Israeli Prime Minister Benjamin Netanyahu has declared war, countering with strikes on Hamas targets in the Gaza Strip. Brad Waldow was half asleep when he first heard sirens outside of his apartment in

Ashkelon, Israel. It was around 6:30 a.m. Saturday, in the middle of the Jewish holy day of Shabbat. Waldow, a Ponderosa High School graduate and professional basketball player for Elitzur Ashkelon of the Israeli National League, was five days removed from the final game of preseason and enjoying some downtime with his wife Alicja and nearly 2-year-old son

Odin Rasco Staff writer Placerville residents will have access to heaps of free, highquality compost this Saturday as a result of a resolution approved by the City Council during its Sept. 26 meeting. A ribbon cutting ceremony for the new compost site located at 580 Truck St. will kick off the city’s new green program Saturday from 11 a.m. to 2 p.m. The event will include recycling, gardening and composting education, including education bags provided

to residents — along with free hot dogs and drinks. Visitors to the new location will also have the opportunity to scoop up 2 yards (1 truckload) of certified organic compost free of charge. The city’s compost distribution comes about as a way to meet green waste procurement thresholds set by California’s Senate Bill 1383 in 2016 and Assembly Bill 1985 in 2022. George Sheetz stands on the deck of his manufactured home on Fort Jim Road in Placerville. Sheetz is taking on the county in court after having to pay more than $23,000 in mitigation fees for the construction of the 1,854-square-foot structure on a 10-acre lot.

A Placerville man is challenging whether traffic impact fees he was required to pay for the construction of a home in Placerville were constitutional. The Supreme Court of the United States decided Sept. 29 to review the case that includes arguments from both El Dorado County and Placerville resident George Sheetz.

The case, which is expected to be argued in early 2024 followed by a decision in summer, is centered a building permit the former Pollock Pines resident applied for in 2016 to construct a 1,854-squarefoot manufactured home on his property. Sheetz bought 10 acres of land on Fort Jim Road with the objective of retiring from his business as a general engineer and spent $23,420 in road improvement fees

per county-adopted policy, according to court documents. Sheetz said those fees were related to school enrollment as well. “I felt like I got over charged. It’s ridiculous,” Sheetz told the Mountain Democrat. “What I paid is over and above the permit fees. Morgan Lee Tyler was born March 25, 1996 in Placerville CA., and was laid to rest August 26, 2023. Morgan was irresistible, he made you laugh and smile. He was a sweet, gentle soul. Always saying funny little comments that would make you feel good. He was loved by everyone who met him. He excelled at sports; karate, baseball, football and his favorite was soccer. He was a good teammate and a good sport. He was also lucky that he did get to travel a little as well. He saw the wonders of Africa and photographed amazing animals! He snorkeled and adventured under the sea in many awesome places, Bora Bora, Hawaii, Jamaica, and Turks and Caicos. He got to see the old countries, Italy and England, and laughed and smiled all the way through. He was a loving son, brother, nephew, uncle and friend. He will be missed. A memorial service will be held on October 21, 2023 at 1:00 pm, at 4700 Old French Town Road, Shingle Springs, CA. 95682

Merritt (Bud) Winn Earnshaw Jr

June 26, 1940 - August 11, 2023

Bud was born and raised in San Francisco. In 1958 to 1962 he served in the U.S. Air Force. Bud met his wife Jean while racing Austin Cooper’s in Alaska. They married in 1963, and moved to the Bay area. He worked 25 years for the Sheet Metal Workers Int. He played semi-pro soccer in Dublin and coached his U12 team to state champion in the early 1970s. In 1977 Bud moved the family to El Dorado County and helped his wife start Sierra Gold Soccer League. In the early 1990s he became a district 54 umpire. He is survived by his sister Mary Lynn Click. Both Bud and Jean are survived by their daughter Shonna Earnshaw and her kids Branden Earnshaw, Ryan McCreary, Breanna Brown and Kylie Gioia, son John and his wife Jeanne Earnshaw and kids Bryan and Jonathan Earnshaw, son Chris Earnshaw, and his son CJ Earnshaw. Please join us for their Celebration of Life Oct 19, 1pm at Green Valley Church.

January 17, 1940 - March 21, 2023

Jean was born in Stockton California. The family moved to Alaska in 1941. She graduated from Anchorage High School in 1959. From 1959-1963 she was a stewardess for Northern Consolidated Airlines. In 1962-1963 she was a member of the Alaska Sports Car Club winning several races in her Austin Cooper. This is where she met her husband, they were married in 1963. They moved to the Bay Area where they raised 3 kids. In 1977 the family moved to El Dorado County and brought the love of soccer with them. In the family home, she formed Sierra Gold Soccer League until 1985. She was also a board member to Timber Little League. She volunteered at Gold Oak School on the PTA Board from 1978 to 1983, and the El Dorado School Board Association from 1981 to 1983. In 1986 when her first grandchild was born, she stayed close to home to be involved. She is survived by her brother’s Glenn and Bruce Avila and sister Mary Avila.

David Neilsen

February 27, 1942 - September 13, 2023

David Neilsen was born in Placerville, CA and he lived and worked in El Dorado County most of his life. He was the middle child of Robert Neilsen and Clara Neilsen who were both descendants of early California pioneer families who settled in the area. After attending high school, college, and serving in the U.S. Army, he took the opportunity to become involved in working with his father who had a logging operation and eventually a saw mill. One of their major challenges came when it became illegal for a sawmill to burn its wood waste. They came up with a plan to turn that waste into a fertilized mulch and all the mills nearby paid them to take away their waste. Then they trucked the mulch to all the nurseries in the area and got paid again. When his father retired, David became the owner and operator of the company. David, like his father, could run any piece of heavy equipment as well as repair it. When David retired, he so enjoyed running equipment he would offer to come and help friends and neighbors with his little caterpillar just for the joy of it. No, fee was required (well maybe a piece of homemade pie)! David Neilsen was a past exalted Ruler Elks Lodge 1712 just like his father. He is survived by his daughter Natalie, grandson Xavior, and younger brother Steve. A memorial service will be held at Elks Lodge 1712, 3821 Quest Ct, Shingle Springs, October 29 at 1:00pm. In lieu of flowers, please donate to the Sugar Loaf Foundation or your favorite charity.

Jean Elizabeth Earnshaw (Williams)

Jean Ann Furbush, 87, died peacefully at her home in Placerville, California, on September 15, 2023. Born November 26, 1935, in Honolulu, the Territory of Hawaii to James and Bertha Durant Huey. Jean spent her childhood and teen years in Kahala on the island of Oahu, Hawaii. She graduated from Punahou High School, Class of 1954. The young graduate then crossed the Pacific to attend Hunter College in San Mateo, California, before returning to the islands for the holidays. While attending a dance for the Marine Corps stationed on Oahu, she met the love of her life, George F. Furbush Jr. After a whirlwind romance, the two became engaged and were married in May 1956. Jean and George quickly raised their family of four children, Gail Ann (Huston), Mary Lee (Kenyon), Paul James Furbush, Carol Jean (Runner). Over the years the family continued to blossom including 11 grandchildren, 20 great grandchildren, and one great-great grandchild. In 1990 Jean and George retired to Placerville, California, where they enjoyed many years of volunteer work and memberships in several community-based organizations. She was preceded in death by George who passed in 2004. Not a day went by that she didn’t miss him and wanted to be with him. On September 15, in her sleep, she peacefully took his hand and left us, just as she always prayed for. Mom was a devoted Wife, Mother, Grandmother and will be missed everyday by her family and friends. A private gathering will be held at a later date.

Robert Carroll Hendrix

Jan. 12, 1949 – Sept. 26, 2023

Robert Carroll Hendrix died peacefully at home with his family by his side on September 26, 2023. Robert (“Bob”) was born January 12, 1949, in Benton Arkansas. He and his nine siblings were raised in Arkansas by his mother, Mable. In 1966, Bob graduated from Benton Hight School, and in 1967 he joined the United States Air Force. From 1969 to 1970, Bob was assigned to the 633rd Consolidated Aircraft Maintenance Squadron, Pleiku Air Base, Vietnam. While stationed in Vietnam, Bob worked on the B-52 and KC 135 aircraft, and also serviced radar and communications systems. Bob received the Air Force Commendation Medal for his service and was honoroably discharged in 1971. Following his dischard, Bob worked on defense contracts at Avantek and later at Hewlett-Packard, helping build parts for planes, ships, helicopters, and the space shuttle. Bob also started his own licensed contracting business following his retirement from Hewlett-Packard. Bob loved southern fried food, golf, and his family. Bob is survived by his loving wife of 50 years, Susie Hendrix, his daughter Michelle, his daughter, Stacie, his daughter-in-law, Kristin, and his three grandchildren, Charlotte (“Charlie”), Miles and Cecilia. Bob will be laid to rest at the Sacramento Valley National Cemetery in Dixon, CA in a private ceremony.

Man killed in Green Valley Road crash Odin Rasco Staff writer A North Highlands man died in the hospital Tuesday morning following a late night singlevehicle incident in El Dorado Hills. California Highway Patrol officers were dispatched shortly before midnight Monday to the scene of a reported crash on Green Valley

Road east of Sophia Parkway. A 2015 MercedesBenz was discovered off the road with major damage, according to a CHP collision report. Investigation indicated the vehicle was traveling eastbound at a high rate of speed before making an unsafe turning movement and colliding into a wrought iron fence; the reason for the turning motion is unknown, according to CHP officials. The vehicle continued to move out

of control, heading down a steep embankment before colliding into another fence and other property on the 3000 block of Green Valley Road. The driver, Ahmad Noori, 23, was transported to Sutter Roseville Hospital and later succumbed to his injuries, the report shows. The investigation is ongoing, according to CHP officer Andrew Brown.

Another franchise battle in California

T

he California Legislature devoted much of its time this year to a battle over regulating wages and working conditions of fast food workers. Last year legislators and Gov. Gavin Newsom created a Dan Walters state agency that would oversee the fast food industry, which fought back with a referendum asking voters to overturn the new law, arguing that it would undermine the franchise business model. With the referendum qualified for the ballot, the battle was rejoined this year with a proposal to make parent companies liable for labor law violations, further eroding the This year, the franchise model. Almost half of El Dorado County is owned by the federal government, which I do not believe pays property taxes. Much of the county is public land. The Eldorado National Forest comprises a significant portion (approximately 43%) of the county’s land area, primarily on the Western Slope. The Lake Tahoe Basin Management Unit, formerly part of the Eldorado and two other national forests, manages much of the land east of the crest. The Pacific Crest Trail runs through the eastern part of the county, along or roughly paralleling the Sierra crest. These areas are governed by the federal government; however, El Dorado County is constantly cleaning up after lost or broken down vacationers, hunters, fisherman and off roaders. I’m all for vacationers, hunters and fisherman and off roaders, but I do not believe we are compensated justly for the manpower required to maintain the federal government’s half of the county. So counties with higher populations, more industry, agriculture and government centers don’t seem to be comparable. Maybe the USA should pitch in to our general fund. LINDA COLOMBO El Dorado

What has become of the Golden State? EDITOR: t was once a land of great opportunity. A glorious place of unsurpassed beauty, with spectacular coastlines and seashores, majestic forested mountains and the most fertile valley in between. The nation’s breadbasket with crops abounding. People came by the millions to enjoy the scenic beauty, the excellent weather, to make a living and call this land home. Industry, agriculture, natural resources and cutting-edge technology could all be found in abundance, jobs and careers were here. A place where dreams came true and the rest of the nation looked to for inspiration. Now our home is fast becoming a third world country, where the escalating cost of living and ever rising taxes have, in many cases, surpassed the ability to succeed. Regulations and restrictions have replaced common sense and reason. Bloated

bureaucracies and corrupt politicians waste our tax dollars by the millions or redirect them away from their intended uses to fund their own special projects, lining their pockets along the way. The current and previous progressive administrations in this state have given way to an ideology of screwball mentality, where constructive forward thinking has become a thing of the past. Where reality, morality and the American way of life are truly threatened. Law and order, justice and decorum have been replaced with a giveinto attitude to placate the despicable. Horrific crimes are often met with nothing more than a slap on the hand and the most vile are many times treated like celebrities. Where true heroes, like law enforcement, are now frequently perceived as villains. Wealthy Hollywood actors, political activists, environmental extremists with their flawed science and every other fringe group one can think of have seized control of the land we call home, moving ever further in the absolute wrong direction. The state can’t pass enough unfair and absurd new laws to regulate and control every aspect of our lives, while their own failed policies have stifled our rights, our freedom and bankrupted our future. Instead of the land of the free and the home of the brave, it’s now a sanctuary state where criminals are protected and decent, law-abiding citizens are considered, in the words of some Democratic leaders, deplorable. If this doesn’t spell tyranny, as Thomas Jefferson so aptly and eloquently explained it, then I don’t know what does and, personally, I want no part of it. My values have not changed, only my grievances with the powers that be. And since we no longer have a voice, maybe the tree of liberty needs to be refreshed. I don’t mean to speak seditiously, only of my dissension with the current direction and state of affairs forced upon us. It’s time to act! Secession from California is possible. It’s easy to feel kind of confused about the rights and wrongs of it all. A notion was floated that the two were considering some kind of television knock-down, drag-out meeting later this coming week. As of Monday afternoon, cooler heads

had prevailed. That’s got to be a small rest and respite for the rest of us, at least until sometime next week. Then they’ll be back at it, I don’t doubt. The USA is showing strong support for Israel with its Mediterranean fleet currently steaming toward the eastern shores of the Med and that may represent one more “rumor of war.” I’d say it does. I don’t anticipate the U.S. or NATO friends descending very deep into this particular caldron any time soon, but that may be why we quote the Bible’s Matthew and Mark calling it “wars and rumors of wars” instead of “perpetual wars” or just “wars.” All those terms work some of the time. This year California’s government put more restrictions on oil fields in Kern County and off-shore fields in Southern California to the point that they are quickly becoming unviable in terms of operating due to government regulations and restrictions. Never mind that the reserves in Kern County and off-shore are vast. California only provides 3.5% of its crude oil capacity to refineries to meet demand. The rest comes from Ecuador, Saudi Arabia, Iraq, Iran and Columbia. And let’s not forget the other side of the “green energy” agenda — wind and solar technology. Presently, China produces over 85% of all residential and commercial solar panels and 60% of all wind turbine manufacturing world-wide. Newsom’s role in Getty Oil was to import oil from Argentina to California. (Now Gavin Newsom imports wine from Argentina). Both Kathleen Brown (former State Treasurer) and Gavin Newsom enjoy a trust fund that was generated from Getty Oil profits. If Newsom and the Legislature want to claim the moral high-ground for “climate change” then they should offer a scorecard of how their taxpayer funded “green energy” regulations support terrorism and repressive dictatorships and openly publish their investments in “fossil fuels.” Frankly, I’d be happy if Newsom and his cronies would acknowledge their underground capitalistic greed, at least the state of California would profit from the oil and gas leases to pay for the social welfare they pass around as if the money were free. The Grizzlies squad under the leadership of head coach Addie Hauschild-Willis has partnered with Florida-based Funds2Orgs to collect gently-used or new shoes as a part of their 2023 fundraising campaign. “With inflation and the economy a little bit tough on people, I didn’t want to dig into people’s pockets to fundraise or burden the kids with having to sell anything,” Hauschild-Willis said. “After (doing some research) it turned out to be a pretty good fit for what we’re trying to do.” Funds2Orgs collects the donated shoes, paying for them by the bag before having them refurbished and sent off to entrepreneurs in third world countries to be sold. The process generates revenue for developing economies and saving shoes from landfills in the process. For Golden Sierra the fundraising will go toward expanding horizons of prospective collegiate athletes

The tons procured will satisfy the city’s procurement needs for all of 2023 and cover half of the requirement set for 2024. This year’s compost acquisition will cost $10,130, which includes the compost as well as transportation; the city received a $21,000 grant from Cal Recycle to aid in the implementation of SB 1383, but the funds cannot directly go toward procurement of reclaimed green waste.

The cost of compost has already been figured into the city’s budget. Municipalities across the state find themselves in the same situation as Placerville with SB 1383 beginning to go into effect this year. Introduced as an element of the state’s ongoing attempts to combat climate change, the bill mandates cities, towns and counties reduce organic waste disposal by 75% by 2025. An augmentation to SB 1383 — AB 1985 — was passed in September 2022 and allowed for the gradual implementation of organic waste procurement. AB 1985 sets benchmarks for green waste procurement for the next three years, giving

local governments time to gear up efforts to meet the ultimate goal amount in 2025 and onward. The benchmarks require 30% procurement in 2023 and 65% in 2024; with the amounts set to .8 tons per resident, Placerville’s goals are 261 tons this year, 566 in 2024 and 871 in 2025. The bags can hold 25 shoes in each for a target goal of 2,250 pairs. “I hope we can do it because we’re so small up here,” Hauschild-Willis said. “I’ve asked other teams to (bring shoes) when they come up to play us or when we travel to them.” Shoe donations are being accepted over the span of the next two months and can be dropped off at all Golden Sierra home volleyball games, as well as during and after school hours by students. Those fees are paid under the assumption completed projects will increase traffic. Sheetz, 72, paid the fees but subsequently took the county to court where it was ruled in California Supreme Court and the California Court of Appeals that no violation against Sheetz’ property rights had been violated. Both courts cited a California law that allows local governments to charge fees to builders to address “increased demand for public facilities reasonably related to the development project.” Sheetz and his legal team argue the fees are unconstitutional because the county did not make determinations there was an “essential nexus” between the effects his project would have on traffic and the need to improve the surrounding road infrastructure. Because the fees are enacted by county policy, the California Supreme

Court determined there was no need to enact a Nollan/Dolan test due to the Traffic Impact Fee Program being a local government condition for all development projects. The Nollan/Dolan test is derived from two cases — Nollan V. California Coastal Commission (1987) and Dolan v. City of Tigard (1994) — and establishes a two-part test for courts to use to determine whether state or local jurisdictions are in violation of the Constitution’s Fifth Amendment ban on uncompensated takings by granting development permits under the condition the applicant set aside land, pay money or provide services and materials. In that test, results must show an “essential nexus” between the conditions of the granted permit and a “rough proportionality” between the condition and restrictions in the development. Sheetz’ attorney Paul Beard referenced the Nollan and Dolan cases in an argument, stating the government must show a connection between impact of

proposed construction projects and restrictions the county is imposing. In Nollan v. California Coastal Commission, the court rejected the commission’s decision that a Ventura County couple must allow public access to a strip of land between a bungalow they wanted to rebuild and a nearby beach on their beachfront property. “The county demanded payment in spite of the fact that it made no individualized determination that the exaction — a substantial sum for Mr. Sheetz — bore an ‘essential nexus’ and ‘rough proportionality’ to the purported impacts associated with his modest project,” Beard writes in the appeal. In a July 5 response, legal representative for El Dorado County Glen Hansen noted the appellate questioning of whether a permit exaction is exempt from an “unconstitutionalconditions doctrine” in the example cases provided “simply because it is authorized by legislation,” but states the court declined to apply the Nollan/Dolan case test because of the county

policy’s exemption, along with other reasons. “Mr. Sheetz’ simplistic distinction between ‘legislative’ and ‘administrative’ exactions, as well as his discussion of the purported ‘legislative/ administrative loophole,’ does not encompass the totality of what the California Court of Appeal concluded in the decision below,” Hansen writes in his response. “The question presented in the petition ignores the fact that the legislatively mandated, formulaic, non-discretionary and broadly-applied fees under the county’s Traffic Impact Mitigation Fee Program that Mr. Sheetz challenges here were found by the trial court and the Court of Appeal to fully satisfy the ‘reasonable relationship test for legislative exactions under California’s Mitigation Fee Act …,” continues the response. Regardless, Sheetz is confident he will win his case in court. “I think the facts are there and when my lawyer lays everything out, it is undeniable,” Sheetz said.

very day of the Placerville Arts Association’s Fall Member Show brought “oohs” and “aahs” from the dozens who stopped to admire the works hanging at the El Dorado Government Center in Placerville, Oct. 2-6. The government center is always a hub of activity, but things perk up when fine art is hung on the walls amongst the garden atmosphere — a most lovely venue for PAA artists to express their inner selves. This year’s show featured 34 PAA artists and about 80 entries. For this show, the artwork was grouped into seven categories: People/Portraits; Animals; Abstract/Non-objective; Landscape/ Seascape; Still life/Floral; Photography; and AI (yep, artificial intelligence). PAA held a cozy reception Oct. 6 for artists and guests to gather and muse over the splendid week and to accept the awards given by show judge Barbara Burge. Burge, who volunteered for many years in Placer County for a wide variety of artrelated events, transitioned into a life of being at the heart of art in that area; she came to judge with a broad professional background in the art world. The Best of Show was awarded to Gloria Vernon’s “Peacock Spring,” an abstract watercolor. The People’s Choice Award went to Carolyn Cunningham’s “Cosmic Inspiration,” a feline collage. The PAA Fall Member Show recognizes and awards a broad range of art created by wonderfully gifted artists. This year’s award winners are:

Sir Henry Wood, then conductor of the Queen’s Hall Orchestra, was the first in Europe to allow women into a symphony orchestra in 1912 but would only hire female violinists, stating, “I do not like ladies playing the trombone or double bass, but they can play the violin.” Not until as recently as 1997 did the Vienna Philharmonic, one of the last bastions of all-male ensembles, achieve some equality after introducing blind auditions. While changes are continuing to take place, Seraph is making strides showing what a powerful all-

Mary Elizabeth Bowden, founder of Seraph Brass, said Seraph is one of many excellent all-female brass quintets in the U.S. Uniquely, the ensemble is passionate about presenting new works from underrepresented composers and has funded commissioning projects to bring new music to life. In its 10th season, Seraph is one of the oldest established all-female groups in the U.S. The group is a proponent of diversity in the arts, drawing from a roster of America’s top brass musicians

that identify as female. Seraph Brass performs a diverse body of repertoire with many new commissions that were recently recorded for an album that will be released in 2024. Some recent commissions by underrepresented composers include “Dust” by Jennifer Jolley, “Miracles of The Human Condition” by Lillian Yee and “Showcase” by Jeff Scott. A pre-concert forum begins at 1:15 p.m. and the performance begins at 2 p.m. Sunday, Oct. 15, at 2889 Osborne Hill Road in Grass Valley.
