People in a packed Kamloops courtroom broke out in applause on Friday as a B.C. Supreme Court judge delivered a judgment described as decades in the making, ruling all lakes are public property and prohibiting private landowners from restricting access to them. The decision was the culmination of a protracted trial spanning six years, pitting a wealthy private ranch — the Douglas Lake Cattle Company, owned by U.S. billionaire Stan Kroenke (husband of a Walmart heir and owner of the Los Angeles Rams, Colorado Avalanche, Arsenal and other professional sports franchises) — against the B.C. government and the Nicola Valley Fish and Game Club in a fight over access to two small fishing lakes. The Nicola Valley ranch’s position was that it owned Stoney Lake and Minnie Lake because the bodies of water are surrounded by private property and alterations to the lakes had been made by the company. The ranch also claimed ownership of fish in the lakes by virtue of the fact it kept them stocked. The fish and game club, on the other hand, argued B.C. laws don’t allow private landowners to control bodies of water or the fish inside them. B.C. Supreme Court Justice Joel Groves ruled against the ranch. He

determined roads in the area of the lakes that had been claimed as the property of the ranch were actually public. Groves also said the Douglas Lake Cattle Company may have to remove dams it has constructed to increase the size of some lakes, which resulted in flooded roads. Groves ruled the ranch cannot lawfully block access to either lake, but he did place some limits on the actions of anglers, ordering catch-and-release fishing on both of the lakes. “It would be nonsensical for a government to retain the rights to a lake if, by virtue of a single owner purchasing all the land surrounding a lake, that owner could prohibit public use or ownership of the lake,” Groves said in his ruling. “It only makes sense that government would have retained the ownership of bodies of water, lakes, with the intention of the public being allowed to access water they retained.” But, Groves added, there are limits. “By access, I am not

suggesting that there exists a right to motorboat or other vehicular access to bodies of water, but it only makes sense that the government’s intention in retaining ownership of lakes means that there is public access, as determined and regulated by government, to these lakes,” he said.

In his judgment, Groves also called out the provincial government for decades of inaction despite findings by provincial officials as far back as 1996 that the ranch’s actions were illegal. “Yet the province did not respond to this apparent unlawful act. In fact, for over 20 years, it did

Groves also issued a five-page epilogue imploring the government to change its laws and regulate access to address issues surrounding ownership and use of lakes and other Crown land. Failing to do so, he said, could lead to a wave of expensive litigation. “First off, look at the Trespass Act. Is that really

what you intend in today’s world?” Groves said. “Secondly, if you own the lakes of the province, which you do, can you not regulate access? There really is no point to ownership, otherwise.” As Groves stood up to leave the courtroom — packed with about 75 spectators — supporters of the fish and game club broke out in applause. Douglas Lake Cattle Company ranch manager Joe Gardner was not one of those celebrating. “I think I want to read it and think about it,” he said of Groves’ decision. “I’ve got no comment other than that.” Speaking to reporters outside court, Nicola Valley Fish and Game Club spokesman Rick McGowan called the decision “a win” for his organization, but not the end of the fight. “It’s good for future litigation,” he said, noting he has been involved in the battle for lake access for 30 years. Douglas Lake Cattle Company has not indicated whether it intends to appeal Groves’ decision.

Coldwater Indian Band Chief Lee Spahan has invited the prime minister to see the band’s concerns over the Trans Mountain pipeline expansion with his own two eyes. At a special Assembly of First Nations (AFN) meeting in Ottawa on Dec. 6, indigenous leaders gathered to express their concerns over the Trans Mountain pipeline consultation process. Speaking directly to Justin Trudeau, Spahan said he has outstanding issues regarding “Canada’s unremedied breach of fiduciary duty and ongoing trespass of the pipeline on the Coldwater reserve.” “I would like to extend the invitation to you, Mr. Prime Minister to come to Coldwater, in British Columbia, to meet with myself and our chiefs there. This is a very, very important issue,” he said. “When the Trans Mountain expansion pipeline was [approved] by your government it was going to go right through my water aquifer — right through the middle of it. That is unacceptable.” Trudeau did not

address Spahan’s invitation in his response, but the prime minister offered an apology. “I could explain and try to justify by saying we were starting from a standing start of a government that had not done any consultations adequately over 10 years, despite their desire to get things built,

but that is not good enough of a reason. I apologize for that, we didn’t do a good enough job, which is why we have asked [former Supreme Court justice Frank Iacobucci] to help us get it right as we move forward,” the prime minister said, adding that he does not expect unanimity on this project, or any others. “But it does mean that we put in place a process whereby concerns like yours can be heard, and addressed.”

The 12 takes of Christmas For a season that is supposed to be about peace on Earth and goodwill towards all mankind, Cole Wagner the holidays COLE’S NOTES do seem to have a tendency to spark impassioned debate and disagreements between otherwise reasonable people. Inspired by the recent controversy surrounding “Baby It’s Cold Outside,” I thought I would use this space to offer some more controversial opinions on the holidays, in case you run out of things to argue about around the dinner table this year. Baby, it might be cold outside, but these takes are as hot as the fire on the Yule Log channel. Strap in. 1. First, let’s address “Baby It’s Cold Outside.” The song was pulled from the playlists of a few FM stations in Canada this year, after the lyrics were called into question for being creepy and a tad predatory. Of course, a wave of backlash followed, and a whole lot of people who otherwise never cared about the song weighed in to say that political correctness was now ruining Christmas (again). The song is a product of its time, and the lyrics represent a bygone era of relations between a man and a woman — context is important here, and both sides of the debate have valid points. 2. But ultimately none of that matters because “Baby It’s Cold Outside” is just not a very good Christmas song. Your time is better spent listening to Springsteen’s classic rendition of “Santa Claus is Comin’ to Town,” or the undisputed greatest Christmas song of all time, “Do They Know It’s Christmas.” You’re welcome.

Game of Thrones in Saudia Arabia Now is the moment of maximum danger for Saudi Arabia’s de facto ruler, Crown Prince Muhammad bin Salman (MbS). He has weathered the immediate storm GWYNNE DYER over the murder of The international Jamal Khashoggi STAGE two months ago. He even went to the G20 summit in Buenos Aires a week ago and persuaded several other national leaders to stand beside him for photographs. But the real threat to his power (and maybe his life) is at home. It’s not the Saudi public he must fear. He’s quite popular with young Saudis, who are a large majority of the population. He’s relatively young himself (33). He has loosened some of the tight social and religious controls (women can drive now, and you can even go to see a movie). And most of them don’t even believe that he is responsible for the killing. MbS’s problem is his family, who know perfectly well that he ordered the murder of Saudi journalist Jamal Khashoggi in the Saudi con-

sulate in Istanbul, and understand what that crime means for the kingdom’s standing in the world. They also realize that his foreign policy has been an unmitigated disaster, from the futile war in Yemen to the blockade of Qatar, and that his economic policy hasn’t been much better. Many prominent Saudis also have personal reasons to hate him. Some were pushed roughly aside in order to facilitate his rapid rise to supreme power. Others were kidnapped, jailed and even tortured in order to extort billions of dollars from them, on the often shaky pretext that their money was the fruit of corruption. If you held a secret ballot among the ten thousand most influential Saudis, MbS would be gone in a flash. It doesn’t work like that, of course. This is still an absolute monarchy, and so long as MbS has the support of his elderly father, King Salman, he has absolute power — in theory. In practice, he must also have at least the grudging support of the royal family, which sees the Saudi state as a family business in which they all have a stake. It is a remarkable family, if only for its sheer size: an estimated 15,000 members, many of whom are direct descendants of the kingdom’s founder, King Abdul-Aziz Ibn Saud. When

he died in 1953 he left 36 sons, and there are literally hundreds of grandsons. All these men, their spouses and their children and grandchildren are supported (quite lavishly) by the family business, but there are only a few hundred people who really matter. They matter a great deal, however, and by now they would be close to unanimous in seeing Muhammad bin Salman as a wrecker who is endangering their own futures. So how to get rid of him? In the past, the family’s rule has survived the abrupt removal of kings: one king was forced to abdicate in 1964, another was assassinated by his own nephew in 1975. The princes closed ranks, and the dynasty carried on with a new king. In theory, it should be even easier when you are only trying to remove the crown prince. Why not just work through his father, King Salman? After all, the king has already appointed and then dismissed two other crown princes; maybe he could be persuaded to do it again. The problem with this approach is that MbS zealously controls access to the 82-yearold king, who is believed to be suffering from mild dementia (Alzheimer’s).

A year ago, I would have said yes, but a spectacularly prepared turkey dinner has since shifted my opinion. Done right, the gobble is king. 4. Turkey has a number of advantages over ham, not the least of which is the fact that gravy goes better with the bird. The ruling will allow the common person to once more enjoy an inherit right we all have as citizens of this country. The bully has been put in his place. It is hard to fathom the time, effort, financial cost and the emotional roller coaster ride that Rick McGowan and the fish and game club have endured for the past 30 years. The stage is set for Merritt’s very own drama club to make a grand debut this holiday season, with the group’s inaugural performance on Dec. 19. Comprised of current high school students, recent grads and a couple seasoned adult performers, the Merritt Drama Club will present The Rented Christmas in Merritt on Dec. 19 at the Crossroads Community Church. The group came together in September with the intention of putting on a holiday play, said Cecilia Dyck, one of the founding members of the club. “There are a couple kids that I knew had graduated, and who were still here in Merritt and most of their friends weren’t,” said Dyck. “I thought they needed something to hang out and do together.” While theatre experience varies among the performers, Dyck said the club features a diverse array of talents. “I’m really happy with the group, because everyone who is there

came because they are attracted to theatre,” she said. “We’re not that experienced but we are having a lot of fun.” The Rented Christmas tells the story of John Dale, a middle aged man who hasn’t enjoyed a ‘real’ Christmas in years. He decides to rent a Christmas from a local rental shop, along with a host of actors to serve as his family.

The play was selected to fit both the make up of the club, and the holiday season, said Dyck. While the club has yet to decide what play they will tackle next, Dyck said the members of the club are eager to get started on another project. “One of the kids said to me, ‘I’m going to be in the next one too,’” said Dyck. “So if

we have interest, I think we would definitely continue.” The club’s first performance is set for 7 p.m. at the Crossroads Community Church on Dec. 19, but the club will put on an encore performance on Dec. 23 at Merritt Secondary School. It won’t be enough to put shovels in the ground, but a $250,000 grant helped the Nicola Valley Community Theatre Society (NVCTS) move one step closer to constructing a performing arts venue in Merritt. The group received $250,000 through B.C.’s community gaming grants program, announced a press release from the ministry of municipal affairs and housing on Nov. 26.

The funds “are to be put towards construction and equipment on the lot near the Railyard Mall,” said NVCTS director Rich Hodson, adding that the society has amassed about $1.5 million worth of funding for the project. The current vision for the performing arts complex at the corner of Garcia Street and Coutlee Avenue includes two “screening theatres” and a larger “flex theatre,” said Hodson. The flex theatre would be equipped with a 24 foot stage,

which could accommodate musicians, and stage productions, he said. The final price tag to construct the facility is approximately $3.9 million, Hodson said, and no construction is planned until the total amount is raised. The society is waiting to hear back on a number of federal grant applications which could close the current $2.4 million gap in funding. “We’re not going to borrow money to build, we’re going to have money in our accounts before we build,” said Hodson.

Ministry buying land to build connecting road Plan to replace Marshall Bridge abandoned by the transport ministry. Cole Wagner THE MERRITT HERALD

A new access road planned for Lower Nicola would provide residents along Marshall Road with a link to the community, after a surging Guichon Creek destroyed the bridge linking the road to Highway 8 in 2017. But not all of the residents in the area are excited about the project. The 450 metre access road will link the dead-end of Marshall Road with Highway 8, approximately 600 metres west

of Ten Mile Bridge. It would provide residents on one section of Marshall Road with a route to the highway which doesn’t involve making a trip over an old railway bridge — which has been the case since the original Marshall Bridge was washed out. “Since the destruction of the Marshall Bridge, the ministry has been working on a plan to replace the old structure with a new bridge,” stated the ministry of transportation and infrastructure in an email to the Herald. “However, due to the flooding in April

2018, engineers have determined the reconstruction of the bridge is not feasible, so the ministry is designing a new route to access the west side of Guichon Creek from Highway 8.” In order to construct the new two lane road, the government will have to acquire sections of private land from three different owners. Which means where there was once pasture in Ellen Miller’s backyard, there may soon be traffic. “Unfortunately, we have no choice. There is nobody that overpowers the ministry of transport. Lawyers have told us we cannot do a damn thing about it,” said Miller, whose property off Highway 8 is one of the three affected by the new access road. Despite the determination from transportation ministry engineers that a new bridge would not be feasible,

Drink, Drug & Drive Don’t Drink Drug & Drive Too many people are arrested every holiday season after failing breathalyzer tests at police roadside checkpoints. Driving while intoxicated puts your own life in danger, but the worst thing is that it endangers the lives of other road users as well. Make sure that this festive time of year doesn’t end in tragedy for you or anyone else. Christmas time often means one party after another with drinks galore. When you accept an invitation, plan ahead of time how you’re going to get home. Members of the same family or group of friends can designate a driver, arrange to share a taxi at the end of the evening, or use a free or forhire drive home service. Even if your alcohol consumption is moderate you still ought to check that you’re still capable of driving safely. Use a personal breath alcohol tester to find out if you’re over the legal limit; they are on sale at most provincial liquor and wine stores. It might be hard to remember this when under the influence, but a person’s behaviour and faculties are altered by alcohol. When blood alcohol content is over 0.5 g/l, a driver’s field of vision shrinks, distance perception changes, visual reaction times increase, there is more sensitivity to glare, and vigilance and resistance to fatigue are reduced. Perhaps the ultimate danger is that alcohol consumption results in a loss of inhibition, which causes drivers to under-evaluate dangers and break traffic laws.

The choice you make will determine which room you end up in tonight. Driving under the influence will cost you — so think about it before you do it! There are two types of designated drivers: this one, or this one. The choice is yours. Don’t drive under the influence, period!

Immigrant service returns to Merritt

Two indigenous women in Merritt are set to receive resources to turn their business ideas into reality. Teck Highland Valley Copper Mine Operations (HVC) has partnered with the Merritt Small Business Centre, the Indigenous

Women’s Business Network and Community Futures Nicola Valley to spearhead the Indigenous Women’s Business Incubator pilot project. The program will offer a customized business support plan for two women to help their businesses thrive, including a year of free office space at the Merritt Small Business Centre as well as business coaching, mentorship and marketing support. Jacqueline Schneider, HVC’s senior community affairs officer, told the Herald the idea was inspired by similar incubators across Canada.

“And then having those conversations and engaging with local agencies and coming up with ideas on how we can promote economic development within the Nicola Valley,” she said. “The program does align with our commitment to build really vibrant communities and of course engaging with our indigenous communities and initiatives that will create a benefit.” Applications for the program are now open and will be accepted until Dec. 10. Canada’s newcomers who land in the Nicola Valley now have access to immigrant resources right here in town. Kamloops Immigrant Services is once again offering in-person support in Merritt thanks to some additional funding from the provincial government. In an effort to make integrating into the community as seamless as possible, the organization is offering a variety of services including assistance with housing, health, legal and school systems, culture shock and government programs such as the Medical Services Plan and income assistance. The organization has arranged to use private rooms in the public library to meet with clients, free of charge, said settlement and integration counsellor Liza Ferris Ortiz. “We know that there are a number of immigrants that need services — they lose their documents, they want to become Canadian citizens, to learn about employment

standards. They have all kinds of questions to help them set out into the community,” she said, noting they serve naturalized Canadian citizens and first generation Canadians as well. “They are shy, there is a language barrier, there is a cultural barrier so we are able to guide them through what living in Canada, and living in Merritt, looks like.” Kamloops Immigrant Services used to operate in Merritt, Ferris said, but a lack of funding caused the program to halt. While the organization continued to offer services to clients outside of Kamloops via telephone, Ferris said she is hopeful they can continue to offer the benefits of face-to-face support. “If we are successful in reaching the newcomer population then we will be able to have this on a permanent basis like it used to be where we have a staff member driving to Merritt every week,” she said, adding the pilot project expires in June of 2019. It takes new arrivals approximately two years to settle into a new country, Ferris said,

and supporting them through that process is beneficial for everyone. “It is important for people to have a sense of belonging — it is a basic human need,” she said. “That sense of belonging, loving your community, finding work and knowing how everything works, not to be shy to talk to other people and establish roots — it helps the community because everyone has something to give.”

The Cents faithful didn’t have to wait long to toss their teddies on the ice during Saturday’s tilt against the Nanaimo Clippers. Christian Sabin banged in his ninth of the season, seven minutes into the first period, kicking off a cascade of cuddles at the Nicola

Valley Memorial Arena. Over 350 bears were tossed on the ice, which were then donated to the Nicola Valley and District Food Bank’s Christmas hamper program. The bears will be given as gifts to children and seniors this holiday season. With goal number one out of the way, the Cents focused on the second task of the eve-

ning — earning another two points to keep them in the race for top spot in the BCHL’s Interior division. The result was never in doubt, as captain Nick Wicks tallied a goal to go along with his two assists, while Matthew Kopperud, Brad Cocca and Joey Berkopec also added singles en route to a 5-1 Cents win.

WINNER WINNER TURKEY DINNER There was more than just glory at stake at the annual Turkey Spiel, hosted by the Merritt Curling Club. Fixings for a proper holiday feast were up for grabs, with turkeys, eggs and chicken prizes graciously donated by Save On Foods. Sixteen teams took part in the bonspiel, with four frozen birds handed out as grand prizes. Winners were (above right, left to right) Jodi Latremouille, Lorna Latremouille, Vern Latremouille and Jason Nyeste. Meanwhile, Kenneth Seaman, John Noel, Anthony Ogg and Lee Woods walked away with chicken prizes. Egg cartons went to Alan Paulson, Meg Paulson, Nancy Ellingson, Paul Montgomery, Sue Newton, Clara Irwin, Vic Newton and Bill Stowell. It is with sadness we announce the peaceful passing of Dorothy Dueck (nee Slager). She was born June 2, 1939 in Saskatchewan and passed away on December 9, 2018 at Gillis house in Merritt. Dorothy moved to Maple Ridge at a young age and spent most of her life there and she never stopped calling Maple Ridge home. Met Mino Kuiper in 1955, married in 1957 until Mino passed in 2017. Survived by sons John, Rob and Dan Kuiper, brothers John, Peter (Marja) and Gus, plus grandchildren and great-grandchildren. Will be fondly remembered by many friends, relatives and business associates. Enormous appreciation to the staff of Baillie House for a year of such kind and competent care. Memorial service will take place after New Year and will be announced in this column.
