The 11-mile Parade is escorted by the Austin Police Department and stages at 7:00 p.m. on the Rally grounds and leaves promptly at 7:45 p.m. The Parade ends at the capitol building on Congress Avenue where thousands of spectators await your arrival for the ROT Congress Party — then stick around for the biggest party you’ve ever seen — with cold drinks, food and live music by 20 Shades, Omar & The Howlers and The Jimi Berg Band!

Arrive early to the Congress Avenue party to star watch and show your support to the Rally sponsors who help make the Rally happen! A Gregory-Portland, Texas native, Steve now resides in Los Angeles, California. Steve has been on the road headlining Improv Comedy Clubs, Funny Bones and Punchlines across the country. His resume includes writing for and appearing on the Mind of Mencia show on Comedy Central and appearing on The Late Show with Craig Ferguson, Comics Unleashed and Comedy TV. One of Steve’s biggest live appearances to date was on “The Doghouse Comedy Jam” in San Francisco with names like Dave Attell, Jamie Foxx and Dave Chappelle. His first hour-long comedy special was recently filmed and was unleashed spring of 2012. He’ll be cracking up the Rally all weekend long. See schedule for more details.

ROT knows that bikers love to ride, and for the past 4 years the ROT Rally has put together some of the most memorable and meaningful rides for motorcycle enthusiasts. From shutting down IH-35 for over 30 miles through Austin for our police-escorted pack — to hosting celebrity Dee Snider to champion our March of Dimes benefit ride — we are committed to bringing our rally-goers the best. Held Friday, June 8, “The ROT Annual Memorial Ride” honors lost loved ones who have served and protected in the many service organizations of this great country — including military, law enforcement, emergency and others — as well as those who are heroes to you — biker friends, family and ROT devotees alike.

Thursday lineup Kenny Wayne Shepherd 8:00 p.m. – Main Stage

Still barely in his 30s, the Louisiana born axeman and songsmith has been selling millions of albums, throwing singles into the Top 10, shining a light on the rich blues of the past and forging ahead with his own modern twist on a classic sound he has embodied since his teens. He met Stevie Ray Vaughan at 7, shared the stage with New Orleans legend Bryan Lee at 13. As an adult, he continues to create genre-defining blues-infused rock n’ roll.

Gov’t Mule 9:45 p.m. – Main Stage

With 2 million paid song downloads through their site MuleTracks, seven critically acclaimed studio records already released, a handful of DVDs and live albums, plus an ever-expanding fanbase and soldout coast-to-coast tours, Gov’t Mule could easily rest on its laurels. Yet when you’re in one of the hardest working bands in rock history, pushing yourself to greater heights always supersedes cashing in on past successes.

Frontman Michael Hobby (23) and lead guitarist Bill Satcher (22), the co-founders and creative conspirators of A Thousand Horses, have been crafting rock music infused with traditional American flavors of the southeastern US for over half a decade. A Thousand Horses blends blues, R and B, and good old slashing guitars, bass & drums in an elixir that comes out tasting of Small Faces and “Exile”-era Rolling Stones.

shooter jennings 9:45 p.m. – Main Stage

The only son of country legends Waylon Jennings and Jessi Colter, Shooter Jennings spent his childhood on a tour bus. Shooter was playing drums by the time he was five years old and had already begun taking piano lessons. He discovered guitar at 14 and rock & roll at 16. He moved from Nashville to L.A., where he assembled a rock band called Stargunn. Stargunn earned a reputation for its strong live shows before Jennings rediscovered his outlaw country roots and dissolved the band. After a short stay in New York he returned to L.A. and put together a second band — this time with solid country roots — which he named the .357s. Jennings and the band holed up in the studio, emerging with a rambunctious country album called Put the O Back in Country. Following in his father’s footsteps, but with his own feisty, scrappy sense of country, Jennings placed himself in a fine position to both explore that legacy and to carve out his own.

The band members grew up together amongst the dead-ends and cactus needles of Tucson, Arizona and have known each other since grade school. They graduated from the same high school together (immortalized in their song “Santa Rita High”). They chose to play in a band together because they simply liked hanging out — not because they considered themselves great musicians. “In this era of pre-fabricated, put-together-to-have-a-hit bands, we consider ourselves a kind of ‘aberration’ — and this makes us smile a little every day.”

2012 Texas Motorcycle Laws By Robert Filla For all our out-of-state guests, the Republic of Texas Biker Rally wishes to send a hearty welcome and wish you safe riding while enjoying our great state. And for any riders unfamiliar with Texas motorcycle laws, here’s a quick rundown of current regulations. Helmets: A DOT approved helmet is required for all motorcyclists. An exception to this stipulation exempts anyone 21 years and older from wearing a helmet if they have successfully completed a motorcycle operator training and safety course or they are covered by a health insurance plan. Proof of either is mandated by law but rarely requested by an officer. In addition, SB 1967 was signed into law in 2009 and reads, “A peace officer may not stop or detain a person who is the operator of or a passenger on a motorcycle for the sole purpose of determining whether the person has successfully completed the motorcycle operator training and safety course or is covered by a health insurance plan.” Licensing: A Class M motorcycle endorsement on your driver’s license is mandatory along with valid insurance and a current vehicle inspection sticker. A copy of your registration may go a long ways in avoiding prolonged roadside stops. Equipment: By state law, an operator cannot carry a passenger unless the bike is designed to carry more than one person, which means having both a passenger seat and passenger foot pegs. (Another new law that also went into effect in 2009 carries an age restriction, stating that no child under the age of five years old can ride on a motorcycle unless that child is seated in a sidecar. But that shouldn’t be a problem for Rally attendees since the Republic of Texas carries its own age restriction—18 and older only.) Texas designates that a bike may not be operated at any time unless at least one headlight is illuminated (except for bikes manufactured before 1975). Of course the bike must have both an operating taillight and brake light along with a horn. Side-mounted or vertical side-mounted license plates are generally not a cause for alarm while at least one mirror is mandatory. Texas law states “A motor vehicle shall be equipped with a muffler in good working condition that continually operates to prevent excessive or unusual noise”. But if you suppress any outbursts of “throttle fever,” drag pipes will rarely get you pulled over. Behavior: Safety and common sense is most imperative during the ROT Rally and burnouts, wheelies and other “stunts” will not be tolerated on any Austin city street. The Austin PD can be most friendly (especially during ROT). Let’s do our best to keep ‘em that way.


What’s 11 miles long, has more than one thousands wheels and is world famous? That would be the annual Republic of Texas Motorcycle Parade being held on Friday, June 8, 2012. It’s one of the most well attended bike parades in the world with thousands of riders making the event a priority during their ROT experience. For those who may have never joined in this unique affair, here are a few pointers. Staging for the parade begins at 6:30 p.m. Friday evening inside Gate #3 (refer to the Expo Center Map located in this guide). This year the Parade will depart at 7:45. Your time of arrival during staging will determine your placement in the procession. Many riders begin staging earlier than the scheduled time to secure a position at the front of the pack. The Parade departs the Travis County Expo Center and, using surface streets, eventually intersects I-35 South for a ride to downtown Austin where live music and vendors await. With thousands participating, the Parade has many stops and starts along the way and can easily take more than an hour to cover the 11-mile route. And with this many bikes creeping along in stop-and-go traffic, heat will be a factor with those riding further back in the motorcade suffering the greatest. There will be pre-Parade festivities at the staging area with the Bud girls handing out water. The parade will be hot and staying well hydrated increases your reaction time while riding and expands your safety margin. And please be aware that during the 2012 ROT, Austin will be enforcing their “No Refusal Weekend” policy. (Under this provision if you get pulled over for possible DUI and you refuse a breath test, you will be forced to take a blood test to determine your blood alcohol level.) The best advice is to discontinue all alcohol consumption early in the day well before the Parade departure time. Although a helmet is not required for anyone over 21 that meets the State’s criteria for exemption (see Texas Motorcycle Laws elsewhere in this guide), if you are packing a young thang below that age, they best have DOT approved head gear in place. And although a full-face helmet provides the ultimate in protection, a half-helmet might be a better selection due to its superior ventilating properties. Make certain your partner is enough of a riding veteran that they don’t become a safety problem. A rookie passenger can be just as dangerous as a novice rider. Eye protection is not mandatory but it is highly advisable. Sunset in Austin on June 10th is at 8:32 p.m. And while that should allow sufficient light during the Parade for the use of dark riding shades, take along a pair of clears for your ride home after the 6th Street party. And while leather chaps are always fashionable, they will dramatically trap the heat raising body core temperatures. Leather jackets, if worn, should have all available vents fully open. Check your bike out before staging to be certain all your equipment is operating properly. A responsive brake system is vital during such an exercise but no more important than a functional brake light. Tires should be properly inflated and turn indicators will give those riding near you valuable information of your intentions beforehand—so use them. Just as indispensable, your mirrors are more than an attractive chrome accessory. Check them constantly to stay alert of the traffic around and behind you. Riding in such a stop-and-go situation will cause additional heat buildup in your engine. To help alleviate a dragging clutch due to excessive heat, slip the transmission into neutral when coming to a stop. So make certain you have plenty of petrol on board for an 11-mile, one-hour ride, tank up your body with a sufficient amount of water, and Parade safe. See ya on 6th Street.

HELMET LAW TICKET DEFENSE

WE RIDE…WE CARE WE WIN! The following has been developed to aid in your defense when you have been stopped and ticketed for wearing an “unapproved” helmet. Read the following to the Judge as your defense and ask that the charges be dismissed. “YOUR HONOR, I was wearing a motorcycle helmet acquired in a good faith attempt to comply with the State’s Mandatory Helmet Law. The helmet, at the time I acquired it, had a “DOT” sticker on the back. Thus, I was improperly ticketed and the case should be dismissed.” THERE ARE TWO ISSUES IN THIS CASE THAT THE STATE MUST PROVE BEYOND A REASONABLE DOUBT: (1) The helmet I was wearing failed to comply with Federal Law. (2) I knew my helmet did not comply with Federal Law. The State Mandatory Helmet Law has incorporated Federal Standards set forth in the National Traffic and Motor Vehicle Safety Act of 1966 and in the Federal Motor Vehicle Safety Standard (“FMVSS”) No 218. Section 1392 (d) of the Safety Act states that once a Federal standard is adopted, that federal standard has supremacy... the state may enforce no standards which are not identical to the federal standards. The “DOT” sticker, on the back of the helmet raises the presumption that the helmet meets federal standards. The federal law places a burden on the manufacturer and the seller of certification and compliance with the standards set forth by federal law, FMVSS 218, and not on the user. National Traffic and Motor Vehicle Safety Act of 1966, Section 1397(a)(1)(A): (1) No person shall (A) Manufacture for sale, sell, offer for sale, or introduce or deliver for introduction in inter-state commerce, or import into the United States any motor vehicle or item of motor vehicle equipment manufactured on or after the date any applicable federal motor vehicle safety standard takes effect under the subchapter, unless it is in conformity with such standard. Under section 1403, the evidence of certification with regards to helmets is a “DOT” sticker in the back of the helmet. FMVSS 218 sec. 5, 6, and 1(e)Federal law only requires the exercise of due care by the user at the time of acquisition. National Safety Act


45 of 1966, Section 1397 (b) (2) Para-graph (1) (A) subsection (a) of this section shall not apply to any person who establishes that he did not have reason to know in the exercise of due care that such vehicle or item of motor vehicle equipment is not in conformity with applicable federal motor vehicle safety standards, or to any person who, prior to such first purchase, holds a certificate issued by the manufacturer or importer of such motor vehicle or motor vehicle equipment, to the effect that such vehicle or equipment conforms to all applicable federal motor vehicle safety standards, unless such person knows that such vehicle equipment does not so conform. Therefore, federal law only requires good faith compliance and the exercise of due care at the time of acquisition of the helmet. The “DOT” sticker raises the presumption of good faith compliance. Federal law prohibits the Department of Transportation from establishing a list of approved helmets. There is no currently published list of approved helmets known to be available to the general public. The absence of, at the time of the issuing citation, a sticker on the back of the helmet is not evidence of lack of compliance because federal law does not require that the sticker remain on the helmet. (See NTMVS ACT of 1996 and FMVSS 218). The State must prove beyond a reasonable doubt that my helmet does not meet FMVSS 218 and that I was aware of this fact. Proof that my helmet does not meet federal standards requires expert opinion and actual testing of this helmet. A traffic officer lacks the personal knowledge of actual testing and lacks special knowledge, skill, experience, training and/or education regarding FMVSS 218 and testing procedures . Expert opinion is not proper testimony unless my helmet was actually tested. To my knowledge there is no case law in this State to support the use of expert opinion without actual testing when a technical test is required by law to prove compliance with a standard. If the State proves the helmet did not comply with federal standards, they still must show I knew the helmet was not in compliance at the time I got it. At the time I acquired the helmet, it possessed a “DOT”s ticker on the back and, therefore, I acted in good faith and the State cannot prove otherwise. Therefore, I respectfully request that this case be dismissed. WARNING: BEFORE READING THESE ARGUMENTS TO THE COURT, BE SURE TO PLEAD “NOT GUILTY.” This defense will only work if you acquired the helmet with the “DOT” sticker on the back or a label on the inside which indicated that the helmet complied with the “DOT” standards.” If the helmet had a label on the inside, everywhere in the argument that it says “sticker on the back”, insert the words “label on the inside.” MOTORCYCLE ACCIDENT OR ROADSIDE EMERGENCY — CALL 1-800-4-BIKERS 24 HOURS TOLL-FREE NATIONWIDE — 1-800-424-5377

In addition, the ROT and Sheriff’s Department have developed an emergency evacuation plan and designated shelters on the grounds for catastrophic weather events or other similar emergencies.
