2 neighbors agree to replace fence, 1 won’t pay his share Q: I live in Suisun City and purchased a home at Lawler Ranch in July 2009. When we moved in, the fence was rotting and we knew it was something we were going to have to replace eventually. We wanted to replace the wooden fence with a composite fence so it would last longer and not rot, but we also knew it would be more expensive. I took the estimates to the neighbors and both agreed to pay for half of the fence with me. I fronted the money and got the fence built. Construction was completed in May. One neighbor gave me my money immediately, but to this day I haven’t received a penny from the other neighbor.

Is there any recourse I can take to get my money from them?

A: This question, or at least a version of this question, is easily the most common I receive.

However, the normal story involves a neighbor who refuses to pay for their share of the good neighbor fence. Regular readers will recall the remedy is pretty straight forward. Since there is a state law that requires neighbors to share the cost of a fence

Tim Jones in most instances, a trip to small claims court will usually solve the problem, though perhaps it won’t improve the personal relationship between the neighbors.

Your case is different.

Since your neighbor apparently agreed to pay for his share of the fence, your issue involves the law of contracts, not real estate.

We learned in law school that a “contract” is any agreement between two or more people that the courts are empowered to enforce.

In this case, you made an agreement with your neighbor that the fence would cost a certain amount and he would pay his 50 percent.

And it’s a good thing you did.

Composite fences are, as I recall, three or four times more expensive than wood.

If you were relying on a

neighbor who would not agree to pay to replace the fence to pony up half, I’d be telling you to forget it.

The other neighbor’s responsibility is only to pay for half of replacing the existing fence with a fence of the same type.

If you had unilaterally decided to get an upgraded fence, the increased cost would be on you.

But once you and the neighbor went over the estimate and approved it, the neighbor was consenting to pay for the other half. You formed a contract.

Now, the big question: Did your neighbor sign the estimate or some other document memorializing his intent to pay the higher price?

If so, then you go down to the courthouse and sue in small claims court. It’s fast, cheap and easy.

If there’s no signature or other writing you can show a judge, the problems potentially mount.

First, what you have is known as an “oral” contract, obviously meaning it’s not in writing. That carries a two-year statute of lim-

The figures reflect a cooling

market as the Federal Reserve raises interest rates to soften demand in the broader economy and tame decades-high inflation.

The average rate on a 30-year mortgage is nearly double what it was a year prior. Coupled with high home prices, the rapid run-up in borrowing costs has sidelined many potential buyers and triggered more canceled deals.

Other data Tuesday from the Conference Board showed the share of consumers planning to buy a home in the next six months dropped to 4.4% in July,

the lowest in nearly seven years, from 5.7%. Overall consumer confidence fell to the weakest point since February of last year on dimmer views of the economy because of inflation.

Separate reports last week showed a slowdown in building activity and a two-year low in home resales amid intensifying affordability concerns.

Sales fell in three of four U.S. regions. Purchases slumped about 36.7% in the West, dropped 2% in the South and fell 5.3% in the Northeast.

Then you have what’s known in the business as a “proof problem.”

You’re going to show up in court and say, “Hey judge, Mr. Neighbor and I had a conversation about this and he agreed with me that we should pay three times the cost of a wood fence and he agreed to pay for his third.”

Your neighbor may respond, “Huh? What conversation?”

You see the problem.

Often the hardest part about enforcing an oral contract is proving that one even exists, let alone what the terms were.

So the sooner you pursue this the better.

Not that you’re going to need a The Law Offices of

new fence anytime soon, but for everyone else, a word to the wise.

Get a commitment from the fence contractor that he will be responsible for collecting payment from the neighbors.

Don’t take it on yourself.

Have the contractor break down his bid into how much each neighbor is responsible for and have him get each neighbor’s signature.

That will avoid all of this legal hassle, not to mention the hard feelings it creates between people who have to live next to each other.

Survey: Real estate stays on top as Americans’ favorite investment for the long term JAMES ROYAL

ortgage rates are surging higher, inflation is soaring, and many experts are forecasting a recession may soon be on the way. Despite these negative impacts on the housing market, real estate remains America’s favorite long-term investment in 2022, according to a just-released Bankrate survey.

It was the third time in the last four years that real estate took the top honors.

In all, 29% of Americans said that real estate was their top pick for investing money that they didn’t need for 10 or more years. Real estate made a strong showing, and it was the secondhighest result – behind only the 31% it notched in 2019 – in the survey’s 10 years of polling. The runner-up in this year’s survey was stocks, which garnered 26% of Americans’ votes.

“Despite a housing market that is coming off the boil, preference for real estate remains high,” says Greg McBride, CFA, Bankrate chief financial analyst.

“For the third time in the past four years and sixth time in the past 10 years, real estate is Americans’ preferred way to invest money not needed for more than 10 years. Despite a brutal bear market in 2022, the stock market was a close second.”

Bankrate surveyed 1,025 American adults from June 17-20 about their investment preferences. Below are the main findings from the survey.

Here’s the full list of responses and the percentage of Americans who favored each: • Real estate – 29% • Stock market – 26% • Cash investments (savings, CDs) – 17% • Gold or other precious metals – 9% • Bonds – 9% • Bitcoin/cryptocurrency – 6% • None of these – 3% Americans appear to be more enthusiastic for the stock market, despite stocks being down 20% year to date at the time of polling.

The preference for stocks as a

long-term investment surged to 26%, from 16% in the year-ago survey. That result was below only the preference for stocks in 2018 (32%) and 2020 (28%) in 10 years of the survey.

Cash came in third, falling from 25% last year to 17% in 2022, even as interest rates have sharply risen and are poised to go even higher.

“Preference for cash moderated notably, cited by just 17% of respondents, the lowest in a decade’s worth of polls,” says McBride. “Nothing like the highest inflation in more than 40 years to remind investors of the need to earn higher returns to grow the buying power of a nest egg.”

Bonds have gotten crushed in the market this year, but that didn’t stop survey respondents from citing them as their pre-

ferred investment at the highest rate, 9%, in a decade of polling.

That’s up from just 4% in 2021.

Gold and other precious metals were less popular than last year, falling from 13% to just 9% in 2022, sinking to the lowest all-time level during the decade of the survey.

Cryptocurrency became less popular as well, falling from 9% last year to 6% in 2022. Finally, a further 3% of respondents said none of these choices was the best place for investing money over the next ten or more years.

just a bit less optimistic about them than real estate? The survey dug into the reasons.

Among respondents who didn’t pick the stock market as their preferred investment for the next decade or more, here are the top answers for why they didn’t select it: • “Too much volatility” – 36% • “Intimidated by the stock market” – 16% • “The investment returns won’t keep pace with others” – 15% • “The stock market is rigged against individuals” – 14% • “Focused on preserving money rather than growing it” – 10% • “Some other reason” – 9% • “Don’t know” – 1% Age seemed to play a role in whether a respondent said that volatility was the key factor in their decision, with 44% of baby boomers (ages 58-76) and 40% of Generation X (ages 42-57) citing it, compared to 29% of millennials (ages 26-41).

In contrast, being intimidated with the stock market was more associated with younger cohorts.

About 22% of older millennials (ages 33-41) and 18% of younger millennials (ages 26-32) cited this reason, compared to 15% of Gen X and 11% of baby boomers.

Age also seemed to be associated with whether Americans said that their top reason for not preferring stocks was the market was rigged against individual investors. Younger millennials (20%) and older millennials (17%) responded at higher rates than did Generation X (13%) and baby boomers (12%).

SOLANO REAL ESTATE SCENE

Let’s take a look at government loans for homebuyers V A and FHA loans have been a huge part of the Solano County real estate market for many decades.

VA has been an amazing loan program for active duty and veterans since the 2008 crash. VA has modernized its loan program over the past 14 years by increasing the loan limits and updating some old guidelines.

When I first moved here, the veteran was not allowed to pay any discount points and the rate was set by VA, which made the discount points a moving target and tricky for Realtors. That silly rule went away many years ago and now the only difference between a conventional and VA loan is that a termite report and clearance is required, which is usually no big deal unless the property is loaded with pests and dry rot.

FHA remains a very important option for people working hard to move into the middle class and achieve the American Dream, but unlike VA, FHA is not achieving its mission of making homeownership accessible and affordable. For some reason, unlike private mortgage insurance, or PMI, the FHA

mortgage insurance premiums, or MIP, cost is not risk based.

An FHA buyer with a 625 FICO score pays the exact same MIP rate as a buyer with a 740 FICO score and what makes it even worse, the buyer is stuck with the monthly MIP for the life of the loan. The cost of the FHA non-refundable MIP is 1.75% up front and .85% with 3.5% down and .80% with 5% down annually, which is substantially higher than PMI. Let me give you folks an idea of how outrageous the difference is for people that need to go FHA to qualify.

A buyer putting 5% down on a $600,000 house with a FICO score of 680 can get a conventional loan with a PMI cost of only .70% annual with zero up front PMI and can have the PMI removed once they get their loan down to 78% loan to value. An FHA buyer with a 680 FICO and

Keep in mind that thousands of Solano County residents that took FHA loans between 2014 and 2019 refinanced out of their FHA loans in 2020 and 2021 into conventional loans but never got any refund from the 1.75% they paid the Feds for their up-front mortgage insurance. On a $600,000 loan taken in 2018, the consumer paid $10,500 to FHA-HUD for their mortgage insurance to protect the lender-investor for 30 years, but when the loan was paid off in 2021, there was no more risk and HUD got to pocket all the money.

To me, this is like paying for

of their houses on the old FHA reverse mortgage program from 2003 to 2007, prior to the crash in 2008. FHA is still crying about this but now the reverse loan program is more conservative, and FHA is now flush with cash.

Imagine it is 2006 and an 85-year-old walked into Wells Fargo to get a reverse mortgage on his $600,000 house in the Woodcreek neighborhood. Under the old FHA reverse program Wells Fargo would have given him a loan for $450,000 based on his age and value of the home with no mortgage payments required for the rest of his life.

Yeah sure, there were some FHA loan defaults from 2009 to 2014 but there were very few in Solano County because nobody took FHA loans from 2003 to 2007 because buyers bought houses with nothing down and took out loans with no PMI or MIP. FHA never offered stated income or zero down payment loans during that crazy time. The only significant losses HUD-FHA took from 2008 to 2014 were from the seniors that died after taking all the equity out

Comfort levels with cryptocurrency have fallen along with their price Americans say they’re much less comfortable with investing in cryptocurrency, according to the latest Bankrate survey. Only 21% say they’re either “somewhat comfortable” or “very comfortable” with cryptocurrency, compared to 35% in last year’s survey.

In contrast, 75% of respondents said they were “not too comfortable” or “not at all comfortable,” compared to 61% in last year’s figures.

Age seemed to be associated with the comfort level for investing in cryptocurrency, with younger investors reporting higher levels of comfortability.

34% of Generation Z said they were somewhat or very comfortable with investing in crypto.

29% of millennials reported they were somewhat or very comfortable.

Just 21% of Generation X responded the same.

Only 11% of baby boomers said they were somewhat or very comfortable with crypto as an investment.

On the flip side, a total of 66% of Gen Z says that it’s either not too comfortable or not at all comfortable investing in cryptocurrencies. Millennials reported a similar result (68%).

Agastaches or hummingbird mints are aromatic, and they create wonderful olfactory moments when you brush up against them. They are even more enjoyable to cut and use in floral arrangements indoors. You hardly hear anyone touting this, which is probably because we are so enthralled with all the pollinators. So my recommendation is to grow enough so you feel free to cut for the vase.
