ABOUT THE PHOENIX There is no better symbol for the spirit of the people of this region that the Phoenix. The phoenix is a mythical sacred firebird with a tail of beautiful gold and red plumage (or purple and blue). It has a 500 to 1,000 year life-cycle, near the end of which it builds itself a nest of myrrh twigs that it then ignites; both nest and bird burn fiercely and are reduced to ashes. From those ashes, a new, young phoenix or phoenix egg arises, reborn anew to live again. The new phoenix is destined to live as long as its old self. The bird was also said to regenerate when hurt or wounded by a foe, thus being almost immortal and invincible — it is also said that it can heal a person with a tear from its eyes and make them temporarily immune to death. The phoenix is a symbol of fire and divinity

The Phoenix first hit the streets on Saturday, March 7 - exactly one month after the Black Saturday fires. We now publish weekly, and distributed free over a wide area. Our aim is to help survivors with rebuilding their lives, their homes, their businesses and their communities. We are certainly not in competition with existing services or established local newspapers.

● The late David Evans ■ It is really pleasing that the late David Evans has been honoured with a picnic table at Yea’s Rotary Park, formally dedicated this month. David was a charter member, Past President and Paul Harris Fellow of the Rotary Club of Yea. Together we were members when the busy service club met variously from 1986 at the St Luke’s Parish Hall, Beaufort Manor, the Grand Central, the Royal Mail and Country Club hotels. Yea’s charter members of Rotary were doctor Philip Basser, teacher Ian Bell, car dealer Neil Beer, stock agent Ross Bryant, policeman Graeme Broadbent, engineer Daryl Callander, plumber Graeme Clements, farm manager Tim Dale, hotelier Clarry Davison, David Evans, accountant Gary Fitzgerald, farmers Les Hall and Peter Hauser, piano tuner David Lawson, cattle breeder Don Lawson, sheep breeder Bob Lockhart, yours truly Ash Long, stud cattle man Ric Long, farmer John McCormack, machinery dealer Bernie Quinlan, horse breeder Adrian Sier, butcher John Tainton and restaurateur Ray Watson. Stay warm ■ Thousands of bushfire survivors will receive a one-off $2000 cash payment from the Victorian Bushfire Appeal Fund as part of a $9 million new winter needs grant to support communities through the colder months. The new $2000 Winter Needs Grant will be automatically paid to individuals who have received payments for destroyed or damaged homes.

‘INSURED PAY FOR THOSE WHO DON’T’ ■ People who insure their home against fire pay for those who do not, says National Party State Leader Peter Ryan. “The Fire Services Levy, which is essentially a tax on insurance premiums to fund fire services including the Country ● Peter Ryan Fire Authority, means that people who insure their home against fire pay for those who do not,” Mr Ryan said. “The Victorian Liberal-Nationals Coalition, in government, will review the existing Fire Services Levy and implement a fairer system that provides adequate funding for state fire services. “The levy is a strong disincentive to insure against fire, with evidence from the recent bushfires suggesting that approximately 30 per cent of the houses lost were not insured. “There are other fairer models that fund fire services in other states which more evenly distribute the cost of funding fire services,” said Mr Ryan, who has made a submission to the bushfires Royal Commission.

WINDSTORM REPORT KEPT SECRET: LIBS
■ A report with recommendations on how emergency services could better handle communications was deliberately withheld from the Bureau of Meteorology, says the Victorian Shadow Minister for Energy and Resources, Robert Clark. The report was conducted after the windstorm that hit Victoria in April last year. “The Brumby Government must explain why it failed to provide a copy of the Review of the April 08 Windstorm to the Bureau of Meteorology, even though a key recommendation of the review required action by the Bureau,” Mr Clark said. “The Victorian Bushfires Royal Commission heard evidence from the Regional Director of the Victorian Regional Office of the Bureau of Meteorology, Dr Mark Williams, that the Bureau did not receive a copy of the re-

website when it was finally made public in April – two months after Black Saturday.” “This is despite the fact the Esplin review found several key organisations did not receive the BoM’s weather warnings during the April 2008 windstorms, and recommended that ‘the Bureau of Meteorology must ensure the detail for these critical contacts remains up to date.’ “The BoM managed to take some action to update their contact list because an emergency services officer spoke to BoM about what was likely to be recommended. “It is no surprise that the Brumby Government attempted to hide this report from Victorians because of its damning findings, including the fact that the government was warned the 000 network would fail during a significant emergency,” Mr Clark told The Phoenix Newspaper.

■ After a week's break because of the InterLeague match, Kinglake Football Club is regrouping ahead of a huge month for the Club. Coach Mick Nott says matches against Belgrave, Yarra Glenn and Thornton Eildon can help set-up Kinglake for the second half of the season. Attending this meeting will be representatives from Slidders Lawyers and Maurice Blackburn Lawyers, Tim Tobin QC and loss assessors. A similar meeting is also being held this week at Yarra Glen.
Special grants ■ A fact sheet is available online for further assistance for businesses and primary producers directly impacted by the 2009 bushfires. The one-off grant of $5000 is available for those who have otherwise missed out on a business recovery grant on the basis of the requirement to earn 51 per cent of their income from that business. ‘Easier to rebuild’ ■ Changes have been made to the Murrindindi Planning Scheme making it easier for people to rebuild their homes and farms destroyed by the recent 'Black Saturday' bushfires. The changes allow for a variety of buildings including houses, agricultural buildings and dependant person units, to be replaced without needing to comply with the normal requirements of the planning scheme, except for properties in the Heritage Overlay. It means that in most cases, people will be able to rebuild on the same property with less red tape. A planning permit will not be required and a new streamlined process will be put in place to approve siting plans. Memories of Max Emmins ■ We have received a letter from Max and Margaret Emmins, parents of Max Emmins, following our report of the Royal Commission transcript of evidence given by Strathewen resident Denis Spooner: “In your May 18 edition of The Phoenix, in an article headed ‘Fire Roared Like 10 Jets’, there was a mention of "old Max Emmons (sic)". “I would like to point out that Max (Emmins) had recently turned 45. He moved to Strathewen about 10 years ago with his wife Lisa and their two children Maggie (now nearly 13) and Alex (now 11). “For the first nine years Max was a house dad and spent his time running kids to and from school, installing computers at the school and working with the Strathewen Hall Committee, helping neighbours, and working on his guitar and computer skills. “These skills resulted in him running many trivia nights and doing all the sound work for the Primary School concerts over many years. “He worked for the last year as an AudioVisual Technician at Genazzano Catholic Girls School in Kew. They thought so much of him in the short time he was there, that Genazzano conducted a beautiful memorial service and mass for him. “He will be missed by all who knew him, and always loved by his family. - His parents, Max and Margaret Emmins

Anger with ambulance
● Les Ridd ■ “Molesworth man les Ridd has hit out angrily that a friend of his died, and that chances of survival may have been greater if ambulance drivers were always available,” we reported 25 years ago. In a letter to our newspaper, Mr Ridd said he was “stunned to learn that a driver was not available” after a neighbour had suffered what semmed to be a heart attack. We reported: “He says he was told that the patient should be transported to Yea Hospital in a utility, because there was no ambulance. “We lifted the patient into the back seat of a sedan, and after noifying the Hospital that a heart patient was on his way ... (we) drove to the hospital in convoy with the doctor. “On the 10-minute journey, despite foorts of the patient’s daughter-in-law to keep him conscious, the patient succumbed. “I do not know for sure however whether this patient may have lived if he had been in an ambulance with a doctor at his side,” Mr Ridd said. “But I am sure that his chances of survival would have been greater.”

EXPERT PREDICTED FIRES
■ Dr Kevin Tolhurst, an expert witness called to the Royal Commission, had mapped out the probable path of the February 7 fires, some time in advance of them hitting Kinglake and Marysville. Last week’s hearings heard that Dr Tolhurst’s early training in the 1970s had included hands-on firefighting and experience in the Alexandra-Taggerty area. In 1996, Dr Tolhurst received a Doctorate of Philosophy from the University of Melbourne. “The topic of my thesis was looking at the effect of - basically the ecology and management of bracken, bracken fern (Pteridium esculentum), but what I was really looking at, I suppose, was how fire and other management activities affected the bracken; so I was just using bracken, I guess, as a bit of an indicator of how fire, timber harvesting and other management affected the dynamics within foothill forests,” he told Wednesday’s hearing. Questioned by Jack Rush, Counsel assisting the Commission, Dr Tolhurst said he had been increasingly involved in prediction work with Victorian bushfires: So as a result of that early work we basically developed a new system of assessing fuels and, I guess, by default to some extent, in characterising the fires, to help understand how the ecology was changing with different - the nature of the fire, I have built up some expertise, I guess, in fire behaviour, it was important to characterise a fire. “So since the mid-80s I guess I have been involved in providing specialist advice at wildfires on fire behaviour and fire suppression strategies.” Dr Tolhurst said he had been involved in ‘reconstructing’ the February 7 fires for purposes of review. “The four elements are the weather, the topography, the fuel and the fire itself and each of those four elements affect each other and that is an important thing to appreciate, I guess. “Weather is related to both the climatic conditions, so the preceding conditions, if you like, as well as the much more dynamic weather that occurs on the day. “The topography relates to things like elevation as well as slope and aspect and the weather will vary with the topography. “The fuel relates to both the fine fuel which is important in driving the fire forward, but it also refers to the coarser fuel which can add considerably to the amount of heat that is coming out of that fire; and then there is the fire itself, so the scale of the fire, how it interacts with the atmosphere and how the spotting processes go on; the fire will actually help reinforce or provide a positive feedback to its own behaviour. “So all of those four elements are really important to consider how each one is contributing and how they are interacting with each other when you are describing fire behaviour.” Dr Holhurst went through various stages of Black Saturday, providing data to the Commissioners, using a range of technology. He was asked specifically about the fire that claimed so many lives in the Bald Spur Rd are of Kinglake. “I have done some modelling. I don't know whether it is appropriate to actually show it now, but the way I would see - what's probably happened on Bald Spur Road, for example, is it's been hit while the fire's still been going forward and it's basically been a forward movement of the tongue effectively of the front. “At some stage I might be able to demonstrate that in the modelling and show you exactly where Bald Spur Road is so you can actually see that, it may help your understanding of that.” Answering a question from Commissioner Pascoe, Dr Tolhurst said the temperature of the fires may have reached as high as 1500 deg. Asked about the speed of the fires, Dr Tolhurst said: “I guess the maximum rate of spread that I've estimated was basically as the fire was burning from the Kilmore area over the Mount Disappointment range, heading towards Humevale and so on, Strathewen, and I estimated its average spread rate over an hour of being - it travelled 12 kilometres in an hour;

● Jack Rush so 12 kilometres an hour as its maximum spread rate for an hour period, which is about - is the same as basically what was estimated for the spread rate of the fires in some of the mountain forests on Ash Wednesday around Melbourne. “So the spread rate from that sense is not exceptional, although a fire in forest spreading at 1 or 2 km/h is still a fast fire, so 12 kilometres is pretty fast. The average over a longer period of time was probably closer to about 8 km/h. “So it is not so much the spread rate that was exceptional, it was certainly at the top end, but it was, I think, the mechanism of spread that was most exceptional about the fires this year.” Mr Rush asked about calculations about the energy of the fires, and how it impacted on firefighters. Dr Holhurst: “There's no way you would be able to stop the fire is part of what it is telling us ... (you would) have to be in an area where the fire was much less intense than that if you were going to have any chance of defendingyourself.”
