NTSB: Derailed MTA train was going 82 mph Investigation. The Metro-North train that derailed Sunday morning was speeding toward a 30-mph curve in the line. National Transportation Security Board member Earl Weener briefed the press once again Monday afternoon following the tragic derailment of a Metro-North train early Sunday morning. According to Weener, the black box recorders recovered from the wreck showed that the train was going 82 mph approaching a 30 mph zone. The stretch of tracks preceding the 30 mph zone has a maximum speed of 70 mph. Preliminary data showed that the throttle went idle six seconds before the locomotive engine stopped. Approximately five seconds before the locomotive stopped, the air pressure on the brakes plummeted suddenly from 120 pounds per square inch to zero, which would have resulted in the train braking at the maximum strength possible. But Weener, along with Sen. Chuck Schumer (DNY) and Sen. Richard Blumenthal (D-CT), said it’s still too early to tell if the speed and the abnormal braking were due to hu-

The investigation into the derailed train continued on Monday at the crash site. / GETTY IMAGES A troubled year Metro-North has seen three other major incidents this year. •

On May 17, a derailed New Haven Line train ended up causing a collision between two trains near the stop in Bridgeport, Conn.

On May 28, a track foreman was killed when a train was unintentionally routed onto a track under repair.

On July 18, a CSX freight train derailed near the same place where Sunday’s derailment occurred.

“For a train to be going 82 mph around that curve is just a frightening thought.” Sen. Chuck Schumer, who said that the speed issue “raises so many questions and is scary.”

NYPD. Man, 33, shot to death outside of Tompkins Houses A gray Monday morning was shattered by the sound of gunshots, according to a 911 caller. man error or mechanical failure. But, Weener and the senators noted, the train stopped at nine stations prior to the derailment, and so far the NTSB investigation has turned up no indication of any issues with the brakes at any of those stops. Schumer said investigators told them: “It looks pretty certain that the tracks are OK.” Weener confirmed that NTSB had returned the tracks to the authority of Metro-North. “There are two choices,” Schumer said. “One would be human error on behalf of the engineer, the other will be mechanical error on behalf of the locomotive.” Weener said that the engineer underwent drug and alcohol testing, but the results had not been made available to NTSB as of Monday evening. NTSB had started interviewing the engineer on Monday and intends to interview the other three crew members in the coming days. The engineer’s cell phone was also taken into custody — a routine part of any NTSB investigation. Six out of the eight train cars had been inspected as of Monday, and low-quality surveillance video was sent to a Washington, D.C., facility for possible enhancement, Weener said.

De Blasio pushes pre-K tax proposal Confident. The mayor-elect said his tax hike plan to fund pre-K has support from some State Assembly Democrats. Mayor-Elect Bill de Blasio said his universal prekindergarten plan was well-received during a meeting with Democratic State Assembly members Monday. “It was very warmly received by the assembly members,” de Blasio said after the lunch meeting. The plan involves raising income taxes for wealthy city residents to fund universal prekindergarten and after-school programs for middle school students. Raising income taxes requires approval form the State Legislature, which critics have said would be difficult with a Republican-controlled Senate. De Blasio said he plans on meeting with Gov. Andrew Cuomo and Senate GOP leader Dean Skelos about the proposal. Most Senate and Assembly Republicans support cutting taxes, not raising them.

Earlier-than-usual online deals to steal Cyber Monday thunder Analysts. Online sales at many chains may come up short thanks to big stores eschewing tradition this year. Earlier-than-usual online holiday discounts are expected to dampen Cyber Monday sales totals in the United States. That helped overall online sales from Thanksgiving through Sunday rise 14.5 percent

Prices for most of the items in the song — including the partridge, two turtle doves, three French hens and five gold rings — remained steady from last year. Was Walker drag racing when he died?

CULTURE

Details continue to emerge about the car wreck that killed “Fast and Furious” actor Paul Walker and his business partner, Roger Rodas, on Saturday — and they aren’t pretty. TMZ.com reports that cops are looking into the possibility that Walker and Rodas were drag racing when their Porsche exploded after first hitting a tree and then a lamppost. The area where they died is a well-known racing strip. In fact, TMZ reports that fans are “doing dangerous burn-outs, donuts

and other high speed stunts” at the death site in memoriam of Walker. Meanwhile, production for “Fast and Furious 7” “won’t be scrapped,” sources close to the production tell the Hollywood Reporter. Filming has been underway in Atlanta, taking a break for the Thanksgiving holiday. Sources say production will be “delayed” as they figure out how to re-work the project and “how to proceed in a manner that would be respectful to Walker’s death.”

British Olympic diver Tom Daley and actress Maria Bello took to different forms of media this weekend to reveal new same-sex relationships. Daley posted to YouTube to officially come out, telling fans that he has been dating a man for most of this year. “Come spring of this year, my life changed massively when I met someone. And it made me feel so happy, so safe, and everything just feels great. That someone is a guy. It did take me by surprise a

I’m glad I didn’t go there.’” Jonas also reveals that he smoked marijuana for the first time with Miley Cyrus and ex-girlfriend Demi Lovato. “I must have been 17 or 18,” the 24-year-old writes. “They kept saying, ‘Try it! Try it!’ So I gave it a shot, and it was all right. I don’t even smoke weed that often anymore.”

little bit. It was always in the back of my head that something like that could happen, but it wasn’t until spring this year that something just clicked,” he said. Meanwhile, Bello told the world about her new girlfriend, Clare, in a firstperson essay in the New York Times titled, “Coming Out as a Modern Family.” Jackson, Bello’s 12-yearold son from a previous relationship, took his mother’s new relationship in stride. When she told him, “He looked at me for what seemed like an eternity and then broke into a huge, warm smile. ‘Mom, love is love, whatever you are,’” she wrote.

Moss, over-the-hill? Not so fast

Everything’s coming up Kate Moss this week. First up, the supermodel, who turns 40 next month, was honored at the British Fashion Awards in London on Monday where she won a special award for her 25 years in fashion. Second, her hotly-anticipated issue of Playboy hits stands on Friday. The 18-page spread features a Q-and-A with Moss and Tom Jones. Jones lobs softballs at the model (as you should when someone is naked) with such questions as, “Who would be on your ultimate guest list?” The model replies, “Jack Nicholson, [photographer] David Bailey, Stevie Nicks, Catherine Deneuve, Joan Collins — love! She texted me the other day. I could not believe it. ‘Hi, it’s Joan Collins.’ I was like [mimes dying-of-shock]. My husband, because it would be mean if I didn’t invite him. And Hugh Hefner, obviously.” ALL PHOTOS GETTY IMAGES

Avril Lavigne on ‘Avril Lavigne’ Music. The Canadian pop princess talks about growing up and “Here’s to Never Growing Up. On the cover of Avril Lavigne’s newly released selftitled album, she looks all grown up, with a stern expression and dark makeup framing her eyes. But the first thing she sings on the album is the line “I don’t care about my makeup, so it’s probably best to pay heed to the age-old advice of not judging a book (or album) by its cover. Within “Avril Lavigne is a whole bunch of fun anthemic pop that she’ll be the first to tell you doesn’t

really get too deep inside the real Avril Lavigne. But there seems to be a friction on the album between the impulse to preserve her youth (“Here’s to Never Growing Up) and actually growing up (“Falling Fast). “It’s really not that deep, musically, she says, almost dismissively. “I like to be onstage, I like to write poprock songs. That’s what everyone wants to hear from me, and that’s when everyone goes apes—. With this album, Lavigne collaborated heavily with husband Chad Kroeger of Nickelback. He co-wrote eight of the album’s 13 songs, produced six and performed with Lavigne on one duet. “We worked on the album, she says. “Then he left and then we worked again. We worked in dif-

ferent clumps. When I had actually taken a break after the tour, I moved to France on my own. Then he came out to visit me, and that was our first time getting together without it being work-driven. But not all of the collaborative efforts are for public consumption. “We also worked on a song called ‘If I Said That I Loved You,’ and it’s a duet. It’s unreleased, but we played it at our wedding as our first-dance song. But Lavigne insists that was the only time the guests at their wedding heard either of them sing. “I had a band there to play jazz music, because that’s what I really like: a lot of Frank Sinatra and Billie Holiday, then a DJ to play a bunch of dance music for people to dance to.

Q&A

Helping female artists Your song “Bad Girlâ€? with Marilyn Manson is a great anthem, and in the years since you ďŹ rst came on the scene, other bad girls have come forth to dominate pop music. Do you think that you inuenced them? When I came out on the scene, Britney and Christina [were] playing one style of pop: very bubblegum pop. ... Then I came along, I was a girl with a guitar, writing a dierent style of lyrics and music. I think [to myself], “Did I help open door for other artists in that genre?â€? That is what does happen. I’m not going to straight-up say that I did that for these people, but it does happen. Any female artist that’s doing her own thing is also helping other female artists.

The characters in Albom’s latest book, “The First Phone Call From Heaven, are given exactly that chance. The book is about a small town that starts receiving phone calls from heaven. Mostly, it follows one man whose wife died, leaving him to raise his young son alone. When the boy starts asking when mommy is going to call, he can’t bear for his son to have false hope, so he sets out to prove the whole thing is a hoax. With an in-room jacuzzi — standard for all suites — and a furnished patio, our accommodations were quite large for a single person. But it wasn’t long before we took advantage of the cavernous marble shower, swim-suited up and set out for sunshine. While climbing stairs that led to the nearest pool, we almost stepped on one of dozens of sunbathing iguanas that would appear over three days. Outstretched in a chaise

But when the water gets to be too much, guests will be happy to know that Moon Palace has a spa, two salons and daily yoga in an on-site meditation garden. Even though it briefly rained each day, the side effects were positive: The loudest guests — mostly families — abandoned the deck, and the ocean breeze rolled in to whip our paperbacks’ pages and the napkins under our cocktails du jour. Wash, rinse, repeat: We pool-hopped like this for the rest of the trip. One afternoon at the Sunrise pool’s coal-fired pizza oven, two newlyweds chit-chatted with other

Among a crowd of hundreds of spectators, our gaze turned to the pool’s center stage as a DJ encouraged an 8-yearold to dance to LMFAO’s “Sexy and I Know It.” It’s rare to see confidence (and hear applause) so pure. Just beyond these pools is the quieter beachfront. Although a hefty bit of seaweed clutters the otherwise sea glass-green waters — not on par with the Mayan Riviera’s reputation for pristine beaches — the sandbars are the glorious temperature of bathwater and the sand itself is the softest we’ve bared our feet for. The appeal is as strong for the under-18 set as it is for grown-ups. Parents relax poolside while their kids roam independently with minimal risk, and vice-versa. Plus, the all-inclusive element means that, cost-wise, parents don’t need to utter the dreaded word “no” very often. Kids seem elated; adults look relieved.

and drew one, too. “Have you ever been kissed by a Mexican?” asked Miguel, a trainer at Moon Palace’s own dolphinarium, where guests get a show and a wet smooch from one of eight bottlenose dolphins. A professional photographer on hand means that guests take home a souvenir portrait that’s a step up from a smartphone selfie. On the last evening of the trip, we had an unexpectedly exceptional meal at Los Tacos. At the poolside snack bar, surrounded by a ring of romantic canopied beds and mangroves, a flirtatious waiter brought to our table a heaping plate of nachos that we didn’t actually order. But it didn’t matter, because the tortilla chips swimming in cheese, grilled pork and pineapples were as gratifying as the tumbler of Dos Equis we washed them down with.

Parenting. Want to work from home part-time? Here’s how to do it.

Whether you have a toddler or an older child, it can seem like you never have enough time at home. Liz O’Donnell, author of “Mogul, Mom and Maid: The Balancing Act of the Modern Woman, tells Metro that no matter what your work-home situation is, talking to your boss about flextime is worth it and can be done. Here’s how to do it.

Gauge your work culture “A lot of companies boast about having flex benefits, but it might not be the true culture of the workplace, O’Donnell says. “If you look around and no one’s doing it, it doesn’t mean you shouldn’t ask for it, but you could be frowned upon for taking them up on something they hoped nobody would.

Frame it as a winwin situation Now comes the hard part: asking your boss. O’Donnell stresses it’s important to point out what your employer will be getting out of the deal.

“If you ask to work from home on Wednesdays, tell your boss how fully committed you’ll be those days because it means not worrying about your kids being home alone, or whatever it is, she says. O’Donnell also points out that your boss might have questions that will take you time to answer, so it may take more than one conversation. “Your boss may want to know how it is going to work, especially if you have clients or meetings. It may take several conversations to answer his or her questions.

Flexibility goes both ways If your boss gives you the

go-ahead, it’s important to actually work from home. “Marissa Mayer at Yahoo! pulled back her company’s work-from-home policy because data showed people who said they were working from home weren’t logged onto the server, O’Donnell says. “If you are expected to work 9 to 5, be logged on from 9 to 5. O’Donnell also says you should be willing to come in for an important meeting even if it falls on a day you typically are at home. “You shouldn’t say, ‘Well, you had me come in on Wednesday, so now I’m going to switch my work from home day to Thursday this week, she says. “If you ask an employer for flexibility, you need to [give] flexibility back.

Monopoly Empire

Play-Doh Create ABCs App

The Monopoly franchise oďŹƒcially sold out this year with the release of Monopoly Empire, which is basically a clever way to advertise to kids. Players compete to buy Coca-Cola, Samsung and other brands instead of properties. Even the game pieces are ad-based: Kids can be McDonald’s French fries or an Xbox controller, to name a couple. It’s product placement at its worst. Another downside to Monopoly Empire is that

Um, sorry, but what fun is Play-Doh when you can’t smell it, feel it or mold it? The Play-Doh app lets kids choose what they want to make, but when all you are doing is sliding electronic Play-Doh into a mold, it takes away all of the creativity and fun. A pro is that the game does help kids learn their ABCs by prompting them to trace outlines of the letters with the Play-Doh. And while the educational merit deserves some credit, tracing letters isn’t why kids love Play-Doh in

only two to four people can play it, which is only half the number of people who can play original Monopoly and most of the other editions. But with fewer pieces racing around the crammed board, which will give you the same headache you get when you’re in Times Square too long, it might be for the best.

The Real Tooth Fairies VIP Upgrade Membership

The Tooth Fairy gets a fashionista spin with this virtual game. Kids can use their “sparkle dollarsâ€? to buy their Tooth Fairy a closet full of outďŹ ts (there are more than 200 to choose from) and plan parties. Meanwhile, the money parents spend on this game is very real at $59 per year. The game does have a couple pros. The Tooth Fairy writes personal letters, which kids are bound to think is pretty cool. But the whole idea of paying $60 for a Tooth Fairy is completely twisted: Isn’t the Tooth Fairy supposed to be giving you money?

If only dinosaurs had armor and cannons like this toy, they would still be around. The batterypowered Apatosaurus can walk and shoot without kids even touching it — no playing or imagination necessary! Also, get ready to want to throw this toy out the window: The ďŹ ring sound eects play on and on. Despite the aws, plenty of parents rave about the toy on Amazon, saying any dino-loving kid will enjoy it. But the Campaign for a Commercial-Free Childhood criticizes the toy, saying the idea of a brontosaurus with heavy machinery is too violent.

iPotty

Meant to teach toddlers how to use the toilet, the iPotty is a tablet on which kids can play games and watch videos while on the potty. Great, so your kids will ďŹ nally want to go to the potty, but don’t expect them to actually, you know, go. Shouldn’t the bathroom be the one place where kids don’t need electronics? A toilet toy just doesn’t sound sanitary. Although the tablet’s instructions say it comes with a clear screen protector to prevent “smudges and little messy accidents,â€? it still seems like the toy is a germ-magnet. There has to be a better way to toilet-train a toddler.

How to play Fill in the grid so that every row, every column and every 3x3 box contains the digits 1-9. There is no math involved. You solve the puzzle with reasoning and logic.

Obama not a very good boss Re: ‘This is not your father’s GOP’ (Metro, Dec. 2) In his letter, Mr. J. Connell claims that the GOP wants only three things: One: The destruction of President Obama. If fighting against a man who has made the world less safe (Iran pact), drove the national debt up by trillions, kept the unemployment rate at just about 8 percent for five years and destroyed the best health system the world has ever known via Obamacare is wrong, then count me and millions of other Americans as happily wrong. Two: The elevation of the private sector over the public. Meet

the new boss, Mr. Connell ... same as the old boss. You want to be a slave to some nameless bureaucrat who has his job because he/she passed a civil service test — be my guest. I’ll take my chances with the private sector. Three: Reversing the last 50 years’ worth of progress on social equality. The first female appointee to the Supreme Court, the first African-American appointed secretary of defense, the first female African-American appointed secretary of state, the first Hispanic attorney general of the U.S. were all made under Republicans. Kerl route

Kerley plans to return on Sunday Jeremy Kerley tells Metro New York he will be back this Sunday, and not a moment too soon for a Jets passing attack that has been failing the past few weeks. The wide receiver’s left elbow was dislocated in Week 8 during a win over the Saints and he hasn’t played or been active since. There is a sense or urgency for Kerley who despite still feeling soreness in his left arm said he will play and boost the league’s worse passing offense. “I will be out there regardless,” Kerley said. “Regardless.” Despite missing four of the Jets’ 12 games this season, Kerley is still the leader in receptions (28) and receiving yards (347). The Jets managed just 108 passing yards and 13 completions from their quarterbacks this past Sunday in a dismal loss to the Dolphins. He refused to put a percentage on his elbow, saying, “Any percent you want to put it at.” KRISTIAN DYER

Jets fans stuck with Smith starting again NFL. The rookie will start against Oakland despite being benched against Miami. The Jets signaled that they are more concerned with the future than the present when they announced on Monday that Geno Smith will be the starting quarterback for Week 14. The rookie is coming off a 23-3 loss this past Sunday where he was benched at halftime in favor of Matt Simms. Quarterback coach David Lee told Smith on Monday morning that despite a fourth straight game with a completion percentage less than 50 percent and a streak of five full games without a passing touchdown, he will start. “Coming into this week, coming into this building today, my mindset hadn’t changed,” Smith said. “My goal is to go out there every single day in practice and prove myself and that’s what I want to do this week. Pretty much in this league, no one’s job is for certain. Everyone has to earn their pay and I’m no different.” Smith was 4-of-10 for 29 yards with an intercep-

For a quarterback who is error-prone, that is a high tightrope for Smith to walk. “I don’t feel I have to be perfect out there,” Smith said. “I just think we’ve got to do a better job as an offense and I have to do a better job as the quarterback in getting the right play and moving the chains.”

And considering that we really needed a big performance out of somebody, it is definitely going to be one of those memorable football games for me,” said Tuck. “Hopefully [critics] see that I can play the game at a high level.” TONY WILLIAMS
