Another delay announced in murder retrial for Ricky Davis Pat Lakey Staff writer If murder defendant Ricky Davis was seething beneath his cool exterior in a Placerville courtroom last week, as yet another delay in commencing a new trial in the 1985 stabbing death of a woman at an El Dorado Hills home was announced, the man who has spent 15 years behind bars for a crime he says he didn’t commit didn’t show it. Davis, 54, cocked his head and listened as defense attorney Melissa van der Vijver spoke to him, sitting together in the space where it was hoped last fall a jury would be sitting, ready to determine whether Davis truly is the person who stabbed Jane Anker Hylton nearly 30 times at a home on Stanford Lane where she was staying with her teenaged daughter to flee an ugly domestic situation involving her husband Archie Hylton. Hylton, 54 at the time of her death in July 1985, had accepted an invitation from Ricky Davis’ mother to stay at her

PG&E scam alert Pacific Gas and Electric Company is alerting customers to be aware of ongoing scam phone calls with criminals threatening to shut off power if a payment is not made. PG&E’s Corporate Security department has received several reports in the past few weeks regarding scammers requesting payment on past due utility bills immediately using a Green Dot card, Money Pack or gift card. The greater Sacramento area has experienced scam phone calls threatening suspension of electric service if a payment is not immediately received. PG&E wants to remind customers that its representatives will always carry identification and will never ask for immediate payment with a prepaid cash card over the phone or in person. Customers with concerns about the legitimacy of a call about a past due bill, service request or request for personal information are encouraged to call PG&E at 1-800-743-5000. Be aware that scammers can disguise their true phone numbers. Customers should always ask to see identification before allowing anyone claiming to be a PG&E representative inside their home. sanctuary now. “We’re also limited in how well we can serve on Sundays because of space, so this was a way to address both of those issues at the same time.” Vintage Grace Church has also built a small park behind its church that is open to the public. The new, two-story building sports a footprint of 26,000 square feet and reaches 51 feet at its tallest point. The upper floor houses a spacious sanctuary where the Sodestroms plan to hold worship services plus a nursery or “cry” room for babies, a classroom, a foyer that opens out onto an outdoor covered patio as well as rooms for storage, an electrical equipment room, an audio/visual room, a green/prep room and restrooms. The ground floor will offer two open spaces, one for a ministry support room for large gatherings and the other for offices, which Sodestrom dubbed the “bullpen.” Two more classrooms, a supply closet and more restrooms round out the lower level. Vintage Grace offers four Sunday services, but the new structure will allow the Sodestroms to streamline their current service schedule down to two. If the congregation continues to grow, they will gladly add another service back into the lineup. The building is on track to be completed by this summer with a grand opening scheduled for the fall.

“We haven’t had a lot of delays, thankfully,” said Drew. “Our hope is not only to have space for the church to use it on Sundays, but to use it midweek to serve the city.” Already the church hosts Little League teams and recovery groups, but would like to expand and serve additional sports leagues, schools and other groups throughout El Dorado Hills. Groups will be able to sign up through the Vintage Grace Church website to use the spaces. “We like to be very generous,” Jen said of their decision to balance the cost of the expansion with their service objectives. “How do we keep being generous but still make enough space?” The Soderstroms have made financially conservative decisions, making sure they can continue to contribute to causes for which they feel strongly. The church is involved in ventures such as Child Headed Households in Africa that helps kids who have lost their parents in the South Sudan civil war and has also partnered with local foster care systems. “We are currently giving 15 percent of whatever money comes in to projects and ministries that are not Vintage Grace and our goal is to give 50 percent someday,” Drew said. Hidahl a rocket scientist and 10 years at Northrop Grumman as a chief systems engineer, retiring in 2014. A grandfather to 10, Hidahl and his wife Eileen have been El Dorado Hills residents for 41 years, seeing all five of their daughters through Oak Ridge High School. Elected to the El Dorado County Board of Supervisors in 2016, Hidahl said he’s proud of achieving his previous campaign goals of structurally balanced budgets for three successive years, preserving open space and providing multiple senior housing facilities in El Dorado Hills, adding that he hopes to complete the work he started in the last three years. Hidahl acknowledged the help of staff and department heads who brought about the culture change he has seen within the county in his efforts “to improve and lean out county government.” Describing himself as a financial conservative who cares about helping others less fortunate, Hidahl cites his 41 years in the private sector and 33 years as an El Dorado Hills Fire Board director as reasons he stands apart from other candidates. If re-elected, Hidahl pledges to maintain the commitments of his first term to a balanced budget, preservation of open space and senior housing. He also hopes to restore the Green Valley Road and Bass Lake Road expansion and safety projects removed from county transportation plans in 2016 “to improve Green Valley Road and Bass Lake Road as originally promised to the community.” In addition,Hidahl said he plans to support a solid Traffic Impact Mitigation Fee program to ensure planned road improvements will be funded as well as obtain commitments for the prompt construction of the community park adjacent to Sellwood Park in Serrano. Hidahl also envisions creating a vocational training facility in El Dorado Hills to help youth to obtain well-paying jobs while continuing to bring jobs to El Dorado County via effective economic development policies. Hidahl revealed that one topic

that has him concerned involves land use and development issues. “The county General Plan defines the need for more housing to meet state requirements. El Dorado County is non-compliant in meeting these allocations and the state is applying more pressure with threats of punitive action,” he explained. Other top concerns for Hidahl include homelessness and people on fixed incomes, non-renewal of fire insurance policies in rural areas, the recent trend in declining property tax revenues and the resultant need to cut county jobs and services and the lack of new revenue sources to fill the property tax revenue gap. As an Eagle Scout, Hidahl actively supports local Scout organizations, the Placerville Nomadic Shelter group and the Lighted Candle, which serves the county’s homeless population. He enjoys spending time with his family, traveling and being outdoors. “My personal motto is ‘service before self,’” said Hidahl. Former District 4 Supervisor Ron Briggs, El Dorado Hills attorney Wayne Haug and EDH Community Services District Board President Benjamin Paulsen are also running for the District 1 seat. The primary election will be held March 3.

The 38-year-old said he aims to bring an open governance approach to county operations. If elected, Loewen told Village Life he hopes to close the communication gap between constituents and elected officials. “We really need to be out there and taking the input, communicating with those residents we serve,” Loewen said. “Whether it be neighborhood or community groups, we need to hear them out and make sure we’re collecting enough information to meet their needs. Someone is always going to be unhappy but we still need to give them the time of day to be heard.” Having worked with several different community groups and government agencies, Loewen said he has

an unmatched grasp on administrative workings. “I bring an internal understanding to the table from working in the public sector on how to find and optimize efficiencies,” he said. “I know how to operate ‘leaner and meaner’ or more ‘well-oiled’ or however you want to put it. Once we get to that starting point, it’s easier when you come against hardships, financial or otherwise.” As the EDHCSD general manager Loewen said he has fought the contentious battle over the future of the old El Dorado Hills golf course, maintaining that the land should stay as a recreational/open space resource. The candidate said he’s a “rural lifestyle” advocate in

the ongoing conflict over growth in the county. “Having open spaces and strong agricultural business are so important and this county must continue to recognize the tremendous value that comes with it,” Loewen wrote on his campaign website. “The way of life in our rural areas and our pursuits for quality open spaces must be supported and preserved.” Loewen holds a master’s degree in psychology from California State University, Fresno. He is currently enrolled in the land use and environmental planning certificate program with the UC Davis Extension. He is a certified behavior analyst, parks and recreation professional, playground safety inspector and landscape irrigation auditor. A native of Kings County, Loewen and his wife settled in El Dorado County in 2014 when he joined the EDHCSD team. Previously, he worked for Kings County Parks and Grounds. Over six years with the department, he was the liaison for a museum advisory committee, historical society, sportsman’s gun club, and fish and game fines/advisory committee, according to his website. The candidate is pledging to donate half his supervisor’s earnings to non-profit organizations and efforts to benefit District 2. He is running to replace Supervisor Shiva Frentzen, who is termed out. Former supervisor Ray Nutting, business owner George Turnboo, former Cal Fire director Ken Pimlott, Libertarian Party of El Dorado County Chairman Tyler Kuskie and Cameron Park Community Services District board member Felicity Carlson also have announced their candidacies for the seat. go partying is what triggered the deadly assault, Davis always has maintained his innocence. He and Dahl said from the outset that they came home to find Autumn standing outside the house, ostensibly waiting for them to return home, and that the trio discovered the nightmare only as all went inside. Dahl’s account was publicized by the Mountain Democrat at the time, a couple days following Anker’s slaying, after she led a reporter through the house and showed the killing scene, speculating that whoever had committed the murder had lain the victim’s body back onto a bed in the room where she was to sleep. That detail in the story, along with other statements made by Dahl under questioning two decades later by cold case investigators from El Dorado County, would lead to Ricky Davis’ arrest and eventual conviction in 2005 for the killing. Dahl had changed her original account of an “unknown intruder” being responsible to explaining, in gruesome detail, how she had assisted her then-boyfriend in killing the older woman. The first jury to hear the case hung up, announcing it couldn’t reach a verdict. The next jury, although announcing it was deadlocked at one point during deliberations, eventually would find Ricky Leo Davis guilty of slaying Jane Anker Hylton. Languishing in state prison at Solano since 2005, Davis came in contact with attorneys with the Northern California Innocence Project out of Santa Clara University, with one lawyer in particular dedicating her time to show the verdict should be overturned. When DNA evidence tested with more modern techniques indicated biological matter found under Jane Hylton’s fingernail and on her nightgown by a male could not scientifically be linked to Davis nor the now-deceased former husband — and with those new findings presented to a Superior Court judge in Placerville — Davis’ conviction was thrown out and a new trial ordered. Judge Kenneth Melikian, after poring for 10 months through thousands and thousands of past trial transcripts and other case documents, last spring tossed the verdict and ordered a new trial. He also has ruled that despite the fact that primary witness Connie Dahl has since died, her death reportedly from a drug overdose occurring in 2014, the jury sitting during the new trial will hear her testimony read from a transcript of the 2005 proceeding. And despite the fact that Davis consistently has refused to waive his Constitutional right to speedy court proceedings, he has been overruled as Judge Melikian found the defendant’s need for a thorough, competent defense outweighs his 6th Amendment right. Attorney Melissa van der Vijver, well respected locally for her record as a criminal defense attorney, is in poor health, with her condition part of the record as the delays in the case have been explained and justified. Getting up to speed on the complicated matters affecting the defendant’s future also have contributed to myriad delays — the most recent of which occurred Jan. 7 before Judge Melikian. The magistrate last fall had ordered Davis’ new trial to begin in February 2020, with jury selection beginning this month, but after conversations last week in the judge’s chambers with van der Vijver and El Dorado County deputy district attorney Jay Linden, it was announced in open court that the trial now will likely take place beginning April 14, with jury selection taking up much of the month of March. The defense attorney’s health situation again was named as the catalyst for the change of dates. The next appearance for readiness and settlement where attorneys discuss any new matters that could affect the case scheduling and or outcome is set for Monday, Feb. 3, in Melikian’s Dept. 2 courtroom in downtown Placerville. As the judge questioned Davis last week as to his understanding of the reasons for yet another delay, and exacted the defendant’s responses, the man who has sat waiting for freedom for a crime he insists he did not commit, answered, “Yes, Your Honor,” and “I understand, Your Honor,” as his attorney sat at his side.

Sharing traditional home buying guidelines

rian was my first new client call for the 2020 New Year. He and his wife, Sandy, made a New Year’s resolution to be in their own home by Christmas 2020. They had shared their home buying resolution with family on New Year’s Day and Brian’s dad suggested they call me for advice on how to get there. They were excited, overly optimistic and willing to do whatever was required to buy a home this year. They also had little savings, some previous credit issues and didn’t have a clue as to the complexities of the home buying process. They were, however, the type of buyers I most enjoy working with because they reminded me of me and my first home purchase. It was my uncle who referred me to his trusted real estate broker, Audie Moore, when I was 23 and wanted to buy my first home. It took eight months but Audie eventually had me into my two-bedroom, 800-square-foot bungalow. The price was $18,000 and with

an 8 percent interest rate my mortgage payment was $250 a month, including property taxes and insurance. During my first meeting with Audie I sat in his office and listened. “OK, kid, so you want to buy a home. That’s not going to be easy but Doc Smith has been a good client. I can get you into something. It won’t be much, but it will be yours. However, before I take you over to Bill at First National you need to follow my instructions. Are you willing to do that?” “Yes sir.” “OK whatever you have in your bank account isn’t enough. I want you to save half your paycheck and each week bring me a receipt showing you have deposited it with First National. If you miss a week I won’t have anything to do with you. Understand?”

Audie let me know up front that whatever he found for me “wouldn’t be much.” It wasn’t. It needed paint, carpet, new appliances and smelled musty. It did, however, qualify for an FHA 3 percent down payment loan, which at the time was the only loan I could qualify for. I remember him telling me that this was a short-term purchase that he would trade for something better in a few years. That happened. Often young millennials have enjoyed a privileged lifestyle provided by their parents. That’s about to dramatically change with the responsibility of a family and owning a home. Starter homes will not be the homes of their dreams and entry-level buyers must be willing to accept living in a home less desirable than their parents. Eliminate excess debt. Not only did I not have a down payment but I also had a car and student loan debt that prevented me from qualifying for a loan. Audie could have told me to come back after I had paid off the two debts but instead said, “Get rid of the car and pay off that student loan.” I did, trading my new Ford Mustang for a used Ford Falcon but with the $2,500 difference, I paid off my student loan. Today we often focus on managing debt and debt consolidation. The number one obstacle in preventing first-time buyers from buying a home is consumer debt. Stash cash. Audie insisted that I save half my paycheck and wanted proof. That requirement had some unintended consequences. I discovered that I could radically adjust my lifestyle and that short-term sacrifices will yield long-term gains. The most frequent complaint first-time buyers have regarding their purchase is they didn’t understand how much more money was required. Often agents and lenders will minimize expenses. Home inspections, closing costs, moving expenses and furnishing for a home always run higher than anticipated. Then the repairs and remodeling begin. Qualifying for a mortgage with me first. Before Audie walked me over to First National and introduced me to his FHA lender, he made sure I was prepared and qualified. A frequent question agents will ask when initially discussing a home purchase with a buyer is “Have you been pre-qualified?” If they haven’t, the agent may suggest a lender that would before they begin shopping for a home. That’s good advice but it’s better when the agent does their prequalification before referring them to a lender. Having a buyer’s complete financial picture is invaluable when helping them make the best decisions. Audie Moore would go on to become president of the state association of Realtors. That same year I received my real estate license. My $18,000 purchase is now valued at $200,000 and the average student loan is $37,000. The practice of real estate has also seen many technological advances in the last 45 years but a successful first home purchase is often the result of the traditional value of personal commitment.
