Brady’s four-game suspension upheld by NFL; court next? Deflategate. New information was released Tuesday that said the Patriots QB destroyed his cellphone. Patriots quarterback Tom Brady could see more of the courtroom this fall than he might see the playing field at Gillette Stadium as the NFL on Tuesday ruled that it will uphold the fourgame suspension given to Brady in connection to his “general awareness” that footballs were underinflated during this past January’s AFC Championship Game against the Indianapolis Colts. The National Football League Players Association (NFLPA) had implied previously that it intended to take the NFL to court regarding the matter if Brady’s entire suspension was not entirely wiped out. ESPN reported Tuesday that Brady has, indeed, authorized the NFLPA to go to federal court to attempt to have the suspension overturned. Brady and the NFLPA appealed the suspension on June 23 at the NFL’s offices in New York. The league likely upheld the suspension because Brady is said to have destroyed his cellphone, information that wasn’t made available until Tuesday. Per a league statement: “On or shortly before March 6, the day that Tom Brady met with independent investigator Ted Wells and his colleagues, Brady directed that the cellphone he had used for the prior four months be destroyed. He did so even though he was aware that the investigators had requested access to text messages and other electronic information that had been stored on that phone. “During the four months

the investigators had first sought electronic information from Brady. “Based on the Wells Report and the evidence presented at the hearing, Commissioner [Roger] Goodell concluded in his decision that Brady was
aware of, and took steps to support, the actions of other team employees to deflate game footballs below the levels called for by the NFL’s Official Playing Rules. “The commissioner found that Brady’s deliberate destruction of potentially relevant evidence went beyond a mere failure to cooperate in the investigation and supported a finding that he had sought to hide evidence of his own participation in the underlying scheme to alter the footballs.” According to multiple reports Tuesday, Brady told the NFL that he routinely destroys his cellphones for security reasons due to the extent of the celebrity of he and his wife, model Gisele Bundchen. Hot. Boston slammed with heat wave Bostonians: Get ready to be boiled like a lobster, and maybe even battered by thunderstorms this week. The National Weather Service predicts a wide array of weather, from 100-degree saunas to pockets of thunderstorms. Humidity levels will also remain high through Friday. Heat waves kill more people annually than any other extreme-weather event -— that includes wicked big blizzards. The city is advising that vulnerable residents seek air conditioning and that folks call 911 at the first sign of heat stroke. Skies will be sunny and clear, and the hot weather is expected to continue after the advisory ends, with highs in the upper 80s to low 90s continuing through the weekend. So stay hydrated, check on your neighbors and exercise a bit of patience for your fellow T rider, because we are all in this together. Also, keep an eye on your pets, who are probably as

Revere police charged a Swampscott man with killing two puppies, tossing them in a plastic bag and trying to ditch them in Revere. Police have been investigating this instance since the remains of two puppies were found near the Sunoco gas station on the 1700 block of North Shore Road on Nov. 22, 2014. Jason Gentry, 34, was arraigned Tuesday on two counts of animal cruelty and two counts of malicious killing of an animal. He was held on $1,000 bail. Dominick Donovan, 50, of Long Beach, New York, was taken into custody in New York and will face arraignment soon.
Jason Gentry, 35, was arraigned at Chelsea District Court on animal cruelty charges. TED FITZGERALD, EXTENSIS
Assistant District Attorney Vincent DeMore told the court that the bodies of two dogs were discovered in a trash bag behind a Revere gas station on Nov. 22. A necropsy performed by the Animal Rescue League of Boston determined that the dogs — one female and one male — were both approximately 20
weeks old and had been in good bodily condition when they were killed. The dogs were determined to be Donovan Pinschers — a breed created by Donovan. During the course of their investigation, Revere police detectives learned that at the time of their deaths, both dogs had been in Gentry’s care at the training facility he operated, Alpha Canine Performance in Lynn. Donovan arrived at the location in November to transport the animals back to New York. In a post-Miranda interview with police, Gentry made statements indicating that on Nov. 2, the dogs were hanged at the facility until they stopped breathing because each failed to meet the standards for the breed, prosecutors said. Gentry will return to court on Sept. 3. NATE HOMAN @MetroBOS

Obama weighs in on Huckabee ‘Holocaust’ fight Quoted

Criticized. Obama dove deep into the Huckabee controversy. President Barack Obama has come out swinging against former Arkansas Gov. Mike Huckabee’s incendiary remarks that the White House has struck a nuclear arms deal that marches the Jewish state of Israel “to the door of the oven.” Huckabee has been criticized by fellow Republican president candidate Jeb Bush for the don’t-go-there Holocaust reference, and Democrat Hillary Clinton said comments like his are “offensive, and they have no place in our political dialogue.” “The particular comments of Mr. Huckabee are, I think, part of just a general pattern that we’ve seen that is — would be considered ridiculous if it weren’t so sad,” Obama told reporters in Ethiopia, his latest stop on his historic trip to Africa. He noted that GOP Arkansas Sen. Tom Cotton even likened Secretary of State John Kerry, who negotiated the deal to lift sanctions on Iran in return for verifiable restrictions on its nuke program, to Pontius Pilate.

“There are going to be disagreements,” Obama said, “but we just don’t fling out ad hominem attacks like that because it doesn’t help inform the American people.” Huckabee has refused to back down. He stood by his comments, citing Iran’s repeated threats to “destroy” and “annihilate” the state of Israel. “They used the word ‘Holocaust,’” Huckabee told Fox News’ Geraldo Rivera, who urged the candidate to take back the oven remark. After Obama hit back at him, Huckabee tweeted: “I will stand with our ally Israel to prevent the terrorists in Tehran from achieving their own stated goal of another Holocaust.” JOHN A. OSWALD

Kerry warns scrapping Iran deal would mean path to nuclear arms Secretary of State John Kerry intensified efforts on Tuesday to beat back criticism of the Iran nuclear deal and convince U.S. lawmakers that rejecting it would give Tehran
a fast track to a weapon and unlock billions of dollars from collapsed sanctions. Battle-hardened from years of negotiations with Iranians, Kerry sharpened his response to U.S. congressional criticism that the deal’s provisions were temporary and would not prevent Iran from obtaining a nuclear weapon in the long run. ‘Cash bonanza’ for Tehran The Republican chairman of the House of Representatives Foreign Affairs Committee said on Tuesday the Iran nuclear deal gives Iran a “cash bonanza” while weakening Washington’s ability to pressure Tehran. “If this agreement goes through, Iran gets a cash

Ed Royce said in remarks prepared for a hearing on the agreement. “With sweeping sanctions relief, we have lessened our ability to challenge Iran’s conduct across the board. Prison worker who aided New York escapees pleads guilty
A female prison employee pleaded guilty to one felony and one misdemeanor charge in a deal with prosecutors on Tuesday in connection with helping two convicted murderers in their daring June escape from a maximum security prison in upstate New York. Joyce Mitchell, 51, faces up to seven years in prison for her role in the breakout by inmates Richard Matt and David Sweat from Clinton Correctional Facility on June 6. Appearing in Plattsburgh County Court, Mitchell wiped away tears as she signed legal documents before Judge Kevin Ryan. “She realizes that she made a horrible mistake,” her attorney Stephen Johnston told
reporters. Under the plea deal, she will not face any possible sexual assault or rape charges stemming from allegations that she had sexual relations with Matt or Sweat, Clinton County District Attorney Andrew Wylie said at a news conference. Mitchell, the training supervisor in the prison’s tailor shop, pleaded guilty to a felony charge of promoting prison contraband and a misdemeanor charge of criminal facilitation. Video has emerged of Shia LaBeouf having a fight with girlfriend Mia Goth in Germany before getting a lift to the airport from some helpful — and camerahappy — locals. After squabbling with a mostly silent Goth over his backpack — and telling her, “I don’t want to touch you. The video caps off with a very inebriated LaBeouf talking directly to the camera phone, declaring, “This is a contract. You come to Los Angeles. I’ll pick you up in my car. You come and stay at my house.” Don’t do it, guys. It’s a trap.
So Lindsay Lohan really is working on a book, apparently, and if her attempt at teasing it is any indication, it will be inscrutable, unintelligible and nausea-inducing. Fun times! Sara Bareilles is turning melancholy into a musical Interview. The singer takes on a new role: composer for A.R.T.’s latest show. Sara Bareilles is no stranger to the stage, but she’s trying something new with “Waitress,” the new musical at the American Repertory Theater: writing for someone else. Bareilles wrote all the music for the show, which is based on the 2007 movie. The new musical is in good hands all around, with A.R.T. maestro Diane Paulus directing and Tony-winner Jessie Mueller in the lead role. Though it’s Bareilles’ first time developing a musical, she’s enjoying the work, joking, “It’s pretty much the only thing I care about in my life right now.” How did you get involved? I had lunch with Diane Paulus, the director, and we talked about the film, which I had not yet seen at the time, and she asked me if I had any

interest in writing for the theater. I loved that kind of storytelling, so I agreed that I would watch the movie and see if there was any kind of connection there. After I watched the movie, it felt like it was begging to be musicalized, and I fell in love with Jenna’s character and her melancholy and the tone and
the perspective of the film. How has the collaboration process been? This whole project exists based on a deep dedication to collaboration. … I had a song I wrote for one of the earlier drafts of the show that was for our wise, older character, Joe, who owns a diner, and he’s Jenna’s guard-
ian angel throughout the show — a very salty guardian angel, I should say. I wrote a song for him, and the book writer Jessie Nelson so beautifully said to me one day, “I think the beauty of the show is we get to have something only you can give,” and it was the nicest way for her to say, “You can do better than that song.”
That is such a nice way to tell you to do something better. I mean, I’ve been an a-—hole, too, sometimes. It has not been all flowers and roses. But I really believe everyone’s intentions are in the right place, which is good. Did you find it difficult to write for someone else’s voice? I’ve screwed up left, right and center in that. I’ve written duets for the show, and thank God that we have such tal-

I’m just so moved by the way she works and watching her do what she does — it’s like being in a master class everyday. She’s astounding in her presence, in her drive, in her patience, her resilience. Comedy. Ed Helms steps into the shoes of Rusty Griswold.
One more thing
With “Vacation,” Ed Helms becomes the fifth actor to play Rusty Griswold, the son of Clark Griswold (Chevy Chase) from the storied National Lampoon film series. Luckily for Helms, having a different actor in the role for every movie meant he could do whatever he wanted.
Vacation, all he ever wanted
How did you envision Rusty as an adult? I see Rusty as a kind of aspirational character for me. He is relentlessly hopeful and optimistic, in-

He’s always trying to make the best of a terrible situation. Exactly. When he rents the Tartan Prancer [a car], that would bum out anybody. But Rusty spins it in his own mind and convinces himself that it’s awesome. When he gets home to share it with the family, he genuinely believes that it’s awesome. He’s making the best of things to a psychotic degree.
Did they ever tell you what happens if you press the swastika button on the car remote? No. And I won’t speculate. [Laughs] So, it turns out Chris Hemsworth has amazing comic chops as well. Does that just make you angry at the universe? Absolutely. Not fair, right? I mean, I’ve been working my

Every ‘Vacation’ movie featured a different actor as Rusty Griswold. So which one are you playing? It’s all of them! All of them and none of them, in a weird way. I loved all those Rusty performances, and I’m proud to be next in a long line of Rustys, but I didn’t feel beholden to any previous performances — especially with the age gap. Love where you live Step away from the luxury Fort Point condos: Dorchester can house you for way less money. MEGAN JOHNSON @MetroBOS letters@metro.us
Forget oversaturated South Boston or the exorbitantly expensive South End. When it comes to which Boston neighborhood is booming, Dorchester takes the cake. “It scares me a little bit to think about how many people are coming here,” says Leslie MacKinnon, a longtime Dorchester resident and realtor with Gibson Sotheby’s. “You really can get a lot more for your money in Dorchester than other parts other city.” Even though real estate
“It’s a little idyllic place, kind of undiscovered.” Leslie MacKinnon
is so popular in Dorchester, many residents still recognize a distorted view of the neighborhood from outsiders. “Any time someone comes to visit me here, they’re like, ‘Where am I?’ It’s a little idyllic place, kind of undiscovered,” says MacKinnon, who says that she sees families choosing Dorchester over South Boston or Jamaica Plain. “A lot of my buyers have been choosing this side because it’s such good proximity to the Cape, the South Shore. The sweet spot.” Cody and Jessica Klein are just two of Leslie’s buyers who unexpectedly found themselves in Dorchester. Originally from San Diego, the couple stuck it out renting in the transient West End for a couple years before decided it was time to buy. After looking in the typical urban professional favorites like Southie and Jamaica Plain, the expectant couple came across the Savin Hill area of Dorchester and immediately fell in love. “We didn’t have any plans to move to Dorchester,” says Cody, a landscape architect. “We were looking for a certain amount of house. Southie is at that point where it’s getting to or has reached its peak. That’s where everyone wants to be.
Savin Hill is almost there. I think it’s a hidden gem.” With the constant influx of new residents, area businesses are recognizing Dorchester as a reasonably priced spot to open up shop. Alan Issokson and his wife, Wendy, opened Chill on Park ice cream and coffee shop in Dorchester’s Fields Corner neighborhood when a space became available in a building they owned. “You realize, wow, there are some real jewels here — and Dorchester, especially Fields Corner, is one of those jewels,” says Issokson. Since its May opening, Chill has found its niche serving delicious treats to the neighborhood, thanks to the new buyers who just discovered the area and longtime residents who proudly represent it. “There’s retail, residential, schools, libraries, Little League fields, the Fields Corner subway station, commuters,” says Issokson. “All outside our front door.”

Players to watch as trade deadline nears for Sox
SPORTS
Visit Metro.us for more on the controversies surrounding the LFL.
MLB. The Red Sox can still make some noise before the trade deadline arrives Friday at 4 p.m.
With the Red Sox pretty much eliminated from any sort of playoff contention, the team will likely be active at this week’s non-waiver trade deadline, even after dealing Shane Victorino on Monday. The team doesn’t have as many big names to sell as last season when they dealt away Jon Lester, Jonny Gomes, Jake Peavy and Andrew Miller, but they still have a few players they will likely part ways with. On the other side of things, the team could also be looking at getting a head
start on 2016 by trading for a player under team control long-term, specifically a starting pitcher. Here’s a look at three players the Red Sox could be parting ways with, or adding by the end of the week:
1
Mike Napoli, first baseman It appears Napoli’s days in a Red Sox uniform are numbered. The first baseman is in the final year of his contract and having underperformed this year, it seems very unlikely he would be re-signed. With him hitting of late, a team could be willing to take a chance on him given his history and playoff experience. Before being ejected from Monday’s game, Napoli had reached base in nine straight games, while hitting .367 in those contests. The Pirates have been one of the teams to
Can Mike Napoli’s recently improved hitting help the Red Sox bring in a good prospect?
express interest in Napoli.
2
Koji Uehara, reliever While it may seem unlikely, there is a chance the Red Sox’ closer could be dealt even as he approaches age 40. The right-hander has clearly shown he can perform on the biggest of stages and it would appear the Red Sox will be getting calls on him from teams seeking help in the bullpen. The Red Sox’ asking price on Uehara could be in line with what they got back for Andrew Miller — left-handed prospect Eduardo Rodriguez,
who was in Double-A at the time.
3
Carlos Carrasco, Indians starting pitcher The Red Sox have reportedly been eying starters who are under team control and Carrasco fits that criteria. The right-hander is 10-8 with a 4.26 ERA with the Indians this season. Last year, he was 8-7 with a 2.55 ERA, as the 28-year-old has showed signs of being dominant. He is signed through 2018 with team options for 2019 and 2020, which is exactly what the Red Sox want. The

Indians certainly won’t be willing to give up Carrasco for nothing, as he’s one of their better starters, but the Red Sox do have the prospects in their organization to get a deal done. It would not be out of the question to see the Red Sox give up one of their left-handed pitching prospects, as the probability of all three being in the starting rotation next year doesn’t seem to be very high. NFL
NFLPA, Brady’s agent slam Goodell The NFLPA fired back Tuesday afternoon regarding the NFL upholding the fourgame suspension of Tom Brady. Via CBS Sports: “The Commissioner’s ruling today did nothing to address the legal deficiencies of due process ... The fact that the NFL would resort to basing a suspension on a smoke screen of irrelevant text messages instead of admitting that they have all of the phone records they asked for is a new low, even for them, but it does nothing to correct their errors. The NFLPA will appeal this outrageous decision on

behalf of Tom Brady.” Tom Brady’s agent, Don Yee, again tore into the NFL on Tuesday stating: “The Commissioner’s decision is
deeply disappointing, but not surprising because the appeal process was thoroughly lacking in procedural fairness. More importantly neither Tom nor the Patriots did anything wrong. And the NFL has no evidence that anything inappropriate occurred … the appeal process was a sham, resulting in the Commissioner rubberstamping his own decision … the science in the Wells Report was junk … All of the electronic information [we gave the NFL] was ignored; we don’t know why. The extent to which Tom opened up his private life to the Commissioner will become clear in the coming days.” MATT BURKE
