3 things you need to know SENATORS ACCUSE YAHOO OF ‘UNACCEPTABLE’ DELAY IN HACK DISCOVERY

1

Six Democratic U.S. senators Tuesday said it was “unacceptable” that Yahoo only last week announced a 2014 hack into 500 million user accounts and asked embattled CEO Marissa Mayer for more information about the company’s investigation into the data breach. The lawmakers said they were “disturbed” the two-yearold intrusion was detected so long after the hack occurred. “That means millions of Americans’ data may have been compromised for two years,” the senators wrote in a joint letter addressed to Mayer. “This is unacceptable.” Yahoo did not immediately respond to a request for comment about the letter. Yahoo has faced mounting questions about exactly when it knew about the 2014 cyber attack that exposed the email credentials of users, a critical issue for the company as it seeks to prevent the breach from affecting a pending takeover of its core business by Verizon Inc. CALIF. CHANGES LAWS SO KIDS CAN NO LONGER BE CALLED PROSTITUTES

2

Children will no longer be classified as prostitutes in the U.S. state of California after a new law decriminalized prostitution for minors in a move praised by children’s rights campaigners. Coming on the back of a public campaign coined “There is No Such Thing” as a child prostitute, crimes of solicitation and prostitution will no longer apply to anyone aged under 18. Underage victims of sex trafficking are to be referred to child welfare agencies. The law was among several signed by Gov. Jerry Brown this week to boost protections for children forced into sex trafficking. “The passage of these critical laws marks a clear shift in the public perception of sexually exploited children as victims rather than criminals,” said Yasmin Vafa, executive director of Rights4Girls that launched the “No Such Thing” campaign. TV AUDIENCE FOR DEBATE LIKELY TO APPROACH 80M RECORD

3

The television audience for the first U.S. presidential debate between Democrat Hillary Clinton and Republican Donald Trump looks set to approach 80-million viewer record for such events set in 1980, early Nielsen data cited by U.S. media suggested Tuesday. But the initial data from the four main broadcast networks suggest Monday evening’s 90-minute debate, which was carried on multiple U.S. broadcast and cable networks, would not surpass 100 million viewers, as some analysts had predicted ahead of the face-off. Smoke still billowed from rubble five hours after an explosion at a house in the Bronx killed an FDNY chief Tuesday morning. Battalion Chief Michael Fahy, a 17-year veteran of the FDNY and a father of three, was killed in the blast by falling debris just after 7:30 a.m. when a house at 304 W. 234th Street in Kingsbridge erupted. Earlier in the morning, neighbors reported an odor of gas emanating from a private two-story home, prompting the fire department to evacuate the street. “The smell of gas woke me up” at around 6 a.m., Adrianna Fellheimer said. “It was really strong. My chest was hurting.” She and her husband, Brian, were the ones to call 911, potentially saving the lives of the dozens of residents who were

Fahy is the FDNY’s highest-ranking member to die in the line of duty since the Sept. 11, 2001, attacks, and the first member to be killed since July 2014. He became a firefighter in 1999. He was promoted to lieutenant in 2004, to captain in 2007 and to battalion chief in 2012, and was most recently serving in the Bronx. “We lost a hero today, and our members are all saddened,” FDNY Commissioner Daniel Nigro said of the “rising star.” He said that the tragedy served as a “reminder of the dangers first responders face every day.” Nigro, who had served with Fahy’s father, a former fire chief, added it was a loss not only for the fallen firefighter’s family but the entire department. Authorities are still investigating the source of the reported gas odor and explosion.

NYC considers providing free lawyers to tenants facing eviction The proposed bill would provide free legal counsel to tenants in the city’s housing court. GARY KANE @MetroNewYork gary.kane@metro.us

It’s a familiar scene in New York City Housing Court: An attorney for a landlord argues his case while a tenant facing eviction stands silent, clutching a few documents. A majority of City Council members want to change that scenario. The council Monday conducted a hearing on a proposed bill that would make New York the first city in the country to provide pro bono lawyers to any lowincome residents facing eviction. Bronx Borough President Ruben Diaz Jr. testified at the hearing that evictions fuel the city’s homelessness crisis. “Anyone doubting the causal relationship between evictions and possessions of the dwellings of low-income tenants and homelessness need only look at the available data, which shows that thousands of families have just faced eviction at the time they

entered the shelter system,” Diaz said. The Bronx led all boroughs in the number of evictions recorded last year, with 7,401, according to data compiled by Housing Court Answers, an organization that provides information and assistance in housing matters. A total of 21,988 evictions occurred citywide last year. The proposed bill would save the city $320 million annually, the New York City Bar Association claims. The savings would be accrued in the costs of sheltering evicted tenants, replacing rentregulated apartments

that become marketrent units after evictions and providing other services to the homeless. Diaz testified that “the deck remains stacked” against low-

income tenants who appear in housing court without legal representation. The city’s Office of Civil Justice found that, during a two-day study period in April, about 27 percent of

tenants in 2,196 cases appeared in court with counsel. “The benefits of this proposed law are considerable, and could help keep New Yorkers in their homes,”

Diaz said. “Too many families become homeless because they don’t have an advocate in court or someone to get them connected with housing financial assistance.”

The Donald won, say Metro readers in online poll Donald Trump crushed Hillary Clinton in their first presidential debate, say readers who responded to Metro’s “debating the debate” unscientific poll. Out of the 2,128 who took Metro’s online poll Monday night after the debate into Tuesday evening, the flamboyant Republican candidate was declared the winner by 63.4 percent of Metro’s readers. The former secretary of state was deemed the victor by nearly 34 percent of the poll participants. Another 2.6 percent

of the readers said the debate ended in a tie. Other national polls have given the victory to Clinton; CNN, for example, polled 521 registered voters who watched the debate and found 62 percent thought Clinton had won, while only 27 percent thought Trump had prevailed. Only a few of the readers who participated in the poll added a comment. Most of the comments were left by readers who said Clinton won the debate. “I’m not a big fan of Clinton, honestly, but in

this case, I’ll choose ... the lesser of two evils,” wrote a reader who identified himself as Jay Haney. Because the Metro poll could be accessed via a Google search and social media, 21 percent of those who participated in the poll did so from outside the U.S. Votes were recorded from 54 other countries, including Russia, Malaysia and South Africa. Most votes originating outside the U.S. came from Canada and the United Kingdom. While the poll was

unscientific, participants were restricted to one vote per computer to help stem ballot-stuffing. The debate attracted about 80 million viewers, according to early figures released by Nielsen. The TV audience was the largest since televised debates began in 1960 with the John F. Kennedy-Richard Nixon face-off. The total, however, falls far short of the 105 million who watched the final episode of “M.A.S.H.” in 1983. The second debate is scheduled for Oct. 9. GARY KANE

Gov. Andrew Cuomo unveils plans for Moynihan Train Hall “Penn Station gets 650,000 passengers per day,” Cuomo said. “That is double JFK, Newark and LaGuardia airports — more than all the airports combined. KIMBERLY AQUILINA @MetroNewYork

Gov. Andrew Cuomo unveiled plans on T uesday for the new station in the historic James A. Farley Post Office, adjacent to Penn Station. A developer-builder team, including Related Companies, Vornado Realty LP and Skanska AB, have been hired to redevelop the Farley Building into the Moynihan Train Hall, which will create a new 255,000-square-foot train hall to house passenger facilities for the Long Island Rail Road and Amtrak. “We’re going to rebuild the Long Island Rail Road concourses first,” Cuomo said in a speech on Tuesday. “It’s

BRIEFS Bruised boy dies; mom, boyfriend questioned: NYPD Police are looking into the death of a 6-year-old Harlem boy, who had multiple bruises about his body head, investigators said Tuesday. Officers responded to a 911 call about an unconscious boy at a West 135 Street address, but arrived to find that the child had been taken to Mount Sinai St. Luke’s Hospital by his mother. The boy, later identified as Zymere Perkins, was pronounced dead at the hospital, police said. Investigators were questioning the boy’s mother and her boyfriend, according to NY1 News. No arrests were reported. Zymere wasn’t registered in school this year, sources told the Daily News. Neighbors said they had seen him walking around, but never saw him go to school. GARY KANE

a complete redesign of the underground labyrinth. I wanted to say that they reminded me of the catacombs in Penn Station. They said I couldn’t say that, so we said labyrinth instead.”

The joint venture will also create 112,000 square feet of retail and nearly 588,000 square feet of office space within the Farley Building, the governor’s office said.

“Pennsylvania Station and the Farley Complex across the street — Penn Station gets 650,000 passengers per day,” Cuomo said. “That is double JFK, Newark and

LaGuardia airports — more than all the airports combined. It is triple the capacity that the facility was designed for and it is not representative of New York. It is dirty; it is

dingy; it is dark and that is not what New York is all about.” Building begins in the fall and the new station is expected to be completed by December 2020, Cuomo said.

ACLU defending New York bombing suspect, calls lawyer delays ‘disturbing’ The American Civil Liberties Union said on Monday it will temporarily provide legal counsel for the man suspected of detonating a bomb in the heart of New York City that injured 31 people earlier this month, as concern builds over the suspect’s lack of access to a lawyer. Ahmad Khan Rahami, a 28-year-old naturalized U.S. citizen, has been held in police custody in a hospital in Newark, New Jersey, since he was arrested on Sept. 19 following a dramatic gun battle with officers trying to take him into custody. York and New Jersey stemming from the bombing in Manhattan’s Chelsea neighborhood two days earlier, and explosives found in two New Jersey locations. The attacks are being treated by authorities as an act of terrorism. They came days after the 15th anniversary of the Sept. 11 attacks, and after a

series of attacks in the United States inspired by Islamic militant groups including al Qaeda and Islamic State. Federal judges denied requests by public defenders to be appointed to represent Rahami last week, siding with prosecutors who argued he had not officially been arrested by federal authorities. On Monday, ACLU lawyer Alexander Shalom filed a notice of appearance as counsel for Rahami in federal court in Newark. His filing comes as prosecutors and federal public defenders in New York and New Jersey squabble over when Rahami will get

a court-appointed legal counsel. In a statement on Monday, the ACLU said the U.S. Justice Department and the Prosecutor’s Office in Union County, New Jersey, continue to improperly deny Rahami the right to an attorney. For example, the ACLU also said that the Union County prosecutor prevented Rahami’s local public-defense counsel from checking on Rahami’s condition because the prosecutor said an arrest warrant had not yet been executed. “The right of an accused person to have an attorney is a fundamental, undeniable right,

regardless of the charges,” Shalom, the ACLU lawyer, said in a statement on Monday. “It’s extremely disturbing that Mr. Rahami’s lawyers have not been able to verify their client’s health condition, including his level of consciousness.” The Union County Prosecutor’s Office did not immediately respond to a request for comment. A spokesman for the U.S. Attorney’s office in New Jersey declined to comment. Shalom will represent Rahami on the federal charges until public defenders are able to represent him, the ACLU said. BRIEF Stop-gap bill to avoid government shutdown fails Senate procedural vote A stop-gap funding bill to avoid a federal government shutdown later this week failed to garner enough votes to move forward in the Senate on Tuesday, with Democrats and Republicans both opposing the measure. The must-pass continuing resolution, or CR, which would keep federal agencies operating from Saturday through Dec. 9,

received only 45 of the 60 votes needed to limit debate and be considered for passage by the 100seat Republican-controlled Senate. Forty Democrats and two independents opposed the CR because it lacked a $220 million aid package to address the drinkingwater crisis in Flint, Michigan. It also drew opposition from 13 Republicans, including Sen. Ted Cruz, the former presidential candidate. Senate leaders said they

would explore alternatives to avoid a shutdown. Without an extension, many federal agencies will run out of operating funds when the government ďŹ scal year expires at midnight on Friday. The bill includes $1.1 billion to combat the Zika virus and $500 million for ood relief in Louisiana and other states. “This is a 10-week funding bill. Its contents command broad support. It contains zero controver-

sial riders, Senate Majority Leader Mitch McConnell said before the vote. Democrats in the Senate and House of Representatives vowed to oppose the resolution until Republicans agree to a Flint aid package that the Senate passed by a 95-3 margin this month as part of a separate water resources bill. Flint, a city with over 100,000 people, has had lead-tainted drinking water for more than two years. REUTERS

Republican Donald Trump suggested on Tuesday he would hit rival Hillary Clinton harder in the next presidential debate while the Democratic nominee sought to keep him on the defensive with accusations that he is a sexist, racist and tax dodger. As had been expected, Monday night’s first faceoff between Clinton, who has decades of experience in public life, and Trump, famous as a television personality but running for office for the first time, attracted a huge audience. Some 80.9 million Americans watched the debate on television, setting a new viewership record for such events, CNN said. Clinton tried to keep up momentum from a forceful performance, saying on Tuesday that the New York real estate mogul “was making charges and claims that were demonstrably untrue, offering opinions that I think a lot of people would find offensive and off-putting.â€? Trump praised himself for not attacking Clinton during the debate about the marital infidelity of her husband, former President Bill Clinton, but said that he may take up the attack line going forward. There are two more debates

scheduled, on Oct. 9 in St. Louis and Oct. 19 in Las Vegas, ahead of the Nov. 8 election. “I may hit her harder in certain ways. I really eased up because I didn’t want to hurt anybody’s feelings, Trump said in an interview on the Fox News program “Fox & Friends. He added that when Clinton criticized him for his treatment of women, he held back, saying, “I was going to hit her with her husband’s women. And I decided I shouldn’t do it because her daughter was in the room. Clinton brushed off Trump’s vow, saying, “He can run his campaign however he chooses. Trump himself was still married to his first wife, Ivana Trump, when he had a high-profile affair with Marla Maples, who became his second wife. He eventually divorced Maples and married his third and current wife, Melania Trump. Clinton, a former senator and secretary of state, stepped up her criticism of Trump for refusing to release his tax returns, as presidential candidates have done for decades, and for saying during the debate that not paying federal income tax “makes me smart. “He actually bragged about gaming the system to get out of paying his fair share of taxes. In fact, I think there’s a strong probability he hasn’t paid federal taxes a lot of years, she said at a campaign rally in Raleigh, North Carolina, a pivotal state in the election. REUTERS

Facebook tells district court judge it takes terror threats seriously Lawyers for Facebook Inc. on Tuesday sought to assure a U.S. judge overseeing lawsuits by victims of militant attacks in the Middle East that it took a “zero-tolerance approach to any communications that may promote terrorist threats or activity. The comments came after U.S. District Judge Nicholas Garaufis in Brooklyn on Thursday accused Facebook’s law firm of insulting the court by sending just a junior attorney to address him in lawsuits involving militant groups’ threats of violent attacks on Israelis. The judge Tuesday apologized to the extent his comments may have sounded like criticism of the first-year associate, but said he was concerned about whether Facebook’s lawyers at Kirkland & Ellis

Facebook GETTY IMAGES

were taking the matter seriously. “We heard you loud and clear, and we apologize, Craig Primis, a partner at Kirkland & Ellis, told Garaufis. As a sign of the level of attention the judge’s critique drew at Facebook, the company flew Paul Grewal, a deputy general counsel, from California to New York to appear before him for what was otherwise a procedural hearing.

Grewal said Facebook had people working around-the-clock trying to monitor and remove posts on its website that glorify or incite violence through terrorism. “Facebook has a very serious interest in keeping terrorism content off, he said. The hearing came in a pair of related lawsuits, including one filed last year by 20,000 Israelis seeking an order requiring Facebook to stop allowing militant groups like Hamas from using its platform to incite attacks against Israeli citizens. The company also faces claims by victims of such attacks who are seeking to hold Facebook accountable under the U.S. Anti-Terrorism Act for providing support to militant groups. REUTERS

Man pleads guilty in celebrity nude-photo hacking scandal Edward Majerczyk pleaded guilty in District Court in Chicago to one felony change of unauthorized access to a protected computer to obtain information, charging documents showed. An Illinois man pleaded guilty to hacking the email accounts of high-profile female celebrities in a scandal linked to the online release of nude photos of actress Jennifer Lawrence and others. While no victims were named in court documents, Lawrence and actress Kirsten Dunst and model Kate Upton have addressed the leak and online dissemination of their nude photos in interviews. The Chicago Tribune

named those celebrities as among the victims, as well as U.S. soccer player Hope Solo. The Tribune reported that Majerczyk told U.S. District Judge Charles Kocoras on Tuesday that he targeted celebrities, going through personal information and downloading “sensitive images.” His lawyer, Thomas Needham, did not immediately respond to a request for comment. The newspaper quoted Needham as telling the judge there was no evidence “of any effort

by my client to sell or disseminate” any images. “So essentially it was for his own personal satisfaction and enjoyment?” Kocoras said, according to the newspaper. “Yes, your honor,” Needham was quoted as saying. Assistant U.S. Attorney Joseph Fitzpatrick for the Northern District of Illinois said by email that his office agreed to seek a nine-month prison sentence for Majerczyk, who lives near Chicago. Sources: FBI believes cellphones of some Democrats targeted by hackers Democratic National Convention GETTY IMAGES

FBI investigators believe foreign hackers have targeted mobile phones used by a small number of Democratic Party figures, possibly including elected officials, four political and government sources said on Tuesday. The hacking attempts occurred within the last month or so, the sources said. Two sources said investigators believe that, like hackers who earlier

attacked the central data servers of key Democratic Party organizations, the mobile phone attacks were carried out by hackers connected to the Russian government. One source said that some of those whose phones were targeted by hackers had been asked by the FBI to turn over their phones so that investigators can “image” them. REUTERS

BRIEF Aetna to offer Apple Watch at a discount to certain customers U.S. health insurer Aetna Inc. said it would offer some customers discounts on Apple Inc.’s smartwatch, marking the first deal made by the tech giant with an insurer for its devices. Aetna, which has about 23 million members in the United States, will also give away the Apple Watch for free to its nearly 50,000 employees, Aetna said in a statement on Tuesday. The deal could help Apple boost the appeal of its Watch to potential customers as the company looks to target health and fitness conscious users with its new device. Aetna will discount a significant portion of the cost, and will offer users monthly payment options to pay off the remaining amount. The discounts on the devices will vary for customers, according to Aetna spokesman Ethan Slavin. However, reaction to the second edition of the Apple Watch has been muted since its launch earlier this month with the device likely to remain a niche offering, according to some analysts. REUTERS

Governor Chris Christie GETTY IMAGES

New Jersey Gov. Chris Christie was aware of a politically motivated scheme to close lanes at the George Washington Bridge in 2013 as it was unfolding, a key prosecution witness testified on Tuesday at the criminal trial of two former Christie associates. The testimony marked the first specific evidence federal prosecutors have presented to back their contention that the Republican governor knew at the time about the scandal known as “Bridgegate,â€? despite his repeated denials. Baroni and Christie’s former deputy chief of staff, Bridget Kelly, are charged with fraud and other crimes for allegedly orchestrating the September 2013 closure of access lanes at the bridge in Fort Lee, New Jersey, to punish the town’s Democratic mayor for refusing to endorse Christie’s re-election bid. “Mr. Baroni said, ‘Governor, I have to tell you, there’s a tremendous amount of traffic in Fort Lee this morning,’â€? Wildstein testified, adding that Baroni was using a sarcastic tone. Baroni also said the mayor, Mark Sokolich, was “very frustratedâ€? that his calls to the Port Authority were being ignored. “Gov. Christie responded by saying, ‘I would imagine that he wouldn’t be getting his phone calls returned,’â€? Wildstein said. Prosecutors showed jurors a series of photographs depicting the three men laughing at the site that morning, which was the third day of the weeklong lane closures. Christie has not been

charged with wrongdoing. Wildstein pleaded guilty to two counts of conspiracy and agreed to cooperate with prosecutors. At an unrelated news conference in Trenton, New Jersey, Christie reiterated that he was never made aware of the scheme. â€œI had no knowledge prior to, or during, these lane realignments. I had no role in authorizing it. I had no knowledge of it,â€? he said. The scandal helped torpedo Christie’s White House run, undercutting his bipartisan image. Since taking the witness stand Friday, Wildstein has described coordinated efforts by Christie’s office to use the Port Authority’s power to punish local officials who failed to get behind his reelection campaign. Another such official, Mayor Steven Fulop of Jersey City, had meetings with executives from the Port Authority and other state agencies canceled after he declined to endorse, Wildstein testified. At the same Sept. 11 event, then-Port Authority Chairman David Samson joined the three men and told Christie that Fulop was trying to reschedule a meeting, according to Wildstein.  â€œGovernor Christie said, ‘No, no meetings with Mayor Fulop,’â€? Wildstein testified. Samson, a close ally of Christie’s, had also been informed of the lane closures, Wildstein said. He pleaded guilty in July to an unrelated scheme in which he used his power to coerce United Airlines into reinstating a discontinued flight between Newark and South Carolina, near where he owned a vacation home. At one point, Sokolich texted Baroni to say children were trapped on schoolbuses in the gridlock and practically begging for help. REUTERS

Can Supplements Do The Same Thing?

Viscosupplementation allows your joints to glide more smoothly eliminating a lot of the rubbing, grinding and pain.

No. Glucosamine and chondroitin and other supplements are much different. You can only get this from a doctor and it often helps knee pain sufferers who got limited or no success from glucosamine and chondroitin. Beware of unsubstantiated claims made by supplements to do what this advanced medical procedure does.

Baby Boomers May Avoid Knee Surgery With Modern Arthritis Treatments The director believes one of the most important factors for the success of viscosupplementation is making sure you are getting it into the joint space precisely. That’s why the doctors at NY Pain MD use advanced imaging technology to apply Precision Arthritis Targeting during every treatment. A device called the "C-Arm" allows the doctor to see into the joint and actually watch the medicine be applied exactly where it is supposed to. Research shows that performing procedures without Precision Arthritis Targeting (P.A.T.T.)can result in missing the joint space as much as 30% of the time. If you had viscosupplementation treatments without Presision Arthritis Targeting Technology and did not get good results - this may be why. “If you have knee arthritis pain, viscosupplementation might be the answer you are looking for. The keys are to not wait, get a good evaluation from an expert and make sure precision arthritis targeting is used to make sure you have the best chance for success.”

Can This Be Avoided? Total knee replacement is serious surgery requiring months of rehabilitation. Some doctors think modern treatments done early enough can keep baby boomers from going under the knife.

Doctors say these two factors are the keys to knee arthritis treatment success and relieving pain without surgery By Matt Edgar America’s Health Writer New York City - Everyone has said it at one time or another. If I had only known about “this” sooner - things would be very different today. That’s what many knee arthritis pain sufferers are saying about this technology and treatment. “We all know that countless lives are being saved every year because of early detection and better treatment ” noted the clinic director at the NY Pain MD in New York City. “The same holds true for treating arthritis pain. I believe we are having so much success at NY Pain MD because of two factors: One is we are using advanced medical technology and treatments a lot of clinics do not use. And second, the word has spread to our community and so many knee arthritis sufferers are coming in sooner. And the earlier we can treat knee arthritis the better the results. The key to trying to avoid knee replacement surgery is doing the correct treatment as soon as possibly” What is the “correct treatment?” “That depends,” said the director. “There is no one answer when it comes to medical conditions. nee arthritis is no different. That’s why, if you have knee pain, you should have it evaluated by a doctor who deals with and treats knee pain every day,” added the director. For many knee arthritis pain sufferers the right treatment is iscosupplementation a preparation of Hyaluronic acid is applied directly into the knee joint using Precision Arthritis Targeting Technology. Hyaluronic acid is the natural lubricant and shock absorber of your joints and is found to be decreased in arthritis sufferers. This is similar to running your without oil. Obviously, the sooner you put oil back in the car - the less damage will be done. That’s why some doctors feel early vis cosupplementation gets the best results and is so important for avoiding surgery.

DeSai was wearing military-style clothing and had Nazi paraphernalia on him at the time of the shooting. They said he was armed with a handgun and that 2,600 rounds of ammunition and a rifle were found in his car. Both firearms had been legally purchased, they said. Memorial Hermann Hospital said two of the victims were still hospitalized and were in good condition. The hospital said it had released three others. Ben Taub Hospital, where some of the victims had been taken Monday, could not confirm if any were still there. DeSai, who received his law degree from the University of Tulsa in 1998, had a small law firm that closed about six months ago, according to his former law partner.

Hubble spots evidence of water plumes on Jupiter’s moon Europa Astronomers on Monday said they have spotted evidence of water vapor plumes rising from Jupiter’s moon Europa, a finding that might make it easier to learn whether life exists in the warm, salty ocean hidden beneath its icy surface. The apparent plumes detected by the Hubble Space Telescope shoot about 125 miles above Europa’s surface before, presumably, raining material back down onto the moon’s surface, NASA said. Europa, considered one of the most promising candidates for life in the solar system beyond Earth, boasts a global ocean with twice as much water as in all of Earth’s seas hidden under a layer of extremely cold and hard ice of unknown

While drilling through the ice to test ocean water for signs of life would be a daunting task, sampling water from the plumes might be a simpler project. “If the plumes are real, it potentially gives us easier access to the ocean below ‌ without needing to drill into miles of ice,â€? said lead researcher Williams Sparks of the

Space Telescope Science Institute in Greenbelt, Maryland. Europa is about 1,900 miles in diameter, slightly smaller than Earth’s moon. Among Jupiter’s four largest moons, Europa is the second closest to the biggest planet in the solar system. The telescope observed the plumes three times in 2014, mostly around Europa’s southern polar region, scientists said in a conference call with reporters. On Earth, life is found everywhere where there is water, energy and nutrients, so scientists have a special interest in places elsewhere in the solar system, like Europa, with similar characteristics, said Paul Hertz, director of NASA’s astrophysics division. REUTERS

Well, this is no fun: Naomi Watts and Liev Schreiber split There are celebrity couples whose names you turn into fun portmanteaux, like “Brangelina” or (digging up an old Colbertism) “Filliam H. Muffman.” Then there are celebrity couples you take for granted, assuming they’d always be a power pair even if paparazzi didn’t spy on their every trip to buy toothpaste and crunchy peanut butter. Naomi

Watts and Liev Schreiber (Schratts? Lioami? We got nothin’) were one of those couples. Note the past tense, because, sadly, they are now no longer one of those couples. The acclaimed actors, who’ve been together for 11 years and had two children — and who we sometimes forgot were a couple, because we didn’t think to always invade their privacy — publicly announced their split, after noting

they sort of kind of split up about a year ago: moving into separate NYC apartments, juggling parental hand-offs, all while putting in the occasional public appearance, as they did at last year’s Oscars. There’s no tabloid-y joy to be had here: Both are fine actors we probably take for granted, as we did their coupledom, and both seem like very nice people who deserve happiness. Sad face.

Katy Perry strips down in the name of democracy After telling her Twitter followers Monday that she would be “using [her] body as clickbait to help change the world,” Katy Perry proved that she’s serious about her promises. The 31-yearold pop star upheld her vow, offering the world a video of her rolling out of bed to vote — naked. After all, the star was eager to share her good news: “This year, you can look like s—t when you vote.” “In the name of democracy, any just out-of-bed look is A-OK,” she says in the video. “A child’s onesie, hunk in kids’ briefs, that free XL T-shirt you got from your bank—or, if you’re like me—I sleep naked.”

Unfortunately for Perry, arriving at the polls in the nude isn’t so legal, even in the world of comedic simulation, and the star is immediately put in cuffs. It appears she might have only “briefly scanned” her constitutional rights. Speeding off in the back of the cop car, Perry ends the clip with a brief recantation: “My bad, you have to wear clothes. See you at the polls Nov. 8th.”

Although Hadid was clearly the victim in this scenario, the young “It girl” has received flack for fighting back. Hadid vented to Dunham about a headline describing her self-defense as “not model behavior.” “First of all, it was a woman who wrote a

Tim Roth on dying with dignity The acclaimed actor talks his new film, “Chronic,” and what it says about mortality.

Tim Roth knows his way around a beautifully penned piece of dialogue. But in “Chronic,” he’s largely silent. In fact, he spends most of the film engaged in menial labor. In the latest from austere Mexican director Michel Franco (“After Lucia”), the esteemed actor, 55, plays David, a quiet caretaker often viewed in long takes tending to his sickly patients, one of whom (played by “American Horror Story’s” Robin Bartlett) wishes to die. Slowly, though, it becomes apparent that David has far more going on than he likes to discuss. When I watch movies like this, where there are very long takes often showing very mundane activity, I wonder what that’s like for the actors. We find it very invigorating, to be honest. It has a theatrical feeling. It feels like it’s for the actors, where usually film is a director’s medium. We establish the performance in rehearsal, then [the director] decides where he wants the frame to be. And we continue the performance sometimes on-screen, sometimes offscreen. It’s very liberating. You’re also conveying the character through action, and not always through

dialogue. You can’t fall back on words — though that does mean you had less lines to learn. Oh, I don’t mind homework. I’m looking at homework right now. The homework was fine. A lot of work, though, was done before filming. I worked with two nurses, met their patients and was trained in certain things you see in the film. We had two nurses on set with us as well. That was all difficult. The filming of it, though, was wonderful, because we could put all of that work onto the screen. It was for me — weirdly [laughs] — one of the most enjoyable films I’ve been involved in. Euthanasia comes up, and without prodding us, it forces us to think about it. The character Robin Bartlett plays desperately wants to die because she finds living to be physically painful. It’s a big conversation

within the medical community. It’s absolutely legal in many countries, unfortunately not here. There’s dignity one can have in death. A friend of mine said to me after she saw this that when her father died, they knew it was coming. But they were in control of it. They said the six months of that, with the palliative care worker — who was preparing her for her father’s death as well — were some of the best times she had with her dad. If we get to have our choice, it can be a very positive thing for everyone concerned. We’re just not allowed that here for some reason. We’ve been denied that human right. Sad. I should ask about one of your older films. So tell me about your small but crucial role in Peter Greenaway’s “The Cook, the Thief, His Wife and Her Lover,” from 1990.

I think it’s one of Peter’s best, to be honest. Maybe I’m just biased. But it was an incredibly enjoyable time making that. Getting to watch Michael Gambon work and being close to him was probably worth more than any drama school can ever

give you. Going back to actors learning lines: He just doesn’t. He would have them written everywhere: on napkins, on his sleeve, on the back of a bottle. It’s beyond him; he just gave up doing it. It was really funny watching him pull that off.

takes on a sprawling novel (by Lewis Grassic Gibbon) about rural Scottish life in the early 20th century. As a resilient young lass struggling with love and loss, Agyness Deyn is no mere model who gave an excellent performance. She’s as perfectly fused with the material as her character is with the land she calls home.

Fall’s not the best time to watch Steven Soderbergh’s favorite movie. But the classic that ushered in the summer blockbuster — and helped destroyed the idea that mainstream cinema could be about more than tentpole franchises — should work gangbusters whenever. We won’t pester you with stories you’ve heard a million times before (the shark wouldn’t work!) or talk about the best scenes (remember the scar-off?!?). We’ll just say this remains a beautifully made film, and that Richard Dreyfuss fella is pretty good.

Community Board 6, Frank Gulluscio. “Every shop you could possibly want is right there, from the big-box stores like Costco across the board to the mom-and-pops. If you don’t want a house with a backyard and a front lawn, it’s the place to be — and for a young couple looking to build a family, its great.” Robert Glinka’s parents became aware of these perks while searching for an apartment in Rego Park 22 years ago. For his mother, who had no interest in driving, everything she needed to raise her two children was within walking distance. “Everything was so close for my mom — food, clothes, parks, the trains — it was all right in our backyard,” says Glinka. “The convenience, especially for the price, was amazing.” While 2012 ignited a surge of high-end buildings such as The Contour, and later, Millennium 99, Harold Valestin, vice president of brokerage firm MNS, says the neighborhood is still very affordable, offering newcomers the option of either high-end condominiums

or smaller-scale, less luxurious apartments and homes. “Millennium 99 raised the bar on another level,” says Valestin. “That kind of development was never in Rego park—it was something you would see more in Manhattan, or [Long Island City] or Williamsburg, and that’s what drew a lot of people to that project because it was such a high-end project in a neighborhood people wanted to be in.” Still, the neighborhood offers “an interesting combination of middle-, low- and highincome,” says Gullusico. In fact, affordability has been one of real estate agent Lily Tran’s biggest pushes for her clients. That, and the good public schools in district 28, including P.S. 139 and P.S.175. The neighborhood, which Tran describes as “family-centric,” is “a great option for people who have been priced out of Forest Hills but are still looking for a good school district,” she says. “Plus, it’s affordable compared to Long Island City, Astoria, Forest Hills and Kew Gardens, because those are on the express

train

home

stops, whereas Rego is on the local train stops.” For kids who’ve already grown up, however, there aren’t an abundance of hangout zones. “It’s not really for the millennial crowd,” says Tran. Of course, for many residents, this is a good thing. After living in Rego Park for 34 years, Pat Morgan has come to appreciate the sound of silence. “We’re not like Austin Street or Metropolitan Avenue with their late-night bars,” he says. “Rego Park closes down after a certain hour, which is very nice. Some people want to live where they can go to a bar until 3 a.m., and some don’t.” Thankfully, those chasing the late-night party scene have to endure only a 10-minute walk to either the bustling streets of Forest Hills or the nearest train station. “It’s a very low-key neighborhood,” says

Tr a n . “It’s not where the hipsters are going — yet.”

This design feature brings character and light into the loft-style homes. CRISTABELLE TUMOLA @CristabelleT

cristabelle.tumola@metro.us

Apartment windows in New York City can look out onto everything from the city skyline to a brick wall to the ocean waves. But for any NYC apartment large windows with a view can make the difference between a musthave place and just a place to crash. Here are two places — both located on East 22nd Street in Manhattan’s Flatiron area, that not only have large windows with a view, but reflect the character of what’s going on inside and out.

21 E. 22nd St., 2F $1,350,000 This Flatiron loft is described as having a “dash of steampunk, but what really stands out in this one bedroom, one bath is its original brushed steel casement windows. Featuring industrial hinges, the windows fit well with the loft’s high

21 E. 22nd St., 2F

ceilings. “I had never seen casement windows quite like these before, said Cassie D’Agata, licensed real estate salesperson with CORE. “Most units in the building have had them replaced or painted over but these still have the original brushed steel frames; vintage architectural pieces that preserve a century of history. They are at least 8 feet tall and rather than lift from the bottom, the top panes hinge and open by pulling the chain and hitching it to a front latch. After a bit of research I found they are sometimes referred to as awning windows because they swing outward and project like an awning.

29 E. 22nd St., 12S

$4,750,000 This three-bedroom, two-bath loft, located on the top floor of a prewar co-op, has 11foot ceilings and seven large arched windows. The windows in this industrial/modern-style home feature wood trim and extend from the living room into the adjacent master bedroom.

Giants’ Orleans Darkwa willing to do whatever he’s asked to win The third string running back broke through in Sunday’s loss. KRISTIAN DYER @KristianRDyer sports@metro.us

Orleans Darkwa certainly made the most of his opportunity, the New York Giants running back stepping up to have the biggest day of his career in Sunday’s 29-27 home loss to the Washington Redskins. With Rashad Jennings out with an injury, Shane Vereen (now also out with an injury) and Darkwa stepped up their production to help key the offense. Darkwa had a second quarter touchdown to put the Giants up 21-6, part of a day where he had 10 carries for 53 yards and also had a reception for nine yards. It was a significant step up in involvement for the third-year running back as Darkwa came into the game with just a single carry for minus-1 yards.

Orleans Darkwa could see an increased workload with the Giants’ injuries at running back. GETTY IMAGES

While he is pleased with his own performance he noted that the team was still on the wrong end of the score. “The line did a tremendous job of opening up holes but at the end of

the day it doesn’t mean anything if we don’t win,” Darkwa told Metro after the game. “We just need to take a look as a team and see where we can improve, what we can do.” His production on the

day was impressive as he set career marks in carries and rushing yards. “Whatever they ask of me I do. I just want to win, I don’t care what it takes. Whatever it is, I want to do it,” Darkwa

said. “I’ve never won a championship in my life, that’s what I look forward to.” The Giants certainly didn’t look like the team that would bring him to that championship on

Sunday, running out to a big first-half lead then seeing penalties and turnovers drop them to 2-1 on the season. Darkwa, however, emerged as a bright spot in the game. While the Giants lack a superstar in their running back depth chart, they do boast balance and depth at the position. Vereen led the Giants with 63 rushing yards on 11 carries as well as a touchdown in the first quarter. Darkwa said that the competition among the running backs helps to keep him sharp for a moment such as this. “That’s the motto, I’m a professional. I’m going to do my job, one day they call me up I’m ready. That’s one thing I pride myself in is that when I’m called upon, I’m ready,” Darkwa said. “Every back in that room is capable of starting and producing. We push each other, every week is a battle amongst each other, amongst the team. We have a great group of backs; we just need to continue to produce and find ways to improve.”

Rose rape allegations come to the forefront Getting back to playing basketball at an elite level may soon be a distant second on the priority list for Knicks point guard Derrick Rose. The Los Angeles Police Department confirmed this week that there is an open criminal investigation into Rose’s role in an alleged incident from August of 2013. The civil case - which alleges that Rose and his friends Ryan Allen and Randall Hampton broke into a women’s apartment, drugged her and raped her while she was unconscious – is set to go to trial next week. The website, The White Bronco, also unearthed the following letter from the LAPD to the alleged victim’s lawyer.

Mr. Anand, This note is to clarify any misconception that the Los Angeles Police Department does not have a current and open criminal investigation pending that names the suspects as the defendants in the current civil case being handled by your office. When filing the crime report, the victim in this case exercised her right to confidentiality as outlined in California Penal Code section 293.5 (a). Her identity will continue to remain confidential throughout the criminal investigation being handled by the Los Angeles Police Department. The ability to offer anonymity to victims of sex crimes is an invaluable investigative aid to investigators as well as a great comfort to victims of crimes of such a sensitive nature. A federal judge, however, ruled last week

that the alleged victim must reveal her name during the civil trial as a result of Rose’s lawyers arguing that the accuser has repeatedly spoken to the media about the case. “Because Jane Doe and her lawyers are openly pandering to the media on a nationwide blitz tour, Ms. Doe should be precluded from using a pseudonym,” Rose’s team wrote in a court filing. Rose maintains that the accuser is a “golddigger.” ESPN.com recently outlined why the court is allowing Jane Doe’s name in the civil case. “Civil rape cases can be just as traumatic for victims as criminal rape cases, and the consequences can be meaningful for the accused.

But civil cases are not about guilt or innocence; they’re about liability. Generally, that means money is on the line. In this case, Doe wants to hold Rose and his two friends liable to the tune of $21.5 million. After the alleged events in August 2013, she initially didn’t file a police report. But she reported the matter to police in August 2015, the same month she filed the civil case.” MATT BURKE

We’ve seen the defense, and we saw enough of the running game over the first two weeks to make the Bengals focus on stopping C.J. Anderson at their own peril. Trevor Siemian tossed four TD passes, including a 55-yarder to Demaryius Thomas to seal the win. Â

Yeah, this is a large jump, but the Eagles earned it. Hanging the largest loss of the week on the reigning rankings No. 1 is a far cry from looking good against Chicago and Cleveland. Carson Wentz and Doug Pederson have taken Philly by storm, and the Eagles look a class above the rest of the NFC East.

The Packers-Lions game had shades of the Pack’s NFC Championship loss to the Seahawks two years ago. After Aaron Rodgers threw four touchdown passes in the first half on their way to a 31-3 lead, the Packers just managed to run out the clock in the second half.

As good as the Steelers offense can look, it looked mighty ugly against the Eagles. Ben Roethlisberger was off, his receivers were dropping passes and Deangelo Williams couldn’t get going on the ground. Le’Veon Bell can’t get back any quicker.

A week after they seemed to turn a corner by beating the Chiefs, the Texans looked severely undermanned against the Patriots. In a game where neither team topped 300 yards, the Texans turned the ball over three times and took it from the Patriots zero times. That’s how you get shut out.

Patriots (3-0)

Chiefs (2-1)

Seahawks (2-1)

Panthers (1-2)

Beating Houston with their third-stringer at QB was something after the way the Patriots looked to be on the ropes at the end of the Dolphins game after Garoppolo was injured. If neither he nor Brissett can play this week, defeating the Bills with Julian Edelman under center will be something else entirely.

This defense is for real. A week after handling Aaron Rodgers (who looked fine against Detroit), the Vikings sacked Cam Newton eight times and managed to come back from a 10-point deficit while the offense gained just 211 yards on the day. The run game, sans Adrian Peterson needs work.

Kansas City didn’t even need an offense to take the field against the Jets on Sunday. They had eight turnovers, two defensive scores, and limited an offense that had decimated the Bills a week earlier to three points. We finally have a stellar prime time matchup when KC plays the Steelers.

The Seahawks alleviated concerns that the first two weeks were something larger than the regular season opening malaise we’ve seen in Seattle the past few years. It looks like Russell Wilson will be OK, and it looks like Thomas Rawls has some work to do to win the job back from Christine Michael.

Protecting Cam Newton has to become a priority for the Panthers. It sounds crazy that it wouldn’t be already, but evidence from the Broncos and Vikings games looks bad. After two great games, Kelvin Benjamin was shut out Sunday. Their losses, in their defense, have been to very good teams.

Aries Learn through trial and error. Take a practical approach to any job you are given and leave nothing to chance. An unusual relationship will help you advance.

Libra Take seriously matters concerning institutions and government agencies. A practical approach will be necessary. Too much of anything will be your downfall.

Taurus You’ve got more going for you than you realize. Take pride in what you do and show off the skills and talents you have mastered. Travel and romance are highlighted.

Scorpio Approach whatever you do with a practical plan and an open mind. Being receptive to different techniques will make things easier and more fun.

Gemini Refuse to let anyone talk you into doing something you don’t want to do. Focus on personal improvements, and avoid indulgence and overspending.

Sagittarius If you aren’t sure about something, don’t make a move. A risky venture will leave you stressed out and cause you to rethink your strategy.

Cancer You can make positive changes at home, but you must stick to your budget to avoid criticism. Your insight into trends will prompt a good professional choice.

Capricorn Nothing will be as it appears. Everything will cost more and take up more time than you had planned. You need to downsize and cut your overhead.

Leo Don’t let demanding people lean on you. Ask for favors and incentives to make whatever needs to be done worth your while. Don’t let anyone boss you around.

Aquarius A job opportunity will develop if you send out your resume. Get the inside scoop from a trusted party to help you bring about a positive personal change.

Virgo Express your thoughts and feelings, and find out where you stand. You will have the upper hand as long as you eliminate any negativity before it has time to fester.

Pisces Speak up and refuse to let anyone push you around. Spice up the way you present yourself to others. Update your look. Romance is highlighted. EUGENIA LAST
