Two First Nations bands in the Nicola Valley won a significant battle in their efforts to prevent the Trans Mountain expansion project from coming through their territory. A unanimous decision from the Federal Court of Appeal overturned the federal government’s approval of the pipeline project. The panel of three judges deemed that the National Energy Board’s review was too flawed to be relied upon in the approval process. The court ruling, written by Justice Eleanor Dawson, stated that the NEB review “unjustifiably” did not include the potential impacts of tanker traffic off the coast of B.C. The judges also noted that the federal government approved the project without adequately consulting

Merritt’s city council is set on holding the owners of ‘nuisance properties’ in town accountable. The good neighbour bylaw, complete with cost-recovery program to recoup expenses by RCMP and fire rescue, was given third reading at the regular city council meeting on Aug. 28. The bylaw, which was recommended to council by the city’s police committee earlier this year, will allow the city to fine landlords of ‘nuisance properties’ that are the subject of repeated police, ambulance and firefighter calls. The additional revenue for the city could offset the cost of responding to complaints and discourage homeowners from neglecting properties. Sean Smith, the city’s director of corporate services, explained the bylaw deems a property a nuisance if RCMP or other emergency services are called to it more than once in a 24-hour period or more than three times in one year. He said there can still be discretion as to whether a call is a ‘nuisance’ or not, however. “Maybe [RCMP get] a call saying that [a property owner’s] weeds have gotten twelve inches long. Are we going to count that one as a nuisance call against this particular home?

Whereas if it’s something truly atrocious or there’s drug activity or something like that happening it might be a little clearer that’s going to be strike against,” he said. City staff will be meeting with RCMP and Merritt Fire Rescue in the coming weeks to develop a procedure for implementing the bylaw, Smith explained. “We will have discussions and try to formalize what is going to be considered a ‘nuisance call’ and what isn’t because we want it to be relatively standardized,” he said. “The designation itself will be made by the city, but there needs to be some form of information sharing, of course, so that we know what calls the RCMP have responded

to.” The dollar amount of the fine will vary depending on the resources used to respond to the call — including staff and vehicles — plus an administrative fee of 15 per cent. On the lower end of the scale, a single bylaw response to the call may result in a charge of around $100, Smith estimated. However, the charge could climb to over $1000 if a bigger response, such as several fire engines, were to be required. “And that would be invoiced to [the homeowner],” he said. “If the invoice isn’t paid it would go on to property taxes.” Coun. Linda Brown expressed concerns that there will no opportunity

for public input before the bylaw is passed. “I’d like to see us take a little bit of time with this,” she said. On the other hand, Mayor Neil Menard said he was eager to have it implemented. “I don’t think that we’re rushing,” he said. “I think it’s our responsibility to keep moving — keep doing stuff — and I think we should move forward with this bylaw and carry on.” The motion was carried by a vote of five to one at the meeting. Coun. Brown was the only one to vote in opposition, and Coun. Goetz was not in attendance. Council will choose whether or not to adopt the bylaw at the regular city council meeting on Sept. 18.

While the majority of councillors are in favour of moving forward with the bylaw, there are still plenty of questions that should be answered before we start handing out tickets. For starters, city officials, the RCMP and local fire department will have to put their heads together to decide what exactly constitutes a nuisance property. Such a guiding document should be public knowledge ahead of the passage of the bylaw, so that landlords and tenants alike know which activities might land them in hot water. Beyond that, it would be prudent to keep an eye on how such a ‘good neighbour’ bylaw will affect the rental market, particularly when it comes to vulnerable members of the community. As the fines for any violations would be directed towards land owners, it would not be surprising to see the already-restricted rental market in Merritt become even more draconian. Will landlords ask for even more personal information and background checks before renting out their suites? Bylaws like the one being considered by the City of Merritt are already in force elsewhere in the province — so the answers are out there. It’s just a matter of asking the right questions.

When reforms come back around On Sunday, Brazil’s top electoral court ruled that ‘Lula’, former president Luiz Inácio da Silva, cannot run in the presidential election this October. He served two GWYNNE DYER terms as president The international (2003-2011), he STAGE dutifully waited out the following two terms, and his Workers’ Party (PT) has nominated him for the presidency again. Opinion polls give him 39 per cent support, more than twice as much as any other candidate. However, Lula is in jail in the southern city of Curitiba, serving a twelve-year sentence for corruption. The bad news is that he is probably guilty — perhaps not of the specific offence he has already been convicted for, but of four other charges of money laundering, influence peddling and obstruction of justice that are still pending. Lula’s current conviction rests on little more than the word of an executive of a giant construction company who claims he

gave Lula a penthouse apartment in a seaside resort town in return for a lucrative contract with the state-owned oil company Petrobras. The executive was facing corruption charges himself, and made the accusation as part of a plea bargain. There are no documents linking Lula or his late wife to the house, nor is there any evidence that they ever spent any time there. This case went to trial first only because it suggested that Lula had sold out for personal advantage. He probably didn’t. But there is plenty of evidence that Lula engaged in other kinds of dodgy fund-raising, not to benefit himself, but to buy the cooperation of other parties in Brazil’s Congress, where there was a plethora of small parties and his PT never had a majority. This was illegal, but it was perfectly normal political practice when he became president in 2003. So Lula appointed PT members to senior executive roles in Petrobras and other stateowned companies. They demanded kickbacks from companies that sought contracts with Petrobras and the others, and handed the money over to the PT — which handed much of it on to smaller parties in Congress in return for their votes. That’s how Lula pushed through radical

measures like the ‘bolsa familial,’ a regular payment to poor Brazilians (provided that their children had an 85 per cent attendance record at school and had received all their vaccinations) that lifted 35 million people out of poverty. Brazil’s economy boomed, and when he left office in 2011 with an 83 per cent approval rating, Brazilians were both richer and more equal than ever before. His chosen successor Dilma Rousseff won the election, but then world commodity prices collapsed, the Brazilian economy tanked, and unemployment soared. She squeaked back into office in the 2015 election, but was impeached in 2016 for misrepresenting the scale of the deficit. It was a trivial offence, but she was so unpopular by then that nobody much missed her. Her vice-president, Michel Temer, a deeply corrupt politician from another political party, has served out the rest of her term, but he will surely be arrested too if he loses the protection of holding a high political office. In fact, half the current members of Congress would be arrested if they lost their seats.

Road to Hell is paved with good intentions

Editor, I regularly walk my dog between the hours of 12 a.m. and 3 a.m. and just wanted to mention some observations over the course of the past year. (And in case people wonder why I am out, it is much cooler on a dogs paws — not to mention for me — during these hours and there are very few other dogs or people for the most part). 1. Drunk kids wandering around. I have seen them as young as preteen. Why are little kids out at these hours? I couldn’t imagine letting my preteen stay up past 9, let alone wander around the streets after midnight. 2. Merritt already has very high taxes. I can see why. From the graffiti to the knocked down signs and broken glass covering the sidewalks where young kids and dogs walk. 3. Suspicious bike riders in dark clothes and bags of stuff hanging off them. I see maybe three different guys in hoodies frequently at these

MLA Jackie Tegart’s claim in her recent “View from the Legislature” that the coming referendum on proportional representation (PR) is rigged simply does not hold water. In it she trots out most of the lame criticisms she and her Liberal colleagues continue to repeat. The rules of the referendum are clear and fair. It will be a simple two question document. The first question asks voters to state a preference for the present system or PR. The second will ask which of three PR systems the voter supports. No smoke and mirrors, no bias just two straightforward questions. The issue will be decided by a simple majority. The previous referendums are used in Tegart’s argument against PR. In the 2005 referendum PR was preferred by 58 per cent of voters. The Liberal government of the day declared the proposal a failure. That same year the Liberals won a majority government with only a 46 per cent minority in voter support. Every year after that election until last year’s loss they have won a majority in the house with minority popular support. No wonder the Liberals are opposed to PR! Looking back over the elections prior to 2017 only one of 20 were majority governments supported by most of the voters. In the 19 other elections, the voices of most voters were not heard. This is tyranny of the minority and it must be changed. The last arrow in the anti-PR quiver is the claim that because most voters live in the Lower Mainland, there is a built-in bias against rural voters. Damn those “coasties” anyway. One basic principle of democracy which has not been challenged is that one person gets one vote. I would hope that Ms. Tegart is not proposing discounting the value of Lower Mainland votes in order correct balance this perceived bias. The change to PR is long overdue. Only by making every vote count can we arrive at a government that reflects the wishes of all voters.

If you live on Voght Street, congratulations — you have somewhat frequent police patrols. I have rarely seen them on other streets. 5. School sprinklers. These are on every single night even on rainy days. Everyone else gets restrictions on watering. There is absolutely no reason to water your fields every night. Three to four times a week is more than enough to keep your fields green. I see other peoples grass is still fine with little watering. 6. Do not place your garbage out before 5 a.m. of your collection day. Every Friday I see numerous garbage cans already at the curb. Five a.m. to 7 a.m. is a pretty narrow window and it sucks, but that is what the city requests. It must be convenient to only follow the rules you want to, or maybe I am in the wrong and I should start putting my garbage out whenever I feel like it too. I usually mind my own business when it comes to what other people are doing but sometimes the little things start to eat at you after awhile.

The reason for that is a political cleansing operation called Lava Jato (Car Wash). The past eight years have been miserable for Brazilians both economically and politically, but Operation Car Wash has offered real hope for the future. It’s a huge police and judicial operation, run out of the city of Curitiba, (called the ‘London of Brazil’ because it is seen as incorruptible), which targets both corrupt politicians and the businessmen who buy them up. The irony, for Lula, is that Car Wash owes its success to two key reforms of Dilma Rousseff ’s government. One was to make evidence obtained through plea bargaining acceptable in the courts. The other was to appoint a truly independent attorney-general and independent judges and prosecutors — who duly sent Lula to jail even though they may share his politics.

“She always underestimated Car Wash,” said Delcidio do Amaral, the PT’s former leader in the Federal Senate, now under house arrest and plea-bargaining hard, “because she thought it would reach everyone but her. She thought it would make her stronger.” Instead, it has destroyed Lula. So what happens now? The PT has ten days to substitute Fernando Haddad, Lula’s choice and a former mayor of Sao Paulo, as the Workers’ Party candidate for the presidency in the election on Oct. 7, but it’s unlikely that he can win all the votes that would have gone to Lula. Which may leave the road open for a darkhorse candidate like Jair Bolsonaro, a born-again would-be Trump who disparages women, blacks and gays. A 49-year-old local was air lifted to the Royal Inland Hospital after being stabbed in the chest on Sept. 3. The incident took place following an alter-

cation at a residence on the 1300 block of Pine Street. “The investigation revealed the victim had been at a neighbour’s residence when he was allegedly accused of stealing something from the suspect, who

then stabbed him in the chest,” said Staff Sgt. Lorne Wood. “RCMP attended and conducted first aid until B.C. ambulance personnel were able to take over and transport the victim to hospital.” The victim is set to

undergo surgery and is expected to recover, according to Wood. Meanwhile, a 51-year-old suspect was arrested without incident. Charges of aggravated assault will be recommended to Crown counsel.

Police investigate two fatal crashes near Merritt Dara Hill THE MERRITT HERALD

Two drivers died in separate motor vehicle accidents near Merritt. The first rollover took place on Highway 8 just west of Lower Nicola around 8:00 p.m. on Aug. 30. “The 28-year-old driver of the car died at the scene due to injuries sustained in the roll over,” Merritt RCMP Staff Sgt. Lorne Wood wrote to the Herald in an email. While speed and alcohol are suspected to be contributing factors to the incident, the RCMP Central Interior Traffic Services (CITS) and the B.C. Coroners Service continue to investigate. The second crash took place on the Coquihalla Highway 15 kilometres south of Merritt around 9:45 a.m. on Aug. 31.

Hailey Cullen’s last year at Merritt Secondary School (MSS) was one for the books. In addition to working part-time and enjoying time with friends, Cullen pulled off the highest grade point average (GPA) in her graduating class. MSS vice-principal Gian Cavaliere awarded Cullen with the Governor General’s Academic Medal, a distinction which marks her top-notch grades during her senior year at MSS in 2017/18, as well as the MSS Mayon Cup for achieving the top GPA across all subjects. Even though Cullen had already

received an award for the highest Grade 12 physics mark, she admitted the award for top marks overall came as a surprise. “I thought someone else would have beat me this year,” she said. Turns out, Cullen is a natural. “I had a lot of fun in my grad year,” she said. “It was a lot of work, too, but just kind of got all the work done and I guess I did it well.” In addition to the academic medal and the Mayon Cup, Cullen received several scholarships to put towards her future studies. After taking a year to work in Kamloops, Cullen said she plans to pursue a bachelor’s degree in science, either at Thompson Rivers University or the University of Victoria.

Council approves community centre plan

Owners of the St. Michael’s Church property in Merritt are one step closer to selling a chunk of their land to the Canadian Mental Health Association (CMHA) to be used as a community centre. Merritt city council approved a rezoning application to subdivide the St. Michael’s Church property at 1990 Chapman Street at the regular city council meeting immediately following a public hearing on Aug. 28. The rezoning will make way for the owners to subdivide the property into two parcels, allowing the owners to sell the existing church on the proposed north parcel to the CMHA so it can be converted to a community centre. The existing community hall on the southern parcel would then be used as a church. “The program we operate is a psychosocial rehabilitation program. We work with adults in different life domains through their recovery from their illness,” said Christa Mullaly, executive director of the CMHA Kamloops branch. “So, our goal is to help folk reintegrate through social mechanisms into community, help them learn life skills as well as to find them employment.” Retaining the historical integrity of the building is a priority of the CMHA, Mullaly said, and they plan to add plumbing, a kitchen and a couple washrooms to the space. “We have found a preferred contractor that will be able to preserve every piece of wood that we need to move within the building,” she said. Mullaly explained her goal is to have construction get underway within the next couple of months, and have the community centre operational before this

Audrey Campbell, minister at St. Michael’s Church, spoke in favour of the rezoning application at the meeting and addressed councillors’ concerns that there is currently no parking on the lot. “What people may not know [is that] Canadian Mental Health has been doing their program out of the church hall [already]. And there’s been no change, no complaints — they are excellent tenants,” she

said. “The parking will not be an issue — it’s downtown, and a lot of people don’t have cars.” Councillors also raised questions about the potential of the community centre becoming an overnight shelter, which the CMHA does operate in Kamloops. “There is a need for [overnight shelters] in Merritt, but what’s there to say two years from now you decide to do that and we don’t have the parking?” Said Coun. said they have no plans to use the space as an overnight shelter. “We have some very good partners who are providers here in town that do that work already,” she said. “Having said that, when folks attend shelter, they’re not driving there.” The motion to rezone 1990 Chapman Street from institutional and public use (P3) to central business (C2) was carried by a vote of six to zero at the meeting. It’s the end of an era for Coun. Diana Norgaard. After a four-year term serving on Merritt’s city council, she has decided not to seek re-election this fall. Her first reason for stepping aside stems from concerns about future council leadership, she explained at a regular city council meeting on Aug. 28.

“Four years is a long time to work for a leader that you have no confidence in,” she said. “I currently have a great deal of confidence in the leader that we have but I would not necessarily be able to work for someone that I do not have confidence in and I am not prepared to ask the taxpayers to spend money in a byelection.” She cited health concerns of a family member as the second factor influencing her decision at the Aug. 28 city council meeting. “This job, if you’re doing it right, takes a lot of hours, takes you away from your family and it can often take you away from your community,” she said. “In all good conscience I am not going to be running.”

Future family doctors are being matched with patients who head for the nearest emergency room because they don’t have an alternative for rapid treatment of non-emergency conditions. The Urgent Primary Care Centre at Royal Inland Hospital in Kamloops is the pilot project for B.C.’s primary care strategy, seeing nearly 1,000 people since it opened in June. Health Minister Adrian Dix announced Monday the facility is expanding with a “family practice learning centre” to connect patients with University of B.C. medical residents for treatment. Patients are referred through the Healthlink BC waitlist for Kamloops, with priority given to people who don’t have a family doctor or nurse practitioner and who need immediate attention. Dix says the

Cowboys and cowgirls from near and far came away with considerable winnings as the 60th annual Nicola Valley Pro Rodeo wrapped up on Sept. 2. According to the unofficial results, posted to the Canadian Pro Rodeo Association website, Louisiana’s Shane Hanchey collected the weekend’s biggest cheque, winning $1,513.40 for his performance in the tie down roping event. Derek Frank from Stoney Plain, Alta. left the Nicola Valley with $1362 in his pocket after winning the steer wrestling event. He was half a second faster than Travis Reay’s mark of 4.0, which put Reay in second. Meanwhile, Seth Hardwick of Ranchester, Wyo. came away with $1294 from his 80 point performance in bareback riding. Dawson Hay of Wildwood, Alta. collected $1275 as the weekend’s sad-

dle bronc riding champion. His 83 points topped Kolby Wanchuk’s 81.5 point ride, which earned Wanchuk $1055 in second. The good results kept coming all weekend for the Alberta cowboys, as Wacey Finkbeiner earned $1237 as the pro rodeo’s top bull rider. Luke Gee, Jared Parsonage and Kane Larsen were the only other cowboys to post qualified rides, finishing second to fourth respectively. The action was fast and furious in the ladies barrel racing, as nine riders finished in the money. Callahan Crossley of Hermiston, Ore. paced the field with her time of 15.944 seconds, earning her a cool $1139. Shelby Spielman and Sherry Cervi rounded out the top three. The team roping event on Sunday saw two teams tie for the top spot, after both teams posted matching times of 4.4 seconds. Two Alberta cowboys, Trey Gallais of Sundre and Trent Tunke of Medicine Hat, tied with Cory Petska and Derrick Begay, both from Arizona. Both teams collected matching cheques for $1091. Last but not least, Mason Helmeczi of Sundre, Alta. and Ben Andersen of Eckville, Alta. won the novice bareback and saddle bronc riding events respectively.

Seven players will don the signature red and white of the BCHL’s longest running franchise for the first time in a regular season match on Sept. 7, when the Merritt Centennials visit the Salmon Arm Silverbacks. Local prospect Talon Zakall will be one of the brand new Cents, but not all the recruits are playing close to home. Daniel Tkac, a 17-year-old forward originally from Presov, Slovakia will make his debut with the Cents

this weekend. Tkac has roots in the U.S. too, which is where he played his last season of hockey with the Omaha Lancers of the HPHL. Nic Granowicz is another new Cent with roots in the U.S. The Macomb, Mich. product is a 20-yearold forward with the distinction of being the most experienced of the Cents’ signings this year.

The Cents faithful will recognize the name Frazer Dodd, a Hazelton, B.C. player who appeared in seven games last season with the Cents as an associate player. Brett Roloson brings a hockey pedigree to the Cents this season, as he is the son of NHL goaltender Dwayne Roloson. But the younger Roloson is more scorer than stop-

DANCE WITH A DIFFERENCE Participants of the Love To Dance Academy’s 2018 summer dance camp were immersed in art this past August. In the prior years, guest teachers from out of town have been invited to teach LTD students, exposing them to new dance styles not regularly presented at the LTD Academy. This year, students had a taste of the other aspects of the dance world, including designing costumes and painting stage decor and props that will be used in the upcoming Christmas concert. It is with great sadness that we announce the passing of Shirley George, a long time resident of the Merritt BC area. Shirley passed away peacefully Saturday the 18th of August in her home. She was predeceased by her father Rasmus, mother Dorothy (Quimby), brother Raymond, and son David. She is survived by her husband of 50 years, Cyril, son Christopher (Tammy), daughter Jennifer (Ross), daughter Nicole (Scott), and grandchildren Teanna, Keagan and Gavin, and many more extended family. Born in 1942 in Vancouver BC, Shirley raised her young family in Surrey BC before retiring to the Merritt area 20 years ago. She spent many years volunteering with Fish and Wildlife as well as the Rod & Gun club, and working as a lunch supervisor at Collettville Elementary School. Shirley lived life to the fullest through simple pleasures; chatting with friends and family and spending time with her children and grandchildren. Her favourite times were doing anything that involved being with them, from days at the lake, to sitting at home enjoying a family meal.
