■ A Bendigo region man who viewed high-level pornography on his computer has received a greater jail sentence after an appeal by the Director of Public Prosecutions to the Court of Appeal. Stephen James Guest now has an 18month jail term, rather than a 3½-year community corrections order, after the case was r5e-heard by Supreme Court Judges Weiberg, Whelen and Coghlan. He will be eligible for parole after six months. His sentence was back-dated to November last year. Guest pleaded guilty late last year in the County Court to using a ‘carriage service’ to access child pornography. Guest was detected when the Australian Federal Police identified that an IP address assigned to an Australian Internet Service Provider (ISP) was used to download child pornography material. The user of the computer connected to the ‘eDonkey’ network and downloaded 286 images. The network allows group users to connect with each other, and directly access files from each other’s hard drives. The IP address was assigned to a Telstra account in the name of Guest. The Australian Federal Police’s Child Protection Unit attended his residential address, and the man’s wife informed them that he was at work in Bendigo. There, they found him at his workstation with an HP laptop computer, connected to a Toshiba external hard drive, with a chat session active between users. Guest told Police that he started looking at child pornography in the 1980s. He had been using Yahoo Chat to access and view child pornography on a weekly basis. He said his interest in the child pornography arose “probably out of curiosity”, and his sexual interest in the material varied from a “zero to a seven”. His interest was in female teenagers aged 13 and older, but he did get images of younger children through his searches. Guest has been attending weekly treatment with a psychologist.
