An appeals court upheld a lower court ruling allowing Yale University to keep a painting by Vincent van Gogh, denying a request by the great-grandson of a Russian art collector to argue his ownership of the painting. The 2nd U.S. Circuit Court of Appeals in New York ruled the arguments made by Pierre Konowaloff, the great-grandson of art collector Ivan Abramovich Morozov, lacked merit. In an effort to clamp down on Boston’s free-for-all street performance rules, two city leaders were considering a new permitting policy for artists who use sidewalks and parks as stages. All the city’s guitarstrumming, bowling pin juggling, breakdancing public entertainers would need to buy $40-per-year permits to practice their craft, according to an idea scheduled to be pitched at a City Council meeting on Wednesday. Keytar Bear, for one, was not pleased to hear the news. “This is an effort to take away the soul of Boston, and to kill Boston culture slowly,” the beloved bear costume-wearing performer told Metro. “Buskers generally are seen as a threat anyway and always have been. We don’t conform to the norms of society. ... Whoever’s at the very top of the pyramid doesn’t like that.” Councilors Salvatore LaMattina and Bill Linehan were behind the idea. LaMattina told Metro the proposal — modeled after permitting policy in Cambridge — came after hearing complaints about

dancers near Faneuil Hall, whom he described as loud and intimidating. “This particular group is very insulting to people,” he said. “It’s nothing against street performers.” He said he couldn’t identify exactly which group had been performing in the space and said he hadn’t attempted to reach out to them. The dancers were not there on Tuesday. The ordinance as proposed would allow Public Works to revoke permits through a hearing process. It would restrict performers from setting up within 50 feet of one another or within 100 feet of a hospital or a school, library or church in session. The MBTA requires musicians to have permits to perform in T stations. They cost $25. Artists have to apply for permits to perform at Faneuil Hall, which are issued by the marketplace’s owners. Otherwise, street performers have been allowed to set up on sidewalks, parks and other public places in the city without permits since the mid-2000s. Stephen Baird, executive director of Bostonbased nonprofit Community Arts Advocates, told Metro he supported the councilors’ idea because it could make street performance in Boston more orderly.

“Some people are so loud and so crazy they get everybody mad. When that happens they crack down on everybody,” he said. “I do like a permit system because it’s something you can show a police officer.” One free speech expert, meanwhile, said he strongly opposed the idea. “This is just the latest in a long series of efforts by governments to try to capitalize and profit from actions and activities that are quintessential examples of free speech,” Harvey Silverglate, a Boston-area First Amendment lawyer, told Metro.

Wizard casts spell of calm at Boston’s rock ’n’ roll shows Odds are, if you’ve gone to concerts and festivals in Boston, you’ve seen the Wizard standing guard. NATE HOMAN @MetroBOS

nate.homan@metro.us

By the time the fan decided to make a run at Debbie Harry, the Wizard was on him before house security saw him on their crystal ball. “She was on her first solo tour, and she came down the back stairs, across an empty dance floor before the show,” said private security guru Jeff Freedman, owner of Boston’s famed Wizard Security. “This kid jumped over the railing and tried to grab her. So I took him out.” From that moment on, Freedman set out to work as a conductor of crowd control in Boston’s nightclubs and concert halls. His love of hard rock combined with an

unflinching drive to protect the party kicked off the ongoing voyage of Wizard Security, a highly recognizable, rigorous defender of music lovers. If you’ve found yourself in a Boston-area mosh pit in the last few decades, chances are you’ve run into the 5-foot-5 Methuen-born biker, pilot, vendor and smallbusiness owner. Despite his small stature, he’s hard to miss. “Tossing people off stage back into the crowd is the fun part,” Freedman said. “That never gets old. If it’s a punk or metal or hardcore show, that’s the part that stage divers live for. I know the difference between someone coming over the barricade to have fun versus someone looking for trouble. It’s very rare I have to get physical with people.” It was 1984, and a week after he decked the dude who ran at the Blondie frontwoman, the

He’s incredibly calm in chaos. The bands love him because he runs it like we are on the same team. Everybody who is involved in that world has seen him in action.” Today, he is 70, has business degrees from Boston University, Tufts and UMass Boston, and is still running the safety at hundreds of shows a year. His watchful eye keeps bands and patrons safe from creeps, rowdy drunks and other troublemakers while keeping the well-behaved audience members hydrated, tossing water bottles to those who seem ready to wilt. “We love having him,” said Clay Ferland, Middle East Club general

They look out for him and he looks out for them at the same time.” He had the name Wizard Security before the long, gray ponytail and the distinctively large rings for each knuckle and grew into the image

of a hardcore Gandalf who befriends as many acts as possible. “I was working the downstairs bar,” Ferland said. “He wasn’t even working that night, but Lars Frederiksen and The Bastards were playing. old friends, so he was a volunteer bodyguard and a fan in one.” One night circa 1990, Freedman said, Pantera was playing The Channel and the adrenaline in the room hit the stratosphere. A bald-headed crowd surfer went headhunting, looking to clobber all in his range. The Wizard worked his magic to defuse the situation through the power of laughter instead of meeting the aggression head on. “He was looking to brawl, and I saw him from my position on the stage between the monitors,” Freedman said. “He

looked like a bulldog. He didn’t have any hair for me to grab onto, so I grabbed him by the ears and gave him a big wet kiss. The crowd laughed, the band laughed and the hostility went away right there.” Freedman rarely speaks about his endeavors as the Wizard Security guy to the media. He said that more often than not, interviewers want to hear about the blood and gore of the gig. “Good security means nothing happens,” Freedman said. “If you’re fighting fires all night, you haven’t done your homework. The majority of the problems can be avoided

or addressed with a quick word, telling folks to cut it out.” He has safeguarded punks like Rancid and GBH, hardcore bands like Converge and the CroMags, boy bands like 98 Degrees and LFO, rappers like Ghostface Killah and Slaine, hemp-worshiping hippies at Freedom festivals and legends like Tom Jones and Johnny Cash in tiny sweatbox clubs and open air festivals alike. Somehow, he still has decent hearing, all of his teeth and no plans of retiring. “The real show is never on stage,” The Wizard said. “It’s in the crowd.”

BRIEF U.S. ends probe of Wal-Mart on “Made in USA” logos The Federal Trade Commission, which enforces laws against deceptive ads, said Tuesday it had closed a probe of Wal-Mart Stores Inc. after the company addressed the problem of products advertised as “Made in USA” that were not. The FTC closed the probe without action after Wal-Mart dropped all “Made in USA” logos from products on its website, the FTC said in a letter to the company that was posted on the agency’s website. Wal-Mart has since redesigned its “Made in USA” logos for some products to better indicate how much of the product was made domestically and how much was made overseas, the FTC noted in its letter. “Based on your actions and other factors, the staff has decided not to pursue this investigation any further,” FTC staff attorney Julia Solomon Ensor wrote in the letter. The problem arose as WalMart sought to fulfill a pledge made in 2013 to buy an extra $250 billion in U.S.-made goods over a decade to support U.S. manufacturing jobs. The world’s largest retailer by revenue

has faced criticism by unions and others that its low-cost business model was a big factor in pushing manufacturing jobs offshore. The watchdog group Truth in Advertising found 100 instances of mislabeled products in June and raised them with the company. The group found another 100 in July and took the information to the FTC, said Legal Director Laura Smith. “In light of the company’s steps to address the issues, we’re not surprised that the investigation has been closed,” Smith said. Wal-Mart said it was pleased with the decision. “We’re committed to reviewing and strengthening our processes,” said spokesman Kory Lundberg. REUTERS

Tesla slammed by Consumer Reports annual reliable survey

BRIEFS Apple Music hits 6.5 million paid users: CEO Tim Cook Apple Inc.’s music streaming service has netted more than 6.5 million paid users, the tech giant’s chief executive oďŹƒcer, Tim Cook, said Monday. Speaking at a technology conference organized by The Wall Street Journal in Laguna Beach, California, Cook said an additional 8.5 million people are participating in a free trial of Apple Music. That gives it

more than 15 million users in total, which Cook described as a successful debut. “I’m really happy about it, and I think the runway here is really good, Cook said. Released in June, Apple Music is the company’s attempt to carry its dominance of digital music through its iTunes store into the era of music streaming pioneered by Spotify and others. Apple is allowing users to test its service free for 90 days;

the trial period elapsed for the ďŹ rst users earlier this month. Analysts have predicted Apple’s service will ďŹ nd a strong following due to the vast installed base of iTunes users, but few think the iPhone maker will eclipse other music streaming companies. Industry leader Spotify has more than 20 million paid subscribers worldwide, the company has told Reuters. In a wide-ranging conversa-

tion with Gerard Baker, editor in chief of The Wall Street Journal, Cook also touched on Apple TV, which recently received a longawaited update. A new version of the set-top box featuring apps and expanded search features will be released later this month, but the product does not include a streaming TV service, which industry executives say the company is exploring. Owners of vehicles with advanced fuel-saving technology and digital multimedia systems, including the Tesla Model S sedan, are hurting reliability, Consumer Reports magazine found in its annual survey of vehicle reliability. There is “an emerging trend of increased troubles with many vehicles that use new transmission technology to boost mileage, the magazine said Tuesday. The latest reliability survey was to be presented by the magazine’s editors at a meeting of Detroit’s Automotive Press Association. One of the most technologically adventurous cars on the market, the Tesla Model S, registered a worse than average reliability score based on survey responses from 1,400 owners, Consumer Reports found. The battery powered Model S P85D was recently lauded by the magazine’s editors for racking up the best scores ever in its performance tests. But owners complained of rattles, leaks and problems with the charging equipment, drivetrain and center console displays, the magazine said. Complaints about balky multimedia “infotainment systems continue to plague several major automakers, in-

And there’s nothing overly cutesy or twee about Elsie. What gives?

About the only ways it overshot were with a device that gives eyesight to the blind (sort of) and another that records dreams — but those, surely, are en route.

Bostonians have long known about the sprawling historic homes in Dorchester, the city’s largest neighborhood. But it’s not every day they see a single-family home in the area sell for more than $1 million. Brian Piccini’s (now former) home at 92 Grampian Way is a three-bed, three-bath Garrison-style home in the Over the Bridge section of Savin Hill. The home was initially listed for $999,000, and after a competitive bidding war is under conract for $1.01 million. The sale is expected to be finalized Oct. 30. The Boston restaurateur, who owns dbar, Boston Chops and Deuxave, purchased the home with his former partner in 2006 for $650,000. (He bought out his ex’s share of the home when they split.) When rumors surfaced that he was going to sell the home about six months ago, he realized the property was generat-

ing a lot of interest. “I had dozens of notes and offers in my mailbox,” says Piccini, who is downsizing with his partner, Alex, for the South End. “Somebody even called my publicist with an inquiry.” Piccini credits the frenzy of interest to several factors: The house was fully renovated five years ago, and a porch was added. There are four off-street parking spaces, including two in the garage. And then there’s the very private, fenced-in backyard, complete with lush, mature trees. There’s also a two-bedroom townhouse attached to the home, which Piccini lets sit vacant. (This is why the home was listed as both single and multifamily.) In fact, Piccini’s home is so identifiable with Savin Hill that it’s even the homepage photo on the neighborhood’s Wikipedia page. A handful of Dorchester homes have been listed for more than $1 million, but 92 Grampian Way is the first single-family home to achieve the distinction of selling for more than seven figures. Last week, before the house went into contract,

Two sides Many locals agree the area has been undervalued for quite some time. Leslie MacKinnon of Gibson Sotheby’s Savin Hill office says the area is finally receiving the attention it deserves. But with that attention come additional concerns. “I think there’s [mixed] feedback about the increasing home values in Dorchester. As one of Boston’s largest neighborhoods, which represents many different households, there’s a concern about housing stock becoming too expensive for those who have been here for a long time,” explains MacKinnon. “On the other hand, many feel that Dorchester has been overlooked for decades and is now finally being recognized for its magnificent housing stock and vibrant community.”

Piccini’s broker predicted 92 Grampian would be the one to snag the mighty honor. “The initial response was just so positive,” says Justin Green of In Realty. “There were multiple people interested, and the buyer came in really strong.”

Deflategate revenge? Just another game in the win column if you ask the Pats. They are 5-0 for the first time since their ill-fated 16-0 regular season in 2007, which came after Spygate. Memo for the NFL: Offseason controversies lead to undefeated Patriots teams.

If we just copy and paste “The defense is as good as any defense we’ve seen, but the offense is miserable,” in here every week, does that work going forward? The optimistic take is that the Broncos finally got the run game going with 152 yards on the ground.

Who needs Ben Roethlisberger to Antonio Brown when you have Landry Jones to Martavis Bryant? The Steelers, now 2-1 without Big Ben, are looking more and more like one of the class teams of the NFL once he gets back in the fold. He remains sidelined with a knee injury

Is Ryan Fitzpatrick suddenly a help and not a hindrance to the Jets’ season? If they’re this good on defense, can pound the rock with Chris Ivory and have good quarterback play … well, we’ll know more after they head to Foxborough to face the topranked Patriots.

Rookie Stefon Diggs’ emergence as a receiving threat (216 yards in the last two games) may finally give opponents something to worry about besides Adrian Peterson. And it may be just in time, if teams are going to focus on just shutting down the run like Kansas City did Sunday.

Packers (6-0)

Bengals (6-0)

Panthers (5-0)

Cardinals (4-2)

Falcons (5-1)

Colts (3-3)

Aaron Rodgers began his next two years without an interception at home streak, and the Packers got their closest win of the season with a big goal-line stand. The invisibility of Eddie Lacy has to be concerning; he’s only topped 50 rushing yards twice, and has yet to carry the ball 20 times in a game.

Cincinnati is playing so well they look like the Cardinals do when the Cardinals play bad teams. Andy Dalton is on pace for somewhere between five and six interceptions, less than half what he’s thrown in any previous season. Sign me up. I believe.

The Panthers kept being the team that just wins each week. Greg Olsen is off to a big start as Cam Newton’s best (only?) receiving threat, and caught the game-winner to complete his second 130-yard receiving day of the season. They host the resurgent Eagles on Sunday night.

The Cardinals have lost two games in almost the exact opposite method they’ve won their other four. In Arizona’s victories, Carson Palmer has thrown for 12 touchdowns and just two interceptions. Palmer in the team’s two setbacks has thrown two touchdowns and three picks.

Devonta Freeman is the surprise of the season, but it’s yet more surprising that Atlanta is content with giving him 13 carries, especially considering every other player with a carry fumbled Thursday. After 34 receptions in the Falcons’ first three games, Julio Jones has 15 in the last three.

Indianapolis head coach Chuck Pagano says he “doesn’t regret” the “fake-punt play” the Colts ran Sunday in their Deflategate rematch against the Patriots. Their opponents can only hope he doesn’t regret it enough to run it again, and again, and again.

Revs running out of time to flip into playoff mode The Revs aren’t yet officially in the playoffs with one regular-season game remaining. RICH SLATE @RichSlate

sports@metro.us

After two lengthy winless streaks earlier in 2015, it had seemed like the Revolution (13-12-8) had finally gotten their act together late in the year. Instead, New England heads into its final regular-season match on Sunday (5 p.m., CSNNE) at Yankee Stadium vs. NYCFC (10-16-7) carrying the burden of a new four-game winless streak (0-3-1). Yet again, the Revs had

a chance to clinch a playoff spot last Saturday in their home finale against. Montreal (14-13-6), but they choked in a 1-0 loss at Gillette Stadium that enabled the Impact to make the postseason for the first time in their franchise’s brief history. New England still isn’t in much danger of missing the playoffs since it remains three points ahead of seventh-place Orlando City (12-13-8) with a goaldifferential that is plus-8 better. It would take a monumental collapse — a blowout loss to NYCFC coupled with a lopsided win by Orlando at Philadelphia (9-17-7) on Saturday night. Still, the fact that it has come down to the last match for the Revolution to clinch a playoff

For more Revs and MLS news, visit metro.us bid is shocking, given that a few weeks ago, they were legitimately in the hunt for a top-two seed in the Eastern Conference and a bye. The easiest thing for fans to point out about the Revolution this season versus last season is that they made no moves this summer in the transfer window while in 2014 midfielder Jermaine Jones came aboard and

made an immediate impact that carried them all the way to the MLS Cup. On paper, this club still has plenty of potential and ability but it certainly hasn’t been apparent in their last four games where they have scored a combined two goals. Montreal shut them out for the second time in a month as New England lacked any creativity or confidence in going one-on-one after Ignacio Piatti scored the go-ahead goal for the Impact in the 55th minute. Gillette had the largest crowd ever for a Revolution regular-season game (42,947) on Saturday and needless to say, their supporters deserved better than what they got on the field that night.
