.

But the implementation of diversity, equity and inclusion (DEI) initiatives as a leader in an organization is no small feat as existing structures and cultures can create obstacles.

“It is important to strike a balance between the need to bring about systemic change and the need to work within the existing structures,” he said.

Nared referenced a multi-faceted approach of partnering with DEI practitioners, leveraging data-driven insights (from initiatives like the CODE Assessment), fostering open dialogue and collaboration, and continuous learning and adaptation to best practices.

Lighting the path

Bell credited organizations like 100 Black Men of Omaha, Empowerment Network, Greater Omaha Chamber and the Aksarben Foundation as “greatly beneficial” to his career.

“Even if you feel out of place or you haven’t reached a certain level, just continue to keep showing up, be yourself and be present,” he urged. “Show up and ask yourself, ‘What lessons can I learn from today’s interactions?’ Stack the lessons on top of each other and you will begin to get more and more comfortable in your skin.”

Price said to embrace every opportunity to learn and network.

“Understand that challenges are not setbacks, but stepping stones

to greater achievements,” she said. “Most importantly, believe in your unique value and contributions to your industry and community.

“Do not be afraid to be vulnerable or to admit when you need help. You may just be surprised who shows up and where you may end up adding value in return.”

Brown noted that experiences can offer a unique perspective on the world.

“Leverage that unique perspective to offer fresh insights and solutions, and I believe that diversity of thought is crucial for progress,” he explained. “It’s not about being special, but contributing something valuable others might not have considered.”

Johnson offered advice to those experiencing imposter syndrome.

“You’re not underqualified or overqualified; you’re exactly where you’re meant to be,” she said. “The job and position are rightfully yours. So stop questioning and wondering ‘Why me?’ and start affirming ‘Why not me?’ Give yourself credit for the silent battles and storms you’ve faced, even if no one else knows.

Nared has found considerable value in meetings of The Circle, a network of DEI area practitioners and professionals who understand the unique challenges and opportunities and provide guidance, support, and encouragement.

He suggested recognizing growth and development as “iterative processes.”

“Seek out mentors, leverage resources and networks, and embrace the journey of continuous learning and improvement,” he said. “Remember that your unique perspective and experiences are valuable contributions to the spaces you inhabit. Trust in your abilities and stay resilient in the face of challenges.”
