Duterte dissolves Negros Island Region

Executive Order (EO) No. 38, signed by Duterte on August 7, revokes EO No. 138 signed by former president Benigno Aquino III which created the NIR. The new EO reverts the provinces of Negros Occidental to Western Visayas (Region VI) and Negros Oriental to Central Visayas (Region VII). The NIR regional offices are now abolished, with their personnel ordered

to return to their previous assignments or reassigned to other offices in their department or agency. Duterte’s EO states that there is not enough funding for the NIR given other priorities of the administration. “The establishment of regional offices (ROs) of departments and agencies in the NIR requires substantial appropriation to be fully operational, thus competing with government priority programs and projects for funding,” reads the document. Duterte had already made the decision to dissolve the island region in a Cabinet meeting on October 3, 2016. Budget Secretary

Benjamin Diokno had then told the President that the NIR came with a too heavy price tag. “When we came in, I was confronted with a P19-billion request by various agencies for that new region. I said, that’s not affordable, we have other priorities,” Diokno told reporters back then. The NIR was supposed to have been a legacy of the Aquino administration. Its creation had been endorsed by then interior secretary Manuel Roxas II, whose family hails from Negros Occidental. His mother Judy Araneta-Roxas hails from Bago City. Creating a region for the two adjacent

provinces, according to Aquino’s EO, is needed to accelerate social and economic development and improve the delivery of public services. The governors of Negros Occidental and Negros Oriental, Alfred Marañon Jr and Roel Degamo, respectively, supported Roxas’ presidential bid in 2016. DFA reminds Filipinos abroad on safety after Barcelona attack

he Department of Foreign Affairs on Friday reminded Filipinos travelling abroad to take additional precautions following the terrorist attack that killed 13 people and wounded more than 100 others at a popular tourist destination in Spain. The Philippine government continues to check on the condition of a Filipino family of Irish nationality wounded when a van rammed into pedestrians along Las Ramblas in Barcelona, said DFA spokesman Robespierre Bolivar. Two of them have been released from the hospital while 2 others were still being monitored, he said. Bolivar urged Filipinos going abroad to remain vigilant and “be mindful of your surroundings.” “If you notice any suspicious behavior, any suspicious packages, please immediately report to the police or any authority figure in the area,” he told ABSCBN News. They should also secure the contact numbers of the Philippine embassy or consulate nearest their destination, he said. “If you have an opportunity, when you land in that country or in that city, please inform the embassy or consulate that you are there, where you are and where you can be contacted in case of emergency.” The DFA expressed concern over terrorist attacks especially those that targeting civilian populations such as those in London, United Kingdon and Nice, France over the past few years. Without tax reform, only half of infra projects can be funded – DOF chief

he Duterte administration’s ambitious “Build, Build, Build” program might not be completed if Congress would not pass the proposed comprehensive tax reform program, Finance Secretary Carlos G. Dominguez III said. Dominguez told senators during the briefing on the proposed P3.767-trillion national budget for 2018 that the government planned to spend over P1 trillion for infrastructure projects next year and a total of up to P9 trillion until 2022. To finance the higher requirement for infrastructure spending, the government would source the bulk or 80 percent of the

funds locally while tapping multilateral lenders as well as development partners such as China and Japan for the rest, Dominguez said. He added that the Tax Reform for Acceleration and Inclusion (Train) would also generate additional funding for the infrastructure buildup. Asked how important Train would be for the “Build, Build, Build” program, Dominguez replied: “It’s very important. Without the Train, we will probably not be able to fund half, maybe not even half [of the infrastructure projects].” Dominguez said the additional funds

from tax reform would be crucial so that the government would not breach the programmed 3-percent annual budget deficit cap. Asked further what would happen if Congress would not pass Train, Dominguez said the “Build, Build, Build” initiative “will not continue as projected” as the projects may be reduced by “less than half.” The government plans to roll out over P3.6 trillion in public infrastructure projects from 2018 until 2020, as the state planning agency National Economic and Development Authority jacked up to 75 from 55 previously the number of so-called flagship, “game-

changing” projects that the administration aims to start and complete before 2022. Under its “Build, Build, Build” program, the Duterte administation plans to usher in a “golden age of infrastructure.” During the hearing, Dominguez sought support for the Department of Financebacked Senate Bill No. 1408, which contains the first package of the tax reform program aimed at brining down personal income tax rates while slapping new or additional taxes on consumption. resident Duterte is allocating more than P1 billion for the assistance of overseas Filipino workers in the protection of their rights and welfare. The President recognized the heroism and sacrifices of the OFWs in giving them a higher budget during his State of the Nation Address (SONA) before a joint session of Congress. “They are our heroes. They and their families have sacrificed much to the — for the country. We all know how a large part of our economic — economy comes from their remittances,” Duterte said in his remarks. “That is why to ensure that their rights are protected, I ordered the increase of our assistance to the OFW from P400 million to more than P1 billion,” he added. The President assured that the government has been “hard at work” in securing the rights and welfare of the Filipinos working abroad. The Department of Labor and Employment recently launched an identification card system to hasten the OFW access to government services. The OFW IDs also meant to replace the overseas employment certificate (OEC) at no cost to the workers. At least 17 one-stop shops catering to the needs of the OFWs have also been established by the labor department. The facilities placed several government agencies under one roof to serve the OFWs.

LTFRB suspends Uber operations for one month

he Land Transportation Franchising and Regulatory Board on August 14 suspended the accreditation and operations of Uber System Inc. (Uber) for one month. In its advisory, the LTFRB said the board meted out the penalty of one-month suspension “on the accreditation of Uber System, Inc. (Uber) and was ordered to cease and desist its operations of their online booking application during the period of suspension.” LTFRB also recommended that Uber extend financial assistance to affected peer-operators during the one-month suspension “as an expression of good faith”, noting that the operators “would not have suffered the current predicament were it not for the predatory actions of respondent user.” The suspension takes effect immediately. In a statement, Uber Philippines said they have received the order and is currently studying it. “Uber received an order around 6pm tonight (August 14) to completely stop operations. We are studying the order at the moment. We will update our riders and drivers as soon as we can,” the company said. Uber and rival Grab are in dispute with the LTFRB over the scope of regulation on ride-sharing services, sparking separate investigations by the Senate and the House of Representatives. The LTFRB earlier fined Uber and Grab P5 million each, accusing the companies of operating some 50,000 vehicles without proper permits.

OFW groups slam proposed VAT on low-cost housing

However, OFWs may have to work harder to purchase their dream homes as the Tax Reform for Acceleration and Inclusion (TRAIN) bill that proposes the addition of Value Added Tax (VAT) on low-cost housing has been passed by the House of Representatives and is now under the Senate deliberation. Once the law is passed, the sale of low-cost housing valued at P1.7 million will increase to P1.9 million, while houses and other residential properties priced at P3 million will now cost P3.4 million. Several OFW groups and non-government organizations intend to submit a position paper to the Senate and the Department of Finance (DoF) this week, in opposition of the proposed lifting of the 12 percent VAT on low-cost housing, The Manila Times reported. “Based on surveys, these OFWs go abroad to be able to buy a home for their family and a P3-million house is what they can usually afford. And then you are removing the VAT exemptions. Isn’t it you are penalizing the OFWs?” Senator Cynthia Villar said in a public hearing in July. The tax imposition will likely affect minimum wage earners, contractual employees, and overseas workers as these are the target properties of aspiring new home owners. “These are the houses that our OFWs can afford not immediately, but through years of hard work and sacrifices. Removing the VAT exemptions on low-cost, socialized and economic housing penalizes the poor, while the extremely rich are able to avail of tax loopholes with the help of their connections and legal experts,” ACTS OFW partylist Rep. John Bertiz III was quoted as saying. Kabalikat ng Migranteng Pilipino (KAMPI) also expressed their opposition to the proposed plans to remove tax exemptions on affordable housing. “Around 60 percent of those who avail of low-cost housing loans for property less than P3 million are OFWs. They were never consulted about the intent of the TRAIN bill, and many of them are unaware of the DoF’s plan to remove the VAT exemption on affordable houses,” KAMPI founder Luther Calderon said in an interview. The government is expected to earn P6.2 billion from the expansion of the VAT base by 2018.

DOLE, DA to launch cacao investment program for OFWs

ith soil and climate conditions perfect for cacao cultivation and a ready world market for cacao products, the Philippines eyes to bring the country back on the world cacao map. The Department of Agriculture reported that the global demand for cocoa is estimated to reach 4.7 million to 5 million metric tons by 2020 but with a cocoa global shortage predicted at 1 million metric tons. “Because cacao has strong domestic and export market demand, it is now considered a very important commodity. Cacao can provide more jobs and livelihood opportunities and promotes countryside development. Not only it is less prone to severe fluctuation but also requires low startup cost,” DTI National Cacao Cluster Coordinator Edwin Banquerigo said in a forum last September. In line with this, the Department of Agriculture – Agribusiness and Marketing Assistance Service (DA-AMAS), Philippine Cacao Industry Council, and the Department of Labor and Employment (DOLE) will launch the OFW Agriculture Business Investment Program this year, according to a report by the Philippine News Agency (PNA). The program aims to enable OFWs to invest their money and let it grow through farming as well as usher a competitive and sustainable Philippine cacao industry, Philippine Cacao Industry Council chair Valentino Turtur said. OFWs in Hong Kong will pilot the program, with their investments being used for the development of a corporate farm with a minimum of 50 hectares. “Our OFWs in Hong Kong are eager to invest in Philippine’s cacao industry. The program will be like a crowd funding and our OFWs will serve as the investors,” Turtur added. After the launching Hong Kong, the program will be replicated in Singapore, Korea, and Dubai. Turtur is confident that Agriculture Secretary Emmanuel Pinol will support the program.

Senator urges gov’t to allot ‘quick reaction fund’ for OFWs

ollowing the recent North Korean announcement of a missile strike against Guam, a Pacific island territory of the United States, Senator Ralph Recto called for the creation of a “quick reaction fund” to safeguard the lives of Filipinos in conflictthreatened countries. A contingency fund must be available to embassies and consulates “not after but before an emergency,” the Inquirer quoted the senator as saying. Recto says that even the budget during peaceful times is not enough, given the number of Sen. Ralph Recto Filipinos working overseas. For example, the Philippine embassy in Seoul, South Korea, one of the world’s most expensive cities, proposed a P109 million annual budget for 2018. “Peace time pa lang, kulang na ito dahil sa dami ng mga Pilipino doon. Ano pa kaya kung may krisis na?.. When there is a crisis to prepare for, their resources must be increased,” the senator added. The Department of Agriculture (DA), in partnership with the Department of Labor and Employment (DOLE), is crafting a memorandum of agreement (MOA) that will allow overseas Filipino workers (OFW) to finance local farmers and improve food production in the country, DA Secretary Emmanuel Piñol said in a Facebook post. “I explained to him [Labor Secretary Silvestre H. Bello III] that following a successful model of an OFW investments program between Don Bosco Multipurpose Cooperative and Dubai-based Filipino overseas workers, the agriculture department is looking at tapping other OFWs to provide financing to rice and corn farmers,” Piñol added. Under the adopt-afarm program, OFWs can invest up to P20,000 per hectare and would be used to buy seeds, fertilizers, and other farm needs. “The OFWs’ investments will earn an interest of 6-percent per harvest, with guaranteed two harvests every year or earnings of P2,400,” he said.

Cebu Pacific fast tracks P550 NAIA terminal fee exemption for OFWs

ebu Pacific has updated all its booking systems to ensure that passengers who are exempt from the International Passenger Service Charge (IPSC), or terminal fee, at Ninoy Aquino International Airport (NAIA) can avail of this regardless of how they book their flights on Cebu Pacific. “Through these system upgrades, we hope to make it easier and more convenient for our OFWs to book flights with Cebu Pacific; and not have to go through a tedious and time-consuming process of reimbursing the NAIA Terminal Fee that they have been longexempted from under the Migrant Workers Act,” said Atty. JR Mantaring, Vice President for Corporate Affairs of Cebu Pacific. The move is seen to benefit thousands of Overseas Filipino Workers (OFWs) who book flights on Cebu Pacific to get to their job sites. Since July 8, 2017, passengers who book their flights through the Cebu Pacific mobile app have been able to claim the NAIA Terminal Fee exemption by simply ticking a box before booking and payment is processed and confirmed. Bookings made through the Cebu Pacific Reservation Hotlines or via the website, www.cebupacificair.com on the other hand, have been exempted from paying the P550.00

NAIA Terminal Fee since April this year. Passengers need to present valid documents upon check-in to verify their eligibility for the IPSC exemption. For OFWs, these include the Overseas Employment Certificate (OEC); and those included under the Philippine Overseas Employment Administration’s Balik Manggagawa program such as a valid employment contract, recent payslip, or Company ID. Aside from OFWs, pilgrims with authorization from the Philippine Sports Commission, and guests who have been issued a MIAA exemption certificate (MEC) are also exempted from paying the IPSC, provided valid documents are presented. Hindi mo papayagan ang kahit sino na lamang pumasok sa iyong tahanan at paki-alaman ang lahat ng mga bagay na naruruon. Gayon din naman sa relasyon sa kapwa at sa lahat ng bagay. Kailangan maglagay ng hangganan o bakod (boundaries) upang manatili kang ligtas at matino sa buhay. Ang hangganan (boundary) ay mga limitasyon o partisyon o bakod na itinatakda para sa sarili, sa pamilya, sa mga kaibigan, sa ka-trabaho. Gayun din sa pakikisama at pakikisalamuha sa iba pang kapwa tao, o sa komunidad na iyong ginagalawan. Sa pansariling buhay, para maging protektado at ligtas, kailangang nakatakda ang mga bakod. Sa bagay na ito, kailangan mong liwanagin sa sarili kung sino ang bibigyan ng karapatan maghari sa iyong buhay sa lupa tungo sa buhay na walanghanggan at kangino ikakandado ang kaluluwa. Iisa lamang ang buhay sa daigdig na ibinigay sa iyo ng Diyos kaya mahalagang tantuhin kung kanino mo ipagkakatiwala ang iyong kaluluwa. Dalawang uri ng Spirito mayroon sa mundo ayon sa Biblia. Ang Banal na Spirito at ang masamang spirito. Ang masamang spirito ay hindi nakikita at naghahari sa sanlibutan at papatayin ang iyong kaluluwa at katawan. Alam natin na may mga taong na-poses ng masasamang spirito gaya ng lalaki na nanahan sa sementeryo ng Gadareno (Mark 5). least five million Filipinos abroad send shipments of durable and consumable goods to their families back home every year, according to the Door-to-Door Consolidators Association of the Philippines (DDCAP). Mostly, these are contained in balikbayan boxes which are charged a fixed freight rate regardthem very less of the weight of the contents, making affordable to overseas Filipino workers. A new set of rules on balikbayan boxes—Customs Administrative Order (CAO) 05-2016—will take effect on August 1, 2017. The new regulations stemmed from the passage of the Customs Modernization and Tariff Act or CMTA (Republic Act No. 10863), which was signed into law in May 2016. The CMTA updated many of the provisions of the old Balikbayan Box Law that removed customs duties on personal goods sent home by overseas Filipino workers. The Bureau of Customs (BOC) reminded the public about some of the provisions of CMTA that applied to balikbayan boxes. The following are some of the most salient points from the BOC’s reminders:

The CMTA increased the ceiling on the value of tax-free personal items that can be sent via balikbayan boxes to Php150,000 from Php10,000. The law also raised the de minimis value of goods subjected to duties from Php10 to Php10,000, which shall be adjusted to keep up with inflation once every three years. The increase in the value of minimum goods subject to import duties lessens the discretion of customs officials to inspect goods and impose taxes, according to lawmakers. In a Facebook post, Bureau of Customs commissioner Nicanor Faeldon appealed to overseas Filipinos sending balikbayan boxes not to abuse the tax-free privilege to minimize the loss of potential government revenue. “Ang programa pong ito ay isang pribilehiyo at regalo ng gobyerno sa ating mga kababayan. Kaya po tayo’y nananawagan at umaapela sa likas na kabutihan ng ating mga kakababayan na huwag po itong abusuhin para sa tunay na pagbabago,” (This program is a privilege and a present for our fellow countrymen. That’s why we’re appealing to the innate goodness of our countrymen not to abuse (this privilege) towards genuine change,” he said in a Facebook post. Filipinos staying abroad whether for employment, education or permanent residency may avail of the tax-free balikbayan box privilege. They are referred to as Qualified Filipino While Abroad (QFWA), and are defined as follows, according to CAO 05-2016: *Overseas Filipino Workers or Filipinos who work abroad either with passports issued by the Department of Foreign Affairs and certified by the Department of Labor and Employment (DOLE) or the Philippine Overseas Employment Administration (POEA) for overseas employment purposes or those who work in a foreign land on a contractual basis; *Non Resident Filipinos or Filipinos who have sought permanent residency abroad but have retained Filipino citizenship; *Resident Filipinos or Filipino citizens staying abroad temporarily and hold any of the following visas: student, tourist and investors; *Recipients of the balikbayan boxes must be a relative of the sender up to the fourth degree of affinity to qualify for the privilege.

Qualified Filipinos working or living abroad can send up to three balikbayan boxes in one calendar year (January 1 to December 31) tax-free, provided that the contents of all shipments only amount to Php150,000 in total. If you ship an item or items exceeding Php10,000, the BOC will consider the parcel as one of three availments of the privilege for the year. “For instance, if an OFW has been exempted from duties and taxes on his/her first availment, amounting to Php 100,000, he/she can only avail the remaining Php 50,000 for two remaining availments, in a given calendar year,” the BOC told Entrepreneur Philippines. The BOC reminds OFWs that these balikbayan boxes must only contain personal and household effects only. The privilege cannot be used for the shipment of items for barter or commercial use.

Here comes the tedious part. To assure the BOC that the boxes sent home contain only permitted items, the bureau is requiring senders to accomplish information sheets that will detail the contents of the shipments. Everything in the box, even secondhand items, must be declared, including their value and quantity. If the box contains new items, the sender must provide the necessary receipts to certify their value. Faeldon clarified, however, that gifts, groceries and other secondhand items need not to be provided with receipts but must still be declared on the sheet with a corresponding “approximate value.” He cited a used shirt bought for Php500 as an example, which may only have an approximate value of Php100 once shipped. Senders may download these sheets online or may ask for copies from accredited consolidators or foreign freight movers. The BOC requires senders to prepare three copies of the forms for the consolidator, deconsolidator and the sender. To check the veracity of the sender’s declared list of items in the balikbayan box, the BOC said the shipments will undergo X-ray examination under the supervision of a BOC personnel. If ever the bureau finds an item or box “suspect” then it will be opened or “100 percent physically examined.” Once a discrepancy is found, the BOC will “segregate the shipment and will be released upon compliance with existing rules.” Otherwise, the BOC will assess if the shipment can avail of the CMTA privilege and be shipped accordingly. Aside from the information sheet and some necessary receipts, the sender must also provide a photocopy of his or her passport to certify citizenship. There is a processing fee of Php250 that the sender needs to pay to the BOC for each balikbayan box to be sent home. Even a parcel containing items less than the de minimis value of Php10,000 are subject to the processing fee. Any sender and/or deconsolidator caught violating the rules is liable to fines of up to Php300,000 and even criminal prosecution. —Entrepreneur Ph

atholic nun O Anuna (滿詠萱) from the Philippines, who has devoted almost half of her life to taking care of children with disabilities in Taiwan, officially became a Republic of China (Taiwan) citizen Friday (August 4). “I’m the most joyful when being with the children and I’m happy to be able to stay in Taiwan forever,” the 58-year-old sister said after receiving her ROC identification card from Chiayi County Magistrate Chang Hwakuan. Despite the challenges involved in taking care of children with disabilities over the past 27 years, Anuna said she has really enjoyed the process, and that her decision to become a naturalized ROC citizen has also gained the support of her family. The fact that she was given a ROC identification card symbolizes that her love for the children is being appreciated, she said. Born in 1959 in the Philippines, Anuna first came to Taiwan in 1990 to serve at

Migrant workers get more overtime pay under new rules

igrant workers have been enjoying better labor protection in Taiwan since a controversial five-dayworkweek policy was implemented in August last year. The Department of Labor of Taoyuan, northwestern Taiwan, says the amount of overtime pay for migrant workers who sought help from the department was NT$14 million (more than US$463,500) in the first half of this year. It said that was an increase from a year ago, according to a report by United Daily News, but it did not disclose the amount of overtime pay in the first half of 2016. The number of labor disputes in Taoyuan, which has 20,000 foreign caregivers and 70,000 migrant factory workers, reached 1,907 in the first half of the year, most of which were due to issues involving overtime pay, it said. A total of 504 cases were settled. Other employer malpractices included treating workers improperly, taking away employees’ passports, and discrimination. The five-day-week policy, launched by Taiwanese President Tsai Ing-wen, ensures that a worker can enjoy one fixed holiday per week and another flexible rest day. A worker can get overtime pay if he or she is required to work on the flexible rest day. Since the new rule was implemented in August 2016, the amount of outstanding overtime pay increased as migrant workers were entitled to higher wages, said Chang Cher-hung, chief of the Foreign Workers Service Section. Chang said employers who failed to pay their employees overtime could be subject to fines ranging from NT$20,000 to NT$1 million. Rights of migrant workers raised at women’s summit

he rights of migrant workers was among the issues raised at the 2017 Council of Asian Liberals and Democrats (CALD) Women’s Caucus Conference, an international women’s summit being held in Taiwan for the first time. The two-day summit, organized by CALD and Taiwan’s ruling Democratic Progressive Party (DPP), covers topics such as gender awareness and violence in Asia, women’s empowerment in the media, civil society, business and government, as well as the rights of lesbian, gay, bisexual, transgender and intersex (LGBTI) people. In a question-and-answer session at a panel discussion, Emily Lau, a prominent liberal politician in Hong Kong, raised the issue of foreign domestic workers, noting that many of these workers in Asia and elsewhere have been deprived of their human rights. “Most of them are women. Some do not have a legal day off, and some have to work for a very long time in their homes. Some do not have enough food to eat and are beaten up,” Lau said. “I think you will agree with me that the hallmark of a civilized society
