After they were temporarily kicked out of Zuccotti Park yesterday, protesters marched to Canal Street.
As protesters trickled back into Zuccotti Park without their tents and tarps last night, they pledged to make tomorrow’s International Day of Action one this city will never forget. “On the 17th, mark my words, we’re going to burn this city down,” said Nkruman Tinsley, 29. Protester Eli Moses said Tuesday’s midnight police raid on the park only “invigorated” the movement. “Anyone who was in that raid is going to be more angry than scared,” said Moses, 22. “We have

to get more intense if we want anything to change. There are a lot of things that are going to happen tomorrow.” Occupy Wall Street protesters are planning a litany of events meant to disrupt New York City in commemoration of the group’s two-month anniversary. As several hundred protesters entered the park after sunset, they cried and hugged in celebration. They were searched by police before entering, to make sure they didn’t
bring in sleeping bags, tarps or tents, all items that are now contraband in the private park. But many of the protesters vowed that even without their gear, they’re staying put at Zuccotti, no matter how cold it gets. “It’s really good to be home,” said J.A. Myerson, 25, who is looking forward to Thursday. “A lot of people are willing to throw their bodies into the streets for this movement.”

The “Occupy Wall Street Library” first started when college students who joined the movement wanted to designate a secure space for their textbooks. It quickly grew to include thousands of donated books as supporters spread the story via social media. Julie Wood, a spokeswoman for Mayor Michael Bloomberg’s office, said via Twitter that the confiscated books are safely stored at the 57th Street Sanitation Garage. Reporters covering the eviction among those handcuffed Several reporters covering the NYPD’s surprise eviction of Occupy Wall Street found themselves in handcuffs along with the nearly 200 others arrested yesterday. Associated Press writer Karen Matthews, AP photographer Seth Wenig and Daily News reporter Matthew Lysiak were all arrested, according to the AP. Two reporters from DNAinfo.com, news editor Patrick Hedlund and freelance photographer Paul Lomax, were also arrested while covering the eviction, DNAinfo reported on their site.

Elected officials from Harlem to Brooklyn are calling the move “sneaky” and “legally questionable.” “Given the NYPD’s sneaky tactics early on, I am not surprised by the NYPD’s efforts to use the cloak of night as a shield for their brazen violation of the First Amendment,” said Brooklyn Councilman Jumaane Williams, who was at Zuccotti Park when the eviction happened yesterday. “I expected this would happen; I just did not know when.” Councilman Ydanis Rodriguez, who represents northern Manhattan, was among the nearly 200 arrested when police stormed the park and kicked out the campers.
In his own defense Bloomberg was supposed to be in Washington, D.C. yesterday but abruptly canceled the trip to remain in New York, where he stood by his decision to evict the Zuccotti Park camp. “Inaction was not an option. I could not wait for someone in the park to get killed or to injure another first responder before acting,” he said, referring to an EMT who was hurt last week at the camp while removing a mentally ill man.
“Mayor Bloomberg made a needlessly provocative and legally questionable decision to clear Zuccotti Park in the dead of night,” said Public Advocate Bill de Blasio, a frequent critic of Bloomberg’s. “Provocations
under cover of darkness only escalate tensions in a situation.” Bloomberg said the decision to evict the protesters was his and his alone, although he made the call after complaints from nearby business owners and Brookfield Properties, which owns the park. But at least one city councilman approved of the mayor’s decision. “Bloomberg ended only the illegal aspects of what had clearly become an occupation, which denied others their right to safe, clean streets,” said Queens Councilman Peter Vallone. “The protests can continue, within the reasonable restrictions set by the Legislature and the courts,” he added. The lawyer who took on the Roman Catholic Church in Boston in a sex-abuse case has some advice for Penn State University: embrace the victims and tell the whole truth, promptly. Most legal experts agree that Penn State is likely to face civil lawsuits from alleged victims in the child sex abuse scandal that ousted the university’s president and legendary football coach Joe Paterno. The size of Penn State’s legal headaches and the damage to its reputation will depend on how the university reacts, according to lawyer Roderick MacLeish. The university first

It will give them credibility.” Penn State should also offer unconditional mental health treatment to the alleged victims and set up a private victims’ compensation fund, sparing potential plaintiffs the “horrors of litigation,” he added. MacLeish, who has no connection to the Penn State case, was the lead lawyer in a clergy abuse case against the Archdiocese of Boston that settled in 2003. The church’s combative legal stance ultimately backfired, MacLeish said. REUTERS

BofA: Debit card $5 fee was big error $5 card surcharge was a mistake, Brian Moynihan concedes Promises more transparency in the future
Bank of America canceled plans for a $5 monthly debit card fee a month after proposing the idea, following backlash from customers and politicians. DAVID MCNEW/GETTY IMAGES
Bank of America Corp. learned a lesson from its abandoned debit card fee and will work to provide transparency and fair pricing to customers while producing a return for shareholders, Chief Executive Brian Moynihan said yesterday. The bank and its peers are updating product offerings even as they “address new regulations that have reduced our revenues in this business,” he said. Consumer banking will become a “smaller platform” at Bank of America and derive its profitability from lower expenses and deeper relationships with customers, Moynihan said. In another move to build capital, Bank of America said it was selling most of the remaining shares it owns in China Construction Bank Corp.

It was disclosed yesterday in a lawsuit filed in Manhattan Supreme Court that the singer screamed obscenities at a toddler and threw a punch at the baby’s mother (who also happens to be a school teacher) sometime this year. The mother, Roseanna Monk, is now suing LaBelle, who was living in Monk’s Manhattan apartment building while appearing on Broad-

The downside of downward dog Just how does one get through the most unpleasant moments that can occur in yoga class? Plus, some etiquette rules to remember
Problem 1:
embarrassing incident during yoga class is to laugh it off. “Yoga is a moving meditation that allows you to let go of a lot of things in life. Getting annoyed or agitated adds
Problem 2:
aggressiveness and ego to your practice, which defies its purpose,” she says. Other than having a sense of humor, here are some ways you can address mortifying mat moments.
Problem 3:
You’re embarrassed to make a sound
You make an, erm, unexpected noise
You settle next to a rude neighbor
That “ohm” in the beginning can leave firsttimers in a fit of giggles. Solution: The purpose of the Sanskrit sound is to mentally bring everyone into and out of the class. “It’s what helps you stay focused and aware of your breath,” says David Kim, instructor at L.A.’s YogaWorks studio. “If doing the ‘ohm’ really embarrasses you, then do a very quiet one under your breath,” Kim suggests.
Passing wind in public is bad enough. It’s even worse when it happens during a silent yoga class. Solution: “If a student passes gas, ignore it,” says Kim. “Some poses trigger the release of gas, especially twists and inversions that upset digestion.” And if it’s you you’re worried about, avoid eating two to three hours before a class, and relax: The anxiety over trying not to fart can make it happen.
You arrive early to secure the best spot. Five minutes into class, the aggravator arrives, puts his mat an inch from yours, blocks your view and wedges his toes in your face. Solution: The teacher should lay down the law. “It’s only fair to have a 15minute rule, after which the people aren’t allowed in,” says Kim. Barring that, ask them to be careful — and wish them namaste afterward.

I’m a single guy in the city. I’m really tired of gold-digging women expecting me to pay for everything on dates. I understand it’s appropriate to pay for the first date or two, but why is it that women can’t chip in at all when they want equality in every other part of life? How can I handle this? I want to continue to date but don’t want to go broke doing so.

o doubt, you’ll encounter women who are simply after a good meal. Many female clients have told me they go out with a new guy several nights a week just to get a free dinner. Don’t be a victim to such gold-digging. Pay for the first date if you initiate it. No need to take someone to an expensive restaurant on a first date. The focus should be on getting to know the other person, not judging each other by how much is spent. Subsequent dates, though, aren’t that clearcut. Without jobs, who to exploit? I hope the OWS people go out and get jobs soon. If they don’t start working on their retirement funds and 401(k)s now, then what will bankers be able to recklessly overleverage during the next boom/bust cycle? DANIEL CIAMBRONE, VIA E-MAIL
Congress gets rich illegally This is real easy if you have half a brain. OWS is about corruption and greed that affects all of us. “60 Minutes” just
aired a piece on how our congressional leaders use nonpublic information in order to make large amounts of cash for themselves. People go to jail for that; it’s called insider trading. They also buy land near areas that they know will be developed because of this nonpublic formation. Wake up and stand up. ROBERT ASHE, VIA E-MAIL

I understand the protestors have rights according to the First Amendment. But does that right include taxpayers footing the bills that come with these rights? Our cities are spending hundreds of thousands per week of taxpayer monies to allow OWS their First Amendment rights. Why don’t they pay
To Michael Chimenti, who asserted that America was built on the concept of “work,” something he says OWS protesters wouldn’t understand: Do you mean all that work Americans did by enslaving Africans and forcing them to work for them for over 500 years while they sipped sweet tea in between lashings, rapes and lynchings? If your argument is true, then OWS is just following in that fine example set by their forefathers!

Christian vs. convicts In a callback to the days of Notre Dame-Miami, bad boy Jets face Tim Tebow, Broncos Main focus is on bringing down bruising runner Defense concerned with multiple looks GARRETT ELLWOOD/GETTY IMAGES
Love him or hate him, Broncos quarterback Tim Tebow is a challenge. The 6-foot-3, 235-pound Tebow is built like few other quarterbacks — a mobile quarterback who can shrug off would-be tacklers. Taking Tebow down is the top goal of the Jets’ defense. “You have to bring him down. A guy like him is so good at breaking tackles, it is hats to the football,” defensive end Aaron Maybin said. “You can’t bring him down with one tackler; you need to get on him. He’s that strong; he’s a big guy you have to wrap him up.” Tebow can run the ball and pull up to make a pass, giving him the ability to hurt defenses that key in on his running ability too much. “If you pull up as a linebacker thinking he’s going to do one thing, he can hurt you the other way,” linebacker Jamaal Westerman said. Tim Tebow only completed two passes against the Chiefs last Sunday, but they still won the game 17-10.

Rangers win their seventh straight In a game that looked like it was going to be determined by the foot soldiers, it was a star who scored the gamewinning goal. Brad Richards’ goal with 4:55 remaining in the third was the gamewinner in the Rangers’ 4-2 win over the Islanders last night at the Nassau Coliseum. The Rangers have won seven in a row, equaling their longest winning streak since October 2009. The Islanders meanwhile have lost five of six and fall to 4-8-3 on the season. Sean Avery snapped a wrister past Evgeni
Nabokov stickside 14:43 into the first period to give the Rangers a 1-0 lead. The goal was Avery’s second of the season. Frans Nielsen’s slapshot goal at 17:06 tied the game at 1-1. Steve Eminger’s first goal in 30 games allowed the Rangers to retake the advantage, 21, in the second. Matt Moulson equalized it on the power play at 13:02 of the third period. John Tavares, who controlled the puck at the right wing circle, fed Moulson who drove to the net and tipped Tavares’ pass past Lundqvist. That set the stage for Richards' game winner. Ryan Callahan added an empty netter. DENIS GORMAN

Brad Richards scored the sixth goal of his Rangers career. He has five goals in the last eight games — seven of which were wins.
28
The Islanders outshot the Rangers 28-15 over the final two periods of the game, but were outscored 3-1 on the scoreboard.

Wild, wild 250 West You’ve likely zipped past 250 West St. while driving up the West Side Highway. The former fruit-andvegetable warehouse has arched windows and the words “West Street” stenciled on its Hudson Riverfacing facade.

The building was purchased in 2006 by the Elad Group, the Israeli developer famous (or infamous, depending on your perspective) for converting the Plaza Hotel into condos. Elad started converting 250 West into apartments in June, and as of last month, 250 West had sold 25 of its 106 units, with 11 in contract.
The building has a mix of units — from studios to three-bedrooms to a 7,000square-foot penthouse with outdoor space and a private elevator lobby. JULIA DAHL/REAL DEAL TheRealDeal.com is a daily blog and monthly magazine covering real estate in the New York metro area.

Renewal by Andersen Master Installers only come to your home after they’ve been trained, tested and trusted. With teams that average 10+ years of window installation experience, most installations—including the cleanup—are completed in just one day.
For a strong window that will last, look to the company that has lasted. Renewal by Andersen is the exclusive start-to-finish replacement window subsidiary of Andersen Windows—a company with a 108 year reputation for quality. Our replacement windows are held to Andersen’s same high standard, while some other, less reliable windows have been reported to leak and fail after just a few years.

The M34 now has Select Bus Service. Life got a little easier yesterday. That’s when Select Bus Service (SBS) began on the M34 route, giving riders better service and improved travel time along 34th Street. The M34 SBS has a dedicated, strictly enforced bus-only lane. You pay before boarding at special sidewalk kiosks, then board through any door. Plus, SBS buses run more frequently than the M34 limited buses they replace. And they even control the traffic signal at 7th Avenue . . . a critical bottleneck. For the 18,000 of you who ride the M34 every day, trips could be up to 20% faster. Look for the buses with flashing blue LED lights. For more information, visit mta.info. 34th Street yesterday. More miracles tomorrow.
