The new regulations, which took effect on April 18, stipulate that employers cannot refuse to grant paid vacation and certain other types of leave once specific conditions are met, or they risk a fine of NT$60,000 to NT$300,000 and revocation of their permits to hire migrant workers, the ministry said. According to the new regulations, migrant workers have the right to paid marriage leave, bereavement leave and personal leave in accordance with the Labor Standard Law, the Act of Gender Equality in Employment and regulations governing labor contracts, the ministry said. In the event that the employers have an urgent work situation, such as a large number of orders to fill, or cannot find a temporary replacement, they can negotiate with employees on a mutually acceptable leave period, it said. If an agreement cannot be reached, the worker has the right to obtain leave for the required period, in accordance with the Employment Service Act, the ministry said. The implementation of the new regulations took effect after an amendment to the Employment Service Act last year, which removed a requirement for migrant workers on the maximum three-year contract to leave Taiwan for at least one day if they wanted to return to be rehired.

“Your flight is delayed.” This announcement from the airport’s PA system can be one of the most frustrating things a passenger faces when traveling. But what are passengers entitled to when their flight doesn’t leave on time? According to the joint DOTC-DTI Air Passenger Bill of Rights, passengers are entitled to basic rights upon purchase of ticket and upon arrival at the airport. If a flight is delayed at least three hours after the estimated time of departure, whether or not the cause is attributable to the carrier, passengers are entitled to refreshments or meals, free phone calls, text or e-mails, and first aid. Passengers also have the right to rebook or refund the ticket, and to be endorsed to another carrier.

For more than a decade, when you needed assistance or information from Taipei, you would always remember Antonio Basilio. Tony was synonymous with MECO (Manila Economic Cultural Office) in Taipei. In a sense he was always present and omniscient as far as the visiting delegations and VIPs from Manila were concerned. Tony has served our country with distinction throughout his postings in London, Geneva, Beijing, Jeddah and Washington DC. His career with MECO alone spans a period of 15 years and it would be fair to say that there are few people in the Philippines who know and understand Taiwan as well as he does. During his tenure, as MECO resident representative, people to people exchanges and the scope of relations were broadened over the years as reflected by the 26 MOUs he signed and participated in negotiations including in the areas of trade and investments, agriculture and fisheries, science and technology, health, antidrug and anti-money laundering, mutual legal assistance among others – all while delicately keeping within the confines of our “One-China Policy.” As t he head of MECO, he was conferred the award of “Outstanding Foreign Representative Office” by the prestigious General Chamber of Commerce of the ROC. In 2008, MECO achieved ISO 9001 certification and as far as I can recall, MECO is the only mission/embassy of the Philippines which succeeded in attaining ISO certification. Furthermore, in 2015, Tony initiated the development of an electronic visa system, which gave MECO the capability to issue an online electronic visa 24x7, in coordination with the Bureau of Immigration in Manila. This was the culmination of his effort to improve the customer experience for visa application, which he shortened from three days to 24 hours when he first arrived to issuing them on the same day even while enhancing security features. Tony was also popular with the Filipino community in Taiwan for enhancing MECO’s outreach to them. He spearheaded the federation of the many Filipino community organizations into a central coordinating body and helped establish the Ugnayan Center in Taipei where OFWs can socialize or learn new skills. One of his quiet achievements was in successfully appealing the commutation of the death penalty imposed on an unfortunate Filipina convicted of murder to imprisonment. But it is in the area of managing conflicts and in resolving complex issues that he excelled as a diplomat for the Philippines.

His time in Taiwan was the most turbulent period in the history of Philippine-Taiwan relations. Incidents such as the shooting death of a fisherman in Batan island; the repatriation of 14 Taiwanese citizens to China on charges of committing cybercrimes against mainland Chinese citizens in 2011. More recently the 2013 Balintang Channel incident where a Taiwanese fishing boat was fired upon by a pursuing Philippine Coast Guard vessel resulting in the death of the boat’s captain. In this last particular incident, sanctions were imposed and all exchanges were brought to a standstill. It was his experience and network of contacts (particularly his personal rapport with the Taiwanese foreign minister) that allowed for a mutually agreeable solution to be reached, ending the protracted negotiations thus restoringClearlyrelations.asadiplomat, he should be rated outstanding, meaning he exceeded the requirements of the job at all times and deserves to be acknowledged. Ironically, it was Taiwan that conferred on him the Order of Brilliant Star, Grand Cordon, Taiwan’s highest civilian decoration. Since its inception in 1941, he is only the seventh recipient of the decoration for those who served as diplomats/representatives to Taiwan. Among foreign nationals conferred were Vaclav Havel of the Czech Republic, Prime Minster Yoshiro Mori of Japan and US Secretary of Defense Donald Rumsfeld. Despite his accomplishments, Tony has remained humble and unassuming in demeanor. He is a role model, which should be emulated by the young foreign service officers of today. —Philstar and Tony

Pinag-aaralan at pinaghahandaan niyang maging malusog ang sambahayan. Ang ina ay magiging higit pa sa Hiyas kung.... Maitataguyod Ang Dangal Sa Lipunan. Sa unang pagkakataon sa historya ng pre-dominantly white na Los Angeles City, California, ay naging mayor ang isang anak ng black slave. Si Tom Bradley ay nahalal nuong 1973 at nanatili sa posisyon hanggang 1993. Sa kanyang panunumpa bilang mayor, nag pasalamat siya una sa Diyos at sa kanyang ina na si Crenner Bradley. Gumagastos ng malaki upang mapanatili ang kanilang pigura. Hindi masama ang gawin ito at nararapat din naman ngunit kung mas pinahahalagahan ito kaysa sa pag-aayos ng relasyon sa Diyos, hindi malay ong magka problema sapagkat sinabi ng Bib lia, “Mandaraya ang pang-akit at kumukupas ang ganda, ngunit ang babaing gumagalang at sumusunod kay Yahweh ay pararangalan” (v.30). Mabuting unahin ang pagsasa-ayos ng buhay ayon sa kalooban ng Panginoong Diy os. Kamakailan lamang ay ipinagdiwang na tin ang sakripisyong ginawa ni Jesus sa krus (Holy Week). Inihandog ni Jesu Cristo ang bu hay upang bigyan ng kapangyarihan ang sino mang sasampalataya sa Kanya na maipatupad ang pagiging huwarang ina. Kung isusuko ng ina ang kanyang sarili kay Jesu Cristo gaya ni Crenner Bradley at itataguyod ang pamilya sa mga katuruan ni Jesus, tiyak magiging higit pa siya sa isang mamahaling Hiyas! Halimbawa ay si Teodora Alonso ang ina ni Jose Rizal na naging pambansang bayani ng Pilipinas. Si Coretta Scott King, ang asawa ni Martin Luther King Jr. na naging matagumpay na Civil Rights mover. Si Sarah na ina ni Isaac at lola ni Jacob na siyang naging ama ng bansang Israel. Si Elizabeth na naging ina ni Juan Bautista, ang napiling bap tizer ng Panginoong Jesu Cristo. Tutuo na may mahalagang papel ang mga ama ng tahanan subalit hindi maikaka-ila ang inpluensiya ng ina sa buhay ng anak. Ayon sa pag-aaral ni Dr. Adam Tomison, kapag ang ina ay may kriminal na record at ang ama ay malinis o walang re cord, 33% ang tsansa na makagawa ng krimen ang anak na lalaki. Kung ang ama at ina ay may kriminal na record, tataas ang tsansa ng 67% na makagagawa ng krimen ang anak na lalaki. Ang bawat ina kung gayon ay kinakailangang magkaruon ng matuwid na huwaran. Walang kuwestyon na lahat ng ina ay nais maitatag na maging maganda at mabuti ang kanilang mga anak. Subalit marami ay tsamba tsamba kung magpalaki ng anak. Nagbigay ang Biblia ng ilang tanda ng isang higit pa sa Hiyas na ina mula sa Biblia, Mga Kawikaan 31. Ganito ang pahayag mula sa sinulat ni Haring Solomon, hari na pinatalino ng Diyos. Ang ina ay magiging higit pa sa Hiyas kung.... Maging Matulungin Sa Asawa Masipag o hindi ang lalaking asawa, ang babae ay magiging higit pa sahiyas kung mag sisikap na tulungan ang asawa sa pagtataguy od ng kanilang relasyon at mga anak. Imbes na nagger o mahilig manisi nang asawa, kanyang tutulungang punuin o iresolba ang ano mang kakulangan ng asawa. Imbes na maging “hys terical” o “historical” kapag may problema, kalmado niyang haharapin at aayusin ang mga hamon hinaharap sa buhay. Ganito ang nasusu lat, “ Pinaglilingkuran niya ang asawa habang sila’y nabubuhay, pawang kabutihan ang ginagawa at di kasamaan” (v.12). Ang ilang sa mga kabutihan gawa niya ay “Wala siyang tig il sa paggawa, hindi na halos nagpapahinga...” (v.13). Ibig sabihin, ginagamit niya ang pana hon upang maka suporta sa pangangailangan ng asawa at pamilya. Inihalintulad pa nga sila sa isang barko nangangalakal. “Tulad ng isang barkong puno ng kalakal, siya ay nag-uuwi ng pagkain mula sa malayong lugar” (v.14). “Bago pa sumikat ang araw ay inihahanda na ang pagkain ng buo niyang sambahayan, pati na ang gawain ng mga katulong sa bahay” (v.15). “Sa kanya’y mahalaga ang bawat ginagawa, hanggang hatinggabi’y makikitang nagtiti yaga” (v.18). Lahat ng ito ay nakikita ng mga anak habang lumalaki at nagiging huwaran. Nagbibigay pa ng katuwaan at kasiyahan. Ito ang nagpapalusog sa kaisipan, emosyon at ka tawan ng mga anak at asawa. We are hoping to give the service for as low as Dh10 service charge to make it competitive with prevailing charges of existing remittance centers. This will be the government’s corporate social responsibility (CSR),” said Buenaventura.

However, the Ministry of Labor’s “Foreign Worker’s Affidavit for Wage/Salary and Expenses Incurred before Entering the Republic of China for Employment,” which is also signed by the workers before they come to Taiwan and verified by the Philippine Overseas Employment Administration, states that employers would charge employees a monthly fee for board and lodging, Chen said. A factory in Taoyuan has told him that some of its Philippine workers are planning to claim back the fees that have paid for board and lodging, which they said should have been free according to the terms of their contracts, Chen said. “In the affidavit, it is agreed that there is a monthly fee for board and lodging,” he said. Assuming that a NT$2,500 (US$81.57) monthly fee was paid by each worker, if the 130,000 Philippine migrant workers in Taiwan are assumed to have worked an average of three years, the amount at stake would be more than NT$10 billion, Chen said, urging the ministry to come up with a solution. Similar disputes have arisen since 2008, “but at the beginning it involved migrant workers regardless of their nationality,” ministry official Su Yu-kuo said. “Since then we have reached agreements and ironed out inconsistencies with all the governments involved except Manila, which in 2013 changed its contract [to demand free board and lodging] and has since been insistent on retaining the clause despite our requests,” he said. In 2008 and 2013 the ministry declared that employers could make consensual agreements with workers to change their contracts to eliminate the discrepancy and bring them into line with the affadavit — under the condition that the workers’ basic rights are protected, Su said, adding that employers that have done so will have the upper hand in any lawsuits filed on the matter. “We will continue our efforts to communicate with the Philippine government at the meeting scheduled for August between the two countries’ ministers of labor,” Su said.

Aregulation has recently been revised to lower the amount of service fees that brokers in Taiwan can charge foreign migrant workers after they have worked in the country for more than two years. According to the amended “Standards for FeeCharging Items and Amounts of the Private Employment Services Institution,” which was announced by the Ministry of Labor on April 6, brokers should not charge migrant workers more than NT$1,500 (US$49) per month in service fees from their third year onward. The revision came after an amendment to the Employment Service Act cleared the Legislative Yuan on Oct. 21 last year and went into effect on Nov. 5. The amendment removed a provision that required migrant workers who have worked in Taiwan for three years -- the longest contract allowed -- to leave the country for at least one day if they want to be re-hired. It means that foreign migrant workers can be re-hired without having to leave Taiwan every three years, saving them travel time and expenses, as well as brokerage and regulation fees. Until now, brokers have been allowed to charge migrant workers up to NT$1,800 per month in the first year of their contract, up to NT$1,700 per month in the second year, and up to NT$1,500 per month in the third year. The cycle is repeated again after the workers leave and re-enter the country, meaning that they are charged NT$1,800 per month again in the first year of their re-entry. Under the new regulation, workers should not be charged more than NT$1,500 per month beginning from the third year of their stay, whether or not they have left and re-entered the country.

The minister of Taiwan’s Ministry of Transportation and Communications Ho Chen Tan proposed to charge foreigners taking tourist rail routes to visit scenic areas in the country to pay higher train ticket fares in the future. The suggestion is part of MOTC proposal to change Taiwan Rail ticket pricing system by charging different rates for various rail routes, and introduce new compartment rates. As part of the new rail infrastructure upgrade, the MOTC is considering amending the Railway Act, and charge ticket prices based on operation costs and rail functions, said Ho Chen. Taiwan Rail trains ticket prices have remained stagnant for 20 years made the rail line rather unprofitable, ticket prices reach nearly only 50 percent of operation costs, said Ho Chen. The High Speed Rail for instance charges NT$4.39 (US$0.14) per kilometer (km), but the Taiwan Rail’s fastest train Tze-Chiang Limited Express charges nearly half the rate of NT$2.27 per km.

Manila International Airport Authority general manager Ed Monreal on Monday announced his agency would start on April 30 implementing a new policy exempting overseas Filipino workers from paying terminal fee. Under the agreement signed by the airport authority with air carriers, OFW exemption shall be recognized at any point of sale in the Philippines or abroad beginning April 30. “As they buy their ticket, one has to state or declare that he is an OFW for exemption to be recognized. The selling agent may or may not ask for a proof of entitlement during transaction. If no proof is shown during transaction, the passenger should be able to present one during check-in at NAIA where same shall be validated,” said Monreal.
Winston Chen, director-general of the Foreign Ministry’s Department of East Asian and Pacific Affairs, added that under the New Southbound Policy, the number of Filipino visitors to Taiwan grew by 35,000, or 24 percent, from 2015 to 2016. With upcoming visa privileges for visitors from the Philippines, it is expected that Philippine arrivals will double this year, he said.
On July 31, on the other hand, air carriers will start honoring OFW exemptions at any point of sale for tickets purchased online, through telephone and mobile applications.

The current Taiwan Rail pricing scheme is inflexible where the express train is charged a single price depending on the distance it covers. It was a rare occurrence that Taiwan Rail reported its first profitable fiscal year in 2016, due to fewer retiring employees resulting in lowered pension payments, reduced debt, and better management of its urban commuting lines, explained the minister. The ministry is evaluating whether to make new price adjustments in Taiwan Rail pricing system in the next three months, and said price hikes would be gradual for common commuters of the rail line.

President Rodrigo Duterte said he was pushing for the creation of a separate department for Overseas Filipino Workers and a national ID system but Congress had to pass laws to this effect. Duterte told some 1,000 OFWs gathered at the Marriott Makarim Hall here on Wednesday that congressional action was needed for the two concerns which the OFWs want his government to establish. He however pointed out that on the national ID system the OFWs wanted to be implemented to hasten government transactions, there was a bill already filed in Congress. Duterte also said a Consular office will be established in Al-Khobar region to serve OFWs in the Eastern part of Saudi Arabia, who had to endure about 400 kilometers of travel by car to process documents at the Philippine Embassy here or at the Consulate in Jeddah. “Give me three months,” he said.
“We also consider this trip as something aimed at creating progress, that is to draw investors to the Philippines by showing potential investors that the Philippines is a viable destination for doing their business, and the fact that we also have a huge and fairly young population in the Philippines, ” Manalo added. Manalo pointed out that the delegation hopes to engage Saudi investments to Mindanao especially and particularly “its sectors of halal food security, energy security and tourism.” For his part, Labor Secretary Silvestre Bello III said his counterpart in the Saudi government also agreed to negotiate on new rules to improve working conditions for Filipino overseas workers. Bello announced that his request that more than 160 runaway workers who are stranded in shelters in Saudi be allowed to return to the Philippines has been granted by the Saudi government and will be allowed to fly home in time for the President’s return.
The ministry is also considering to make international visitors pay a premium ticket price compared to domestic passengers if they take tourism rail lines that pass through Jiji Train Station in Nantou County, Pingxi in New Taipei City, or Neiwan Line and other branch lines. Other routes included in MOTC tourist route assessments include the Eastern Line and South-link Line. The Tsai Administration approved a stimulus of around NT$424 billion for some 38 rail infrastructure projects on March 24, 2017 that takes up nearly half of the NT$880 billion to be set aside to update important country infrastructures. Rail infrastructures are expensive to construct, most metro rail system pricing is based on costs. If rail lines are to be viewed as a public infrastructure and public service by the people, who are demanding to decrease price differences among different rail systems, then the ministry might consider subsidizing light rail lines and metro lines in the future, said Ho Chen. The MOTC and Taiwan’s local governments should discuss how to price different rail lines in accordance to its function.
The minister recommended Taiwan Rail introduce business and tourism compartments that will be charged more expensive rates than average compartments.
In contrast, the Taiwan High Speed Rail Company will be transformed from a private company to a state-owned company in the near future, which could lead to potential ticket price cuts in the future, but will require further evaluation and discussions, said Ho Chen.
Democratic Progressive Party Legislator Wu Kuen-yuh, who was elected chairman of the Taiwan-Philippines Congressional Association, said he hopes the association can push for more cooperation in trade, investment, agriculture and medicine.

The Ministry of the Interior (MOI) said that it is necessary to retain the “good moral character” requirement for new immigrants seeking Republic of China (ROC) citizenship.Prostitution, drunk driving and other offenses that authorities might consider to be less severe might not appear on a criminal record, but could still affect social order, “and it is therefore necessary to retain such a requirement” in the Nationality Act governing non-citizens who are seeking Republic of China (ROC) citizenship, ministry officials said. Article 3 of the act requires applicants to “have demonstrated good moral character and to have no criminal record.” Department of Household Registration Affairs officials were responding to a call by the Alliance for Human Rights Legislation for Immigrants and Migrants to remove Article 3’s “good moral character” requirement from the Nationality Act. The alliance urged the government to change the “no criminal record” requirement to “no criminal cases record that can be proved by an absence of a police criminal record.” The public cannot accept the idea that they should be punished for such minor offenses, while foreigners or new immigrants with a record of such offenses can apply for ROC citizenship, the officials said. They quoted naturalization laws of other countries, such as Canada, South Korea, Singapore and Australia, as requiring applicants for naturalization to “have good moral character” so that once they become citizens they will not adversely impact national security and social norms.
During the meeting, Tsai pitched her New Southbound Policy targeted at strengthening Taiwan’s relations with countries in Southeast and South Asia, saying that there was growth in both bilateral trade and Philippine visitors to Taiwan in 2016. She also hoped for deepening bilateral exchanges at all levels and closer trade relations in view of the geographical proximity between Taiwan and the Philippines. Relations could be advanced, Tsai suggested, by signing an economic cooperation agreement, cooperating more closely on visa streamlining, education and disaster prevention and holding a dialogue on South China Sea cooperation. That may be a difficult wish list to achieve, however, especially when it comes to the South China Sea. A Philippines Department of Foreign Affairs spokesman said earlier this month that all member states of the Association of Southeast Asian Nations (ASEAN) adhere to the “one China” policy. As a result, the spokesman said, regarding Taiwan’s claims in the South China Sea, the ASEAN sees China as the representative in negotiations concerning those claims. The Philippines, ASEAN’s rotating chair for this year, is playing the leading role in organizing a series of ASEAN meetings in 2017, including those for talks aimed at crafting a framework for a code of conduct in the South China Sea.

During two rounds of discussions, on March 15 and on Monday, participants said that after taking into account new immigrants’ rights and citizens’ perceptions about new immigrants, they would recommend listing only “serious” minor offenses as “not demonstrating good moral character” — such as offenses in which indictment has been confirmed, but delayed, or offenses for which prison terms, fines or delayed execution of the sentence have been handed down. Also to be considered as “serious” minor offenses are use of hallucinogenic drugs, engaging in gang fights, failure to live up to legal obligations to support a spouse or dependent children, habitual domestic violence and seriously damaging public interest. Ministry officials said these offenders would be observed for two to three years, after which, if they do not repeat their offenses, they would be permitted to resubmit their applications for naturalization.
The ministry has invited academics and experts to discuss how to define what kinds of people have “not demonstrated good moral character.”

DOTr, ICTSI launch Philippines’s first ro-ro barge terminal Tycoon Enrique Razon’s International Container Terminal Services Inc. (ICTSI) and the Department of Transportation launched on Friday the country’s first roll-on/roll-off barge terminal. In a disclosure to the Philippine Stock Exchange, ICTSI said that the terminal in Tanza, Cavite was launched through wholly-owned subsidiary Cavite Gateway Terminal in partnership with the Department of Transportation. “In line with the Department of Transportation’s national transport plan, Cavite Gateway will facilitate off-the-road seaborne transport of containers between the Port of Manila and Cavite and service industrial locators in the Cavite area,” ICTSI noted. The terminal has an annual capacity of 115,000 twenty-foot equivalent units (TEUs), which is equivalent to 140,000 fewer truck trips on city roads each year, the company said. “The terminal will be integrated with other major Luzon port facilities for more cost-effective and time-bound access to the Cavite market,” it added.
