AFTER OUR OFFICE MOVE AND THE REDESIGN OF OUR MAGAZINE AND DIRECTORY, AND WITH 3 NEW DIRECTORS ON THE MDBC BOARD, WE ARE ALL SET TO INCREASE MDBC’S EXPOSURE DURING THE SECOND HALF OF 2012. Dear MDBC members and friends, Welcome to the re-designed MDBC magazine. By now you have also seen the new MDBC Business Directory 2012/2013 which was launched late June. Thanks to Lisette Scheers from La Scheers Co. and the MDBC team, the Directory and Magazine has been made more modern and up-to-date. The design changes will increase readability, accessibility and visual appeal. More than just functional, the new layout allows us to provide summaries, information on each section and to better distinguish sections. 2012 has been a very active year so far with a wide variety of events which saw an emphasis on information sharing, visits and networking. At the end of June we had our Annual General Meeting over Financial Year 2011 which was followed by the launch of the Directory.
In April, in between all these events, we also had to take care of the MDBC office move. Thanks to Intermovers, Adrenalin, Markant and Silverstreet, the move went smoothly. Do visit us in our new premises! I would like to take this opportunity to say thank you and good-bye to two departing Directors of our Board. Bas van den Berg has returned to Holland for a very interesting assignment at Friesland-Campina and Deputy Head of Mission of the Netherlands Embassy, Jan Soer will soon retire after a highly successful diplomatic career. I would like to express the gratitude of our Board for the valuable contributions both have made to the MDBC over the last couple of years. After our recent Boardmeeting, we can also welcome three new Directors to the Board: Joos Louwerier from ING, Michael Brouwer from Silverstreet and Wim Botermans from RB Lifescience. I
have succeeded Bas as the Vice-Chairman, while Datin Sandra van Hellemond has succeeded me as Treasurer. We all look forward to an exciting second half of this year, which will, among many events, include our MDBC Sustainability Awards 2012 in the 4th quarter. VICE CHAIRMAN REMCO KOSTER

AGM FOR FY 2011 & LAUNCH OF THE MDBC BUSINESS DIRECTORY 2012 / 2013 27 June, MDBC launched the new MDBC Business Directory 2012 / 2013. Held at the KLIX Lounge of the Parkroyal Kuala Lumpur Hotel, the launch was part of a double event program with the 15th MDBC Annual General Meeting held immediately before. The new Business
Directory features a redesign by La Scheers Co. (You may have noticed, the MDBC Magazine is also sporting a brand new look. This is all part of our efforts to improve the readibility and visual appeal of our publications for our members.) After the formalities of the
AGM, members were greeted by a fun and festive football themed atmosphere at the KLIX lounge. After a brief introduction which included thanks to the individuals and groups that made the publication of the directory possible, the actual launch formalities began. Next to the mini penalty shootout which had been set up, the new directory patiently waited for its unveiling, covered in 9 separate black pieces. 9 VIPs were invited on stage and tasked with scoring a goal before they could remove a piece of the black cover. With the crowd cheering them on, the VIPs were able to successfully score their goals and unveil the new directory to attendees. MDBC Executive Director Marco Winter also took the opportunity to introduce the MDBC Team. We bid farewell to long time team member Carmen Khong and welcomed her successor Bernardin Manen.

VISIT TO MARKANT OFFICE FURNITURE AND SIME DARBY PLANTATIONS - CAREY ISLAND
MDBC Members and student interns were invited to a unique double event on 20 June towards the east Coast near Klang. First, a visit to Markant Office Furniture in Jenjarom, where Markant manufactures high quality office furniture and ergonomic accessories. The visit included a briefing on company history and operations. Markant has a very modern office that doubles up as a showroom and a production floor that is mainly for assembly. The second event was a visit to Sime Darby Plantation at Carey Island. Sime Darby is one of the largest palm oil producers in the world. The drive was met with kilometres of palm oil trees along the way and our . The first stop was at the plantation where we were educated from pollination to harvesting of the Palm Oil fruit. We also had the opportunity to taste palm fruit. Sime Darby also shared their efforts in maintaining / developing the utilization of animals for bio control of oil palm pests. This included the Tyto Alba or barn owl that was brought out for guests to greet. Sime Darby has been utilizing barn owls as a natural pest controller for their plantations locally. Then we proceeded to the refinery where we were educated on the purification process. This event served as a unique experience for members and student interns alike who learned firsthand the upstream and downstream elements of the palm oil industry.

DIALOGUE INTERNATIONAL TAX PERSPECTIVE ON MALAYSIA MY 2 ND HOME
Text: Barend van Drooge and Gene Kwee of VoskampLawyers Some of you may have heard about the Malaysia My Second Home Programme (‘MM2H’). MM2H offers benefits to foreigners who wish to settle down in Malaysia. While none of the benefits offered in Malaysia are disputed, other countries may take different views when establishing their own taxing right.
Example As to provide an example: a Dutch couple that just retired wants to leave the dreariness of rainy Holland behind to relax and enjoy the sun in Malaysia. They apply for and are granted the MM2H status, and they remit their pension payments to Malaysia to ensure a comfortable lifestyle.
In this article we set out some international tax considerations to take into account when settling in Malaysia under the MM2H, and which may ensure you that your stay in paradise is not unnecessarily or unexpectedly disturbed by tax authorities from other jurisdictions.
They buy a nice house in Penang and ship over one of their cars. Furthermore, the couple still have their children and grandchildren living in the Netherlands and of course they want to be able to visit them often, especially during the summer holidays.
Benefits of MM2H In brief, the MM2H programme offers a renewable, ten - year, multiple entry visa for qualifying applicants. One of the main benefits is that the applicant receives a Malaysian residence permit without having to work in Malaysia or spend a minimum amount of days there. Furthermore most of the benefits of employment pass holders apply equally to the MM2H crowd. Finally, MM2H offers several tax benefits, such as tax exemptions on foreign pensions remitted to Malaysia and import duties of bringing in a personal car.
Therefore they decide to keep their house in the Netherlands unoccupied, so they can come over whenever they want. To stay comfortable when in their Dutch home the couple retain their car, their newspaper subscriptions and cable tv, etc etc. The couple spends around 4 months per year in the Netherlands.
Consequently, it is no surprise that the programme has been popular, especially with seniors who after a long life of hard work wish to retire in Malaysia or spend extended periods there.Contrary to popular belief, just because Malaysia allows one to stay in Malaysia without a minimum or maximum number of days does not mean that other countries have their own interpretation of who they deem to be subject to based on their own rules, or even based on tax residency.
The above may sound familiar. Even more so, the above scenario is actually based on a recent court case involving a retired couple living in Switzerland (the mechanics apply similarly for other countries, including Malaysia). In this case the Dutch court ruled that the couple had retained their “centre of their vital interests” in the Netherlands and were therefore considered tax resident in the Netherlands for Dutch tax purposes and taxable on their worldwide income. Tax residency In many countries tax residency determines taxing rights on income for individuals. Whether or not you are a tax
resident is typically based on domestic law. However, on this basis it is possible to be a tax resident of more than one country at the same time. In that case the provisions of the relevant tax treaty (if applicable) will determine which country can treat the individual as a tax resident. Under the tax treaty between Malaysia and the Netherlands, prominent consideration is given to where the person has a permanent home available to him / her. If this is available in both countries then the “centre of vital interests”, i.e. where the person’s personal and economic relations are closets, will be the determining factor. This “centre of vital interests” is determined on various criteria, including length and purpose of stay in both countries, energy usage in your respective homes, where your immediate family resides, where you have social contacts and memberships, where you work, where your assets are and where you spend your money, where you have subscriptions and insurance policies, where you go for medical consultation and even from where you depart for your holidays! Conclusion The above shows that there are several tax considerations when living in Malaysia as a foreigner and these apply both for retirees and working professionals. While we specifically used tax residency in the Netherlands as an example, this principle applies similarly to most countries worldwide. Therefore, in order to fully enjoy your MM2H status and ensure that you are taxed only in Malaysia, you should make Malaysia not your second home, but your first! MDBCONNECTS · 2ND ISSUE 2012

STUDENT INTERNSHIP PROGRAM THE INTERN INTERVIEW: Lisanne Veltman 3rd year student intern Lisanne Veltman from the University of Applied Sciences Windesheim is currently in Malaysia to do her internship with MDBC member company Philips. This International Business and Languages student works in the Consumer Lifestyle department and reports to two marketing managers. “My internship consist of two projects. I had to find out Philip’s current market position compared to its competitors. For several weeks I did a lot of mystery shopping, survey on consumer behaviour and benchmarking which all led to some recommendations that Philips can use to improve their market position. Currently I am helping out with some in-store marketing activities for Philips Saeco. “
Having heard of the MDBC and after attending an information gathering at her university, Lisanne said that she did not need much time to think about joining the MDBC Student Internship Program. Having been in the country previously on holiday, Lisanne was excited to return and this time experience the working culture. “To work in an international business environment, to be able to communicate in three modern foreign languages in a professional manner and to be able to empathize with different cultures in order to support the business process surrounding international business is what my studies are all about.” She added, “My colleagues are very friendly and they really make me feel part of the team. Doing my internship at Philips Malaysia is definitely one of the best decisions I made so far!“
STUDENT VISITS During the first half of the year, many student groups from the Netherlands visited Malaysia for fact-finding and research projects. Upon arrival, most groups receive an extensive introduction on Malaysia by the Netherlands Embassy and MDBC We welcomed students from the Universities of Amsterdam, Rotterdam (twice), Leiden, Breda and Twente, from a variety of study areas. Some student groups also visit MDBC members during their stay, such as Eurogain (picture below). With the University of Twente’s Mosaic visit, the students were joined by Dr Anne Flierman, President of the Executive Board (picture bottom).
SIP BRIEFING Specifically organised to share experiences from current internship companies and students, several interested MDBC members attended the Student Internship Program (SIP) briefing in June to gather ideas on the opportunities which SIP can offer their companies. MDBC’s SIP Manager Jolande Jonge Poerink and Intern Tom van Berkel kickstarted the briefing by providing the SIP introduction and processes. Marius Bremmer, Coordinator International Placements Office at longstanding MDBC Partner Hanze University Groningen, was present to give details in internships from the University’s point of view.

Students Daniel Haamke (GAB) and Manuel Pit (AkzoNobel) gave additional input on their responsibilities for their respective companies. With all these students coming from different universities and study areas, the presentations gave a wide variety of input and ideas. The February 2012 intake included placements in Malaysia for not less than 50 Dutch student interns, while for the September 2012 intake we expect to confirm at least 40 placements. EU Ambassador and Head of Delegation, H.E. Vincent Piket, presented the opening remarks while H.R.H. Norodom Arunrasmy, the Ambassador of Cambodia closed the event. The debate was followed by the lunch reception to mark Europe Day. sion: “The EU and EU firms are world leaders in tackling climate change and green business. We want to engage with emerging economies including Malaysia, to support climate actions and technological development. And we want to promote green business dynamics, as green growth means new investment and job creation.” EUMCCI General Manager Minna Saneri highlighted the significant scope for EUMalaysian cooperation in green technology. “This Mission was a great opportunity to discuss and explore the best environmental, economic and business decisions for Malaysia and to use the expertise, experience and the knowledge held by Europe to embrace a greener development path.” The next EUMCCI Trade Mission to Finland and Estonia in September will focus on the ICT sector and cleantech.

LET’S GO FURTHER ON ONE LITRE OF FUEL. We must learn to use energy more efficiently. For 25 years, the Shell Eco-Marathon has supported teams worldwide who explore ways to maximise fuel economy. This year, the Shell Eco-Marathon will be brought to Asia for the first time. It will be held in Kuala Lumpur, Malaysia and will feature many teams from across Asia. Last year’s winner went 3,771 km on the equivalent of one litre of fuel. This spirit epitomises our relationship with car manufacturers, finding ways to make cars more efficient. And is typical of our ambition to help build a better energy future. Let’s go. www.shell.com/letsgo
GREEN BOARD
SHELL’s ECO-MARATHON THE CALL for greater energy efficiency among nations becomes stronger than ever We live in what is described as an era of volatile transitions; a zone of uncertainty where energy demand surges with rapid growth and development, energy supply struggles to keep pace, and environmental tensions intensify. By 2050, global demand for energy can triple that of its 2000 level, with developing nations entering its most energy-intensive phase of economic growth, further industrialising, urbanising, building infrastructure and increasing the use of transportation. Here in Southeast Asia alone, as one of the fastest growing regions, the number of vehicles is expected to triple and reach 92 million by 2030. Faced with this scenario, the call for greater energy-efficiency among nations, communities and individuals becomes stronger than ever. As we continue to move more people and things than ever before, demands on mobility will increase. Shell constantly finds innovative ways to help move the world’s growing number of people and goods safely, efficiently and with reduced impact on the environment. Shell’s “Smarter Mobility” programme includes developing more energy-efficient fuels and lubricants; investing in lower carbon alternatives; offering driver’s fuel-saving tips; working in technical partnerships; and helping to reduce CO² emissions from road-building. Amongst the programmes promoting smarter mobility among today’s youth is the Shell Eco-marathon, the international fuelefficiency competition that challenges students around the world to design, build and test energy-efficient cars that can achieve the farthest distance using the least amount of energy and producing the least amount of CO² emissions.
All the Shell Eco-marathon Asia 2012 participating cars lined-up on the Sepang track Below left: Battery Urban concept electric car made from plywood by students from University Sains Malaysia (USM)
Shell Eco-Marathon What started as a friendly wager between Shell employees over who could travel furthest on the same amount of fuel, the Shell Eco-marathon has become a significant event against a backdrop where world energy demand is set to grow exponentially, making it critical for energy companies, the transport industry, businesses, governments and inventors of the future - like the youth participants - to work together to meet the mobility challenges of the future. Held at three locations around the world (Houston, Rotterdam and Sepang Malaysia International Circuit), cars enter one of seven categories to run on conventional petrol and diesel, bio-fuels, fuel made from natural gas (GTL), hydrogen, solar or electricity. As the world’s future car manufacturers and designers, it is hoped that Shell Ecomarathon’s youth participants and the smarter driving techniques and smarter automobile technology they develop through the competition will, with time and effort, lead and shape tomorrow’s transport landscape. There remains consistent proof that changes will emerge on the maximising of fuel efficiency as displayed by the students; the best run at Shell Ecomarathon Asia 2012 was a mileage of 2,903 km/l – the equivalent of driving from Kuala Lumpur to Hanoi, Vietnam!
Smarter Mobility Stakeholder Dialogue To ensure government policies merge with that of key stakeholder involvement, the Shell Eco Marathon in each location also hosts a Future Energy, Smarter Mobility Forum, which invites senior policymakers and stakeholders to discuss issues relating to smarter mobility, sustainable transportation and city planning. Panel discussions focused on current and future energy challenges and potential solutions. The End Game The essence of smarter mobility is to take a holistic view of not just the products – where the discussion on sustainable mobility can sometimes tend to focus on technological solutions, some of which, though important can take a long time. The focus should also look at the impact of infrastructure and importantly usage and behaviours. Near term actions which could complement these are sustainable biofuels which are already available as well as improvements in vehicle efficiency. Another area which is receiving increasing attention are individual choices and behavior - the way we drive and maintain our cars for example can make a significant impact on reducing emissions. The key challenge for developing countries is how to access the social and economic benefits of increased mobility without the associated increased emissions. MDBCONNECTS · 2ND ISSUE 2012

NL in MY NCH’s Biomass mission to Malaysia Last May, the Netherlands Council for Trade Promotion (NCH) organized a trade mission to Malaysia and Thailand with a focus on the Biomass sector. In Malaysia, the mission was coorganized by the Malaysian Investment Development Authority (MIDA)and the Embassy of the Kingdom of the Netherlands in Kuala Lumpur.
Several Dutch companies and institutes like Wageningen UR, Energieonderzoek Centrum Nederland (ECN) and Paques joined the mission to get a glance of the biomass developments in South East Asia. The program included a 2 day visit to the ‘EU - Asia Biomass Best Practices and Business Partnering Conference 2012’ in Kuala Lumpur, a briefing by MIDA and, a network reception at the Embassy, several biomass factory visits and individual appointments for each of the participating companies. All participating companies were positively surprised by the developments in the biomass sector in South East Asia and at the same time they see many opportunities where they can collaborate with local partners in the near future. Based on this successful trade mission, the NCH is planning a follow up mission in Q4 or Q1 2013 together with the above mentioned partners.
Visit of HRH Princess Maxima
NL Tax seminar
Her Royal Highness Princess Maxima of the Netherlands visited Malaysia on April 2 and 3.
Last May, decision-makers from over 20 companies from the Northern region gathered in Penang for the informative “The Netherlands as the European buisness hub for Malaysian companies - a Tax Perspective” session which was organised by the Netherlands Foreign Investment Agency (NFIA). The session provided the companies with the benefits of expanding their operations to Europe using the Netherlands as the gateway. While its attractive fiscal climate is one of the key incentives, international companies are also interested in the tax advantages of setting up R&D activities in the Netherlands.
In her capacity as the UN Secretary General’s Special Advocate for Inclusive Finance for Development, the Princess met with a delegation of Bank Negara in the beautiful new Sasana Kijang complex (picture right), with Deputy Finance Minister Dato’ Lim and with HRH Prince Nazrin Shah (picture below right taken in his palace). Princess Maxima invited Malaysia to share its good practices in the upcoming G20 summit in Mexico, where the development of healthy, vibrant and stable financial systems will be discussed.
Speakers were Vinod Kalloe, director of international tax with KPMG Meijburg & Co, Karin Rancuret, NFIA’s South East Asia area director, and a spokesperson of CS Hui, a Malaysian high-precision electronics technology company that has already set up a manufacturing base there.
