Florida’s sentencing process in death penalty cases violates the constitutional rights of criminal defendants, the U.S. Supreme Court ruled on Tuesday, siding with a death row inmate convicted in the 1998 murder of a fried-chicken restaurant manager. The court’s 8-1 decision means inmate Timothy Hurst, 37, could be re-sentenced, potentially avoiding the death penalty. First, the case will return to the Florida Supreme Court to determine whether Hurst’s death sentence can be upheld on other grounds. REUTERS

A major wrong-way collision shut down a section of Route 128 early Tuesday morning, ABC Boston reported. The collision, which took place around 4:30 a.m., involved two vehicles at Exit 32 in a northbound lane. Two were taken to a local hospital with critical injuries. MATT LEE

A teenager in Brockton was hit by a stray bullet while in his home. According to police, the young man was getting a drink of water in his home when he was struck in the back. “The bullet pierced the wall of the housing complex, hit the boy in the back and exited his body,” ABC Boston reported. “The gunfire outside the complex also hit several cars, leaving residents stunned and shaken.” The teen was reportedly taken to Boston Medical Center and is expected to survive. The shuttered Starlab Studios is throwing benefit concerts for a landlord legal battle. SPENCER BUELL @MetroBOS

Last year, Starlab Studios had to start over. Forced out of its old Prospect Street location two years prior to make way for the Green Line’s planned extension through Somerville, the scrappy DIY music-andarts service set up shop again at a new spot a few blocks away in Union Square. The GLX was coming, and there wasn’t much they could do. Now, after months of renovations in its new headquarters (a cozy, repurposed car garage), Starlab is again facing the possibility of being uprooted, this time via
a contract dispute with a new landlord who, Starlab’s leaders said, has locked them out of the space. But this time, Starlab is fighting back, rallying its community of supporters to help pay for a brewing legal battle. “It’s frustrating,” Richard Hawke, a Starlab leader who runs the studio’s video and photo wing, told Metro. “You put a lot of hard work and effort into trying to build something bigger and better, and something that a lot of people

In January, they plan to host a pair of benefit concerts — the first on Wednesday night at the Middle East in Cambridge, featuring a lineup of acts that have passed through Starlab’s doors over its history, headlined by Boston outfits CreaturoS, Mini Dresses and The Dazies. Starlab’s leaders said they were reluctant to get into the specifics about the legal issues with their landlord. And Metro was not able to get in touch with the building’s owner to ask about the buyer’s plans for the space. But what is public now is that Starlab, since December, has been kept off the premises at their Somerville Avenue location, the fence

BRIEF Fantasy sports industry criticizes proposed Massachusetts limits Efforts by Massachusetts to ban people under 21 from playing paid fantasy sports games and to stop companies from promoting the games on college campuses drew fire on Tuesday from the fast-growing, multibillion-dollar industry. State Attorney General Maura Healey in November proposed rules that also would prevent the
daily paid games from allowing neophytes to compete against highly experienced players; to prohibit fantasy games based on college sports; and to ban professional athletes from playing paid fantasy sports. At a public hearing in Boston, representatives of advocacy groups aimed at combating problem gambling hailed the proposals, particularly the focus on stopping promotion of the contests on university campuses.
“College students that play fantasy sports are more likely to develop gambling problems,” said Keith Whyte, executive director of the National Council on Problem Gambling. Officials from several industry groups at the hearing said they opposed the planned ban on players under 21 and argued against stopping fantasy games based on college sports. “At 18 years old, you are old enough to vote in this country
and make adult decisions,” said Peter Schoenke, chairman of the Fantasy Sports Trade Association, which has some 300 member companies. But the industry representatives gave measured support to the overall approach by Massachusetts, which was more restrained than that of other states. Officials in New York, Illinois and Nevada have characterized the games as illegal gambling and have imposed state-wide bans. REUTERS

This after they had lovingly built a home fitted with a control room, live performance space and common area, crafted by a studio designer for noise-blocking acoustics, Hawke said. “It was an empty box,” he said. “We transformed it.” But Union Square is changing, too. Now twice the neighborhood Starlab has called home, it’s undergoing a massive redevelopment campaign with the promise in mind of a long-awaited subway connection. And in a story that has played out time and
again, artists in Somerville worry that property-flipping developers could squeeze out the creative types — Starlab among them _ that help make the ’Ville the coveted real estate that it is. “Starlab Studios has been a tremendous asset to Somerville,” said Susan Berstler, director of two nonprofit art galleries in the city called Nave and Nave Annex. “It would be a huge loss if they had to leave.” As an arts leader and a Somervillian of 30 years, Berstler said she has learned to only plan six months in advance, because there is no way of knowing how permanent her galleries will be. Her landlord, a patron of the arts, keeps her rent artificially low, she said. But that might not always be the case. “The real estate speculation in Somerville tied to the Green Line Extension is insane,” she said. “The number of people who are getting pushed out of their rental properties is absolutely crazy.”

As the commonwealth takes on the ongoing opioid epidemic, many schools in the Greater Boston area are prepared to administer Narcan in the event of a crisis. So far, schools haven’t had to administer Narcan, according to officials in Quincy and Newton. Other cities that equip schools with Narcan include Cambridge, Concord and Malden. Police in Quincy have been equipped with Narcan for six years, but administration of the anti-opioid varies widely throughout the city and throughout the calendar, according to Quincy Detective Lt. Patrick Glynn. “We could go a week or two without a reversal then have two or three in one day,” Quincy Detective Lt. Patrick Glynn. “It’s sporadic. You can’t pinpoint specific times. We had an unusually low number last month, where we are used to 15 to 16 nonfatals.” Despite the lack of opioid emergencies during school hours, officials said it’s best to be prepared. “We learned a big lesson from China White, a heroin problem in the early 1990s and crack cocaine in the 1980s that we have to be prepared and hit the problem head on,” Glynn said. “We aren’t giving into a stigma — we have sporting events, community events [where an emergency might occur]. In reality, it’s not much different than public facilities equipped with defibrillators or EpiPens. It’s another layer of protection and it is better to have it and not need it.” While many public schools in Massachusetts are expanding their overdose prevention programs

by arming more nurses with the spray, Boston schools have yet to equip their staff with Narcan. “Boston Public Schools is grateful that our city’s first responders are equipped with Narcan should it ever be needed,” Boston Public Schools spokesman Dan O’Brien said in a statement to Metro. “BPS nurses currently do not have Narcan and there is no immediate plan to begin purchasing Narcan for Boston Public Schools.” According to the state Department of Public Health’s October 2015 survey, 133 of the 244 public schools surveyed are equipped with or expect to be equipped with Narcan revival kits by June. And many towns and cities on Boston’s borders are training school nurses to prevent opioid-related deaths. Newton, for example, has put revival kits in every public school, from preschool to their high schools. “School nurses, by design, intervene in emergencies and are
able to administer meds and educate people on meds,” said Newton Public Schools spokeswoman Ruth Hoshino. “As the crisis grows, they are prepared to help when it is needed. This is about the community more than the students, and this is a serious public health issue. We wanted to be a public health model and be prepared as opposed to having to wait until after a tragedy occurs.” The Middlesex District Attorney’s Office has been sponsoring Narcan training sessions since November 2015. District Attorney Marian Ryan has hosted training sessions for school employees from Newton, Cambridge, Concord, Malden, Woburn, Waltham and other nearby towns. Meanwhile, Needham, Lowell, Brockton, Braintree, and Hudson all have standing orders to maintain a supply of Narcan and conduct training sessions, which are expected to move forward in early 2016 . As of August 2015, an estimated 1,256 people died from opioid overdoses, according to the state’s data brief. “It’s not necessarily a focus on our students,” Hoshino said. “This is a public health issue, and we don’t know who visits the facilities. Pre-schools have parents and family, all schools have faculty. When you have a professionally licensed nurse, why wouldn’t they intervene in a crisis?”

David Bowie was a weirdo like us I usually don’t cover music. I love it, I listen to it, and it’s a huge part of my life, but I don’t write about it. Today, there wasn’t really a choice. The news came in late Sunday that David Bowie had passed away from cancer at the age of 69. Celebrity deaths happen all the time, and those of musicians are often not a surprise. Stone Temple Pilots’ Scott Weiland, sad as that was, didn’t exactly come as a shock after his years of drug addiction. David Bowie, though — he’s immortal. He’s the Goblin King. How is it possible that he’s gone? I was thinking about why this one hit me so hard, and judging by the reaction on social media, it seems like I’m not the only one to ďŹ nd this more devastating than the average celebrity passing. I came to this conclusion: He was a weirdo. He was odd. He wasn’t what anyone expected him to be. He was one of us. So, why is a geek reporter covering music today? Because many of us have felt the same. We feel
weird. We like things other people don’t. (Well, now everyone likes them, but geek hasn’t been chic for all that long.) We feel “o.â€? Sometimes people don’t know how to react to us. Bowie cosplayed, dressing up in strange costumes and creating alter egos. He became Ziggy Stardust and then The Thin White Duke. He created a superweird video game that had sex shops and demons. (It’s “Omikron: The Nomad Soul,â€? if you’re interested.) He wrote music about space (which pretty much ensured that I’d have space phobia forever). He made grand gestures like putting out an album as a ďŹ nal goodbye to his fans with lyrics we’ll be dissecting for years. He was dramatic. He lived dierently. He was special. I sometimes think that, as geeks, we love the things we love because they stand out from the normal, mundane world. They make us matter in some way. They make us feel like we won’t fade into the background of day-

Brooklyn-based duo rock/ electronica instrumental Ratatat (Evan Mast and Mike Stroud) know how to put on a good show. In fact, they’ve become so good at it that they basically tour nonstop, which is why it took them five years to release their fifth album, “Magnifique,� last summer. “From the beginning, we always wanted to play actual instruments on stage rather than do a laptop set or DJ kind of thing just because it’s more interesting to watch,� Mast tells us. While the duo play live instruments on stage, they also add elements, like lights and lasers making their show’s visually stimulating as well. The live shows, in turn, influence their sound. “When we got into the studio, we were responding to have been touring a lot and we really wanted to make songs that would be

Naming songs with no lyrics As a purely instrumental band, it’s harder to know what Ratatat’s songs are about. All the listener has to go on is the sound and song titles such as “Cream On Chrome� and “Pricks of Brightness,� which aren’t saying much. “Usually a song starts with something we are influenced by, like a sound or a feeling,� Mast says. “Then we start

reacting to that, adding another layer and then reacting to that and adding another layer. It’s very intuitive. I went to school for visual art [Mast and Stroud met at Skidmore College] and it’s very much like creating an abstract painting or collage. The song starts to have some kind of emotion, and once we see
that, it’s about pushing that as much as we can.� When it comes to naming a song — or collection of songs — with no lyrics, Mast says he and Stroud simply try out different ideas until something feels right. Both guys have total veto power over names — if they don’t both 100 percent love it, it’s a no-go.

Superfoods aren’t limited to salads and smoothies, and Belmontbased food writer Katie Chudy’s book, “Superfood Sandwiches,� proves just that. The personal chef, who owns The Skinny Beet catering company with her husband, Richard, managed to stack a whole slew of superfoods into her recipe roster. “The book was developed out of personal necessity,� she says. “I work long hours and needed a convenient way to eat properly.� Superfoods are foods that exhibit noteworthy nutritional value when they’re not busy fighting crime. Meet ‘Matt & Ben’ in Davis Square A play depicting the bromance to end all bromances as imagined by two hilarious college BFFs skyrocketed Mindy Kaling’s comedy writing career into the mainstream. Today, she has her own wildly successful Hulu series, but “Matt & Ben� — as in, Cambridge’s prodigal sons, Matt Damon and Ben Affleck — lives on. The stage show, which Kaling wrote and performed with Brenda Withers in 2003, is in the midst of an engagement at Jamaica Plain’s Riot Theatre, and will open at the 160-seat Davis Square Theatre in April. The show parodies Damon and Affleck, just two young lads circa 1995, as they grapple with a moral dilemma when the “Goodwill Hunting� screenplay falls from the sky in Affleck’s apartment. Sweet Potato “Falafelâ€? Sandwich Yield: 4 sandwiches •2 cups diced sweet potato •1 tablespoon olive oil •½ teaspoon kosher salt •1 teaspoon ground cumin •2 tablespoons chopped scallion •Ÿ cup fresh cilantro, + garnish •1 teaspoon minced garlic •1 tablespoon lemon juice •½ to ž cup chickpea our •4 buns •ž cup Greek yogurt •Sliced cucumber, for garnish
Directions Preheat the oven to 375ºF. Line a baking sheet with parchment. Coat the sweet potatoes with the oil and salt in a small bowl and lay on the baking sheet. Roast until the potatoes are soft and light brown, 25 to 30 minutes, then cool slightly. Add the sweet potatoes, cumin, scallion, cilantro, garlic, lemon juice and ½ cup of the chickpea our to a food processor, and coarsely chop
until it begins to come together. If it does not hold its shape, add the remaining Ÿ cup our. Form the dough into balls a little smaller than a golf ball. Place on the baking sheet and bake until they start to brown, ipping them halfway, 20 to 30 minutes. Meanwhile, split the buns in half and toast, 3 to 5 minutes. Spread with the yogurt. Add falafel balls to each bun, and garnish with cilantro and cucumber.

There’s a reason you haven’t started that “get organized” New Year’s resolution yet, and the reason is simple: It’s an overwhelming chore. Well, for most of us at least. You see, some people not only enjoy finding order in the chaos, but they enjoy it so much they’ve made it into a career. Before you forget all about your 2016 pledge, we hit up some professional organizers for their top tips.
Start small If you resolved to learn to cook this year, you wouldn’t start with hosting a six-course
dinner party. Likewise, you don’t want to kick off your organizing plan with a garage overhaul. “The junk drawer is the perfect starter project because it’s a microcosm of your entire home,” says New York-based organizer Jeni Aron, owner of Clutter Cowgirl. “You can sort your junk drawer in a half-hour to an hour. And then you can move on to a bigger challenge with confidence.”
Get a handle on your paperwork You know those papers on your coffee table? Well, more are coming in tomorrow’s mail. The good news? It’s fairly simple to get a handle on. “A quick solution is to gather all your current papers in one place and divide everything into three piles: To Do, To Read and To File,” says Debbie Lillard, au-
thor of “A Mom’s Guide to Home Organization.” “If unopened mail is included in that pile of paperwork, open it and discard envelopes and excess materials. Then tackle one pile at a time until you are caught up. Just having it all in one place will make you feel more in control.”
More than any other space, closets are prone to becoming cluttered, daunting pits. “If you haven’t worn something in a year, you probably won’t wear it again,” says New York-based organizer Aly Finkelstein, of Organized by Aly. “Scan your closet and then bag all of your unwanted clothes for either resale or, preferably, donation.” While you’re in there, she says to replace those warped, mismatched, clothessnagging hangers — it’s

They give him a lot of responsibility and he doesn’t make many mistakes.” The Utah product threw just seven interceptions during a regular season in which he threw the ball 470 times. In other words, he’s nearly as good as Tom Brady when

When CBS attempts to sell this weekend’s matchup between the Patriots and Chiefs (Saturday, 4:35 p.m., CBS) one can bet the TV network will rely heavily on Patriots stars Tom Brady and Rob Gronkowski. The quarterback of the hottest team in the NFL, however, won’t be seeing his name or face on any sort of marquee. Ten years ago, the networks would have salivated over a playoff matchup between the No. 1 overall pick of the 2005 draft and the already-established Brady. But Alex Smith had to go and have the oddest career in the history of pro football and ruin it for all of us. Smith is regarded as the definition of “aver-

it comes to protecting the football (Brady threw seven picks in 624 attempts). Pittsburgh’s Ben Roethlisberger has a much higher approval rating than Smith when it comes to quarterbacking an NFL team. But Big Ben threw a whopping 16 interceptions in 469 attempts this year. Peyton Manning, the other quarterback in the AFC who will be under center this weekend, threw 17 interceptions in just 331 attempts in the regular season. Even surefire MVP Cam Newton threw more picks this year than Smith (10 in 495 attempts). Before his eventually meaningless interception against the Texans last week, Smith had thrown 119 postseason passes without throwing a pick. It’s the longest streak to start a career in NFL his-
tory, according to ESPN. The Patriots are very good at protecting the football and causing turnovers themselves, but their plus-7 turnover differential pales in comparison to the Chiefs’ plus-14 mark this season (second in the NFL). As efficient as Smith has been, however, he is not prone to a bad outing. In the Chiefs’ regular-season finale against Oakland (a 23-17 win) he threw back-to-back interceptions in the second quarter — including a pick-six. He also had a double-INT game in Week 2 against the Broncos (a 31-24 Chiefs loss). When you consider that Smith had 11 games this season in which he did not turn the ball over in the air, it’s remarkable that he had two of these outlier games.
