Session on Estate Planning

The Madras Chamber under the auspices of the Legal Affairs commi�ee jointly with Deloi�e organized the Virtual Session on “Estate Planning” on 6th January 2021 We had the Session on Family Enterprise Con�nuity in the month of December 2020 and this was the second part of the earlier Series. Ms K.Saraswathi, Secretary General gave the welcome address. Ms. Savitha Kesav Jagadeesan, Co Chairman, MCCI Legal Affairs Commi�ee introduced the speakers for the session. She informed it is a very crucial topic in the current scenario and the subject ma�er experts from Deloi�e will help us to understand the nuances. Mr Vijay K. Dhingra, Partner ,Deloi�e Haskins & Sells LLP & Mr. Chandraprakash,Partner, Deloi�e Haskins & Sells LLP handled the session. They made a detailed presenta�on on Estate Planning. Session also covered on the topics like Transmission of assets under a will, Trust as mode of transmission, overview of estate duty legisla�on , applicable laws among others. There were more than 33 par�cipants who took part in the webinar and the feedback was posi�ve.

Workshop on Incoterms 2020 to Academy of Mari�me Educa�on and Training (AMET University)

The Chamber under the auspices of Logis�cs and Educa�onal Commi�ee organized the workshop on “Inco terms 2020” to students of Academy of Mari�me Educa�on and Training. (Amet University) for the students of MBA and BBA Stream in 2 batches. The objec�ve of the session was to acquaint the students with the Incoterms 2020 and to update the latest changes. Mr. J.Krishnan, Partner, S. Natesa Iyer and Co. who has more than 3 decades of experience in the logis�cs sector deal with the subject in detail . The program was well a�ended by more than 50 students in each batch and the feedback was posi�ve.

Arbitra�on 5th Series on Independence and Impar�ality of Arbitrators

Under the auspices of the MCCI Arbitra�on, Media�on and Concilia�on Centre (MAMC) the Chamber organized the Fi�h Arbitra�on web series on the

topic "Independence and

Impar�ality of Arbitrators on Thursday, 7th January 2021 between 6 pm and 7 pm. Mr. Anirudh Wadhwa, Partner, Wadhwa Chambers, New Delhi, addressed the session. Ms Madhumathi.C, Registrar of Arbitra�on Centre gave a brief introduc�on about the Chamber and the Arbitra�on Centre and introduced the speaker. Mr. Anirudh Wadhwa made a detailed presenta�on covering Independence and Impar�ality of Arbitrators and the recent developments in the area star�ng from the 246th Law Commission of India report as well as the amendments made in 2015 to the Arbitra�on and Concilia�on Act, 1996, and the subsequent judicial pronouncements in respect thereof. He stated despite all the efforts the Act s�ll requires effec�ve measures and changes to encourage and facilitate a reformed & more independent system of fair & unbiased dispute resolu�on in the interest of jus�ce and basic fairness for India to become a hub of Interna�onal Commercial Arbitra�on. In the Q & A session queries of the par�cipants were clarified by Mr. Anirudh Wadhwa. Ms. K.Saraswathi, Secretary General, proposed the vote of thanks. There were more than 27 par�cipants who took part in the webinar and the feedback was posi�ve.

Session on CBIC’s Quarterly Return filing and Monthly Payment of Taxes (QRMP) Scheme

The Madras Chamber of Commerce and Industry Jointly with Directorate of Taxpayer Services organised the Session on “CBIC’s Quarterly Return filing and Monthly Payment of Taxes (QRMP) Scheme”. It was an outreach session organised to understand the recent changes happening in GST tax filing. Ms . K.Saraswathi gave the welcome remarks. Mr. K.Vaitheeswaran Chairman, GST Commi�ee set the context for the session. He apprised that the idea of QRMP is brilliant and lot of thought process has been done within and outside the government to change and to liberalize the GST system.

Shri. P. Ram Mohan, Joint Director, DGTPS, Chennai Zonal Unit gave the overview of Quarterly Return filing and Monthly Payment of Taxes scheme nuances and introduced the speakers Shri.S.V.Murugan Mourugaram, Joint Commissioner, Puducherry GST Commissionerate and Shri.R. Srivatsan, Addi�onal Assistant Director, NACIN. Shri.R. Srivatsan, Addi�onal Assistant Director, NACIN made a detailed presenta�on on the QRMP scheme and clarified the issue raised by Mr. K.Vaitheeswaran . In the Q & A session queries of the par�cipants were jointly clarified by Shri.R. Srivatsan & Shri.S.V.Murugan Mourugaram. Mr. R. Gopakumar, Co Chairman, GST Commi�ee proposed the vote of thanks. There were more than 47 par�cipants who took part in the webinar and the feedback was posi�ve.

Presenta�on on Occupa�onal Health Safety and Working Condi�ons Code (Rules) 2020

Under the auspices of HR& IR Commi�ee, a presenta�on on “Occupa�onal Health Safety and Working Condi�ons Code (Rules) 2020” was organized on 20th January 2021. Mr. Anand Gopalan, Co-Chair of the Commi�ee led the discussion on OSH and Working condi�on rules 2020. He apprised the members that OSH code includes the Factories Act, but the implementa�on under factories act has normally been with State Government which frames the rules. There will be State rule under the OSH primarily applicable to Factories Act. OSH is not restricted to factories Act and is much wider applicable to other establishments. He highlighted the changes and explained the provisions in detail for the benefit of the members. Mr Anand Gopalan informed the members that the State Government would come up with its rules with more clarity for necessary implementa�on. A few queries which were raised were clarified by Mr. Anand Gopalan. We had 38 par�cipants who took part in this interac�ve mee�ng.

Virtual inaugura�on of MCCI Arbitra�on Media�on and Concilia�on Centre (MAMC)

The Chamber set up an exclusive Arbitra�on, Media�on and Concilia�on Centre with the state of the art facili�es. This was formally inaugurated virtually on 25th January 2021. Mr Srivats Ram, President MCCI & Chairman MAMC gave the welcome address. He briefed about MCCI ac�vi�es and gave an overview of MCCI Arbitra�on Media�on and Concilia�on Centre. Mr.Anand Gopalan, Chairman, MCCI Legal Affairs Commi�ee gave the MAMC introductory note He apprised about the MCCI arbitra�on ac�vi�es. He informed though we have established two decades back, with Ins�tu�onal arbitra�on gaining importance, based on the request of the members, an exclusive MAMC has been set up with the Governing Council to provide guidance. A walk through of the facili�es was shown to the par�cipants. Jus�ce Mr Sanjay K Kaul, Judge, Supreme Court of India, virtually inaugurated the centre’s new premises. He apprised that both media�on and arbitra�on are excellent modes of dispute resolu�on. They will ease the system of the main legal system and provide an excellent opportunity in a methodology to resolve disputes. Commercial disputes are best resolved in a more informal environment,” he said. Jus�ce called for sanity in the process of appointment of arbitrators and said the process should not end in a lose-lose situa�on. He added that the Chamber should u�lise the state-of-the-art facili�es in the best possible manner. We had more than 100 par�cipants who took part in this virtual inaugural.
