DNA evidence cracked 1992 cold case: DA Technology. Almost a quarter century later, a Dorchester man faces murder charges for the murder of 21-year-old Lena Bruce. After an investigation that spanned more than two decades, officials announced Thursday they have found the man they believe murdered 21-yearold Lena Bruce in 1992. DNA evidence led investigators to James Witkowski, 42, of Dorchester, Suffolk County District Attorney Dan Conley said Thursday afternoon in a press conference. Witkowski will be arraigned at a to-be-determined date, Conley said. Detectives collected samples from Bruce’s

body had been stored and preserved for nearly a quarter century, Conley said. The evidence was a match with a sample collected from Witkowski while the man was serving a sentence for a violation of parole on felony charges, Conley said. Bruce’s death, which attracted wide media coverage in Boston and Philly, and stumped “generations of investigators,” he said. Advances in DNA technology and a policy of collecting DNA swabs from prisoners with felony convictions were to thank for finally cracking the case, he said. “As a result, we have

today what they could not have imagined in 1992,” Conley said. Boston Police Commissioner William Evans said the department continues to work on cold cases and urged witnesses to come forward. “We never forget,” Evans said. Bruce, a 21-year-old Philadelphia native, was found dead in her South End home in 1992, after it appeared she had been strangled and sexually assaulted. At the time, she was the only black woman in her class of nearly 250 students at Tufts University to graduate with an elec-

trical engineering degree, officials said, and she had recently been offered a job with a prominent city firm. It was her roommate who discovered her body after returning from a weekend trip. Her sorority sisters at the Xi Tau chapter of Delta Sigma Theta have paid tribute to Bruce by holding annual candle light vigils and raising awareness about violence against women. The chapter awards a scholarship in her memory every year to support young women of limited means. “In every way, Lena

Bruce was the very kind of person we want in our city,” Conley said. “Had she been allowed to grow into a successful woman, there’s no telling what she could have accomplished.” At the press conference, Conley also called for an expansion of the state’s DNA database, and touted laws in other states like Virginia, which require that police collect DNA swabs after arrests. Two kittens found in a drainage pipe at a construction site in Dorchester who were born without eyelids are headed for surgery to repair their birth defects. A good Samaritan brought Anna and Elsa to the MSPCA in late August. They were scared, filthy and emaciated, and the vets at the MSPCA’s Angell Animal Medical Center found that both cats were born without upper eyelids. This is a rare condition called agenesis, and it renders cats unable to blink or moisten their dry, irritated eyes. If untreated, the condition leads to blindness. Ophthalmologist Dr. Martin Coster is set to remove and transplant tissue from their lower lips to the muscle that controls their ability to

blink and build them new eyelids. “This condition is not common at all,” Coster said. “Over the last eight, nine years, two cases at most per year. It’s a birth defect where they have a lack of development during the maturation of the fetus. Any species could potentially get this condition, but I have only seen it in cats and one dog in my career.” He performed the same surgery last December on Phil, a homeless cat whose story caught the eyes of the world. The kittens sleep with their eyes semi-open and will have to relearn

how to blink once the surgery is over. Each eye takes about an hour to work on. “What I find remarkable is they still are playful and happy,” Coster said. “This condition doesn’t seem to be preventing them from enjoying life, even if it is irritating. You wouldn’t see it affecting them given their behaviors and attitudes.” The kittens are going in for a pre-surgery screening with Coster on Thursday. The procedure will likely cost about $2,000 and the MSPCA is asking folks to help out with the expenses by donating at MSPCA. org/dorchesterkittens. The kittens will be ready for adoption six to eight weeks after the operation. NATE HOMAN

Following the transit snags of Wednesday, the MBTA said it’s taking precautions against Hurricane Joaquin and other future storms. “In advance of the next storm, the MBTA will dispatch work crews throughout the transit system to verify that water pumps are functioning properly and to make sure key drainage areas are clear and unobstructed,” MBTA spokesman Joe Pesaturo said. “During the overnight hours, the MBTA operates observation trains to look for signs of flooding and trees or large limbs that have the potential to fall on the right-of-way. We have tree-cutting crews at the ready if branches or trees begin to lean on or even come close to the overhead power wires along the Green and

Blue lines.” Pesaturo said several of the delays Wednesday were unrelated to the weather. “[Early on], the rapid transit system performed fairly well with the exception of some minor delays caused by varying reasons,” Pesaturo said. “On the Green and Orange lines, trains were held when passengers said they felt ill and requested medical attention. A train at Central was delayed when a rider’s bag got caught in the train door.” A rider pulled the emergency brake in response to the cries for help, which caused delays when the brake did not let go. Almost two months after the death of a 2-year-old and the hospitalization of a 22-month-old in a DCF foster home in Auburn, the state released a report on the causes of death and injury as a case review on the foster mother. Kimberly Malpass’ home in Auburn on Aug. 15. The two were taken to a hospital after Malpass was seen running out of her home screaming about the unresponsive children. Ava was pronounced dead at the hospital. Tests showed that Samara had high levels of salt and was dehydrated. She suffered from seizures, respiratory failure and a high fever. Authorities determined that both children had been exposed to high temperatures for an extended period of time. Responders filed a report with DCF. At the time of the incident, there were four other children living in the house. A third child in DCF was taken to the hospital for evaluation, where officials found no signs of abuse, and authorities placed the child into another DCF foster home. DCF took emergency custody of the children and placed them with relatives the next day. Samara was transferred to long-term rehabilitation on Sept. 3. State and local police are still conducting a criminal investigation. The doctor’s report from the DCF review says that the injuries the two children sustained were from “having been left unattended in a room or vehicle with excessive temperature. pattern concerning as they may have resulted from child struggling against car seat restraints, though pattern of injury not definitive. It is my medical opinion that this represents child neglect.” The report showed that DCF did not follow proper protocol. They did not properly approve Malpass’ entry into the DCF program, take into account her medical history which includes lupus, kidney failure, a Xanax prescription, and Social Security disability payments, the report said. DCF didn’t fully assess the safety of the home before issuing Malpass a license, nor were the Auburn Police contacted to inquire about the home. In March 2015, Malpass allowed her boyfriend to

stay in the home, despite evidence that he used drugs and had been recently charged with unarmed robbery. “The [report’s] findings reveal several instances where DCF staff failed to appropriately assess the foster mother and identify risks to the children in her care,” DCF spokeswoman Andrea Grossman said in an email. “This investigation demonstrates the importance of the initial screening of a foster home, the importance of accurate documentation, the need for vigilant supervision, and the shared responsibility of DCF staff to ensure the safety of children.” NATE HOMAN @MetroBOS

Gunman opens fire at Oregon college campus in mass killing Gun violence. The massacre is the latest in a series of mass shootings at schools. A gunman opened fire on Thursday at a community college in Oregon, killing 13 people and wounding some 20 others before he was shot to death by police, in the latest mass killing to rock a U.S. school, state and county officials said. There were conflicting reports on the number of dead and wounded in the shooting rampage at Umpqua Community College, which began shortly after 10:30 a.m. local time. The state’s attorney general told the local NBC affiliate that 13 people had been slain, 20 wounded and the shooter killed. The office of Ellen Rosenblum

did not immediately return calls seeking comment. Governor Kate Brown said the suspect was a 20-year-old man but he was not identified further by authorities. CNN reported that four guns belonging to the shooter were recovered from the scene. The killings have fueled demands for more gun control in the U.S. — where some say ownership of firearms is protected by the Second Amendment of the U.S. Constitution — and better care for the mentally ill. Kortney Moore, 18, told local newspaper News Review that she was in her writing class in Snyder Hall when a gunshot came through the window and struck her teacher in the head. Moore said the gunman told people to get on the ground, then asked them

to stand up and state their religion before he started shooting. Douglas County Sheriff John Hanlin said the gunman was slain in an exchange of gunfire with police officers. “It’s been a terrible day,” Hanlin said. Student Brandy Winter, in a posting on Facebook, said she was in a classroom in Snyder Hall, next door to the room where the shooting began, and ran, along with her classmates, when they heard the gunfire. “I ran to the edge of the

campus, down a hill, and waited. From talking with a student in the classroom where it happen, almost every person in the room was shot by a man with four guns,” Winter said. Authorities were combing through the campus, which serves more than 13,000 students, 3,000 of them full-time. Fall term began at the college on Monday. REUTERS

Five things you need to know

No death penalty decision as trial delayed in church massacre

The federal trial for the man charged in the deaths of nine people at a South Carolina church was delayed on Thursday, as U.S. prosecutors told a judge they have not decided whether to seek the death penalty against the accused gunman. stemming from the killing of black churchgoers at Charleston’s historic Emanuel AME Church in June. State prosecutors have said they will seek the death penalty. The decision to seek capital punishment in the federal case will lie with U.S. Attorney General Loretta Lynch, a federal prosecutor said in court in Charleston on Thursday. U.S. District Judge Richard Gergel said he would delay the federal trial proceedings until at least January to give defense attorneys more time to wade through more than 15,000 pages of evidence. Jury selection had been scheduled to start in November. Gergel asked federal prosecutors to alert him of the government’s decision on the death penalty as soon as possible. REUTERS

Benghazi panel may have violated ethics rules: Pelosi

A probe of the Benghazi attacks may have violated congressional ethics rules, House of Representatives Democratic leader Nancy Pelosi said after a top Republican indicated it aimed to hurt Hillary Clinton’s presidential candidacy. Democrats called for the Benghazi panel to be disbanded following the remarks by House Majority Leader Kevin McCarthy, who is campaigning to be the next Speaker of the House. Pelosi told reporters that political efforts by the Benghazi committee, set up last year, could violate ethics laws that ban using taxpayers’ dollars for political purposes. REUTERS

Oregon becomes third state to allow recreational marijuana sales

VW says emission scandal investigations to take months

Peanut plant managers get prison time in salmonella outbreak

Marijuana sales for recreational use began in Oregon on Thursday as it joined Washington state and Colorado in allowing the sale of a drug that remains illegal under U.S. federal law. Oregon residents 21 years and older can buy up to a quarterounce (seven grams) of dried pot at roughly 200 existing medical-use marijuana dispensaries as a new law took effect. Backers hope the law will help curb a flourishing black market, but opponents said it heightens drug use and access by children.

Volkswagen said on Thursday it would take longer than expected to investigate its rigging of vehicle emissions tests, raising the prospect of months of uncertainty for customers, shareholders and staff. After a sevenhour meeting late on Wednesday, the German carmaker’s supervisory board said it would take “at least several months” to complete investigations, including an external inquiry by U.S. law firm Jones Day. As a result, it proposed canceling a Nov. 9 shareholder meeting it called less than a week ago to discuss the crisis. REUTERS

Two former peanut plant managers who testified against their boss in one of the largest food poisoning cases in the United States received prison sentences in Georgia for their own roles in the deadly salmonella outbreak. Samuel Lightsey and Daniel Kilgore were sentenced to three years and six years in prison, respectively, in an outbreak that killed nine people and sickened more than 700 who consumed salmonellatainted peanut butter that originated from the Peanut Corporation of America plant in Blakely, Georgia.

wknd Matt Damon blinds you with science THE FUN STARTS HERE RICHARD PECKETT @MetroBos letters@metro.us

In Ridley Scott’s “The Martian,” Matt Damon is forced to, as he puts it, “science the s—” out of his predicament when he finds himself stranded on Mars after a mission goes awry. If being isolated 140 million miles away from home isn’t bad enough, his character, Mark Watney, is injured with only a limited supply of food and water. But the more-than-resourceful astronaut transforms the research station into a field to cultivate the humble potato, as well as hatch other crafty means of survival. While Watney becomes a folk hero back on Earth, Damon himself might well be responsible for turning an entire generation into would-be science superstars. Being lost in space, again: “The first thing I said to Ridley is, ‘I’ve done this cameo in [“Interstellar,” where] I play a guy who is stranded on a planet by

From cult book to Hollywood screenplay “Drew Goddard, who wrote the screenplay, fell in love with this book. I’ve read interviews with [author] Andy Weir where he said, ‘I just came up with this premise and let the science dictate what happened.’ [Mark Watney, his character,] just does

himself. Then I’m going to take a year and a half off, and then I’m going to do a movie playing a guy who is stranded on a planet by himself. This might be a really bad idea.’ Ridley laughed it off. He said, ‘The movies’ feel and characters are so different. Plus people’s attention spans are so short that by the time this comes out one year later, they’ll have forgotten all about you being in “Interstellar.”’” On his character’s intense

loneliness and isolation: “I would be dead probably within 20 minutes. I mean, I’m an actor, so, ‘Wait, nobody’s going to bring me a coffee?’ It would be suicide. I think the loneliness part is a part that I try to protect in my life. I was talking to a friend of mine a few years ago about technology. There are all these wonderful things that come along with it, but the ability to be deeply reflective is getting lost. It’s almost something you have to practice: putting your phone away and

going for a walk. That’s the way we all used to because usually that’s where the better ideas come from — from being reflective. So a little bit of loneliness is great, but I wouldn’t last very long, no.” Does he “science the s—” out of real life?: “No. [Laughs] I don’t do science in my spare time. If my kids have something to do, I’ll do experiments with them or if they have stuff for school, but otherwise no. I try to read about everything that’s changing and what’s kind of happening in technology. I’m interested in where we’re going and the Ray Kurzweil type of thinking. I love hearing those guys lecture or watching them on YouTube, and trying to guess what kind of world my kids are going to live in. Because it’s changing so rapidly and it’s going to happen exponentially. The life they’re going to live isn’t going to bear that much resemblance to the one that we did, so that’s very interesting.”

Jena Malone has been acting since she was a kid, though even her parts back then — “Bastard Out of Carolina,” “Stepmom,” “Donnie Darko” — tended to be heavy. She’s grown even more serious as an adult. In “Time Out of Mind,” she has the small but crucial role of Maggie, the estranged daughter of a man (Richard Gere) who’s currently homeless.

Dana-Farber’s

Mammography Van October 2015

Maggie is very hostile toward her father. How did you view her anger, which can be extreme? I think I understood her. A lot of people place a lot of blame and judgment on their parents. That’s a really normal, human thing. It’s partly about breaking away at a young age. It’s how you find your own voice. You have to pare down the voices of your parents to find your own, in a weird way. The film only alludes to what went down with Maggie and her father. Do you go deep on backstory or do you just play the moment? I came up with my own [backstory]. I thought it’d be more interesting if I had my own ideas of what happened, and Richard had his. There was this competing thing of, “What do you

How did this change your view of the homeless? The worst thing you can do to another human being is know nothing about them. For me what [this film] did was it shattered as much as it mended inside my heart the idea of realizing you have to see all people as people, regardless of their actions.

remember? I remember this, you remember that.” I think that happens a lot between two people who are upset at each other.

Did you steer clear of Richard during shooting? Sometimes actors do that with other actors. I only met

Richard on set. I met him on film, basically. It was very easy to do my prep work independently and come on the set and feel very comfortable creating. Then Richard and I stayed really far apart from each other, even until the last scene. We didn’t really sit down and talk to each other until we were in Toronto.

‘The Walk’

Director: Robert Zemeckis Stars: Joseph Gordon-Levitt, Charlotte Le Bon Rating: PG

•••••

Joseph Gordon-Levitt plays Philippe Petit, the man who in 1974 walked a tightrope between the Twin Towers, in Robert Zemeckis’ “The Walk.” SONY

There’s a solid reason for “The Walk” to exist and, of course, it’s the walk itself. The story in Robert Zemeckis’ latest was already told in “Man on Wire,” which also chronicled French acrobat Philippe Petit’s storied and stranger-thanfiction tightrope stroll between the Twin Towers in 1974. But footage of Petit’s saunter is virtually nonexistent, and “Man on Wire” was forced to resort to

insistent music and hyperbolic talking heads to conjure up a spell. “The Walk,” meanwhile, has 3-D, IMAX and one of cinema’s most tech-friendly maximalists at the helm. The big centerpiece (at the end, as it were) is not a letdown. Zemeckis creates both a sense of vertigo and a sense of peace, of transcendence. It would be easy to say this capper is all “The Walk” has going for it, but for the record it’s all of a piece, and Zemeckis makes the story his own, which is to say he turns it into one of his proudly cornball triumphs of the eccentric spirit. Zemeckis is one of digital cinema’s best friends, and he

10

knows that all movies are an optical illusion. He’s using tech and the language of populist film to bring the World Trade Center back to life. When Petit first encounters them in person, he touches the side with his nose, as though using his head to create a mind-meld; all we, as voyeurs, can do is look. But Zemeckis is also recreating the walk itself — another ephemeral thing that once lived only in pictures and rapturous accounts, that couldn’t even fully come back in a doc as loved and award-gobbling as was “Man on Wire.” “The Walk” is at once thin and mighty — redundant in some ways, yet quietly, even tragically, bittersweet. Matt Damon uses science to stay alive in Ridley Scott’s oddly upbeat (but still grim) “The Martian.” GILES KEYTE

Did Ridley Scott just make a feel-good rabble-rouser with an ABBA montage? It’s often easy to forget that the director’s name is even on “The Martian.” Scott tends toward the doom and gloom, even when making blockbuster entertainment. His latest — set, like the pitiless “Alien,” in space and, like the downer “Blade Runner,” in the (near) future — meanwhile, is downright utopian, encouraging us to cheer and whoop, and usually to laugh. In a way, it’s the most surreal movie of the year. Then again, look deeper, and it’s not that cheery. Matt Damon plays Mark Watney, an astronaut stranded on Mars after a freak storm seems to have left him dead. But Mark

‘The Martian’ Director: Ridley Scott Stars: Matt Damon, Jessica Chastain Rating: PG-13

••••• has real pluck, and the good vibes go a long way to masking what a harsh and dispassionate film this is. It’s unabashedly pro-science in a way that’s hugely happy-making. But it also understands that science is hard and takes time, that experiments routinely fail miserably. It’s another tough, merciless, godless Ridley Scott movie about the indifference of the universe. It’s just fun this time.

"The Affair" was one of the more unusual TV shows to premiere in the last year, seeing as it was told from the shifting perspectives of two participants in an affair, Noah (Dominic West) and Alison (Ruth Wilson). The series played with audience expectations about who was telling the truth, while also showing differing versions of how Noah's wife, Helen (Maura Tierney), and Ruth's husband, Cole (Joshua Jackson), reacted to what was happening. The show returns this Sunday with a new twist: We’ll now be getting Cole

and Helen’s perspectives as well. We talked to Jackson about how Cole is dealing with betrayal.

The journey for all the characters in the second season is dealing with the “Holy s—, what do we do now?” Each one of them has their own version of that. His version is essentially to start from a totally clean slate in life

Where do we find Cole this season?

We find him in a not very good place. The aftermath of everything that went down last year has left him kind of bereft.

“One of the things that was challenging as an actor in the first year for myself and Maura, for everybody who was outside of their own perspective, was being essentially a memory. That was fun and interesting and you get to paint in broad strokes, but it’s nice to be able to go inside of Cole’s perspective now, because we all see ourselves as more competent in ways that we’re not, and more frail in ways that maybe we’re not. And so you get to have a sense of his own sense of

his weakness and insecurity and all of those things that make us human, which you didn’t really get a sense of last year. He was always very strong and very direct and very composed. It’s nice to be able to break all that stuff down and speak to how he feels on the inside.”

FOUR BEST NFL TEAMS ARE ALREADY KNOWN You know what they say. The cream always rises to the top. And right now, at least, the best teams in the NFL have wasted no time proclaiming themselves title contenders. Entering Week 4 of the NFL season, there are seven undefeated teams. While not all seven are equally talented, the “best of the undefeateds” — as I called them this week on my podcast — have certainly been established. And yes, the New England Patriots are one of the best, as they enter their bye week. Only three games in, however, it seems somewhat impossible to name the top dog — a No. 1 in the power rankings, if you will. So how about this? I’ll one-up your weekly power rankings by telling you that the top four teams in the NFL right now will be the last four teams standing in January during Conference Championship weekend. Those four teams? The Patriots, Green Bay Packers, Arizona Cardinals and Denver Broncos. They’re the best of the undefeateds in the NFL through three weeks. And they’ll be the best four teams vying for a chance to play in Super Bowl 50 this winter. The other three undefeated teams — the Cincinnati Bengals, Atlanta Falcons and Carolina Panthers — are all pretenders, in my opinion. For one, Cincinnati’s schedule isn’t the easiest, as their next three games are against a hungry Kansas City Chiefs team, a Seattle Seahawks club that’s just getting their groove back, and a Buffalo Bills squad whose defense should give Dalton fits at the Ralph. Meanwhile, the Falcons might have the easiest schedule in football, and with their next six games against Houston, Washington, New Orleans, Tennessee, Tampa Bay and San Francisco, they could be looking at a 9-0 record entering a Week 10 showdown with the Indianapolis Colts. Still, it’s the Falcons quarterback — Ryan — who is guaranteed to make several mental mistakes and bad throws in every game, that will even-

tually cost them. Oh, and as for Carolina, I can’t take the Panthers too seriously right now

because the three teams they’ve beaten so far are Jacksonville, Houston and a Saints team without Drew Brees. So that leaves us with Tom Brady, Aaron Rodgers, Carson Palmer and Peyton Manning. The best four now. And the final four when it’s all said and done. I know, you’ve already given up on Manning. You think he can’t throw anymore. But his offensive line will improve, and the reality of his arm strength isn’t the same as what some want to be the reality. He’s got enough brains and weapons to get to the AFC Championship and lose to the Patriots. Yes, I said “lose to the Patriots.” Because there’s nobody I’m taking in this league over Brady. Not right now. Not even over Rodgers, who some have recently tried to compare to Michael Jordan in his prime.

Wait, what? Jordan won six championships. Two sets of three-peats. And he was the Finals MVP in all of them. Rodgers has one championship and one MVP. If you’re going to compare Jordan to any NFL player (not even sure why you would), you better compare him to Brady, who has four championships and three Super Bowl MVPs. No disrespect to Palmer, who I’ve somewhat left out. If he can stay healthy, he’ll get Larry Fitzgerald over 1,000 yards receiving. Combined with their playmaking defense, the Cardinals will be at Lambeau for the NFC Championship. I know. It’s only Week 4, and a whole lot could change between now and Conference Championship weekend. But in my eyes, the cream has already risen to the top.

Another week, another millionaire crowned, but the story of this lineup is a bit different than the previous two weeks. First, the 252.1 point total was by far the highest so far this season for the Sunday Million. Secondly, this is a lineup that owner Cookies248 had a clear strategy of utilizing two highvolume, low-cost running backs. The real difference maker though was in lieu of spending up at wide receiver, he paid for the top defense and kicker. This is an unusual practice in most tournament winning lineups:
