A: As with many legal ques tions, the definitive answer is “no” and “sort of.” Before I get to the specific answer to your question, let me spring off into a brief outline for other landlords, or perspec tive landlords, regarding how problems similar to this happen, which they do all the time. As we go through this, remember we live in sunny Cal ifornia where you can ski in the morning and drive to the beach to get clam chowder for dinner. (OK, it’s a long drive, but you get theCaliforniapoint.) is where the con sumer is king and the vast weight of the law is designed to protect consumers from those who would prey on them, the byprod uct of which is a situation like you just described. In this case, we can’t really make sense of the problem without a little LandlordTenant 101. Law school teaches the concept that real estate isn’t just a thing. Instead, it’s a bundle of things, or more accurately “rights,” to a particular piece of land. You can give away some of the sticks in the bundle without losing your ownership. For example, I bet your home has easements running across it for gas, electric, water, sewer, municipal landscaping, maybe even access to your neighbor’s house. You probably don’t own the mineral rights under your house. Likewise, you probably wouldn’t be allowed to have a commercial shooting range at your house. Each of those is a stick in the bundle that you no longer own. But still, you own yourInhouse.a“big picture” way, land lords and tenants have a simple agreement with each other. The landlord agrees to provide a roof over the tenant’s head if the tenant will agree to pay rent. In legal terms, you are renting out some of the sticks in your bundle. So far so simple. Obviously, the devil is in the details. I’m sure the landlords out there are aware that the “roof” they’re providing has to come with certain things. Like walls and locking doors for example. You’re also renting the “occu pancy” stick to your tenant. Put another way, your tenant gets to occupy the house pretty much like an owner would. Generally, the right to occupy is the right to have guests of your choosing and the right to rent, or sub-rent, theThat’sproperty.likely where you ran intoWithouttrouble.a contractual prohi bition to the contrary, a renter has a right to sub-rent. The subrenter then has whatever right to the property the “master” renter has. All standard residential contracts I’m aware of contain a prohibition against sub-renting. I’m assuming, for the sake of argument, yours does, too. And common sense would dictate that would be enough. But it isn’t. Unless the lease was recorded at the County Recorder’s office, and therefore put on the public record, the sub-renter likely had no idea the master renter couldn’t rent to them. Lacking specific knowledge, at least theo retically so, the sub-renter could take possession in good faith. In

Q: My wife and I augment our retirement income via rental property we own in Suisun City. Recently, we had to evict our long-term tenant who had basically lived there rent-free during the pandemic. But when the sheriff’s deputy showed up to get the tenant out, their daughter with small children and unemployed boyfriend remained. The deputy couldn’t get them out because they weren’t on the eviction papers. We had to go back to court and get another judgment to evict them, but loopholes allowed them to challenge the eviction, though they have no lease with us, and we must set another court date. In the mean time, they have occupied our property rent-free all this time. My question is simple: Is there some kind of “listing” or source of protection for landlords that can pre-warn them of this kind of well-informed freeloader who uses the law to rob landowners of income and legal expense?

Gordon: Generally, homeowners will not find any issues or harmful substances if they test their water quality. Most water in the U.S. is filtered at water treatment plants and water safety standards are mandated by the government. Water com panies such as WSSC publish an annual Water Quality Report. However, those living in rural areas who get their water from a well should test their water at least once a year. Well water does not always have access to water treat ment plants.

Khiel: Severe issues would be if high levels of heavy metals, like lead and mercury, are detected in drinking water. These can cause major health issues, espe cially in children.

The EPA website has a list of certified laboratories.Dunphy:Homeowners should be aware that not all tests will provide specific or accurate results. We recommend using our free digital water test that assesses levels of hardness, chlorine, pH, iron, copper, alkalinity and more.

Q: What are common issues caused by hard water?

Khiel: There are many water test kits on the market. Most are fairly simple to use. Fill a clean container with tap water, insert a test strip into the container, let it dry, then compare it to the chart provided to see what it indicates.

ater filters, whether installed on a faucet or on a pitcher in your refrigerator, have been around for decades for healthier drinking water. But not everyone uses them, and they don’t address the impact of hard water on your home and appliances. We asked several experts about what homeowners need to know about the quality of their water: Mary Gordon, vice pres ident of InSite Builders & Remodeling in Bethesda, Md.; Tim Dunphy, a water expert with Leaf Home Water Solutions, a national water solutions supplier for homeowners; and Chuck Khiel, senior vice president with Fred Home Improvement in Bethesda, Md. All answered via email, and their answers were edited for clarity.

How to test, improve your tap water

Dunphy: Hard water is one of the most common water quality issues discovered during testing. It can be found in homes with either city or well water. Another common issue in city water is disinfection chemicals (i.e., chlorine) and byprod ucts, which cause unpleasant tastes and smells, damaged hair and skin, and possi ble adverse health effects. Well water sees multiple challenges identified through water quality tests, such as the presence of iron, manganese or hydrogen sulfide, a naturally occurring element that makes your water smell like rotten eggs. “Sulfur water” is the common phrase for this and can cause problems such as stained fix tures, bitter taste in your water, corroded metal and dingy laundry. Water testing can also find more serious issues, like lead or arsenic contamination and PFAs, other wise known as “forever chemicals.”

• Cause a mineral deposit build-up in shower fixtures, faucets, dis posals and pipes.

magine a plant so unusual and beautiful in your land scape you stare hypnotically at it every day. Go further and say, 100 days. That is pre cisely how I feel about Heart to Heart Burning Heart cala dium, and the reason is this: It simply can’t be that color. In May I wrote about Using Heart to Heart caladiums to create the unexpected in the landscape. Son James used Heart to Heart Burning Heart in a project and I was shocked I not only had never heard of this variety, but even more so, that he didn’t share some with Dad. The old Garden Guy was able to locate his own, however, and although the summer hot misery index was off the chart, Burning Heart created some ecstatic plant bliss that pulled me through the heat. I shot a picture one night about 8:30 and sent it off to Dr. Allen Owings, professor emeritus with the LSU AgCenter and now horticulturist at Clegg’s Nursery. I asked him if he knew about this caladium, and was it in Lou isiana? He said, we’ve have had it for a couple of years, and it is shazam, shazam, shazam! So, then I inquired of the company, was this caladium found on an expedition to the rainfor est in Borneo? Kind of like Indiana Jones. The first answer is, caladi ums are from Central and South America. Next, Heart to Heart Burning Heart was developed the old-fashion horticulture science way. Pollen from the male parent was given to the female parent, and seeds were planted. Good lord, how long was this process? Can you imagine one day a horticulturist was looking at the field plot, and these flaming red leaves were coming out of the ground. Surely the happy dance commenced. So now I have given the real story, red leaves with pink or orange flecks or freckles. The glowing color changes through out the day, depending on the sun. In direct sun it is a hot, hot vibrant red, but let the light shift to filtered and you will swear it is now a rusty red that still mes merizes you. Catalogs and trial sites will tell you it is an upright grower with leaves that will reach 12 inches. This morning I took the tape out and measured several that were 16 inches long and almost 10 inches wide. Son James, ever the envelope pusher, combined his with Shad owland Coast to Coast hostas, which are a dazzling chartreuse, and the gray, sword-like leaves of Catch a Wave Mangave. I used mine in containers, and the combinations turned out simply incredible. The first partner ship created was with Graceful Grasses Queen Tut papyrus grass. I’ll admit I really didn’t know what I was doing. I love both and essentially said, “Let’s see how well you play together.” Then I used the spiller of the ages, Goldilocks Creeping Jenny.
