first impressions of the new chairman Time has a way of moving quickly and before you know it, months if not years have passed you by. It seems just like yesterday that I was approached by Marco Winter and H.E. Harry Molenaar (the Ambassador of the Netherlands), to consider taking up the post of Chairman of the MDBC. That was some eight months ago, and I still recall the lunch meeting with Marco and H.E. Harry Molenaar at a café in Ampang. The meeting went well; I immediately felt comfortable with the two gentlemen, especially by their informal and open approach – a Dutch disposition I have been accustomed to during my 30 years with Shell. I also consulted my predecessor, the late Dato’ Jaffar Indot, and following this meeting and with the strong support of my wife, I agreed to accept the Chairmanship of the MDBC, effective January 2014. The first six months have been a continuous learning experience for me. I had not realised just how active the MDBC is. When I first met Marco, I was persuaded by his assurance that it would not be that taxing on my time, with only about six meetings a year. On hindsight, I think Marco had somehow forgotten to advise me of the many events that MDBC and the Dutch Embassy organise,

not to mention the many emails that I have to attend to as well. The latest saga with the EUMCCI has also been quite challenging. So it goes without saying that after only six months in office, MDBC have taken up more of my time than I had envisaged. Having said that, I must however confess that I do find all these organised events and interactions very interesting, informative and dare I say, refreshing. Indeed, MDBC has opened a new window; a window that adds a new dimension to my life. As the saying goes, one doesn’t stop learning, no matter how old or how much one has travelled the world. My 30 years journey with Shell started in Miri, Sarawak where I spent almost 15 years, and then to Holland twice, spanning a period of 3 years in Assen, and 4 years in The Hague. So I have been widely exposed to the Dutch and do appreciate the culture and some of the idiosyncrasies of the Netherlanders. I do miss the beautiful Dutch spring blooms, especially the tulips at Keukenhof, but I can’t say I miss the Dutch cold and wet winters that chill you to the bones. My time in Shell also took me to mystical Cairo where I headed Shell Companies in Egypt for almost 3 years, before retiring in 2008. After 5 years of retirement from Shell, I am happy to resume

my interaction with the Dutch fraternity and their business partners, through MDBC. I am still considered a newcomer, being shown the ropes by Marco and the MDBC Board members. Thanks to Malaysia’s sustained economic growth, the positive bilateral economic relation, the excellent working relationship we maintain with the Netherlands Embassy, government agencies, trade organisations, and last but not least, all of you - our invaluable member companies and our wide network, I have no doubt MDBC will continue to grow from strength to strength. As with previous years, we have in store another full calendar of events for 2014, so I look forward to meeting more members during the next few months. Zainul Rahim, Chairman

INTERCHAMBER WITH MABC

VISIT TO THE STAR MEDIA HUB

MDBC held its annual interchamber event with Australian colleagues (MABC) on 27 March at the Australian High Commission. Attendees spent the evening in a heart to heart talk with Monitar Tan, a qualified naturopath from Blackmores Malaysia, on how to manage and maintain good heart health by adopting natural therapies including dietary, lifestyle and natural supplements. Topics like cholesterol and blood pressure were highlighted.

MDBC members were invited for a special visit to The Star Media Hub (SMH) to get a behind the scenes look at what it takes to produce Malaysia’s leading English daily ‘The Star’. Located in Bukit Jelutong, Shah Alam, the SMH spans across 9.5 acres of land and houses a newsreel warehouse, prepress Computer to Plate system, four printing press lines and a sophisticated mail room system, and is the main printing plant for the newspaper with a daily print run of 300,000.

Recently, they upgraded their Goss Colorliner newspaper presses. This upgrade to state of the art presses was made possible through an extensive configuration by Dutch company and MDBC member, Q.I. Press Controls, as explained by its Area Sales Director Asia Pacific, Job van Hasselt.

Also speaking that evening was Jan Beltman (Managing Director, Markant Office Furniture), who was visiting from The Netherlands. Jan gave an interesting presentation on the dangers of sitting all day long. Light refreshments and networking followed the talk.

As the most progressive state in Malaysia, Selangor has been in the news for different reasons, varying from water rationing to its constant improvement of the investment infrastructure, inclusive of the South Klang Valley Expressway, the Pulau Indah Industrial Park and Halal Hub. In 2013, Dutch companies invested RM 113 million in Selangor which was a unique surge in the long standing investment relations with The Netherlands. A large percentage of MDBC members are based in Selangor. This

is not only for logistical reasons in the west-side of the state, with closer access to Port Klang, but also because many manufacturing and services companies are based in other areas of the Klang Valley. Special Event with Prof Jan Peter Balkenende & Launch of MDBC Business Directory 2014/15 Last May, MDBC held a special event with the former Prime Minister of The Netherlands, Prof. Jan Peter Balkenende. Prof Balkenende served as Prime Minister from 22 July 2002 to 14 October 2010. After his premiership, Prof. Balkenende retired from active politics and became Partner Corporate Responsibility at Ernst & Young, as well as a professor of Governance, Institutions and Internationalization at the Erasmus University Rotterdam.

Prof Balkenende also brought together the Dutch Sustainable Growth Coalition (DSGC), an initiative aimed at giving further impetus to business growth that links financial and economic results with environmental and social returns. DSGC comprises eight of the biggest multinational companies in the Netherlands: AkzoNobel, DSM, FrieslandCampina, Heineken, KLM, Philips, Shell and Unilever.

The speaker stated his pleasure that the Dutch entrepreneurial mentality continues to this day and can be seen in the presence of many Dutch companies ranging from world-famous multinationals to SMEs and start ups. “With all our expertise and knowledge, we can be proud to be Dutch,” Balkenende said, but at the same time he acknowledged that this is the age of Asia. Clearly seeing a shift from West to East, and the vitality and fight for wealth on this side of the world, Prof Balkenende recommends that we be aware of the changes, and to do business in Asia in the right way, with the key words innovation, sustainability and entrepreneurship.

During his talk, which included many anecdotes, Prof Balkenende touched on the long history of the Dutch in Malaysia. Starting back in 1606 when the VOC (Vereenigde Oostindische Compagnie or Dutch East India Company) made a formal pact with the Sultan of Johor, the Dutch have been doing business in Malaysia.

To the delight of the 80 guests, Prof Balkenende promised to advise current Prime Minister Mark Rutte “do not forget Malaysia!” Following Prof Balkenende’s talk, MDBC launched the new Business Directory for

DSGC MNC’s in Malaysia AkzoNobel, Dutch Lady, GAB/Heineken, Philips and Unilever participated, together with Malaysian MNCs IOI, Petronas, KL Kepong, Basis Bay, UEM and Builders Biomass. The Malaysian Ministries of Natural Resources and Plantations, and Matrade and MIDA also joined the discussion, which focused on defining common approaches and finding new alliances in governmental and corporate approach to sustainable business

DOUBLETREE TAKES PART IN HILTON ’S GLOBAL CAREER EVENT DoubleTree by Hilton Kuala Lumpur has taken part in Careers@Hilton Live: Youth in Hospitality Month, Hilton Worldwide’s largest ever global career event showcasing to young people the many opportunities available in the hospitality industry. Throughout the month of May, Hilton Worldwide hotels and corporate offices around the globe were hosting hundreds

of events to inform those looking for employment, including young people, about the vast array of exciting opportunities available to all in the hospitality industry. This event is part of Bright Blue Futures, a global program that encourages Team Members to donate their time and expertise to help young people achieve stability and bring hope to their communities, preparing them for a brighter future.

DoubleTree by Hilton Kuala Lumpur hosted a ‘Cookie Hunt’ event which saw 30 children from Sekolah Kebangsaan Sentul 1 and HOPE Worldwide on an exciting excursion to the hotel’s ‘back of the house’. The children, aged 11 to 16 years old, were given a line-up of fun activities which began with a welcome note from General Manager Ian Barrow. They were then ushered to various departments such as Food & Beverage, Kitchen, Housekeeping and Front Office where activities such as decorating of DoubleTree by Hilton’s signature chocolate chip cookie and cupcakes, setting up of banquet tables and making of beds at the guest rooms, took place. Ian Barrow said, “Young people continue to face challenging employment prospects, so it is more important than ever to make sure they receive information and advice about the options available and the skills and attributes they will need once they embark on their chosen careers. Empowering and nurturing youths are also part of DoubleTree’s long standing CARE culture to create value to the local community.”

EXPATRIATE SERVICES DIVISION ONE STOP SERVICE DELIVERY This June, the Prime Minister of Malaysia YAB Dato’ Sri Mohd Najib Tun Razak officiated the new Expatriate Services Division (ESD), aimed at streamlining and enhancing immigration service delivery for expatriate talent, especially those with expertise needed by priority sectors spearheading Malaysia’s economic transformation. The transformation of the ESD was executed through a joint cooperation between the Ministry of Home Affairs, Immigration Department and TalentCorp, marking another milestone in the enhancement of public service delivery in immigration services. It offers an integrated service covering expatriate needs for Employment Pass, Dependent Pass, Social Visit Pass, Professional Visit Pass and Resident Pass-Talent. Acting as

a one-stop centre for expatriates, the ESD provides a single channel for expatriates or companies to submit all expatriaterelated immigration matters via an integrated data platform which enables online applications. This customer-centric approach will reduce the processes for expatriate applications. All immigration services relating to expatriates will now be dealt with at the ESD, without having to go to different divisions for different products. Immigration Malaysia is commited to a client charter of 5 working days to process employment pass applications by companies registered with the ESD.

NFIA’s 1st “investment In the Netherlands“ talk in Ipoh The Netherlands Foreign Investment Agency (NFIA) held its first investment seminar on the Netherlands in Ipoh, Perak on 9 June 2014. The event, held at FMM’s Perak office, was jointly organized by FMM Perak. Perak is a natural choice as it is the second largest state in Peninsular Malaysia; it also has a number of companies exporting to Europe, two of which are present in the Netherlands (Taiko Marketing and KL Kepong). SARAWAK GOVERNMENT COLLABORATES WITH SHELL AND PETRONAS TO CONSERVE ENVIRONMENTAL BIODIVERSITY to help facilitate the development of strong and sustainable communities.

The Sarawak Government, in partnership with Shell Malaysia and PETRONAS, charted a significant milestone with the earth breaking of the Piasau Nature Reserve in Miri recently. Newly appointed Head of State, Pehin Sri Abdul Taib Mahmud officiated the earth breaking of the proposed development project of Piasau Nature Reserve. The momentous event was held at the former Piasau Camp, witnessed by Sarawak Chief Minister Tan Sri Datuk Amar Adenan Satem, PETRONAS President and CEO Tan Sri Dato’ Shamsul Azhar Abbas, Shell Malaysia Chairman Iain Lo and Cabinet

ministers and community leaders. “I would like to commend Shell and PETRONAS for having the foresight and acting as the catalyst in the project. They are not only the main sponsors but will remain very much involved in the development of this Nature Reserve,” Adenan said. Iain Lo added that sustainable development is about operating the business in a manner attuned to community expectations, with a shared responsibility with government and society

on Commodities between senior Dutch and Malaysian government officials to discuss outstanding issues and areas

for collaboration in the timber, palm oil and other commodity sectors. Minister Dijksma also voiced her hope that the outstanding FLEGT Voluntary Partnership Agreement negotiations between Malaysia and the EU will be concluded soon this year. In addition to timber issues, Minister Dijksma also touched on the importance of the palm oil trade between Malaysia and the Netherlands and in particular on the sustainability aspects of the trade. On agriculture issues, Minister Dijksma had a fruitful courtesy visit with her Malaysian counterpart, Dato’ Sri Ismail Sabri bin Yaakob at the Ministry of Agriculture & Agro-based Industry. The Ministers reflected on the various areas of mutual co-operations they have had in the past; exchanged views and underlined opportunities of future mutual areas of co-operation in the field of horticulture, dairy and fisheries sector. Both Ministers support the idea of a frequent dialog and bilateral exchange and agreed to the formation of a Joint Working Committee for that purpose.

In addition, Minister Dijksma also visited the Sungai Tekala Forest Reserve in Selangor to observe sustainable forestry management practices and the timber certification process. She also attended a lunch meeting with representatives from the Malaysian Dutch Business Council, Malaysian companies and Government agencies at the Residence of the Dutch Ambasssador. AN INSIDE LOOK: &samhoud - NUR HAMURCU AND WOUTER VAN DER WEIJDEN In this edition of An Inside Look, MDBC spoke with &samhoud Managing Partners Nur Hamurcu (NH) and Wouter van der Weijden (WW). These gentlemen are responsible for &samhoud Asia and are the first point of contact for most clients. &samhoud was founded 25 years ago by Salem Samhoud. A vision driven, self proclaimed “usual unusual company”, they started out as a management consultancy firm and have since ventured out into additional industries such as food, hospitality and personal development. MDBC: Please give us a brief background about yourselves and how you ended up at &samhoud. NH: Born in Turkey and raised in The Netherlands, it was four years ago that I left for Malaysia with my wife Sonja and daughter Eliza, to become the Managing Partner of &samhoud Asia. After studying Economics in Amsterdam, I was looking to work for a company where I could strike a balance between business and society. A company with a philosophy and business model that would contribute to a better world for all. I found this at &samhoud, where we strive to realize our mission, which we call our higher goal: ‘Together we build a brighter future. We achieve breakthroughs by inspiring and connecting people’. After sixteen years, this higher goal why I still tremendously like working for &samhoud. WW: After my studies and work led me from The Netherlands to the United States, Poland, Austria and Sweden, I came to Malaysia two years ago with my wife Vanessa and our children Silas, Ingmar, and Flo. I joined &samhoud 17 years ago and from the beginning I have always been a big fan of our business philosophy. NH: Who we are and how we do things are based on our three core values: intensity, authenticity and friendship. Over the past few years, we have been serving multinationals (MNC’s), government linked companies (GLC’s) and local companies. Our client base includes TNT, Ericsson, MontBlanc, Huisman, Axiata, Malaysia Airports, Bank Rakyat and Hong Leong. MDBC: What made you decide to come to Malaysia and open up an office here? Why Asia but not Africa or Latin America? WW: For us, Asia has the biggest potential. The market is booming, there is a lot of energy and excitement here, and abundant opportunities. The demand in Asia is huge, with more than 4.2 billion people, which

NH: There are three main reasons why we chose Kuala Lumpur as our hub in Asia. First of all, I believe that to be a successful entrepreneur you need a happy family life. And me and Sonja wanted to live in an authentic and very diverse society. Second, Malaysia lies in the heart of Asia and is very well connected to the region. Third, it is a good choice with our mission in mind. Malaysia is still a developing nation, which gives us the opportunity to assist local leaders to grow holistically and exponentially with our expertise and approach. MDBC: Could you share some of your experiences in setting up this office? NH: In principle, Malaysia has a very open attitude towards foreign investors and entrepreneurs. Malaysia likes to position itself as a foreign investment hub for the region. In reality, as we probably all experienced doing business in Malaysia, the administrative process in setting up an office is quite challenging. From arranging the operating license to opening a bank account: it all has been a hassle. In that respect, Malaysia can learn a lot from Singapore. But, ever since we are up and running, business has gone quite smoothly. MDBC: How difficult was it to secure local clients? What were some of the biggest hurdles in securing local

NH: In the beginning, it was very tough. Business is done on the basis of trust. To gain trust, it is very important to invest in the relationship. And a relationship needs time and energy to materialize. WW: The speed to get things approved and the complexity of the decision-making process in various organizations are very common hurdles. Patience and persistence are crucial qualities to secure clients eventually.

MDBC: What are some of the most common management challenges that Malaysia / Malaysian companies face (let’s say Top 3)? WW: Building a great place to work. Employee engagement and loyalty in Malaysian companies is relatively low. The main priority of most organizations is to make a profit. And in the quest of building a profitable business, building a great place to work is not very high on the priority list. This weakens the sense of belonging and the sense of unity, ultimately resulting in a high turnover rate. NH: Creating a meaningful brand/customer experience. Most relationships between Malaysian organizations and their customers are very transactional. Organizations rarely make their customers raving fans. In our eyes, a missed opportunity to create long lasting brand ambassadors. WW: Improving alignment and execution power. A lot of Malaysian organizations lack alignment of vision, strategy, culture and action. Organizations do invest time, money and energy in developing long term plans, but often fail to involve the right people in the process, resulting in less alignment and ownership. Further, organizations often fail to cascade the long term plans down to the operational level and anchor them in the culture. As a consequence, execution power is low. MDBC: How can Malaysia/Malaysian companies make a change? NH: First of all, Malaysian organizations should create a sense of urgency and ex-

citement for change. Without a clear case for change, people will not move. Second, leaders should take ownership of the change and mobilize the right people to embark on the change journey. WW: Third, Malaysian organizations should develop an inspiring vision and clear strategy for the future in a participative process. Fourth, all energy should be put into making the vision and strategy happen. This means cascading the vision and strategy down to operational plans and instilling a performance culture in the organization. Last but not least, Malaysian organizations should show and share the results with their stakeholders. MDBC: In 2012, Malaysia was ranked 7th out of 60 developing countries on KPMG’s Change Readiness Index. Where do you think the country will be by 2020? Are they taking the right steps? WW: I believe, the strength of Malaysia lies in its vision to become a developed nation by 2020. The road map and the disciplinary approach by PEMANDU, the Project Management Office of the Prime Minister’s Department, are impressive as well. Across the globe you will hardly find countries with such a clear ambition and disciplinary approach for execution. NH: Business will thrive and contribute by becoming regional champions. The road ahead will not be easy, but Malaysia has proven itself to be successful in overcoming huge challenges in the past. With that in mind, we have no doubt Malaysia will accomplish its vision in 2020. Joost van Alphen Joost van Alphen is a third year Logistics and Supply Chain Management bachelor student from Windesheim University of Applied Sciences. When offered a chance to do his internship with MDBC member and globally well known logistics provider, CEVA Logistics, Joost said it was an easy choice. This program is seen as a method to provide the customer an impeccable execution and it is also providing a standard in day-to-day business. The SCA consists of 218 different parameters which measures the maturity and level of professionalism of the operations. This standard implicates getting simple

things right, like 5S, visual management (signage), standard operating procedures, working instructions but also focuses on aspects of more complex elements like Scheduling, Productivity, Health & Safety, Security, Environment, Human Resources, Commercial and Financial Management. Based on the scoring of these 218 parameters, an operation can be qualified as “Developing, Basic, Advanced or Show Case”. In order to complete the internship, the operational standards have to be implemented and a plan needs to be drafted to sustain or improve the rating of the parameters. “I was responsible for assessing multiple customer operations and implementing the first assessment in Malaysia. This part makes the internship exciting and interesting; the changes you make as a team can be seen immediately. It gives you an opportunity to work closely with local colleagues on different levels in the organization, but it also means that you have to take responsibility for the end result. During implementation, things do

When asked about what it was like to work here in Malaysia where you are exposed to a variety of people from different backgrounds, races and religions, Joost answered, “This makes the internship more challenging and attractive. In order for you to complete the job, you have to understand and manage different perspectives. It is nice to be exposed to these different cultures and to understand better their behavior and their beliefs.” Joost also added, “The people in the company are really friendly and openminded; they are willing to spend time with me and show me around. During lunch hours and even after work, colleagues have brought me to places I would not have found in the tourist books. While exploring the great food and the environment, you are reminded of the big differences between Malaysia and Western countries. Sometimes it is sad to see what living conditions are like, but things are changing fast in Malaysia, and in a good way. The past 4 months have expanded my scope and experience and was really fun too; When there is possibility in the future to come back to Asia or Malaysia, I will definitely take that opportunity. The nice weather and friendly people make Malaysia a beautiful country to live in, but before coming back, I need to ensure that I graduate first!”

EU Doha-style debate on “ASEAN Should Be More Like the EU” The EU Delegation and the Asian Strategy & Leadership Institute (ASLI) co-organised a debate on “ASEAN Should Be More Like the EU” on 26 May. The debate centred on whether deeper integration, similar to the EU’s experiences, was the best way to safeguard ASEAN’s political and economic future. Advocates for the motion - H.E. Declan Kelly (Ambassador of Ireland), Dr Andreas List (EU Senior Coordinator for ASEAN) and Dr Lili Yulyadi Arnakim (Department of Southeast Asian Studies, University of Malaya) – testified that while the EU was far from perfect, ASEAN could seek inspiration from what has worked as well as its mistakes. The EU had inspired its smaller Member States to benchmark and improve their governance based on the more prosperous Member States.

Tan Sri Fong Chan Onn (former Minister of Human Resources), Mr Bunn Nagara (Senior Fellow, ISIS Malaysia) and Professor Ruhanas Harun (Department of Strategic Studies, National Defence University of Malaysia) – drew upon the different historical backgrounds and formation motives of both regions as the reason for ASEAN to pursue its own path of integration. ASEAN, they argued, was formed on the principal of mutual respect and non-interference. It took a peoplecentred approach, had never aspired for political unity and was unlikely to do so in the future.

EU meets Malaysian stakeholders on trade in legal timber In the margins of the latest round of the EU-Malaysia negotiations on trade in legal timber (the FLEGT/VPA negotiations), held in Kuala Lumpur on 20 - 21 May, the EU organised an Information/Consultation Session with Malaysian Stakeholders. The Session was hosted and chaired by Hugo Schally, the EU Chief Negotiator in the EU-Malaysia FLEGT/VPA process. More than 60 Stakeholders, including civil society members, attended the

event. The event had two main objectives: allowing the EU negotiators to inform the Stakeholders about the state of play of the process and the outcome of the latest round of FLEGT/VPA negotiations; and allowing the Stakeholders to present their views and concerns to the EU and contribute in informing the final stages of the process. After the event, Schally shared: “I have the feeling that Malaysian Stakeholders now have a much better understanding of

what the EU is trying to achieve in this process. At the same time, I personally have a much better sense of the many issues raised by the participants. I believe that open and transparent engagement with Stakeholders always pays back. We have learnt this lesson in Europe over the years and now no major legislative initiative and international negotiations take place without full engagement with Civil Society.’’

Daan Roosegaarde is a Dutch artist, entrepreneur and innovator. He has created an illuminated bicycle path with shining bricks, operating on solar energy, giving the impression of a Van Gogh painting. It was his work that inspired the Dutch Minister for Education in her speech on innovation, stating that every innovation starts with a dream. Visualizing this dream is the first step to its realization. This is just as true for entrepreneurs setting out to start a business in South East Asia.

Of course I am not familiar with the exact way that Roosegaarde set about creating his path, but I guess he started familiarizing himself with the do’s and don’ts of solar energy, the needs of the average cyclist, the composition of the bricks and of course the colours of the Van Gogh painting. He may have had to deal with copyright issues. And what about licensing from the municipality where he envisaged his project? I don’t know whether he started alone or had a partner? What a waste of a brilliant concept it would have been if Roosegaarde

would have been denied the use of the path because of licensing issues. How sad if a project like this faced bankruptcy as a result of legal battles over founder’s rights. As any dream evolves into reality, a wide range of issues become relevant, some of which can make or break the project. Starting up a business in Malaysia involves a similar process of identifying and fleshing out practical issues, but with a cross border aspect. For instance, knowledge about the people you want to do business with is essential. Their culture, their way of doing business and how to adapt to that are the bricks on which successful cooperation is built. I, for instance, am amazed by how much goodwill a few well-chosen words of Bahasa can bring my way. Factors such as the way one exchanges business cards and the importance of sharing a meal during or after business deals can really make a difference. Just a little research will inform you on how to deal with these issues. But when it comes to cross border legal and taxation issues, a little research isn’t enough. Each jurisdiction has a unique legal framework, and navigating these requires in depth knowledge and experience. I will name a few legal differences and developments in Malaysia of which investors thinking about entering the region should be aware. First, the Data Protection Act (DPA) dating from 2010 became effective from

15 November 2013, making Malaysia the first country in the ASEAN region to enforce such an act. The Malaysia government sped up the institution of this law after receiving 800 to 1,000 complaints per month regarding personal data being distributed to those who were not supposed to have access. Eleven sectors are classified as data users, encompassing the health, transport, direct sales and services industries. There are many specific rules that start-ups should be aware of; legal advice may be required as much is still unclear about the enforcement of the act. Singapore has also introduced a similar act, effective 2 July 2014, and it might be reasonable to conclude that other countries in the region will follow suit. Second, the Copyright Amendment Act 2012, which took effect from March 2012, introduces new provisions for the legal framework of voluntary notification of copyright. Regulation 5 states that notification of copyright can only be made by a citizen or permanent resident of Malaysia. This Amendment also offers the protection of compilations of data, thus clearing up issues regarding eligibility for protection. It is important to stay up to date with changes in the law and regulations that may affect day to day business, which is where legal advice comes in. Third, cross border insolvency. This is an area where Malaysia and Singapore have a shared legal history, as they both are based on UK law. Globalization has shown the need for cross border knowledge as well as cross border cooperation and harmonization on insolvency matters. When cross border business partners go bankrupt this may immediately affect your own business. Recognition of foreign insolvency orders and questions whether court rulings from, for instance, a Singapore court will also include Malaysian assets need legal expertise. These are some examples of laws that could influence the way entrepreneurs structure their new business in Malaysia. SKRINE hOW THE PDPA AFFECTS YOU! Text by Jillian Chia Yan Ping (Partner, Skrine) The Personal Data Protection Act 2010 (“PDPA”) was passed by the Malaysian Parliament in May 2010 and received Royal Assent on 2 June 2010. The PDPA came into force on 15 November 2013 by way of notification in the Government Gazette, with a three month sunrise period, which ended on 15 February 2014.

Protection Principles which have to be complied with when processing personal data. Non-compliance by a data user of any of the aforesaid principles constitutes an offence under the PDPA and the penalty includes fines or imprisonment or both. Certain principles are qualified by exceptions and exemptions as provided for under the PDPA. (Please see below.)

The PDPA governs personally identifiable data which is collected in respect of a “commercial transaction”. Recent proposal papers which have been issued by the Personal Data Protection Department have also clarified that employment related data will come within the ambit of the PDPA. The PDPA will however apply to parties though not established in Malaysia but uses equipment in Malaysia to process personal data otherwise than for purposes of transit through Malaysia.

RIGHTS OF DATA SUBJECT The PDPA confers rights on a data subject vis-à-vis a data user in relation to his personal data and the processing thereof. Such rights include: (i) the right to access personal data; (ii) the right to correct personal data; (iii) the right to withdraw consent to process personal data; (iv) the right to prevent processing likely to cause damage and distress; and (v) the right to prevent processing for direct marketing. Certain of the rights mentioned above are qualified by the provisions in the PDPA.

CONCLUSION The provisions of the PDPA are extensive in nature and grant data subjects a say over how their personal data is processed and used. The PDPA also imposes a wide range of obligations on data users in relation to the personal data collected. Upon the implementation of the PDPA, data users will have to change the way in which they process and manage personal data and to ensure that their business processes comply with the seven Personal Data Protection Principles.

“The carpet we developed together with a company from Holland called Desso,” van der Heide explains. “We added light to it; we have pixels in the carpet that can guide you through a space or create very interesting patterns.” Because the product looks like a normal carpet when the LEDs are off, van der Heide says it can be used to incorporate health and safety signage inconspicuosly into a building interior. “[When the LEDS turn on] in an emergency, they can lead you quickly to the exit,” he says. “These are very important applications that add a lot of new value to what light is in a building.”
