BOEM Hosts Public Offshore Wind Meeting

OCEAN CITY – Community members came out in droves this week to share their comments regarding an offshore wind project near Ocean City.

On Tuesday evening, the Bureau of Ocean Energy Management (BOEM) hosted the first of two in-person public meetings regarding a draft environmental impact statement (EIS) on US Wind’s offshore wind project. Lorena Edenfield, environmental protection specialist for BOEM, said the federal agency will continue to collect comments through Nov. 20.

“Tonight, we really are here because we want to hear what we need to be including in the EIS,” she said. “We did do some scoping last year to determine what we needed to include in the draft EIS, and that really informed the process.

So now we want to know how we did.”

Hundreds of people, many of whom shared their frustrations with the openhouse format, visited Ocean City Elementary School on Tuesday evening to view various informational posters staffed by BOEM subject matter experts and to share their views on the US Wind project.

Those in opposition said they were concerned the wind turbines being proposed for the offshore lease area would not only impact wildlife, including whales and birds, but offshore fishing. West Ocean City resident Alan Rittmeyer, captain of the Roncito, said he worries the wind turbines could interfere with radar and make it more difficult for boats to navigate through the area.

“The other issue is if you can’t navigate through them, you’ve got to go around them, which is going to cost you thousands of dollars more in fuel, if you even have the capacity,” he said.

Attorney Mark Cropper, representing several local marinas, also came to Tuesday’s meeting with exhibits showing the impact the wind turbines would have on fishing trips and navigation to local fishing grounds. He argued the proposed lease area would have a detrimental effect on the fishing community.

“My clients adamantly oppose the proposed lease area,” he wrote in a letter to BOEM. “The negative impact upon their businesses (and others in Ocean City and throughout Worcester County) is beyond description. If windfarms must be located off the east coast, they should be placed where the negative impact to the recreational fishing community can be minimized or eliminated.”

“We have an oceanfront property, and we are afraid the values are going to go down,” Burke Pieper said. “We’ve had it since 1975. It’s a rental property for us, but so many negative things have come out that people are not going to come back.”

Those in support of offshore wind say the proposed project supports renewable energy goals. They also argue there has been no scientific or environmental study that links wind farms to whale or bird deaths.

For its part, US Wind says it is on track to develop its offshore wind project off Maryland’s coast. Nancy Sopko, US Wind’s senior director of external affairs, said the company would continue to keep the community informed.

“Maryland has adopted very ambitious plans to develop offshore wind energy off its coast. US Wind is proud to partner with the state to develop its first offshore wind farm and put Maryland on track to achieving its goals,” she said in a statement Wednesday. “We’re pleased that BOEM has done such a thorough and comprehensive review of our federal permitting application. US Wind has talked to many, many residents across the state, including Ocean City, about offshore wind and our project plans and we’re confident that a large majority of Marylanders are supportive. We will keep the public informed every step of the way.”

As proposed, US Wind plans to construct up to 121 wind turbines, up to four offshore substation platforms and one meteorological tower within an offshore lease area located approximately 8.7 nautical miles from Ocean City’s shoreline and nine nautical miles from Sussex County, Del. If approved, BOEM reports the project could generate between 1,100 and 2,200 megawatts of renewable energy for the Delmarva Peninsula and support up to 2,600 jobs annually throughout the development and construction phases.

In late September, BOEM announced that a draft EIS on US Wind’s Construction and Operations Plan had been published, setting in motion a 45-day public comment period that includes a series of virtual and in-person public meetings.

Edenfield said comments collected from the public will be used to finalize the EIS, which could be released as early as next summer.

“At that point, the final EIS goes to our decision maker, and they will decide whether to approve the action as proposed, approve it with modifications, or to disapprove it,” she explained.

Education Officials Respond To School Safety Concerns

NEWARK – Education officials maintain that schools are safe and cite a “gross failure” in communication as the reason for the current discord between the school system and local law enforcement.

Following a trio of closed session meetings to discuss concerns shared

by Worcester County State’s Attorney Kris Heiser and Sheriff Matt Crisafulli, Worcester County Board of Education President Todd Ferrante this week responded to law enforcement. The letter, sent Monday, stresses that schools are safe, criticizes the way law enforcement officials have expressed their school safety concerns and reiterates the need for the task force created by the board last week.

“We now must find a way to move forward together, and you have the commitment of this Board that it intends to do so efficiently and productively,” the letter reads. “We hope that the Board has your commitment as well.”

In a statement the following day, Heiser and Crisafulli expressed their disappointment with the school board’s response.

“Unfortunately for the community, but perhaps unsurprisingly, school officials are once again outright denying that school safety issues exist, even after having been confronted with direct evidence and concrete examples,” the statement reads. “It appears that school officials are choosing to prioritize the appearance of school safety over actual school safety.”

On Sept. 21, Heiser and Crisafulli sent a letter to the school system outlining serious concerns about the safety of local schools. She and Crisafulli made clear last month law enforcement have ongoing concerns about the lack of notification they receive from school officials regarding criminal activity in schools. That’s despite the fact that a memorandum of understanding (MOU) between the sheriff’s office and the school system in August stipulates that school staff will report crimes to school resource deputies.

Ferrante’s letter acknowledges the meetings the school board held regarding the concerns and states the board concluded that very little could be agreed upon between the sheriff, state’s attorney and school system’s executive team.

“Specifically, the Board found that there is a gross failure in effective communication between the Partners and believes, without reservation, that this needs immediate attention and correction. Likewise, the Board is concerned that misinformation, not only between the Partners, but that has been conveyed to the community, has led to confusion and SEE PAGE 8

The Board welcomes constructive criticism with a goal of helping improve Worcester County Public Schools (“WCPS”), but the Board believes that the time, place, and manner of providing such criticism is a vitally important consideration when matters as delicate as school safety and parental and student rights are at issue. The Board fails to see how engaging in a truth versus fiction dialogue through public forums is helpful in maintaining school safety…”

The letter goes on to say that that dialogue may violate FERPA (Federal Educational Rights and Privacy Act of 1974), HIPPA (Health Insurance Portability and Accountability Act of 1966) and

IDEA (Individual with Disabilities Education Act).

“The Board agrees that the Memorandum of Understanding (“MOU”) between the Sheriff’s Office and WCPS needs be followed,” the letter from the school board reads. “Given the date of your letter of September 21st, the Board notes that the MOU was in effect for a total of 12 school days … The Board found, however, that the Executive Team/WCPS is not the only Partner that has failed to meet every expectation of the implementation of the MOU and looks forward to a time when all Partners can comply.”

The school board invites Heiser and Crisafulli to join the school safety task force they announced the creation of in a statement last week. The task force consists of school board members Elena McComas, Katie Addis and Bill Gordy as

well as Superintendent Lou Taylor, Chief Safety Officer Annette Wallace and the school board’s attorney.

“Shortly following this letter, you will receive an email with dates and times for the initial meeting,” the letter reads. “The initial meeting will be vital to firmly establishing the goals and procedures of the Task Force, determining whether additional staff/Partners should be invited to join the Task Force, and to begin work on matters that not only need to be resolved, but also for all Partners to gain a clear understanding of what specific improvements are needed from each Partner moving forward. After a date and time for the initial meeting is established, the Task Force will circulate the draft agenda and our Task Force members welcome your input on additional agenda items that should be a priority at the initial

meeting. We trust that moving forward all Partners share the same objective – to work in partnership, with honest and clear communication, and to do anything that is necessary to maintain a safe learning environment for students, faculty, and staff.”

The day after Ferrante’s letter was sent, Heiser and Crisafulli responded with a joint statement. They said they were disappointed with the school board’s stance.

“After waiting for over a month to receive any response, it is now abundantly clear that school officials plan to take no meaningful action to resolve the specific concerns law enforcement detailed for them during their presentation on October 4th,” the statement reads. “The Sheriff and State’s Attorney now urge the Board to immediately reconsider.”

According to the statement, law enforcement remain concerned that the pattern of minimizing safety concerns, excusing student misconduct without disciplinary action and failing to take precautionary measures will continue.

“The Board’s response does not outline any specific corrective actions the Board or school officials will take to comply with state law, it does not address the specific questions posed about school safety-related protocols, nor has the Board decided to accept law enforcement’s offer to provide regular updates to ensure they have full and accurate information about crime occurring in the schools,” the statement reads.

The school board has indicated the task force will be working through the issues presented to the board, facilitating strong communication, providing educational opportunities on the nuances of school law and serving as a liaison to the board. Heiser and Crisafulli don’t believe it’s enough.

“As it stands, the often-repeated conclusion of school officials that ‘schools are safe’ doesn’t make it so, and a socalled ‘task force’ comprised of all the same individuals with whom law enforcement has continuously discussed these safety issues for the past 4 years is not likely to suddenly become an effective solution,” their joint statement reads.

“Law enforcement would, however, be willing to consider participation in a task force with a membership having the demonstrated ability to effect positive changes within the schools.

“At this juncture, Sheriff Crisafulli and State’s Attorney Heiser remain dissatisfied with the safety situation in our schools and are actively discussing law enforcement’s options. The Sheriff and the State’s Attorney want to assure the community that school safety remains their utmost priority, and that their efforts in this area will continue undeterred until Worcester County attains the highest standard of safety within the schools.

Community updates will be provided by both the Office of the State’s Attorney and Worcester County Sheriff’s Office as they continue to work together to bring transparency and accountability in matters of school safety.”

Brief Filed In Knupp Dismissal Appeal

SNOW HILL – The Maryland Attorney General’s Office is requesting oral arguments be heard in a case that was recently dismissed in Worcester County Circuit Court.

Last Thursday, the Office of the Attorney General filed its brief with the Appellate Court of Maryland regarding the case against Tyler Mailloux, a local man whose traffic charges were dismissed in Worcester County Circuit Court in August over lack of jurisdiction. In their filing, Attorney General Anthony Brown and Assistant Attorney General Zoe Gillen White argued the circuit court erred in dismissing the criminal information.

“Here too, the criminal information was properly filed in Circuit Court, and the District Court was consequently divested of jurisdiction over all 17 charges,” the brief reads. “The circuit court erred in dismissing the criminal information. The State respectfully asks the Court to reverse the judgment of the Circuit Court for Worcester County.”

In a motions hearing Aug. 18, Judge Brett Wilson granted a motion to dismiss the case against Mailloux in Worcester County Circuit Court over lack of jurisdiction, although he noted that charges could be refiled in district court. Immediately following the ruling, the prosecution filed a notice to appeal.

“The State is filing an immediate appeal of the dismissal and we will await the decision of the appellate court,” Worcester County State’s Attorney Kris Heiser said in a statement at the time.

“Nothing will happen with the case until that decision comes down.”

In April, 17 traffic charges – including failure to immediately stop at the scene of an accident involving bodily injury and failure to immediately stop a vehicle at the scene of an accident involving death – were filed against Mailloux, 23, of Berlin, in the death of Gavin Knupp last July.

Knupp, 14, was struck and killed by an unidentified motorist in a black Mercedes while crossing Greys Corner Road on July 11, 2022. Knupp was returning to a vehicle driven by his older sister.

Knupp died from injuries sustained in the collision. Mailloux allegedly fled the scene and did not return, according to charges filed. Six days after the incident, the Mercedes identified as the vehicle in the collision was seized from a local home.

In circuit court this summer, Mailloux’s attorney, George Psoras, presented 12 motions for the court’s consideration, including a motion to dismiss for lack of jurisdiction.

While he argued the district court had jurisdiction in the matter, the Worcester County State’s Attorney’s Office argued state statute provided exceptions allowing the case to be tried in circuit court.

The circuit court judge ultimately ruled in favor of the motion to dismiss, and the case was appealed to the Appellate Court of Maryland.

attorney general’s office argues that both the district and circuit courts had concurrent jurisdiction over four felony charges and four misdemeanor charges brought against Mailloux. Once those charges were brought to circuit court, the brief states, the remaining charges within the exclusive jurisdiction of the district court could also be tried in circuit court.

“Finally, the jurisdictional statutes also plainly establish that once the State’s Attorney exercised her authority to bring those charges in the circuit court, exclusive original jurisdiction over the additional nine related charges (Counts 9-17) then vested in the circuit court as well,” the brief reads.

The attorney general’s office has asked that the appellate court hear oral argument. With the brief now filed, the appellee has 30 days to respond. As of Oct. 2, Mailloux is being represented by the Office of the Public Defender Appellate Division.

“Mr. Mailloux is in good hands with the Appellate Division of the Public Defender's Office,” said Randolph Rice, managing partner in Psoras’ law firm, Rice, Murtha, and Psoras. “All charges remain dismissed until and unless the State either honors the previous Court order and files in the District Court or until the Appellate Court of Maryland issues its decision. We are confident the Appellate Court will make the correct legal decision.”

BERLIN – A visit from a local farmer highlighted National Farm to School Month for students at Buckingham Elementary School.

Local farmer Carol Cross visited Buckingham last week as students all got a taste of a salad made with kale from Cross Farms. The visit was in recognition of National Farm to School Month, an initiative started in 2010 to cultivate the connection communities have with healthy food and local food producers.

“It’s important to get local foods on our menu,” said Odtis Collins, the school system’s coordinator of food service.

“It’s vital to our kids, especially at this age, to learn about healthy eating and where their food comes from.”

Cross, who with her husband Shawn started Cross Farms on Pitts Road in 1993, has been working with Collins to provide the school system with a variety of fresh locally grown fruits and vegetables. Cross Farms has provided watermelon, cantaloupe, cherry tomatoes and kale so far this year.

“We want children to see where their food comes from,” Cross said.

Collins hopes to expand even further the amount of local produce used in school breakfasts and lunches.

“One of my goals has been to support local folks, especially our farmers,” he said.

He added that it was critical that students gain a better understanding of where their food comes from and how agriculture has an impact on their health. National Farm to School Month is meant to empower students to make more informed food choices.

For last week’s visit, Cross teamed up with Supplemental Nutrition Assistance Program Education (SNAP-Ed) educator Caitlin Daw to talk to students about nutrition and encourage them to taste test the kale sweet potato salad.

“Giving students the opportunity to taste nutritious foods in school at an early age is vital to establishing a lifelong commitment to a healthy lifestyle,” Collins said. “We’re grateful to both Cross Farms and the SNAP-Ed program for enabling us to bring such a wonderful experience to the children of Buckingham Elementary.”

BERLIN – Town officials reaffirmed their commitment to seeing a skate park on a portion of Heron Park this week.

On Monday, the Berlin Town Council had a brief discussion regarding skate park location at Heron Park. While there was initially some talk of situating it on parcel 57, where the old processing plant is, they agreed they’d like to see it stay planned for parcel 410, the area in front of the retention ponds.

“We want to position you all in a spot where you can start moving forward with the design work and the fundraising side…,” Mayor Zack Tyndall said. “We’d like to nail down the location as much as possible.”

a Berlin skate park. Tyndall told elected officials this week that a subcommittee tasked with moving the skate park project forward had discussed locating it on parcel 57 because a public works facility might also go on parcel 410.

“There appeared to be consensus on that at our last meeting,” he said. “Subsequently we’ve had some discussion that’s got us back to 410. We’re really still at Heron Park, we were just trying to work through some logistics.”

Tony Weeg, executive director of We Heart Berlin, the nonprofit focused on bringing a skate park to Berlin, said he’d like to maintain parcel 410 as the location. He pointed out that parcel 57 could be sold.

“If you were to encumber the 57 parcel with any sort of skate park you would be potentially encumbering dollars we could realize for that space,” he said.

Councilwoman Shaneka Nichols agreed that the future of parcel 57 was unknown.

“Putting you there may not be the smartest move,” she said.

Councilman Steve Green said he wanted the town to ensure We Heart Berlin was in a position to seek funding for the skate park.

“The important thing for me is for the town to be fluid to a degree but to allow you to move forward with grant opportunities,” he said.

We Heart Berlin’s Jeff Smith said the skate park could be the start of the planning process for the future of Heron Park.

While the land has remained mostly untouched since the town purchased it, its future has come into question in recent months as officials considered selling a portion of the property for development.

Green said it still wasn’t clear what the

town was going to do with the park.

Patricia Dufendach, a member of the town’s parks commission, recalled how excited and full of ideas the community had been when the property was purchased.

“Why don’t we take charge?” she said.

“Yes it’s not easy but with drive and a lot of fundraising we could come up with anything we want. The thing is we have to decide.”

She also used the opportunity to advocate for the passive use section of the property where the ponds are located.

“A forest bath is taking a walk in a quite beautiful beautifully designed place where you can go relax,” she said. “You notice the plants, you see some birds.”

Councilman Jack Orris echoed Green’s questions regarding the future of the overall property.

“We haven’t had these discussions and honestly I’m not sure those discussions should entirely be on this body,” he said.

He suggested the parks commission be tasked with determining plans for the passive use portion.

“The front part is where I believe the community is wanting something,” he said, adding that maybe a new subcommittee was needed.

Weeg said We Heart Berlin was interested in any future planning endeavors.

“If there’s a new committee formed we’d love to have a seat at the table,” he said.

Sheriff’s Office Eyes Radio Encryption

SNOW HILL – The Worcester County Sheriff’s Office will soon be moving to encrypted radio communications.

Like a growing number of police departments nationwide, the Worcester County Sheriff’s Office will be transitioning in January to encrypted radio communications. Sheriff Matt Crisafulli says the change is meant to keep law enforcement officers safe.

“I understand that this is not a popular decision, however; it is a necessity for the preventative safety of our law enforcement officers,” Crisafulli said. “As you know, this is a very demanding and stressful job, especially in today’s world with instant informational access at everyone’s reach. This includes those that may have nefarious intentions towards our brave men and women.”

Crisafulli shared a statement on social media Saturday announcing his agency’s plan to move toward encrypted communication. His announcement came after the Eastern Shore Undercover Facebook page, known for its monitoring of emergency radio channels, shared the news that Worcester County would soon be encrypting its communications.

“That unfortunately means that we will no longer be able to provide coverage to the citizens of Worcester County,” read a lengthy post on the page Saturday. “This is NOT my choice and does not make me happy at all, but the reality is there is nothing I can do about it.”

When contacted Monday, Crisafulli said the change was a preventative measure meant to keep law enforcement officers safe and came as the agency had taken additional steps, including the addition of body cameras, to provide further transparency for the public. He said the decision to encrypt came after consultation with subject matter experts.

“We spoke in depth about the pros and cons of encryption,” he said. “After this consultation with the subject matter experts, we also consulted with numerous deputies about encryption. They overwhelmingly are for this.”

He stressed that communications would be available to the public afterthe-fact with a Maryland Public Information Act request. Fire and ambulance calls will not be encrypted.

“We are trying to balance the safety of our personnel, while continuing to be as transparent as possible,” the sheriff said. “All of our communication will continue to be recorded and available to our residents, via the appropriate channels for release.”

“Encrypting the channels will in essence create an atmosphere where the public will no longer know what is happening, and in my opinion, create a major safety issue for the public and law enforcement,” Campbell said. “The argument that this is an ‘officer safety issue’ has been used many times; however I will argue that by encrypting channels, you are creating a community safety issue, as well as making it less safe for officers.”

Crisafulli acknowledged that citizens were making the argument that there hasn’t been any local law enforcement safety issue related to anyone monitoring a scanner.

“We are very fortunate that this has not occurred here as of current time,” Crisafulli said, adding that the change was mainly meant to be preventative. “I agree that most of our residents with scanners do not have nefarious intentions. It is those that may, that are my greatest concern for my men and women and their families. The stress that they are under, and the stress that their families are under, have been elevated over the last several years with attacks on our law enforcement officers.”

He added that further discussion with his staff had yielded information regarding crimes that did involve scanners, primarily burglaries, thefts and narcotics.

“It is always a possibility that danger could be elevated by real-time response to calls, traffic stops, warrant attempts, etc.,” he said. “The encryption takes away from a criminal being able to know our every step in real-time. I have to ensure that I am doing everything within my power to safeguard our brave law enforcement officers, as their job is already a dangerous one. We will keep our community informed and strive to improve our level of services, always.”

Campbell said that Eastern Shore Undercover made a point to delay posts.

“We run a very safe page and I have policies in place to make sure, incidents are not posted until it is safe to do so, with delay and never under any circumstances when it could be an officer safety issue,” he said. “I would encourage you to pick any random call, then compare the time of the call, to the time that it is posted. You will see that there is a significant delay in when the call is posted. Most times, it is 15-20 mins, sometimes longer with major incidents.

As a former law enforcement officer, I am fully aware of officer safety concerns and I am one of the most pro-police individuals you will ever meet but at some point, we also have to weigh the safety of the public, in addition to law enforcement.”

According to Crisafulli, encryption will begin in January 2024. He said the county wouldn’t need to purchase new equipment, as the existing radios were being reprogrammed. He said he’d heard from members of the public the

concern that encryption would keep the sheriff’s office from communicating efficiently with allied agencies. That, however, is not expected to be a problem because Worcester will be able to share encrypted channels and for large-scale events would utilize “currently available tactical channels.”

Crisafulli added that the move to encrypted communications was based on national best practice by law enforcement agencies.

“All local law enforcement in Worcester County is switching to encryption, all of Delaware is already encrypted, and again, most law enforcement agencies across the country are looking to make this transition, to help add a layer of safety for our law enforcement officers,” Crisafulli said. “My office will always work to improve in all areas of our service to you, and our Worcester County residents. My office will remain committed to transparency and accountability.”

Nevertheless, Campbell believes the move will expand the divide between law enforcement and the general public.

“When anyone tries to hide something, in the public eye, it appears that it is to conceal something and creates further distrust in the community,” he said. “We've worked over 3 years to build that trust and now, it is being taken away, and I just don't think it is the right thing to do.”

FENWICK ISLAND – Officials continue to explore Route 1 safety measures in Fenwick Island.

On Tuesday, members of the Fenwick Island Pedestrian Safety Committee continued brainstorming ways to improve safety along Route 1, the roadway dividing the east and west sides of town. Councilman Ed Bishop, committee chair, said one of the town’s efforts includes working with the Delaware Department of Transportation (DelDOT) to install sidewalks along the remainder of the corridor.

“For us to make Fenwick Island safe for pedestrians, we need sidewalks on both sides of town,” he said.

Earlier this year, the Town of Fenwick Island finished installing sidewalks along five bayside blocks from Indian to Dagsboro streets. Since that time, the town has continued to push DelDOT to fund a sidewalk project for the remainder of the corridor.

“The planning is going to start this year,” Bishop said in an update this week. “As we stand currently, the funding for construction is approved for 2030 … They did indicate funding could be pushed up if projects elsewhere aren’t ready, but we’re really looking to have sidewalks done a year or two from now.”

Bishop said the town is also working with DelDOT to install and move crosswalks throughout town. He said the town is seeking a crosswalk at Lewes Street, as well as the relocation of the crosswalk to the north end of Bayard Street.

“It’s probably one of biggest U-turns in town for people leaving Royal Farms and going south …,” he said. “If we can get the crosswalk moved, it will make it safer for pedestrians.”

Police Chief Michael Morrissey said enforcement would likely increase at crosswalks ahead of the summer season. He said the department would also like to see flashing lights installed at all of the town’s crosswalks.

“I think flashing lights will be part of the sidewalk project,” Mayor Natalie Magdeburger replied.

Committee members this week also explored ways to calm traffic along Route 1.

Bishop said officials are exploring a median project that includes new landscaping along the north end of Route 1.

“We’re looking to do things on the north end of town, changing up the entry way to the north end of town, adding flowers and making it look like you are entering a neighborhood,” he said.

Magdeburger said she had reached out to DelDOT seeking support for the town’s median project. She said state officials had suggested native plants, instead of crepe myrtle trees, to replace some of the landscaping in the median.

“In order to slow down traffic it must catch the idea of the person who is driving …,” she said. “Using native plants doesn’t do that. Using the crepe myrtles is a more attractive way to highlight we are a neighborhood.”

After further discussion, the committee agreed to table the issue until the next meeting.

BERLIN – Officials delayed a West Street project to allow for changes to the proposal.

The Berlin Town Council on Monday voted 4-1 to table design of improvements for West Street. The delay will allow Davis, Bowen & Friedel (DBF) a chance to update their proposal to address additional stormwater issues raised by the council.

“We’ll make all that clear and come back in two weeks,” said Josh Taylor of Davis, Bowen & Friedel.

Taylor approached the council this week to present a proposal for design services associated with roadway reconstruction, pedestrian facilities, a bike path and utility improvements for the section of West Street from Broad Street to Buck-

ingham Lane. The utility improvements would include the relocation of the existing sewer pump station out of the roadway.

“We need to cover soup to nuts, we tried to put everything in here,” Taylor said.

Mayor Zack Tyndall noted that the proposal did not include ungrounding utilities, as that was expected to cost close to $3 million. Staff added that the poles were also used by Verizon and Comcast, neither of which would move their infrastructure for free.

Councilman Jack Orris said he was eager to see improvements to West Street but wondered if the design could also include Abbey Lane and Westminster Drive, as they were in need of stormwater improvements in the near future.

Taylor acknowledged stormwater was a concern and said DBF could look at Abbey and Westminster as they evaluated West Street.

“We certainly welcome as much planning and forward thinking as possible,” Taylor said.

He said he’d set up a meeting with EA Engineering, the town’s stormwater consultant, to discuss Abbey and Westminster. As far as how the West Street improvements would help residents overall, Taylor said they would enhance pedestrian and bicycle access and would update utilities in the area.

“It only makes sense to replace that old clay sewer main,” he said.

He added that there was only enough space for a bike lane in one direction so the town would have to decide how to address that as the design moved forward.

Orris made a motion to table approval of the project until the first meeting in November in order for DBF to update the proposal. He said he also wanted to hear EA Engineering’s input regarding the stormwater aspects of the project.

“I think everyone would appreciate us taking time and doing it right,” he said.

Town Administrator Mary Bohlen said DBF wasn’t being paid to do the work until there was council approval.

“If we ask them to meet, there’s assumption we’re moving forward or it comes out of on call services,” she said.

Taylor said three weeks would give him time to modify the wording to ensure it addressed the items the council brought up Monday.

The council voted 4-1, with Councilman Steve Green opposed, to delay approval.

“I want government to be efficient and delaying the motion to move ahead with the West Street design work for three weeks unnecessarily slows the process,” Green said following the meeting. “Stormwater concerns and allowing time to meet with the town’s consultant about specific areas was cited as the reason for tabling, but stormwater management is already listed in the scope of services of the design work. Putting off the approval for three weeks is a waste of time. It will most likely be approved next month but it should have advanced this week to get rolling.”

BERLIN – Area residents again voiced traffic safety concerns related to an apartment complex on Seahawk Road.

Berlin residents Gabe and Diana Purnell approached the Berlin Town Council this week to ask for road improvements in front of the Oceans East apartments on Seahawk Road. They said the striping on the road is difficult to see and the small median in the road only makes matters worse.

“I’ve seen some very close accidents,” Diana Purnell said. “The buses and everything, I don’t know what you can do about that piece of cement. That’s very dangerous.”

Purnell, who is also a county commissioner, approached the council with her husband this week to ask for improvements to Seahawk Road. Residents and officials have voiced concerns regarding the traffic pattern in front of Oceans East since 2018. While various changes have been made to address the issue, Purnell said it was still difficult to navigate Seahawk Road in front of the apartment complex. Her husband said they traveled the road every day.

“It’s very very dangerous. In fact, the markings are just about gone…,” Gabe Purnell said. “I feel the markings need to be done on a periodic basis.”

He said the faded striping made it hard for motorists to see the turn into Oceans East. He added that motorists often drove right over the median that was in the middle of the roadway.

Mayor Zack Tyndall told the Purnells the town had already been in communication with the Maryland State Highway Administration (SHA) regarding striping.

“They have indicated they have no idea when that will happen,” Town Administrator Mary Bohlen said.

Councilwoman Shaneka Nichols said she’d recently inquired on the situation and found out the SHA striping truck that served the Eastern Shore was out of service.

“They’re looking at next year,” she said.

Bohlen said town staff was in the process of reaching out to private contractors that might be able to re-stripe the area.

“The state’s truck breaking down threw a monkey wrench,” she said.

Tyndall said the town had at one time looked into increasing lighting in the area but hadn’t been able to because the electric poles on the street were not the Town of Berlin’s poles.

The Purnells asked the council to keep the public informed as far as potential improvements.

“We’ll put the call in,” Tyndall said.

“We’ll try our best.”

OCFD Recognizes Fallen Firefighter October 27, 2023

OCEAN CITY – Officials recognized the sacrifice of a former Ocean City Volunteer Fire Company chief with an engine rededication this week.

On Tuesday, officials with the Ocean City Fire Department gathered at Fire Station 5 in West Ocean City to honor former Ocean City Volunteer Fire Company Chief Ralph R. Dennis with an engine rededication ceremony. Dennis, a founding member of the fire company and a longtime legislator, was the first Ocean City firefighter to die in the line of duty.

“A lot of us can stand on the sidelines, we can sit down, or we can stand up and stand out,” said Ocean City Fire Department Fire Chief Richie Bowers. “Chief Dennis was that chief that stood up and stood out as a fighter.”

Dennis, 49, died on the evening of July 24, 1937, shortly after working with local firefighters to extinguish a chimney fire at the George Washington Hotel. He succumbed to the injuries he suffered after inhaling chemicals used to extinguish the blaze.

As a founding member of the fire company, Dennis served as its first assistant chief. He also spent 12 years of his 32-year service as the company’s fire chief.

In addition to his role within the fire company, Dennis served as principal at

Ocean City High School and as a delegate in the Maryland General Assembly, representing Worcester County in Annapolis for roughly nine years.

During Tuesday’s rededication ceremony, Bowers recognized Dennis as not only a leader within the community, but as a visionary within the fire company.

“Any organization is only as good as its foundation,” he said. “The men and women who serve on the frontlines are certainly that foundation but so are our chief officers. And Chief Dennis certainly was and will always be remembered as a visionary for this department.”

Past Ocean City Volunteer Fire Company Fire Chief Bo Duke added that Dennis is known for his courage, honor and commitment. He said the engine rededication recognizes the ultimate sacrifice he made in service to others.

“It is the least we can do for this great forefather of the Ocean City Volunteer Fire Company,” he said.

Dennis’ granddaughter, Mary Adeline Bradford, also recognized her grandfather’s contributions to the community.

She shared stories of his time in the fire company, as well as his legislative achievements.

“I can’t thank the fire department enough for the recognition that has come to my grandfather,” she said.

At the conclusion of Tuesday’s event, the fire department unveiled a plaque on Engine 701 recognizing Dennis for his service and sacrifice.

BERLIN – A proposal from a developer interested in Heron Park will not be added to the town council’s agenda.

In a straw poll this week, the council indicated 3-2 that they did not want to grant a local developer’s request to have his proposed Heron Park contract added to a future meeting agenda. The decision comes about two months after the council opted not to continue negotiations with developer Palmer Gillis.

the acquisition of Heron Park. While no name was mentioned, developer Jack Burbage approached the council when negotiations were still ongoing with Gillis to share a vision for a mixed use project at Heron Park.

Tyndall said he was sharing the request with the council to get feedback.

“My recommendation would be before you entertain any offers to sell all or a portion of Heron Park that we clearly articulate if that’s the path you want to go down,” he said, adding that a request for proposals (RFP) should be drafted so anyone could submit a bid.

Orris was quick to say he felt the council needed to decide what it wanted to do with the property before any offers could be considered.

“I think entertaining a contract without even going through the RFP process would be considered ill-advised from a

business person’s standpoint,” Orris said.

“That may … give the appearance of an unfair advantage in the future.”

Councilman Steve Green said Tyndall had handled the situation correctly.

“I’m not interested in entertaining any other thoughts or plans for the chicken plant until we know the council majority that turned down the most recent proposal, what they want to do,” he said.

He said the council had met several times with Gillis before the majority voted to end negotiations.

“I don’t think it’s fair to have another bidder come forward after hearing all of our conversations and being very aware of the pricing and positions taken by each of us as to why we were in favor or why we were opposed,” Green said.

lin. He stressed that what he wanted to do with the property wasn’t important.

“It is important that we search out the opinions and recommendations of folks that live in the town of berlin to entertain what they would like to see out on Heron Park,” Burrell said. “I believe that if someone has an idea of what, I’m not saying enter into a contract, if someone has an idea of what Heron Park could be, I think it is worth the citizens of the Town of Berlin having an opportunity to hear that idea.”

Tyndall said he was not putting the item on the agenda unless the majority of the council wanted it on the agenda.

Councilman Jay Knerr said that because there were plans to build a skatepark on parcel 410, the only parcel of the property really left to sell was parcel 57.

“I think it’s in our best interest to listen to anybody with an idea,” he said. “We don’t have to accept it, we don’t have to act on it…it might help us formulate what we want there. I think it’s worth our time.”

Councilwoman Shaneka Nichols said she felt anyone interested in the property should go through the RFP process like the last entity had. She felt it wouldn’t be fair otherwise.

“Whoever comes forth needs to be treated the same way that the other individuals were treated,” she said.

Tyndall said that with the majority of the council (Orris, Green and Nichols), he would not be placing the Heron Park proposal on the agenda.

County Study Reveals OPEB Improvements

SNOW HILL – The county’s retiree benefit funds continue to improve, according to an annual report.

Finance Director Phil Thompson told the Worcester County Commissioners last week that the county’s new OPEB (Other Post Employment Benefits) liability decreased 10% in the last year. The improvement comes in the wake of an increased level of funding paired with efforts to reduce costs.

“We’ve reduced the overall liability by about 10% or $13 million in one year,” Thompson said. “We continue to improve our position relative to the long-term viability of our benefit plan.”

Thompson told the commissioners that each year, the county is required to have an updated study of its OPEB liability done. The county has OPEB liability related to the long-term health care benefits of general government employees as well as for the Worcester County Board of Education.

“The study looks at the funding needs and estimated expenses associated with providing these benefits for the next 30 years,” Thompson said.

He said local officials began the process almost 20 years ago, as the first study was done in 2006 and an OPEB trust was created in 2010.

“We currently have a trust for the general government and one for the board of education,” he said.

“We’ve made numerous changes to our plan in recent years which have resulted in significant gains in relation to our funding status and the overall liability.”

The most recent study shows the general government trust fully funded. The county has close to $75 million in the account, with total OPEB liability at $59 million.

“This has taken us about 17 years to get to this point,” Thompson said.

The board of education trust is in a better position than it was but is far from fully funded.

“We have decreased the liability by about $11.5 million for the year,” Thompson said.

The board of education OPEB account’s assets are about $35 million while the liability is $175 million. According to the report, the board of education’s OPEB account is 20% funded while the county’s is 126% funded.

Thompson added that he expected the board of education fund to continue to improve, as the commissioners in recent years have made a dedicated effort to allocate more to the school system’s retiree benefits.

FENWICK ISLAND – A Fenwick Island committee agreed this week to accept a $59,000 proposal from a Lewesbased engineering firm to support bidding work related to the town’s dredging project.

On Monday, the Fenwick Island Dredging Committee voted 6-0 to accept a $59,000 proposal from Anchor QEA. Steve Bagnull, project manager, said the document includes $4,000 for the firm to draft a temporary erosion sediment control plan and $55,000 for the firm to support the town’s bidding and RFP process for a long-awaited dredging project in the Little Assawoman Bay. “We want to make sure it’s executed in a way that protects the town,” he said.

In June, the Town of Fenwick Island submitted three permit applications – one with the U.S. Army Corps of Engineers and two with the Delaware Department of Natural Resources and Environmental Control (DNREC) – for a dredging project in the Little Assawoman Bay. The project calls for dredging roughly 19,000 cubic yards of material over 4,000 linear feet in the north and south channels.

With the third and final round of public notifications now underway, committee members this week began looking ahead to the bidding and RFP portion of the project.

“If all goes well, we’ll kick off the bidding and RFP process in January with the hope of selecting a dredge contractor in February,” Councilman Bill Rymer, committee chair, said Monday. “We’re hoping they hit the water in March for 60 to 75 days and have the project done before June 1.”

Rymer, however, told committee members several things must first happen in order for the town to begin the bidding process.

He noted the town must first finalize a land access agreement with Carl M. Freeman Companies, the owner of the Route 54 parcel that the town plans to deposit its dredged material on. He said the town must also receive its permits

from the Army Corps of Engineers and DNREC. He said the public comment period for the third and final permit will close on Oct. 31.

“I’m expecting by the end of December at the latest, we will receive all comments related to our outstanding permits,” he said.

Rymer explained that Anchor QEA has submitted its proposal to provide bidding and RFP support once the process begins early next year. He said the town had used engineering firms in recent years to provide bidding support, with proposals ranging from $23,000 to $60,000.

“I stepped away thinking it’s a reasonable range,” he told the committee.

For his part, Bagnull said his company would not only compile and finalize design documents, but would seek bids, hold a pre-bid meeting, receive and valuate bids, and make a recommendation to the town.

“There are contractors that already have their eyes on this project,” he said.

Rymer said he hopes to have the land access agreement finalized in the next 30 days and permits finalized in the next 60 days. From there, the town can begin bidding work.

“This requires the dominos to line up …,” he said. “I’m excited, and it feels like we have a very clear path forward.

Obviously, permits are a huge step for that.”

When asked about the dredging timeframe, Bagnull said the town could dredge at any time of year. Rymer noted, however, that the town would want to complete work in the Little Assawoman Bay by Memorial Day. “We obviously want to be done before the summer boating season,” he said.

Rymer said plans to dredge the Little Assawoman Bay during the spring could also work in the town’s favor.

“There could be more folks available to do the dredging for us,” he said.

After further discussion, the committee voted 6-0, with member Jack Pyne absent, to accept a $59,000 proposal from Anchor QEA. The favorable recommendation will now be forwarded to the Mayor and Council for final approval.

OCEAN CITY – Officials at Diakonia say additional resources are needed to expand its Rapid Response Team, a pilot program that has assisted more than 100 homeless individuals this year.

From April to August, members of Diakonia’s new Rapid Response Team (RRT) provided immediate assistance to 118 people facing homelessness. Executive Director Ken Argot said the pilot program has since been able to place 18 of those individuals in shelter and three in permanent housing, while assisting several others with clothing, SNAP benefits and drug rehabilitation admissions.

“These are eye-opening returns,” he said. “Post pilot phase, there is certainly proof of concept that RRT is a vital program and should be part of a permanent component of homeless outreach in our community, working alongside our referring

partners and local law enforcement.”

For years, Diakonia has been a member of the Worcester County Homeless Outreach Team (HOT), a multi-agency effort to connect homeless individuals with local resources. While HOT members go out into the community at scheduled dates and times, on-call staff with the Rapid Response Team are dispatched as soon as law enforcement, EMTs, hospitals or other service providers identify a new homeless individual.

“Today, there is still a need for both entities,” Argot explained. “RRT responds to the call of homelessness in real time, with coordination from HOT and local law enforcement. RRT is dispatched when information is given that a client is at a specific location and either appears to be in need of services or has resulted in a complaint to authorities.”

Officials say homelessness is a complex issue, with contributing factors such as chronic health illness, mental illness and substance use.

“Post COVID, the challenges and narrative have changed,” he said. “While outreach traditionally has had a level of risk, post COVID we have seen a rise in persons presenting with more pronounced mental health and substance use issues. In addition to this, with the rising cost or rentals, we are seeing a level of evictions that, as a community, we have perhaps not been adequately prepared.”

That, he said, is why services provided

by HOT and the Rapid Response Team are critical.

Throughout the five-month pilot program, the Rapid Response Team was dispatched 54 times, resulting in 118 people being served. Thirty-three individuals were placed in shelters, three were placed in permanent housing and 18 were signed up for SNAP benefits. Additionally, 18 individuals received clothing vouchers and four were admitted into drug rehabilitation.

But Argot said the pilot program did come with its challenges, as it utilized Diakonia staff with limited availability to always respond to calls. Rapid Response Team members also saw a need to expand services to other parts of Worcester County.

“Initially, the program was to serve only Ocean City, but quickly it was noted that other areas of Worcester County needed this service as well,” he said.

In order to expand services, Argot said Diakonia will likely have to shift staff duties and hire additional personnel. The expansion would also require additional funds.

“For now, however, RRT will continue to function in a limited capacity until such a time as funding can be secured,” he said.

“It is important to note that pilot phase numbers would be higher, but as the RRT is a volunteer endeavor, the team’s individual responsibilities for Diakonia supersede their outreach efforts.”

Argot said the community can support the Rapid Response Team by visiting diakoniaoc.org, clicking on the “Donate Now” button, and placing “Homeless Outreach” in the comments section of the donation form. The Rapid Response Team is also seeking donations that can be distributed to individuals during the winter months.

“Any items that homeless persons could use during the winter (coats, blankets, gloves, hats, hygiene products, etc.) would be greatly appreciated,” Argot said.

Snow Hill To Host Halloween Events

SNOW HILL – The Town of Snow Hill will once again host a Halloween Block Party.

On Oct. 28, beginning at 6 p.m., the Town of Snow Hill, in partnership with Maryland’s Coast, Downtown Snow Hill and Tides & Vine, will host the second annual Snow Hill Halloween Block Party.

Nancy Hendricks, co-chair of the town’s promotion committee, said festivities include a Halloween parade, a bounce house, games, crafts, facepainting and a showing of Disney’s “Hocus Pocus.”

“It’s really an event to promote the town and its businesses,” she said. “And it’s about neighbors getting together and having a good time.”

Hendricks said the block party is a revival of the Halloween festivities the Town of Snow Hill hosted in years past.

She said last year’s first annual block party attracted several Snow Hill residents.

“We used to do a Halloween parade and it kind of died away,” she said. “We started it up again last year on a whim, and a lot of people were there. The kids also had a great time.”

Now back for a second year, Hendricks said there will be something for everyone at the Halloween block party.

She said the event kicks off at 6 p.m. with a Halloween parade, which will make a loop starting at the municipal lot be-

“They will be giving out trophies for best costume and things like that,” she explained.

From there, the town will host a block party, featuring DJ Deogee, Halloween crafts, games, a bounce house and more.

Hendricks said there will also be a showing of “Hocus Pocus” on an inflatable, outdoor screen.

“The Bearded Mens Society of Ocean City will also be hosting a beer truck for those 21 and over,” Hendricks said. “The proceeds will benefit Diakonia.”

Hendricks encouraged everyone to come out and participate in the Snow Hill Halloween Block Party. She said the evening will be similar to Snow Hill First Friday, as there will be an opportunity to meet and spend time with neighbors, while enjoying activities with the kids.

“Everybody should come on down,” she said. “It’s a lot of fun.”

The block party will be one of three Halloween-related events taking place in Snow Hill in the coming days.

On Friday, Oct. 27, from 6-8 p.m., Maryland’s Coast and Worcester County Recreation and Parks will host a Track or Treat event for kids ages 12 and under at the Worcester County Recreation Center. The event will feature vendors and goodies, and families are encouraged to bring their own bags.

The Town of Snow Hill will also host a night of trick-or-treating on Oct. 31 from 5-8 p.m.

Swanson is a Maryland native, growing up in the Annapolis area with experience working across the Chesapeake and Coastal bays. He considers himself a proud “river rat,” since his youngest days.

biomechanics with complex deformities, enhanced outpatient total joint arthroplasty strategies, identifying and minimizing pain after surgery, and decreasing the risk of post-operative urinary retention.

Hello all and welcome to the final Fish in OC fishing report of the 2023 season.

We’ve had a great year of fishing and we’ve still got plenty to go, but I’m getting busy with the 2024 edition of Fish in OC magazine and gearing up for trade show season.

I’ll bid you adieu until next May. Offshore fishing has certainly slowed down, but there is still some good fishing to be had if you know what to target and where to target them. There have been good numbers of wahoo inside the Washington Canyon and there have been some tuna and mahi in the Washington. Trolling ballyhoo has been the best method for both wahoo and tuna while chunking cut bait around floating debris has produced some mahi. We should have some tuna action for another couple of weeks, but the mahi and wahoo will be leaving the area sooner than later. Offshore boats are also doing more deep dropping for swordfish and tilefish as water temperatures cool. Cut bait in 300 to 350 feet of water around structure can produce big sea bass and blueline tiles, while whole squid baits, eels and lures in 900 feet or more can entice a swordfish bite.

The ocean going party boat fleet has been enjoying good sea bass fishing since the reopen of Maryland black sea bass season on Oct. 10. There have been several boat limits of 15 fish per person over the past couple of weeks with some fish

as big as 4.5 pounds. Ocean bottom anglers are also seeing some nice flounder up to 6 pounds or so and some bluefish and porgy.

Back bay fishing has been good over the past week with lots of different options for inshore anglers. Sheepshead and tautog are being caught at the north and south jetty on sand fleas and crab baits while rockfish, bluefish and flounder are being caught around the east channel and Route 50 Bridge. Night fishing for rockfish from the bridge has been exceptional this week with a good tide happening during the nighttime hours. Shaun Flaherty and the Always Bent crew have been catching lots of keeper sized rockfish in the slot of 28” to 31”.

Worcester Prep’s kindergarten class took a field trip to Parsons Farms Produce in Dagsboro, Del. Students had a blast riding the tractor out to the pumpkin fields and eagerly picking their own pumpkins to take home. During the fun-filled afternoon, kindergartners learned about the different crops grown at the farm, the life cycle of pumpkins and visit with furry friends. The class is pictured above with kindergarten teacher Heather Dennis and Erica Phillips and assistants Jennifer Hoen and Ingrid Poffenberger. Pines Police Department Awarded Two State Grants

OCEAN PINES – The Ocean Pines Police Department continues to benefit from state grants.

The association announced in August the department received $20,000 from the Maryland Governor's Office of Crime Control and Prevention for police retention, and $2,750 from the Maryland Governor's Office of Crime Control and Prevention for the police department's community engagement programs.

This week, Police Chief Tim Robinson announced two additional grants: $2,485.50 to defray the cost of bullet proof vests from the federal Patrick Leahy Bulletproof Vest Partnership through the

U.S. Department of Justice; and $22,600 from the state Police Accountability, Community and Transparency Grant through the Governor's Office of Crime Control and Prevention.

Robinson said new bulletproof vests are always a crucial need and the state funding will allow the department the ability to commit to transparency in a manner expected in 2023. He said the additional funds will help defray the costs of mandated phycological testing for new hires, as well as mandated mental health screenings for existing officers. Additionally, the funds will go towards implementing new computer software that will as-

OCEAN PINES – The Ocean Pines Police Department will partner with the Kiwanis Club of Greater Ocean PinesOcean City for a special “Shop with a Cop” pancake breakfast event on Saturday, Nov. 18 from 8-11 a.m. in the Assateague Room of the Ocean Pines Community Center.

The event will benefit the Cricket Center in Berlin, which is the only statesupported child advocacy center in Worcester County.

Tickets are $9 at the door and children under 10 are free. Carryout and dine-in options are available.

According to the Kiwanis, the Shop with a Cop event is a “partnership with Worcester County law enforcement agencies, giving children the chance to shop with a local law enforcement officer for holiday gifts for their families.”

Traditionally, the campaign gave local at-risk children $150 to spend on gifts for themselves.

According to the Kiwanis, “The Cricket Center realized that instead of buying holiday gifts, they were buying

basic necessities for their families. To assist this effort, the ‘Shop with a Cop’ local drive provides our community the opportunity to donate these basic necessities, enabling children to focus on holiday gifts.”

There will be a drop box at the pancake breakfast to help collect those items. A spokesperson for the Kiwanis said essentials that are needed are new, unexpired, items (30 of each): boxed stuffing; canned vegetables; canned cranberries; jelly/jam; peanut butter; pancake mix; trail mix; crackers; fruit snacks; powdered drink mix; popcorn (unpopped); toothpaste; toothbrushes; deodorant; toilet paper; paper towels; hand soap; bar soap; boxed cereal; granola bars; cereal bars; pasta; pasta sauce; mac and cheese; and canned tuna.

Additional drop boxes will be available in the Community Center lobby, The Parke at Ocean Pines clubhouse on 2 Arcadia Court, and the Ocean Pines Racquet Center on 11443 Manklin Creek Rd.

Hhw collection day provides an opportunity for residents to safely dispose of products containing harmful chemicals, such as bleach, pesticides, pool chemicals, oil mixtures, gas and other fuels, acids, automotive fluids, thinners, and other everyday hazardous wastes accumulating in and around the home, like light bulbs, batteries, and oilbased paints. Note that water-based paints are not hazardous materials and should not be brought to any hazardous waste event. Instead, solidify water-based paints by drying or adding absorbent materials, like sand, kitty litter, or mulch.

Then place the dried paint in the trash.

Hhw collection day is open at no charge to county residents only.

The storm was considered one of the most important events in Worcester County’s history as it opened the way for development of Ocean City’s bayside, commercial harbor and offshore charter fishing industry. The storm also ended the railroad era and the pound fishing industry in Ocean City.

In the late 1990s a major revitalization of the old downtown took place. The section of Boardwalk from the Inlet to North Division Street was converted back to wood after being made of concrete since 1955. Additionally, a $6.3 million renovation of Baltimore Avenue was completed. A center island with brick pavers and landscaping was built from 15th to 33rd streets along “Motel Row” and Victorian street lights were installed downtown. The lower end of Ocean City had become safer and more attractive for everyone.

One of the resort’s most famous structures had its beginning in 1999 when ground was broken for the Boardwalk Arch on North Division Street. When completed the following year the new tourist attraction was visible to everyone entering Ocean City from the Route 50 Bridge.

As the 21st Century approached, Ocean City’s old downtown was looking better.

Berlin Officials OK Event Rain Dates

BERLIN – Municipal officials approved rain dates for three key Berlin events in 2024.

The Berlin Town Council on Monday voted unanimously to approve rain dates for the Berlin Jazz and Blues Bash, Berlin Fiddlers Convention and Oktoberfest. The rain dates were requested after weather prompted the cancellation of several events this year.

“I do believe a rain date is a considerate thing to do,” Councilman Dean Burrell said.

Ryan Nellans, executive director of the Berlin Chamber of Commerce, approached the council this week seeking approval of rain dates for three of the town’s key events. He said the requests were being made because the Berlin Fiddlers Convention was canceled this year because of weather and Oktoberfest was moved inside.

“You have a whole bunch of businesses that lost out a chunk of change here over two weekends,” he said. “They were not very happy with anyone about that.”

He said that if an event attracted 2,000 people, and they spent about $50 each while they were in town, that was $100,000 that was sprinkled throughout downtown shops.

In an effort to not miss out on event spending next year, he said the chamber was requesting that the biggest three events have rain dates approved. Those dates would be the Sunday of the scheduled weekend.

“Instead of trying to reserve a separate weekend at some other point in the calendar it was suggested we shift our events from being on Saturday to being on Sunday in the hopes that 24 hours really makes a big difference,” Nellans said.

Councilwoman Shaneka Nichols pointed out that two of the rain dates were on Sundays the Berlin Farmers Market was typically held. Town staff said that would not be a problem, as there were plans to move the market to the post office parking lot if the rain dates were utilized for an event.

“I look at this as a no brainer,” Councilman Steve Green said.

He said the town had seen the negative impact the weather could have on events that were important to the town’s economy.

“Oktoberfest was an outstanding pivot but it was not what it would have been,” he said.

Green added that the forecast could be checked the middle of the week prior to an event so organizers and everyone involved would know whether it was going to be held Saturday or Sunday. He said discussions about selling Heron Park, during which several people expressed concern about development there impacting downtown businesses, had shown how vulnerable local shops were.

“Allowing this option will strengthen our businesses,” he said.

The council voted unanimously to approve the rain dates.

Tickets Now On Sale For Annual Wild & Scenic Film Festival In OC

BERLIN – Assateague Coastal Trust’s (ACT), Wild & Scenic Film Festival (WSFF) has announced 2023 festival tickets are available for sale.

“Tickets are selling fast, with over half sold out, so we are encouraging you to buy your tickets now,” said ACT Executive Director Brenda Davis.

For 12 years, every November, the WSFF has welcomed audiences to Ocean City for this annual event. The 13th year of this festival features many elements of the past, including top filmmakers, activists and social innovators.

The event is geared toward spotlighting 14 short films, combined with environmental awareness, action and first-rate storytelling to inform, inspire and ignite solutions to restore the earth and human communities while creating a positive future for generations to come.

The WSFF is one of the nation’s largest environmental and adventure film festivals, with this year’s festival theme as “CommUNITY,” in recognition that 2023 marks the 40th anniversary of the South Yuba River Citizens League (SYRCL).

OBITUARIES Charles Owen Rouse OCEAN CITY – Charles Owen Rouse, age 73, passed away peacefully on Sunday, Oct. 15, 2023 at Tidal Health in Salisbury.

Born in Baltimore to the late Charles R. Rouse and Mary Bernadette Rouse, Charles was the second oldest of 6 children in a close, loving family. After graduating from college, he obtained a Masters of Social Work from Washington University in 1998 and a Masters of Business Administration from Fontbonne College in 1998.

He enjoyed a career of service, most recently helping addicts escape a life of addiction with Reach Behavioral Health in Baltimore.

In his youth, Charles summered at the family home on 5th street in Ocean City, working at such venerable establishments as The Embers, Pappy’s Restaurant and Candy Kitchens where he often displayed his fudge making skills in the window of the 6th street boardwalk front store. Charles retired to Ocean Pines where he volunteered at the Ocean Pines Library serving as Treasurer of the Board, and as a docent and on the Board of the Skipjack Nathan of Dorchester County.

He was a skilled sailor having raced for the North Point Sailing Club in Edgemere and a bridge player in the Ocean Pines Sanctioned Bridge Club.

He is survived by his sister, Eileen

Donald Charles “Don” Rohrer OCEAN CITY – Donald Charles “Don” Rohrer, 86, of Ocean City, passed away on Wednesday Oct. 18, 2023, at Coastal Hospice Stansell House in Ocean Pines.

He was born on September 28, 1937, in Boonsboro, MD to the late Charles Lee and Mary Etta (Eakle) Rohrer. He is survived by his wife, Merry Rohrer, whom he married on Dec. 6, 1959.

Don was employed

by Stoy, Malone & Company in Bethesda as a Certified Public Accountant for 46 years until his DON retirement.

He was a member of ROHRER Mt. Nebo United Methodist Church in Boonsboro.

After his retirement, Don was employed by American Door Company in Beltsville, Md. He was a member of the Lions Club for over 25 years and served as president a few times during his membership. Don loved boating, fishing, and spending time with his family and grandchildren.

In addition to his wife, he is survived by a son Mark Rohrer and his wife Annamarie of West Ocean City; son Craig Rohrer and his wife Kris of Pompano Beach, Fla.; daughter Kim Rohrer of Cambridge; grandchildren Breanna, Mark, Nicole, Megan, Brandon, Taylor and Conner; and numerous nieces and nephews.

Besides his parents, he is preceded in death by his brother, Wilmer Rohrer.

Funeral services were held at the Osborne Funeral Home, P.A. 425 S. Conococheague St. Williamsport, Md. on Wednesday Oct. 25, 2023 with Pastor Kenny Brown officiating. Interment followed at Boonsboro Cemetery in Boonsboro.

Robert Timothy Sheridan, Jr. BERLIN – Robert Timothy Sheridan, Jr., age 56 died on Tuesday, October 3rd, 2023, at Atlantic General Hospital in Berlin.

Born on May 6, 1967, he was the beloved son of the late Robert Timothy Sheridan, Sr. and Doris Louise Sheridan.

He was the older brothROBERT er of Kathleen Torres and brother- in- law Scott SHERIDAN Torres. He was the greatly loved uncle to Angelina Torres.

He is survived by many close cousins, aunts and uncles who all have fond memories of him.

Bobby was a great storyteller and was very funny. His greatest passion was music and he loved playing and writing songs on his guitar. He loved to cook and was an avid reader. Bobby also had a great concern and love for animals.

Michael Shoemaker FRANKFORD, Del. – Michael (Mike) Shoemaker, 70, of Frankford, Del., passed away on Oct. 18, 2023.

He is survived by his wife of 45 years, Jeanne Shoemaker; his brother, Dennis (Denny) Shoemaker; six nieces; three nephews; and many cousins. Mike was preceded in death by his father, Walter E Shoemaker, and his mother, Betty J Shoemaker.

and for 17 years as Financial Secretary for the International Brotherhood of Electrical Workers, Local 26 in Washington DC. He was a third generation union electrician and dedicated his time and efforts to his profession. He retired in 2015.

State Surfing Championship Held

OCEAN CITY – The Eastern Surfing Association (ESA) Delmarva District's Maryland State Surfing Championship was held in Ocean City last Saturday.

The ESA Delmarva District held four events during the ESA's 2023 season qualifying local surfers of all ages for the ESA championship events in 2024.

Numerous awards were handed out to finalists in a variety of divisions based on age, gender and board preference.

Top honors went to 18-year-old ESA-AllStar Kai Sommers, who took home the coveted Open Shortboard title, which is a division that includes men and women of all ages. Sommers also won the Mens Division title for his first year competing in the adult divisions.

“I was happy to take the win in Open Shortboard” said Sommers. “Our local district has some strong talent coming up and it’s fun to surf against them.”

Morgan Cushing won both the Open Longboard and Jr Men Longboard divisions. ESA All-Star Carolina Labin won Jr. Women Longboard, Jr. Women U18 and U16 shortboard divisions.

Puppy Swim Fundraiser:

There were some exhausted dogs earlier this month after the 3rd Annual Atlantic General Hospital Puppy Penguin Swim & Yappy Hour fundraiser wrapped up at the Residence Inn by Marriott Ocean City.

The event, which attracted more than 50 dogs of all shapes and sizes, serves as a kick-off for the New Year's Day Penguin Swim, which benefits the Atlantic General Hospital Foundation. More information on the annual swim can be found at aghpenguinswim.org.

Concerns Require Immediate Meetings How We See It

The tough talk between the Worcester County Board of Education and the State’s Attorney and Sheriff’s Office has reached alarming levels.

As a media institution closely following the situation on a weekly basis, we have a solid grasp on the back-and-forth statements and complaints being aired. The public, however, must be worried. Parents of students, especially those in middle and high schools, are left wondering who to believe.

Law enforcement is contending individual schools are not sharing with authorities when criminal activity takes place within school buildings. After being challenged about it, the school system issued a letter, eliciting this response. “Unfortunately for the community, but perhaps unsurprisingly, school officials are once again outright denying that school safety issues exist, even after having been confronted with direct evidence and concrete examples. It appears that school officials are choosing to prioritize the appearance of school safety over actual school safety. As it stands, the often-repeated conclusion of school officials that “schools are safe” doesn’t make it so, and a socalled “task force” comprised of all the same individuals with whom law enforcement has continuously discussed these safety issues for the past 4 years is not likely to suddenly become an effective solution. …”

Those harsh comments were a result of a three-page letter from the school board, saying, “the Board found that there is a gross failure in effective communication between the Partners (Sheriff, State’s Attorney and our Executive Team) and believes, without reservation, that this needs immediate attention and correction. Likewise, the Board is concerned that misinformation, not only between the Partners, but that has been conveyed to the community, has led to confusion and discontent. The Board believes that all Partners share in some of the responsibility for these sentiments.”

It’s becoming a saga now. It’s time for cooler heads to prevail in the concerns over school public safety. The goals need to be the same, but the current strife is hurting the community. Anxiety has mounted in recent weeks as the chief law enforcers of the county express concern school safety is not the priority it’s stated to be. Equally concerning are statements from school officials how the media should not be involved, writing in a prepared statement, “The Board fails to see how engaging in truth versus fiction dialogue through public forums is helpful in maintaining school safety …”

If a task force is the next step, it needs to meet immediately, and all parties need to come together and create an action plan for change. The meetings must be productive and result in the changes needed to settle law enforcement’s concerns state law is not being followed in local schools.

Between The Lines

by Publisher/Editor Steve Green Hundreds of individuals crammed into the cafeteria at Ocean City Elementary School this week to participate in the first of two in-person public meetings as part of the process to create a final environmental impact statement on US Wind’s offshore wind project, which will include 121 turbines in the ocean, four offshore substation platforms and one meteorological tower within the lease area. It was clear the majority of those who came to learn more about the project were adamantly opposed to wind turbines off Ocean City’s coast and stunned by new renderings clearly showing the turbines visible from the beach. The visuals shown in the various renderings were startling.

The fact public comments could not be articulated for all to hear at the meeting, organized by the Bureau of Ocean Energy Management (BOEM), enraged some on social media. Some folks viewed the event as a public hearing when it was not. Oral and written comments were accepted at the meeting and at future in-person and virtual gatherings. This week’s session was simply an opportunity to learn more about the project. Posts from local business owners, boat captains and others summarized the event as a “joke” and a “sham” that’s simply required by the government before inevitably advancing the project. The sentiment seems to be wind turbines will eventually be built off Ocean City and there’s nothing the local community can do to stop it. It’s just a matter of how many years it will be, most believe.

In a statement this week, US Wind seemed to be of the same mindset, saying, “Maryland has adopted very ambitious plans to develop offshore wind energy off its coast. US Wind is proud to partner with the state to develop its first offshore wind farm and put Maryland on track to achieving its goals.

We’re pleased that BOEM has done such a thorough and comprehensive review of our federal permitting application. US Wind has talked to many, many residents across the state, including Ocean City, about offshore wind and our project plans and we’re confident that a large majority of Marylanders are supportive. We will keep the public informed every step of the way.”

At this point, the process continues with BOEM’s 45-day comment period continuing until Nov. 20. The feedback received about the draft environmental impact statement will then be culled with possible changes to the draft before it’s forwarded for approval, disapproval, or modifications.

The concept of encrypted radio communications has been discussed in law enforcement for many years.

At the heart of the issue appears to be police officer safety vs. the public’s right to know. Worcester County Sheriff Matt Crisafulli and Wicomico County Sheriff Mike Lewis are for radio encryption to protect their officers while some folks, namely those in traditional media and social media, are opposed because it cuts off their abilities to listen to incidents and gather details as incidents unfold.

Crisafulli and Lewis are using the same arguments in support of encryption and their comments mirror each other.

“As many of you know, I am a huge proponent of transparency and the Worcester County Sheriff’s Office is more transparent now than ever before,” said Crisafulli. “My intention is to balance the safety of law enforcement personnel, respect the privacy of our citizens, and to continue to be transparent as possible. All communications will continue to be recorded and can be accessed through MPIA requests if needed. During the process of making this decision, I was told by some that the safety of law enforcement personnel was not a substantial reason to encrypt radio transmissions. I could list several scenarios and circumstances to support that this is an officer safety concern. Please keep in mind that when you listen to a scanner at home of our radio transmissions, there are criminals who have the same capabilities.” For his part, Lewis wrote on social media similar sentiments and how social media pages documenting incidents as they happen and without context can be dangerous for officers as well as unnecessarily produce anxiety for the general public.

On the flip side is Earl Campbell, founder of the Eastern Shore Undercover website and Facebook page, who currently uses scanners to update the public on incidents unfolding across the shore. His website and page are popular because they provide real-time.

“Encrypting the channels will in essence create an atmosphere where the public will no longer know what is happening, and in my opinion, create a major safety issue for the public and law enforcement,” Campbell said. “The argument that this is an ‘officer safety issue’ has been used many times; however I will argue that by encrypting channels, you are creating a community safety issue, as well as making it less safe for officers. …. We run a very safe page and I have policies in place to make sure, incidents are not posted until it is safe to do so, with delay and never under any circumstances when it could be an officer safety issue. I would encourage you to pick any random call, then compare the time of the call, to the time that it is posted. You will see that there is a significant delay in when the call is posted. Most times, it is 15-20 mins, sometimes longer with major incidents. As a former law enforcement officer, I am fully aware of officer safety concerns and I am one of the most pro-police individuals you will ever meet but at some point, we also have to weigh the safety of the public, in addition to law enforcement.”

t some point years from now, the boys will be given all these columns as I am keeping binders for them.

I happen to be flipping through some of them the other day updating the binders. As I was flipping back through the last 15 years of writing this diary of sorts (more than 800 columns to date), I had a few gasp moments. Some regretful musings to be certain, but there’s no point fretting over something on my mind 10 years ago. It may seem silly today in the big picture, but it’s a space for honest reflections. My hope is my kids appreciate the candor years from now when reading these pieces.

In the meantime, since I’m a glutton for punishment here are some “oh my” moments that brought back memories yesterday as I flipped through the binders of columns.

• June 2011: “See what happens when you run around the pool -- you bleed”: In a desperate attempt to illustrate the point, it was what I said to Beckett after he stubbed his toe and cried. I was desperate to try and drive the point home and lately whenever he runs he says, “I’m going to hurt my toe.”

• July 2010: “Do not step on your brother’s head”: Again, I would have thought this would never have to be said, but it’s something Pam and I both find ourselves saying to Beckett, who has a disturbing penchant for wanting to inflict pain on Carson.

• March 2014: Although they were reluctant, we forced them to frolic in the snow a bit, hopefully for the last time. Carson refused to wear his gloves and never took them out of his pockets in a form of protest apparently. Beckett threw some snow balls initially, but instead preferred to trash talk how neither I nor Pam could hit him from across the street. I then fired one, a little too hard.

getting a little too rambunctious for our nerves, including Carson inadvertently shoplifting on several occasions (all items were returned), we decided to walk along the beach. Apparently, that decision was made a little late, as Beckett managed to pull a beer bong off a rack and stuck it in his ear, while Carson hummed into the funnel side. Apparently, and I was happy they didn’t know what it was, they thought it was something similar to the can on the string. I quickly put that back before I was made to pay for it. The last thing I needed to be carrying along the Boardwalk was a beer bong saying, “I Got Bonged In Ocean City.”

• July 2013: Both kids find it fun to try and race a vehicle driving down our street while balancing on the edge of the sidewalk. However, if a lady bug is found on a swing, they scream in fear it’s going to bite them.

Both kids will pick up a horseshoe crab or sand crab found on the beach, but they will run away with reckless abandon if I try to show them a spider in a web.

Neither kid has an aversion to heights at all, but if either sees a bumble bee they will run inside and seek shelter immediately.

• November 2010: Walking back into the house can be a tricky time as well.

While I sort of tip-toe lightly, Beckett’s eyes widen as we walk into a clean house. You can hear the excitement in his voice as he says, “wow Mommy it’s so clean”, before he immediately heads for his toys.

As much as my wife detests clutter, it seems Beckett craves it. I find myself stuck in the middle, but my wife would say I tend to my son’s side of looking at things more so than her point of view.

If you talked to her about it, she would probably cite as an example one particularly memorable situation on a Sunday afternoon during a football game. Pam had been busy early in the

day tidying the house, and a nice lazy afternoon had developed. Apparently at some point, and I don’t even really remember it, on my way to the refrigerator for something, I kicked aside a truck so I could open up the fridge.

Pam noticed, though, saying, “really, you didn’t see that and didn’t think you should pick it up, rather than kicking it aside.”

• January 2010: During one particularly rough bath night, Beckett refused to sit down in the tub and was incredibly difficult. It was his way or no way, and I was feeling the same.

Eventually, I wrestled him to his bottom and managed to get the job done.

When I turned to grab the towels, he saw his chance to get even with me for making him stay seated (or at least that’s how I interpret it) and dumped a huge bucket of water on the floor, sending me scrambling to keep it contained and away from Carson.

Meanwhile, there’s little Carson, belly laughing and pointing.

• June 2010: Toddlers lose their cool, but there are clear lines of demarcation between a true fit of annoyance and a cry of significance.

For example, when Beckett fell off our slide a couple weeks ago, it goes without saying that was a justified ball session. That’s a cry of fear and pain, and these can be as tough on the parents as on the child. However, when my toddler gets upset over not being allowed to have his 20th cracker of the day, that’s not a real cry. That’s more like a screaming session intended to sound like he’s crying. That can be deemed fake almost every time.

There’s nothing wrong with a little crying, but I do start to get a little frenzied when they both go at it at the same time. It almost seems intentional.
