Axselle reappointed, new Henry rep named

Tomato Festival Pageant

By Jim Ridolphi for The Mechanicsville Local HANOVER -- More changes are in store for the Hanover County School Board, as two appointees were announced at last week’s Hanover County Board of Supervisors meeting. John Axselle was appointed to another term by Beaverdam supervisor Aubrey “Bucky” Stanley, but Earl Hunter did not get the nod from Henry District supervisor Sean Davis. Marla Coleman, a lifelong educator, was appointed to replace Hunter who had 20plus years of service on the school board and had expressed a desire to continue. Hunter said he got the news earlier in the day when Davis called to inform him “that he’d decided to make a change.” Following the announcement, Hunter said he sought another term in order to complete projects that are ongo-

ECHANICSVILLE — Contestants in the 2015 Tiny Miss and Little Miss Hanover Tomato Festival Pageant, held Saturday, June 27, at the East Hanover Volunteer Fire Department have to wait two weeks to learn who will be crowned. Winners of both categories will be announced at 10:30 a.m. July 11 on the E.J. Wade Foundation Entertainment Stage at the annual Hanover Tomato Festival at Pole Green Park at 8996 Pole Green Park Lane in Mechanicsville. Tiny Miss contestants must reside in Hanover County and be age 3 or 4, while Little Miss

contestants must also live in Hanover County and be age 5, 6 or 7. At this year’s pageant, 10 Tiny Miss contestants and seven Little Miss contestants showed up in their “Sunday best and waited patiently in the “princess section to be individually called up in front of the audience to participate in a short interview. Interviews were conducted by pageant director Lynn Watson and contestants were escorted to the front by Tiny Miss Hanover Tomato Festival 2014 winner Bailee Long and Little Miss Hanover Tomato Festival 2014 winner Nicole Maleta. Not surprisingly, across both the Tiny Miss and Little Miss categories, pizza and the movie “Frozen were among

the hot topics, with at least two of the contestants showing off their singing skills by belting out songs from the movie for the audience. Some contestants were quiet and shy while others enjoyed being in the spotlight. The girls chatted with Watson for about five minutes, telling her and the audience what they like to do over the summer and what some of their favorite things are. Going to the pool and the beach was something nearly every little girl said she thinks is fun and stuffed animals was a popular favorite. This year’s Tiny Miss contestants included: Ember Eades, Ryleigh Houchins, Emma Irving, Lilly Justice, Juliet McCauley-Baldwin, Kaylee Ogden, Cora

Queensberry, Lydia Reid, Sarah Stokes and Elayna Wood. Little Miss contestants were: Aysha Daniel, Aspen Eades, Savannah Irving, Shiloh Longest, Callie Madden, Lindsey Phillip and Caylee Testerman. After the interviews, contestants were given gift boxes filled with jewelry, coloring books and other goodies. Cupcakes and refreshments also were available for the participants and attendees. Because participation in the pageant has been declining over the years, the 2015 Tiny Miss and Little Miss Hanover Tomato Festival Pageant will be the last. Judges for the 2015 pageant were Kellie Watson, John Fibbiani and Dan Sherrier.

ECHANICSVILLE – All eaters and chefs are welcome to join in kicking off the Hanover Tomato Festival on Friday, July 10, at Pole Green Park at 8996 Pole Green Park Lane in Mechanics-ville by taking part in the UnCookoff with the famous Hanover tomato. Chefs of all levels are invited to prepare their Hanover tomato recipes — simple, refreshing for everyone to sample. So, if you are an “underground” chef (supper club, caterer) or an “above ground” chef, start working on your tomato masterpiece. Think salsa, bruschetta, lightly pre-cooked items or more creative takes on the famous Hanover Tomato. Amateur and professional chefs will gather to compete head-to-head to transform the Hanover Tomato into “tantalizing tomato recipes.” Hanover County Parks and Recreation will provide each chef with five pounds of tomatoes. Two tables will be set up to prepare – not cook – and serve samples. There also will be a 20x20 area with two tables to prepare and serve. Set-up and prep will be from 4 to 6 p.m., with judging scheduled for 7 p.m. Awards to be presented include “Judge’s Choice” and “People’s Choice.” A nominal fee will be collected for those wishing to participate in the tastings. To prepare, chefs should supply: All other ingredients required for their recipe (feel free to prep ahead). 200 1½-ounce tasting portions of your creation. Provide tasting cups and napkins to accompany the portion sample. Serving utensils. Chefs may choose to provide their own or supplement with additional Hanover Tomatoes. There is no cost to enter; as a chef,

however, you must complete all required paperwork and permits by their respective deadlines. Spaces are limited and are being offered on a first come, first served basis. If that isn’t enough, Papa John’s Pizza is joining in the fun and sponsoring the 4K Pizza Run. This unique event is all about family, friends and pizza. The pizza run is an extremely short race, only 4 kilometers or 2.5 miles, which any level can complete within an hour. Multiple “pizza stations” will be strategically placed at the start and along the race route where a slice of Papa John’s pizza will be waiting for you. In addition to that tasty experience starting right at 6 p.m., every participant will receive a Papa John’s and Parks and Recreation goodie bag. If you aren’t going at it alone, team registrations also are available. The top male, female and team finishers will win pizza for a year. Runners/walkers can register at www.hanoverparksrec.com The Pizza Run begins at 6 p.m. and Uncookoff goes from 6 to 8 p.m. Live musical performances will be presented by the E.J. Wade Foundation. OPINION | The Local Views

Thinking about generations of love

From the editor

How can skin color still be an issue today? When a young man was welcomed into a church to join in a Bible study, worshipping, unfortunately, wasn’t on his mind. He brought a gun into the Emanuel African Methodist Episcopal Church in Charleston, South Carolina, with a goal: to take lives — black lives. The fact that anyone has a hatred based on skin color is incomprehensible. What possibly could motivate someone to think one race is superior to another? This is where Adolf Hitler comes to mind — and he was evil incarnate. However, the families who lost loved ones on Wednesday, June 17, responded in what many probably found remarkable: They forgave 21year-old Dylann Roof. Bigotry, intolerance, prejudice, racism. These words have no place in our society. Yet we read and view images of the violence that stems from hate. The words of the late Dr. Martin Luther King Jr., who marched for civil rights and died at the hands of a racist, ring true: “We must learn to live together as brothers or perish together as fools.” Churches and communities have bonded following this tragedy to show we as a nation can and will unite — in spite of the hate mongers that sadly walk among us. This is proving difficult to write because words cannot express the horror of what took place in that church two weeks ago. How do we overcome such hatred? We don’t give up, that’s for sure. It’s not about color. It’s about humanity. It’s about the future. If you have an issue with those of another race or religion, take a look in the mirror and ask yourself why you feel that way. Healing often starts from within. Our thoughts are with Charleston and its people.

Etc. Be sure to watch for our newest publication, The Hanover Local, which debuts next Wednesday. We will be reaching readers throughout Western Hanover County. Our carriers will bring the newspaper to you every Wednesday. More about The Hanover Local can be found on page 16. Melody Kinser

By Jim Ridolphi Contributing Columnist I only saw my father cry once in the brief years I spent with him. He had just received news that his father had passed away in Montgomery, Alabama, and he was on the phone checking for a flight South to attend the funeral. There were several problems. First, he was a committed non-flyer as the result of a close call during his time in the U.S. Army. Complicating his hesitancy to fly was the cost and timing of the flights. We recently had purchased a set of World Book Encyclopedias, forcing a tight budget for a few months. As fate would have it, my grandfather’s death occurred shortly after we got the new books. The introduction of the books excited my sister and me, and I liken the experience to a

kid with his first computer in today’s terms. After speaking with his mother, he did not attend the funeral, a decision I know he regretted. As a small child, I’d known my grandfather as a caring old man who took great pleasure in spoiling his grandchildren. He was the only adult who would give a child a slice of watermelon that rivaled the recipient’s height and weight. He always had a pocketful of candy and was never hesitant to distribute a handful to his many grandchildren. Years later, I would understand what my father felt that night. Not many years later I would be feeling the same thoughts as we planned his premature funeral. My grandfather immigrated to the United States at the age of 12, a

small unaccompanied little boy from Corsica whose mother feared for his future on the small island. He landed in New York and traveled to Philadelphia to stay with family friends who eventually arranged for his trip southward to Montgomery and more family friends. Too short to see over the counter, he opened his first lunch counter at age 15, and eventually opened The Pickwick Cafe, a Montgomery institution for decades. Less than five feet tall, my grandfather raised eight boys and a girl as he ran his restaurant, with a more than ample amount of help from my grandmother. As a father and grandfather, he had the unique quality to make whoever he was speaking to seem special -- even if you were the tiniest of see LOVE, pg. 8

Walk planned to help educate about diabetes One in three adults will have diabetes by 2050 if current trends continue; 29.1 million children and adults in the United States have diabetes now; 86 million are prediabetic. The numbers are staggering — and are growing every year. That’s why the American Diabetes Association holds a Step Out Walk — to raise money for educational programs for the Richmond community, to advocate on behalf of people living with diabetes and to raise funds for research for a cure. The 2015 Walk to STOP Diabetes will be held Saturday, Oct. 17, at the Bon Secours Washington Redskins Training Center. Check-in is 8:30 a.m.; the walk begins at 9:30 a.m. The walk features a Wellness Village, entertainment, a Kid Zone and lunch for all walkers. Individuals and teams are welcome, as are sponsors. Over 1,000 walkers participated in 2014. We hope to break that record in 2015. This 5K walk is the major fundraiser of the year for

the American Diabetes Association in the Richmond area. For more information or to register, visit diabetes.org/ stepoutrichmond or call 804-225-8038, ext. 3255. Ann Weinberg 2015 volunteer marketing chair Central Virginia American Diabetes Association see LETTERS, pg. 8

(Editor’s note: The following is in response to a letter to the editor from Raymond C. Germeroth that appeared in the June 18, 2015, edition of The Mechanicsville Local.) Your referring to the Baltimore “thugs” in your letter to the editor (The Mechanicsville Local, June 18, 2015) illustrates unambiguously your racist outlook on this society. Young black males are “thugs.” Young Latino males are “illegal aliens.” Young white males are “mentally unstable.” “Release the dogs on the thugs,” huh? You know that conjures up images of the South in the 1960s. If that had happened as you envision . . . you’d be getting your race war . . . “radical liberals that brought Baltimore to its knees,” huh? Do not forget that the entire issue started when a cop driving the paddy wagon murdered Freddie Gray by slamming on the brakes at 55 mph! You are very good at making people need nausea medication in that you give folks reading your hate speech big stomach pains. Your racist rants (that always end with Obama this and Obama that) are only printed as the result of the First Amendment Rights of Free Speech in the Constitution (written by the liberal colonists in 1787 in Philadelphia . . . another liberal stronghold).

children. As I look back, it’s clear where our family’s clear sense of commitment and dedication to the ones they love originated. And, as I look back on the evening so many years ago as I watched my father with his heartfelt grief, I understand why. Fathers leave an indelible mark on the children they raise, an impression that doesn’t dull with time. The wisdom and judgment many of us depend on today had their roots in relationships we enjoyed with our fathers. As I enjoyed my Father’s Day with three of my children at my side, and another a heartbeat away in the Caribbean, I can now appreciate the loss my father felt that night. It wouldn’t be long before I felt the same grief when he left us so suddenly a couple of years later. My only hope is that, as a father, I can continue a legacy that began long ago, when a small 12-year-old boy boarded a ship headed for the United States, and our future … and a continuing chain of love began.

If it weren’t for liberals, you’d still be speaking like the British. But, then again, that would most likely be better than you do now. I’m not going to try to change your mind because I doubt that you possess such depth. Franklin Delano Roosevelt was a liberal Democrat. Do you enjoy a retirement pension? Republicans have “villainized” liberals for three decades now. They have made efforts over that period of time to tear apart the policies that liberals instituted since the founding of America. Many liberals sought to make this country the greatest nation on the face of the Earth and now radical conservative Republicans are destroying what they built. Why is this? Here is a list of the greatest liberals in American history and what they did to make our nation great: 1. George Washington — hated the Revolutionary War. 2. John Adams – gave us the first health care mandate. 3. Thomas Jefferson – free press proponent and restricted corps (back then?). 4. Ben Franklin – liberal to the bone and hated government controls. 5. Abraham Lincoln wrote the Emancipation Proclamation. 6. Beth Stanton – founded the woman’s suffrage movement. 7. Susan Anthony – Civil Rights leader. 8. Teddy Roosevelt – greatest progressive in American history, founded the USDA. 9. FDR – New Deal, NRA

(no . . . the National Relief Act), your social security. 10. Eleanor Roosevelt – fought for minimum wages. 11. Harry Truman – ordered an end to segregation in the military. 12. John F. Kennedy and Robert F. Kennedy – expanded unemployment benefits. 13. Martin Luther King – probably the most progressive of all. 14. Lyndon B. Johnson – totally (and unilaterally) founded the Great Society (go look that up). . . . to name only a few. LBJ signed into law most of the 1964 Civil Rights legislation . . . bet you didn’t know that (or care). Abe Lincoln (again) wrote the Emancipation Proclamation (bet you hate that) … you hate liberals and yet Richard Bruce Cheney (one of the most (in)famous conservative Republican heroes of yours) made over $40 billion (with a “B”) when Halliburton illegally invaded Iraq in 2003 (where over 4,400 veterans were killed; over 32,000 veterans were wounded and over 130,000 dead Iraqis) and he will never be brought to trial. Yet . . . “There you go again” (Reagan quote during his debate with Jimmy Carter, another liberal) in the 1980 presidential election. Then (and I don’t hold this against you because of the time frame involved) on June 17, 2015 at about 9 p.m., some little punk filled with white supremacist propaganda (he was too young to feel that way so he must have been indoctrinated by these “thugs”) walked into a historically significant church and murdered nine black people worshipping Jesus Christ in His house at their Wednesday night Bible study . . . Wow! One thing is for sure, there are nine more souls crying with joy that they are in the presence of the Lord. see LETTERS, pg. 19

Richmond Suburban News will launch a new free community newspaper, The Hanover Local, on Wednesday, July 8. The publication’s circulation reach will be 14,000 households. Publisher Joy Monopoli said many requests from residents and business leaders prompted the decision to focus on those areas of Hanover County that do not receive The Mechanicsville Local, a popular weekly publication that has served eastern parts of the county since 1984. “Our team has planned for this next venture in Hanover County with the same commitment and enthusiasm they have brought to The Mechanicsville Local for more than 30 years,” said Monopoli. As a “sister publication” to

The Mechanicsville Local, The Hanover Local will provide the same mix of coverage, touching on all aspects of the people, places and events in the western part of Hanover County and the town of Ashland.

In addition to those homes receiving The Hanover Local, the newspaper will be available throughout the coverage area. A list of locations will be published in the paper each week. Managing Editor Melody Kinser, News Editor Meredith Rigsby and Sports Editor Dave Lawrence will direct coverage along with frequent contributions from long-time freelance photojournalist Jim Ridolphi. grants, which are run through the town administration and funded annually by town council for small business projects aimed at improving the outside of a business’s building. Ashland has been conducting two rounds of façade grant funding each year, but Amos requested local business feedback about the idea of creating a revolving project funding program due to a lack of grant applications it receives. Only about two to three applications for façade grant funding are submitted each round, Amos said. Applications for façade grants should be turned into Topham by July 15. Amos reminded business owners about the Economic Development Authority’s (EDA’s) Revitalization Loan, which is a forgivable loan program geared toward improving and bringing historic buildings up to code for use by new businesses. In collaboration with Market Ashland Partnership, the town also has an ongoing gift certificate program. About 40 businesses throughout Ashland currently accept the gift certificates that can be purchased at town hall. Amos said about 600 certificates have been sold. In addition, applications for the Ashland Citizen Leadership Academy are due July 31.

The Ashland Citizen Leadership Academy is a series of monthly seminars designed to provide locals with an indepth view into how the town works, a chance to discuss local issues with town leaders and prepare to serve on town boards, commissions, committees and neighborhoods, according to the town website. Amos also noted that the town Instagram account is available for any local resident, including business owners, to take over for a week and curate photos about what they love about Ashland. The Town of Ashland website also features a “Notify Me” section where residents can keep track of events and meetings via email notifications. “Everything we do at the Main Street organization really is about economic development and trying to bring new people in to town to work with the businesses that are here,” Joyce said. “We want to be a resource for business leaders, property owners and town staff to serve as a conduit to create good things, good new businesses.” The Virginia Main Street program was developed by the National Trust for Historic Preservation and started in 1985. Ashland was named a Virginia sanctioned downtown main street association in 2014.

Because the town was granted the $25,000 fund, it is now qualified for an additional $500,000 grant, which it has already been approved for by the state, to renovate and repurpose the theater, Joyce said. The Ashland Theatre has been open as a “pop-up” venue while plans for the restoration develop, and the town has been able to host 49 events there since Nov. 21, 2014. Joyce recognized new businesses, including a new restaurant and a new beauty salon. He also brought attention to the local bike garden initiative led by Nancy Crozet, announcing that the town plans to publish a bike garden “art” scavenger hunt for town visitors. Train Day will be held Nov. 7 and the festival will feature music, games, model trains, children’s train rides, food and railroad related vendors. Fire-EMS: Leave fireworks to the professionals HANOVER — Every Fourth of July Fourth, thousands of people, most often children and teens, are injured while using consumer fireworks. Battalion Chief Jason Williamson said that Hanover Fire-EMS recommends enjoying one of the many public fireworks displays in the area put on by experts. “Hanover Fire-EMS is opposed to the consumer use of fireworks,” he said. “Even sparklers and firecrackers burn hot enough to cause third degree burns.” Williams reminded residents that it is unlawful and

Better stop worrying about all the “radical liberals” and start worrying about the robber baron “donor class” that will have you (and us all) in chains one day because someone’s daughter needed an abortion or someone’s son is marrying his boyfriend. Dr. Richard Ryder, PhD Mechanicsville

Educate yourselves The June 23 Executive Order by Gov. Terry McAuliffe to remove the Confederate Battle Flag from state license plates indicates that he is as historically ignorant, as are all those who view the flag as a sign of hate. Educate yourself Mr. Governor! All parties, black, white, green, yellow and purple, need to simply scratch the surface.

a class 1 misdem e a n o r, punishable with up to a $2,500 fine and up to one year in jail, for anyone who discharges fireworks without a permit. This includes any firecrackers, sky rockets, or any object that explodes, rises into the air, or travels laterally, or fires projectiles into the air. Exceptions to this are sparklers, fountains, Pharaoh’s serpents, caps for pistols, pinwheels commonly known as whirligigs or spinning jennies, which may only be used on priThe War for Southern Independence was just that. Take a very few moments to look beyond your elementary school history book chapter which states that the Civil War was over slavery, the South lost, The End. You will readily and easily find that the threat and right to succeed, under the Constitution of the United States’ provision pertaining to the sovereignty of each individual state over the Federal Government (Tenth Amendment), was nearly exercised by South Carolina in the early 1830s over exportation tariffs. These tariffs were proposed by the Federal Legislature Representatives of the mechanized north, attempting to force the exportation of the raw textiles of the South to Europe be redirected to the northern states for severely reduced profits. Also, read Abraham Lincoln’s Emancipation Proclamation very closely. It was this speech that made the

vate property with the consent of the owner of such property. Wi l l i ams offered the following information: Facts: In 2011, almost 18,000 fires were caused by fireworks in the U.S. In 2012, U.S. hospital emergency rooms treated an estimated 8,700 people for fireworks related injuries. On Independence Day in a typical year, far more U.S. fires are reported than on any other day, and fireworks war, seemingly, about slavery. However, it did not free a single slave. It freed the slaves in the “rebellious states” (“that all persons held as slaves [within the rebellious states] are, and henceforward shall be free”). The “rebellious states” were a part of their own government, not Mr. Lincoln’s government. In addition, it did not free the slaves in Maryland, Kentucky, etc., who chose not to succeed. It was a two-fold political ploy: First and foremost, Mr. Lincoln wanted to make the war about slavery for fear of European war ships in the Chesapeake Bay, and, secondly, he felt that this would be an enticement for the “rebellious states” to rejoin the union and keep their slaves. Neither happened, and each supports my argument. In closing, I suppose ignorance is truly bliss. Sadly, it is this ignorance that makes the uneducated see the Battle Flag of the Confederacy as a sign of hate.

account for two out of five of those fires, more than any other cause of fires. The risk of fireworks injury was highest for young people ages 15-24, followed by children under 10. Sparklers, fountains and novelties alone accounted for one-quarter (25 percent) of the emergency room fireworks injuries in 2012. Males accounted for three quarters (74 percent) of the injuries. Sources: NFPA’s Fireworks report, by John R. Hall Jr., June 2013. 2012 Fireworks Annual Report by Yongling Tu and Demar Granados, June 2013. Furthermore, it is this politically correct, historically ignorant view that cost the Commonwealth of Virginia billions of tourism revenue by ignoring the significance of the War for Southern Independence’s Sesquicentennial. I am a proud member of The Sons of Confederate Veterans; my great-greatgrandfather, Daniel Morehead, enlisted in the Confederate Army. As a dirt-poor farmer from deep Southwest Virginia, he had probably never even seen a black man, let alone owned one. He enlisted and risked his life for this reason and this reason only: his country, his commonwealth was under invasion. If we all, Mr. Governor, had a shred Daniel Morehead’s pride in the commonwealth, what a grand one we’d again have; being a native of New York, you, Sir, have no idea what it means to be a Virginian. Andrew Bennett Morehead Old Church

Residents reminded of Virginia laws pertaining to fireworks HANOVER — The Independence Day holiday is almost upon us, and with it comes celebrations, festive times and fireworks. Hanover County FireEMS wants to be sure that citizens are aware of the laws regulating fireworks and their proper use. In Virginia, it is illegal to sell, buy, use, ignite or explode firecrackers, skyrockets or similar things that contain any explosives or inflammable compound or substances that explode, rise

into the air or travel laterally, or fire projectiles into the air. The only fireworks legally allowed to be sold or used in Virginia are sparklers, fountains, Pharaoh’s serpents, caps for pistols and pinwheels (commonly known as whirligigs or spinning jennies). Residents are urged to observe these safety precautions when using fireworks of any kind: Always read and follow label directions. see FIREWORKS, pg. 20

A new section, 19.2-60.1, bans the use of drones by LEO without a warrant. Exceptions are Amber, Senior or Blue Alerts, when necessary to alleviate immediate danger to a person, for training exercises and for consent given by one with legal authority. The warrant requirement does not apply for uses other than law enforcement. Amendments to sections 19.2-10.3 and 29.1-745, requires LEOs to have reasonable suspicion to stop, board or inspect a non-commercial vessel. Conservation police and Virginia Marine Police can stop, board and inspect for hunting, fishing, and trapping licenses or creel or bag limits and conduct safety checkpoints in accordance with agency policy. Section 19.2-386.2 is amended to provide that when any property is seized, the seizing agency shall, as soon as practicable, conduct an inventory and furnish a copy to the owner. Failure to comply does not invalidate the forfeiture. Several statutes were enacted dealing with reporting sexual assaults and sexual violent in a higher education setting. Most briefly, the statutes impose a duty upon certain employees of the institution or campus police to report and/or notify specific individuals. The victim is not required to report. Newly created section 23-9.2-15 mandates that a “prominent notification” shall be included on a student’s academic transcript if the student

cover the gap in costs between a school’s financial aid package and the total amount of money that is needed to attend that particular school.,” said Bob Holsworth, chairman, GRASP Board of Directors. “We are especially grateful for our supporters and donors who make these scholarships possible.

The Last Dollar Scholarships are another avenue GRASP uses to ensure that every student has an equal opportunity for continuing education after high school.” GRASP is dedicated to helping primarily low income and disabled students overcome financial and social barriers to

attending college or vocational education after high school. Supported by individual, foundation and business donations, GRASP has advisors in 76 public and private schools throughout Virginia and provides services and scholarship assistance, free of charge, to students and their families.

In the most recent school year, GRASP advisors assisted more than 6,000 students and their families in developing post-secondary education game plans and leveraged more than an estimated $69 million in financial aid. Many of this year’s Last Dollar scholarship winners

will be the first members of their families to attend postsecondary education. For more information about GRASP, visit www.grasp4va.org. Follow on Twitter at: http://www.twitter.com/ GRASPFlash and Facebook at GReat Aspirations Scholarship Program (GRASP).

is dismissed, suspended or withdrawn while under investigation for violation of the college’s or university’s code of conduct. VMI is exempt due to its demerit system. Venue (where the trial may be had) is addressed by amendment. If venue cannot be readily determined, it may be had in the Virginia county or city where the defendant resides, where a non-resident defendant is apprehended or where a related offense was committed if the defendant is a nonresident not apprehended in Virginia. Venue for homicide cases was expanded to include any jurisdiction where any part of the body was found. Venue for Medicaid offenses may be had where any act was performed in furtherance of the offense or where the defendant resided at the time of the offense. Strangulation of a family or household member was added to the list of crimes for which there is a rebuttable presumption against bond. Section 19.2-264.3:1.1 was amended to clarify the procedure to be followed in reporting scores of tests for mental retardation in capital (death penalty) cases. This was in response to the U.S. Supreme Court Decision in Hall v. Florida. Upon certification if any felony by a general district court after a probable cause hearing, ancillary misdemeanors shall be certified if consented to by the prosecution and the defense. Any misdemeanor so certified will proceed in the same manner as a misdemeanor appeal.

A new felony of enticing, etc. a person, to enter a house with the intent to commit murder, abduction, aggravated malicious wounding, robbery, rape, sodomy, and/or object sexual penetration was created. A violation of this new statute is a Class 6 felony (up to 5 years imprisonment). Statutes dealing with child pornography and obscenity offenses were amended to add the mens rea (state of mind) of “knowingly” and removed the requirement to prove “lascivious intent.” The amendment also clarified that for certain such offenses, a second offense was punishable as a Class 6 Felony. Laws concerning cigarette enforcement, administration, and trafficking were amended. The felony threshold for possession with intent to distribute contraband cigarettes was lowered to 200 cartons from 500. Criminal and civil penalties for purchasing cigarettes using forge business licenses, a license obtained by false pretenses, a forged or invalid Virginia sales and use tax certificate or a sales and use tax certificate obtained by false pretenses were enacted. Adults must now sign for mail order tobacco or nicotine vapor products and after Oct. 1, 2015, no one may sell a liquid nicotine container unless it is in child resistant packaging. Powdered or crystalline alcohol are added to the definition of alcoholic beverage and no container sold or shipped into Virginia may include such a product. The possession, sale, purchase or use of powdered or crystalline alcohol is

a Class 1 misdemeanor (up to 12 months in jail and/or up to a $2,500 fine). A new offense of commercial sex trafficking (18.2-357.1) was created with penalty of a Class 5 Felony. If the act is accomplished by force, threat, intimidation or deception, it is a Class 4 Felony (2-10 years). Any adult who violates the section with an underage person is guilty of a Class 3 Felony (5-20 years). It is also a Class 3 Felony to receive money for procuring a minor or receiving money from the earnings of an underage minor and for pandering involving a minor. Section 18.2-308.1 was amended to add the mens rea or “knowingly” to prohibitions of possessing a firearm, stun weapon, knife and sundry other weapons on school property. Non-residents may petition for the restoration or the right to possess a firearm in the circuit court where the last felony conviction occurred or where adjudicated delinquent. The prohibition against firearm possession, etc. does not apply to a felon whose rights were restored in another state. LEOs and firefighters who have completed training course may administer Naloxone to combat an overdose. A new section creates an affirmative defense if caught while seeking medical attention for oneself or another for the unlawful possession, purchase or consumption of alcohol, drunk in public and unlawful possession of drugs and paraphernalia. For the defense to apply, the individual must remain at the scene or where transported

for medical attention, identify himself to a LEO and cooperate with the investigation. The affirmative defense cannot be asserted if medical attention was sought during the execution of a search warrant or during a lawful search or arrest. An affirmative defense to possession of marijuana is created if the possession of cannabidiol oil or THC-A oil is pursuant to a valid certification and for the treatment of intractable epilepsy. This law became effective Feb. 26, 2015. Certain traffic laws were amended. It is now unlawful to follow more closely than reasonable non-motor vehicles such as bicycles, mopeds, electric assistive mobility devices, etc. Prior to the amendment the statue was limited to motor vehicles. Vehicles assisting with traffic incidents or management may now use flashing, blinking or alternating amber warning lights. Antique motor vehicles manufactured before 1950 are exempt from the requirement that the exhaust system prevent excessive or unusual noise if the engine is compatible to that designed as standard factory equipment for that vehicle and the exhaust system is “in good working order.” Section 46.2-838 was amended to read that a driver overtaking a stationary vehicle displaying flashing, blinking or alternating amber lights shall proceed with due caution and maintain a safe speed for the conditions. Also, on a four or more lane highway, a driver overtaking a stationary refuse collection vehicle shall yield

the right of way by making a lane change into a non-adjacent lane or on a highway of less than four lanes, decrease speed to ten miles below the limit and pass at least two feet to the left of the vehicle. Tow truck drivers and recovery operators may not knowingly permit a person to occupy a towed vehicle. Drivers may cross a double yellow line or a solid yellow adjacent to a broken yellow line in order to pass a pedestrian or device moved by human power, if such movement can be safely made. A new statute, section 32.1370, allows a mother to breastfeed in any place where she is lawfully present. The Conflict of Interests Act was amended, effective Jan. 1, 2016, to state that any person who knowingly and intentionally makes a false statement of a material fact on a Statement of Economic Interest is guilty of a Class 5 Felony. Civil penalties are provided for local and state officers or employees who do not timely file a Statement of Economic Interest. I emphasize the preceding is only a summary of select pieces of legislation. Please contact me should you have any questions. My thanks to Delegates Chris Peace and Buddy Fowler and to Senators Ryan McDougle and Don McEachin for their accessibility and responsiveness throughout the legislative process. Finally, my thanks to my fellow citizens for the honor of serving as the Commonwealth’s Attorney for Hanover County.

Along with the design, India went back and forth with the music directors and students to get interviews and used her own time to take pictures of band and orchestra students in class. She also put a lot of thought and care into the intriguing headlines. Many staff members attended music events during and after school to make sure every musical moment was captured, so that some of the best photos could be featured in the yearbook. This recognition is well deserved by our school’s yearbook staff,” Miller said. Oak Knoll Middle School’s yearbook, The Dynasty, was one of only 476 yearbooks selected from approximately 3,000. The 2015 panel of judges, comprised of nationally recognized scholastic journalism professionals and awardwinning yearbook advisers, selected the best examples of yearbook spreads and covers to make up the 344-page 2015 Look Book. “Yearbooks are unique, limited edition books cre-

important thing you can do to protect your pets is to evacuate them, too. If it’s not safe for you to stay behind then it’s not safe to leave pets behind either. VDACS suggests the following tips for keeping pets safe: Make sure pets wear collars and tags with up-todate identification. Your pet’s ID tag should contain name, telephone number and any urgent medical needs. Be sure to write your pet’s name, your name and contact information on your pet’s carrier. Consider microchipping your pet as a more permanent form of identification. Always bring pets indoors at the first sign or warning of a storm or disaster. Pets can become disoriented and wander away from home

during a crisis. Keep a pet emergency supply kit, including the following: three- or more-day supply of food and drinking water; bowls for food and water; current photos and physical description of your pets, including details on markings; medications, vaccination records (especially rabies records) and first aid pet supplies; comfort items such as a toy and blanket; small garbage bags; for dogs — a leash, harness and a sturdy carrier large enough to use as a sleeping area; and for cats — a litter box and litter as well as a sturdy carrier large enough for transport. Keep a list of pet friendly places, including phone numbers, with your disaster supplies in case you need to evacuate.

Many hotels, motels, campsites and other facilities around the country now allow pets. Check out AAA or petswelcome.com to find a list of those in your area. Hotels and motels may be willing to waive “no pet” restrictions in an emergency. Friends and family members living outside the area may be able to provide shelter, too. Pet owners should be aware that many emergency shelters do not accept pets — check with your local emergency management office to determine if a pet-friendly emergency shelter will be set up in your location. He said all of them had one thing in common: a sincere desire to serve in Hanover’s quality education system. “Everyone said we had a very good system and a little tweaking now and then would get the job done,” Stanley said. After receiving calls and emails supporting all of the

candidates, Stanley said he received the most support for current board member Axselle, and motioned for his reappointment. “After much deliberation and thought and talking to a lot of people. By far, John Axselle stood out among those people who called,” Stanley said. Both nominations were approved unanimously by the board of supervisors.

Carolyn Griffis, left, of Mechanicsville, recently donated the Miller & Rhoades Tea Room sign to the Virginia Historical Society. She donated the sign in memory of her late husband, Robert “Bob Griffis. Griffis said she wanted to donate the “Downtown Richmond memory for the city and all of Virginia “to remember and enjoy their beautiful memories of the Tea Room. The sign was purchased in 1989 at the liquidation sale. She is shown with E. Lee Shepard, vice president of Collections. Griffis is modeling a hat from the Virginia Historical Society’s museum shop. The society has hats for sale as part of its merchandise for the upcoming exhibition, “Dressing Downton: Changing Fashion for Changing Times, which opens Sunday, Oct. 19, to the public. The exhibition will feature the costumes from the PBS program, “Downton Abbey.

Supervisors deny application for motocross facility By Jim Ridolphi for The Mechanicsville Local HANOVER — After a controversial motocross project received approval from the Hanover County Planning Commission approval last month, the Hanover Board of Supervisors voted last Wednesday to deny an application for a Conditional Use Permit allowing a motocross training facility on 43 acres fronting Washington Highway near Verdon Road. Although the majority of supervisors expressed support for the project presented by former national motocross rider Randall Everett, most

Jim Ridolphi for The Local

said the concerns of residents and a question of zoning provided enough doubt for them

Applicant Randall Everett and his attorney, Mac Chenault, address the Hanover County Board of Supervisors in the top photo at left. David Newell, above, spoke in favor of the project. Iris Deford, the bottom photo at the left, a longtime resident of Doswell, expressed her concerns with a proposed motocross track in the community.

Dr. Joseph Elrod, Jr. and Dr. Bryson Dunham are excited to provide their patients with “gentle dental care” in a comfortable and relaxed environment. As they stay focused on the most current trends and technologies, they are proud to offer: • Invisalign orthodontics • Sedation dentistry • Implant restoration • Cosmetic dentistry • Surgical extractions • Restoration & Preventative dentistry • Full mouth reconstruction • Root canal treatment

to vote for denial. “I want this project in Hanover County,” said board chairman Wayne Hazzard, South Anna District. “I’m just not sure this is the right place.” Many Doswell residents agreed as they lined up to express their concerns during a public hearing held before the decision to deny was recorded.

The main issue expressed by opponents centered on noise with secondary traffic concerns. The applicant proposed three weekend events per year and a weekly operating schedule that ended activities at the track by 6 p.m. Chenault pointed out the noise is not constant and events are scheduled to include “down time.” The project had its share of proponents who voiced their support for the project, many of them local riders who search for facilities close to home to

practice their sport. Brian Watson, a Hanover resident, voiced his support for the project. “Me and my family are in full support of this project, he said. “It’s a great family sport. I believe this would be great for Doswell. This will be a positive facility teaching hard work, courage and discipline to young kids.” David Newell of Beaverdam also supported the request. “My two sons race. They are 12 and 9,” he said. “Motocross is a family sport. We are all

there to support and help each other out.” Everett, a world class motocross competitor, said he envisioned a motocross training facility that included health and nutrition classes in addition to the nuts and bolts of executing tricky moves on the track. Mac Chenault, an attorney representing Everett, described the sport as a family type entertainment, and said the project could supply badly needed economic development to that portion of the county. The land is currently zoned for agricultural use, but the CUP would have allowed the facility to operate within the current zoning. Some supervisors hinted the land, strategically located between Interstate 95 and the CSX tracks, could be put to a higher use, perhaps rezoned to Industrial under the county’s new land use policy. Members of the Jerusalem Baptist Church, situated within close proximity of the proposed project, voted not to support the project and their minister echoed those sentiments during the public hearing. “Surely, there are more out of the way properties where a motocross could be located,” see MOTOCROSS, pg. 37

to give at the race.” With Cameron Gallagher’s blueprints in their hands, her parents decided to continue where she had left off. They organized the SpeakUp5K race with the hope they could use it to bring parents, families and friends together to support one another and positively impact teenagers dealing with anxiety and depression. The first race was held at Byrd Park on Sept. 6, 2014, and attracted about 3,500 runners. The race also managed to raise $150,000 for the Virginia Treatment Center for Children. The mission of the Cameron K. Gallagher Foundation is to fulfill Cameron Gallagher’s dream and legacy by being a positive force that works to cultivate awareness and understanding of teenage depression and anxiety. Since the original SpeakUp5K race, the Gallaghers have organized a SpeakUp5K race in San Diego, California, which took place on May 22, and an upcoming SpeakUp5K race in Boon, North Carolina, scheduled for Aug. 22. When Tunstall, a close family friend of the Gallaghers, heard about the Gallagher’s ordeal he wanted to help in whatever way he could. “Everybody says ‘What can I do?’ ‘How can I help?’ and you know, the Tunstalls were able to take their talents and

what they do and say, ‘This is how we can help.’ And it does just open up to the whole community that there’s lots of ways to be involved and lots of ways to spread the message,” Grace Gallagher said. Tunstall and his wife wanted the Gallaghers to be involved with the building of the house from the very beginning, and, when the foundation was laid, he invited them out to the property. “Bobbie Sue and I met David and Grace out here when we were laying the foundation; the masons were putting the blocks in. David and I went in right there where that door is and placed mementos of Cameron’s in the foundation, the mason covered it up,” Tunstall said. “So when you walk across that threshold, I can guarantee you, you will feel her love. I felt it every day building this house.” The Gallaghers said the model home dedication means a great deal to their family and represents an innovative way in which their daughter’s message can be spread. “I think it shows that the community can contribute to the cause and get involved in the cause in more ways than we thought originally,” David Gallagher said.

MECHANICSVILLE — On June 25, a crowd gathered at a model home named “The Cameron,” located in the Villages at Cool Spring development as Jeff Tunstall, CraftMaster Homes president, dedicated this specific model to the Cameron K. Gallagher Memorial Foundation. CraftMasters also made a $50,000 donation to the organization. The two-story, 2,700-squarefoot home has four bedrooms and three bathrooms. The list price is $394,000 and contractors and subcontractors worked on the home at a discounted rate to enable CraftMaster Homes to make the size donation that it did, according to an article from the Richmond Times-Dispatch. The Cameron K. Gallagher Memorial Foundation was created by David and Grace Gallagher in memory of their 16-year-old daughter, Cameron Gallagher, who battled severe depression and anxiety. Cameron Gallagher was a sophomore at Freeman High School and died of heart failure on March 16, 2014, as she crossed the finish line at the Shamrock Half Marathon in Virginia Beach. After her passing, Cameron Gallagher’s parents found carefully laid plans she had been making in an effort to create a 5K community race. The idea behind the race, which Cameron Gallagher had named “SpeakUp,” was to help bring awareness to teenage depression and anxiety. “She had created the entire plans, she had contacted sponsors, she had talked to doctors about speaking,” Grace Gallagher said. “She actually wrote a speech that she wanted

E. Richard Swan, pastor, said. “We hope that you will vote no in support of our voices and our needs.” Other members of the community agreed and said the project was just not compatible with their community. Lindsey Tingler, a lifelong resident of Doswell, addressed several issues of concern, including the noise. “This will negatively impact our simple way of life that we all know and love,” she said.

“We’ve been told the hours of operation will be work hours. Most of the people that live in Doswell are elderly and retired who are home during the day, working in their gardens or sitting on the porch.” Other speakers noted the project will offer no jobs or tax revenue to the county. Beaverdam District representative Aubrey “Bucky” Stanley said he had been flooded with emails regarding the project, but many came from out of town. He received 203 votes in favor of the project but only ten originated from local

Is there something I’m missing?” Other supervisors expressed support for Everett

Ed Via, Ashland District supervisor, stood firm in his support for the proposed track. “I believe this is a safe environment for children and adults to learn to ride safely. After visiting the site, it appears to me the sound would be minimal due to its isolated location,” Via said. “I cannot support the motion to turn this project down.” The board voted to deny the application 6-1.

Going forward, David and Grace Gallagher hope to continue using the Cameron K. Post 175 hangs loose, gets win over Post 137 By Danny Polk For The Mechanicsville Local CHESTERFIELD – Casual and clutch. Those are two adjectives that describe some of the early season performances for Mechanicsville’s Post 175 American Legion baseball team. The even-keeled and easy-going group was at it again Wednesday night as they strung together eight hits for six runs en route to a 6-4 win over South Richmond’s Post 137. With the game tied at two in the sixth inning, Post 175 combined three hits – including a solo home run by Brandon Crosby – and a walk to score three runs. “It seems like the theme of our season is to get to the bullpen and scratch a few runs,” Post 175 manager Tyler Kane said, “When we get hits, we get them together. That’s great baseball, and that’s helped us out so far.” Post 175 was aided by solid outings from starting pitcher Brett Ayer and reliever Joseph Neagle, both recent Atlee graduates. The pair combined to surrender nine hits, but managed to pitch their way out of trouble – Post 137 left runners in scoring position in five separate innings. “South Richmond is always a great hitting team. We knew they were going to hit the ball well. We just had to contain

it,” Kane said. “Brett Ayer and Joseph Neagle gave us a great start and great relief off the bump for sure.” Ayer, a lefty who will play his college ball at St. Andrews University in North Carolina, worked a variety of off-speed pitches and let his defense clean up behind him. “My curve ball was really working today. I was doing a

really good job locating,” he said. “My change-up was working too – it’s not usually one of my go to pitches, but tonight I guess it was working.” Ayer, like many of his teammates, has the benefit of using American Legion competition as part of preparation for collegiate baseball. The majority of Post 175 has committed to play or just completed their first

season at the next level. “Legion, for me, is to keep getting my work in to prepare for next year,” Ayer said. “Hopefully I’ll get stronger and more prepared for college.” The laid-back atmosphere coupled with high quality baseball has played right into the characters that comprise Mechanicsville’s squad, Ayer said.

“The guys on this team are really cool. They’re hilarious,” he said. “I just love being around them.” “It’s definitely a lot different of an atmosphere than high school. It’s relaxed,” Kane said, “You come out here with a plan and just take your approach to the plate, and you just control what you can control.” Maybe a change of pace

“It’s great when you want to teach, like, doing all sprints, but if they don’t understand in freestyle that they need to pull a certain way – doing long pulls instead of short pulls – then it doesn’t matter how fast their arms go. They’re not going to increase their speed.” Ashcreek had a host of quad and triple winners. The Crocodiles quad winners were Olivia Fisher, Owen Guest, Oakleigh Hogg, Noah Kegley, Haley Lambert, Harrison Lambert, Jenna Martin and Nathan Shadik. Their triple winners were Eric Allen, Cere Duplissey, Sierra Kegley, Cameron Smith and James Taylor. Milestone had two quad winners: Wyatt Jones and Weston Williams. The Makos’ triple winners were Noah Brant, Penny Quinn, Ryan Reutti and Nate Sager.

and then they do a pull, versus and older kid who does two kicks per pull.” As the swimmers get more comfortable with their strokes, the goal is go faster. But that is not necessarily the most important aspect of the meets for most of the swimmers. “Our main thing is having fun at practice and having fun at meets – and dropping time along the way,” said Milestone head coach Maddy Murphy. “It’s always nice to win, but we really just want our swimmers to do well on an individual basis.” Potter said the Crocodiles begin to switch their focus from learning strokes about mid-season. “We tend to focus more on learning until right about now,” Potter said. “Then we start to focus on speed only because if they can’t do the stroke properly, then it’s not as successful.
