As building and housing costs continue to rise, city and state government agencies are looking to find unique ways to help close the gap.

In compliance with Nebraska bill LB866 – also known as the Municipal Density and Missing Middle Housing Act – the city of Omaha hired RDG Planning and Design to analyze data and engage with the community to create the Housing Affordability Action Plan (HAAP), released in late September.

“This is a broad and complex issue. There will be no one single solution to it,” said Amy Haase, the principal at RDG tasked with leading the study and developing a strategy.

“This is a starting point where we can build momentum and continue to find new and innovative ways to address housing challenges.”

Zoning Challenges

Arguably one of the biggest challenges for the city is zoning.

Currently, 80% of residential zoning in Omaha is set aside for singlefamily lots, which excludes housing options such as townhouses, duplexes, cottages, and small family apartments.

The gap left by these restrictions has been nationally dubbed as the “missing middle,” and is a roadblock to creating diverse, healthy neighborhoods.

To demonstrate what a diverse neighborhood looks like – one that has a variety of housing options – Haase singled out the Dundee Neighborhood. She noted that if you were to drive around Dundee, you’d see plenty of single-family homes, but you’d also see singlefamily homes that have been retrofitted into small, multifamily homes.

“But, scale-wise, it fits with that single-family home that’s sitting next to it,” she said.

Another example is Seventy Five North Revitalization Corporation’s Highlander development. With the help of the state and city, SeventyFive North broke ground on the first phase of its development in 2015 and has since developed hundreds of homes, ranging from townhomes, rowhomes, duplexes, small apartment complexes, and soon, single

During its research, RDG confirmed that 67% of residents surveyed are interested in missing-middle housing options, like the ones Seventy Five North has been developing. But the zoning restrictions pose hurdles not easily cleared due to time constraints and finances.

RDG responded to this finding by suggesting five separate rezoning options that would open the doors for a variety of housing options in one to three years.

Missing Middle Cheat Sheet

While demand for a variety of homes is high, the report noted that there are few contractors or developers building these products.

“Omaha market and developers noted two main concerns. The first being hurdles to how these projects are financed. Second was uncertainty in the marketability of mixed-income projects to the broader public,” it said.

To that end, the HAAP suggests that the city partner with a developer to create a project that demonstrates how affordable housing projects can be successful.

The plan also suggests the creation of a “housing pattern book” that could solve two major issues: unfamiliarity with missing middle options and long wait times for city approval on projects.

The book would help developers understand missing middle options by providing specific, visual examples that showcase dimensions, zoning information, and financing information. And, because it would be created by the city, these examples could showcase pre-approved options, which could speed up project approvals.

Pre-approved options could also utilize modular construction, which could decrease build time, but Omaha currently lacks those types of manufacturing businesses.

Showcasing Infill Options

With much of Omaha zoned for single-home residences, Omaha by Design decided to spearhead an initiative to guide potential

developers considering building single-family homes; Specifically in older neighborhoods in southeast Omaha near its urban core where infill is needed.

With the help of community partners Seventy Five North, Alley Poyner Macchietto Architecture, Morrisey Engineering, Assistology, Blair Freeman, and B-Strategies, the Affordable by Design Housing Playbook was launched.

In the introduction, Omaha by Design Executive Director Scott Dobbe described the Playbook as “an open-source set of housing prototypes” to show homeowners and small developers what’s possible in the narrow lots that are common in older neighborhoods.

“What we’ve already done is a lot of the expensive, challenging work,” Dobbe said. “In a way, rather than [potential developers/ homeowners] getting the ball at the five-yard line, we’ve teed it up for them, and they’re already at midfield.”

The team paid special attention to universal design and energy efficiency to extend the life cycle of homes.

Nationwide, the playbook noted, fewer than 5% of living units are livable for individuals with moderate mobility issues, and less than 1% is

available for those with wheelchairs.

Through discussions with local company Assistology, the team began to understand the wider scope of universal design, from those who have lifelong mobility challenges to temporary challenges to aging in place and growing families.

“Universal design recognizes that there’s a broad category of issues anyone may encounter,” Dobbe said.

Recognizing the cost of homeownership, both environmentally and fiscally, it enlisted Morrissey Engineering to help uncover practices that could offset cost upfront and/or long-term costs. For example: how building orientation can affect heat gain to minimize summer/fall energy consumption, while maximizing gain during the colder months, reducing furnace use.

Guided by what’s needed now, and what may be needed in the future, the group created four base designs – The Burdette, The Parker, The Patrick and The Blondo – that could then be paired with a variety of floor plans, features, and interior/exterior materials. Each floor plan is designed to be 100% accessible on the main level.

“That should be the baseline standard,” Dobbe said.

Seventy Five North will begin construction in 2023 on six single-family homes in its Highlander neighborhood that follow designs in the Playbook. The Playbook is available online.

State Initiatives

A lack of affordable housing is not strictly a Greater Omaha area problem; therefore, Nebraska receives financial aid from the U.S. government to help finance research and projects.

The Nebraska Investment Finance Authority (NIFA) acts as the mediary between the U.S. government and all the communities in Nebraska, providing direction as well as distributing funds through programs.

Programs include the Nebraska Affordable Housing Tax Credit Act (AHTC), the Multifamily Tax-Exempt Bond Program, the Collaborative Resource Allocation for Nebraska (CRANE) program, and the LowIncome Housing Tax Credit (LIHTC) program – one of the biggest funding sources for affordable housing projects.

In 2021 alone, NIFA helped finance 20 affordable rental projects to the tune of $193.3 million, which included 294 units for those with special needs, 397 units for the elderly, and 259 units for families.

One of the most visible projects to receive LIHTC funding is Seventy-Five North’s Highlander Neighborhood. NIFA Executive Director Shannon Harner lauded the variety of housing offered as forward thinking.

“You want to stabilize people and provide them places to live, but you also want to help them grow towards the ability to become homeowners,” she said. “That’s what creates long-term and generational wealth.”

In August 2022 her organization embarked on developing a Statewide Strategic Housing Framework.

“We’re calling it a framework as opposed to a plan because it needs to be flexible,” Harner said.

Research is being facilitated by Colorado-based Wellstone Collaborative Strategies in collaboration with a council of Nebraskabased leaders in the housing sector, ranging from nonprofits to government entities. The process is expected to be finalized at the end of the year.

After soaring to all-time peaks in 2021, the global mergers and acquisitions market has seen a decrease of 12%.

“Although M&As have decreased from the previous year due to uncertainty, they’re in line with healthy, pre-pandemic levels,” said Koley Jessen Attorney Eric Oxley. “Geopolitical instability, spiking inflation, supply chain issues, skittish capital markets, regulatory changes and more are fueling uncertainty.”

Private equity deals continue to be a key driver to the growth in the United States. M&A represented $1.2 trillion of U.S. deal value in 2021. This trend is expected to continue as private equity funds raised a record $733 billion in 2021.

According to Jeff Herdzina, founder and president of ExitBig, M&As are increasing for three reasons.

sell their businesses. Second, the COVID19 pandemic — an unexpected event — affected the mindset of many business owners. Third, more information about M&A is available than in the past.

“I think a lot more professionals — CPAs, bankers, attorneys — are learning about M&A and educating their clients, so there’s a lot more talk about M&A than there was five or 10 years ago,” Herdzina said.

Why Merge?

In the world of M&A, there are two types of mergers. A horizontal merger grows a company by acquiring another company in the same industry, such as a trucking firm buying another trucking firm.

A vertical merger is when a company acquires another firm that operates in a different level of its supply chain, such as an automaker acquiring an electrical widget

manufacturer.

“You’re likely to see the most M&A in the health care, technology, financial services and retail sectors,” said Maurice Johnson, senior counsel at Goosmann Law. “Usually it’s where small to medium-sized firms are trying to compete in the marketplace with a number of behemoths.”

In terms of financing, it’s harder to start a business from scratch than it is to acquire an existing business.

“If you go to a bank and ask what kind of financing you can get, you’ll most likely be able to finance it if the business is making money,” Herdzina said. “Bankers don’t get very excited about startups. They’ll do a loan on a personal guarantee and basically look at your personal financial strength, but [startups] are not as financeable. It also takes a lot longer to get a startup up and going.”

Buyers are looking to target companies

that capitalize on economies of scale, increase market share or diversification, benefit from revenue synergies or increase their product/service offering, according to Mark Otte, M&A manager at Lutz.

“Over the last few years, I think small to medium-sized companies have become more aware of M&A opportunities as a solution for their business succession,” he said. “When the economy began to recover from COVID-19 and buyers became more aggressive in 2021, companies that initially were not looking to be acquired reconsidered their options due to recent strong valuation multiples for highperforming businesses.”

In a typical M&A cycle, deal volumes and values first decrease along with a downturn in the economy, which is frequently caused by an external event.

investors reevaluate their portfolios and investment plans, the desire to acquire increases as more people start to sell,” Oxley said. “Lower valuations for targets during the cycle improve the chances for acquirers to see higher returns.”

The technology, media, and telecommunications sector has outperformed other industries, accounting for 30% of total deal value, lagging behind 2021’s 32% but nearly matching its 2020 performance of 31%.

The next two largest sectors in M&A sectors are real estate at 13% and industrials at 11%.

“At Lutz, our typical clients are in the lower to middle market, with industries spanning from manufacturing & distribution to software and professional services,” Otte said. “There has continued to be strong demand from buyers in these industries for high-performing sellers that have properly positioned

themselves to be an acquisition target.”

Preparing for Success

A lack of management depth is one of the main operational issues Lutz sees in transactions.

“Buyers will become less interested if the selling owners are overly involved in the day-to-day operations or if they have too much influence over customer/vendor relationships,” Otte said. “Sometimes in this situation, the buyer will make a portion of the sale price contingent on the owner staying in the business for a period of time.”

A related issue is when the existing management team members are close to retirement, and replacements have not been trained or hired. Addressing these issues with the management team well in advance is important to a successful transaction.

“A business owner will spend 30 or more years working on a business, and selling it

is so important to many of their retirement goals,” Herdzina said. “The No. 1 thing they should do when preparing for an M&A is to get the professionals involved — their CPA, banker, attorney and an M&A professional.”

The firm should clean up its finances.

“Many smaller businesses run lots of their personal expenses through the company,” Herdzina said. “I recommend not doing that for a minimum of three years.

That will get the seller the best number. It will be easier to sort through the finances.”

Document processes so that the business doesn’t hit a speed bump if an employee who has all of the information about running a division leaves. A new hire could come in, read the process document, and be brought up to speed.

“Talk to an M&A adviser,” Herdzina said. “It

doesn’t mean you have to sell your business; it’s just information. Most sellers I talk to for the first time don’t really know how the process works. Having that information available for them so they can make a good decision is key.”

Hire experienced financial and legal experts to plan for and facilitate the transaction. The legal team should include not only seasoned M&A attorneys but also experts in appropriate specialty areas such as tax, compensation and benefits, employee matters, real estate, intellectual property,

data privacy and litigation.

“Insist on a nondisclosure agreement,” Johnson said. “Sign that when talking with a potential acquirer. Also, attempt to incorporate an employee non-solicitation provision.”

An investment banker can be helpful in finding buyers and acting as an intermediary. Have an M&A counsel hired by the selling company.

“The CEO should not negotiate the terms,” Johnson said. “He or she might have a conflict, so usually you might want to have

a committee of the board. Then you want to have a letter of intent that kind of locks up the deal while you’re negotiating things and gets some of the niceties out of the way with regard for warranties, indemnifications, provisions [and other things].”

Make sure you have complete files of your contracts, corporate records and stock options information. You might want to set up an online data room where potential buyers can see all those documents.

Prepare a disclosure schedule that

discloses the key contracts, equity holders, options litigations and intellectual property.

“[The disclosure schedule is] difficult and time-consuming to prepare and sometimes that can delay things, but it can prevent a lot of problems down the line,” Johnson said. “If you have any leases or any key contracts that are not assignable, you’ll have to negotiate with that lease-holder — for instance, if you’re getting ready to turn over the lease on your building.”

projections as to what they’re saying and what is true. There are also employee issues. For instance, what is their plan for retention and motivation of employees? How will they deal with stock options and will they need to carve out some pay to the employees after closing?

“Some of the contentious deal terms might be what’s the amount of escrow you’ll agree to, conditions to closing, adjustments to price, negotiating the representations and warranties of the buyer and seller and just keeping your eye on the ball while you’re trying to run the company at the same time,” Johnson said. “It can be kind of distracting.”

Some deals can take over a year if the initial buyer backs out and the sale process needs to be restarted. One of the benefits of running a full competitive sales process is that all potential buyers are kept on a timeline. If the selected buyer backs out,

other buyers who made strong offers can be re-approached.

“If a target company decides to only explore selling to one buyer, there is a risk the buyer can back out, and the sale process would be delayed if they choose to go-to market again,” Otte said.

Smaller M&A deals will typically take one to three months, although most deals range from three to six months, but can take up to 12 months. Larger deals could take up to two years or more.

“Some factors that determine the length of time for an M&A deal include whether the deal is part of an auction process or a single buyer deal, the buyer’s diligence process, the type of business, the location of the business, the structure/organization of the deal, and the amount of time it takes to respond to requests,” Oxley said.

Interest Rate Impact

Because of the Fed’s recent interest rate increases, servicing debt on buying a business is more expensive today than it was a year or two ago, according to Herdzina.

“I believe that high interest rates are going to drive prices down,” he said.

Because interest rates make everything

more expensive, the buyer can’t pay as much for the business, and with more businesses up for sale, it is a seller’s market.

“As more supply of businesses come online, buyers will have more options, therefore driving prices down,” Herdzina said. “If you’re thinking about selling your business, there may not be a better time than right now.”

The pandemic, skyrocketing fuel prices, and a lack of pilots and airline mechanics has thrown a big wrinkle in many people’s travel plans recently. These factors have added strain to the industry, negatively affecting airlines and travelers alike. Aviation schools and airports are working to attract and retain new aviation professionals to get things back on course.

The Numbers

Scott Vlasek, director of the Aviation Institute at the University of Nebraska at Omaha, noted that when looking at the numbers, it is hard to deny that there is a steep need for aviation professionals – not just now, but well into the future.

“According to data from Aero Crew News, on the airline side, if you look at the number of retirees between now and 2033 for United, Delta, American, and Southwest, it’s just over 25,000 pilots. You also need to consider these airlines’ growth over the next 10 years. Boeing projects that over the next two decades, there will be a need for 600,000 pilots, 610,000 maintenance technicians, and 899,000 cabin crew professionals,” he said.

“I have never seen anything like this in my 25 years at the Aviation Institute. If you look at this from a supply and demand perspective, it would be difficult to say there is not some shortage … the need for professional pilots at every level seems to be there.”

The Pandemic

At the onset of the pandemic, there were many pilots that were furloughed, some took early retirement packages, and others just simply decided to make a career change.

Schools and other pilot training programs were also shut down temporarily or had significant changes in how they operated, which set things back. When the demand for airline travel started to slowly increase again, airlines everywhere were grappling with increased numbers of travelers and fewer employees.

“As COVID took over globally, the airlines weren’t sure how long recovery would be,” said Dave Poole, vice president of business development at Oracle Aviation. “They started offering early retirement for those that were close but not quite there yet. So, when COVID rebounded, they were left in a lurch.”

Vlasek also said that the pandemic impacted the aircraft.

“During COVID, airlines parked a lot of aircraft,” he said. “It takes time to bring them back online and, in some cases, replace them with more fuel-efficient aircraft.”

Retirement

Another major factor – and one that airlines and aviation schools saw coming for quite some time – is the fact that many pilots were reaching the mandatory retirement age of 65. Many pilots were initially trained in the military during the

Vietnam era and then moved to commercial aviation for the rest of their careers.

Once they’ve reached their retirement age, they’re required to turn in their wings – no questions asked. The Federal Aviation Administration increased the retirement age from 60 to 65 in 2007. It’s possible the FAA could increase the age again, although that increase would only partially solve the problem.

“One issue with this is that the international mandatory retirement age is 65, meaning they could not fly overseas,” explained Vlasek. “This could certainly have some unintended consequences if it comes to fruition.”

The Impact on Nebraska

While we are feeling the effect of the pilot shortage nationwide and, arguably, worldwide, Nebraska has also seen some specific impacts as well.

“Look at how many flights the major and regional airlines have canceled, and how many routes from Nebraska airports have either been put on temporary hold or deleted, with no indication they will ever return,” said Jerome Howard, chief flight instructor at REVV Aviation. REVV Aviation is the flight training vendor for the UNO Omaha Aviation Institute.

“This has a direct effect on the economy and people’s lives. In 2018, the Aviation Workforce Alliance published a report on how pilot shortage impacts each state. By

the year 2026, the report indicated Nebraska could lose a significant number of jobs, which will affect the economic impact in the state, and so on. It is a domino effect.”

Vlasek noted the biggest impact on Nebraska has been the flight cancelations and delays over the past year.

“The reason for delays ranges from TSA and Air Traffic Control staffing issues to weather, to more people wanting to get away and go on vacation,” he said. “Yes, the pilot shortage has played into this as well.

“Central and western Nebraska cities that rely on Essential Air Service (EAS) may encounter the impact of this more than Omaha does. This does not mean that Omaha is immune to it. Some of the airlines that have provided EAS have gone out of business because they cannot find a pilot to fly their aircraft. Communities that have air service rely on it ... according to the Regional Airline Association, two airports have lost more than 25% of service in Nebraska.”

The Importance of Education

Howard said that one of the first steps for welcoming more aviation professionals into the industry is by educating them about the benefits of working in it.

“In lots of cases, it is a lack of interest, or not knowing that being a pilot is an option for a career,” he said. “A good majority of those in the collegiate environment are studying for traditional careers in medicine, engineering, law, etc. Being a

pilot isn’t a consideration for most people.”

Howard noted that REVV Aviation is doing its best to draw people into the industry, but it can be difficult with training being costly. However, salaries are increasing, and this is allowing for increased enrollment into aviation education programs.

“With sign-on and retention bonuses, the industry has made it very attractive to be a pilot,” he said.

At REVV, training includes private, instrument, commercial, multi-engine, instructor and airline transport pilot programs.

“Together with the university, we work to train and prepare prospective pilots for a career as a professional pilot,” he said. “Once our students have the necessary ratings and certificates, they can work as an instructor here to gain the hours airlines require before they hire a

prospective candidate.

“Education is a huge component in the industry. We have seven flight schools throughout the Midwest region, and we’re connecting with colleges in each of those locations to set up a similar partnership like we have with the University of Nebraska at Omaha.”

Poole noted that the amount of time that it takes for pilots to train is significant, with the typical airline

requiring about 1,500 hours of flight time before hiring. That requires patience and an understanding that the shortage may be something that we’ll deal with for a while.

“Whether you want to fly for a living or be in maintenance, it’s an incredible time to get into this industry,” Poole said. “An aviation student could literally go anywhere in the world. It’s a great time to get involved and get passionate about it.”

ANGELA LENNON BUILDS ACCESS AT KOENIG DUNNE

Growing up in South Dakota, Angela Lennon set her mind to go into a career in law at a young age.

“I always knew that I wanted to go into law,” she said. “I remember even in second grade, when they would ask you what you wanted to be, my mom would tell me later that I had always said that I wanted to be a lawyer. I just knew I wanted to do something big, and I knew attorneys in the community held important positions where they had access to make decisions and help people.”

Receptionist to Partner

In college, Lennon racked up impressive credentials, including graduating magna cum laude from both Vassar College in New York and Creighton University School of Law, and a clerkship in the Douglas County Attorney’s domestic violence unit. But it was a foot in the door that would eventually spark the professional success that was soon to follow.

“I was a receptionist at Koenig Dunne before I went to law school, so I had some exposure to a smaller private practice with a law firm owned and run by women helping people,” she said. “In law school, I wasn’t quite sure where I’d land, but I knew I wanted to be working directly with people and not more transactional work. I’d built really strong relationships with the folks at Koenig Dunne and went back and clerked there my second year and never left again.”

Now an equity partner and chief operations officer, Lennon is a respected voice in the legal community, especially for her work to bring expert family legal services to those of limited means. She designed and implemented Untie Online in 2019, an online option for individuals whose financial situation would otherwise require them to represent themselves.

“Many people contact us asking for support to meet with a lawyer, but they simply can’t

afford it,” she said. “For years, we would refer them to other associations, but those folks are completely overwhelmed, and they can’t help everybody. That’s really what got our wheels turning about something we can do to help provide access to justice to these people who need a lawyer.

“In Nebraska, we are the first and still the only Nebraska law firm to offer an online limitedscope divorce. Something like Untie Nebraska is also quite rare nationally; it’s definitely on the leading-edge, cutting path of innovation.”

Charting the Future

Two years in development, Lennon said Untie Online will continue to play a big role in the company going forward.

“I think [the pandemic] helped push Untie Online further than it initially would have gone,” she said. “Before, that just wasn’t traditionally how the legal profession operated. I think we’ve revolutionized a way of accessing legal services.”

With Untie Online continuing to grow, Lennon remains at the forefront of business development, charting Koenig Dunn’s course for the future, both in the courtroom and in the community.

“Our collective firm’s goals in 2022 are to really peel back the layers of what happens in a divorce process and really look at the client support aspect,” she said. “I think the other piece is continuing our law firm’s culture focused on community endeavors and advancing social justice. Besides the reward of getting to work with an amazing, brilliant team, that’s something I appreciate most in this role.”

While many may think agriculture is the top industry in Iowa, that is not the case. Agriculture and associated biosciences are certainly critical to the Iowa economy, but advanced manufacturing is the state’s top industry. It represents seventeen percent of Iowa’s gross state product, making Iowa ninth nationally in percentage of gross state product from the manufacturing sector.

With October being Manufacturing Month, it is fitting the Council Bluffs Area Chamber of Commerce is celebrating the major contributions of Council Bluffs and southwest Iowa manufacturers.

In Pottawattamie County, there are 1,958 manufacturers accounting for 31,473 jobs, $1.3 billion in annual wages, and $1.328 billion in annual taxable sales. They compose 11.5% of the county GDP and pay $54,609,092 in county taxes and fees alone*. These figures speak to the significant impact local manufacturers are having on the community and why supporting them and ensuring they have everything they need to succeed is so important.

Not only do manufacturers contribute handedly economically to the community, but their team members are also key board members and volunteers, offer critical insight and expertise on key issues, invest sizable in community betterment and local projects that align with their mission, and maintain sizable amounts of property throughout the community. Without the taxes and fees they and other large employers pay, communities would not be able to invest in themselves and prosper in the manner they do.

Council Bluffs and southwest Iowa are a natural location for manufacturers supplying goods worldwide. We are well-positioned to globally distribute locally manufactured goods, possessing a strong transportation network with easy access to air, water, rail, and highway infrastructure. In addition, local education and job training efforts, in collaboration with our community school districts and Iowa Western Community College, ensure we can continually grow a workforce pipeline to fill the innovative, technical jobs local manufacturers require. We are also part of the largest metropolitan statistical area in the state of Iowa, so while attracting and retaining talent is still a challenge, we have a much larger laborshed to draw from.

Manufacturing 4.0 is an initiative of the Iowa Economic Development Authority (IEDA) that supports manufacturers’ abilities to incorporate advancing technologies and ensures businesses of all sizes continue to remain competitive in the global economy. After recognizing the critical need to support our local manufacturers in Iowa, Iowa’s Manufacturing 4.0 initiative began in 2020. Manufacturing 4.0 refers to the utilization of technologies that fully automate processes for decision-making across a full product lifecycle. It challenges the industry to adopt innovative technologies to increase productivity, compete for talent, and encourage ongoing globalization.

As the state’s largest industry, advanced manufacturing generates

assistance programs, such as tax increment financing and job training programs administered by Iowa Western Community College, make Council Bluffs, Pottawattamie County, and southwest Iowa an extremely attractive location for manufacturers.

In Pottawattamie County, over 10% of the workforce is employed in the manufacturing sector. “The Council Bluffs Area Chamber of Commerce and Advance Southwest Iowa Corporation work with city, county, and state representatives to retain and advance our manufacturing industries,” says Drew Kamp, president and CEO of the Council Bluffs Area Chamber of Commerce. “Iowa continues to target the manufacturing sector because of its significant economic impact.”

Casey Putney serves as the VP of Leadership Development with the Business Ethics Alliance. He oversees the ethics programming for the Alliance and delivers values-based leadership development solutions for leaders and organizations across the metro. But Putney’s journey to the Alliance and the study of leadership hasn’t been a traditional one.

Putney joined the military at the age of 22, having started and stopped college multiple times. “I was lost,” Putney said. “I had no idea what I wanted to do with my life.” Prior to joining the military, he struggled to identify a purpose, and operated from a value system focused on answering his personal needs with no attention on how others were impacted. He knew however, that he wasn’t living to his potential, and needed to change. “I entered military service with a strong desire to reinvent myself. And meeting Rick Rigsby was exactly what I needed,” Putney said.

Rigsby was Putney’s first supervisor in the military. In delivering Putney’s first performance feedback, he wrote, “he’s a leader among his peers.” But Putney struggled with that definition. He had no real understanding of what being a leader meant. Confused, he went to Rigsby and asked for clarity.

“He gave the greatest gift he could’ve given me,” Putney said. “He refused to provide an answer.” Instead, Rigsby encouraged Putney to seek out answers for himself. The two would meet regularly and discuss articles and books Putney was reading. Rigsby gave Putney time. He listened to ideas, and thoughts. Together the two would watch how leaders communicated with their teams and how they handled challenge. They would then gather and talk through what they had seen and how certain behaviors and communication styles impacted team performance. “He sent me on a leadership journey,” Putney explained. “The journey’s lasted well over 25 years and continues to this day. Along the way, I’ve led teams in federal and state government. I’ve developed leaders at a local and global

TEXT: FOR AN ACT relating to the Wage and Hour Act; to amend sections 481203, Revised Statutes Cumulative Supplement, 2020; to change the minimum wage as prescribed; and to repeal the original section.

Be it enacted by the people of the State of Nebraska,

Section 1. Section 481203, Revised Statutes Cumulative Supplement, 2020, is amended to read: 48-1203 (1) Except as

otherwise provided in this section and section 481203.01, every employer shall pay to each of his or her employees a minimum wage of:

(a) Seven dollars and twenty-five cents per hour through December 31, 2014;

(b) Eight dollars per hour on and after January 1, 2015, through December 31, 2015; and

(c) (a) Nine dollars per hour on and after January 1, 2016. through December 31, 2022;

(b) Ten dollars and fifty cents per hour on and after January 1, 2023 through December 31, 2023;

(c) Twelve dollars per hour on and after January 1, 2024, through December 31, 2024;

(d) Thirteen dollars and fifty cents per hour on and after January 1, 2025, through December 31, 2025; and

(e) Fifteen dollars per hour on and after January 1, 2026, through December 31, 2026.

(2) The minimum wage established in subdivision (1)(e) of this section shall be increased on January 1, 2027, and on January 1 of successive years, by the increase in the cost of living. The increase in the cost of living shall be measured by the percentage increase, if any, as of August of the previous year over the level as of August of the year preceding that year in the consumer price index for all urban consumers (CPI-U) for the Midwest Region, or its successor index, as published by the U.S. Department of Labor, or its successor agency, with the amount of the minimum wage increase rounded up to the nearest

multiple of five cents. No later than October 15 of each year, commencing October 15, 2026, the Nebraska Department of Labor shall calculate and publish the minimum wage rate that will take effect the following January 1.

(3) For persons compensated by way of gratuities such as waitresses, waiters, hotel bellhops, porters, and shoeshine persons, the employer shall pay wages at the minimum rate of two dollars and thirteen cents per hour, plus all gratuities given to them for services rendered.

The sum of wages and gratuities received by each person compensated by way of gratuities shall equal or exceed the applicable minimum wage rate provided in subsection (1) or (2) of this section.

In determining whether or not the individual is compensated by way of gratuities, the burden of proof shall be upon the employer.

(4) Any employer employing student-learners as part of a bona fide vocational training program shall pay such student-learners’ wages at a rate of at least seventy-five percent of the minimum wage rate which would otherwise be applicable.

Section 2. Original section 48-1203, Revised Statutes Cumulative Supplement, 2020, is repealed.
