Lenders will foreclose if property is transferred Q: I inherited some money last year. Recently, I started looking for a small home or condominium to purchase when I found a guy who was willing to sell me his condo. I gave him $22,000 in cash and he gave me a grant deed. The deal was that I would take over the mortgage payments. Last week, I had a concern regarding a tax bill the bank should have been paying.

I called and got transferred around to several people at the mortgage company until one of them finally told me I didn’t own the house and they were going to start foreclosure proceedings. I don’t understand what is happening.

A: I don’t know if I can help, but I can tell you exactly what happened.

The type of transaction you are describing used to be called a “wrap.” In other words, the buyer would pay the seller for his equity in the home and would simply continue to make mortgage payments. Until the mid-1980s the lender didn’t care who was making the payments.

As long as the account was kept current, all was well.

The laws were changed about 40 years ago to allow lenders

Known as an acceleration clause, it required a buyer to formally assume or pay off the existing mortgage.

Then the Great Recession hit about 15 years ago and lenders went back to not caring so long as the payments were made.

Then we came out of the recession about eight years ago and all of a sudden the banks went back to caring, as they still do today.

Wraps are still done to a small degree, but the only way they work is if no one publicly records the deed.

Most, if not all, commercial lenders run routine computer checks of the public records for each of the properties on which they have a mortgage. If the property records indicate title to the property has changed, the lender will begin the accelThe Law Offices of

eration process. If the note isn’t immediately paid off, the lender can foreclose.

When you called the mortgage company and represented to them that you were the owner of the property, you tipped them off to the transfer.

You haven’t told me whether or not the deed was recorded.

If the deed was on record, the mortgage company undoubtedly put you on hold while they ran a quick records check. When they discovered the change in ownership, they announced their intent to foreclose.

You have to do something to protect your equity in the property.

If the bank is allowed to foreclose, there is a very good chance you could find yourself out of the house with nothing in your pocket.

If you are able, you need to quickly refinance to pay off the mortgage holder. Any conventional type of financing will work.

Check with your local bank or get a referral to a lender.

If you are unable to refinance, try to talk to the existing lender and see if they will let you formally assume the loan.

oon after I became pregnant with my second child, I realized we had no room for a dedicated nursery. We were two years into the pandemic, and the guest bedroom was masquerading as my husband’s office.

The living room had morphed into a makeshift playroom. And my 2-year-old son’s nursery was doubling as a guest room.

Because of the lack of space – and my experience with my impossibly nocturnal first child – I decided I should just keep my baby at arm’s length, so I decided to create a nursery corner in the main bedroom.

I didn’t want to spend a lot of money on this, though, or make any big structural changes; I knew the baby would quickly outgrow the space. So we turned the wall opposite our bed into a nifty nursery nook.

After more than a year of living with it, I can say it was one of the best decisions I’ve ever made.

If, like me, you have been pondering ways to add a nursery corner to your bedroom but aren’t sure of where to start, we have you covered. We spoke with some designers about easy, budget-friendly ways to decorate a temporary space for your baby.

Here are their suggestions:

Pick a consistent palette If your bedroom was neutral before your baby came along, stick with that color scheme. By honoring the existing palette, you can make the nursery a seamless extension of your bedroom. “In a

Sarah Sham, founder and principal designer of Mumbai-based Essajees Atelier, recommends adding a natural touch. “Plants are a nice, natural way to bring in the outdoors, and they ... pack a visual punch, too,”

she says. They are the perfect way to add interest without making the room look too juvenile for a shared space.

Look for multitasking furniture Remember: Your baby will quickly outgrow this space – and the furniture – so it makes sense to opt for multitasking pieces, such as removable shelves, cribs with drawers, compact storage ottomans, bassinets that double as storage baskets and nursing chairs that can be used as accents. “A contemporary and convertible baby crib can dovetail nicely with the ... aesthetic

Look for solutions that are big on storage but small on size.

Hanging shelves, wall hooks, over-the-door hangers and wall organizers, for example, are excellent ways to make use of vertical space. Kim Lewis, founder of Austin-based Kim Lewis Designs, also suggests updating your closet. “Adding a second rod can be a quick, convenient way to double your closet’s capacity,” she says. “You can do this by attaching a new rod to the existing one with a lightweight chain and using carabiners, S-hooks or screw eyes to secure the system in place.”

Rolling carts can be used to hold diapers, creams, washcloths and blankets, and the carts can be stowed when not in use. And make the most of under-crib space by filling it with storage cubes and baskets to hold sheets, mattress protectors and other non-daily-use items.

Tailor your lighting What works for adults in a main bedroom might not be the best fit for babies, so adjust your lighting accordingly. 2022 a tough mortgage market

D

iana Olick of CNBC reported that mortgage demand has fallen to the lowest level in 22 years. Purchase money loan applications are down from the same time last year and refinance applications are off a whopping 75%.

As a mortgage banker dealing with this ugly market, people ask me why I have such a positive outlook. The answer is simple. I have seen this story before – in 1994, 2004 and 2008.

We had a huge refinance mania in 1992 and 1993, which died in 1994, and another even bigger refinance market from

Housing market slowdown takes hold as mortgage rates dig in THE WASHINGTON POST Reduced competition, fewer sales and even some price drops by sellers are all indications that buyers and homeowners are reacting to higher mortgage rates, high prices and high inflation. Three reports from Redfin real estate brokerage demonstrate the cool-down in the national housing market.

May, traditionally one of the busiest months for home sales,

saw a 3% decline in sales, compared with April, according to Redfin’s report. Sales were down 10.2% compared with May 2021.

Median sales prices continue to climb, up 14.8% nationally, compared with May 2021. No metro area saw a price decline in May, compared with the previous year, and some saw large price jumps. The median sales price rose 30.5% in North Port, Fla.; 28.1% in Tampa; 26.8% in Las Vegas; 25.9% in Knoxville;

and 25.8% in Orlando.

While demand for homes is declining, which makes competition less fierce, the number of listings is still down, according to Redfin. Active listings were 4.3% lower in May, compared with May 2021 and were down 0.7%, compared with April 2022.

Fewer buyers faced competing offers in May, when Redfin reported that 57.8% of buyers working with a Redfin agent were in a bidding war for a prop-

erty. That represents the lowest share of offers facing competition since February 2021 and is down from 68.8% in May 2021.

The percentage of offers facing competition has declined for four consecutive months.

Buyers face the most competition in Worcester, Mass., where 81.8% were in a bidding war in May, followed by Las Vegas (74.5%), Boston (72.6%), Dallas (72.3%) and Philadelphia (69.3%).

The metro areas with the lowest competition in May were Riverside, Calif. (41%); Providence, R.I. (45.3%); Olympia, Wash. (47.2%); Honolulu (47.8%); and Minneapolis (48.7%). In the D.C. region, 61.1% of buyers faced competition in May, compared with 70.6% one year ago.

The prime culprit for the slowing housing market is mortgage rates, which have risen quickly in recent months to rates not seen since 2008.

The greenhouse pot has become an ecological marvel

o longer will trays of flower transplants create a mess, a sore back from picking them up and clutter in the garden shed with thoughts of future use.

Winter From Page 7 The organic nutrients are rich in phosphorus, calcium and nitrogen. As the containers – which are planted directly into the soil – break down, nutrients are released to the roots all season long.

The process is simple: You peel off four tabs on the bottom of the pot before placing them in the planting hole. Removing the tabs is essential for roots to be properly exposed to the soil and begin growth. The containers and removed tabs can be planted in landscape beds or your favorite mixed containers. Water your plants well after planting. The Eco+ Grande containers will gradually disintegrate over time, helping to feed the plant's roots.

By planting the entire container into the soil, you minimize

root disturbance, you don’t have to fret about weekly feeding or worry about fertilizer runoff.

Since climates and environmental conditions differ over a long growing season and across the country, the size of pieces left in the soil may vary and can simply be tilled in for the next growing season.

Son James planted a couple of flats of Blue My Mind evolvulus grown in the Eco+ Grande containers. He used a Proven Winners Twist n’ Plant Original Gardening Auger with a cordless drill. New guidance can lower home’s fire risk – and insurance rates THE WASHINGTON POST Homeowners in the U.S. have new guidance to help them defend against increasingly frequent wildfires and associated rising insurance premiums.

The Insurance Institute for Business & Home Safety (IBHS), a research nonprofit funded by insurers, has developed the first standard that can demonstrably lower a home’s risk of wildfire damage. To earn the Wildfire Prepared Home designation, homeowners have to meet

a series of criteria – including, for example, clearing anything flammable, such as shrubs, from five feet around their homes – and pass an annual inspection.

The guidance will be particularly useful for homeowners in western states that have been plagued by wildfires. The town of Paradise, Calif., 90% of which was leveled by the infamous 2018 inferno, immediately announced that all new construction would have to meet these standards.

“This is a critical piece to our rebuild,” said Kevin Phillips, Paradise’s town manager.

“We are doing everything we can to show the insurance companies we are mitigating against risk and that we are a community that you would come back to and invest in.”

The state of California already has strict building codes for new construction in areas known to be fire-prone, but many houses predate these standards and therefore do not conform to

them. The steps for meeting the IBHS are even tougher.

For many years the IBHS has done research for the insurance industry on how to keep homes and business safer from fire, including by building test homes and setting them on fire in their laboratory. But Roy Wright, chief executive of the institute, said in recent years homeowners have become hungry for this information as well.

“The catastrophic events in California 2017 and 2018,

changed that conversation about fire insurance,” he said. “All of a sudden, climate change comes marching through the front door, these California families, they want to know what they can do.”

IBHS said the designation was based on the latest science and included a list of concrete steps proven to reduce fire risk, such as including and adding fine mesh coverings to attic vents or outdoor decks to prevent the spread of embers and replacing See Rates, Page 11

Now, don’t get me wrong, I am exceedingly upset about my IRAs and 401(k) dropping in value by 30%, but this is just another cleansing of the saturated mortgage market.

Thousands of loan officers quit the business in 1994 because selling a refinance in 1992 and 1993 was like trying to catch a 7-pound salmon in a 5-gallon bucket. Helping a client in 1991 drop from 7% to 6% was an easy sale, and then calling that same client nine months later to drop from 6% to 5% was cool.

1994 was a rude awakening for the newer loan officers who specialized in refinances.

Many quit and returned to their previous career when they realized being a loan officer is one of the toughest sales professions in the world.

Here are some reasons why selling loans is hard: No. 1: Competition. There were more than 10,000 different loan officers who funded at least one loan in Solano County in 2021, and there are only around 500 home sales per month. I predict the number of loan officers in our beloved market will drop to 1,500 in 2022 because it

will be a 90% purchase and only 10% refinance. Realtors and sellers don’t like dealing with loan officers out of Texas and Florida who they cannot hold accountable in person.

No. 2: Professional expertise with debt and financial management. Helping people with their largest asset is an incredibly important responsibility.

Tens of thousands of loan officers in California left the business in 2008 when underwriting came back to normal, and people had to qualify for a mortgage.

No. 3: Nobody loves borrowing money. Selling something that people need but nobody really wants is not easy unless you can provide a lot more value than just a loan. Most people need creativity, financial literacy education and debt management advice. People want a lender who cares more about creating a “raving fan” than just selling a loan. “Raving Fans” is the title of a book written by Ken Blanchard and Sheldon Bowles that talks about the importance of exceeding a customer’s expectations, so the customer is not only a client for life but also a referral source who raves about you to their friends and family.

No. 4: Hustle and hard work.

The top loan originators in the country, and keep in mind that historically 80% of the business is done by 20% of the loan officers, all work at least 45 to 50 hours per week and most are available 24-7 by phone. Real estate agents and brokers are
