Preferred File Format

Digital files in Quark, Adobe Photoshop, and Adobe Illustrator, must be formatted as EPS or PDF files. All required trapping must be included in the file. Images for 4-Color ads must be submitted as final highresolution, CMYK, TIFF files. All fonts must be included. Apple True Type fonts should not be used or included. Information should be supplied on a Jazz, Zip, CDROM, or flash drive. All disks must include a print out of contents and must be accompanied by page proofs at 100% size. Spreads should be set up as two single pages. Ads submitted as film will require digital conversion at the advertiser’s expense. Right-reading and emulsion-side down film negatives will be accepted and screened at 133 for 4-Color and B/W

Terms and Conditions 1. Rates published herein are effective with the issue dated. Announcement of any rate changes will be made at least seven weeks before the issue date of the first to which such rates are applicable. 2. All advertisements must be clearly and prominently identified by trademark and/or signature of the advertiser. Advertisements that simulate editorial material must be clearly labeled gADVERTISEMENT. h CRUNK, may, at its sole discretion, so label such advertisements. 3. The publisher reserves the right to reject or cancel any advertising order or advertising copy for any reason at any time, whether or not the same has been acknowledged and/or previously published. 4. Advertiser and agency may not cancel orders for advertising after closing dates. 5. It is understood that the advertiser and agency are jointly and severally liable for the payment of invoices for advertising published here under. 6. Cancellation of any portion of any advertising contract by agency or advertiser or failure to have published the specified number of pages automatically nullifies any rate discount, including for previously published advertisements, and may result in short rate. In such event, the page rate will be recalculated for the published portion of the order and agency and/ or advertiser must reimburse CRUNK for the short rate within 30 days of invoice thereof. 7. A sample of supplied insert must be submitted to and approved by CRUNK before printing in

accordance with the special units and production requirements detailed in this rate card. Advertiser and agency shall be responsible for any additional charges incurred by CRUNK arising from the advertiser fs and/or agency fs failure to deliver supplied inserts pursuant to CRUNK fs specifications. If CRUNK is unable to publish the supplied insert as a result of such failure to comply, advertiser and agency shall remain liable for the space cost of said insert. 8. CRUNK is not responsible for changes accepted after closing dates or errors in key numbers. 9. Advertisers and agency represent and warrant that they are authorized to publish the entire contents and subject matter of the advertisements and that the publication and distribution of the advertisements will not defame anyone or violate the trademark, copyright, right of publicity, or right of privacy, or any other proprietary right of any third pparty. In consideration of the publication of the advertisements, the advertisers and agency will indemnify and save CRUNK harmless from and against any loss, claim, or expense arising of the publication of such advertisements, including, without limitation those resulting from claims or suits for libel, plagiarism, violations of right of publicity or privacy, infringements of copyright or trademark, or other claim for violation of any proprietary right. 10. References to specific sources of availability in Canada are not permitted. 11. Advertiser and agency agree to reimburse CRUNK for any fees and costs incurred by CRUNK in collecting any unpaid charge or portion of the charge for advertisements, including attorney fees and court costs. 12. In consideration of CRUNK fs consideration of any advertising for publication, the agency

and advertiser agree not to make promotional or merchandising references to CRUNK in any way except with the prior permission of the publisher in each instance. 13. CRUNK shall not be subject to any liability whatsoever for any failure to publish or circulate all or any part of any issues because of strikes, work stoppages, accidents, fires, acts of God, or any circumstances not within the control of CRUNK magazine. 14. Any condition on contracts, orders, or copy instructions involving the placement of advertising within an issue of VIBE (such as page location, competitive separation, or placement facing editorial copy) will be treated as a positioning request only. CRUNK fs inability or failure to comply with any such condition shall not relieve the agency and advertiser of the obligation to pay for the advertising. 15. Agent fs commission: 15% 16. Orders for cover pages may not be canceled. Options for cover positions must be exercised at least 30 days before the closing date. If order is not received by such date, the cover option automatically lapses. 17. Terms of sale: Payment is due within 30 days of the date of invoice. Bills are rendered on or about the on-sale date. Interest will be charged at a rate of 1.5% per month (or the highest rate permissible by law if lower than 1.5%) on past-due balances. 18. No conditions, printed or otherwise, appearing on contracts, orders, or copy instructions that conflict with the provisions of this rate card will be binding on CRUNK.
