Hundreds of people were rescued by boat and helicopter as floodwaters inundated North Carolina towns in the wake of Hurricane Matthew, and officials warned that life-threatening flooding from swollen rivers would continue for days. In the United States, the number of fatalities rose to at least 23, with nearly half in North Carolina. North Carolina’s skies were clear on Monday after the state received as much as 18 inches of rain from Matthew over the weekend, but raging rivers and breached levees posed major problems. REUTERS
TOP COURT DECLINES TO HEAR TOBACCO ARBITRATION DISPUTE

The Supreme Court on Tuesday let stand lower court rulings allowing Pennsylvania and Maryland to keep tens of millions of dollars in a dispute with tobacco companies involving the massive 1998 settlement over deceptive marketing and advertising of cigarettes. The justices declined to hear appeals, filed by Reynolds America Inc., Altria Group Inc. and other companies that were part of the settlement, of rulings that had favored Pennsylvania and Maryland regarding the amount of the annual payment that those states should receive under the deal. The dispute centered on the 2003 annual payment that companies that participated in the settlement were required to make to the various states as part of the deal. An arbitration panel found that six states, including Pennsylvania and Maryland, had not met their side of the bargain to ensure, as required, that companies that were part of the settlement did not disproportionately lose market share as a result of the terms of the deal to competitors that shunned it. Samsung scrapped its flagship Galaxy Note 7 smartphone on Tuesday less than two months after its launch, dealing a huge blow to its reputation and outlook after failing to resolve safety concerns. Samsung announced the recall of 2.5 million Note 7s in early September following numerous reports of the phones catching fire and on Tuesday it finally pulled the plug on the $882 device in what could be one of the costliest product safety failures in tech history. Some surprising New York City neighborhoods surged to the top of the list of the city’s priciest dwellings between July and September 2016, according to property research firm Property Shark. The “Top 50 Most Expensive Neighborhoods in NYC Q3” list shows the changing real estate landscape of a city in which once-unpopular neighborhoods are suddenly all the rage. “The way to think of this housing boom of the last four years is an outward radial push from Manhattan to brownstone Brooklyn and beyond to other boroughs and suburbs,” real estate consultant Jonathan Miller told Metro. Chic areas in Manhat-
tan still round out the top-three spots: Tribeca and SoHo remain lofty as the top two, with median sale prices of $4.44 million and $3.6 million respectively. Sale prices in both increased by more than 20 percent since last year. NoHo placed third and actually saw the typical sale price dip 46 percent since last year, to $2.66 million. Dumbo landed in fourth place. Homes sold for around $2.5 million, which is a 54 percent increase from last year. The jump is being attributed to a luxury development at 1 John Street that sold 30 units in three months at no less than $2.2 million. Dumbo’s place on the list is unusual because outer-borough neighborhoods generally do not out-price Manhattan’s notoriously pricey sections such as Greenwich Village, which is ninth on the list with a median sales price of $1.65 million. “Brooklyn is no longer seen as the cheaper alternative. It’s Manhattan’s direct competitor. It’s its own brand,” said Miller. “Queens is the new Brook-
lyn. The Bronx is the new Queens.” Another example of an outer-borough neighborhood that spiked is Forest Hills Garden — the rather exclusive area of Queens with large, private homes. The neighborhood ranked 11th on the list of 50 with a median sale price of $1.56 million, above both midtown Manhattan and the Upper West Side. It’s not that Manhattan has gotten less popular; explosive population growth (five years ahead of Census projections), as well as job growth (NYC currently has the highest amount of employees in history) has more people with fewer housing options, which skews the supply-demand dynamic toward luxury, Miller explained. Miller also pointed out that the numbers on this quarter’s list are wildly skewed because of new housing developments that go up and then sell out in one quarter. “It means that a ton of property, or none, closed in that quarter. It does not mean that prices have permanently changed somewhere and that people are
facing massive depreciation.” Another eye-popper is Roosevelt Island with a median sale price of $1.08 million, which represents a 128-percent increase from last year. It’s the biggest price jump on the list. Property Shark asserted that the increase is attributed to a lower number of transactions and influenced by co-op sales at two new developments, Island House and Riverwalk Court. Areas that traditionally boast astronomical sales prices also became pricier: Greenwich Village saw a 61 percent year-to-year increase in the typical sales price to $1.65 million and Central Midtown recorded a 41 percent increase to $1.3 million. Some neighborhoods retained their mostexpensive status despite a decrease in the median sale price. NoHo, ranked high at the No. 3 spot, dropped 46 percent from last year — the typical sale dipped from $7.6 million to $2.66 million. However, the figure is based on only six sales.

It’s been a tough week for a couple of New York public university presidents. Both Alain Kaloyeros, president of SUNY Polytechnic Institute and Lisa Coico, the president of CUNY, quit amid unrelated investigations. Kaloyeros, an admired nanotechnology whiz and economic development leader, was president and CEO of SUNY Polytechnic Institute in Utica from January 2015 until Tuesday morning. In September he was one of nine charged in the massive bribery and fraud scandal that quaked the administration of Gov. BRIEFS Central Park jogger dragged into woods, beaten and robbed A woman jogging through the northern end of Central Park was attacked by a lone mugger Monday night, police said. The victim, 28, was jogging near East Drive at 107th Street at about 9:30 p.m. when she was grabbed from behind and thrown to the ground. The attacker then dragged her into a wooded area where police said he punched her, kicked her in the head and attempted to molest her. He took her iPhone out of her pocket and ran, police said. Her phone tracker last pinged in the Bronx. The man is described as in his 30s, with a scruffy

New Yorkers might have a new wave of food trucks and carts on the streets soon, as the City Council considers legislation to gradually double the number of food vendor permits issued by the city. The proposal calls for spreading the new permits over seven years, giving 600 more street vendors the right to start doing business legally each year, The New York Times reported. The city’s Health Department has kept the number of permits it issues at about 4,235 since the early 1980s. The cap has prompted many venders to resort to buying permits on

a black market, where the full-time permits can cost as much as $25,000, the Times reported. Street vendors currently pay $200 for a
city permit that can be renewed indefinitely. The proposed legislation would hike the fee to $1,000 for a two-year permit. Council Speaker

The notorious Russian woman who accused former Gov. Eliot Spitzer of assaulting her was arrested Monday night after returning to the country and allegedly attempting to extort $50,000 from him. Svetlana Travis, aka Svetlana Zakharova, was charged with grand larceny by extortion, and accused of trying to shake down Spitzer following allegations that he attacked her at The Plaza Hotel. The disgraced governor denied the allegations at the time. Details about the alleged extortion attempt were unavailable. Travis was also charged with second-degree forgery in a separate case in which police said she used the information of a Bloomfield, New Jersey, man to sign a lease agreement that cost him $18,000. Travis had known

Spitzer, 56, “for a period of time” when the two met on Feb. 13 at The Plaza before she planned to return to Russia, his attorney Adam Kaufmann said at the time. “They had a brief and amicable conversation, and then Mr. Spitzer left,” Kaufmann had said in a statement. She later
called and asked him to return and was “highly emotional and was threatening self-harm,” he added. Travis attempted to cancel a 911 call she made saying she cut herself and was having a breakdown in the room the former governor had rented, police said. Kaufmann
confirmed that Travis made the calls and that Spitzer “sought to keep her calm.” The woman was taken to the hospital after police noticed a cut on her arm and broken glass in the room. She told doctors she had a relationship with Spitzer and he had assaulted her, offi-
cials said. She left for Russia the following night. Spitzer wasn’t charged in the incident. Travis is expected to appear Tuesday in Manhattan Criminal Court to face both charges. Bronx District Attorney Darcel Clark is expected to handle to the case as Manhattan District At-
torney Cyrus Vance recused himself from the case in February, citing past personal and professional connections to Spitzer, the New York Daily News reported. There was no information as to whether Travis had obtained a lawyer who could comment on the charges in her behalf.
Man injured in Hoboken train crash is suing NJ Transit for safety failures “Somebody help me,” screamed Sheldon Kest, a passenger in the first car of the NJ Transit Pascack Valley train, after it crashed into Hoboken Station on Sept. 29 at 8:45 a.m. Kest, 66, a Tenafly, New Jersey, resident who has been using the system for 50 years, announced Tuesday that he is suing NJ Transit for its safety failures that led to the Hoboken crash and caused his serious injuries and emotional trauma. He suffered a broken nose, deep flesh wounds and his right middle finger had to be partially amputated. He was also recovering from knee surgery at the time of the crash and his healing has
been compromised. Kest is one of 114 people injured in the crash. There was one fatality, Hoboken resident Fabiola Bittar de Kroon, 34, who was standing on the platform and was killed when the ceiling collapsed. Investigators determined from black box data that the train was going nearly twice the speed limit, 10 mph, for a train entering the station. Yet there has been no additional information about why that happened or what could have prevented it. “I need to know, and the public has the right to know, why did it happen? How did it happen? And who should be held accountable so it doesn’t
happen again?” said Kest at the news conference in Newark called by his attorney Tom Kline. The train went “over the bumper block, right through the depot” and came to a stop at a wall just before the station’s waiting area,” Michael Larson, a NJ Transit employee who was one of the first responders at the crash, told reporters during a CNN broadcast. “I don’t think I’ll be able to board another train. Right now, I’m anxious to even ride in a car. I continue to struggle with horrific memories of this tragedy,” Kest said. He described being trapped in the carriage surrounded by wreckage. “Given my recent knee

surgery, there’s just no way I could have hoisted myself through that window. I don’t know what
would have happened without those guys lifting me up,” he said, adding that he looks forward
to the day he can thank them in person. Kline, along with co-counsel from Andrew Duffy, added that “there is no excuse for operating that train at more than twice the speed restriction entering the station, and there is no excuse for the NJT’s deadly deferral of Positive Train Control that every industry operator, expert and government regulator has known for decades prevents these accidents and saves lives.” The lawsuit is seeking an undisclosed amount for damages related to Kest’s numerous doctor’s bills including plastic and orthopedic surgeons and a neurologist. Mount Sinai Health System announced on Tuesday that Phase 1 of a $500 million project to rebuild Mount Sinai Beth Israel and create the new “Mount Sinai Downtown” network is set to start. Yankee Stadium After a year of speculation, Chipotle will open its first location in the South Bronx by the end of the year, company spokeswoman Danielle Moore confirmed to DNAinfo without giving a specific opening date. The eatery will be located a few blocks from Yankee Stadium at 260 E. 161st St. in The Melrose Building across from the Bronx County Hall of Justice. The addition of Chipotle to the area, which will be housed in the same building as a recently opened Starbucks, will “inch us closer to being recognized as a place that can support more dining options, more eating options,” Cary Goodman of the 161st Street Business Improvement District told DNAinfo.

Trump says ‘shackles’ are off, assails House speaker, McCain GOP nominee condemned the Republicans who have backed away from his White House run in a barrage of stinging tweets, deepening a dramatic rift in the party over his struggling campaign. Presidential candidate Donald Trump lashed out at U.S. House Speaker Paul Ryan and other “disloyal” Republicans on Tuesday and vowed to campaign in whatever style he wants now that the party establishment has largely abandoned him. “It is so nice that the shackles have been taken off me and I can now fight for America the way I want to,” Trump said on Twitter, adding he would engage Democratic rival
Hillary Clinton on his own terms. Describing “disloyal” Republicans as more difficult than Clinton he said, “They come at you from all sides. They don’t know how to win — I will teach them!” A string of Republicans have distanced themselves from Trump since a 2005 video surfaced Friday showing him bragging crudely to a reporter about groping women and making unwanted sexual advances. Ryan, the top Republican in Congress, told party lawmakers Monday he was breaking with Trump and would not campaign for him, all but conceding Clinton would win the Nov. 8 election. The move angered some Trump supporters, although Ryan said he would not withdraw his endorsement of the New York business-
man. Trump slammed Ryan as a “very weak and ineffective leader” and complained in another tweet that it was hard to do well with “zero support” from Ryan and others. He also took aim at Sen. John McCain of Arizona, the Republican presidential nominee in 2008, who said Saturday that he could not vote for Trump. “The very foulmouthed Sen. John McCain begged for my support during his primary (I gave, he won), then dropped me over lockerroom remarks,” Trump said. The U.S. Supreme Court agreed to decide whether to block a lawsuit against former Attorney General John Ashcroft and others by non-U.S. citizens, mainly Muslims, swept up after the Sept. 11 attacks who said they were abused in detention. The senior officials under former President George W. Bush, also including former FBI Director Robert Mueller and Immigration and Naturalization Service Commissioner James Ziglar, have asked the justices to reverse a 2015 lower court ruling allowing the long-running suit to proceed. The civil rights lawsuit seeks to hold the former officials responsible for racial and religious profiling and abuse in detention that the plaintiffs said they endured after being detained following the 2001 attacks by al Qaeda Islamic militants on the United States.
The brief order said two justices, liberals Elena Kagan and Sonia Sotomayor, will not participate, meaning only six justices will hear the case. The court remains one justice short following Antonin Scalia’s February death. The suit was filed by a group of Muslim, Arab and South Asian nonU.S. citizens who, their lawyers said, were held as terrorism suspects based on their race, religion, ethnicity and immigration status and abused in detention before being deported. They were charged only with civil immigration violations. But the plaintiffs said they were subjected at Brooklyn’s Metropolitan Detention Center to 23-hours-a-day solitary confinement, strip searches, sleep deprivation, beatings and other abuses and denied the ability to practice their religion.
They said their rights under the U.S. Constitution to due Mueller process and equal protection under the law were violated. The plaintiffs include Benamar Benatta, an Algerian Muslim who was seeking refugee status in Canada, and Ahmed Khalifa, an Egyptian Muslim who said he was on vacation. During the U.S. Justice Department’s massive investigation after the 2001 attacks, certain immigrants in the country illegally were detained until being cleared of Sept. 11 involvement. The New York-based 2nd U.S. Circuit Court of Appeals ruled that Ashcroft, Mueller and Ziglar could be sued, based on a 1971 Supreme Court ruling. REUTERS

Anguished worshippers carried the bodies of dead and wounded people from the iconic building, which is covered in brilliant blue tiles. Initial reports put the number of attackers at three, but Sediqqi said police special forces who responded to the scene found and killed only one gunman. The attacker was dressed in a police uniform, said Jamshid Jan, who witnessed the attack. An angry crowd surrounded and kicked at the suspected attacker’s dead body, with some vowing to burn his remains, before police intervened. Security forces at the scene evacuated the shrine as the attack unfolded, said Kabul police chief Abdul Rahman Rahimi.
The attack occurred at one of Kabul’s largest shrines as Shi’ite Muslims gathered to observe the Ashura holy day, which commemorates the 7th century death of a grandson of the prophet Mohammed. There was no immediate claim of responsibility. A Taliban spokesman denied any involvement. Afghanistan’s chief executive, Abdullah Abdullah, condemned the shooting and vowed to “hold terrorists (and) their supporters accountable.” Afghanistan has largely avoided widespread sectarian violence between Sunni and Shi’ite Muslims, but Afghanistan’s Shi’ite minority has complained of discrimination and has faced increased threats. At least 84 people were killed and another 130 injured in a suicide attack on a Shi’ite demonstration in July. That attack, during a protest march in Kabul, was claimed by Islamic State. BRIEF Top court grapples with AppleSamsung iPhone patent feud The Supreme Court signaled a willingness to reduce the potentially huge penalties imposed for ripping off a patented design as it heard arguments in the legal fight over the amount Samsung should pay Apple for copying the iPhone’s distinctive appearance. The eight justices heard arguments by lawyers for the world’s two top smartphone manufacturers, as well as the
U.S. government, in Samsung’s challenge to the $399 million it was forced to pay Apple for violating three patents regarding the iPhone’s rounded-corner front face, bezel and colorful grid of icons. Some of the justices expressed deep skepticism over how, in practice, juries could figure out which part of a product a design applies to, in order to calculate damages for patent infringement.
“If I were a juror, I wouldn’t know what to do,” Justice Anthony Kennedy said. Smartphones like Cupertino, California-based Apple’s iPhone and South Korea-based Samsung Electronics Co. Ltd.’s Galaxy have become an indispensable part of everyday life for many people worldwide, as well as huge business for their makers. As such, the two companies have become increasingly bitter rivals as Samsung seizes an enviable
share of the market. The case came before the Supreme Court on same day Samsung scrapped its flagship Galaxy Note 7 smartphone following reports of the phones catching fire in one of the costliest product safety failures in tech history. The device, launched in August, was supposed to have competed with Apple’s latest iPhone for supremacy in the smartphone market. REUTERS

Wireless carrier Sprint Corp. on Tuesday pledged to provide 1 million high school students with free mobile devices and internet access as part of a White House initiative to expand opportunities for lower income kids. Marcelo Claure, chief executive of Sprint, said the plan builds on the company’s prior commitment through the White House’s ConnectED program to get 50,000 students high speed internet. He said Sprint realized that while providing students with internet at school was helpful, students would still need to be able to use the internet at home. “We are going to equip 1 million kids with the tools they need to reach their full potential and achieve their dreams,” Claure told reporters on a White House call. President Barack Obama will travel to
Greensboro, North Carolina, on Tuesday to participate in a town hall on race and sports and to highlight the administration’s work to improve the lives of disadvantaged youth through its My Brother’s Keeper initiative and other programs. Sprint aims to give cellphones, tablets, laptops or mobile hot spots to students who do not have internet at home. Students would be able to choose the type of device that might meet their needs and it would be coupled with four years of free data plans. The company hopes to reach its goal of a million students in five years. Manufacturers have agreed to provide the mobile devices at no cost, Claure said. He also said the company would encourage customers to donate their old devices to the program and that it would not cost Sprint much to allow the free use of its network. “I think we are working to address a huge problem that we have in our country which is the digital divide and the homework gap,” Claure said. “Most people would assume internet is a given for everyone in the United States and that’s the way it should be, but it’s not.” He said children in more than 5 million U.S. households today lack internet connection at home. Obama says work has begun on habitats to help humans reach Mars President Barack Obama, highlighting his pledge to send people to Mars by the 2030s, on Tuesday announced further publicprivate efforts to build habitats that could help humans live long-term far from the Earth. â&#x20AC;&#x153;We are working with our commercial partners to build new habitats that can sustain and transport astronauts on longduration missions in deep space. These missions will teach us how humans can live far from Earth â&#x20AC;&#x201D; something weâ&#x20AC;&#x2122;ll need for the long journey to Mars,â&#x20AC;? Obama said in an opinion piece on CNNâ&#x20AC;&#x2122;s website. His comments come ahead of a meeting planned by the White House in Pittsburgh this week to team up scientists, students and others to advance the commercial space market,
travel to Mars, Earthâ&#x20AC;&#x2122;s neighbor some 35 million miles away. Like Earth, the so-called Red Planet also has seasons, and a 2012 National Aeronautics and Space Administration (NASA) mission found conditions there once supported microbial life, according to the space agency. It would take about eight months to get there, depending on rocket velocity, according to NASA experts. Efforts to fund the space program have faltered in recent years over concerns about fiscal priorities. Carson Daly fills in for suspended Billy Bush on “Today” Show It’s been a rough few days for Billy Bush. The TV host’s job is on the line after a video was release last week revealing Bush engaging in a sleazy conversation with Republican presidential nominee Donald Trump. In the footage, which was recorded as the two prepared to film a 2005 episode of “Access Hollywood,” Trump made several lewd remarks about women, and Bush egged him on. Kesha files protective order to prevent Dr. Luke from publicizing her medical records Kesha was forced to submit over 900 pages of court-ordered medical documents in the ongoing legal proceedings between herself and Dr. Luke, the producer she accused of sexually, physically and emotionally abusing her in 2014. On Monday, the 29-year-old singer filed a protective order against Dr. Luke to keep the information in those documents — which include “gynecological, psychiatric and rehabilitation records going back more than 10 years” — confidential, according to E! News. Dr.
Luke has rejected the confidentiality request and claims he has a right to use the medical information “without condition.” This is a messy case that has involved lawsuits in multiple states and coming from both sides.
Dr. Luke has vehemently denied all of the allegations made against him, and worked with Sony to force Kesha to continue to work with him under the terms of her contract. We’re side-eyeing him, hard.

The obsession with exploring New York City started with a game called â&#x20AC;&#x153;Last Stop.â&#x20AC;? Beginning at age 9, William B. Helmreich and his father would hop on a random subway line and ride it until the very end, where they would get off to walk around for a while. â&#x20AC;&#x153;We did this for years,â&#x20AC;? says Helmreich, now a professor of sociology at City College of New York. â&#x20AC;&#x153;Once we ran out of last stops, we went to the second-to-last stop, and then the third-to-last stop, and so on.â&#x20AC;? Helmreich continues to spend his free time exploring the city, block by block, with no clear destination. He affectionately calls it â&#x20AC;&#x153;the worldâ&#x20AC;&#x2122;s largest outdoor museumâ&#x20AC;? and is writing a walking guide to each borough. First up is â&#x20AC;&#x153;The Brooklyn Nobody Knows,â&#x20AC;? out this week, for which Helmreich walked all of Brooklynâ&#x20AC;&#x2122;s 44 neighborhoods â&#x20AC;&#x201D; a total of 816 miles, guided by strangers along the way and his own unrelenting curiosity. Before he was in Hollywood movies, the Venezuelan actor was a journalist, and spent much of his life traveling the globe with his father, a soldier. When he started appearing in films, like â&#x20AC;&#x153;Domino,â&#x20AC;? â&#x20AC;&#x153;Zero Dark Thirty,â&#x20AC;? â&#x20AC;&#x153;Joyâ&#x20AC;? and especially â&#x20AC;&#x153;Carlos,â&#x20AC;? he
always did so because he connected with them on a deep level. As such, he sees a lot in â&#x20AC;&#x153;The Girl in the

Train,â&#x20AC;? the splashy film version of Paula Hawkinsâ&#x20AC;&#x2122; mega-best seller about a lonely woman (Emily Blunt) who gets involved in the case of a missing woman (Haley Bennett). Ramirez, 39, has a small role in the film: He plays the therapist to the AWOL girl, who becomes one of the possible suspects. Emily Bluntâ&#x20AC;&#x2122;s character is prone to stalking and spying, which is something that technology has made easier. But Iâ&#x20AC;&#x2122;d argue social media can create real connections, as well as fake ones. I donâ&#x20AC;&#x2122;t see technology as a threat. First of all, itâ&#x20AC;&#x2122;s inevitable. I remember people being afraid of cellphones in the â&#x20AC;&#x2122;90s. I remember my first years of college, when some of my classmates bought phones, they were ostracized. They were laughed at and bullied. Then two years later everyone had a Nokia. For me, itâ&#x20AC;&#x2122;s nothing but resistance

to change. Because itâ&#x20AC;&#x2122;s frightening â&#x20AC;&#x201D; change is terrifying. Youâ&#x20AC;&#x2122;re leaving your comfort zone. Where social media is going to take us has yet to be seen. Weâ&#x20AC;&#x2122;re only seeing the beginning of it. Right now, itâ&#x20AC;&#x2122;s a doubleedged sword. It can be helpful but also activate our worst instincts. Thereâ&#x20AC;&#x2122;s this fake assumption that everything that is trending will necessarily have an impact and change things. When a social event is trending, the reality is: so are cats. Itâ&#x20AC;&#x2122;s not access to technology that changes things; itâ&#x20AC;&#x2122;s how you use that technology. You still need to do the groundwork of getting your hands dirty to achieve change. Before social media, when you knew about something, it was probably because progress was already happening. Now, knowing about something doesnâ&#x20AC;&#x2122;t necessarily mean progress is taking place.

Uproariously funny comedian Iliza Shlesinger is back on Netflix with her latest comedy special, “Confirmed Kills,” covering everything from the black hole of a woman’s purse to finally putting an end to our obsession with mermaids. This time around, however, the 33-year-old star is more than funny voices and side-splitting humor. Shlesinger aims to use her platform to drive meaningful conversations with her audience, too. She chatted with us from her home in Los Angeles about her career beginnings and using comedy

to help women. When did you decide you wanted to do comedy professionally? I always knew I was going to be funny for a living. Growing up in the suburbs of Dallas, I didn’t have access to comedy clubs, but I think I just got it where I could. I’d
take in a lot of TV, a lot of sitcoms, a lot of sketch shows and then you find other like minded kids and you form an improv troupe. I knew I was going to be funny for a living but I didn’t know what that was going to look like. You add a lot of physical-

ity to your comedy. What inspires it? It’s sort of baked into our brains as Americans. We know bad guys flinch over, witches have creepy teeth and bony fingers. My body naturally forms to the idea of a cartoon I have in my mind and it comes out onstage and helps get the point across.
What makes “Confirmed Kills” different from your last Netflix special, “Freezing Hot”? When I finished “Freezing Hot,” I remember feeling like I didn’t get out everything I wanted to say and that I was moving toward saying something more uplifting versus just making fun of girls. There was this fire that got lit in me where I was like, ‘If I keep just making fun of girls and we’re all laughing at ourselves, eventually I might become part of the problem.’ I found myself wanting to help women by defending them and say, ‘Here’s why we think the way we do and here’s why the world is scary to us.’ But do it in a way that girls had fun and men
didn’t feel alienated. You dived deeper into issues facing women on this one. Here’s what’s tough. I’m a white girl from an upper middle class family and I’ve never been overweight so I can’t stand there like, ‘Life is great. Love your body. F— the haters.’ That’s not the reality for most, but just because I seem one way to you doesn’t mean I don’t have my own things that I’ve battled. I’ve been put down for having opinions. I’ve been called names because I’m a girl or because I’m Jewish or for whatever reason. My whole life I’ve just had this thing in me where I’ve never had a reason to listen when somebody tells me to be quiet. “Confirmed Kills” is now available for streaming on Netflix.

Andy Grammer says he and Gavin DeGraw are on a “bromance of a tour.” “I remember being a huge fan of ‘Chariot’ during the end of my first year in college,” he says. “I love that record. And I’m not just a big fan, we’re really good friends, too. Our bands are really tight; some of his band members played with me for a while, and vice versa.” Following up on “Fine By Me” and “Keep Your Head Up,” the singersongwriter’s 2014 sophomore album, “Magazines
or Novels,” featured the triple-platinum, temptation-thwarting toe-tapper, “Honey, I’m Good.” Now Grammer, 32, is promoting “Fresh Eyes,” another effervescent feel-good single about finding new reasons to love the ones we love. He called in from the bus between Nashville and Ohio to discuss his upcoming third album, his songwriting process and why he’s cool with his love-positive lyrics. How far along are you with the third album? It’s definitely hard to say, but writingwise, I’m in the third quarter. I like to write about 100 songs. I’m coming up around 75. That’s a lot of songs. for my last album, and “Honey I’m Good” was the 101st song I wrote. So I guess I don’t want to stop just yet. [Laughs] Do you ever go back to those other 80 or 90 songs that didn’t make the cut? Sometimes you reuse them, but usually you’ve
just done better than them and that’s what makes the album. My analogy is when you see a movie with the most amazing chase scene, but the rest of the story isn’t the best. That’s kind of what those songs are. It’s like a Jason Bourne movie.

Totally. The thing about art is that when it’s done right, it’s kind of effortless. Sometimes you write things that are effortless when they come out, but you have to painstakingly go through 20 or more to get to that one. They also say, with art, you can’t say whether it’s good or bad, and I think that’s kind of not true. When I was a street performer sometimes people stopped and sometimes people didn’t stop. There’s a science to it. You have it or you don’t. Do you think your time busking plays a role in your life as an artist now? I think it does do a little bit for me — knowing that you either provide a service for someone or not. When I was performing on the street, I could feel the moments where there’s a service being done and someone is giving their attention versus [when] you’re just giving

to their ears. One of the two are happening. So “Fresh Eyes” is the single from the forthcoming album that’s out right now, and it’s about reinforcing an already existing relationship. How did that angle come about? When you’re in a relationship for a longer period of time, you have to rediscover a person. It just happens in every good relationship. There are those moments when you’re like, “Oh shoot, I don’t fully know you,” and that makes it so much more fully interesting. You’ve sort of become the poster child for healthy, happy relationships. I guess, but it’s funny though. You look at Adam Levine, who can have a bunch of hits about tortured love. Why can’t I just have ones about solid love?

Forget confusing gadgets and robotic accessories. The “smart house” that’s changing the way homes are built is one that’s energy efficient. Called “passive homes,” these spaces utilize solar panels, ondemand hot water heaters, superinsulation and moisture barriers to cut their energy use, and cutting your monthly utility bills drastically. Building and Remodelers Association of Greater Boston member Nick Falkoff is constructing a 4,500-square-foot luxury passive home in Wayland, Massachusetts. “Passive housing has been operational in Europe for over 25 years, and is becoming a serious consideration for people concerned about climate change, energy conservation and health in the U.S.,” says Falkoff, whose project, which will be completed in November, will feature an open con-
cept layout, vaulted ceilings, oversized windows and seamless door frames. First coined in Germany in 1991, a passive house doesn’t require a hot water heater to keep showers and faucets producing piping hot water. Instead, necessities like hot water are available
“on demand.” Instead of holding hot water in the pipes, an on-demand or “tankless” hot water heater doesn’t turn on until you turn the faucet. The system pulls cold water through a pipe to a heating unit, and sends it to the tap or shower. Plummeting heating and cooling bills is the biggest incentive for those considering building a passive home. With triple pane windows and double insulation, the home is keeping cold air out in the winter and constantly pumping fresh air in during the warm weather. Building one is still an expensive task, but advocates say the benefits outweigh the costs. “There is a difference in cost building a passive house, but the difference is typically offset by the return on investment,” says Falkoff. “Many factors need to be taken into consideration when determining savings to the consumer, one of the least discussed benefits are health. Living in an environment where the air is always fresh and dust-free adds a level of benefit that is difficult to measure.”

The scene was the media conference room inside the Madison Square Garden Training Facility in suburban Greenburgh At the podium was Rangers head man Alain Vigneault, answering questions on the first day of training camp about the 2016-17 New York Rangers. Like all executives, coaches and players, Vigneault was optimistic about his team. “I can feel the energy, I feel a refreshed group.” Vigneault said. “We still believe that we’re a very strong hockey team. We’ve got some very good experience — some guys that have played big games, important games, big minutes. We’ve got some younger guys who are developing who are improving. Now that we’re adding younger guys, we’ve got a couple role players who can help us. I see good speed, which is something that I like. I like to play a fast, high tempo game. Even at 34, Lundqvist compiled a 2.48
goals against average and .920 save percentage despite having faced more shots (1,944 according to NHL.com) and more high danger shots (397 according to analytical website Corsica.hockey) than any goalie in 2015-16. For as strong as the forwards and Lundqvist are, the defense — which had long been an organizational strength — is a significant question. Without Yandle and the retired Dan Boyle, the blue line lacks a puck moving, offensive defenseman. Both Dan Girardi and Marc Staal will return despite each having a subpar 2015-16. And the quartet of Adam Clendening, Brady Skjei, Nick Holden and Dylan McIlrath spent the preseason battling for the fifth, sixth, seventh and eighth defensemen slots. Vigneault was asked about having Clendening and Holden play on their off-hand. Vigneault favors having his defensemen play on their strong side. “We could have had three left-handed defensemen and three right handed defensemen,” he said. “We were just looking at different options we could have going forward in terms of sixth, seventh, eighth defensemen. It was something we thought we needed to see.”
Jets’ ‘O’ needs to give Marshall help Following Sunday’s disappointing showing in Pittsburgh, the Jets seemingly have holes all along the dam. What was once a competitive outing, with the Jets taking a slight 13-7 lead with 2:06 remaining in the first half, eventually turned into a runaway 31-13 defeat. So far, there hasn’t been anyone out there to pick up the slack for Brandon Marshall, who amazingly has still found a way to be successful despite the extra attention shown his way. The Jets are undermanned and have been out-executed — and Sunday was a prime example. Pittsburgh put on a clinic of long scoring drives, with four going at least 75
yards. Meanwhile, New York was shy at matching the Steelers’ bravado. The Jets punted twice in the fourth quarter while down 11, once on fourth-and-1 at its own 34-yard line, and again on fourth-and-2 near midfield. Bowles said even in hindsight, he felt both decisions warranted caution — despite no earlier proof that the Jets’ defense had any answer for the Steelers. The evidence was the 12-play, 79-yard drive following the second white flag that iced the win for the home team. Bowles can be flippant when saying that “time travel doesn’t work in life,” when discussing controversial decisions and missed opportuni-
ties, but he should be very concerned that his offense seems to stay behind in the locker room after halftime. During the four losses, the offense has mustered a total of 13 points after the break. They’ve been blanked by both the Steelers and Chiefs in the second halves, scored just six points against the Bengals in the opener, and just seven against the Seahawks. That’s an average of barely more than a field goal scored per game in the second half. Bowles insists the offense seems to improve and have “good practices” during the week leading up to the games. The problem, he deemed, is
that for whatever reason guys haven’t been able to “transfer that to Sundays” — although the head man wouldn’t use miscommunication as a reason. Regardless, it’s a nagging problem that’s aided in the Jets’ current standing, and one that seems to dig them a deeper hole each week. Gailey, though, alluded to some lapses in communication which has caused the offensive lapses. “As I have said, this is a we thing, and some can be pinned on me. Communication is the key for us all to be on the same page all of the time,” Gailey reasoned. “We all have got to be on the same page and do a Brandon Marshall hasn’t received much help this season.
