Beacon Street brownstone owner claiming negligence Civil complaint. The lawsuit alleges that welding work being performed next door was not properly permitted and caused the deadly fire. The estate of a Back Bay building where a massive fire broke out last month, killing two Boston firefighters, is suing the welding company that allegedly started the blaze. An attorney for Herbert Lerman, the executor of 298 Beacon St., filed the lawsuit last week in Suffolk Superior Court. The suit seeks an unspecified amount to cover the property damage and loss of income. The massive nine-alarm Beacon Street fire on March 26 trapped Boston Fire Lt. Edward Walsh and Firefighter Michael Kennedy in the basement, killing them. On April 4, authorities said they believe sparks from welding work being done in the rear of 296 Beacon St. caused the fire. The complaint names the defendants as D & J Iron Works of Malden; its owner, Giuseppe Falcone, and the owner of the neighboring building where the welding work was being performed. Messages left at D & J Iron Works and for Falcone’s lawyer were not returned by press time. “Lerman is informed and believes that … [neither] D & J nor Falcone requested a permit from the city of Boston to perform the welding work,” lawyers wrote.

“D & J had a duty to exercise reasonable care to prevent damage to adjoining property owners in connection with the welding work,” lawyers wrote in the complaint. “Due to the inherently dangerous nature of the welding work, D & J had a duty to take special precautions to prevent damage to adjoining property.” It goes on to allege that neither the building owner, welding company nor Falcone ensured there would be a firefighter at the site, maintained a fire extinguisher or installed a fire-resistant shield to prevent ignition of combustible construction materials, as required by code. Authorities previously said there was no permit pulled or fire detail onsite during the welding work. A permit is required by law, and in many cases a fire detail also must be present. During a news conference announcing the cause of the fire, Boston Fire Department Interim Commissioner John Hasson said that once a permit is pulled for welding work, a fire official will go to the work site to determine the potential hazards and decide whether a fire detail is necessary. Multiple agencies, including Boston police and the Suffolk district attorney’s office are involved in the investigation. Fire officials said strong winds on the day of the fire helped it race through the brownstone, which contained eight apartments. All of the apartments were leased, the lawsuit said. Nas, Roots, Lorde in for Boston Calling The spring edition of Boston Calling is weeks away from setting up on City Hall Plaza, but the biannual music festival is already announcing the lineup for its fall installment. Lorde, Nas, The Roots, Childish Gambino and The 1975 are among the 22 acts that make up the festival’s fall lineup, which Boston Calling will announce today. Also joining the ticket is The National, which was one of the bands that played the first Boston Calling in May 2013. All four of Boston Calling’s lineups have been co-curated by The National’s Aaron Dessner. “Collaborating on the programming of Boston Calling has been such a great experience for me, and I feel we are getting better and better with each edition,” Dessner said in a statement. “We were able to book several of my favorite artists in the world for September’s lineup.” Nas, who is celebrating the 20th anniversary of his debut album “Illmatic,” will perform with The Roots. High court upholds Michigan ban on college affirmative action admissions The U.S. Supreme Court on Tuesday dealt a blow to the use of racial preferences in higher education by upholding a Michigan law that bans the practice in state university admissions. On a 6-2 vote, the court rejected a challenge to the voter-approved ban, although the justices were divided as to the legal rationale. The court made it clear it was not deciding the larger and divisive question of whether affirmative action admission policies can be lawful. The majority opinion rejected the argument made by civil right groups that the 2006 Michigan constitutional amendment that passed as a ballot initiative to ban the practice had imposed burdens on racial minorities in violation of the U.S. Constitution’s guarantee of equal protection.

The Ohio law allows candidates and other citizens to file a complaint for allegedly false slogans, prompting a state election commission hearing and public scrutiny of advocacy groups’ or individuals’ claims in the middle of a campaign. Justice Anthony Kennedy, a Republican appointee, speculated that calling in a
group’s leaders “to justify what [they’re] going to say” could impinge on free speech rights under the U.S. Constitution’s First Amendment. A deadly 2013 fertilizer warehouse explosion in Texas that claimed at least 14 lives could have been prevented, U.S. safety investigators said on Tuesday. Between 40 and 60 tons of ammonium nitrate exploded 22 minutes after a fire broke out at the West Fertilizer Co. warehouse on April 17, 2013, leveling a neighborhood in the town of West, 70 miles southwest of Dallas. The ammonium nitrate, which the company supplied to farmers to use as fertilizer in the region, was stored in wooden bins within a wooden building that did not have a sprinkler system, said Rafael Moure-Eraso, chairman of the U.S. Chemical Safety Board. If those factors had not been in place, the disaster
probably never would have happened, Moure-Eraso told a news conference about the board’s preliminary findings. The board said the state of Texas and federal regulators had much to do to strengthen rules to prevent explosions like the one in West, which injured 236 people. Volunteer firefighters battling the blaze did not know the risks they faced from fertilizer stored at the warehouse, because of lax regulation of volunteer training and inadequate preparations for fires at chemical facilities, the board said. The board also said that safer blends of ammonium nitrate that could prevent explosions should be considered, in addition to tightening standards at chemical warehouses. REUTERS

For me, it makes me want to down a giant vodka smoothie, especially when young children are involved. However, the show runners at “True Tori” (as well as the publisher of Us Weekly in a timed cover story) think mining Dean McDermott’s cheating on wife Tori Spelling is hot stuff indeed. On last night’s premiere of Lifetime’s “True Tori,” McDermott comes clean about having an affair in December with a 28-year-old in a filmed (!) marriage therapy session with Spelling. “My worst nightmare is what I did. Absolutely, I cheated on my wife,” he tells the therapist. “I wasn’t attracted to her. It was just like a warm body. Sex was an escape, just like drugs and alcohol.” But then he kind of blames
the affair on his bad sex life with Spelling. “We had sex once every two weeks. It wasn’t fantastic,” he said of what occurred in their marital bed. The two are parents to four children — Liam, 7, Stella, 5, Hattie, 2, and Finn, 20 months.

In “Transcendence,” Paul Bettany’s character is the first to raise concerns about plans to upload the consciousness of his friend (Johnny Depp) onto a computer as his body fails him. And apparently, in real life it takes much less than that to get Bettany worried about technology. How plausible is the technology in this film? Interestingly enough, I went to see a man at Caltech, one of the foremost neuroscientists in the world. He’d read the script, and I said, “Look, I’m just wondering, how far-fetched is this idea?” And he said, “Thirty years.” In 30 years we’ll upload a human brain into a computer, like you would a song onto an iPod. And I went, “But that’s immortality,” and he went, “Yes.” And this guy isn’t
a kook. He believes, as do most neuroscientists in the world, that our future is inextricably linked with machinery, and that is the next stage in our evolution. How do you feel about that concept? I don’t know, I think I feel rather like [my character]: a little concerned about the whole idea. Are we human at that point? Probably not. I mean, it would be the first organism in the history of this planet — which has seen 98 percent of the species that have lived on it wiped out and succumbed to evolution — that opts out of that cruel process. “The Americans” thrives on never quite revealing exactly what motivates its various spies and government agents. Who can be trusted, and who has a hidden agenda? While Noah Emmerich’s Stan Beeman navigates the FBI, his counterparts in the Russian Rezidentura have a new face in their midst: Oleg Burov, played by Costa Ronin. Oleg had one of the show’s finer introductions: He missed a summons from Rezidentura head Arkady Ivanovich (Lev Gorn) because he was listening to American music too loudly on his headphones. Arkady was quick to write him off as a rich man’s son using his connections to get ahead, but Oleg has proven resourceful. West Elm has gone local. That is, six of the national homegoods chain’s stores added items from several local artisans, one of which is Boston’s Fenway store. “Our local assortrtment really brings that sense of community into our store,” says Chris Thibeau, West Elm Fenway’s general manager. “The he response has been overwhelmingly positive. Our customers are so excited to see these goods in our store and have been eager to share recommendations of their favorite makers with us.” One such local company is Plum Island’s Culinarium, which crafts kitchenware from recycled and renewable materials. “We get a lot of requests from local customers who would like to view our products in a brick-and-mortar store,”
says Culinarium’s designer and crafter, Jordan Castro. “We’ve been working hard to grow our business, but we have also been very careful about the partnerships that we form.” The Seaport’s Uncommon Green, which makes glassware etched with street maps, is another local company the Fenway store now stocks. “We’ve found that people really connect with our products when they see them up close aand hold them in their hands,” says Uncommon han Green designer and G ffounder Brian Johnson. “So, to partner s with West Elm and w have our designs seen h there is an incredible th opportunity to engage opp with a bigger audience right here in our hometown.” Besides boosting business, both Johnson and Castro also find the partnership creatively inspirational. “Seeing our brand amongst so many great products is a strong motivator to keep us on our toes and inspires us to take our game to the next level,” says Castro. “Being on the shelves in the Fenway store is the best kind of validation that we’re doing something right,” adds Johnson.

Itâ&#x20AC;&#x2122;s a disease that takes the lives of about 4,000 women in the U.S. every year, but the good news is that unlike most cancers, cervical cancer is almost 100 percent preventable. Nearly all cervical cancers are related to HPV infection, which is spread through sexual contact with an infected person. Studies detect HPV in well over 90 percent of women who are diagnosed with the disease â&#x20AC;&#x201D; although conversely, many people have been infected with HPV but will never develop cervical cancer. â&#x20AC;&#x153;Sixty to 70 percent of sexually active women under 25 have been exposed to HPV,â&#x20AC;? says Dr. Divya Gupta, assistant professor of obstetrics and gynecology at Weill Cornell Medical College in New York City. But she adds that in most of them, the infection will regress on its own, unless itâ&#x20AC;&#x2122;s a more aggressive type of HPV. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s the persistence of HPV infection that can lead to precancer lesions and ultimately cancer,â&#x20AC;? says Dr. Panos Konstantinopoulos, medical oncologist at the Susan F. Smith Center for Womenâ&#x20AC;&#x2122;s Cancer at Dana-Farber Cancer Institute in Boston.

Gynecological screenings at regular intervals are crucial, he adds, because cervical cancer can be detected long before women exhibit any symptoms. In addition to regular pap tests, the Centers for Disease Control recommends HPV vaccinations for girls and boys as young as 11 or 12. The vaccine has shown to be so effective that some experts credit it with the continuing drop in cervical cancer rates in the United States, and say that the vaccine should become standard care Get your pap!
What is HPV? The human papillomavirus infects the cervix, inserting unhealthy genes into cervix cells. Even if you clear the infection, thereâ&#x20AC;&#x2122;s still a risk for developing cervical cancer down the road because those genes can linger, says Dr. David Hyman, clinical oncologist at the Memorial Sloan Kettering Cancer Center in New York City. Doctors have a very high success rate treating the disease, however, because the pap test is such an eďŹ&#x20AC;ective screening tool, says Hyman: â&#x20AC;&#x153;It tends to detect the disease early when it can be cured.â&#x20AC;?
in developing nations, where the disease is on the rise. Concerned about falling vaccination rates between 2011 and 2012, the CDC issued a statement in July saying that the HPV vaccine is â&#x20AC;&#x153;safe, effective and grossly underutilized,â&#x20AC;? and warned that if vaccinations in the U.S. donâ&#x20AC;&#x2122;t increase, an additional 1,400 people could die from the disease annually. Although most doctors recommend the HPV vaccine as a safe, effective tool for preventing cervical cancer, some people are suspicious of vaccines in general, and some say that vaccinating teens as young as 11 or even 9, in some high-risk cases, might give kids a false sense of security that could encourage them to engage in unprotected sexual activity. A study published in Pediatrics, however, found that most of the 13- to 24-year-old study participants said that they still think itâ&#x20AC;&#x2122;s important to practice safer sex even if theyâ&#x20AC;&#x2122;d had the vaccine, and most were aware that the HPV vaccination doesnâ&#x20AC;&#x2122;t protect you against other STIs. And as Hyman points out, â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s important that the vaccine be given before teens become sexually active; once they become infected, itâ&#x20AC;&#x2122;s too late.â&#x20AC;? of hilarity, for they have to make up and/or misrepresent those “facts” or get them from fossil fuel industry sources, who made them up. However, Ward went on to even greater comedy when he claimed that climate scientists lost their raw data — a truly laughable conspiracy theory promoted five years ago by certain right-wing organizations. Bruins rip Red Wings NHL. The Bruins used a dominant first period to beat Detroit, 3-0, in Game 3 Tuesday. Detroit fans booed Bruins forward Milan Lucic every time he touched the puck at the outset of Tuesday night’s Game 3 but their resentment quickly shifted to their own team as the Red Wings turned the puck over again and again in the first period. Lucic and the B’s did not hesitate to capitalize on the Red Wings’ early miscues at Joe Louis Arena, coming away with a 3-0 victory. They took a
2-1 series lead. Game 4 is Thursday in Detroit (8 p.m., NESN). Nine minutes into the first period, Red Wings goaltender Jimmy Howard and the Detroit defense seemed convinced Bruins defenseman Dougie Hamilton was going to dish off the puck on a power play but the 20-year-old kept it for himself and beat Howard over the glove to put the B’s up, 1-0, early. The Red Wings also failed to put a body on a streaming Jordan Caron, fresh off the bench, late in the first period and Caron made Detroit pay with a rebound goal. It was Caron’s first career playoff strike.

The Bruins took advantage of sloppy Detroit play, particularly early Tuesday night, as the Red Wings had eight giveaways to just one for the Bruins. Boston had 34 shots on net in Game 3 while the Red Wings mustered just 23 shots on Tuukka Rask.
Boston outshot the Red Wings, 11-4, in a dominant opening frame. Patrice Bergeron finished off Detroit with an empty-net goal with just under two minutes to go. The Red Wings tried to mix and match lineups late in the game but it did not prove fruitful. Bruins goaltender Tuukka Rask turned in his second straight strong effort as he stopped 23 shots in the shutout win. Rask had 34 saves and allowed just one goal in the Bruins’ 4-1 Game 2 win last Sunday. Detroit’s last true opportunity to mount a comeback in Tuesday’s game came 10 minutes into the third period as they owned a power play, but Boston’s defense held firm one more time. Brewers (15-5) It was a bit of surprise for the Brewers to get off to such a hot start, but they’ve been able to maintain it. It was expected that their offense would lead the way, but their pitching has actually carried them as they have the second-best ERA in the NL at 2.66.

Oakland has continued its impressive start to the season by winning seven of its last 10 games and has posted an AL-leading plus-31 run differential.
Despite all the off-field distractions surrounding Yasiel Puig, the Dodgers have won six of their last 10. Give them credit for going 8-3 on the road thus far.
After 20 games the Giants have averaged four runs per game, which is surprisingly good for just 11th in the NL. Can they keep pace with the Dodgers out West?
Toronto is hanging in there with the rest of the AL East after three weeks, despite going just 3-3 at home. Their pitching has been better than advertised.

The Braves haven’t done much offensively this year, scoring an NL East-low 76 runs, but their pitching and defense has been exceptional.
Most know what a great and young pitching staff the Cards have, but it’s their offense that might be worth watching now as they are averaging 3.7 runs per game.
Through the first three weeks of the season it has been the Nats’ offense that has caught people’s eyes as they’ve averaged 4.40 runs per game, the third-best mark in the NL.
Chicago has scored the most runs in the AL, but their pitching has also allowed the most runs. Now Chris Sale is said to be going on the DL, which is a huge blow.

The Rangers have averaged 4.30 runs per game, which is good for sixth in the American League. They’ve done this without Adrian Beltre, who is on the DL.
The big question with the Yanks has been whether or not they can stay healthy? Tommy John surgery has been recommended for starting pitcher Ivan Nova.
Colorado has used Coors Field to its advantage as the Rockies have gone 7-3 at home. Overall, the Rockies have scored 114 runs, the best total in all of baseball.
Nothing has really stood out for the Mets. They’ve simply played consistent baseball — something that we haven’t seen in Queens in several years.

Lackey seeking redemption The Red Sox and Yankees continue their three-game series at Fenway Wednesday (7 p.m., NESN) as the Sox will send John Lackey (2-2, 5.25 ERA) to the hill to face New York’s Michael Pineda (2-1, 1.00 ERA). Lackey fell hard in his lone outing against the Yanks this season, a 7-4 loss on April 12, in which he allowed a career-high four home runs. A secure right-of-way is necessary for this project. Acquisitions in fee and permanent or temporary easements may be required. The Commonwealth of Massachusetts is responsible for acquiring all needed rights in private or public lands.
