Members of the Hanover County Planning Commission regularly attend these meetings in an effort to gather more information on upcoming cases. The more information gathered before the actual hearing, the better the chance of making an informed and fair decision. At last month’s meeting, commission members were briefed on the Freedom of Information Act (FOIA) guidelines regarding what constitutes a public meeting. When more than two members of the same legislative body attend a meeting and conduct public business, the meeting is considered public and must be advertised and properly recorded. Assistant county attorney Dennis Walter explained that those community meetings where more than two commissioners are in attendance could raise FOIA concerns.
The purpose of the program is to discuss with veterans how they can help their fellow vets. Those who are active duty, retired, a prior service veteran or family of a veteran are invited to take part.
Ashland District commissioner Claiborne Winborne said the meetings provide valuable information, and members who attend are seeking input on which to base their upcoming decisions. “We’re not there to conduct business. We are there to listen,” Winborne said at last month’s Planning Commission meeting. “The FOIA is there for a purpose and is an imperfect way of dealing with ensuring public access, but it’s the rules under which we operate,” Walter replied. He said his interpretation of the law is that when more than two members of a body are meeting, it should be publicly announced. “It’s not my role to say if that is a good idea of or a bad idea,” Walter said. “It’s your responsibility to make sure that you comply.” Cold Harbor District commissioner Ashley Peace questioned whether the community meetings should be advertised

to solve the issue. “These are not county meetings. They are meetings held by applicants,” Walter said. Winborne said the county plays a prominent role in the meetings. “I’m not sure I’ve ever been to a meeting where Mr. [David] Maloney didn’t speak for the majority of the time,” she said. Maloney is the planning department director. Maloney said the guidelines do not apply to staff, and emphasized the purpose of the discussion was to advise commissioners on the FOIA requirements, not to discuss the merits of the act. “Staff is merely here to identify potential issues that may arise at some point in the future,” Maloney said. “There’s no limitation on the number of staff who can be present at a meeting at any time.” Winborne pointed out “when staff is present . . . it looks to the public like a county-sponsored meeting.” Maloney said the staff recommendations are informational in nature. “My intention is to provide some guidance to the commission, and not to discourage attendance at these meetings,” Maloney said. Megan Rhyne, executive director of the Virginia Coalition for Open Government, said the issue is “tricky.” “You’ve got the rule on one side that says FOIA applies to meetings of more than two people,” Rhyne said. “On the other hand, FOIA does not apply either to chance meetings or for community events, provided the purpose of which
is not to transact public business,” she added. Rhyne said determining what constitutes conducting public business is not clear. “Is it listening to others talk about it? Can one person talk? Can they all talk, so long as they don’t talk to each other?” Rhyne supports a slightly expanded interpretation. “While I don’t want officials using this provision as cover to get business done in an informal setting without notice and minutes,” she said. “But I also want officials to be able to meet with members of the public and hear from them about their concerns and answer questions if need be.” Planning Commission chairman Larry Leadbetter said he would like to see more research on the subject, but echoed concerns regarding the value of information learned at these types of meetings, and the importance of members being present. “Time is already limited when gathering knowledge of these cases,” he said. “If we keep moving in the direction we’re going, one day we are going to walk in that door and not know anything about the cases.” Rhyne said more than two members could possibly attend the meetings if they were not together and attended independently. “I think it does matter that they didn’t attend together, that they are not sitting with each other and that they are not talking with each other (or to each other through another person). If they’re adhering to these limits, I think they’re OK.”

OPINION | The Local Views From the editor
Superintendent search can be a daunting task While the Hanover County School Board prepares for the very important — and maybe even somewhat intimidating — process of filling the position of superintendent of Hanover County Public Schools, we are trying to maintain a sense of optimism as to how members move forward. It just so happens this writer has traveled that road before and, unfortunately, the outcome — as the old saying goes — left a bitter taste for those who volunteered their time and efforts to interview and recommend a qualified leader for the school system in my hometown. The school board appointed community members and I was among those selected (with, I might add, the blessing of my employer). Committee members were excited to be part of such a significant task. We put in many hours with candidates and as a group discussing them. But, as is typical in West Virginia, despite having met with educators that had impressive resumes, the school board appointed a politico’s relative. She was in education, but didn’t have the strong credentials some brought to the table. That’s just how it seems to go there. Yes, it’s sad — and frustrating. At least one candidate was vocal in expressing disappointment in the process. Yours truly agreed. Don’t go through the motions of spending the taxpayers’ money if you already have a candidate in mind. I don’t expect we’ll find the type of political maneuverings I’m familiar with from what seems like another life. To the Hanover County School Board, I have a hope for a search that is without question or controversy. I also hope that what matters most — the students — will remain in the forefront in filling such an important post. Dr. Jamelle S. Wilson continued a legacy started by her predecessor, Dr. Stewart D. Roberson, in that Hanover County Public Schools stands out and is envied across the region and throughout the state. This is our expectation. Whoever moves into the superintendent’s office in a full-time capacity accepts some challenges, as well as countless successes. As the search progresses, the students are the reason for any decision the school board makes. Let’s keep that in mind when naming a successor to Dr. Wilson. The future depends on it. Melody Kinser

Sludge issue: Who’s in control? By Jim Ridolphi Contributing Columnist I’m not sure if it’s the perception or the reality of industrial sludge that scares people the most, but the mere mention of that word, or anything associated with it, evokes a nervesplitting reaction from citizens. While some counties in Virginia have opted to endorse the controversial policy of using industrial sludge to fertilize state agricultural fields, others tremble when they hear the word. Experts will tell you that industrial sludge is different from the latest version of the treated sewage, biosolids. Biosolids are treated sewage that has been processed through wastewater facilities and then transformed
into fertilizer. Companies that want to apply the material to Virginia farmland are required to obtain permission from the state’s Department of Environmental Quality (DEQ). Once a permit is issued, landowners can apply the treated sewage to fields for 10 years, and the permitting process may be only providing lip service to concerned citizens who don’t want the practice utilized in their communities. They argue the studies are incomplete on long-term effects of applying waste to crops consumed by humans or the obvious environmental concerns. But, it’s the lack of local control that really irks some opponents. Allowing
the state to determine who can and how to use biosolids or sludge omits an important and vital element in the biosolids equation: citizens. Once the permitting process begins, concerned citizens can request a hearing when they obtain 25 signatures in opposition to the process. Synagro, a wastewater management company from Baltimore, Maryland, is now seeking permits to spread the mixture on 35 fields in Hanover County totaling about 750 acres. Most of those fields are already permitted and the process could begin anytime on those sites with the exception of one proposed site that fronts the South Anna River. see SLUDGE, pg. 22

Teachers that care, politicians that do not By Ragan Phillips Special to The Mechanicsville Local David Brooks has written a thought–provoking book, “The Road to Character.” I would recommend Brooks’ book to anyone who has an interest in the need for and the value of character in our everyday lives. Brooks asked people to respond with their thoughts about finding a purpose in life. I quote the response the Brooks query received from one Michigan school teacher: “Before class, I would sometimes sit in the chair of a student who was having a lot of trouble and pray that I might be a blessing to him that day.” When I read those words I could only think about the many wonderful teachers in our Hanover County Public Schools who must feel the same way. In their classrooms they see students struggling, not only academically but also because of outside issues, to get through the day. I know their hearts go out to these children. Figuratively speaking, perhaps even literally, these teachers want to sit in the student’s chair and pray that they can help. Teachers did not come to their vocation as a way to become personally wealthy. They became teachers because they love “teaching,” because they want to help students “learn” and because they want their students to become pro-
ductive members of society. But, in my opinion, teachers, the school system and our 18,000 students are being given the “back of the hand” by the Hanover County Board of Supervisors and the Hanover County School Board. County financial support of our schools, controlled by the BOS, has been slashed by $10 million over the past few years. Long overdue renovation of school facilities has been replaced by a new courthouse. Public education receives, year after year, a decreasing share of the county’s General Fund. School supply drive for needy students underway HANOVER -- In the middle of their summer vacation, the Hanover Youth Service Council (HYSC) is coordinating a county-wide school supply drive. All supplies benefit Hanover’s elementary, middle and high school students in need. The school supply drive started July 15 and runs through Aug. 14, ending with a live collection from 9 a.m. to noon Aug. 14 at the Kroger on 9351 Atlee Road in Mechanicsville. HYSC is collecting generic backpacks, composition books, supply boxes, twopocket folders, glue sticks, erasers, dividers, durable binders, supply boxes, pencil pouches, notebooks, hi-lighters, crayons, pencils, markers, colored pencils, loose leaf paper, scissors, sanitizing wipes, dry erase markers, hand sanitizer, tissues, index cards and any other school supplies. “To ensure that we maximize the impact the drive has on the schools, our department intern Jessica Parks and youth volunteer Christine Minozzi have spoken to each school’s counselor to determine what supplies are needed most,” David Duck, HYSC advisor and youth services specialist with the Hanover County Department

The board considered a full RFP process that usually takes about six weeks and a quick quote procedure that is more streamlined time-wise but requires a more detailed summary of services. The quick quote option also forces the board to accept the lowest bid, an element that troubled some members. Assistant superintendent David Myers outlined the previous RFP the county issued when Dr. Stewart Roberson left the system five years ago, and noted the “RFP process offers a broad concept of services.” Myers introduced a draft detailing the summary of
proposed work. The quick quote process requires a more detailed summary of services. Both could be issued within a week, according to Myers. “What’s before you tonight is whether you want to use the quick quote process or the RFP process,” Myers said. Ashland District representative Hank Lowry asked if the board was required to award the bid to the lowest bidder, and if there was a possibility of speeding up the process. “This is a plum job. People are going to want to work with us,” Lowry said. “We should be able to have a firm hired by Aug. 15,” Lowry said. week summer program for gifted students from 32 districts. “We are hoping this will become a prototype so this program can be replicated around the state,” Lewis said. The proposal must be approved by Virginia Board of Education and the General Assembly. The plan hopes to begin in the fall of 2016 with about 40 students. “There is not a program like this around the country. People will be looking at how we put this program to work,” Lewis said. Workforce readiness and career training are hot educational topics nationwide, and the program is designed to put Hanover County on the cutting edge of the movement toward technical training and career readiness. “We believe it’s going to be a very important program, and one that will grow over time. We hope you will approve it tonight,” Lewis said. The retired Fauquier County superintendent said the proposal is only the initial portion of a long process. “The proposal is just the first step,” Lewis said. The logistics of the program will be worked out beginning this fall. “There’s a lot of work left.” “It’s a phenomenal proposal,” Mechanicsville representative Roger Bourassa said. Del. Christopher Peace, R97, introduced the first proposal for the planning grant and, with the help of co-sponsor Del. Buddy Fowler, R-55, secured the $100,000 required to initiate the planning process for the new Regional Governor’s CTE summer school program. The board also held its annual organizational meeting where Bob Hundley was elected chair for the upcoming year and Sue Dibble will serve as vice chair. The meeting also was the first for interim superintendent Dr. Robert “Rick” Richardson.

OBITUARIES | Death Notices & Funerals ROBIN ADAMS Mrs. Robin Mays Adams, of Doswell, passed away on July 11, 2015, due to a freak auto accident. Born in Lynchburg on February 25, 1965, Robin and her family have lived in Hanover since 1996. Married to Tommy E. Adams for 29 years, they have owned and managed their businesses, Adams Electrical and Security Systems Inc. and Crystal Clear Cleaning LLC. Robin was preceded in death by her father, Wyatt Mays; and her grandmother, Frances Ballew. In addition to her husband, Robin is survived by her mother, Gail Stewart; and stepfather, Robert Mell of Stafford; son, Josh Adams (Jen) of Ashland; son, Dillon Adams (Sarah Woytowitz) of Richmond; daughter, Holly Adams (Bradley Anderson) of Doswell; son, Wyatt Adams of Doswell; grandchild, Easton Adams of Ashland; and numerous family, extended family and friends. Robin was always full of life. She was a fun and loving daughter, wife, mother and friend. She was always there for you if you needed someone to talk to, a shoulder to cry on and never missed her kids’ sports games and award ceremonies. She had a love for animals, dancing, music (especially Luke Bryan and Rascal Flatts) and always knew how to have a good time. She would do anything for you no matter what and her dedication to her family and friends will always be remembered. RAYMOND BOWLES Raymond Allen Bowles, 84, of Mechanicsville, went home to be with the Lord on Friday, July 17, 2015, after a long battle with Parkinson’s Disease. He was preceded in death by his parents, Thomas Stanley and Myrtle Pitts Bowles; brothers, Stanley, Charles and George Bowles; sisters, Louise B. Adams, Myrtle B. Farmer and Ida B. Beahr; and is survived by his loving and devoted wife of 59 years, Betty Ann Bowles; two daughters, Brenda B. Beasley (Billy) and Deborah B. Allen (Bill); four grandchildren, Brian Beasley (Jen), Kristin Rosendahl (Rich), Kevin Allen and Kelley Allen; one great-grandson, Ethan Rosendahl; two sisters, Thelma Swails (Jim) and Joyce Dunkum; as well as many nieces and nephews. Raymond served in the U.S. Navy on board the USS Missouri. He enjoyed gardening, yard work, and especially his church. Raymond was a lifelong member of Pole Green Church of Christ, having served as an Elder, Deacon, Sunday school teacher and was involved in various committees. Evelyn was active in the Eastern Star, the First United Methodist Church and later the First Christian Church in Charlottesville. After moving to Mechanicsville to be with her daughter, she became a member of the Fairmount Christian Church. Her faith in Christ and her church were always of utmost importance to her. For many years she sent cards and letters of encouragement to those much in need. She is survived by her daughter, Carol Greene (Roland) of Mechanicsville; grandson, Christopher Greene; granddaughter, Courtney Mullins (Scott); and great- grandsons, Daniel Mullins and Andrew Mullins. Also surviving are
several nieces and nephews. Funeral services were held at 11 a.m. Wednesday, July 15, 2015, at the Mechanicsville Chapel of the Bennett Funeral Home at 8014 LeeDavis Road. He was a mechanic with FedEx in Mechanicsville, committed to keeping their delivery vehicles on the road. He loved spending time with friends and family at the beach and river. Fatality on Cold Harbor Road and Catlin Road Staff Report news@mechlocal.com MECHANICSVILLE -- A Saturday afternoon crash claimed the life of a Richmond man. According to Maj. Michael J. Trice of the Hanover County Sheriff ’s Office, Tyrone A. Davis, 43, was driving a 2008 Lexus KS460 on Cold Harbor Road at the intersection of Catlin Road in the Mechanicsville area. Davis, traveling southbound, crossed the double solid line, entered the oncoming lane and struck a northbound 2001 Ford F350
van head-on. Davis and the driver of the van were transported to the hospital. Trice said Davis was pronounced deceased upon arrival at the hospital. The other driver was treated and released from the hospital. Officers arrived on the scene at 3:25 p.m. Investigators continue to evaluate evidence in an effort to determine all factors leading up to this incident. “We ask that the family and friends of Tyrone Davis be in your thoughts and prayers,” Trice added.

The manor house was rebuilt in 1850, withstood the Civil War, and was owned by several generations of family before being sold to Andy Shield, the current property owner. “My son got involved with the acquiring of this property because we had done the work over at the Sheltons’ home at the original Rural Plains property and preserved that … and wanted to have this place preserved,” Shield said. Shield acquired the Rural Plains property in January 2002 and, in 2006, donated it to the National Park Service. The Pine Splash estate was acquired in about 2004, and
Shield is again working with the National Park Service to open the property to the public. He is collaborating with the National Park Service to hold a “History at Sunset” event at 7 p.m. Saturday, July 25. “I think we are going to try and mix some walking and some talking -- initially describe what happened in this vicinity and provide some context and then talk about specifics of the battle,” Robert Krick of the National Park Service said. “For three days this was part of the front line of the United States Army right here, at the end of May in 1864.” There also will be eyewitness source material from people that lived on the property in 1864, as well as information about the colonial history, the buildings, the architecture and the archeology, Krick said.

cal plank construction, very unusual, very rare,” Shield said. “The head architect at Colonial Williamsburg, Mr. Ed Chapel, said it’s a unique building on the East Coast because it’s so much of that rare architecture in place and in good condition, which Gordon has made a lot better.” Lohr is able to restore the cottage to its original craftsmanship because of his extensive hand woodworking tools. He has patterns on the blades that can recreate mullions to the same degree, and originally match trim and architectural details to those that were made in the 1740s and 1750s. The cottage is still being worked on, but, as of now, has been stabilized, enclosed for the most part and weather-proofed. “It’s kind of a tiny house without a lot of fancy features, but they did an awful lot of nice work on it to dress it up for the time,” Lohr said. “It’s what you would call vernacular architecture.” Going forward, Shield and Lohr will continue to work on some of the windows and doors and some internal trim, among other areas of the cottage. While getting into the floorboards and the basement, Lohr has found a handful of artifacts that will be on display during the National Park Service’s “History at Sunset” event. Lohr has come across a Union button from New York State, an 1809 large cent in the mortar, a 1716 English farthing and green-rimmed China that was said to be among Patrick Henry’s favorites. “This is one of the untold stories of, like Andy was saying, not just Hanover history but American history,” Ruth said. “We can only tell a small piece of this story at Rural Plains, and get into the, again, the traditions of Patrick Henry. This helps to complete the story and people can get a better concept of really the extent to that engagement in 1864.”

The urgent care facility application was deemed in line with listed conditions, including being compatible with existing uses on the surrounding properties, according to the commission. The property is owned by Bramel Construction and, in 1999, town council approved a conditional rezoning of the area from R-2 to RO-1. In a recent zoning ordinance update, RO-1 was removed as a zoning district because of its similarity to B-4. Under the B-4 zoning and conditional use permit, the BetterMed urgent care facility has a maximum height of 35 feet, with requirements for a 25-foot setback in the front, a 20-foot setback to the sides and a 25foot setback to the rear. For landscaping, one street tree is required per 50 foot of street frontage as well as a 10 percent tree canopy, 5 percent of the parking area
landscaped and 5 feet of peripheral parking landscaping. The ordinance also calls for a continuous visual screen, with the height at planting being at least 6 feet. During its review of the application, the planning commission recommended that a 6-foot fence be put in place in addition to the already required vegetative buffer. The purpose is to provide an area of retail shopping and personal services to serve the residential area surrounding it and buffer between the highway commercial and residential areas while maintaining a residential character. During the public comment period, Claiborne Winborne, the Ashland District representative on the Hanover County Planning Commission, spoke on behalf of her neighborhood, which resides in the surrounding areas where the urgent care facility will be located. Winborne said the residents were concerned about an influx of traffic into their neighborhood because of the ability for people to turn left onto Randolph Circle when exiting the
property. Council members agreed with Winborne and, before final approval of the CUP, added a condition that a concrete diverter and appropriate signage be installed and maintained by the applicant to prevent a left turn movement onto Randolph Circle when exiting the property. Council member Faye Prichard said she also would like the CUP to restrict operating hours of the facility to prevent a future tenant from keeping the building open late, causing an adverse effect on the community. Council again agreed and added a fifth condition to the CUP stating that the hours of operation for the facility be 8 a.m. to 10 p.m. During the meeting, town council also approved ORD2015-04, an ordinance to vacate an area of 1,595 square feet of existing right-of-way along the boundary of State Route 1/ North Washington Highway and to transfer this property to BSAT1 LLC, the original owner of the property. In 1999, the town incorrectly asked for 20 feet of right-of-way from one property owner’s side of the road instead of 10 feet. It is com-
mon practice for the town to request equal parts from adjacent property owners. The town planning commission recommended transfer of the property without payment because the purchase of the property was in error. To correct that error, the property simply needs to be transferred back to the original property owner, Nora Amos, director of planning and community development for Ashland said. The town does not have any future use for the property and council approved the transfer of the right-of-way back to Brad Harmon/ Bramel Construction. The approved BetterMed urgent care facility will provide prompt medical care with average wait times in and out at about 45 minutes, Brown said. The facility will be run by trauma care physicians, will be open seven days a week, and will have cross access from the side from Randolph Circle and Caroline Street. “I’m super excited about this business, I just want to make sure we do it really well,” Prichard said.

case where the town charged the owner of a local motel with a zoning violation. The motel was being occupied by a number of long-term residents and the charge stated that the use of the motel no longer complied with the zoning because the property was being used as more of an apartment than a hotel. In summer 2009, the case went to court. The district court judge agreed with the evidence presented and that the motel was in violation of its current zoning distinction, but said the town’s code did not properly define transient. In fall 2010, after 15 months of research, town staff presented a possible solution to the town code and defined transient as someone that stays at a property less than 30 days, with a few exceptions. However, the discussions stayed there and did not advance further until summer 2014, when the issue began being thoroughly looked at, Goodman said. To guide their next steps and possible proposals of changes to the town code, Goodman and his staff referenced research that was openly available, including a Bureau of Justice-funded report by the Cops Office out of the U.S. Department of Justice called the “Disorder of Budget Motels.”

The report referred to a set of studies from Chula Vista, California, an area that was experiencing similar problems as Ashland – growing calls of service and public demands of service because of long-term hotel residency. Two of the main points gathered from the Chula Vista study, Goodman said, were that low room rates are strongly correlated with higher calls for police service and that direct access to motel rooms allow problem guests and visitors to come and go with little detection versus a lobby area. Goodman said he believes Ashland is seeing some of the same issues at its hotel and motel locations and that the majority of occupants are longterm residents, which in turn, makes those locations less attractive for travelers looking to stay for just a night or two. Another issue with longterm residency is that in the commonwealth of Virginia, once a person has stayed at one location for 90 days, they are considered a tenant. At that point, the landlord must follow the tenant act in order to get the resident off the property. This could take up to two to three months to go through the court system, according to Goodman. In fall 2014, the police department presented a position paper to town council, and Town Manager Charles Hartgrove directed Goodman

and his staff to pursue meetings with various stakeholders, including neighboring businesses, churches, those living in hotels and hotel management. From Dec. 1, 2014, to May 28, 2015, 13 meetings were conducted with well over 100 unique individuals in attendance. The three major stakeholders meetings with faith leaders occurred on March 12 hosted by the Ashland Church of God, April 16 hosted by Shiloh Baptist Church and May 28 by St. Anne’s Catholic Church. Additional presentations were given at the Market Ashland Partnership meeting and Ashland Kiwanis. Prior to meeting with the churches as a whole in the focus groups, the police department met with several individual churches, and three major issues were revealed from those discussions, Goodman said. With the current rate of benevolent demand, many of the churches said they couldn’t keep pace in the future; many said their benevolence efforts were being taken advantage of by long-term motel residents that were asking for assistance frequently, or multiple times in one day; and several inquired about a higher degree of coordination to try to track those asking for help, how often they are receiving help and where they are receiving help, to ensure they were spreading their wealth out equally among
the needy, Goodman said. Goodman and staff also met with businesses, including some that are located next to problem locations. Concerns voiced by business owners included the upkeep and appearance of the entire corridor, not just one specific hotel location, reviews on social media casting a cloud over the entire area and experiencing direct loss, larceny, that they feel is directly attributed to the current condition of certain hotels, according to Goodman. Talks with motel residents were facilitated by a reverend of the Duncan Memorial United Methodist Church. The hotel residents at this meeting are not the ones putting the burden on public service, Goodman said. These are the people that are truly in a tough spot and expressed embarrassment about their current situation. Many of the motel residents at the meeting said they felt they are stuck in a cycle of poverty and growing debt, while some work off debt to hotel managers by being housekeepers and maintenance workers and some simply don’t have a full understanding of government resources available, Goodman said. The number one reason for continued residency in hotels is that people can’t save enough money for a security deposit or a first month’s rent and the number two reason is poor
credit, according to Goodman. One positive that came out of the meeting, however, is that many long-term motel residents are aware of the help provided by local faith-based organizations. After gathering information, Goodman and his staff came up with a set of possible regulatory steps that they took from the Chula Vista study and from regulations being utilized by surrounding localities. Regulatory measures up for discussion during meetings with the faith-based groups include: Requiring all adult guests to present a government issued photo ID. Requiring all guests and visitors to be at least 21 years old, or accompanied by a parent or legal guardian. Requiring all motels to
maintain a guest ledger, either in paper or digital form. Requiring a manager be on property at all times. Limiting occupancy to no more than 30 days in a 90day period. Limiting occupancy to no more than 90 days in a six month period. Requiring all motels with at least 25 rooms or more to maintain a health permit from the state health department that is applicable to all rooms. Seeking cost recovery for excessive calls to hotels. Designating 5 to 10 percent of rooms to long-term guests. At the first meeting with faith leaders, about 45 people attended and the the proposed regulatory measures were presented on poster board. see CHIEF pg. 21

was the best route to follow: Limiting occupancy to no more than 30 days in a 90-day period. Designating 5 to 10 percent of rooms to long-term guests. There are some hotels that depend on offering free room to those that work there. With this option they would like to pursue an extra layer of protection, an extra layer of regulation for those rooms, such as a license or conditional use permit. Limiting occupancy to no more than 30 days in a 90 day period, but with an effective date of April 1 2016. This date was chosen due to the typical weather during that time of year not being too severe. Goodman and his staff also requested that town council consider updating the town code when it comes to nuisance violations and language. Goodman proposed adopting a “Bawdy Place” nuisance language as allowed by Vrginia Code, section 15.2-908.1. This code would essentially allow
the town to take corrective against the owner of a property to evade a bawdy place, Goodman explained. “Drug Blight” nuisance language also was presented, as allowed by Virginia Code, section 15.2-907. This code allows corrective civil action against the owner of the property to eliminate drug blight. “I’m not so sure there is a silver bullet to this problem because it is so complex,” Goodman said. “No one wants to see someone put in a worse situation because of regulation.” Following Goodman’s presentation and some discussion and questioning by town council, Hartgrove suggested staff schedule a work session to discuss the issues and more accurately clarify how to proceed. Council agreed and Hartgrove will work with staff to organize that work session. “I want to make sure anything we end up doing we don’t do it half-heartedly,” council member James Murray said.

from runoff or bad management, and each site is required to provide a detailed plan for best practices in managing the tracts. When the General Assembly reconvenes next year, biosolids again will occupy center stage in conversations between localities and state agencies. Expecting different results from that process may be a little bit over-optimistic.

It’s simply too many kids . . . and not enough time to be the teacher I know these kids deserve.” Here is the bottom line. If the residents and taxpayers of Hanover County do not stand up and demand support for teachers and the public school system it will fail. Past superintendents Stewart Roberson and Jamelle Wilson built the foundation of a fine school system. But that system is being slowly undermined by publicly elected officials and their appointees who fail to aggressively support the schools. I am sure that everyone

Will participated in the ceremony at University of Mary Washington on Sunday, May 31. Her brothers Xander and Ashton, who had both previously earned this award, joined her at the event. Will double-qualified for
the award, her scores being among the highest in the state on both the Verbal and Quantitative tests. A participant in the CTY Talent Search, she was recognized for her exceptional performance on a rigorous, above-grade-level test given to academically talented second-through-eighth-grade students. In her free time, Alexa enjoys drawing, reading, playing violin in the Richmond Symphony Orchestra Youth Orchestra Program and volunteering for Miracles in Motion, a dance company for students with special needs. As part of the CTY Talent Search, advanced young learners take above-grade level tests that identify academic talent and reveal gaps between a child’s academic program and her actual
capacity for learning. Seventh and eighth graders take the SAT or ACT — the same tests used for college admissions. These students, along with second through sixth graders, can also take the School and College Ability Test (SCAT), an above-level test, or the Spatial Test Battery (STB), which measures spatial ability. Will, a student at Mechanicsville Elementary School, was one of more than 33,000 students from 60-plus countries who participated in the CTY Talent Search this year by testing between March 2014 and February 2015. Because of the difficulty of the tests, only about 30 percent of students who participated earned an invitation to a CTY Awards Ceremony

Convicted sex offender plead guilty and sentenced for child porn HANOVER -- Timothy Warren Kromer, 38, of Mechanicsville, pled guilty to four counts of possession of child pornography and was sentenced to six years and nine months (35 years’ imprisonment with 28 years three months suspended) in Hanover County Circuit Court on Tuesday, July 14. Kromer is a registered sex offender and previously served two years and one month in 2010 for possession of child pornography and three misdemeanors for unlawful filming. Mark R. Herring, Attorney General of Virginia, made the announcement after the defendant was sentenced by Hanover County Circuit Court Judge J. Overton Harris. “Each time a criminal clicks on a photo of an exploited child, that child is revictimized, they are forced to relive trauma, and their healing process in inhibited,” Herring said. “Any adult who would knowingly participate in this victimization deserves to be behind bars, and the fact that the defendant is a repeat offender makes his conduct that much more egregious. I’m pleased with the sentence in this case and grateful for the collaboration between my office and the police officers who work tirelessly to track down these offenders.”

Kromer was identified after the Hanover County Sheriff ’s Office (HCSO) received information that he was using a cell phone to store child pornography. Once it was confirmed that the device belonged to Kromer, the Hanover County Sheriff ’s Office obtained a search warrant for his residence, which was executed on Dec. 12, 2014. During the search, officers found Kromer in possession of the targeted cellular telephone, and the defendant, who is a convicted sex offender, admitted to using the cellular telephone to search for all kinds of photographs and admitted seeing sexually explicit images of children. A forensic analysis of the cellular telephone confirmed the defendant’s use and revealed four images of prepubescent children engaged in sexually explicit conduct. This case was investigated by officers with the Hanover County Sheriff ’s Office. Assistant Attorney General Tommy Johnstone of the Virginia Attorney General’s Office prosecuted the case on behalf of the Commonwealth, with cooperation from the Hanover County Commonwealth’s Attorney’s Office. Life Church to hold Vacation Bible School MECHANICSVILLE -Life Church will be holding its annual Vacation Bible School from 6 to 8 p.m. Wednesday through Friday, July 22-24, for ages 2 through 11. This year’s theme is “Camp Kilimanjaro: A Journey through Proverbs.” At “Camp Kilimanjaro,” children will be led through the tropical forest by skilled and qualified children’s workers as they learn the wisdom that comes from the Biblical book of Proverbs. MECHANICSVILLE - Oak Knoll Middle School’s yearbook program was named a 2015 Jostens National Yearbook Program of Excellence. The program recognizes engaging yearbooks that reflect a broad representation of the student body while helping students develop 21st century skills. The Oak Knoll Middle School award-winning yearbook program was led by editors-in-chief, Anthony Kayode and Frances McDaniel. Yearbook staff members were Grace Bost, Catherine Cadavid, Shinesha Crumbley, Olivia Everhart, Quinn Kellogg, Catherine Miller, Khyel Munios, Megan Kratzer, Courtney Wells, Harrison Wilson, Hannah Atkeison, Grace Bakeman, Madison Dameron and Kailey Gagne, under the direction of Amber Miller, Oak Knoll yearbook adviser. “I could not have asked for anything more from our yearbook staff. The eighth graders returning this year got a taste of success after being awarded the 2014 Jostens National Yearbook Program of Excellence award last year, so the editors set a goal of not only meeting the qualifications for Excellence again this year, but they wanted to exceed the qualifications. This yearbook staff is a talented and compassionate team dedicated to creating a book that the school and community would be proud to be a part of,” Miller said. The Hanover County Pound, located at 12471 Taylor Complex Lane in Ashland, has two wonderful pets available to a good home. Mia, 405828 1-year-old female Pitbull. She has had her first set of vaccines and is Heartworm test negative. She has been at the Shelter for 3 weeks now. She was a bit shy at first, but has now developed a very sweet personality. Mia gets along well with other dogs. She might need a little training but we believe she will make a very good pet for some one. Junis, 406053 is a 2-year-old female cat. She has had her first set of vaccines and her FELV/FIV test is negative. Junis has got to be one of the nicest cats we have had at our Shelter. She loves everyone she comes into contact with. She even gets along well with dogs. Junis will be the ideal house cat. She loves to lounge in her bed and visit everyone as well. n the brutal heat of this summer, Hanover County Animal Control reminds all citizens that leaving your pet in your vehicle for even a few minutes on sunny days – even if the windows are not rolled up – can be critical to them. “A pet can die in only a few minutes if left in a car even with the windows rolled down,” Jeffrey S. Parker, chief of Hanover County Animal Control, said. “Bring them inside or leave them at home, but don’t leave them in a car. Even when it’s only 80 degrees outside and sunny, the inside of a car gets hot very quickly and your pet will become overheated.” On a warm, sunny day, the temperature in a parked car can reach a temperature of 120 degrees in minutes, even with the car window partially open. “A pet can quickly suffer brain damage or die from heatstroke when trapped in these high temperatures,” Parker said. Parking in the shade offers little protection, as the sun shifts during the day.
If you must travel with you pets and have to stop, it’s recommended to leave the vehicle running with air-condition on so the pet has cool air circulating through the vehicle. Have your spare key to then unlock the vehicle. If your pet is exposed to high temperatures: Be alert for signs of heat stress — heavy panting, glazed eyes, a rapid pulse, unsteadiness, a staggering gait, vomiting or a deep red or purple tongue. If your pet becomes overheated, you must lower its body temperature immediately. Move your pet into the shade and apply cool (not cold) water all over its body to gradually lower its temperature. Apply ice packs or cool towels to your pet’s head, neck and chest only. Let your pet drink small amounts of cool water or lick ice cubes. Finally, take your pet directly to a veterinarian — it could save its life. If you see an animal in a car exhibiting any signs of heat stress, call 911 immediately. Hanover County Animal Control and other
law enforcement agencies also will be patrolling certain areas including parking lots looking for pets and other living things that may be in heat distress because of being left in vehicles. If your animal dies as a result of being left in a vehicle, you can be charged with a felony count of cruelty to animals, which if convicted could lead to jail time. Some other tips for taking care of your pet in hot weather, from the American Society for the Prevention of Cruelty to Animals (ASPCA): Don’t force your pet to exercise after a meal in hot, humid weather. Exercise it in the early morning or evening, and keep walks to a minimum. A dog standing on hot asphalt. Its body can heat up quickly and sensitive paw pads can burn. Do not take an animal to the beach unless you can provide a shaded spot and plenty of fresh water. Rinse it off after it has been in salt water. see PETS pg. 29

ETTRICK -- The Central Intercollegiate Athletic Association (CIAA) has announced the 40 studentathletes from its 12 member institutions selected to the CIAA Commissioner’s AllAcademic Team. Among those student-athletes was Virginia State University’s Brandon Robinson, a Mechanicsville native. Robinson graduated with a Criminal Justice degree from VSU on May 2. He played a major part as a linebacker on the Trojan football team. He led the team defensively with 62 solo tackles, 24 assisted tackles, five sacks, one block and recovered two fumbles.

National Night Out set for Aug. 4 HANOVER – Maj. Michael J. Trice of the Hanover County Sheriff’s Office has announced that National Night Out will take place Tuesday, Aug. 4. He said National Night Out is an annual campaign that promotes police-community partnerships and neighborhood camaraderie to make our communities safer. Neighborhoods, businesses and community organizations across the nation host block parties, festivals, parades, cookouts and other various community events with safety demonstra-

Post 175 clinches berth in District 11 final By Dave Lawrence Sports Editor MECHANICSVILLE – Mechanicsville Post 175 starting pitcher Joey Pride clawed his way through eight innings against one of Post 175’s most dogged opponents this season – the Colonial Heights Post 284 Buccaneers – Sunday night at Atlee High School, stubbornly defending a one-run lead for most of that time to earned himself a 2-1 victory and earn his team a two-day break in the American Legion District 11 tournament. With the third-round victory in the winner’s bracket, Post 175 advanced to the final of the double-elimination tournament, which will be held tonight at 7 p.m. at James River High School. If Post 175 loses tonight, another game will be held Thursday at 7 p.m. – also at James River – to determine the district champion. The district champion advances to the American Legion state tournament, which begins July 28 at Fireman’s Field in Purcellville. Every game this season between Post 174 and the Buccaneers have been decided by just one run, and Sunday’s game was no exception. Post 175 struck for two runs in the bottom of the first inning. By Dave Lawrence Sports Editor MECHANICSVILLE – As the Greater Richmond Aquatic League regular season winds down, teams are focusing more on qualifying swimmers for the league’s champs meet in August than on their immediate opponents in the weekly meets. The regular-season meets are one big preparation for the champs meet as swimmers – particularly the younger ones – learn new strokes and all seek to drop times to qualify for the last big meet of the season. This proved the case Wednesday night at Mechanicsville Recreation Association’s pool, where the Makos hosted Ashcreek in a GRAL Division 2 contest. The Crocodiles, with a deeper roster, edged Mechanicsville 1,5511,334. “We’re doing OK,” said Ashcreek head coach Natalie Potter. “We’ve got to see who’s [going to Champs] and who’s not. They’re all improving their times. Even the ones that have made it to Champs, they’re doing better and they’re getting faster. We’re just looking forward to getting there.” The teams had one more

Buccaneers responded with one run in the third. “Any time these two teams meet, it is going to be a good game,” said Post 175 manager Tyler Kane. “I was expecting a 2-1 ball game. I wasn’t expecting both of our runs to come in the first inning, but I knew that that lead was not safe and I knew that we had to take care of business defensively for us to hold that lead.” Pride fought to keep the Buccaneers from adding any more runs until relieved by Jacob Weis in the ninth. “From the first [inning] through four, it was kind of difficult to locate every pitch,” Pride said. “I had the sun right in my eyes and it was the hottest, so I knew I had to rely on my defense and luckily they did really well out there in those innings and afterwards.” There were times, however, that Post 175 looked shaky, especially after a big throwing error allowed a Buccaneers runner in the sixth inning. Kane had to come out to the mound to settle everyone down. “At that time, we had made a few mental mistakes defensively,” Kane said. “I told the guys we had to step it up with our pre-pitch thoughts – knowing where we were going to go with the baseball. … It was trying to

So it’s been a good place for me. … I’ve had a great time working with the community and the kids and everyone involved.” Athletic directors and coaches spend a lot of time working after hours, so the move might have a more personal benefit to Just. “I might get a little more family time,” he said.
