Clinic scotches nasty rumours

■ ALMOST eight years after the horror of the 2009 Black Saturday fires, $698.5 million is about to be paid to victims.

Lawyers are predicting that funds will be transferred to injured claimants prior to Christmas, next week.

Other payments will be made early in 2017.

■ The Rotary Club of Seymour has named Leading Senior Constable Jane Marks as the recipient of the Community Police Officer of the Year award for the Seymour area.

Accompanying her last week were her family, the nominating officer of the award, Senior Sergeant Dean Williams, and representing Victoria Police, Acting Inspector Ross Britain.

PREPARATIONS FOR CODE RED ■ Murrindindi Shire Council is flagging its arrangements on Code Red fire warning days.

“Whilst the recent wet weather has delayed the start to the fire season, the conditions have been ideal for grass and vegetation growth,” says a Council statement released on Monday (Dec. 12).

“As the weather warms up for summer, it is a reminder to all of the need to review bushfire prevention and preparation plans.

“Council is well underway with its own annual fire prevention program and in planning for changes to its service delivery that will be required on days declared to have the highest fire danger, Code Red,

in the North Central Fire Ban District.

“The likely reduction in the services offered by Council on a Code Red Day is set out in Council's Service Provision on Code Red Days Policy on Council's website.

“The policy aims to ensure that Council staff, volunteers and members of the public are not placed in situations of undue risk on Code Red Days when conducting Council busi-

ness or accessing Council's services.

Murrindindi Shire Council Chief Executive Officer Margaret Abbey said if a Code Red Day is announced, the clear message from the CFA is that people should enact their Bushfire Survival Plans and leave areas of high bushfire risk, either the night before, or early in the morning.

"Council is likely to operate with altered or reduced service levels if a Code Red Day is declared.

“We are talking about very dangerous weather conditions that pose extreme risk to life and property should a fire start," Ms Abbey said.

Mr Benedykt said: “I'm here once again to present scholarships to five students on behalf of Freemasons Victoria “It's very humbling. Freemasons have been supporting this and two other primary schools in the area that were destroyed by bushfires several years ago.”

■ Communities surrounding Lake Eildon are invited to a celebration morning tea for the official launch of the Devil’s River mobile phone base station.

The celebration will be held at 10.30am tomorrow (Thurs., Dec. 15) at the Herb Fitzroy Day Visitor Centre in the Fraser National Park.

“The mobile phone base station is the second of 38 to be launched or upgraded across Indi under the Mobile Black Spot Program, funded by the Federal and State Governments, Telstra, Optus and local councils,” says a spokeswoman for Indi MHR Cathy McGowan.

“Improvements to mobile reception will benefit residents, visitors, emergency services personnel and tourism operators in the area.

Ms McGowan and Telstra General Manager Steve Tinker have extended an open invitation to celebrate the launch.

“Come along and celebrate this great achievement for Murrindindi,” Ms McGowan said.

“It is the result of local people lobbying effectively with council and the Indi Telecommunications Action Group,” Ms McGowan said.

An announcement was made this month of an additional tower for Mt Dom Dom under Round 2 of the Program.

● Ron Ben-David ■ Essential Services Commission Chair Dr Ron Ben-David has hit back at allegations made by Cr Eric Lording and ex-Cr Chris Healy about Murrindindi Shire rate increases.

The Commission earlier this year allowed a 5.1 per cent rate increase, despite a 2.5 per cent cap put in place by the Andrews Labor Government.

In a letter late last month to a Parliamentary Inquiry Into Rate Capping, Dr Ben-David said that the then-Councillors alleged that the Commission’s decision had been “politically motivated”.

Dr Ben-David said ex-Cr Healy implied that the Commission coul have only reached its final decision if it had been subject to “some sort of external influence”.

“These allegations are unfounded and wrong,” Dr BenDavid said late last month.

“As a regulator established under our own Act of Parliament we take with great seriousness our responsibility to discharge our duties independently and impartially.”

■ The City of Whittlesea has successfully secured $8.1 million in state government funding to build seven community projects with $4.3 million to be invested into projects in the North Ward.

Painted Hills Recreation Reserve and Community Soccer Centre in Doreen South ($3.925 million), Oakbank Boulevard Playground and Township Link project in Whittlesea ($220,000) and the Community Facilities Solar Photovoltaic Roll-out at 32 kindergartens and community centres ($200,000) are among the projects to receive the funding boost.

Saleyards works start ■ Murrindindi Shire Council has commenced Stage 2 development works at the Yea Saleyards.

The works are funded through the Australian Government's National Stronger Regions Fund, and will increase sales capacity and provide additional comfort for livestock, clients and employees.

H’wood fatality Police say that a driver died at the crash scene at Homewood on Monday afternoon.

It is believed a car travelling west on the Goulburn Valley Hwy left the road and wentdown an embankment about 3.45pm.

The car crashed into a tree and immediately caught fire which also caused a grass fire nearby.

CFA were in attendance and contained the fire.

Identification of the deceased is still underway.

The highway was closed between Strath Creek and WhittleseaYea Rds.

Second chance

■ A woman who appeared in Mansfield Magistrates’ Court was lucky to be given a second chance by Magistrate John O’Callaghan, commented the Courier.

The former Piries resident was charged with the theft of a motor vehicle, which was subsequently destroyed by fire.

Her appearance in court was part of a successful police operation which had led to the arrest and conviction of her ex-partner for offences involving arson and burglary.

In her case, she was charged with the theft of a hire car.

She is also liable for a payout of $28,000 to the car hire company, as the car was subsequently destroyed by her ex-partner.

Coldstream stories

■ Stories from Coldstream’s past and present are being broadcast around the world, with a new YouTube channel launched to put the town on the map.

Coldstream Stories, a channel featuring videos of Coldstream residents young and old, was officially launched at the Coldstream Community Centre, on Friday, November 25.

The channel is an off-shoot of the Melba Group project, a part of the township group, Coldstream Voice, working to establish a pathway between the Melba Estate and Coldstream proper.

Extra paramedics

■ Yarra Ranges’s emergency services will be boosted, with the State Government approving an extra 14 paramedics for Lilydale.

The Government announced the expansion and new ambulance station as part of its $500 million investment in five years.

Leader previously reported emergency services in the Yarra Ranges would have a state-of-the-art $3.5 million ambulance station built in Lilydale (Leader, July 12).

■ A disability support service is furious with Nillumbik Council’s decision to renege on its Liveable Nillumbik project. The Diamond Valley Leader last week reported that the shire’s plan to build 40-50 dwellings on the old Hurstbridge High School site had been scrapped by the new council on November 22.

The land will be retained as open space. It was earmarked as a residential development for the elderly and families with an adult child who has a disability by the previous council, a project known as Liveable Nillumbik.

Glen passed away on November 29 from cancer. He and wife Lynnda started the magazine in May 2011.

Long Shots knew Glen as far back as the 1970s from his involvement in suburban newspapers such as The Melbourne Times, Richmond Times, Emerald Hill and Sandridge Times, and Metropolitan News.

The North By North-East team has just published their 50th issue, which included Glen's last piece, written two days prior to his passing.

Mr Jack Russell raises concerns over report ■ Yea resident Mr Jack Russell has mailed a ‘Concerns Notice’ to us about The Local Paper’s report (‘Russell admits he is not a ‘returned man’, Nov. 30).

Mr Russell alleges that he has been defamed by the publication of this report, particularly by the inclusion in the report of comments made in 2014 by Michael Annett, Chief Executive of the Victorian Branch of the RSL. He says an adjoining report, with comments quoted from a Leader Newspapers article from 2014 by journalist Kylie Adoranti, also defames him.

That report quotes La Trobe University psychological science associate professor Arthur Stukas, and clinicial psychologist Bill Johnson.

Mr Russell accuses The Local Paper of publishing the report, and the separate boxed report on the same page, with malicious intent.

Mr Russell’s formal ‘Concerns Notice’ arrived at the newspaper’s head office on December 7.

We address these concerns, in publication, at the first opportunity, in the first available issue following receipt of Mr Russell’s notice.

We have also sought to ameliorate Mr Russell’s concerns with an exchange of correspondence, and a personal visit to his home on Sunday (Dec. 11).

In his notice, Mr Russell called upon the previous week’s Local Paper to be removed and destroyed.

Mr Russell sought an unequivocal retraction, and apology, and/or monetary settlement. He foreshadowed that if these actions were not undertaken, he reseved the right to sue in the Supreme Court of Victoria for defamation, seeking damages of up to $250,000.

Mr Russell says he has been harmed by our publication.

The Local Paper FROM THE EDITOR been convicted of unlawful assault and (of) trespass.

Mr Russell has since made enquiries of the Court to discover that convictions were indeed recorded by Magistrate Stuthridge at Seymour Magistrates’ Court last month.

We accept, in good faith, Mr Russell’s statement that he was unaware of the convictions at the time he raised this concern with us.

Mr Russell says he is concerned that the quotes from the Leader newspaper, republished in The Local Paper, had the implication that he was equalto people charged by Police impersonating a returned soldier.

We made no such suggestion.

Mr Russell says he has held affiliate, nonserving RSL membership at a number of subbranches.

Mr Russell says that he was entitled to identify himself as a “returned man”, and he says he has a receipt to indicate his Yea RSL membership money was paid in advance this year.

Mr Russell has pointed to his family’s links as serving members.

Yea RSL Sub-Branch President, Jeffrey Swain, advises The Local Paper that Mr Russell is not a member of the sub-branch, and that the membership payment paid by Mr Russell was refunded by cheque.

Mr Russell denies that he has impersonated soldiers, has engaged in strategic self-preservation, sought personal profit at the expense of others, wanted social approval, had a lack or remorse, and that there was an implication of false association.

Mr Russell asks us to note that when he made

the comment that he was a “returned man” to the Court at the time when a Remembrance Day hearing was being considered, he was in an “emotional condition”.

He says he did so to have the matter relisted from November 11 to November 14, a period of three days.

“Note: Returned Soldier is not ‘Returned Man’,” Mr Russell said.

Mr Russell accused The Local Paper of acting in concert with the President of the Yea and Kinglake RSL Sub-Branch.

The only contact between The Local Paper and Mr Swain, prior to Mr Russell’s ‘Concerns Notice’, has been to enquire about the correct spelling of an RSL scholarship winner’s name.

Mr Russell said there had been no attempt by any authority to contact him.

Mr Russell says that his comments, provided to The Local Paper, should not have been published unless in full.

Mr Russell said he sought ‘right of reply’ without media comment.

We say that our report has not defamed Mr Russell. We have certainly not been malicious at any time or in any way.

We say that the substance of our report (‘Russell admits he is not a ‘returned man’) carried Mr Russell’s own words, including his apology to the public.

We say that by supplying these written words for publication, we had the authority of Mr Russell to do so.

We did not change the wording supplied by Mr Russell. Reasons of space demanded that some of Mr Russell’s other comments were not included. An Editor is obliged to edit.

$698.5M PAYOUT FOR BUSHFIRE VICTIMS ■ Justices Forrest and Dixon of the Supreme Court of Victoria last week made rulings approving administration costs in the Black Saturday bushfire class actions, clearing the way for lawyers Maurice Blackburn to distribute nearly $700 million in compensation, The alwyers say that personal injury claimants can expect to be paid by the end of this year, and people who suffered economic loss and property damage should be paid in early 2017.

Maurice Blackburn Principal Brooke Dellavedova said "It’s been a long, hard fight in Court followed by a long, hard administration process to get to this point.

“The length and complexity of the process has been trying for survivors already traumatised by the Black Saturday bushfires.

“We’re pleased the process is drawing to a close and heartened by the Court’s endorsement of the settlement administration.

“The money won’t change what has happened, but we’re looking forward to distributing much needed compensation to those affected".

Justice Forrest has described the process as “an unprecedented settlement administration in tort class action”.

During a hearing this month, his Justice Forrest said: “I think we can say on behalf of the Court we are satisfied that the appropriate steps have been taken in both cases to endeavour to distribute the money and the funds to people who need it, as quickly and as efficient as possible.

“We congratulate the administrator and his team on that.”

Justice Forrest said: “This demonstrates that the class action process works ... it shows that when it is properly managed, many substantially disadvantaged and affected people can recover compensation that they would otherwise not have been able to ob-

We advised Mr Russell on Monday afternoon as a courtesy that we would be publishing this article. We sent him a preview of this page. He requested changes, all of which we made. In earlier correspondence, he had invited us to express our “right of reply”.

Local Snippets Witnesses wanted

■ Tallarook Police are appealing for witnesses following a collision between a car and a truck in Hilldene on Friday.

Police have been told a blue Hyundai 4WD was travelling north on the Hume Hwy about 12.15pm when it collided with the rear of a semi-trailer travelling in the same direction.

The car lost control and rolled into an embankment on the left hand side of the highway, trapping the driver inside.

The driver and sole occupant, a 43-yearold Wodonga woman, was freed from the car by emergency services and taken to hospital with non-life threatening injuries.

The driver of the truck, a 60-year-old man from Queanbeyan, NSW, was uninjured and stopped at the scene to rendered assistance.

Investigators urge anyone who witnessed the collision and has not already spoken to police to contact Crime Stoppers on 1800 33 000.

Consultation OK

● Justice Jack Forrest At the hearing last week, the Court and group members had their first opportunity to hear from the independent cost assessor appointed by the Court to review costs incurred in administering the settlement scheme.

John White endorsed the appropriateness, efficiency and accuracy of the complex distribution process, giving evidence that: “My view, having examined a great deal of material, is that the Scheme was thoughtfully considered in the first place, implemented properly and accurately and efficiently; that as problems arose, they were expeditiously dealt with and there are not problems that I can see generally that would have been foreseen,” Mr White said.

■ John Hamill, Chief Executive Officer of the Essential Services Commission, has told a Parliamentary Inquiry that his organisation believed Murrindindi Shire Council had “sufficient relevant consultation” with the public on its infrastucture renewal needs, when considering its rate rise campaign.

“It did not consult on the issue of service levels,” Mr Hamill told the Inquiry.

“An outline of the Council’s consultation that occurred is set out in the Commission’s decision.”

Sports Briefs Yea U12 Cricket

■ Friday night saw the Tigers playing Alexandra at the Yea High School oval due to some ground improvements to the Rec. Alexandra batted first and their opening partnership got their innings off to a strong start with lots of boundaries putting the Tigers on the back foot.

The narrow pitch put some of the Yea bowlers off resulting in a number of wides for the night, but all in all Yea fought back and kept the rest of their batsmen to single figures.

Fielding was good and as everyone wants a crack at wicket keeping this week saw Angus Antrobus pull on the gloves and he did a good job and remembered everything we told him on Wednesday night.

Alexandra ended their innings on 166 after 24 overs Yea's innings saw the batting order change again just so the first year boys are batting with some older kids to show them some tips like when to run and fallout nice and loud.

Again all Yea’sbatsmen contributed to the score and defended their wicket strongly. With a couple of our big hitters away this week Yea lacked a bit of firepower but Riz still showed Alex that Yea were going to fight it out till the end with some nice 4s and a big 6.

Yea ended up falling short with a respectable 108, good game Tigers.

This weekend has Yea travelling to Kilmore for our last game this side of Christmas.

CEACA offers courses ■ CEACA , the ‘Continuing Education and Arts Centre of Alexandra’, is offering a number of courses in 2017.

A CEACAspokeswoman says the largest projected employment growth industry is the Health Care and Social Assistance sector, according to the Department of Employment.

“The aging Australian population and the introduction of the NDIS will see the increased need for aged and disabilities carer to be in high demand, as will support in educational settings.”

Studying or training at CEACAin Alexandra, the only local Registered Training Organisation, is suggested.

“On offer are new and exciting opportunities, come in and chat with staff about exploring the possibilities of a new career or courses to obtain employment within the local area.

“We have access through our partnership with Wodonga TAFE to offer a large variety

of courses, as well as our own, that can be delivered right here in Murrindindi Shire.

■ Saturday saw Yea host Alexandra at the Yea Recreation Reserve in the first week of their round 7 A-Grade two-day match.

Yea captain Cam Armstrong won the toss and elected to bat first. James Clavarino and Dan O'Dwyer opened the batting and did a fine job seeing the Tigers safely to drinks without the loss of a wicket.

Three quick wickets saw Yea's innings wobble somewhat, however Armstrong and Ryan Akers came to the crease and set about steadying the ship, before accelerating to see Yea to 3/108 at afternoon tea.

The loss of Armstrong (47) and Akers (20) initiated another collapse for Yea before some late order hitting from Brad Clements dragged the total to 162 all out. This left Alexandra with an uncomfortable 35 minutes to bat before the close of play.

Clements struck in the third over with a terrific Yorker to bowl one of the Alex openers. Andrew Chisholm trapped another Alexandra batsmen LBW the following over and Clements had another caught down the leg side to leave Alex reeling at 3/10 at the close of play and Yea well on top. Next Saturday will see the second day’s play as Yea attempt to return to the winners’ list and consolidate a place in the top four.

■ The first round of the annual Foodworks Murrindindi Masters was played in ideal conditions on Saturday.

The course was in excellent shape and consequently some good scores were recorded.

Some 18 Yea players travelled to Marysville for the event and all enjoyed the day. Di Elliot was the only Yea player to finish in the winner's circle however. Di's 31 points won her second place in the ladies BGrade section. The mini masters winner for the ladies was Helen Findlay of Alexandra with a fine 39 points. Terry Chaplin and Rick Wills both had good rounds of 36 points but neither was a trophy winner in their section.

The star of the day was junior player Dean Malley of Eildon. Dean won the mens Masters last year and started of this year's event in style with 42 points from his handicap of 11. The next round of the event is at Eildon on January 14.

■ The Council spokeswoman said: Some key points of interest from Council's Code Red Day Policy include: ■ Travel and Meetings: Any Council meetings and scheduled meetings of delegated committees will be cancelled. All non-essential travel by Council Staff will also be cancelled, as will any outdoor works and nonessential property inspections.

■ Council Offices: As far as practicable, customer and library services will be offered during normal opening hours at the Alexandra, Kinglake and Yea offices on Code Red days.

The Mobile Library will not operate on Code Red days due to the requirement to restrict non-essential travel.

■ Local Laws: Officers will continue to respond to emergency callouts but will postpone all travel related to non-essential services provided by Council.

■ Resource Recovery Centres (RRCs):All RRCs and Alexandra Landfill will be closed.

■ Kerbside Waste Collection:Waste collections will take place where practicable, but may commence earlier than usual on days declared 'Code Red'.

■ Community Services: Family Day Care and In Home Child Care services will operate in accordance with Department of Education and Training Victoria directives to local primary and secondary education facilities. Child care will continue to be offered, subject to educator availability, in Eildon, Alexandra and Yea. Services based in areas where local schools are directed to close on Code Red Days will not operate.

Maternal and Child Health Services in Yea and Alexandra will operate as normal (subject to staff availability). Services will not operate in Eildon, Toolangi, Marysville, Kinglake and Flowerdale due to elevated risk associated with travelling.

Council's Aged and Disability Services will be restricted to essential services. Where possible, contact will be made with vulnerable clients informing them of service restrictions.

■ Pools, Parks and Recreation Reserves: Alexandra and Yea swimming pools will be the only pools to operate on Code Red Days, subject to qualified staff being available.

Council-managed outdoor recreation reserves, parks and the Great Victorian Rail Trail will in the main remain open for use but people should remain alert to the conditions.

“In the event of a Code Red Day being declared, Council will update information regarding any changes to service on its website at www.murrindindi.vic.gov.au. Code Red days are generally confirmed by CFA the evening before and may be predicted up to four days in advance.

"This policy is about protecting our staff and the community. We do not want to see people put at risk during the State's highest fire danger rating day. We also want to ensure that fires do not accidently start due to our outdoor operations", said Ms Abbey.

“In an emergency, the role of Murrindindi Shire Council is to provide support to key response agencies such as the CFA and Victoria Police and to coordinate relief and recovery efforts within Murrindindi Shire.

"Council's Code Red Policy ensures sufficient staff resources can be re-deployed to emergency response planning functions and, in the event of a fire, provide support to fire fighting agencies and emergency relief centres", said Ms Abbey.

“Council's Code Red Policy is available on its website at www.murrindindi.vic.gov.au by searching 'Code Red Day Policy' or at Council offices in Alexandra, Yea and Kinglake.”
