A wave of relief washed over Nicola Valley Fish and Game Club’s director in a Kamloops court room on July 5. In what McGowan deemed a “precedent setting” case, Justice Joel Groves ruled that the B.C. government and the Douglas Lake Cattle Company will pay the local fish and game club’s legal fees, incurred during a court battle over public access to Nicola Valley lakes. “It’s an unusual order to make but the courts found the club has been acting in the public’s interest,” said Chris Harvey, lawyer for the fishing club. Legal costs for the club exceed $350,000, and are to be split 50/50 between the province and the cattle company. Not having to worry about funding comes as a relief to the club, said Harvey. “They would have needed to rely on fundraising and everything else,” he said. According to McGowan, the province had initially been seeking a 25/75 per cent court costs split. Groves said he ordered the costs be split evenly with the government because, as was shown in court, the province chose not to respond to the illegal actions of Douglas Lake, leading to the litigation.
McGowan said he is not sure how much money the club will be reimbursed, noting it has spent about $160,000 — accumulated through donations and fundraisers — but still owes about $150,000 in legal bills. The club’s counsel has provided the club with a 50 per cent discount, but, McGowan said, there are various ongoing legal costs. “If we can pay off our legal bills, that’d be awesome,” McGowan said, noting the hearing on July 5 cost $1,000. He said he expects the court case to cost all three parties involved — the club, cattle company and province — about $1.5 million. According to Groves, the fish and game club met the criteria required for the order as it was acting in the public interest and had no monetary benefit to gain from the case. “They acted to right what they felt was a longstanding wrong against everyone in British Columbia,” Groves said. In December, Justice Groves ruled all lakes are public property and prohibiting private landowners from restricting access to them. The decision was the culmination of a protracted trial spanning six years, pitting a wealthy private ranch — the Douglas Lake Cattle Company, owned by U.S. billionaire Stan Kroenke (husband of a Walmart

lakes now but the details of it will need to be worked out later.” The ultimate goal for the club, McGowan said, is to ensure all lakes in B.C. remain public. “We’re hoping that the B.C. government is going to take note and not allow the privatization of public lakes in the future,” McGowan said, adding that he hopes the government will take that stance if the club is successful with its next lake access case. The club is suing Corbett Lake Lodge, Douglas Lake Cattle Company and the province of British Columbia for allegedly blocking public access to Corbett Lake. McGowan said no court date has been set yet in that case and the club is in the process of requesting documents from the provincial government.

The Community Policing Office (CPO) courtyard has an extra splash of colour thanks to some of Merritt’s up and coming artists. Organizers of this year’s School District 58 Arts Festival decided
to work with elementary school students to create a collaborative art installation, highlighting the uniqueness of the community. Arts festival organizers brought river rocks to most of Merritt’s elementary school classes for the young students to decorate.
To inspire individuality and expression, leaders also read a children’s book called ‘Only One You’ to the students. “It’s all about being different and unique, it’s pretty neat,” said arts festival organizer Shannon Dunn. Merrittonians can now check out the end

Coast comes to Merritt In 1970, Joni Mitchell reminded us that we “don’t know what we’ve got ‘till it’s gone.” Cole Wagner You COLE’S NOTES probably won’t hear much Joni Mitchell this weekend at the 11th edition of Bass Coast, the electronic music and arts festival set to take over the Coldwater Fields from July 12 to 14. But her song should ring true to the residents of Merritt — many of whom might not grasp how the festival has grown into a world-renowned event, widely regarded among those in the industry as one of the premiere electronic festivals of its kind. And it all takes place right here in our own backyard. Co-founded in 2011 by Andrea Graham and Liz Thompson, the three day event has flourished since moving to the Nicola Valley in 2013. For three days, the festival grounds are transformed into a phantasmagoric display of interactive art and intricate stages. Attendees who come for the music are also able to take in workshops, practice yoga, and party safely thanks to the festival’s emphasis on promoting harm reduction. A well-run festival which attracts good press from national publications already serves as a boon for the City of Merritt. Factor in increased business for local stores as thousands flock to town on Thursday and Friday, and the case for keeping this event here for another decade only gets stronger. Not to mention the fact that the organizers have invested thousands into improving trails around Merritt. To the festival attendees who happen to pick up a copy of the Herald, welcome to the Nicola Valley. Enjoy the festival and everything our town has to offer.

The real refugee crisis is still looming Every once in a while a photograph of a migrant’s tragic death (usually that of a child) catches the public’s imagination. The image of three-year-old Alan GWYNNE DYER Kurdi, fleeing from The international the Syrian civil war, STAGE dead face down in the surf on a Turkish beach in 2015, triggered a wave of sympathy that ended with Germany opening its borders to 900,000 refugees that year — and Hungary building a border fence to keep them out. Here we go again. A picture of 23-month-old Valeria Martinez, tucked into her father Oscar’s T-shirt, both dead face down on the banks of the Rio Grande, has unleashed a similar wave of sympathy in the United States, although it certainly hasn’t reached the White House. And once again most of the migrants are claiming to be refugees. In fact, few of the migrants fit the legal definition of refugees in either case. The

That is the language of the United Nations Convention Relating to the Status of Refugees of 1951, so they don’t qualify as refugees. You may feel sorry for them, but there is no legal duty to let them in. The Refugee Convention was incorporated into US law in the Refugee Act of 1980, so few of the people now seeking entry at the Mexican border qualify either. This matters, because while twenty years ago 98 per cent of the people crossing the border were Mexican young men seeking work, more than half are now entire families from El Salvador, Guatemala and Honduras — and most of them claim to be refugees. They are not, and that (not Donald Trump) is why U.S. courts are rejecting at least three-quarters of the applications for refugee status. You may wish that the law took a more generous and humanitarian view, but it does not. And if you think things are bad now, they will be ten times worse in twenty years’ time.

Logan Lake celebrates small but mighty class

Editor, The Logan Lake grad class of 2019 had only seven students but, what they lacked in numbers, they more than made up for with their collective energizing spirits and smiles! And this year was especially noteworthy marking the 35th commencement ceremony since the first grads crossed the stage in 1984. A truly special part of this event is the Governor General’s Award, which is a Canada-wide tradition, awarded to a grad student from the previous year who achieved the highest academic standing in their school. School counsellor Morgan Whitehouse gave this prestigious award to Samantha Bauer Jayne Latta, vice principal for Logan Lake Secondary School, recognized a relatively new tradition at the school with 2019 being the 10th time in school history in which graduating students have had a parent or step-parent who also graduated from LLSS. Latta went on the say, “graduating second generations is an amazing moment for our school and this tradition will continue again next year.
We now have a running total of 35 parents or step parents who have graduated from the same school as their children”. The two grads who kept a steady path on and off the stage to receive awards amounting to more than $18,000 were Hannah Munro and Nakayla Van Tongeren. Joining them was Michael Humphrey who earned the District Authority Award in the amount of $1250.00 given to the top trades graduate in technical and trades training. And then came the REAL highlight of the evening as the grads crossed the stage to receive their certificates from Mr. Collins followed by handshakes and well wishes from stage guests. When they returned to their places at the front of the room, it was time — as is tradition in Logan Lake — to present their parents with tokens of appreciation for their support and encouragement. Following this period of smiles, laughter and tears, it was time for Jaydan Dick and Hannah Munro, who both been selected share the duties of class valedictorian.
Together, they offered up memories both of spending their entire school lives together in the same schools as well as their shared hopes for the future. This was followed by yet another school tradition which, for the past several grad ceremonies, was offered by Jaydan Dick who, as a grad himself this year, turned the creative “reins” over to Grade 11s. Samantha Holmstrup did an excellent job prepping and presenting a slide show highlighting photos of students from childhood to today which, as always, consistently created both tears and laughter! In his address to the grads, Ron Collins, LLSS principal, reminded the grads to remember the small factors that make “our school a great place surrounded and supported by a great community. If you venture away from Logan Lake, remember that wherever you live there will be schools and organizations that need your assistance, so I encourage each of you to give back whenever you can.” Barrie Ogden Logan Lake
Global heating is starting to bite. We’re still on the learner slopes, but the droughts and the floods, and the crop failures they cause, are multiplying, especially in the tropics and the sub-tropics where temperatures are already high. In the worst-hit areas (which include the ‘northern triangle’ of Central America) family farms are failing, some people are going hungry, and the number of people on the move is starting to soar. This is precisely what unpublished, in-house government studies were predicting twenty years ago in countries like the United States and the United Kingdom. Now it’s here. As the number of migrants goes up, the willingness of host populations to receive them will inevitably go down. Five per cent new population in a decade will feel disruptive to some people, especially if there are big cultural differences between the old population and the immigrants, but most people will accept and adapt to it. Ten per cent in a decade is definitely pushing it, even though it’s only 1 per cent a year. And 20 per cent new population in
a decade would generate a huge political backlash in almost any country on Earth. That’s human nature. You may deplore it, but it’s not going to change. And behind uncomfortable considerations of what the politics will permit lies the even starker reality that they can’t all come. Twenty years from now there will be far more people who desperately want to move than the destination countries could possibly accommodate. So the borders will start slamming shut in the countries, mostly in the temperate zone of the planet, where the climate is still tolerable and there is still enough food to eat. And don’t believe the myth that you cannot really shut a border. You can do so quite easily if you are willing to kill the people who try to cross it illegally, and the governments of the destination countries will probably end up doing just that. Their military and their civil servants, if not their politicians, were already having grim internal debates about it fifteen years ago. Sorry to spoil your day. Burrowing owl enthusiasts in the Nicola Valley are one step closer to their goal of seeing the species thrive without any help from humans. Until then, the Burrowing Owl Conservation Society of B.C. plans to continue working with the Upper Nicola Indian Band (UNB) to repopulate the endangered birds through the burrowing owl species-at-risk reintroduction program. The groups welcomed the public to the UNB reserve at Douglas Lake on July 4 to celebrate the hatching of the next generation of burrowing owls. This year marks the fourth year of reintroducing captive-raised burrowing owls at the UNB reserve at Douglas Lake. Program leader Dawn Brodie said organizers see more and more success each year. Nicola Valley-born owls have been spotted all along the west coast — in Washington, Oregon, California, and even the NASA research centre in California, said
Brodie. “My hope, my dream, is that they grow up here, migrate in October down south, and they’ll return in the spring. And when we come up [to the reserve] in the spring we’re looking for burrowing owls,” she said. A total of 29 captive bred owls have been released at the site since 2016, and the owls have produced 53 wild-born young. “This year alone we have 21 young in these burrows with three pairs of [adult] owls,” said Chris Gill, the project’s lead biologist. “So it’s a highly productive sight, and there’s a reason for that — it’s intact grasslands.” Finding a prime ecosystem for these birds is no easy feat in today’s world, Gill explained, noting the challenges posed by habitat loss, pesticide use and decline of species such as badgers. Unlike most birds of prey, burrowing owls spend a great deal of time on or near the ground and make their homes in underground burrows abandoned by badgers or marmots.

“And that’s the main reason why this site does so well. The grassland habitats within British Columbia are disappearing,” said Gill, noting development is a key threat. Partnering with the band has been crucial to the program’s success because a lot of other reintroduction programs happen on private land, and when ownership changes hands the programs may be stalled or dismissed, Gill added. Burrowing owls were historically present on the band’s reserves — up until the 1990s according to elders and community members — but populations in the Nicola Valley and across
Canada have declined dramatically. UNB implemented the burrowing owl reintroduction program in partnership with the Burrowing Owl Conservation Society of B.C. in 2014 to increase population numbers in the Thompson-Nicola region. “In 2018 this site alone accounted for nine per cent of all the wild born young in British Columbia, so it makes it one of the top sites in British Columbia for burrowing owls,” said Gill.

BC Emergency Health Services (BCEHS) received a call for a two-vehicle collision on the Coquihalla Highway near Larson Hill by Coldwater Road just after 4 p.m. Paramedics were on scene within 20 minutes. BCEHS confirmed two people were airlifted to hospital in serious condition, and another two were transported by ground ambulance in stable condition. DriveBC warned travellers to expect hour-long delays in both directions between approximately 5:30 and 8:30 p.m. as a result of the incident. The crash continues to be investigated.

It has been more than 30 years since Thom Douglas started driving kids to and from school in the Nicola Valley, but he still comes to work with a smile on his face every day. His joyful demeanor is just one of reasons why he’s been named B.C.’s driver of the year by the Association of School Transportation Services of BC (ASTSBC), said School District 58 maintenance clerk Melissa Robinson. “He’s more than a bus driver, he is an individual who has earned the respect from the parents who trust his skills to transport their kids to and from school

A Quilchena cowboy took the top spot during the second day of competition at the Calgary Stampede. Fourteen-year-old Wyatt Smith earned the title of junior steer riding champion after a 70.50 run at the world’s largest outdoor rodeo on July 6. Smith qualified for the finals in second out
of a field of 18 junior cowboys. His run in the finals edged out Riley Harms of Cochrane, Alta. by a mere three points. Harms sat in first after the qualifying round earlier that day. “[Wyatt] rode there last year and didn’t do too well,” said Ryan Smith, Wyatt’s dad. “This year, it turned out for the better.” Smith has his sights set on even more tro-

phies this season, as he continues to pursue the number one ranking in the B.C. Rodeo Association standings among junior steer riders. Smith currently sits in third place behind two Quesnel cowboys, with a large gap between the three leaders and the rest of the field. “He’s booked until Labour Day,” said Ryan.

Athletes top the podium at Jack Brow Memorial track meet Cents add depth ahead of exhibition games

Two Merritt athletes at opposite ends of the age spectrum landed on top of the podium at a recent track meet in Kelowna. Ryland Sheldon, 12, went three for three in his events at the Jack Brow meet, collecting a bronze and two golds. His performance in long jump was a personal best at 4.53 metres, enough to take top spot in his age category. Sheldon’s jumping prowess continued in the high jump, where his leap of 1.30 metres propelled him to his second gold medal of the meet. In the 100 metre dash, Sheldon’s time of 14.16 marked his second personal best of the meet, enough to earn a bronze medal. Competing in the 40-44 age bracket, Buzz Manuel put in a record setting performance in the 100 metre dash.

His time of 15.65 earned him a gold medal, and lowered the official meet record time by .35 seconds. Manuel also collected another gold for his performance in the 200 metre dash, finishing with a time of 32.52.
Fans of the Merritt Centennials won’t have to wait long to see the team’s newest additions make their on ice debut. The Cents announced the acquisition of Olson Werenka and Tanner Mortenson on July 6. Werenka, a defenceman, played with the Salmon Arm Silverbacks last season, where he had six goals and 14 assists in 50 games. Mortenson, 18, will make his BCHL debut with the Centennials after playing for the Notre Dame Hounds of the Saskatchewan Junior Hockey League last year. The pair could factor into the Centennials line-up as the team suits up for their first exhibition game of the season against the Penticton Vees on Aug. 23. The Cents will return home the next night for a
rematch with the Vees at the Nicola Valley Memorial Arena. Centennials head coach Barry Wolff said the new players will help add some grit to the team. “Olson brings a 200 foot game, he has a high end compete, is hard to play against, and doesn’t mind playing a more tough and rugged game,” said Wolff in a news release. “Tanner is a high end character kid, he plays hard, and finishes every hit.” The Cents will round out their exhibition schedule with a pair of games against the defending BCHL champions. The Cents will travel to Prince George to face the Spruce Kings on Aug. 27, before returning for a home game on Aug. 30.

Anne Roberts July 28, 1942 - May 23, 2019
It is with great sadness that we announce the passing of Anne Sherrin Roberts on May 23, 2019. Anne was born in Vancouver, BC on -XO\ WKH Ă€UVW ERUQ to Ronald and Betty (nee Rumley) Paterson. She was the eldest of six siblings, Judith, Bonnie, Barbara, Joanne (Tom) and Ronald. She was predeceased by her parents, sister Bonnie and husband John Robert’s. Along with her siblings and best friend Regina Allen, Anne will be greatly missed by her daughters Charmaine Provost (Larry Lacasse) and Lisa Tesan (Rick). Anne had four Grandchildren Brandon, Dustin, Brittany and &DWHO\QQ DQG Ă€YH JUHDW *UDQGFKLOGUHQ *DEULHOOD Abigail, Arianne, Calliope and Carter. Anne was an “Army bratâ€? and lived in almost HYHU\ 3URYLQFH LQ &DQDGD $QQH Ă€QDOO\ VHWWOHG LQ Merritt and lived out the rest of her life in Lower Nicola enjoying her hobbies, photography, painting and her greatest joy gardening. Anne worked as a Sales Clerk for the Outdoorsman Sport Shop in Merritt, followed by working at the Coquihala toll booth where she also was the Union Representative. Suako (Sue) Kightley March 25,1933 - June 28, 2019
Suako (Sue) Kightley courageously passed away on June 28th at the age of 86. Sue was predeceased by her husband, Bob and stepson, Steve. Sue and Bob brought up 7 children Greg, Steve, Melody, Don, Kelly, Jim, and Karla and 3 grandchildren Devon, Codie, and Michael. Sue leaves behind other Grandchildren Jesse, Jennifer, Dustin, Daryl, Derek, Dallas, Brendan and Owen ; as well as Great-Grandchildren Cheyenne, Madison, Zach, Airlie, Milo, Ashlyn, Brayden, Blake and Scarlett. Sue was a wonderful baker who will be remembered for her delicious shortbread and her special ham buns. For herself, she loved to feast on kimchi, tuna sushi, and rice. She will be missed. Sue was born in Fanny Bay on Vancouver Island. Her family had to resettle in the Japanese Internment camp in New Denver when she was 8 years old. In later years she moved to Merritt. Grandma loved the Nicola Valley and her friendships, especially her newest family at The Florentine. Her table mates Olga, Dorothy, & Fay made meal times most enjoyable. Thank you Sai, Suzy, and Peggy for being there for her. A big thank you to the doctors, nurses, and staff at Nicola Valley Hospital. We were all grateful for your kindness and compassion. There will be no service at her request. Financial or blood donations in her memory may be made to Canadian Blood Services.
You left us beautiful memories, Your love is still our guide, and though we cannot see you you’re always at our side.
